SUBJECT: Lot Line Adjustment, Lots 4 and 5, Block 1, Eagle
Ridge Summit Second Addition
DISCUSSION
On April 4, 1988, staff received a building permit
application and site plan request to construct two townhouses
on the above listed lots. On the Certificate of Survey, the
applicant is proposing to adjust the common lot line between
Lots 4 and 5. Lot 5 is proposed to gain two feet from Lot 4
in order to afford two feet of extra living space.
Staff discussed the proposal with Planner Dahlgren and
he feels as staff does that the exception in the subdivision
ordinance would allow a minor adjustment to a property line
without Planning Commission review and a public hearing. The
division does not cause the other remaining portion of the
lot to be in violation of the zoning or subdivision
ordinance.
RECOMMENDATION
Staff would recommend City Council approval of the
division as proposed.
ACTION REQUESTED
If Council wishes to implement the staff recommendation
to approve the lot line adjustment, it should pass a motion
of approval.

The Dakota County Board has reorganized and expanded the
membership of its Solid Waste Management Advisory Committee
(SWMAC) to, allow greater participation by citizens, local
communities, and the solid waste industry. The new structure
includes nine County, appointees and the seven members of the
Metropolitan Council's Solid Waste Advisory Committee who reside
in Dakota County. This County Committee meets from 4:00 to 6:00
P.M. on the last Tuesday of each month.
The establishment of three subcommittees to deal with recycling,
education, and routed and organized collection was also approved
by the County Board. Each of these subcommittees will consist of
three SWMAC members plus additional representatives from across
the County. We are asking that each urban city appoint one
representative to the Recycling Subcommittee and one
representative to the Routed and Organized Collection
Subcommittee. These representatives should be able to convey the
positions of the City and in turn report to the City on the
County's plans. It! is expected each subcommittee will meet
monthly, probably in the evening.
/TheRecycling Subcommittee will work with County staff in the
preparation of the Recycling Implementation Strategy and the
implementation of future recycling programs. This group will play
an important role inldetermining how Dakota County will achieve
its solid waste reduction/recycling goals in the years ahead.
Other subcommittee members will be waste haulers, citizens, and
industry representatives.

The purpose of the Routed and Organized Collection Subcommittee
will be to assist County staff in the preparation of background
studies and to outline associated issues of concern to communities
and haulers. The County Solid Waste Master Plan requires that all
urban cities consider routed collection of recyclables and
organized collection by 1990.
The Education Subcommittee will focus on determining how best to
inform and educate the public regarding the County's integrated
approach to solid waste management. It will also assist in the
development of educational programs and materials that will
promote the reduction,' reuse, and recycling of waste. Members
will include haulers, teachers and/or school administrators, media
representatives, citizens and some community representatives.
However, we are not asking that each community appoint a special
representative to this Subcommittee.
Because we are anxious to begin the work of these subcommittees,
we hope that the City Council will appoint its representatives as
soon as possible but not later than April 22.

County has applied the following increases for the new tax
assessment.
These increases are City-wide, and could make for a
"full house" once again next Tuesday night.

Attached is a letter from Dakota County Administrator Lyle
Wray, requesting that we appoint members to the Recycling
Subcommittee and the Routed and Organized Collection
Subcommittee of the Solid Waste Management Advisory
Committee. I have not included this item on the regular
agenda, since I understood we were going to be receiving
further information. County staff has since requested,
however, that we get on with making appointments.
Anyone is eligible for appointment to represent the City,
staff, Councilmembers, or citizens. However, it is my
understanding that most communities are designating citizens
for this responsibility. Staff is already involved in the
"staff -oriented" committees.

ACTION REQUIRED
Councilmembers may wish'to volunteer themselves, or to
suggest names of citizens who might be interested. If no
names come to mind, we could advertise for volunteers in the
local papers.

for next Tuesday evening, April 12th at 7:30 p.m. Attached

Housing Act" officially known as Title VIII of the Civil Rights Act of
1968.

Pursuant to due call and notice thereof, the regular meeting of the
City Council, City of Mendota Heights, was held at 7:30 o'clock P.M.

Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M.

Council that he would be out of town.

Mayor Mertensotto asked Treasurer Shaughnessy
to provide Council with an on-going report on
City Hall costs.
STREET SWEEPING Council acknowledged a tabulation of
quotations received for the 1988 street
sweeping program and a memo from the Public
Works Superintendent informing the Council
that the low bidder, Loomis, Inc., has
informed the City that they are unable to
perform the work as specified.
Councilmember Witt moved that the contract for
1988 street sweeping be awarded to Foss
Sweeping Service for their low bid of $46.75
per hour.

Mayor Mertensotto asked who is responsibility
for cleaning up the dirt tracked onto streets
from construction sites. Public Works
Director Danielson responded that in the case
of developments, the developers are required
to clean the streets as a condition of the
development agreement, however there is no
similar requirement in the case of individual
lots. Mayor Mertensotto asked whether there
are firms which would contract on an hourly
basis for clean-up on an on-call basis and
suggested that the City should take care of
sweeping dirt tracked on to the streets
because of the inconvenience caused to
neighboring properties.
HEARING -- PAGEL ROAD Mayor Mertensotto opened the meeting for the +
VACATION purpose of a public hearing on an application
from Marvin Homes for the vacation of a
portion of Pagel Road south of Hazel Court.
It was recommended by staff that since this
issue relates to the Marvin Homes development
which is to be considered on April 5th, the
hearing should be continued to that date. aq
Mayor Mertensotto asked for questions or
comments from the audience.

REGIONAL PARK Mr. Tim Agness, Park Planner and Landscape
Architect in the St. Paul Park and Recreation
division, was present to discuss the proposed
upgrading of the Lilydale Regional Park, the
Harriet Island Park and Cherokee Park. Mr.
Agness briefly summarized the main parts of
the plan for park upgrading, including a
parkway and loop system of,trails for
pedestrians and bikers, an interpretive
center, clean-up and stabilizing of the lake
area and stocking of the lake by the DNR,
along with a swimming beach, boat launching
facility and camping areas. Mr. Agness
informed Council that project timing will be
over a 20 year funding period and that there
will be four different phases in the projeQt.
He stated that the majority of the funding
will come from the Metropolitan Council
through the metropolitan development fund.

Responding to a question from Councilmember
Blesener, Mr. Agness stated that he is
continuing to explore possibilities for
connecting a trail from the regional park into
the City's trail system but has not yet come
up with a solution.
With respect to an inquiry from St. Paul
Attorney Jerry Segal over willingness on the
part of Mendota Heights to allow St. Paul to
annex two small sections of the park which are
in Mendota Heights, Mayor Mertensotto
expressed concern. He felt that the City
would lose any control it might have over use
of the parcels if they are allowed to be
annexed.
Administrator Frazell stated that annexation
is important because of the policing aspect --
St. Paul would have responsibility for
policing if it were annexed -- and that
neither parcel has any value for development
purposes. Attorney Hart stated that the
annexation would provide for clean lines of
authority and responsibility, which he felt is
important.
Mayor Mertensotto felt that staff should
research the implications of annexation more
fully before going into negotiations with St.
Paul. He felt that Mendota Heights will have
no way.of correcting any problems which may
occur if it allows annexation.
Councilmember Blesener felt that the
annexation is appropriate and that staff
should be directed to proceed with discussions
with St. Paul. Councilmember Witt agreed,
stating that any potential problems will be
uncovered in the discussions.
Mayor Mertensotto directed the Administrator
to ask for a response from.Chief Delmont
before going into discussions.
With respect to formal comments to St. Paul on
the proposal, Councilmember Blesener stated
that she would like to see the parking lot on
the bluff to be an early part of the project
and that there should be a provision for
walking access at the end of Annapolis to the
park for bikers and hikers.

CITY HALL Council acknowledged and discussed a report
from the City Administrator regarding engaging
an interior design firm for new City Hall
along with a consultant for telephone system
selection.
It was the consensus of Council that the
contract for interior furnishings design
services should be between the City and the
design firm, Ilten, Ltd., and that the
architect and design firm should be separate
and independent from each other rather than as
an extension of the agreement with Lindberg
Pierce as Bob Pierce had suggested. It was
also the consensus that, because of timing
constraints, Ilten, Ltd. be allowed to begin
working prior to execution of the contract.
Councilmember Blesener, moved to approve the
selection of Ilten Design, Ltd. for City Hall
interior design services for a contract fee
not to exceed $5,000.
Councilmember Hartmann seconded the motion.

Councilmember Blesener moved to authorize the
City Administrator to retain the services of
Burke Engineering, Inc., for telephone
consulting services in accordance with the
letter of proposal dated March 9, 1988, for an
amount not to exceed $2,000.

WATER CONNECTION Council acknowledged and discussed a memo from
Public Works Director Danielson regarding a
request from Mr. Bruce Savage, 1200 Sibley
Memorial Highway, in Mendota, to be allowed to
connect to the Kingsley Estates.watermain via
a long service connection. Mr. Danielson also
recommended that the connection charge be
waived because of the abnormally high costs
associated with running the water service to
the property.
Mayor Mertensotto asked what kind of agreement
had been made with Sunfish Lake residents some
time ago to allow them to connect to the
City's water." He felt that it would be unfair
to approve the request without cost for a
property outside of the City limits when City
properties are assessed for similar
improvements.

There was discussion over whether the proposed
extension is the best solution to the problem.
After discussion, Public Works Director,
Danielson was directed to report at the next
meeting with information on how many
homeowners in the area may potentially request
similar service along with information on the
Sunfish Lake water extension agreement.'

AIRCRAFT NOISE MEETING Council acknowledged and discussed a memo from
the City Administrator regarding a tentative
March 28th meeting with Eagan on the aircraft
noise corridor. It was Council consensus that
the meeting location should be changed to the
MAC meeting room.
Mayor Mertensotto stated that he has a
conflict that evening and would not be able to
attend.
RECREATION PROGRAM Council acknowledved and discussed a report
from the City Administrator outlining a
proposed summer'recreation program.
It was the consensus that the proposed program
is a good solution. Councilmember Blesener
felt that the third Arts & Crafts site should
be Ivy Falls or Wentworth Park rather than
Rogers Lake; Councilmember Hartmann felt that
there should be an $8.00 registration fee for
Arts and Crafts.
Councilmember Blesener moved to authorize a
$15.,00 subsidy per Mendota Heights registrant
to the Mend -Eagan Athletic Association for
operating the 1988 T -ball program.
Councilmember Witt seconded the motion.

Councilmember Hartmann moved to approve'
entering an agreement with.School District No.
197 Community Education for providing summer
arts in the park for Mendota Heights
residents.

be retained to coordinate the adult men's
softball program.

School rather than Rogers Lake Park.
CHANNEL CLEANING The Council acknowledged and discussed a
report from the Public Works Director
regarding cleaning of the drainage channel at
TH 110 and Dodd. Council concurred in Mr.
Danielson's recommendation that a trapper be
hired to remove the beavers in the drainageway
area, after which staff will begin to clean
the fallen trees.
After discussion, Councilmember Witt moved to
authorize staff to hire trappers to remove the
beavers in a humane fashion.
Councilmember Hartmann seconded the motion.
Ayes: 4

COUNCIL COMMENTS Councilmember asked staff to investigate sight
obstructions at Downing and T.H. 13.
Councilmember Witt asked that a street light
be installed at the intersection of Marie and
Lexington. Mayor Mertensotto agreed, stating
that many residents are out biking and hiking
at night and that lights are important.'
Councilmember Hartmann agreed. Councilmember
Blesener agreed on the condition that the
light be a shielded light.
Councilmember Blesener stated that she may not
be able to attend the April 5th meeting and
asked whether the City Planner had met with
Marvin Anderson Homes representatives yet to
discuss roadways. Administrator Frazell
indicated that they had met and that a report
will be available prior to the meeting."
Councilmember Blesener stated that cars are
being parked across the pedestrian walkway
along Lexington at the SOS.store. She asked
whether a guardrail of some sort could be
installed along the trail to keep cars from
parking on it.
Mayor Mertensotto reported on his meeting with
the Rogers Road area residents.

MINUTES
MARCH 22, 1988
The regular meeting of the Mendota Heights Planning Commission was
held on Tuesday, March 22, 1988, in the City Hall Council Chambers, 750
South Plaza Drive. Chairman Morson called the meeting to order at 7:31
o'clock P.M. The following members were present: Morson, Anderson,
Burke, Duggan, Henning, and Krebsbach. McMonigal had advised the
Commission that she would be out of town. Also present were Planner
Howard Dahlgren and Public Works Director Jim Danielson.
APPROVAL OF Commissioner Duggan moved approval of the minutes of
MINUTES February 24 as submitted.
Commissioner Krebsbach seconded the motion.

CASE NO. 88-08, Chairman Morson called the meeting to order for the;
JESCO, INC. purpose of a public hearing to consider a request from
REPLAT, HEARING Jesco, Inc., to rearrange existing lot lines in Eagle
Ridge Summit 2nd Addition. He noted that the applicant
was not present.
After a short wait, Commissioner Henning moved that this
case be tabled to April 26, at 8:00 P.M.
Commissioner Duggan supported this motion conditioned
upon hearing the verbal review and if, after the review
the applicant was not present, then to table the public
hearing.
VERBAL REVIEW Public Works Director Danielson gave a verbal review of
the cases that had been before the City Council.
Planner Dahlgren explained the proposed changes in
Marvin Anderson Homes revised plat, which now shows 69,
rather than 70 lots. He noted that 3 lots will
eventually be double -fronting lots and Commissioner;
Henning stated that the Council should be sure that
Anderson Homes makes this fact known to potential buyers
of these three lots.
Vote on the original motion to table the public hearing
was unanimous.

REMARKS: Construction will begin again around May 1.
Assessment will be by acreage served.
PROJECT: Imp. 87-2 Hillside Creek

Council, at their March 1st meeting, considered an application from
Marvin Anderson Homes for a 70 lot plat called Bridgeview Shores. During
the discussions, Council expressed concern about the number of wetlands
permits, number of cul-de-sacs and the lack of trail access to the Friendly
Hills Neighborhood Park. Action on the project was continued to the April
5th meeting to allow time for the Developer to address these concerns and
for staff to publish for a public hearing for the wetlands permits. The
Developer has now met with City Planner Dahlgren, School District 197 Busi-
ness Manager, Lois Rockney and City Staff to address these items (see Plan-
ner Dahlgren's attached memo). Council also asked that Planner Dahlgren be
invited to attend the April 5th meeting to discuss the development directly
with them.
A public hearing considering the vacation of Pagel Road south of Hazel
Court was also continued to 7:45 P.M. to be considered in conjunction with
the approval of this plat.
Council asked to have a copy of the portion of the wetlands ordinance
with the criteria for the granting of permits (it is attached).
RECOMMENDATION:
The Planning Commission has unanimously recommended approval of this
preliminary plat and its wetlands permits subject to several modifications
to the wetlands setbacks that already have been made. They also recommended
approval of a staggered front yard setback scheme. Subject to approval of
the plat by the Council, staff recommends approval of the vacation of Pagel
Road right-of-way south of Hazel Court.
ACTION REQUIRED:
Conduct the public hearings for the vacation of Pagel Road and the
wetlands permits, discuss plat concerns with Planner Dahlgren and then if
Council desires to approve the preliminary plat as amended, they should pass
a motion approving the Bridgeview Shores preliminary plat dated March 18,
1988, pass a motion approving the wetlands permits as shown on the prelimi-
nary plat and pass a motion adopting Resolution No. 88- RESOLUTION

RESOLUTION APPROVING VACATION OF A STREET RIGHT-OF-WAY
WHEREAS, the City of Mendota Heights is the current record owner of a street
right-of-way as described as follows; and
Pagel Road south of the south right-of-way line of Hazel Court
extended easterly.
WHEREAS, a notice of hearing on said vacation has been duly published and
posted more than two weeks before the date scheduled for the hearing on said
vacation, all in accordance with the applicable Minnesota Statutes; and
WHEREAS, a public hearing was held on said vacation on March 15, 1988, at
7:45 o'clock P.M., at the City Hall of the City of Mendota Heights; and
WHEREAS, the City Council then proceeded to hear all persons interested in
said vacation,and all persons were afforded an opportunity to present their
views and objections to the granting of said petition.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the vacation of the street right-of-way described above, sit-
uated in the City of Mendota Heights, is in the best interest of the public
and the City, and is not detrimental to the health, safety and welfare of
the community.
2. That the above described street right-of-way be and the same is
hereby vacated.
3. That the City Clerk be and is hereby authorized and directed to
prepare and present to the proper Dakota County officials a notice of com-
pletion of these vacation proceedings, all in accordance with the applicable
Minnesota Statutes.

SECTION 7.
Standards Pursuant to Issuance of Permit.
A. No permits shall be issued unless it is determined that the -
proposed action within a "W" District complies with the following,
requirements:
I
a.
1. Dredging -and/or filling shall be located in areas of minimal
vegetation.
2. Dredging activities shall not significantly reduce the water
flow cha.racteristids or ponding capacity.
3. The size of the dredged material shall be limited to the
absolute minimum and said limits designated on the dredging/
grading plan.
4. Disposal. of the dredged material shall not result in a
significant change in the current water flows, ponding, or
in destruction of vegetation, fish spawning areas, or in
pollution of water.
5. Earthwork will not be performed during the breeding season
of water fowl or the fish spawning season.
6. Only one boat' . channel or marina -shall be allowed per large
scale development or PUD. In other residential developments,
dredging shall be located so as to provide for the use of
boat channels and marina by two (2) or more adjacent
property owners. The width of a boat channel to be dredged
shall be no more than the minimum required for the safe
operation of boats at minimum operating speeds.
7. No part of any septic tank system or any other sewage
disposal system requiring on -land or in -the -ground disposal
of waste shall be located closer than fifty (50) feet from
the edge of a "'W" District boundary unless it can be shown
that no effluent can reach the * wetland because of existing
physical characteristics of the site. On-site sewage
disposal systems shall be permitted only if they meet state
and city regulations.

Run-off from developed property and construction projects may
be directed to the wetland only when reasonably free of silt
and debris and chemical pollutants, and at such rates such
as not to disturb wetland vegetation or increase turbidity.
z.
9. No deleterious waste shall be discharged in a wetland or
disposed of in a manner that would cause the waste to enter
the wetland or other water resource area.
10. "W" District lands may not be used for disposal of organic
refuse or garbage material typically disposed of in a•
landfill. No part'of a wetland should be used for a
sanitary landfill.

11. Lowest floor elevation of buildings located within the "W"
District must be at least three (3) feet above the highest
known water level.
12. No development shall be allowed in the "W" District which will•,
endanger'•the health, safety, and welfare of persons or which
will result in unusual maintenance costs to road and parking
areas or the.breaking or,leaking of utility lines.
13. Removal .of vegetation shall be permitted only when and where
such work within the "W" District has been approved in
accordance with the standards of this Ordinance.
14. Removal of vegetation within the "W" District but outside
the wetland shall be limited to that reasonably required
for the placement of structures and the use of property.
15. The proposed action will not cause storm water runoff to
take place at a rate which would exceed the natural rate
of run-off occurring from a rainstorm of a twenty-four (24)
hour duration and a once in two (2) year frequency.
16. Any increase in run-off due to the proposed action will
be detained on the site for infiltration through the soil
to the water table. Detention of water shall be calculated
on the basis of one hundred (100) year frequency rainfall
published by the U.S. Weather Bureau.
17. The quality of water infiltrated to the water table or
aquifer shall remain undisturbed by the development of the
site.
(a) Drainage water shall be directed in such a manner as
to travel over natural areas rather than across
contaminated surfaces.
(b) Treatment of run-off prior to release to natural
drainage shall be provided for parking areas and land
uses which manufacture products likely to contaminate
ground water.
(c) No portion of any septic tank drainfield shall be
located closer than four and one-half (4�) feet from
the highest known water table on the site or underlying
bedrock.
18. Land shall be developed in the smallest practical increment
at any one time and for only the shortest practical period of
time, not to exceed a single construction season.
19. Sufficient control measures and retention facilities shall...
be put in place prior to commencement of each development
'increment to limit gross soil loss from the development
site to not more than five (5) tons per acre per year.
20. Existing wetlands shall not be used as sediment traps.

21. Sediment yield from construction sites adjacent to streams
and lakes shall not exceed two (2) tons per acre per year.
22. The person seeking the development permit shall be required
to demonstrate that after the development is completed the
conditions on the site will be stabilized such that the yearly
solid loss from the site will not be greater than 0.5, tons
per acre.
23. Development•of woodlands shall not reduce the existing crown
cover by more than fifty per cent (50%). The removal of
trees seriously damaged by storms or other acts of God, or
diseased trees shall not be prohibited.

RE: Marvin H. Anderson Preliminary Plat, Bridgeview Shores
Attached is a copy of our February 23, 1988 Planning Report for the Marvin H.
Anderson Construction Company's preliminary plat. The report summarizes our concerns
and background information relating to several staff meetings with Marvin H. Anderson
representatives at City Hall.
On March 7, 1988, the Staff, as requested by the Council, met with Randy Hedlund
(Hedlund Engineering), Fred Haas (Marvin H. Anderson Construction Co.), and Louis
Rochne (School District 197). The staff was represented by Kevin Frazell, Jim
Danielson, and Howard Dahlgren. The purpose of our meeting was to carefully examine
and review the proposed plat with the objective of considering the possible elimination
of some cul-de-sacs, relationship to the school property, the functioning of the pathway
system as it relates to the plat and the school property, minimizing the extent and
number of variances to the shoreline setback requirement, the potential for continuity
between platted areas (extension of all rights-of-way), and street and lots configuration.
The meeting was very amiable, with everyone contributing toward possible alterations to
achieve our general objective of improving the plat so as to produce the best home
sites for future occupants in the City of Mendota Heights.
Generalized Street Pattern
Attached is a drawing (Figure 1) showing the Site Location. The subject property is
indicated in the dark shaded area being contiguous to Mendota Heights Road along the
south boundary, with the existing platted areas to the north and the school district
property to the east. The school district property is being held as a public school site,
with the very strong possibility that it will, in fact, be utilized for that purpose in the
future. A 30 acre minimum is required to meet State standards. Louis Rochne noted
that with the cul-de-sac for Bridgeview Drive located on the site, this reduces the site

to less than 30 acres, which is a matter of considerable concern to the School Board.
In any case we suggested that it is not crucial to maintain public street access to the
site, but that the maintenance of pedestrian access to the site is important.
To the north side most of the nominal 40 acre tract is contiguous to the original
Friendly Hills plat, a portion of which is owned by Bernie Friel. On Figure 1 the lots
owned by Mr. Friel -are shaded in light gray. You are all aware that Pueblo Drive as
it passes through these lots has been vacated. Mr. Friel's house is very near the
right-of-way at the southeasterly portion of the site in such a location where the future
extension of Pueblo Drive would be difficult if the land is to be subdivided in the
future. There is a 30 foot existing right-of-way at the southwest corner of Mr. Friel's
property, which is indicated in the light gray tone. This provides a 30 foot access to
Pagel Road. Pueblo Drive could be extended from the north where the stub streets
exist. However, it would be advisable to provide a second means of access to the Friel
property so as to provide for a future division of the land. This will undoubtedly occur
at some point in the future, though not necessarily accomplished by Mr. Friel.
You will note the possible extension of Pagel Road directly south from its existing
connection with Hazel Court through the property in question. Connecting the major
portion of the subject property in the southerly area of the site to Pagel Road and
Hazel Court would be desirable, providing a connection from one neighborhood to the
other. We carefully examine the possibility of achieving this objective and found that
the ecological impact is too great a price to pay for this connection. Examination of
the larger scaled drawings indicates that such an extension would have to go through
the far west end of the Twin Lakes that dominate the northern central portion of the
land. In fact, it would desecrate the land with severe impact on the water body itself,
and the DNR would take a very dim view of this extension.
Another possibility for the connection of the two neighborhoods would be the extension
of Mohican Court beyond the old water tower site down around the east edge of the
Twin Pond configuration. Here, the examination of the terrain confirms that this will
be a very difficult connection and would have a deleterious impact on a large stand of
21 to 36 inch oaks that exist in this area of the site.
In summary, it appears as though the connection of vehicular access routes from the
platted areas to the north to the proposed site presents severe economic, ecological
problems. The connection of the neighborhoods via public foot paths that pass through
the property and to the school site, however, is a very important consideration providing
for neighborhood continuity and ease of pedestrian movements through and around the
proposed development.
Topography and Vegetation
Figure 2 illustrates the generalized topographical formation and the tree growth that
exists on the site. Though the topography is hard to read at this scale, we examined
carefully at a larger scale (and later in the field) the topographical conditions as related
to the ponding area and three points where possible roadway extensions could be made
which would tend to eliminate some of the cul-de-sacs. These points were:

a) On the east end of the Twin Lakes area (in the narrow neck of land between the
east end of the lake and the school district property);
b) To the north of this pond where it might be possible to connect Bridgeview Court
to Mohican Court; and
c) Where Pagel might be extended southerly to connect to Westview Terrace.
In all three of these locations we felt that the forcing of the street right-of-way
through these areas and around the affected ponds would not be in the public interest.
On the east side the terrain is very steep and is occupied by the heavy stand of
mature oaks previously mentioned. The extension at the north end of this pond would
result in passage over a deep hollow, and the fill being close to the lake, resulting in
the loss of several'very good lots. Likewise, the extension of Pagel Road would go
through the ponding area, unless we were to acquire a significant portion of the lot
southeasterly of the Hazel Court cul-de-sac. Again, there are existing stands of 18 to
24 inch oaks which would be severely effected. As a result, the extension of these
cul-de-sacs through the sensitive terrain areas would not be wise.
Westview Drive Cul -de -Sac Area
As noted, Louis Rochne expressed deep concern about the impact of the dedication of a
cul-de-sac right-of-way on portions of the school property. Ms. Rochne suggested that
the impact of the cul-de-sac on this portion of the site as determined by the school
architects could be deleterious. In other words, this is not the portion of the school
site from which vehicular access is desired. Therefore, we suggested that it would be
appropriate to pull the cul-de-sac further to the west and substitute a pedestrian access
to the school site from the end of Bridgeview Drive. Ms. Rochne agreed that it would
be appropriate to provide for a public path along the west side of the school site
connecting this pathway to the northwest corner of the site, then easterly to Apache
Lane. This pathway would also connect with Mohican Court so as to connect these
three access points to the school site. This would be provided by a 30 foot easement
and the construction of a 5 foot pathway.
Figure 3 illustrates the change that results in the movement of the cul-de-sac to the
west off of the school property. The previous preliminary plat is indicated in brown,
and the proposed plat is indicated in green. You will note that this change results in
the reduction of one lot in this area of the plat, though it produces some very
desirable home sites. This change also results in the reduction in the length of the
cul-de-sac, with the cul-de-sac now being approximately 550 feet in length.
Mohican Court
Figure 4 illustrates the public pathway along the west edge of the school site and its
connection to Mohican Court. This will provide access to the school site for the
southwesterly portion of Friendly Hills. You will note that Outlot B continues to exist
as an 8,800 square foot parcel. It may be appropriate at some time in the future to
add this parcel to the school site. It could be retained as an attractive
"vest -pocket -park" as part of the school site or by the City itself. It is, of course, the

former site for the water tower and is an attractive high piece of ground. Figure 5
(the Havenview Court area) illustrates a recommended shortening of the cul-de-sac by
moving it westerly a distance from the ponding area. This shortens the cul-de-sac by
100 feet and produces a more desirable lot configuration, as well as increasing the
setback from the pond edge to the proposed residences.
You will note that the 25 foot setback in the previous proposal (illustrated in brown) is
now being increased to 70 feet. This occurs on Lot 8. You will note that on Lot 9
the setback is increased from 40 feet to 55 feet. In this case, a number of lots
remain the same, but the cul-de-sac is shorter and the lots will be more buildable sites
with greater setbacks to the pond. You will also note that the extension of the 8 foot
wide concrete sidewalk will now occur directly off the cul-de-sac. The extension of
this walkway across the Twin Ponds area will provide a means of access to the
southerly portion of the site and to the school site. This will also provide pedestrian
access to residences on Hazel Court and Pagel -Road.
Figure 5 does not extend far enough to the west to illustrate a change proposed by Mr.
Haas as a result of his meeting with Mr. Friel. In response to Mr. Friel's concerns
about future access to his property, Mr. Haas has agreed to provide a 25 foot
right-of-way along the far northwest boundary on the plat. This produces a less than
desirable condition with double frontage for three of the lots off Havenview Court.
However, this seems the only practical way to provide a secondary access for the future
subdivision of the Friel property. Mr. Danielson has suggested that the total 55 foot
right-of-way for this purpose will be adequate. Certainly this represents a magnanimous
gesture on the part of the Marvin H. Anderson folks to accommodate the development
concerns of contiguous properties.
It appeared from our joint examination of Pondhaven Lane, as it was proposed directly
north of Pondhaven Circle, that the roadway could be moved south so as to increase
the setback to the homes off the south end of the Twin Ponds (north of Pondhaven
Lane). Figure 6 illustrates this adjustment in right-of-way increasing the setbacks from
the pond from approximately 70 feet to 90 feet. This has a deleterious impact on the
remaining lots to the south, each of them, as you will note, still remaining larger than
15,000 square feet each.
Pathway System
The original preliminary plat did not include a pathway system on Pondhaven Lane and
Westview Terrace. All of the rest of the major street system was provided with the
pathway system. A review of this condition with Mr. Haas at our meeting resulted in
his agreeing to propose the extension of the pathway system to the street as well.
This results in the overall plat providing a continuity of the pathway system throughout
the entire plat. This will provide efficient access between the individual lots within the
plat, a connection to contiguous platted areas, and an efficient access system to the
future school site as well.
Summary
Careful examination of the topography, the wooded areas, and the very attractive ponds
on the site on the large scale drawings and field visits lead one to conclude that this
is an area of tremendous potential for the accommodation of upscale housing. It is
obvious, however, that the restricted adherence to the normal "rules and of development"

is difficult to achieve and still retain the best of the quality home sites possible on
this property. Though there are still some lots on which the location of the homes will
be less than 100 feet from the shoreline, there are, of course, many lots where the
distance far exceeds that number. In the old plat there were 26 lots with setbacks of
less than 100 feet, with an average setback of 70.96 feet. In the new plat, there are
24 lots with setbacks less than 100 feet, with an average setback of 73.75 feet.
Overall, it seems as though the adjusted plat achieves a reasonable density averaging
20,000 square feet -of land (above water) for each single-family lot. Thus, the overall
density (excluding the ponds) is of a standard higher than that normally applied in most
of the City (where new platting prevails).
Although some of the cul-de-sacs are longer than one would desire and there is no
motorized connection between the north side of the plat and the south, it appears that
there are strong ecological reasons for foregoing these accomplishments in the interest
of producing the best home sites without desecrating the terrain, the ponding areas, or
some of the extensive tree growth.

Approval of Preliminary Plat
1. This 47 acre tract was, as you know, recently put up for sale by the
School District for which the buyer is Marvin H. Anderson Construction
Co. You will recall, when this property was considered by the Planning
Commission and Council for redesignation from a school site in the
Comprehensive Plan to residential development, a condition was attached
by the Council that the land be developed for single-family housing at
15,000 square feet per lot (excluding water area) and that the land not
be subject to the normal PUD consideration (for development' other than
single-family housing). The applicants, representatives of Marvin H.
Anderson Construction Co., and their consultants have met with staff on
a number of occasions wherein preliminary concept plans were reviewed.
2. Because of the existence of permanent water bodies on the site, the
platting of the property for single-family lots is very difficult.
Particularly challenging is the handling of that portion of the property
north of the twin ponds in the northerly half of the site. It appears
that the only reasonable solution for the handling of this area results in
a cul-de-sac which is 800 feet from its intersection with Hazel Court
and Pagel Road on the west end. Any attempts to loop this street
results in necessitating a crossing of the narrow isthmus between the

ponds, or extending the road easterly along the shoreline, leaving
inadequate depth for development to the north property line. Though
the 800 foot cul-de-sac exceeds the nominal 500 foot cul-de-sac
maximum length, it appears that the cul-de-sac as proposed is the most
appropriate solution.
The overall solution plats the property into 70 single-family lots. All
of the lots meet or exceed the 100 foot lot width requirement as measured
at the 30 foot building setback line. Each lot also has a minimum of
15,000 square feet of land above the high water line (where portions of
the lot include ponding areas).

pertinent development data. The overall development proposal appears
to be of 'consistently high quality, producing e meticulously planned
concept. '
5. The ponds on the site are port of the overall wetlands system.
Normally the development of structures are restricted to more than lOO
feat from the high water line of such ponding areas. In the ooue of
this proposal, the applicants are seeking a number of variances for
specific lots. It has been the normal practice for the City to consider
such variances at the time of specific development proposals. However,
in this case, you will notice on Sheet 7 of the drawings that the
individual houses are proposed for each specific lot, with the distance to
the water line indicated on each water related lot. Thus, it would
appear appropriate in this case to consider approval of the variance to
the lOO foot setback based on the plans as submitted. You will notice
that, in most cases, the setback distance to the water line exceeds lOO
feet. The configuration of the topography, however, rnohem this almost
impossible to maintain the IOO foot setback in all cases. This in
particularly true with respect to the cul-de-sac in the for southeast
corner of the site and the site conditions along the narrow, northern
tier (north of the twin ponds in the northerly half of the site).
6. It appears in the development /plan for the property, that the retention
of the *mxioting trees has been on important factor. Though this is
diff icu1t 'in the development of single-family lots in areas of
"interesting" terrain, it appears to have been done .rather successfully in

this development proposal.

7. The application is for approval of the preliminary plat and approval of
variances to the wetlands ordinance relating to matbeoku to the high
water line of specific lots. Many options to the plans have been
considered by the applicant and the staff in the review of the design
for the development of this property. It would appear that the
proposed solution meets the City's development criteria in a reasonable
fashion, given the severity of the constraints of topography and ponding
areas.
8. Conditions c6u1d be included that the property be developed as
submitted in the development brochure dated March I, 1988 and subject
to final engineering details.

INTRODUCTION•
James Maifield of Lovering Associates, has applied for a
building permit on behalf of School District #197, for a
9,500 square foot building to maintain and repair school
buses. The property is located in the
Industrial Zone at 1145 Medallion Drive, just west of the
City's public works garage.
DISCUSSION•
The plan review has been completed. The building
complies with building and fire codes and is well within the
guidelines set forth in the zoning ordinance. The parties
involved have been cooperative in supplying staff with the
necessary information during the plan review process.
Staff feels that the land use is appropriate, plans are
in order, and would recommend issuance of the requested
permit.
ACTION REQUIRED:
If Council wishes to implement staff's recommendation,
it should pass a motion to approve the issuance of said
building permit.

SUBJECT: Foto Mark Building Permit Request
2411 Pilot Knob Road
DISCUSSION:
Michael Meagher of Foto Mark, Inc., and Larry Hines of
Hines and Sons Construction have submitted plans and
application for a building permit for a proposed addition to
the Foto Mark facility.
The addition will be a two story masonry structure
attached to the north end of their present facility. The
footprint of the addition is shown to be 14 feet wide and 76
feet long. The ground floor level will be for solvent
storage and the upper floor will contain the paint drying
furnace.
The proposed parking, as shown on the site plan, will be
in excess of minimum zoning ordinance requirements. The ;
reconfiguration to angle parking on the north and west areas
of the building has been proposed to provide an adequate
width for the one-way driving lane and 20 foot parking
spaces. Landscaping is also shown on the site plan.
RECOMMENDATION:
Staff would recommend approval of the permit as
requested. ,

WHEREAS, the City Engineer reported that the proposed improvements and
construction thereof were feasible and desirable and further reported
on the proposed costs of said improvements and construction thereof;
and
WHEREAS, the City Council has heretofore directed that the City Engi-
neer proceed with the preparation of plans and specifications thereof;
and
WHEREAS, the City Engineer has prepared plans and specifications for
said improvements and has presented such plans and specifications to
the City Council for approval.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the plans and specifications for said improvements be and
they are hereby in all respects approved.
2. That the City Clerk with the aid and assistance of the City
Engineer be and is hereby authorized and directed to advertise for
bids for said improvements all in accordance with the applicable

SUBJECT: LCS Metal Stamping, 1480 Sibley Memorial Hwy.
DISCUSSION:
Mr. Jerry Stotts, President of LCS Metal Stamping, has
requested to be on a future City Council agenda to seek a
variance from the fire codes, which is his right under the
City's Fire Prevention Code.
Mr. Stotts will request a variance from that section of
the fire code that requires basements exceeding 1500 square
feet without the required window openings to either install
the necessary openings or protect the basement with an
automatic sprinkler system. The basement of this building is
in excess of 2000 square feet and is used as a lunch room,
storage facility, contains the water system and heating
plant, and is panelled with a combustible panelling.
Two points should be called to your attention:
1. There is only one recognized entry to this basement
for firefighting purposes. This entrance, which
lacks a door knob, is located outside the west side
of the building. The other entry is through a maze
of turns and machinery with unprotected wooden steps
which would preclude this approach for firefighting.
2. At the present time, there are four buildings in the
City that either have or will soon have written
orders to comply with approximately the same
situation. It is my concern that a variance
approval would initiate a spate of requests by these
additional four businesses.
Staff estimates that it would cost approximately $6,000
for compliance with the code requirement. About half this
cost, $3,000 would be for installation of domestic water
service. LCS has already been assessed $9,000 for the
watermain in the abutting roadway, so would have no water
hookup charge.
RECOMMENDATION•
Recognizing firefighter safety and compliance with City
fire codes as primary considerations of the City Council,
I recommend denial of the variance request by Mr. Stotts.
ACTION REQUIRED:
If Council concurs with the staff recommendation, they
should pass a motion denying the requested variance.

Dear. Gentlemen or Ladies,
I am at this time asking the council to issue to the LCS
Company a variance and to rescind the need for this company
to install sprinklers in the basement of the property at
1480 Sibley Highway. I ask you to consider, this for the
following reasons:
A. Of the 2100 square feet, only 800-1000 square feet
is used for employees to eat lunch. The additional
space is used for, the storage of tools and dies which
are made of steel and are noncombustible. Also there
are two means of exit from the room. I see no
jeopardy of safety for, people under, these circum-
stances.
B. I feel this would create an undo hardship on the
company because of the cost of installation. Also,
at the cur'r'ent time, the water; supply of the company
is from a well.
In summary, it is felt that there is no undo danger, to
life or property and that it would create undo financial hardship.
It is at this time I request the council review the abover_
listed reasons and issue a favorable conclusion to this matter,
by means of a variance to LCS Company.

4. Request that MASAC conduct an annual review of the
effectiveness of the agreed upon corridor departure
procedures, so that the cities would have the
opportunity to change their positions if their
desired objectives are not being met.
During our workshop discussions, we will deviate from
this position as needed be to reach a group concensus.

SUBJECT: Consultant Proposals for Community Commercial
Market Study
I have previously forwarded to you copies of the Market
Survey Proposals from Maxfield Ldt., and Resolutions, Inc.
As I am sure you noticed, the fees substantially exceeded
what we were anticipating.
If Council is willing to spend an evening on this
subject, it would be my recommendation that we invite the two
consultants in for a presentation and question and answer
session. Even if we should decide not to commission a study
by either proposer, I think just talking with them would help
pique our own thoughts about what we are looking for. We
might also explore ways of focusing the study more directly
on the questions which we want answered, thereby reducing the
cost.
Another thought I have had is that we might approach
local business developers and the shopping center owner about
participating financially. We want the study results to be
oriented to public policy considerations. However, a good
study will obviously have benefits to the developers, and
some level of financial contribution would seem to be
appropriate.

To decide on a desired course of action and direct staff
accordingly.

BACKGROUND
Our list of target issues, adopted by Council in the
Spring of 1987, included two priorities with regard to
relationships between Council and the advisory commissions.
Item #10, a "high" priority, was as follows:

Clarify relationship to Council.
Develop recruitment effort.
Develop training program.
Define planner/staff role.
Hold periodic joint workshop.
Item #27, a "low" priority, was:
COUNCIL/STAFF RETREAT
Study and anticipate the future.
Plan and organize to react appropriately.
Consider need for professional assistance.
We have anticipated meeting these target goal objectives
by having a joint workshop between the Council, the
Commissions and top staff during the Spring of 1988. $3,000
is included in the adopted 1988 budget for this workshop.
DISCUSSION
At Council direction, I have solicited information and
proposals from area consultants who might be able to
facilitate this type of workshop for us. Four names and
resumes were provided by the Government Training Service:

John Vinton
Karen Ray
John Seppela
In addition, proposals were received from Peter C. Brown and
Don Salverda.
In thinking about our workshop, we need to keep in mind
that we have already drafted and adopted a vision statement
(remember "Spacious and Gracious"7), and Council adopted an
updated list of target goals one year ago. I am assuming
that most Council and Commission members would buy into the
general direction of the vision statement and the adopted
goals.
In my opinion, it seems to me that we are at the point
where we want to focus on building the City team (Council,
Commissioners, and staff,) to most effectively and
efficiently carry out our vision and goals.
I also have a bias for working with a consultant who has
extensive previous experience in doing workshops with local
governments; there are a lot of nuances in city government
that might be missed by those who have worked mostly with
private sector or non profit, special purpose agencies.
Of the proposals submitted, three struck me as having
the credentials closest to the criteria I would be looking
for:
John Vinton, Barbara Arney and Don Salverda
ACTION REQUIRED
If Council wishes to proceed with the workshop, I
suggest three actions this evening:
1. Come to some consensus on the purpose of the
workshop, and the goals that we hope to achieve.
2. Select a facilitator.

There will be some engineering time for staking tree locations so the

should we then tell callers that the trees are all gone for 1988 and not
take any more names)
RECOMMENDATION•
Staff recommends we award the tree contract to Greenworks, Inc. for
their low bid of $12,100 and authorize the planting of 100 trees. Green -
works already has the 1988 West St. Paul tree contract and had South St.
Paul's contract last year. Both Cities speak well of Greenwork's work.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion awarding a purchase order to Greenworks, Inc. for their low
bid of $12,100.

INTRODUCTION:
Engineering Technician Charlie Whelan recently accepted a job as an
architect and quit. The City is going to have another busy summer in
engineering so we do need to replace Charlie.
DISCUSSION:
Staff advertised for a full-time temporary position in the Minneapolis
and St. Paul Sunday Papers and received five responses. Of those responses,
Mr. Jon Schmidt is a graduate civil engineer with some experience and is the
best applicant. Mr. Schmidt is from South Dakota and is engaged to be
married to a woman working in the Twin Cities. His immediate goal is to find
temporary employment in the Twin Cities with the idea of moving back to
South Dakota around the first of next year.
RECOMMENDATION:
Staff recommends that we hire Mr. Jon Schmidt as a full-time temporary
engineering technician for an hourly wage of $9.00 per hour (his minimum
acceptable amount). His wages will be funded entirely by improvement pro-
jects.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion hiring Jon Schmidt at an hourly rate of $9.00. -

SUBJECT: Rescheduling of May 3 Council Meeting
Our Parks Bond Referendum will be held on Tuesday, May
3, the normal date for the first City Council meeting in May.
The Council Chamber will be in use as a voting place until
8:00 P.M., and several of the key staff members will be tied
up in processing election results. Therefore, we are
requesting that Council reschedule the meeting to a later day
in the week.
The City Hall Subcommittee is working with our interior
designers on a "fast track". Current schedule indicates that
we will make preliminary furnishing and color pallet
selections on Monday, May 2. The interior designers will
then attend a City Council meeting to present the Committee's
work and recommendations for your consideration. It would
work best if the Council meeting could be held on Thursday,
May 5, so as to give the designers three days following our
subcommittee meeting to prepare for their presentation.
A meeting on Thursday evening will also allow the
Council to meet within 48 hours of the completion of the
Parks Bond Referendum vote to canvass the results.
ACTION RE UIRED•
If Council concurs with the staff recommendation and
request, it should pass a motion changing the date of the May
3 Council meeting to May 5. If this date does not work for
everyone, the alternative is to hold the meeting on
Wednesday, May 4.

SUBJECT: Bevan Marvey - Easement Acquisition
INTRODUCTION:
In conjunction with the Victoria Highlands project approval, Council
directed staff to include a gravity level control for the Marie Avenue Park
Pond. This pond level is currently regulated by a pumping station and has
overtopped during two recent super storms flooding a home.
DISCUSSION:
The City does not have an easement within which to install a pipe
between the Marie Park and the Victoria Highlands project so staff has
looked at several options and contacted several homeowners along prospective
routes. An alignment through Mr. Bevan Marvey's lot, 970 Douglas Road would
provide an excellent path for our new pipe (see attached drawing). Mr.
Marvey has also been the only cooperative resident we have contacted.
We negotiated a proposed easement price with Mr. Marvey based on past
easement prices at $3,150.
RECOMMENDATION:
Staff recommends that Council authorize staff to purchase the needed
permanent and temporary easments from Mr. Bevan Marvey for the proposed
easement price of $3,150. The total amount to be funded by the project.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion approving the expenditure.

Re: Clarification stions Concerning
Athletic Complex/Recreation Area Alternatives
The public discussion over the parks bond referendum is
gearing up, and it is obvious that comparisons between the
previously proposed Sibley Athletic Complex, and the now
proposed Southeast Area Recreation Area alternative will be a
part of that discussion. The purpose of this memo is to
answer questions that:have been raised. In writing this
memo, it is not staff's intent to enter into the debate or
take sides on the issue. We simply want everyone to have
access to the same base of accurate information, as much as
possible.
1_._ Comparison of Facilities Provided
Attached is a side-by-side comparison sheet of the two
alternatives.
Please note that the comfort station in both proposals is
2,000 sq. ft. The earliest plan for the Southeast site
(prepared by the Tandem/Centex developers) had a 3,000 sq.
ft. facility; this was subsequently reduced by the Planning
Committee and Council.
A question has also been raised about the size of the
respective playing fields. The softball fields in both
proposals have centerlines of approximately 290 feet,
considered acceptable for both adult and child play. The
baseball field in the Southeast site has a center line of 375
feet, whereas the Sibley baseball field centerline was about
325 feet.

The Sibley plan included lighting the existing eight tennis
courts; the Southeast Recreation Area has no tennis courts.
The issue has never been the need for more tennis courts per
se; the Barton-Aschman Facility Needs Study indicated that we
are blessed with an abundance of tennis courts in Mendota
Heights. Rather the issue is lighted tennis courts.a
Approximately $45,000 was included in the previous bond issue
to light the existing Sibley courts.

The previous plan would have provided lighting for the tennis
courts and drainage improvements on the playing fields.
However, the facilities in their current condition are still
available to use by City residents.

I am very concerned that information In the subject memo was
incomplete and misleading. Paragraph 2 states "I think it
Is fair to say that a corrected amount for the previous bond
issue would have ranged from $1.95 to $2 million, all other
items remaining the same."
This implies that all other items in the comparison between
the 2 proposals are the same, when in fact we all know that
under the present proposal, the trail program was reduced by
about $150,000, and eliminating the contingency fund cut
about another $150,000. The difference In cost between the
2 proposals is not $500,000 as the memo would lead the
reader to conclude, but rather $800,000.
No one can argue with the need to distribute fair, accurate
and complete information so that Mendota Heights citizens
can make an informed decision. In order to preserve the
credibility of the city in this controversial issue, I feel
stronaly that a second memo be sent to all Darties to
clarify this issue.

SUBJECT: Downing & Trunk Highway 13 Bushes
At the March 15th City Council meeting, staff was directed to investi-
gate a possible site obstruction at 989 Downing, James Konen residence.
After looking at the intersection it was the concensus of staff and Mn/DOT
that there is not a sight distance problem. Mn/DOT states that they can not
remove the hedge because it is not on their right-of-way. Staff checked
with the Police Department and they report that there have been no accidents
in the past two years at the intersection.
