Although the minutes of the October 18th meeting are provided they have been deleted from the agenda since Council would not have time for adequate review. Please keep these for adoption at the November 15th meeting. Four new items, all for the consent calendar, are included on the agenda as discussed below. No additional information is submitted for any item already scheduled. 3. Agenda Adoption It is recommended that Council adopt the revised agenda printed on blue paper. 4. c. Adoption of Ordinance No. 259 Re: Liquor Store Hours of Operation on Thanksgiving Eve Please see attached memo and ordinance from City Clerk Kathy Swanson. 4.h. Approval of Computer Eguipment Purchase Please see attached memo from City Clerk Kathy Swanson concerning purchase of this budgeted item. As the total price exceeds $2,500, Council authorization is required. .i. Approval of Rubbish Hauling Contract for City Hall An RFP for rubbish service was recently sent out requesting the following: 1. Weekly pickup of mixed solid waste. 2. Bi -weekly pickup of recycled office paper. 3. Option for aluminum can recycling. The office paper recycling component is a mandatory condition of receiving solid waste funding from Dakota County. In response, the attached four proposals were received. Two of the proposers, Knutson Rubbish and Mendota Heights Rubbish met the specifications. As can been seen, Knutson offers the lowest monthly charge, $24.62. ACTION REQUIRED Motion to award contract for City Hall rubbish removal and recycling to Knutson Rubbish Service, Inc. in the amount of $24.62 per month. 4.j. City Hall Janitorial Service The following quotations have been obtained for City Hall Janitorial Services: Lee's Janitorial C-Tak Mendota Heights Brooklyn Center 3 days/week $760.50/month $880.00/month 5 days/week $1,170.00/month $1,295.00/month The level of service proposed by each is roughly similar. Staff recommends that we try Lee's on a 3 day/week basis, with a periodic review to determine whether the quality and frequency of the service is acceptable. ACTION REQUIRED Motion to accept proposal of Lee's Janitorial Service for 3 day per week service for new City Hall. CITY OF MENDOTA HEIGHTS TO: Mayor, City Council, FROM: Kathleen M. Swanson City Clerk MEMO October 31, 1988 Citx'c� strator SUBJECT: Hours of Operation, MGM Liquors INTRODUCTION We have received a request from MGM Liquors for an amendment to the liquor ordinance to allow their store to be open until 10 P.M. on Thankgiving Eve. State statutes provide that off -sales may occur until 10 P.M. on the evenings preceding holidays other than Christmas Eve. The draft version of the Liquor Ordinance did in fact provide for a 10 P.M. closing for the day before New Year's Day, July 4th and Thanksgiving. An asterisk was typed after each of these days, and a footnote was placed at the bottom of the Ordinance Section stipulating that on the evenings preceding these days offsales may occur until 10 P.M. The asterisk after Thanksgiving was apparently dropped accidentally in the final document. RECOMMENDATION/ACTION REQUIRED I recommend approval of the request and have prepared an ordinance amendment for Council review. If Council concurs in the recommendation, it should adopt Ordinance No. , "AN ORDINANCE AMENDING ORDINANCE NO. 209 (Codified as Ordinance No. 1403). Swanson City Clerk SUBJECT: Equipment Purchase INTRODUCTION The 1988 Administration budget allocates $2,100 for the purchase of a second laserjet printer and $600 for font cartridges. We have delayed the purchase to avoid having another piece of sensitive and expensive equipment to worry about moving to new City Hall, and would like to place a purchase order now for delivery to occur at new City Hall on November 10th. The State Contract for computers and printers lists a price of $2,631 (from Ameridata) for a Hewlett-Packard Series II printer and 2 megabytes of add-on memory. We have received a quotation from Bob Doffing, of Dodd Technical Corporation, for $2,616 for the same equipment. Our existing laser printer is a Hewlett-Packard Laserjet 500+, and was purchased from Dodd Technical. Our experience with both the printer and Dodd has been excellent. RECOMMENDATION I recommend that staff be authorized to purchase a HP Series II laser printer and 2 megabyte expansion board, the purchase to be charged against the $2,700 Administration equipment budget for a laser printer and fonts. ACTION REQUIRED Council should move to authorize issuance of a purchase order to Dodd Technical for $2,616 for a Hewlett Packard Series II laser printer and 2 megabyte expansion board. Y` Page 1 October 25, 1988 t' CITY OF MENDOTA HEIGHTS PLANNING COMMISSION MINUTES The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, October 25, 1988 in the Fire Station, 2121 Dodd Road. Chairman Morson called the meeting to order at 7:30 P.M. The following members were present: Morson, Anderson, Burke, Duggan, Dwyer, Krebsbach, and McMonigal. Also present were Planner Howard Dahlgren and Public Works Director Jim Danielson. APPROVAL OF Commissioner McMonigal moved approval of MINUTES the September 27 minutes as submitted. Commissioner Krebsbach seconded the motion. Ayes: 5 Nays: 0 Abstain: 2, Burke, Morson CASE NO. 88-43, Mr. Charles Thomey was present to request a THOMEY, VARIANCE five foot variance to allow installation of a canopy over the fuel pumps at the Amoco Station, 2030 Dodd Road. Mr. Thomey noted that the canopy height had been omitted from the plan submitted, and stated that the canopy would be 32 feet wide, 50 feet long and 14 feet high, plus 2 1/2 feet more for the logo, for a total height of 16 1/2 feet. He noted that the Dodd Road side of the canopy needs the five foot variance to the 20 foot setback, that the sign would be illuminated by lights below the canopy like the Fina canopy nearby, that the piers are already in place, and it would have the same dimensions as those shown in the photographs he had submitted. Mr. Thomey noted that if he was not granted the variance, he would not bother installing the canopy over only half the fuel pumps. Commissioner Duggan moved to recommend approval of a five foot variance as requested by the applicant for a canopy at 2030 Dodd Road not to exceed 16 1/2 feet in height. Commissioner McMonigal seconded the motion. Ayes: 7 Nays: 0 Page 2 October 25, 1988 CASE NO. 88-44, Mr. Fred Haas from Mary Anderson MARV ANDERSON, Construction Company was present to explain VARIANCE FOR the proposed request for three variances ENTRANCE SIGN relative to proposed entrance signs to BRIDGEVIEW their development Bridgeview Shores. He SHORES noted that the main sign, which will be installed on Bridgeview Court and Mendota Heights Road, needs a 17 1/3 square foot area variance. The second variance would be an eight foot variance to allow installation two feet from the property line, and the third variance would be a 1 1/2 foot height variance. The signs will be brick and concrete and will be on private property and the property owners will be responsible for their maintenance. The words will be dark brown concrete with light pillars. Commissioner McMonigal felt that perhaps the City's sign ordinance should be reviewed, as a 6' x 1' sign is pretty small and a sign variance had been granted to Park Place for the entrance monument also. Mr. Haas said the signs will not be illuminated, but will be placed at a 45 degree angle on the left hand side of the intersection for better site visibility. Commissioner Duggan asked why the main sign would not be placed at Dodd and Mendota Heights Road. Mr. Haas responded that the sales staff felt the proposed location would be better. Commissioner Anderson stated he sees no necessity for the signs other than as sales advertising. Once the development is full, the City is stuck with these exclusive signs and the City will be liable if there is an accident at one of these intersections, because the City allowed these signs to be installed there. The signs would last much longer than their use as sales advertising. He felt one sign might be permissible, but he felt that the City should not allow so many signs at so many intersections. Commissioner Krebsbach stated she would not be in support of the signs at the Friendly Hills neighborhood boundary since it would be too dividing of the neighborhoods. Page 3 October 25, 1988 Chairman Morson stated he was totally against the monuments. He felt that each developer was trying to outdo the preceding developer. Commissioner Burke asked if there was any future intention of either temporarily or permanently lighting the signs. Mr. Haas stated no. Commissioner Duggan felt that children will try to run across the bride sins and this would not be a very good situation. He was not thrilled with the whole thing. Mr. Haas asked the Commission if they were not happy with all the monuments, how would they feel about just the main sign? Commissioner Duggan said it should be scaled down closer in size to what is allowed by City ordinance. Commissioner Anderson felt a 12-15 square foot sign might be permissible, but not 23 1/2 square feet of sign area. Chairman Morson asked Mr. Haas if he would be willing to come back with a lesser scale. Mr. Haas responded that it seems that that might be necessary. Commissioner Anderson moved that the requested variances as proposed by Marvin Anderson Construction Company be not recommended for approval to the City Council at this time. Commissioner Duggan seconded the motion. Ayes: 7 Nays: 0 CASE NO. 88-40, Chairman Morson called the meeting to order COLON, SINGLE for the purpose of a public hearing to FAMILY SUB- consider an application from Mr. Vernon DIVISION ON TH Colon for a subdivision of land on TH 13. 13 - HEARING Mr. Colon was present to explain his proposal for a 10 lot single family subdivision on his 5.6 acre site on TH 13 between Downing and Garden Lane. Mr. Colon noted that all lots meet the minimum size requirements. Commissioner Anderson noted that this is Mr. Colon's third time at the Planning Commission for this plat. He asked why all Page 4 October 25, 1988 the trees were removed on this lot. Mr. Colon responded that all the trees were runts and that he had received a letter from the Code Enforcement Officer stating that the weeds must be removed from the property. Commissioner Anderson noted his concern with three cul-de-sacs in the plat, i.e., Miriam, Hiawatha, and the proposed new cul- de-sac off TH 13. Mr. Colon stated that seven years ago the neighbors did not want Miriam to be connected to TH 13. Planner Dahlgren noted that the developer should agree to dedicate land to connect Miriam and Hiawatha. Mr. Colon stated that the street connection would be made with a 50 foot wide street connection, rather than 60 feet as noted in earlier discussions. There was some confusion over which drawing the applicant was requesting action on and Commissioner Duggan felt the Commission should consider holding off until a better description and material is received. Chairman Morson asked for questions or comments from the audience. Mr. Gordon Diedrich, 573 Hiawatha (formerly Pierce Street), expressed concern with possible traffic in the area from TH 13. He objected to the connection with Hiawatha and Miriam. He did not want to see a. connection from TH 13 through there. Mr. William Neish, 572 Hiawatha, said the neighborhood would be ruined if the two streets are connected. He felt not enough people would use it. Mr. Helmut Kadden, 635 Highway 13, just opposite this site, felt there should be another exit from this property for safety purposes. He was glad to see single family homes proposed there and felt the street should be connected. Mrs. Delores Heidenrich,•598 TH 13, asked about Eugenia Street - is it public or private. She noted that she had been Page 5 October 25, 1988 harassed while walking on it by Mr. Schwanz. She felt it should be opened up to TH 13. Commissioner Anderson noted that Eugenia is public property and can be used by the walking public, but that it is not intended for vehicular traffic. Mr. Wayne Schwanz, 591 Hiawatha, or Lot 21, said he was the most impacted of anyone by this proposal. He noted his picture window would face the rear of the lots and he does not want to see Hiawatha or Miriam connected to TH 13. Commissioner Anderson asked Mr. Colon to consider turning his cul-de-sac around so it doesn't enter the plat off TH 13. Mr. Colon said no, he wanted action on the plat as he submitted it. Chairman Morson asked that staff provide information as to the correct width of Miriam, and what is the future use of Eugenia, will it be vacated, or what. He felt the Commission should see a drainage report prior to this being forwarded to the City Council. He also felt that if Miriam and Hiawatha are 60 feet wide, the connection should also be 60 feet in width, not 50 feet as sugVested by Mr. Colon. He asked if Euvenia will be blacktopped as a walking trail in the future. A resident at 586 TH 13 asked what will happen to the alley off Eugenia behind TH 13. Mr. Schwanz noted that he felt Mr. Colon had done a very good job in his layout of the proposed plat. There beinv no further discussion at this time, Commissioner Anderson moved to continue the public hearing until November 22, at 8:00 P.M., to give Planner Dahlgren time to review the correct plans. Commissioner Duggan seconded the motion, offering a friendly amendment that the motion should include the need for a more accurate scale drawing to be submitted to the Commission by either staff or the developer showing the exact width of Page 6 October 25, 1988 Hiawatha; information on what will happen to Eugenia and Hiawatha; and the correct dimension of Miriam. Commissioner Anderson accepted the friendly amendment, noting that all requirements required by the platting ordinance should be submitted, including names of contiguous property owners being shown on the new drawing to be submitted. Ayes: 7 Nays: 0 Chairman Morson asked for a neighborhood petition either pro or con on the street connection in conjunction with this application. He felt they only heard from 3 or 4 residents and the Commission would like more input from the residents. CASE NO. 88-45, Mr. Paul McGinley and Mr. Chuck Partridge PARTRIDGE, were present to request approval of a VARIANCE & wetlands permit and variance for 709 WETLANDS PERMIT Wentworth. Mr. McGinley noted that a single family home is proposed to be constructed at that address and placement of the home necessitates a wetlands permit allowing construction of the home within 95 feet of the wetlands area and also a 16 foot front yard setback variance is needed in order to line the home up with the adjacent homes. He noted that the front setback is 38 feet, which is still in excess of the minimum 30 foot requirement. The proposed homeowner, Mr. Tom Shields, had written approval from his contiguous neighbor to the west, Mr. and Mrs. West, but he had been unable to obtain a signature from his easterly neighbor (Somerset 19) since Howard Guthmann is out of town for 10 days. Commissioner Krebsbach moved to waive the public hearing requirement for a wetlands permit and to grant a wetlands permit and 16 foot front yard setback variance to allow construction of a single family home at 709 West Wentworth 38 feet from Wentworth, rather than 54 feet back. Commissioner Dwyer seconded the motion. Ayes: Nays: Page 7 October 25, 1988 MISCELLANEOUS Commissioner Anderson continued earlier discussions about the future of Eugenia Street, and whether it should be a bike path, or a pedestrian trail, or whether the Parks Commission should take a look at the use for it. He also felt that staff should look at the feasibility of vacating the alley referred to during the Colon public hearing and dedicating a utility easement. The Commission wondered what the proper use of Eugenia should be. The Commission also acknowledged receipt of a memo from Public Works Director Danielson relative to motions being made by the Chair. It was their concensus that the Chair could make a motion if he so desired. VERBAL REVIEW Public Works Director Danielson gave a verbal review of the Linsmayer, Lathrop, and Paster cases that had been before the City Council. ADJOURN There being no further business to come before the Commission, Commissioner Duggan moved that the meeting be adjourned. Commissioner McMonigal seconded the motion. Officer Larry Bridger approached me approximately one month ago and advised that there was grant money available through the State for Crime Prevention. By the time we got the package together, we were four days from the deadline. The grant does not involve the expenditure of any additional City money. We are asking the State to grant us $4,450. To match this, we agree to expend $5,525 for Officer Bridger's salary as well as training, equipment, and supplies that have already been budgeted. What it amounts to is we are asking the State to supplement our existing program, not a new program. 1. Council approve our grant submission. 2. Council reject the proposal, in which case we will withdraw the application. That Council approve our application for a matching grant for Crime Prevention, with the instruction that no City funds are to be expended beyond those already approved and budgeted. Our program initially focused on Neighborhood Crime Watch and was quickly successful. With over 50% of our households now involved, we are having difficulty maintaining the standards we initially set. our Macintosh network can no longer handle all of our normal business, as well as the data base and desktop publishing requirements of the Crime Prevention program. Our audio-visual equipment consists of a 12 year old slide projector and an 8 year old slide program - neither of them works very well. our increase in population and calls for service has drained our time and budget. Our 1989 budget identifies the rejuvenation of our Crime Prevention Program as our #1 objective. The addition of a new officer will free up time for training and presentation time, as well as allowing us to develop a more positive stance. We still need assistance in securing the training, equipment and supplies to build and enhance our.program. Danielson Public Works Director SUBJECT: Wagon Wheel Trail - Trail Request DISCUSSION: At their October 18, 1988 meeting Council received letters of request from several Wagon Wheel Trail area residents asking the City to install a trail along Wagon Wheel Trail. The trail segment they request is included within the City's master plan and was scheduled to be completed with the referendum that failed this past spring. There were a number of other important trail segments that were also included within the referendum and staff recommends that some system of prioritization should be accomplished before we begin completing trails on a first come request basis (see attached map of the City's trail system). OPTIONS: 1. Hold for MSA construction. Wagon Wheel Trail is an MSA street that will be upgraded to MSA standards with a 40-44 foot wide surface and curb and gutter with a trail behind the curb. This construction presently is not scheduled within the 5 year plan for completion but could be looked at for inclusion to be completed in the not too distant future. 2. Hold for referendum. The Wagon Wheel Trail, trail was scheduled for completion with the park referendum last spring that failed. Talks are currently beginning to reschedule another referendum. A widened shoulder trail could be funded and completed in conjunction with that refer- endum. efer- endum. 3. Build now. The widened shoulder option could also be constructed next year out of existing Park Funds. Estimated cost for this segment is $50,000. ACTION REQUIRED: Review the options and select a course of action. At the meeting Mr. Thomey, the station owner, indicated the canopy would be 16 1/2 feet high and would be identical to the Fins, canopy located across Trunk Highway 110. RECOMMENDATION: The Planning Commission voted unanimously to recommend approval of the requested variance. ACTION REQUIRED: If Council desires to implement the Planning Commission recommendation they should pass a motion approving a five foot front yard setback variance for 2030 Dodd Road. Attached in a drawing submitted by the applicant indicating the location of the existing station, proposed fuel tomha, and proposed canopy. The canopy is proposed to be 32 feet by 50 feat, with s rniwlrnurn distance of 14 feet -at the underside of the canopy. The canopy is proposed to be 2-1/2 feet thick at the facia line. This produces a total canopy height of 16-1/2 feet. The rnewimmunn height by Ordinance is 20 feet. 4. The coverage provided by the canopy contiguous to the pump island is proposed to be IO feat (see drawing). At the meeting Commissioner Burt Anderson stated that he felt that entrance monuments tended to segment the community and he was opposed to that. He went on to say that he felt monuments are only of value to the developer and only while he is marketing the development, they are of no value to the City or the neighborhood once the development is sold out. Burt said he was opposed to any type of entrance monuments. Others were less opposed to all monumentation but felt that Mary Anderson was overdoing it by having monuments at every entrance location. It was also the general concensus of the Planning Commission that they opposed the size of the main entrance monument. There were indications from some members that if Mary Anderson would scale down the size and extent of monumentation that the Planning Commission would consider approving it. RECOMMENDATION: The Planning Commission voted unanimously to recommend denial of the variances as requested. ACTION REQUIRED: If Council desires to implement the Planning Commission recommendation they should vote to deny the requested variances. The Zoning Ordin- ance allows in an R-1 District six square feet of name plate sign for a project of six or more dwelling units. The ordinance also regulates loca- tion, requiring a minimum 10 foot setback from any property line. Mr. Haas proposes to install monuments at every street access to his project (see drawings and letter of request). The City has allowed entrance monuments similar in size and shape at other locations (eg., Copperfield, Victoria Highlands and Kingsley Estates). ACTION REQUIRED: Planning Commission needs to review the following variances with the applicant: 1. 23 1/3 square foot name plate sign area versus an allowed 6 square foot (see drawing sheet 1 of 4). Variance requested is 17 1/3 square feet. 2. Two foot setback to the front property versus a required 10 foot setback. Variance requested is 8 feet. 3. A portion of the sign is a fence with five foot high decorative pillars. The maximum pillar height allowed is 316". Marvin Anderson Construction Company is building a single-family residential development on the old school property north of Mendota Heights Road. They propose to construct entrance signs to identify the project as "Bridgeview Shores". The signs are proposed to be located at Bridgeview Court, and a pair of entrance identification posts are to be located at the nearest street entrances of the project to the east and west. 2. First, a word about the sign regulations. Section 18.5(3) requires that all signs in all districts shall conform to the front yard setback requirements. This means that in an R-1 District any sign would have to be setback 30 feet. However, in Section 18.6(5) under the specific sign regulations for "R Districts" this Ordinance notes that any sign more than one square foot shall be setback at least 10 feet from any property line. Also, such a sign shall not be higher than 10 feet. Since the 10 foot setback regulation applies only toward residential districts, we feel that this would be the appropriate criteria. 3. Section 18.6(2) notes that a name -place sign for any dwelling group of six or more units shall not exceed 6 square feet, with no more than two surfaces. 4. The proposal is to construct a 23-1/2 square foot sign flanked on each side by a pair of posts that will be 2 feet 4 inches wide by 5 feet high. A fence is proposed to be contiguous to these two posts on the north side at the main entrance. The fence appears to be 3 feet 4 inches high at each post and approximately 3 feet high for the rails. A 3 foot high fence is allowable in the front yard up to the property line, and the post may be 6 inches higher than the 3 feet. Thus, the fence is allowable except that there is a post that is 5 feet high. Therefore, a variance to 5 feet is requested for the height of these posts which may be a total height of 3-1/2 feet. , 5. A variance is also requested for the area of the sign which can be up to 6 feet in the area that is proposed to be 23-1/2 feet. The sign is also proposed to be 2 feet from the property line as indicated on the attached site plans (see last sheet). Marvin H. Anderson, Case No. 88-44 Page 2 6. The signage, posts, and fence are to be built on private property by agreement with the land owners. 7. The minimum distance of the fence to the street right-of-way would be 2 feet. The Ordinance would allow a 3 foot fence right up to the property line, but in fact one could build a 3 foot fence (with 3-1/2 foot posts) anywhere on his/her property. Most developments in Mendota Heights have not used the project identification sign system. Portions of the Copperfield sites have been identified on a temporary basis. We have no problem with there being a permanent signage system, as long as• it is reasonably in scale with the neighborhood. Our only concern is the possibility that the signage could conflict with the line of site for traffic purposes at the intersections. The orientation of the signage is such that it is at 45 degrees with the intersection. Thus, the visual impact of the sign as proposed is considerably minimized. 8. There may be a case for moving the signage panel slightly north so as to be more than 2 feet from the north right-of-way line of Mendota Heights Road. Because of the lateness of the season and because the next Planning Commission meeting was over a month away and because staff felt the request was minimal in nature we called Chairman Morsen and requestdd that this item be added to the October agenda. Mr. Morsen agreed to allow the item to be added to the agenda provided signed letters of consent would be obtained by the applicant from his abutting neighbors. He agreed to get the required letters. Mr. Partridge's lot is located immediately west of the Somerset 19 Condominiums and the Clement Street right-of-way. Clement Street was platted through a wetlands area and will inever be built, therefore at the neighborhoodIs request Council vacated it a few years ago. The vacation has not yet been filed because of some problems with the arriving at the correct language needed for reserving an easement for the sanitary sewer that runs down the center of the street. That language is now established and the vacation can be filed. The house location proposed encroaches on the 100 feet wetlands setback by 5 feet and encroaches on an established front yard setback by 15 feet. ACTION REQUIRED: Review with the applicant: 1. Mr. Dave Ayers, President of the Curley Neighborhood Association has therefore submitted proposed play structures to the City for approval (see attached photographs). The City previously agreed to fund up to $4,000 of the cost for the play structures. Mr. Ayers orginally proposed a redwood play structure with 6 X 6 sup- port members however that type of structure is much more costly than the treated pine structure and he would get a significantly smaller unit for the same price. The structures you see in the attached photos are constructed of 4 X 4 treated pine construction and the costs for the structures would fall within the City's maximum budget of $42000. Council also indicated that if the project is deemed viable, it would like to have a workshop with the Planning Commission to discuss the land use issues involved, and mutual concerns about aesthetics. Attached is a very brief preliminary tax increment analysis done by City Treasurer Larry Shaughnessy. As you can see, Larry has determined that the pay back period should be between 8-12 years, depending on whether a sit down restaurant is a part of the project. In conclusion, staff feels that the project should be financially viable for tax increment assistance, should Council desire to proceed. Larry will be prepared to answer questions Tuesday evening, and will provide a more elaborate analysis as part of the subsequent workshop on this issue. There are numerous land use and City policy issues involved in this project, including zoning code and land use concerns, financial viability and protections, liquor licensing, etc. Staff recommends that the workshop with the Planning Commission to address some of these concerns be set for Tuesday, November 29, the 5th Tuesday in the month. If Council concurs with that meeting date, staff will be -working on back ground briefing papers that would be made available to the Council and Planning Commission prior to the November 29 meeting.
