Agenda Adoption It is recommended that Council adopt the attached revised agenda printed on blue paper. 5.m. Payment to City Hall Mechanical Contractor Attached for approval on the consent calendar is a payment to the City Hall mechanical contractor. 8.a. Copperfield IV Bid Award Please see attached memo. 9.e. Curley Tot Lot Agreement The agreement sent in the Council packet is missing pages 2 and 3. A complete agreement is attached. 9.i. Change Order for City Hall Tile The City Hall subcommittee requested the architect to provide a price for replacing some of the carpeting in the "main street" area with additional quarry tile. On the attached drawing, the newly covered areas are shown in the light colored checks. The dark checks are the area to be tiled in the existing contract. The cost for the change order is $1,937. Council should decide whether to authorize the additional tile. This expense has previously been anticipated in cost estimates. 9.j. Receipt of Planning Commission Applications Application for appointment to the Planning Commission was open through last Friday afternoon. Attached are copies of the five letters of interest received. Since appointment was not included on this evening's agenda, Council should simply vote to accept the applications, and may wish to discuss how it wishes to go about deciding on a candidate for appointment (presumably at the September 5th meeting). Eckles Civil Engineer SUBJECT: Sewers, Water, Streets Copperf field IV Job No. 8808 Improvement No. 88, Project No. 2 DISCUSSION: Bids were received for the construction of Copperfield IV utilities on Monday, August 15th. Seven contractors bid the project and Ceca Utilities, Inc. was the low bidder with a bid of $120,868.85. The Engineer's Estimate was $135,000. Ceca is currently the contractor for the Bridgeview Shores project. Councilmember Witt moved to accept the telephone system bids as presented by k. Approval of the list of claims dated July 19, 1988 and totalling $2,244,002.80. Ayes: 4 Nays: 0 BID AWARD, TELEPHONE Council acknowledged a memo from the City SYSTEM Administrator and a report and recommendation from Telephone Consultant Bill Burke regarding bids received for the purchase of a telephone system and wiring for new City Hall. Mr. Burke reviewed his report and the reasons why he is recommending rejection of the proposal from the lowest bidder. Councilmember Witt moved to accept the telephone system bids as presented by Page No. 2397 July 19, 1988 consultant Bill Burke and to award the system purchase to AirComm/T.S.I. in the amount of $12,518, and the wiring and jack installation bid to Wahl & Wahl, Inc., in the amount of $3,012, along with pre- authorization for a variation (change orders) of up to $1,500. Councilmember Blesener seconded the motion. Ayes: 4 Nays: 0 KENSINGTON PUD Public Works Director Danielson reviewed the final plat for the Kensington PUD and informed Council that the Indirect Source Permit has been issued by the State. He informed the audience that the total development of Kensington will ultimately be 500 units of townhouses, condominiums and manor homes and that the first phase of the multi -family development will consist of 136 manor homes. He informed Council that there have been no changes from the preliminary plat. After brief discussion, Councilmember Blesener moved adoption of Resolution No. 88-48, "RESOLUTION APPROVING FINAL PLAT FOR KENSINGTON PUD." Councilmember Hartmann seconded the motion. Ayes: 4 Nays: 0 DELAWARE AVENUE Council acknowledged and discussed a memo from the Public Works Director recommending that Council request Dakota County to pave a right turn lane for north bound traffic on Delaware Avenue at its intersection with T.H. 110. Mayor Mertensotto suggested that the Council should ask for turn lanes on Delaware on both sides of #110. Councilmember Witt moved to request Dakota County to install right turn lanes on both the north and south sides of Delaware Avenue at T.H. 110. Councilmember Blesener seconded the motion. Ayes: 4 Nays: 0 PROPERTY TAXES Council acknowledged a memo from the City Administrator regarding the Municipal Legislative Commission's legal challenge to the 1988 property tax bill. Page No. 2398 July 19, 1988 Councilmember Witt moved the adoption of Resolution No. 88-49, "RESOLUTION SUPPORTING LEGAL CHALLENGE OF THE 1988 PROPERTY TAX LEGISLATION," and authorization for a contribution of $2,500 from the General Fund balance to assist in defraying the cost of the lawsuit. Councilmember Blesener seconded the motion. Ayes: 4 Nays: 0 CITY HALL RADIO TOWER Council acknowledged a memo from the Public Works Director regarding installation of a radio tower at new City Hall. Mayor Mertensotto felt that the PI Rod is stronger than the Mono Pole and pointed out that it is $1,700 less expensive: the Mono Pole would cost $4,200 as opposed to the PI Rod cost of $2,500. Councilmember Blesener felt that the Mono Pole would be more aesthetically pleasing. Councilmember Witt pointed out that if the PI Rod were chosen, there would be additional cost to install a safety shield. After discussion, Councilmember Blesener moved to authorize the purchase and installation of a Mono Pole radio tower at new City Hall. Councilmember Witt seconded the motion. Ayes: 3 Nays: 1 Mertensotto STREET LIGHT Council acknowledged a memo from the Public Works Director regarding installation of a street light on Lexington Avenue at Marie and at Avanti. Councilmember Witt stated that she is not in favor of a light at the intersection if it must be the NSP standard light, and asked if there are any other types of lights available other than the NSP standard light. Public Works Director Danielson stated that NSP does have a residential type light but that if the NSP poles are used, the standard light must be installed. Mayor Mertensotto stated that Council must adopt some standards for decorative lights Page No. 2399 July 19, 1988 and directed that the matter be placed on an agenda in the near future. PLANNING COMMISSION Mayor Mertensotto informed the Council that he has received a letter from Planning Commission Vice Chairman Stu Henning stating that his job demands so much of his time that he cannot continue to serve on the commission, and that he was therefore resigning immediately from the Planning Commission. Councilmember Hartmann moved to accept with much regret the immediate resignation of Stuart Henning from the Planning Commission. Councilmember Blesener seconded the motion. Ayes: 4 Nays: 0 The City Administrator was directed to submit press releases to the local newspapers requesting applications for appointment to the Commission. IVY HILLS DRAINAGE In consideration of the 7:00 pre -Council meeting discussion with the Ivy Hills residents, Councilmember Blesener moved adoption of Resolution No. 88-44, "RESOLUTION REQUESTING THE LOWER MISSISSIPPI RIVER WATER MANAGEMENT ORGANIZATION TO COMPLETE A FEASIBILITY STUDY ON THE IVY HILL PARK REACH," as amended to reflect changes discussed at the pre -Council meeting. Councilmember Witt seconded the motion. Ayes: 4 Nays: 0 RECESS Mayor Mertensotto called a recess at 8:10 P.M. The meeting was reconvened at 8:15 P.M. HEARING -- LEXINGTON Mayor Mertensotto opened the meeting for HEIGHTS APARTMENTS the purpose of a public hearing on the HYDRANT ASSESSMENTS proposed assessment roll for the Lexington Heights Apartment hydrant installation project. Mayor Mertensotto asked for questions and comments from the audience. Councilmember Witt moved adoption of Resolution No. 88-50, "RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR FIRE HYDRANT INSTALLATION TO SERVE LEXINGTON HEIGHTS ADDITION (IMPROVEMENT NO. 86, PROJECT NO. 14)." Councilmember Hartmann seconded the motion. HEARING -- CREEK Mayor Mertensotto opened the meeting for REALIGNMENT ASSESSMENT the purpose of a public hearing on the proposed assessment roll for the Willow Springs Addition creek realignment project. Mayor Mertensotto asked for questions and comments from the audience. Mayor Mertensotto noted that the entire assessment was being levied against one lot, and Public Works Director Danielson responded that the lot is proposed to be divided into three lots but the final plat has not yet been approved. He informed Council that the property developer has agreed to accept the total assessment. There being no questions or comments from the audience, Councilmember Hartmann moved that the hearing be closed. Councilmember Witt seconded the motion. Public Works Director Danielson responded that there is some work to be done on the boulevards and storm sewer that will be completed this summer. He stated that he will meet with Mrs. McDonald to see how she wants her boulevard area completed. Mayor Mertensotto informed the audience that staff recommends that if the vacation is approved the City retain a 10 foot utility easement over the northerly portion of the right-of-way and a 20 foot easement over the southerly portion for a pedestrian trail. He informed the audience that Ms. Jan Peyer has requested the vacation so that the vacated right-of-way area could be added to her adjacent lot and she would have sufficient area to divide three platted undersized lots into two lots. He stated that Council could approve the lot division without vacating the right-of-way and stated that it wouldn't make sense for the City to give the land away when it needs easements over the entire area. Ayes: 4 Nays: 0 HEARING -- EUGENIA Mayor Mertensotto opened the meeting for STREET VACATION the purpose of a continued hearing on a request for the vacation of a portion of the Eugenia Street right-of-way. Page No. 2402 July 19, 1988 Mr. Wayne Schwanz showed the Council pictures of the area and stated that the residents are asking for the vacation of all of the right-of-way to Hiawatha and that he would like to see vacation of all of the right-of-way and retention of only the 10 foot utility easement. He stated that the City vacated the alley in Block 2 a year ago and kept a 10 foot easement. He stated that most of the people have built garages on the easement area. He informed Council that he has personal use for the right-of-way that abuts his lot as does Ms. Peyer, and complained about people driving onto the right-of-way, drinking and creating a nuisance after the Lilydale Park closes at night. He stated that the residents are requesting an unencumbered vacation of Eugenia. Mayor Mertensotto stated that the City would be giving away its options if it vacated the right-of-way and if the area were needed in the future the City would have to buy it back. He did not feel that the vacation would be in the best interest of the City, and pointed out that the right-of-way may be needed for some public purpose in the development of the adjacent undeveloped land. Councilmember Witt asked whether the right- of-way could be blockaded so that traffic doesn't go through the area. Councilmember Blesener expressed her hesitation to vacate the area when there is undeveloped land adjacent to it and felt that such action would be premature. Councilmember Hartmann stated that Mr. Colon's past proposal for developing the adjacent land showed a connection of Miriam and Hiawatha and never included any plan for a through street on the right-of-way. ! Mr. Schwanz stated that he needs to build a garage and that he doesn't think retaining an easement would be beneficial to the City. Councilmember Blesener moved to close the hearing. Motion died for lack of a second. Councilmember Witt stated that she is in favor of vacating Eugenia. It was pointed out by the Public Works Director that the hearing notice only included the area of the right-of-way adjacent to the Peyer lot because the request was originally made by Ms. Peyer in connection with her subdivision application— Councilmember Blesener moved that the hearing be closed at 8:54 P.M. Councilmember Witt seconded the motion. Councilmember Witt moved to adopt the proposed resolution approving the vacation of Eugenia. Councilmember Hartmann seconded the motion. The motion failed for lack of majority. CASE NO. 88-19 Mayor Mertensotto reviewed the history of C.G. REIN the proposed development for the audience. He stated that 34 lots in the Mendakota Estates Planned Unit Development were platted as single family residential and the balance of the land was platted as Outlot A, to be developed into 106 apartment units, and public open space. He informed the audience that C.G. Rein's application is to develop 106 units on Outlot A. He noted that there has been some discussion as to whether the legal opinion received from the City Attorney's office on the Council's original majority vote on the P.U.D was valid and there has been a question raised over possible conflict of interest in the City Attorney's office. He stated that because of this question, the City has requested and received an opinion from Attorney Tim Kuntz, from the firm of LeVander, Gillen, Miller, Anderson & Kuntz. He then asked Page No. 2404 July 19, 1988 Mr. Kuntz to review his opinion regarding procedures for granting a Planned Unit Development. Mr. Kuntz stated that he was asked by the City to give an opinion on the number of votes required for approval of a Planned Unit Development. He stated that State Statutes require a 2/3 vote for rezonings, which would translate to a 4/5 vote of the Council, and that a conditional use permit requires a simple majority vote. Mr. Kuntz stated that the issue presented was in the context that the vote taken in 1986 was a three to two vote. Mayor Mertensotto clarified that the vote was three to one, with one member absent. Mr. Kuntz stated that the question asked of his office is whether a Council may by conditional use permit give approval to a PUD and if so, what is the authority for doing so. He stated that Section 19 of the zoning Ordinance stipulates the procedure for granting a conditional use permit and S that the manner for granting approval of a PUD is by way of a conditional use permit. He informed Council that the objective of the PUD in the ordinance is to allow mixed uses and that the Supreme Court has defined a conditional use permit as a legislative decision by the City Council that those uses which are subject to conditional use are in fact allowable uses if they meet the standards the Council may impose. Mr. Kuntz stated that with this particular PUD it is clear that there is a mixed use, single family and multiple residential, and that it is his opinion that Council may approve the PUD with mixed use as a conditional use without rezoning the underlying district. Mr. Kuntz cited case law and treatises and stated that perhaps most importantly, the legislature in 1982 passed a law which expressly states that cities have the right to grant conditional use permits for all developments, including Planned Unit Developments. He stated that it is his opinion that the statute is a response by the legislature to the court case referenced in his written opinion and the Page No. 2405 July 19, 1988 procedures followed in many Minnesota cities. He noted that the statute provides that in granting a conditional use permit, the notice and hearing procedures have to be the same as rezoning and that if a CUP is to be granted Council must let everyone know what is proposed. Mr. Kuntz stated that in his opinion if that procedure was followed (in the original action) Council may proceed by majority vote to grant a conditional use permit for this development, which does in fact continue the mixed uses. He observed that it is often said in such cases, are you not changing uses in that the underlying zoning calls for single family. In a sense, he noted, every conditional use permit changes uses, and he pointed out that the City has listed planned unit developments as a conditional use in its ordinance and has established a rather demanding format and safeguards in addition to the hearing notices. He stated that it is his opinion that the ordinance does permit the Council to grant a conditional use permit by majority vote. Mayor Mertensotto stated that it should be made clear that based on Mr. Kuntz' opinion, the original conditional use permit granted in 1986 on a 3 to 1 vote was for the entire parcel. Mr. Kuntz stated that it is his opinion that that vote which passed was in fact an effective vote and Council had approved what was in front of it at that time, overall conceptual approval of that planned unit development, and that what has been submitted by C.G. Rein is a refinement of that plan. Mayor Mertensotto pointed out that 106 apartment units were granted for Outlot A in the 1986 action, and that what C.G. Rein is asking for is approval of the final development plan for the 106 units. Mr. Kuntz stated that it is his opinion that the density calculations were established for the entire site at the time approval was given to the PUD, and that approval of the final development plan can be by majority vote under City ordinance. Page No. 2406 July 19, 1988 Councilmember Blesener stated that it is unclear to her whether Council would be approving a conditional use permit for the specific 106 units as opposed to approving a final development plan for this portion of the PUD, and asked for clarification. Mr. Kuntz responded that it is his understanding that in 1986, by the granting of the conditional use, Council in effect said with respect to the totality of the site, that it agreed that there could be 106 units on Outlot A and 34 on the other portion of the development subject to the developer coming back to the Council for final approval as to the particular 106 units the developer wants to construct on the site. He observed that this is what is currently happening; the developer is coming forth because of the 1986 action and showing Council how the 106 units will look. Councilmember Blesener stated that Council already granted a conditional use permit to build 106 units on the outlot and asked why it is now considering granting another conditional use permit. She asked whether Council should now be approving a final development plan for the original conditional use permit. Mr. Kuntz responded that it is a question relating to staging and phasing and that in the zoning ordinance there are steps for preliminary and final approval and refinements along the way, and that Section 19 of the ordinance calls for a conditional use permit, which is the action to be taken. He stated that it has been the position of the planning staff in their processing of the application, that in 1986 the permit was clearly given for 106 units and that any extension or refinement of the particulars of it at any time must be granted by conditional use permit.He stated that insofar as it relates to this particular development, Council did not have the plans for what it would look like in 1986. He further stated that typically approval would be in line with the preliminary drawings, but when a final plan comes, everyone knows it is going ahead Page No. 2407 July 19, 1988 because there was preliminary approval. In this instance, in 1986 Council voted on an allocation of lot lines and an allocation of density, he stated. He pointed out that this is the first time Council has seen what this project would look like and that the City needs to afford itself the right to pass on that plan, and would do that as a conditional use permit. Mr. Kuntz stated that Council has allocated densities and given concept approval and the applicant is now coming in with the "bread and butter" and Council has to decide if the proposal meets its standards - theoretically the 106 units and how they integrate into the community could be different. Administrator Frazell stated that what is being considered tonight is a preliminary development plan approval and granting of a conditional use permit, that the first stage set forth the densities and this action sets the particulars. Mr. Bernard Friel asked if what Mr. Frazell is saying is that the ordinance of the City requires the granting of two conditional use permits for planned unit developments for this particular property. He stated that this is what is being done and that the notice calls for a hearing for 106 units. He asked whether it is being stated that two conditional use permit approvals are necessary for a single planned unit development. Mr. Frazell responded that this is correct in staff's interpretation, and that he doesn't know what else'it would be called. Mr. Kuntz stated that the idea of segregating this district from the entire tract is not what the City has done in terms of its PUD approval: what the City has done is looked at the totality and has planned for the totality. He stated that Council has afforded itself the maximum opportunity to deal with the totality and that Council did not deal with the specifics in 1986 but rather specifically addressed the number of multiple and single family units. He stated that Council has Page No. 2408 July 19, 1988 afforded itself the maximum opportunity to analyze what is brought in front of them and that whether there is one CUP or however many, its approval of a Planned Unit Development is by conditional use permit. Administrator Frazell pointed out that this is consistent with the information the public was given in 1986, and that he remembers people asking then whether there would be public hearings when the development of the property came up. He stated that staff has taken the route that would give a maximum opportunity for public hearing. Mayor Mertensotto stated that if he understands Mr. Kuntz correctly, the density on Outlot A of 106 units is nondiscretionary to the Council, having been approved by the City Council in 1986 and that whether it is called a conditional use permit or whatever, the preliminary development plan for the 106 units can be done by a majority vote. Mr. Tim Marx, from the Briggs and Morgan firm and representing Mr. Friel, stated that Mr. Friel's position on the matter dating back to 1986 has beenno secret. He stated that he believes that the original approval in 1986 was in fact a rezoning and requires a 4/5 vote. He stated that Mr. Kuntz allows that Council can approve a PUD with a conditional use permit that has the affect of rezoning without actually rezoning, but that he (Mr. Marx) believes that if you are doing a rezoning you must follow those procedures. He stated that Council is doing both and must follow both procedures. He suggested using the commonsense notion that if one looks at state law and City zoning ordinances a commonsense approach would yield the result that you have to have a 2/3 vote. He stated that state statute says you must have a 2/3 vote for rezoning and the statute enacted in 1982 says that Planned Unit Developments can be processed as conditional use permits by majority vote. He indicated that commonsense notion says that if it is possible, let's apply both; the City is required to give affect to both Page No. 2409 July 19, 1988 statutes if it can do so and that you can question PUD, but not rezoning. He stated that if the PUD were only for single family you could do it, but if you are doing a rezoning, you must have a 2/3 vote and that if your are doing both it is possible to comply with both statutes. Referencing the zoning ordinance, Mr. Marx stated that, particularly as amended last year to create a PUD district, the City has a dual notion under its own zoning ordinance. He then read section 19.22 of the ordinance and stated that the City is recognizing that there can be dual zoning within a PUD district, and then cited Section 5 of the ordinance. He stated that he finds it very interesting that Section 10A of the ordinance creates a PUD district and rezoning to a PUD district. He stated that he and Mr. Friel feel Council has to do both a PUD and rezoning and that if Council is approving .a preliminary PUD by conditional use permit, it is violating the underlying density requirements of Outlot A as it is zoned single family. He stated that Outlot A is 10.6 acres and would only allow 30 units under the underlying zoning requirements. Mayor Mertensotto stated that to clarify, Mr. Kuntz is rendering the opinion to Council that the prior Council has set the density on Outlot A at 106 units and that that is non -discretionary to Council. He stated that what is discretionary is what the 106 unit development consists of: the density has been determined at 106 units in the PUD for the development. Councilmember Blesener asked Mr. Kuntz to respond to the statement that Council is approving a conditional use permit tonight and is violating the underlying zoning. Mr. Kuntz responded that he thinks the concept is being analyzed perhaps because that is the nature of a PUD. The underlying zoning in this instance, he stated, is the R-1 zoning designation, but it is all judgement that in light of the City ordinances Council has set that it can apply a conditional use permit within the structure of a PUD which will allow a Page No. 2410 July 19, 1988 developer the creativity and flexibility they ask if they meet City standards. He stated that he thinks it is significant when the legislature calls out that planned unit developments may be granted by conditional use permit and that he thinks the legislature has given cities the authority to exercise that flexibility as long as there are standards and there is public hearing. Mr. Marx stated that the hearing notice says that the Council is considering a conditional use permit for a planned unit development on Outlot A which is only 10.6 acres, and that if that is the action, Council must apply the rezoning. He stated that this is a procedural point but a valid one. Administrator Frazell stated that in his presentation Mr. Marx referenced the Planned Unit Development District which was only intended to apply to the southeast area of the City. He stated that it seems to him like it is an argument of form over substance: Council promised the area residents that it would hold a hearing to discuss the developing of Outlot A. He observed that if Council had done what Mr. Marx is suggesting, it would just be looking at a building permit, and Council would have been approving something without seeing it. He stated that this process has afforded the public an opportunity to participate in how the property was to be developed. He then read a memorandum from Planner Dahlgren regarding Planned Unit Developments. Mayor Mertensotto stated that the developer has proposed and is willing to realign the proposed buildings so that they are 100 feet back from the westerly boundary of the new dedicated right-of-way line of T.H. 149 and has realigned the access point into the project from and through Mendakota Drive rather than access to Dodd, as the Council had directed. Councilmember Blesener stated that she thinks Council needs to see the connection from the parking lot to Mendakota Drive and subject to that plan, and if the park plan Page No. 2411 July 19, 1988 shows it should be moved 15 feet to the right, for example Council should have that option. She also stated that in 1986 she made her position clear that she was very much opposed to 106 units on'the outlot, and that Council is told that 106 units is not discretionary tonight, but rather that Council is addressing a preliminary development plan for the specific design of the 106 units. She stated that she is satisfied with the plan as submitted, retaining some flexibility. Mayor Mertensotto stated that if he had been on the Council in 1986 he would not have been in favor of the project, 106 units on the outlot, and that he is concerned about the overall site, traffic, location of the units on the site should be easterly, and that he is not happy with the open space layout. He felt that the open space will just be a maintenance headache. Councilmember Witt stated that she doesn't like to see apartments, but Council approved the concept in 1986 subject to close scrutiny. She felt that Council has scrutinized the proposal and addressed the neighbors' concerns. Councilmember Blesener stated that if the 106 units is a given, she is satisfied that Council has done the best it can and that this would be a very high quality development. Mayor Mertensotto pointed that this is the third time the Rein plan has been before the Council and that Council has been advised that the PUD was approved by conditional use permit in 1986 so Council is bound by the density. Councilmember Witt moved adoption of Resolution No. 88-57, "RESOLUTION APPROVING CONDITIONAL USE PERMIT FOR A PLANNED UNIT DEVELOPMENT," subject to the addition of a fifth condition that the Council retains flexibility regarding location of access to Mendakota Drive, to be determined after Page No. 2412 July 19, 1988 completion and review of the park plan. Councilmember Hartmann seconded the motion. Ayes: 3 Nays: 0 Abstain: 1 Mertensotto BETH JACOB PARKING LOT Representatives of the Beth Jacob Synagogue informed Council that they plan to occupy their facility on July 21st and just became aware today that one of the City's requirements for this type of project is a paved parking lot. They stated that paving was originally included in the plans but that they had substituted class 5 gravel because of cost overruns on the project. The representatives informed Council that the Code Enforcement Officer will do a final inspection on the facility tomorrow and has informed them that he cannot issue a certificate of occupancy unless they receive approval of the parking lot change. They stated that they hope that within the next two years the lot will be paved and asked that the requirement be temporarily waived. Councilmember Blesener stated that she can understand a short-term variance to allow the certificate of occupancy, but that paved parking lots is a standard in the City and she would not be in favor of more than a 30 day variance. The Synagogue representatives stated that if they had known paving was required, they would have cut something else in the project, but they were not aware of the requirement. Administrator Frazell responded that the plans originally shown to the Council included paving, that the City staff was not informed of the change order, and the project architect certainly should have known that it was required. Mr. Sweet, one of the representatives, stated that it was the architect who suggested deleting the paving to save $12,000. He informed Council that the Synagogue just learned of the requirement this morning and would not have cut the Page No. 2413 July 19, 1988 paving if they had known of the requirement. Councilmember Blesener stated that she would be willing to approve an extension of the deadline for paving to September 1st. Mr. Sweet asked whether Council would give the Synagogue until April to meet the requirement. Councilmember Witt pointed out that she feels the Synagogue has a good argument with its architect, and suggested that Council allow 90 days before the pavement must be installed. After discussion, Councilmember Blesener moved that the deadline for paving of the Beth Jacob Synagogue parking lot be extended to October 15th so that a certificate of occupancy can be issued without the paving being in place before the July 21st planned occupancy date. Ayes: 5 Nays: 0 SEAL COAT Councilmember Cummins moved approval of BID AWARD the 1988 seal coat bid award, awarding the contract to Allied Blacktop Company for their low bid of $22,244. Page No. 23-3 August 2, 1988 CASE NO. 88-15, Mayor Mertensotto noted that this item was PERRON, LOT SPLIT continued from the June 21 meeting, and that staff had researched into other areas of the City where variances had been granted. Mr. and Mrs. Perron, 1940 South Lane, were present for the discussion. City Administrator Frazell reviewed the Perron request for approval of a lot split, of their 185 foot wide lot to allow a new home to be constructed on an 85 foot wide newly created lot. He noted that according to City ordinance language, the "hardship" must be unique to the property, not to the property owners, and that if literally enforce, would deny the property owner any reasonable use of his property. He cited four previous cases of variances that were granted as noted by the Perron's at the previous meeting. Mayor Mertensotto noted his main concern was with setting a precedent in this case if the lot split were approved. He felt that since many of the homes are on large lots, the City may receive many more requests to subdivide the lots to allow construction of a new home, and if this were granted for the Perron's, in the future many more variances would have to be granted. Ayes: 5 Nays: 0 CASE NO. 88-15, Mayor Mertensotto noted that this item was PERRON, LOT SPLIT continued from the June 21 meeting, and that staff had researched into other areas of the City where variances had been granted. Mr. and Mrs. Perron, 1940 South Lane, were present for the discussion. City Administrator Frazell reviewed the Perron request for approval of a lot split, of their 185 foot wide lot to allow a new home to be constructed on an 85 foot wide newly created lot. He noted that according to City ordinance language, the "hardship" must be unique to the property, not to the property owners, and that if literally enforce, would deny the property owner any reasonable use of his property. He cited four previous cases of variances that were granted as noted by the Perron's at the previous meeting. Mayor Mertensotto noted his main concern was with setting a precedent in this case if the lot split were approved. He felt that since many of the homes are on large lots, the City may receive many more requests to subdivide the lots to allow construction of a new home, and if this were granted for the Perron's, in the future many more variances would have to be granted. Councilmember Hartmann seconded the motion. Ayes: 5 Nays: 0 CURLEY TOT LOT Mr. Dave Ayres was present for the discussion regarding tot lot improvements on Lot 10, Block 1, Curley's Valley View. Mayor Mertensotto expressed his concern over what would happen if the neighbor's disbanded - who would maintain the park and who could the Council contact with their concerns? He felt there should be a default provision in a written developer's avreement so that future council could deal with this property. Councilmember Cummins asked who will mow and maintain the park. He felt the neighbors should be responsible for that aspect. It was determined that the concensus of the Council was to proceed with the proposal by drawing up an agreement with the property owners. Councilmember Witt stated she opposes the proposal, as she has stated on previous occasions. She felt that the City would be creating a substandard size park, there would be increased liability and maintenance, that it was an inappropriate use of City monies, and that this would be setting a terrible precedent. Page No. 23-7 August 2, 1988 Councilmember Hartmann said he does not want to see staff or public works personnel maintaining the park, that this should be the responsibility of the neighborhood association. After further discussion, Council directed staff to draw up an agreement for their review and endorsement. CASE NO. 88-27, Mr. Steven Patrick, 737 Mendota Heights PATRICK, SUB- Road, was present to request approval of a DIVISION subdivision of his 6.75 acre property. He proposes three new lots, plus the lot his present home is on, and an out lot. He plans to sell the lots for single family homes, while maintaining his existing home. This property is located south of Mendota Heights Road, and across the street from the Marvin Anderson Homes single family development. Mr. Patrick noted that Mr. Irving Clark owns property to the west and south of his, and that Centex Homes is planning to build multi -family homes to the east of his site. He described his property as secluded, and very hilly and wooded. Two of the proposed new lots would contain over 20,000 square feet, and the 4th lot would have almost 53,000 square feet of area. Access to Lots 1, 2, and 3 (which is the Patrick residence) would be via a proposed public cul-de-sac on the west side of the Patrick property. Mr. Patrick stated that he has a purchase option on Mr. Irving Clark's to the west, and that Mr. Clark is in favor of developing the remainder of his land, but at present has no plans prepared for future development. Both Mr. Patrick and Mr. Clark noted that the proposed plat shows a temporary cul-de-sac, but that at some time in the future, this could be extended to serve the remainder of the property to the south, east or west. Council advised Mr. Patrick that this property is in airport noise zone IV, and that potential buyers must be made aware of this, and also be advised that the temporary cul-de-sac will be extended in the future. Mayor Mertensotto felt that both Mr. Page No. 23-8 August 2, 1988 Patrick and Mr. Clark should be committed to single family homes for this land, not just four single family homes surrounded by multi -family units. Mr. Irving Clark arrived at this point, and noted that multi -family homes are designated for the area along the freeway according to the City's Comprehensive Plan. Mr. Clark also stated that he is receptive to Mr. Patrick's proposal, but that he has no specific plans for development of the remainder of his land. Mayor Mertensotto felt comfortable on the R-1 zoning but wanted to see what is planned for the Clark property also. Mr. Patrick responded that he couldn't purchase more of the Clark property until he is able to sell his proposed three new lots. He noted that he has a purchase option on the Clark property to the west, but not on the south property. Councilmember Hartmann noted that he would like to see a unified treatment of the Clark property, considering what would be developed on both sides. After much discussion about the proposal, Mr. Patrick noted that he had no further interest in the Glewwe home which he had originally planned to move onto one of his newly proposed lots. Councilmember Blesener moved to table this request to the August 16 Council meeting and asked that the developer or owner of the surrounding properties be present for the discussion. Purchase of Cellular Phone Equipment Attached is a memo from Police Chief Dennis Delmont, requesting the purchase of two cellular phones at $699 each. The $1400 necessary for this purchase can be taken from the fund balance of the Emergency Preparedness Fund, a special fund dedicated for civil defense activities. Apparently cellular phone technology has now become cost• effective for emergency operations and is the "coming thing" in such departments. Fire Chief Maczko is also requesting the purchase of one cellular phone in his 1989 budget request. I concur in Chief Delmont's request. However, since this is our foray into the cellular phone business, I felt Council should be explicitly advised of it and authorize the purchase. KDF:madlr attachment Mendota Heights Police Department MFMORANDt DATE: July 26, 1988 TO: City Administrator FROM: Chief of Police SUBJECT: Purchase of Cellular Phone Equipment I would like to purchase two NEC Cellular telephones for use by the Police Department and in our Emergency Preparedness function. These phones, under the Minnesota State Purchasing Contract, are $699 each and are portable. Emergency Preparedness We planned to use cellular telephones when we completed our Emergency Operating Center at the new Police Station. The need for communications when land lines are down is imperative. Radios are only effective if you need to contact someone else with a radio. When phone lines are down or are jammed, the cellular phone allows for an immediate link between the "on -scene', commanders and the administrators. This type of portable and private communication will also be very effective when the dispatch center is jammed with transmissions from responding police, fire and medical units. Police Department We have discovered a real need for these phones in the Police Department in the past couple of months. During a surveillance of a major drug dealer in our area, officers from three departments, lacking a common radio frequency, used cellular phones to keep in contact with each other. Our representative borrowed a phone from South St. Paul. The result of the surveillance was the arrest, at Dodd and 110, of two drug dealers who were using a Mendota Heights business place as their base of operations. In a second undercover operation, Sergeant Wicks worked with a team of officers to keep track of a known burglar who extensively used a monitor to listen to our radio frequencies. When information on the suspect's movements was called in to the Department, radio transmissions would have tipped the operation off. Carol Bakka called the Department of one of the other officers }- and- and they relayed the information by cellular phone. As a result, the operation was not compromised. A recent surveillance of a man suspected in the ongoing thefts of over $5,000 worth of truck tires was compromised when Mendota Heights officers had to use the radio to keep abreast of the suspect's movements. The suspect called the Police Dispatcher and told him that he was aware of the activities of our officers. These, and many more cases illustrate the effectiveness of the phones. Cast The cost of cellular equipment has come down tremendously in the past year. The West St. Paul Police Department recently spent $1298 for Panasonic equipment, and they are charge4 approximately twice the available rate for access and air time charges. We have the opportunity to purchase the NEC phones for $699 each. The municipal access charge will be $4.95 per month, and air time is .30 per minute from 8 am to 6 pm, and .15 per minute outside those hours and on week ends and holidays. Purchase price is $1398 ($699 x 2) for the phones, battery packs, chargers, etc. The ongoing charges would be $9.90 per month access and the cost of the actual air time. This month alone has accounted for 27% of our runs for the year. 15 of the calls that we responded to involved fighting grass fires. The largest of which occurred in our city on 6/17/88. A train traveling on the Soo line tracks at approximately 11:15 am started a grass fire that burned from the mendota bridge to highway 55. Our department was assisted in controlling the blaze by Inver, Grove Heights and Eagan. The high temperatures and wind on the 17 made the blaze tough to fight. Three firefighters, two from Eagan and one from our department, were overcome by heat and smoke and required treatment and another firefighter from our department suffered a twisted knee. The Department also Responded to a piece of construction equipment on fire at the new school district bus facility. The operator of the equipment recieved second degree burns on the upper half of his body and was treated by firefighters and paramedics. The fire was very tough to extinguish do to the amount of hydraulic fluid, oils and fuel that were present, gest St. Paul was called to bring us additional foam and also responded to a second call for us. The Department also responded on four Mutual Aid calls for the month. Two to Eagan, one grass fire and one call for the boat to help drag the river for a drowning victim near the Cedar Avenue bridge. Two to Inver Grove Heights, one to help on a grass fire and the second to move up to cover while Inver Grove went to help at the Hastings Senior home fire that occurred on 6/12/88. We initially went to IGH at 12:09 pm and then at 2:00 pm we were requested to respond to Hastings for relief. This month was a good example of how strong and benificial our mutual aid organization is within the County responding to four calls for help from County departments and recieving help in the two instances we requested it. MONTHLY TRAINING The monthly training was spent conducting live smoke drills and then finally burning the structure down at 2288 Dodd Road. Firefighters worked on search and rescue techniques under live smoke conditions, attacking and controlling two live burns on the interior of the residence and the on exposure protection when the house was finally burned. However, as the "custodians" of City information, records, and resources, staff often will be called upon to have some level of interaction with Council candidates, both incumbents and challengers. In order to avoid putting the staff in the position of having to make sensitive judgement calls, I am proposing that the attached policy be adopted. The policy is brief, and certainly not exhaustive. However, it does provide some guidelines for the type of information and resources which will be made available to candidates for elective office. If adopted by Council, this policy would be distributed to candidates at the time of filing. ACTION REQUIRED If Council concurs that the City ought to have some policy with regard to elections, it should consider the attached proposal, making any amendments deemed appropriate, then pass a motion adopting,the policy. In an effort to be fair and equitable to all candidates, both incumbents and challengers, the following guidelines are hereby adopted: 1. Upon filing for an elective office, the name of the candidate will be placed on the mailing list to receive all information materials sent collectively to the City Council, including agenda packets for Council meetings. These materials will be provided at City expense. One exception would be confidential items (i.e. personnel concerns, pending litigation, etc.) 2. The City Administrator will make himself and other staff mem- bers reasonably available to Council candidates to provide general and factual information about City operations, programs,• and procedures, and policies. If the staff receives a request for information that, in the City Administrator's opinion, would require a significant devotion of time and/or monies to produce, the request will be brought to the City Council for a decision. If the Council decides to order preparation of the material, copies will be furnished to all Councilmembers and Council candidates.. 3. As a public service, the issue of the City newsletter distributed immediately prior to the election will list the candidates for each office, along with a brief biographical sketch. Director SUBJECT: Pabst Street Vacation DISCUSSION: The Pabst's recently sold their facility in Mendota Heights to Lloyd's Meats and retained some vacant land behind the property. That vacant property was to be served by extending a street north from Mendota Heights Road across from Northland Drive (see attached map). The Pabst's now have had a preliminary plat approved subdividing that parcel into three pieces. One piece is to be attached to Lloyd's property, one to Foto Mart, and the remaining northerly piece to be served off from Perron Road. The r -o -w east of the Lloyd's lot is no longer needed and Lloyd's have requested that it be vacated. RECOMMENDATION: Staff recommends that the request by Lloyd's Meats to vacate the r -o -w east of the property be approved as requested. ACTION REQUIRED: Conduct the required public hearing and if Council desires to implement the staff recommendation, they should pass a motion adopting the attached Resolution No. 88-_, "RESOLUTION APPROVING VACATION OF A STREET RIGHT-OF-WAY." Director SUBJECT: Mendakota Estates Easement Vacation DISCUSSION: The final design of the Mendakota Estates plat provided for running both sanitary sewer and watermain down the lot lines between Lots 19 and 20, as opposed to running one down the lot lines between Lots 18 and 19 as the developer proposed. Separate easement agreements were signed to widen the easement between Lots 19 and 20 to 35 feet. The easement between Lots 18 and 19 can be reduced to a normal ten feet. (See attached site plan). Costs for this project are approximately 50% of what was presented at the feasibility hearing because of the TIF and MSA participation. JED:madlr attached City of Mendota Heights Dakota County, Minnesota RESOLUTION NO. 88 - RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR COMMERCIAL DISTRICT STREET LIGHTS TO SERVE MENDOTA HEIGHTS INDUSTRIAL/BUSINESS PARK, CAREW BUSINESS CENTER, INLAND INDUSTRIAL PARK, MEDALLION INDUSTRIAL PARK YORKTON CENTRE POINTE SOUTH & NORTHLAND PLAZA (IMPROVEMENT 86, PROJECT 11) BE IT RESOLVED by the City Council of the City of Mendota Heights as follows: WHEREAS, the City Clerk, with the assistance of the City Engineer, has calculated the proper amount to be specially assessed for the costs incurred to date with respect to Improvement No. 86, Project No. 11 construction of commercial district street light improvements to serve the following des- cribed property situated in the City of Mendota Heights, Dakota County, Minnesota, more particularly described as follows: Mendota Heights Industrial/Business Park, Carew Business Center, Inland Industrial Park, Medallion Industrial Park, Yorkton Centre Pointe South, and Northland Plaza. WHEREAS, the proposed assessment roll has been on file with the Clerk and at all times since its filing has been open for public inspection; and notice thereof has been duly published and mailed as required by law. Said notice stated the date, time and place of such meeting; the general nature of the improvement; the area proposed to be assessed; that the proposed assessment roll has been on file with the Clerk; and that written or oral objections thereto by any property owner would be considered; and WHEREAS, said hearing was held at 8:15 o'clock P.M. on Tuesday, August 16, 1988, at the City Hall in the City of Mendota Heights, Minnesota; and WHEREAS, the Mayor announced that the hearing was open for the consideration of objections, if any, to said proposed assessments; and WHEREAS, all persons present were then given an opportunity to present oral objections, and all written objections theretofore filed with the Clerk were presented and considered. NOW THEREFORE, this Council, having heard and considered all objections so presented, and being fully advised in the premises, and having made all necessary adjustments and corrections, finds that each of the lots, pieces and parcels of land enumberated in the proposed assessment roll was and is specially benefited by the construction of said improvements in not less than the amount of the assessment, as corrected, set opposite the descrip- tion of each such lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied against each of the respective lots, pieces and parcels of land therein described; and BE IT FURTHER RESOLVED, that the proposed assessment roll is hereby adopted and confirmed as the proper special assessment for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with interest at the rate of eight percent (8%) per annum accruing on the full amount thereof from time to time unpaid, shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment as to street lighting shall be payable in equal amounts extending over a period of ten (10) years; the first of said installments, together with interest on the entire assessment co- mmencing thirty (30) days from the date hereof to December 31, 1988, to be payable with general taxes for the year 1988, collectible in 1989 (now designated as real estate taxes payable in 1989), and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes for each con- secutive year thereafter until the entire assessment is paid; and BE IT FURTHER RESOLVED, that prior to September 16, 1988, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of such assessment, without interest to the City Treasurer; and BE IT FURTHER RESOLVED, that the Clerk shall prepare and transmit to the County Auditor a certified duplicate of said assessment roll with each then unpaid installment and interest set forth separately, to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect said assessments in the manner provided by law. Director SUBJECT: Development of the Southeast Area of Lexington Avenue and TH 110 HISTORY• For several years, Tom Curley, together with others, has attempted to develop a plan to improve the southeast corner of TH 110 and Lexington. At the present time, the SOS Convenience Mart and Furniture Barn are located on portions of the property. 6 The frontage road as it currently is in place, and the access to SOS provide problems for traffic and a variety of zoning on the parcels further complicate the development. In an effort to help in some long range solution to the problem, the City included the parcels in the Tax Increment District in 1986. DISCUSSION• At this time, Mr. Curley is working with Mr. John Duffy to develop a plan for the site which would include: 1. Service Station (Super America type) 2. Restaurant or Day Care Center 3. Strip Shopping Center The plan would be to make the development compatible with the appearance of the City Hall on the north side of TH 110 and relocate the frontage road for better access to Lexington Avenue. Currently the property is owned by Mr. Curley except for the SOS Market. Mr. Duffy has not been successful in his attempt to get the SOS owners to commit to the sale of their property. It would appear that for the project to proceed, it will be necessary for the City to take an active part in the acquisition of the property. The major concern when acquiring a motor fuel station these days is ground water contamination from leaking tanks. (Extensive soil tests should be made to insure that there is no contamination at this site. Some test borings have been made by Mr. Duffy which indicate that there is no contamination in the test area. Further testing would be necessary). The zoning matters will also have to be resolved. The present zoning on the site is R-1 and B-2. R-1 will need to be rezoned and B-2 does not allow for a motor fuel station or a furniture store. It appears that if the project is to proceed, Mn/DOT will provide funds to construct the relocated frontage road and close the current access to TH 110. (The City would construct and Mn/DOT would reimburse). In the extreme, the plan to be successful could call for the City to condemn the SOS site, a friendly condemnation of Mr. Curley's building (he would also like the City to condemn the right-of-way which staff feels should be donated as part of the plat) and the removal of the buildings. The land would then be resold to the developer for the project at a market value. 341W The plan presented is that as developed in cooperation with Planner Dahlgren. It calls for a 32,000 square foot shopping center, service station and restaurant or day care center. The developer indicates he has tentative leases sufficient to make financing available (see letter from NW Bank, St. Paul). Based on estimates by the Dakota County Assessor, the tax on the project will be about $88,000 annually, or an increment of about $78,000. To proceed, staff will need, among other things, 1. An environmental study of the site. 2. A firm finance commitment. 3. A developer's agreement a. Tax guarantee b. Completion guarantee 4. Mn/DOT frontage road agreement. 5. Determine an approach to zoning problems a. PUD or b. Conditional use permit or C. Rezoning 6. Condemnation authority ACTION REQUIRED: Review proposal with applicant (applicants will be present to present proposal and answer questions) and determine to what extent, if at all, Council desires to support proposal with TIF assistance. Assistance in obtaining the corner properties (Exhibit 1) for inclusion in the proposed 6 -acre redevelopment project (Exhibit 2), by use of eminent domain authority. The success of the shopping center is dependent on the controlled development of the Lexington Avenue and Highway 110 intersection. That intersection needs a compatible use which is architectually integrated for site lines and esthetics. It is not economically feasible for LPSP to buy out and relocate the two businesses on the corner. Therefore LPSP is asking the Council to use it's authority to condemn these two sites and deed them to the partnership for inclusion in the project. Expected costs: Curley Furniture Library 3,200 s.f. est. value $200,000 SOS Convenience Center 2,000 s.f. est. value $100,000-$200,000. Because this property is already in a tax increment district, the City will recover it's entire investment plus interest, in a 5 to 7 -year period, through tax increment dollars. 2. LPSP has submitted a development proposal (Exhibit 3) of 46,000 s.f. which they feel is the highest and best use of the site. However, the State and City staff believe there should be a frontage road through the property and the State has agreed to pay the construction costs. This would take about 33,000 s.f. out of the center of the project, and 10,000 s.f. of additional set -backs. LPSP would have one acre of unbuildable property. The developer feels Exhibit 3 provides clear and easy access for all the traffic that this frontage road could ever service. August 10, 1988 Page Two A proposal has been submitted (Exhibit 4) which would comply with all City and State requests, but would reduce the project scale to 40,000 s.f. We are asking the Council to either rule the frontage road is not necessary, or compensate the owner for the loss of property. 3. The subject property currently has two non -conforming uses. LPSP believes it is appropriate to rezone the entire 6 acres to B-3 and amend the Ordinance to allow sale of gasoline in this zoning if included in a shopping center development. LPSP is asking for a PUD to allow multiple buildings on the site. We are asking the Council to direct staff to issue the re -zoning notices so that this could come up at the next meeting. The total project cost came in at slightly less then estimated, but the assessments will be somewhat higher then the estimate. This is due to the fact that those items that are to be covered by TIF came in under estimate, so not as much of the costs are eligible for TIF expenditure. During the one year period, he has performed very well. He has shown an unusual amount of initiative and a desire to further the goals of the Department. In addition, he has accepted the challenge of assisting Sgt. Wicks in the Investigators office. He has accepted these difficult responsibilities willingly and has become a valuable member of the Department staff. I recommend that Sergeant Mack be appointed to the permanent position of Patrol Sergeant effective August 3, 1988. N CITY OF MENDOTA HEIGHTS MEMO AUGUST 3, 1988 TO: Mayor and CitF cil FROM: Kevin D. City Administrator SUBJECT: Smoking Policy in New City Hall Under the auspices of the Minnesota Clean Indoor Air Act, we should adopt a policy on where smoking will be allowed in the new city hall. By definition, private office spaces are not covered by the Act, so smoking is allowed in those areas. Staff has discussed the matter of other areas that should be allowed for smoking, and has identified two: 1. One half of the police squad room. 2. The northern portion of the general lobby area around the seating area near the deck. Approximately one half of the police officers smoke, and so Chief Delmont feels that a portion of the squad room would have to be allowed for smoking while the officers are working on reports, etc. Designating a small portion of the lobby area for smoking would allow a place for our few employees who smoke but do not have a private office space. They would use the area during breaks. It would also provide a smoking area for people attending Council or Planning Commission meetings. Under this policy, there would be no smoking at all in any other areas of the building, including the Council Chamber, conference rooms, and public lobby space. ACTION REQUIRED: If Council concurs with the staff recommendation, it should pass a motion adopting the attached Resolution No. 88- "RESOLUTION ON SMOKING IN CITY HALL". KDF:madlr attachment CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 88 - RESOLUTION ON SMOKING IN CITY HALL- WHEREAS, the Minnesota Clean Indoor Air Act requires that public buildings be separated for smoking and non- smoking areas; and WHEREAS, the City wishes to minimize smoking in the new city hall building, while reasonably accommodating the -need for limited areas being available for smoking. NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the Mendota Heights City Hall is ' declared a non-smoking area, except in private offices, and in the following areas which will be posted for smoking allowed: 1.
