SUBJECT: City Hall Change Order for Cedar Shakes
Gene Lange and Jann Blesener and I met with the
architects and general contractor to discuss replacing the
cedar shingles in the specifications with split cedar shakes.
Joseph Construction has indicated that such a change order
would be in the amount of $4,676. This is an additional
$3,876 for the shakes, and an $800 fee for cancellation of
Joseph's existing contract with a roofing supplier. The
building requires 147 squares.
I realize that all of you quickly came to the concensus
last Tuesday that you wanted the cedar shakes. However, I
would recommend that we take a little time to reflect and
think about this. The architects feel very strongly that
cedar shakes are going to change the image of the building,
and they believe that the smoother cedar shingle look is more
in keeping with the rest of the structure. Cedar shakes, in
their opinion, would give it more of a "rustic" look.
We have a couple of suggestions as to where you might
want to look at shingles versus shakes over the weekend.
If you go into the new Park Place development on the
south entrance to Park Place Drive, there are two houses on
the' south side of the street side by side. The first, at the
corner of Park Place and Boardwalk cul-de-sac, has cedar
shingles. The next house around the circle has cedar shakes.
Please remember, however, that the roofs on these houses are
at a much steeper pitch than the city hall roof, so you will
need to stand up close to get a perspective on what the
relative roofing materials would look like on our building.
If you are up to a longer drive, there are some
buildings on West 78th Street that have both types of roofing
materials at pitches almost exactly the same as on the city
hall. These are the Pond Wood and Dewey Hill townhouse
projects along West 78th. Take 494 to the Bush Lake Road
East exit, go north one block, then west on West 78th. The
first set of townhouses has the shakes, and the townhomes
about two blocks further have the shingles.
This item will be added to Tuesday evening's agenda, and
architect Bob Pierce will be present for the discussion.

RESOLUTION NO. 88-18
RESOLUTION PROCLAIMING MAY 4, 1988 AS CITIES DAY
IN MENDOTA HEIGHTS
WHEREAS, some 8,400 people make their home in the City of
Mendota Heights; and
WHEREAS, cities are a grass roots governmental system,
providing a close relationship between elected officials
and the citizens they serve; and
WHEREAS, cities provide basic services necessary to the
health, safety, comfort, and well-being their residents;
and
WHEREAS, the Mendota Heights City Council is assisted in this
important job by numerous citizen volunteers and
dedicated city employees, all with a strong sense of
public service; and
WHEREAS, Governor Rudy Perpich has proclaimed the first week
of May as MINNESOTA CITIES WEEK.
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of
the City of Mendota Heights that May 4, 1988 is
designated as Cities Day in Mendota Heights, for the
purpose of recognizing the contributions of the city
government and the.people associated with it to the
quality of life enjoyed,in the community.
BE IT FURTHER RESOLVED that all citizens are urged to take
this opportunity to learn more about their city
government, and to participate in festivities to be held
on May 4 at 1:00 p.m. at the site of the new City Hall.
Adopted by the City Council of the City of Mendota Heights

Minutes of the Pre -Council Meeting
Held Tuesday, April 5, 1988
Pursuant to due call and notice thereof, the pre -Council
meeting of the Mendota Heights City Council was held on April
5, 1988, in Room 214, City Hall, 750 South Plaza Drive, to
discuss airport noise.
A pre -Council workshop was convened at 6:45 P.M. The
following members were present: Mayor Mertensotto,
Councilmembers Cummins, Hartmann, and Witt. Councilmember
Blesener had notified the Council that she would be unable to
attend. Also present were City Administrator Kevin Frazell,
MASAC Representative Bernie Friel, and•Larry Shaughnessy.
Councilmember Cummins indicated that he had proposed one
solution at the joint meeting with the Eagan City Council the
previous week,, but doesn't feel that we should be obligated
to stick with -an artificial southern boundary that protects
Eagan, but causes worse problems over Mendota Heights.
MASAC representative Friel said that historically, the
southern boundary had been "backed into". There was an
agreement many years ago to make a slight left turn off 11R
at a time when there was not much simultaneous takeoff
traffic from Mpls/St. Paul Airport. As a result, the
Timberline neighborhood had been designated as a no flyover
area. Consequently, when the traffic volume grew, much more
traffic started moving to the north.
Councilmember Hartmann said that he thought the required
15 degrees separation on the runways could best be achieved
by an approximate 7 1/2 degree departure turn on each side.

Councilmember Cummins suggested a three point program
1. No turns before the end of the runway.
2. On single takeoffs, no turns from 11L until the
plane had passed a localizer on the east side of the
Minnesota River.
3. A departure heading from 11R of five degrees south
of centerline, and from 11L of ten degrees north of
centerline.
Cummins said he felt that this solution more accurately

reflected the residential development in the two communities,
and that was more important than maintaining a historical
boundary that no longer had any validity.
MASAC representative Friel said he agreed with City
Administrator Frazell's written suggestion that the issue be
revisited periodically, to determine whether it is satisfying
the objectives of the two cities.
Mayor Mertensotto said that he would like to provide a
public information and input session at the Council meeting
of April 19..
It was discussed that in taking an official city
position, those Voints where Mendota Heights and Eagan agree
should be emphasized.
MASAC representative Friel suggested that MASAC be asked
to take up consideration of the matter at its June meeting.

Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota
Heights, was held at 7:30 o'clock P.M. at City Hall, 750 South Plaza Drive, Mendota Heights,
Minnesota.
Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following members were
present: Mayor Mertensotto, Councilmembers Cummins, Hartmann and Witt. Councilmember
Blesener had notified the Council that she would be out of town.

Public Works Director Danielson reviewed the application for
vacating a portion of Pagel Road. He stated that the platted
extension of Pagel ends at the wetlands, and that since it is a
federally protected wetlands it would very difficult to extend the
right-of-way across the wetland area.
With respect to the wetlands permit application, Mr. Danielson
stated that there are 24 lots which are proposed for homes
within 100 feet of wetlands. He noted that it is a very difficult
Eof property to develop with 100 foot setbacks on all lots
because of the terrain and other constraints. Mr. Danielson
informed Council that staff has looked at all of the 24 lots
proposed for wetlands permits in conjunction with the City
Planner, and that staff recommends granting of the permits.
Mayor Mertensotto asked for questions and comments with
respect to the vacation.
Mr. James Losleben, 815 Hazel Court, stated that he is in favor
of the right-of-way vacation, however he was concerned over
existing drainage problems in his neighborhood and hopes that

system from the development when it is installed.
Mr. Fred Haas, from Marvin Anderson Homes, stated that
several changes have been made in the preliminary plat since
the last Council discussion. He reviewed the changes, which
included shortening the Havenview Court and Bridgeview Court
cul-de-sacs, providing a pathway along Pondhaven Lane and
Westview Terrace, an increase in the setback fromthe pond for
lots 8 and 9 located at the end of Havenview Court, inclusion of
an outlot from the end of Bridgeview Court to the school district
property to provide pathway access to the school district
property so that a pathway can be provided along the school
property to Friendly Hills, and other modifications.
Mr. Haas stated that he has done as much as is possible in
moving the streets to increase setbacks from the wetlands and
that the average setback for the 24 lots needing wetlands
permits is 74 to 75 feet. He stated that in the design of the
homes for those lots it might be possible to change the
configuration or style of the homes to increase the setbacks. Mr.
Haas stated that he has spoken with Police Chief Delmont
regarding his concern that there is no connection from the north
part of the plat to the south part and that the footbridge
connecting the two areas can be provided at a 10 foot width for
emergency vehicle access if the City so desires. Mr. Haas
informed Council that the average lot size in the development is
20,000 square feet above water and that all basements near the
wetlands areas will be 8 feet above the high water mark and will
be walk outs.
Public Works Director Danielson pointed out that all of the
ponds will have overflow devices.
Mr. Haas informed Council that his firm could make a channel
between the two westerly ponds, or make them into one pond, in
the future, whatever is most desireable to the nei.&hborhood
north of his development. Responding to a question from
Councilmember Witt, Mr. Haas state& that Bridgeview Court is
a permanent cul-de-sac located entirely within the plat, as
opposed to the original concept of a temporary cul-de-sac on the
school district property.
Councilmember Witt stated that she feels that the bridge should
be narrow in order to discourage motorized traffic.
Councilmember Hartmann agreed that the bridge should be
narrow enough to encourage only pedestrian traffic.
Mayor Mertensotto asked City Planner to give his comments on
the proposed development.
Planner Dahlgren stated that at the request of Council he had
met with the developer, School District representatives and City
staff to make any desirable improvements to the plat.

He stated that one result of the discussion was that the
temporary cul-de-sac proposed to be located on the school
property was pulled back onto the plat area because the School
District must have a minimum of thirty acres on which to
construct a school in the future. Mr. Dahlgren addressed all of
the changes made in the proposed plat and also informed
Council that, at the request of Bernard Friel, Mr. Haas has
consented to providing right-of-way (Outlot D) along the
northern property line to provide access to any future
development of the Friel property.
Councilmember Cummins expressed concern over the number
and size of the wetlands setbacks, and felt that the developer
could provide a better plat by eliminating some of the lots in
order to increase the wetlands setbacks. Councilmember
Cummins also asked for assurance that Outlot C is wide enough
to make it a comfortable situation for the homes along side of
the walkway. He also asked whether scenic easements will be
provided around the ponds.
Mr. Haas stated that there will be a fifteen foot scenic easement
around all of the water areas.
Mayor Mertensotto asked for questions and comments from the
audience.
Mrs. Mary Jane Sonnek, 2395 Pagel Road, asked whether her
neighborhood will be assessed for overflow control on the
ponds.
Mr. Losleben spoke in favor of the proposed plat and stated that
he believes it is an excellent proposal except for the 10 foot
bridge. He felt that the bridge should be narrow enough to
provide for only pedestrians so that motorized vehicles will be
discouraged from using it, particularly at night.
Mr. Bernard Friel stated that he has met with Mr. Haas and that
while he shares some of Councilmember Cummins' concerns
over setbacks, it must be concluded on balance that the
developers have done a good job and the wetlands permits are a
good tradeoff.
Mr. David Epstein, 752 Mohican, stated that he is here because
of his concern over the ipotential connection of Mohican Court.
He asked what possibility there is that Mohican might be
connected in the future.
Mr. Dahlgren stated that it is physicall possible that Mohican
could be connected through the school property if that property
develops residentially. Ms. Lois Rockney, from the School
District, stated that the district has no intention to sell the
property and will retain it for a future school.

There being no further questions or comments, Councilmember
Hartmann moved that the hearing be closed at 8:37 p.m.

RESOLUTION APPROVING VACATION OF A STREET
RIGHT-OF-WAY," for that portion of the Pagel Road right-of-

plat for Bridgeview Shores as presented this evening.

preliminary plat dated March 18, 1988.

BUILDING PERMIT
Mr. Fred Haas stated that his company hopes

to get started on a model home as soon as possible in order to
be ready for the Parade of Homes and asked for Council
approval for staff to issue a building permit for Bridgeview
Shores in advance of final plat approval.
Mayor Mertensotto stated that while the builder would have to
Flproceed at his own risk, there has been precedent to issue
permits.
Councilmember Hartmann cautioned Mr. Haas to work with the
City's engineering and code enforcement departments to make
sure that proper setbacks and other requirements are
achieved.
Councilmember Witt moved to grant a building permit to
construct a model home on Lot 3, Block 3 of the preliminary
plat of the Bridgeview Shores addition.
Councilmember Hartmann seconded the motion.

SCHOOL DISTRICT
Ms. Lois Rockney, from School District 197,
MAINTENANCE FACILITY
was present to request approval of a building permit for
construction of a transportation maintenance facility on
Medallion Drive, just west of the City's public works garage.

Mayor Mertensotto related Councilmember Blesener's concerns
over the various exterior colors proposed to be used on the
building, and asked Ms. Rockney if the District could address
the issue.
Responding to questions from Councilmember Witt, Mr. Doug
Ramer, from Ellerbe Architects, stated that parking for 50
school buses will be provided outside of the building and that 6'
high chain link fence will be installed around the lot, that there
will be plantings around the north side and there will also be
berming.
After brief discussion, Councilmember Cummins moved to
approve the issuance of a building permit subject to exterior
color review by Ci staff.
Councilmember Witt seconded the motion.

FOTOMARK BUILDING Council acknowledged a report from Code Enforcement Officer
Berg regarding a request for building permit from Foto Mark for
a proposed addition to their facility at 2411 Pilot Knob Road.
Mayor Mertensotto asked whether all issues regarding dyes and
chemicals have been addressed so that there is no dumping of
these materials into the sanitary sewer system. It was Council
consensus that since there was none present to answer
questions on disposal of chemicals, solvents and dyes, no action
should be taken.
After discussion, Councilmember Hartmann moved to table
discussion on the matter to the next meeting.

SIBLEY HEIGHTS Public Works Director Danielson briefly reviewed the plans and
specifications for public improvements to serve the Sibley
Heights Addition.
Councilmember Hartmann moved adoption of Resolution No.
88-17, "RESOLUTION APPROVING FINAL PLANS AND
SPECIFICATIONS AND AUTHORIZING
ADVERTISEMENT FOR BIDS FOR IMPROVEMENTS TO
SERVE SIBLEY HEIGHTS ADDITION (IMPROVEMENT
NO. 87, PROJECT NO. 5)," bids to be received on May 2nd.

LCS APPEAL Council acknowledged that the LCS company has asked that its
Fire Code appeal be deleted from the agenda.

FLIGHT CORRIDOR Mayor Mertensotto informed the audience on Council
discussion at the scheduled pre -Council meeting on the
Eagan/Mendota Heights aircraft flight corridor and stated that
a formal presentation and discussion on the issue will be placed
on the April 19th agenda.
COMMERCIAL MARKET Council acknowledged and discussed a memo from
STUDY the City Administrator relative to receipt of proposals for a
commercial market study.
Mayor Mertensotto suggested that Paster Enterprises be
contacted relative to interest in cost participation and that the
consultants who submitted proposals be invited to attend a
Council meeting to see how costs can be reduced and how the
project can be scaled back.
In response to the discussion, Administrator Frazell stated that
he will solicit additional proposals, and contact Paster
Enterprises and other firms in the community regarding cost
participation.
TEAM BUILDING Council acknowledged and discussed a memo from the City
Administrator regarding selection of a facilitator for the
Council/Commission/Staff workshop.
It was Council consensus that Don Salverda be selected as the
facilitator and that the workshop be conducted on June 4th, with

TREE PLANTING PROGRAM Council acknowledged a report from the Public Works
Director re arding bids received for the 1988 tree planting
program. We stated that each of the firms is flexible and will
provide whatever proportion of types of trees the City wants.
Administrator Frazell stated that Councilmember Blesener has
suggested that the program be doubled because of community
interest.
Councilmember Cummins moved to award the tree contract for
the 1988 Boulevard Tree Planting Program to Greenworks, Inc.,
for their low bid of $12,100.

PERSONNEL Councilmember Witt moved that John Schmidt be appointed as
a full-time temporary engineering technician at the rate of $9.00

EASEMENT Councilmember Hartmann moved to approve the acquisition of
permanent and temporary easements over 970 Douglas Road
from Mr. Bevan Marvy for a cost of $3,150, in connection with
Victoria Highlands improvements.
Councilmember Witt seconded the motion.
PARK REFERENDUM Council acknowledged and discussed a memo from
Councilmember Blesener regarding clarification of costs for
recreation area alternatives.
Administrator Frazell explained that using the original Sibley
proposal with a 5% inflation factor from the time of the
proposed 1987 referendum, and deleting the contingency but
adding land acquisition to the proposal, the cost of the complex
development at Sibley would be $1.9 million.
Mr. Bernard Friel stated that as one of those who is concerned,
people keep referring to an alternative that doesn't exist. He
felt that it is entirely counter-productive to make comparisons,
and that for one thing, trail sections have been eliminated
because it makes no sense to install sections that would only be
removed as the result of future highway construction.
Councilmember Witt stated that while she has reservations
about the referendum, Mr. Friel has made a good point -- there
is only one proposal and no alternatives before the Council.
EAGLE RIDGE On the recommendation of the Code Enforcement,
Councilmember Witt moved approval of an adjustment of the
common lot line between Lots 4 and 5, Block 1, Eagle Ridge
Summit Second Addition, as requested by John Van Able and as
described in a survey dated March 31, 1988.
Councilmember Hartmann seconded the motion.

SOLID WASTE Council acknowledged a letter from the Dakota County
Administrator asking that someone be appointed to serve as a
representative of the City on the County s Recycling
Subcommittee.
Staff was directed to place a notice in the local paper to solicit a
resident to serve on the subcommittee.
BOARD OF REVIEW Council acknowledged a memo from the City Clerk as a
reminder of the Board of Review meeting and an associated
memo from the Treasurer regarding increased valuation
percentages.

Minutes of the Annual Board of Review
Held Tuesday, April 12, 1988
Pursuant to due call and notice thereof, the City Council of the City of Mendota Heights
met as the Board of Review at 7:30 o'clock P.M. at the City Hall, 750 South Plaza Drive,
Mendota Heights, Minnesota.
The following members were present: Mayor Mertensotto, Councilmembers Blesener,
Cummins, Hartmann and Witt.
Mayor Mertensotto stated that all property owners have received their assessment notices
from the County Assessor as to the market value of their property for next year's taxes, and
that the Council is meeting as a Board of Review in accordance with statutory
requirements. He informed the audience that it is important that everyone in attendance
sign a roster provided by the Assessor's Office, because attendance at this meeting, or
submission of a letter of appeal prior to the meeting is a prerequisite to appealing tax
assessments before the County Board or Tax Appeals Court.
Mayor Mertensotto turned the meeting over to Assessor Bill Peterson. Mr. Peterson stated
that he would give a brief presentation and then invite those in attendance to meet
individually with the representatives of the Assessor's Office to review their valuations. He
stated that the market values for taxes payable in 1989 were derived based on Mendota
Heightsproperty sales for the period from October, 1986 through September, 1987. He
informed the audience that, by law, the Assessor's Office must place a value of at least 90%
of sale value on all properties and that most values were below 901yo in 1988. For this
reason most values increased for 1989.
Mr. Peterson then answered questions from the audience.
There being no further general questions, recessed the meeting so that the Assessor's staff
could meet with the property owners.
WETLANDS PERMIT Mr. Art Staples was present to request Council approval
of a minor adjustment in his wetlands permit for 727
Spring Creek so that he can proceed with the
construction of his home. Since this was not a regular
meeting, Council could take no formal action, however it
was the consensus that the request will be approved at
the April 19th meeting. The Council directed that the
Code Enforcement Officer place the matter on the April
19th agenda for formal action.
Councilmembers Cummins and Blesener were excused.

PARK &'RECREATION COMMISSION
MINUTES, MARCH 8, 1988
The regular meeting of the Mendota Heights Park and
Recreation Commission was held on Tuesday, March 8, 1988, in
Room 214, City Hall. The following members were present:.
Chairman Stein, Commissioners Huber, Katz, and Leffert. Also
present were MEAA Baseball Commissioner Chuck Mastel, City
Administrator Kevin Frazell, and Grant Engelmann.

RECREATION
Administrator Frazell introduced the
PROGRAM
recreation survey proposed by University
graduate student Doug Peterson (who will be
available at the April meeting for comments
and discussion).
T-BALL/BASE-
Chuck Mastel reported on the structure of T-
BALL/ADULT
ball, which will now become an evening'
SOFTBALL
activity, coached by adult volunteers.
Budget was also presented. Bob Leffert moved
"that the City subsidize the T -ball program
in the amount of $15 per child so that the
fee will be $10 per child + $12 MEAA family
membership". The motion was seconded by
Huber and passed unanimously.
Mastel also mentioned that the size and lack
of enough fields continues to be a problem
for the baseball program. Grant Engelmann,
who will coordinate adult softball, is
setting about organizing the season.
Administrator Frazell said letters are being
sent out to previous team captains. He will
work with Mastel and Engelmann to get the
program going.
TOT LOT/CURLEY Frank Pilney and Jill Mattson were present to
VALLEY VIEW request that Valley View Heights Neighborhood
NEIGHBORHOOD be given a tot lot - repeat of request to
rectify situation that has existed for many
years. The City owns an empty lot which
residents would like to see developed.
Chairman Stein stated that according to needs
study and previous study, Rogers Lake serves
that area and it would be dangerous precedent
to construct and maintain such a lot there,
because many neighborhoods are without such
facilities. Residents urged to deal with Mr.
Curley regarding his property and possibility
of developing tot lot at north end of the
subdivision.
ART IN PARKS It was moved that the Commission adopt the
proposal from ISD #197 Community Education
Program to manage the Art in the Park program
for 5-8 year olds. Motion seconded and
passed.
REFERENDUM Administrator Frazell gave a brief update.
The steering committee has met; P.R. will be
going out to the community. Discussion about
the project followed.
MARIE PARK Marie Park will be cleaned up as a public
CLEANUP service activity by a local Brownie troop.
ADJOURN There being no further business to come
before the Commission, the meeting was
adjourned at 8:55 P.M.

SUBJECT: Wetlands permit for 727 Spring Creek Circle
As an emergency measure the council, by consensus,
granted permission for Art Staples to proceed with
construction of,his house with a moderate shift of location
from what was approved by the initial wetlands permit. (See
attached memo).
Staff would recommend formal action be taken for this
approval. We see no problem with the new location of the
structure. '

SUBJECT: Wetlands Permit for 727 Spring Creek Circle
Mr. Art Staples has previously received a wetlands
permit to place a residential structure within 45 feet of the
creek on the lot at 727 Spring Creek Circle.
Today, when our building inspectors checked the
construction, they found that the location of the house had
been altered slightly from the original -plan. The changes
have been noted by the inspector on the attached site plan.
Mr. Staples' contractor believes that the structure
would be within 40 feet of the wetlands, and they are
requesting a wetlands permit for that amount of setback.
Because of excavation piles on site, our own inspectors were
unable to verify whether or not in fact 40 feet would be
adequate.
The elevation of the basement appears to be still well
above the required three feet above the high water level
stipulated in the wetland ordinance.

We have completed our traffic study at CR 45 (Victoria Road) at
Marie Avenue to determine the appropriate traffic control. The
results of the study indicate that multiway stop signs are not
justified. I have attached a copy of the traffic and accident
data for your information.
Given the lack of reported accidents (2 accidents identified at
this intersection in a 31/2 year time period by the Minnesota
Department of Public Safety) and the low traffic volumes, making
a change in the traffic controls may very well cause a safety,
problem which does not now exist.

HISTORY: In the past it has been the practice of
the City'to follow IRS guidelines for mileage reimbursement.
DISCUSSION: IRS is now allowing 22.54 per mile, the
City is presently allowing 214 per mile.
RECOMMENDATION: That Council authorize the 22.54
allowance.
ACTION REOUIRED: If Council desires to implement
this recommendation they should pass a motion approving
22.54 per mile expense.

This past Winter, the cooperation of the City with the neighborhood
hockey rinks was outstanding. The quality of ice was much improved
over previous years and the timliness of snow removal was very
good. Please express, on behalf of our Hockey Program, our thanks
and appreciation to Mike Maczko and Terry Blum.
Additionally, Grant Engleman was a pleasure to work with. Overall,
the rink attendents were easier to work with and better supervised.

DISCUSSION
Six summer workers were budgeted to help in public works this summer -
one in streets, one in utilities, two in parks and two to maintain fire
hydrants. Steve Kennedy worked in -streets last summer and wants to return,
Mark McKasy worked in utilities and also wants to return. Terry Blum, Park
Foreman, has selected Dan Dalglish and Justin Woods as his helpers and would
like to start them as soon as possible. This leaves the two fire hydrant
maintenance positions remaining to be selected after May 1st (the closing
date we advertised in the City newsletter). We already have 13 applications
but we feel some openings should be left available to give everyone who
wants to apply'before May Ist deadline a chance to be considered.
RECOMMENDATION:
Staff recommends rehiring the two returning workers, the two new
workers as selected by the Parks Foreman and two more to be selected after
May 1st by the Utility Foreman.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion authorizing staff to hire the six summer maintenance workers
as described above.

SUBJECT: Position on Eagan/Mendota Heights Aircraft Flight
Corridor
At the April 5 meeting, Council discussed a tentative
three point plan as its position on the Eagan/Mendota Heights
flight corridor:
1. No turns before the end of the runway.
2. On non -simultaneous departures, no left turn on 11L
until passing a localizer on the east side of the
Minnesota River.
3. On simultaneous departures, planes departing runway
11L should be given a heading no more than 10
degrees north of extended runway centerline, and
those departing on runway 11R no further south than
five degrees south of extended runway centerline.
At Council directive, we have set a public information
time of 7:45 P.M. on the agenda, so that citizens can be
further informed on the issue, and provide their input to
Council. Local media were advised of this discussion, and it
has appeared in several of the local papers.
Staff has obtained a large land use map for the two
cities, with overlays which indicate the potential flight
corridor alternatives. City Treasurer and MASAC Alternate
Larry Shaughnessy will be prepared to give a brief public
discussion of these alternatives.
ACTION REQUIRED:
After appropriate public discussion input, Council
should determine its position on this matter, then direct
staff to draft a resolution for forwarding to MASAC.
MASAC representative Bernie Friel has also suggested
that we ask MASAC to take up the issue at its June meeting.

SUBJECT: Request for Permit
RE: Building Addition to Foto Mark, Inc.
Dear Council Members:
The additional storage room we are requesting to be built is to
be used for storage of flammable liquids. This area will house
Class 1B and Class 1C flammables, which includes solvents, paints and
hazardous wastes. The solvents consist of 8 different types all rated
Class 1B or lower flammability. Examples: Isopropanol Alcohol, Xylene,
Tolulene, etc. The paints are of various types for example: Enamels,
Epoxies; Polyurethanes, etc. All of our paints carry a Class 1C or
lower fire rating.
This area will also be used to store hazardous waste, which consists
of waste solvents, waste paints and waste 1-1-1 Trichlorthane. All of
these materials are non-reactive and are classified as hazardous materials
because of their.flammability. The waste solvents are generated during
manufacturing. The solvents are used to clean painting equipment. The
waste paints are materials which have exceeded their shelf life and are
no longer usable. The waste 1-1-1 Trichlorthane is a vapor degreasing
fluid used to remove foaming and cutting oils from metal parts prior to
our processing and painting.
All of the above material are handled according to the State -and
Federal requirements. All of our wastes are monitored by the State and
County in which we are required to be licensed as a generator.
This building will be inspected prior to use by the Fire Marshall
as to qualify for Group H Division 3 Occupancy.

concerning a geese problem on the club land, and in the

Apparently, the Fish and Wildlife Service will conduct a
geese round -up, but only with permission of the local city
council. Somerset Country Club is requesting your approval.
Dr. Jim Cooper of the Fish and Wildlife Service will be
in attendance at the meeting to answer Council questions.

Dear Mr. Frazell,
I have been visiting with Dr. Jim Cooper of Fish & Wildlife about the
Metro -wide goose problem and pointedly about the ever -worsening problem
we have. He assures me the problem will only get worse. He and the DNR
feel there are two control measures, neither of which make a big impact
on the ever-increasing population of geese. One that the DNR likes the
best is a special hunting situation and the other is a round -up at molting
season and shipping them to a more desireable location. Both of these
procedures require action by the City Council.
My request is that the Council consider a resolution allowing the Fish &
Wildlife to round up geese in Mendota Heights.
Dr. Jim Cooper is willing and available to visit or address the Council
all the way from a full blown slide presentation to a very brief over -view
of the problem.
Could we get on the agenda as soon as possible? If possible we would like
to proceed with a round up yet this year.
Please let me know.

SUBJECT: Cornick Water Extension

INTRODUCTION:
Mr. Mike Cornick, 1176 Sibley Memorial Highway (TH 13) had his well contami-
nated as a result of last summer's "super storm". He requested and the City
approved, allowing him to extend a long water service from the Kingsley Town -
homes. Shortly after his approval two of his neighbors also requested long water
services.

Because of the growing problem,staff felt that a more permanent solution to
supplying water to the residents along Trunk Highway 13 south of Lexington should
be looked at. The costs to install watermain in Trunk Highway 13 will be ex-
tremely high - unaffordable if the City can not find some other funding source in
addition to assessments. It was remembered that there was a large amount of
Community Development Block Grant (CDBG) funding remaining from the Northend
Street project, so we contacted HRA. HRA informed us that Mendota Heights has
approximately $80K available that could be used to help out this project. If the
City decides to assign this money to this project;olcould use an "imminent threat"
program. In this type of program the City needs to establish that there exists a
threat (the County Environmentalist will certify to that) and we need to esta-
blish that there are no other City,funds available to do the work (staff will
confirm that in the feasibility study).
Staff conducted an informal neighborhood meeting on April 6 and all the
neighbors indicated that they were willing to cooperate to help Mr. Cornick and
other neighbors who need it, get water (all residents were concerned that the as-
sessments not exceed what normal assessments would be for watermain).
RECOMMENDATION:
Staff recommends that Council take the steps necessary 'to install a water -
main from Lexington Avenue southwest along Trunk Highway 13 to the Mendota City
limits (see attached map). Costs for the feasibility study would be funded by
the City and merged into an assessment project.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should take
the first step and pass a motion adopting Resolution No. 88- , RESOLUTION
ORDERING THE PREPARATION OF A FEASIBILITY REPORT TO SERVE 1176 SIBLEY MEMORIAL
HIGHWAY AND ADJACENT AREAS. The second step will be to order a public hearing
and discuss the project with the affected neighbors at which time we will decide
whether to.assign our available CDBG money to the project and proceed.

WHEREAS, the City of Mendota Heights deems it necessary for a watermain
extension to serve 1176 Sibley Memorial Highway and adjacent areas.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the City Engineer be and is hereby authorized and dir-
ected to prepare a feasibility study as to whether said proposed im-
provements are feasible, whether said improvements should best be made
as proposed or in connection with some other improvement, and as to the
estimated cost of said improvement.

Mr. Virgil McQuay, 976 Kay Avenue has forwarded the attached letter
requesting City assistance in getting the State to construct a noise wall by
his home located at I -35E and Trunk Highway 110 (see map).
I called Mr. Larry Erb, Noise and Air Quality Engineer for Mn/DOT
District 9, and he informs me that the chances of the State funding a noise
wall at this location are rather remote. Mr. McQuay says that when the
State acquired right-of-way from him for I -35E, they made some commitments
about attenuating noise. Mr. Erb states that if Mr. McQuay can produce
evidence of these commitments he would have a much better case in forcing
Mn/DOT to construct a noise wall. Mr. McQuay has not been able to locate
any written evidence (the deal was made many years ago), however, Harold
Levander, Mr. McQuay's attorney at the time, is still searching his files.
Mr. McQuay will be present at the Council meeting to discuss his request.
ACTION REQUIRED:
Discuss the problem with Mr. McQuay and if Council desires to support
his request, I have attached a sample Resolution that could be adopted.

RESOLUTION REQUESTING MN/DOT TO CONSTRUCT A NOISE
WALL ALONG I -35E
WHEREAS, neighbors living in the Northwest quadrant of I -35E and Trunk
Highway 110 are experiencing noise pollution from the Interstate in Mendota
Heights; and
WHEREAS, that portion of I -35E was built before the environmental
protection act so no noise walls were installed; and
WHEREAS, that a neighborhood resident reports to the City Council that
representations were made to him at the time right-of-way was acquired for
I -35E that noise abatement measures would be taken.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of
Mendota Heights requests that the State of Minnesota Department of Transpor-
tation construct a noise wall to attenuate highway noise from residents
living in the northwest quadrant of I -35E and Trunk Highway 110.
Adopted by the City Council of the City of Mendota Heights this 19th day of

State Highway Dept requesting that a sound barr er be erected on the "JorthEast
corner of Iiwy 35E and 11wy 110 immediately next to Victoria !toad. I have talked to several
neighbors and they all want relief from the incessant noise of the new highway.
I called the state highway Engineer and talked to the Mendota lieights Engineer
last fall and the Mendota heights Engineer was to take acfon before the Council.

SUBJECT: Request For Proposals for Park Landscapers
DISCUSSION:
In 1987 the Park and Recreation Commission requested that a landscape
architect be hired to develop a master landscape plan for the neighborhood
parks. Council discussed a $15,000 budget to accomplish this request,
however for some reason only $3,OOQ was put in the final budget.
If a plan is to be developed in time for consideration during the 1989
budget preparation a consultant should be hired immediately.
RECOMMENDATION:
The Park and Recreation Commission.recommends that a landscape archi-
tect be hired to prepare a master landscape plan for the neighborhood parks.
ACTION REQUIRED:
If Council desires to implement the Park and Recreation Commission
recommendation they should authorize staff to solicit proposals from land-
scape architects, once the proposals are in, a budget revision may need to
be made as $3,000 is very likely not going to be sufficient to cover their
fee. The funding for this activity will come from the park fund and will
not affect the general fund budget.

SUBJECT: Referendum Canvassing Board
Minnesota Statutes require that the governing body of a
City must meet to canvass election returns within two days
after an election. The Council must therefore convene as an
Election Canvassing Board for the referendum results on
either May 4th or 5th.
RECOMMENDATION
No other business will be scheduled on the Canvassing
Board agenda, the meeting will be very short. Since this is
a single issue referendum, preparation of the canvassing
documents should easily be completed on May 4th, and I
recommend therefore that the canvass be scheduled for either
5:00 P.M. or 5:30 P.M. on May 4th.
ACTION REQUIRED
Council should pass a motion scheduling the convening
of the Election Canvassing Board at 5:00 or 5:30 P.M. on May
4th, or at whatever time might be more acceptable to Council
on either May 4th or 5th.

DISCUSSION•
There are eight projects ready to be assessed this year; Lexington
Heights Hydrants, Park Place, Stratford Woods, Rolling Woods, The Ponds of
Mendota Heights, Willow Springs Creek Alignment, Northland Plaza and the
Commercial Street Lights project. Staff's tentative assessment schedule is
to begin preparation of the rolls immediately, present them to Council for
approval in May and June and hold the public hearings July 19th (the second
Council meeting in July).
RECOMMENDATION:
Staff recommends that Council authorize staff to begin preparing the
assessment roll' for the above listed projects.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should

The installation of fire hydrants to serve Lexington Heights
Apartments (which improvements have heretofore been known and

WHEREAS, the construction of said improvements has been substantially
completed.
NOT THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights as follows:

be assessed against all properties benefited by said improvements.
2. That the City Clerk with the aid and assistance of the City

SUBJECT: Catch Basin to City Hall Parking Lot

DISCUSSION:
The City Hall parking lot as bid did not include a catch basin for
drainage, just a break in the curb with a ditch to the wetlands (see
attached map). The pitch on the parking lot was also a problem, too flat
(approximately 0.5 percent). This parking lot design is not the best and
very likely will cause water to pond, therefore I asked the architect to
prepare a change order adding a catch basin and increasing the slope on the
lot.
The Contractor has submitted a bid price of $5,396 to complete the work
requested.
RECOMMENDATION:
I feel that if this work is not completed, it will result in ponding
water on the parking lot and cause early pavement failure. I recommend that
the work be completed. Staff will be exploring alternatives with the
architect between now and the time of the Council meeting.
ACTION REQUIRED:
Subject to any alternatives arising, if Council desires to implement
the staff recommendation they need to pass a motion approving the Change
Order authorizing the revised site grading and addition of a catch basin.
