ACTION REQUIRED
In addition to the motion approving the plans and
specifications for the 1988 seal coating program, Council
motion should be for approval of a purchase order to Struck
and Irwin Paving, Inc. in the amount of $10,097.22, for
slurry sealing of Apache Ct., Apache Ln., Nashua Ln., and
specified portions of Cheyenne Ln.
9.a. CASE NO: 88-19, C.G. Rein Apartments
Attached is the opinion of independent legal counsel, Tim
Kuntz, concerning whether approval of the requested
conditional use permit for the apartments is, in essence, a
rezoning action that requires a 4/5's vote of the Council.
He concludes that it is not. Mr. Kuntz will be at the
meeting to give a verbal presentation of his opinion, and to
answer other legal questions that may arise concerning this
matter.
Also attached is a letter from City Planner Howard Dahlgren
discussing the concept of the planned unit development, and
why it is not the same as a rezoning.

DISCUSSION•
Staff has received the attached bid to slurry seal
Apache Court, Apache Lane, Nashua Lane, and the east 600 feet
of Cheyenne Lane. There are no slurry seal contractors
within the Twin Cities area, so this bid is from a Madison,
Wisconsin contractor.
This contractor will be in the Twin Cities in early
August to do some airport work. Staff is still attempting to
get a second bid for a thin hot mix overlay to compare
prices. However, we estimate that the hot mix bid will be
significantly higher.
RECOMMENDATION•
Because Struck & Irwin Paving will be in and out of town
before the Council meets again, staff recommends that Council
award a purchase order tonight and allow them to slurry seal
Apache Court, Apache Lane, Nashua Lane, and the east 600 feet
of Cheyenne Lane for their bid of $10,097.22. If the hot mix
thin overlay bid comes in lower than the slurry seal, staff
then will not issue this purchase order.
ACTION REQUIRED:
If Council desires to implement the staff
recommendation, they should pass a motion awarding the
purchase order to Struck & Irwin Paving, Inc.

said that this type of control allows a developer to tailor
the land use to the topographical and housing needs of the
community.
One commentator said that planned unit development encourages
physical development compatible with the environmental value
of the area. Another noted that the type of development can
be economic and efficient, reducing the cost of utilities and
other services.
Thus, planned unit development is intended to bring an
element of flexibility into an otherwise rigid system of
controls. This purpose has been widely approved in relation
to special permits, vacancies, and other techniques. The
objective of providing a variety of housing types at all
economic levels seems not only to serve the public welfare
but to be consistent with the policy of government at all
levels.
Section 3. OBJECTIVE OF MENDOTA HEIGHTS PLANNED UNIT DEVELOPMENT.
The concept of mixed uses is found in the Mendota Heights
ordinances dealing with a planned unit development. City Code,
Section 3.2 (99), defines a planned unit development as:
A development which consists of two (2) or more principal
structures or uses on a single parcel of land.
City Code, Section 19.1, continues this concept and defines a
planned unit development as:
A. Planned Unit Development shall be defined as any project
utilizing ten (10) or more acres of contiguous land wherein
there is (a) more than one principal building per lot, or (b)
more than one use per lot.
Finally, City Code, Section 19.2 (6), indicates that it is the
intent of a planned unit development to provide a means to allow
substantial changes from the uses of the underlying zoning
district, if the City imposed standards for a planned unit
development are met.
Unless such changes are incorporated in the City approved planned
unit development, City Code, Section 19.2 (5), makes clear that
the development regulations of the underlying zoning district
govern. In any case, the residential density for the entire site
cannot exceed the density permitted in the underlying zoning
district.
Section 4. MANNER OF GRANTING APPROVAL FOR A PLANNED UNIT
DEVELOPMENT. City Code, Section 19.1, makes clear that approval
for a planned unit development shall occur by the granting of a
conditional use permit.
City Code, Section 3.2 (27), defines a conditional use permit as:
A permit specially and individually granted for a conditional
use in any district.

The form of the conditional use permit is the Final Development
Plan and any agreements relating thereto.
A rezoning is not mentioned.
City Code, Section 6.1, lists the zoning districts in Mendota
Heights. A planned unit development is not listed as a separate
district.
The structure of the Mendota Heights ZVuioq Ordinance is to grant
a planned unit development as a conditional use permit and not as
a rezoning. Thus, under the City Zoning Ordinance mixed uses not
otherwise permitted in the underlying zoning district may be
allowed without a rezoning, if, but only if, a conditional use
permit for the planned unit development is granted.
In the past, the City/ consistent with the structure of its
ordinances, has, without rezoning but by a conditional use permit/
approved mixed residential uses in a planned unit development.

Section 5.
foIlmvs:
STATEMENT OF ISSUE.
The issue may be stated as
May the City, by the granting a conditional use permit but
without rezoning, approve a planned unit development that has
oaea not otherwise expressly permitted in the underlying
zoning diotZic�t?
Based on the reasons which follow, the answer is yea. This answer
has a supportive basis in:
a) treatises;
b) case law;
o) statute.
Section 5. TREATISES. Two respected treatises in the law of
zoning are:
Anderson, American Law Of Zoning, 3rd Edition
Rathkopf, Law of Zoning
Anderson (in Section 11.15 and 11.18 of his treatise) points out
that a planned unit development may be created in at least two
ways. One is by rezoning; the other is by conditional use permit.
Both ways have received judicial approval. In the rezoning
situation, the City first enacts an ordinance dealing with the
general regulations and requirements for a planned unit
development. Then, the City, in the second step, rezones a
particular tract to a PUD District.

In the alternative procedure, the City does not rezone; rather, it
uses the conditional use permitting device to regulate planned
unit developments in any of the existing zoning districts.
Some cities pick one method; some cities pick the other method.
Rathkopf (in Section 63.02 of his treatise) points out that "in a
number of cases, courts have held that, subject to specific
conditional use regulations to the contrary, there is no
restriction on the type of dwellings permitted in a PUD, regardless
of the zoning restrictions in the district in which the PUD is
located."
Section 7. CASE LAW. In Chandler v. Kroiss, 291 Minn. 196, 190
N.W.2d 472 (1971), the Minnesota Supreme Court upheld the approval
of a planned unit development by a conditional use permit. In
Chandler, the property was zoned R-1, One Family Residences. The
landowner, following the city ordinances, applied for a conditional
use permit for a planned unit development that contained a
multi -family dwelling. The City granted the conditional use
permit. The Court upheld this procedure and stated:
To the extent that the result of the proceeding for approval
of a planned unit development thus alters the established,
allowed land usages of the village, it has the same effect as
would a succession of variances or rezonings. So long as
procedures for securing a permit for a planned unit
development fairly provide for airing the topic, and those
before us have done so, we cannot say that the concept, as
implemented, is impermissible. 190 N.W.2d at 476.
It is interesting to note that this procedure, namely, a planned
unit development by means of a conditional use permit, was
sustained by the Court notwithstanding the statutory prohibition
in Minn. Stat. 462.357, subd. 6, that a city "may not permit as a
variance any use that is not permitted under the ordinance for
property in the zone where the affected person's land is located."
This statutory prohibition and the holding in Chandler can be
reconciled by the fact that a conditional use is, by definition,
an allowable use if but only if the standards for such use are met.
Section 8. STATUTE. Finally, and most importantly, there is now
a statute that authorizes a planned unit development by a
conditional use permit. Minn. Stat. 462.3595, subds. 1 and 2,
passed in 1982, provide:
Subdivision 1. Authority. The governing body may by
ordinance designate certain types of developments, including
planned unit developments, and certain land development
activities as conditional uses under zoning regulations.
Conditional uses may be approved by the governing body or
other designated authority by a showing by the applicant that
the standards and criteria stated in the ordinance will be

satisfied. The standards and criteria shall include both
general requirements for all conditional uses, and insofar as
practicable, requirements specific to each designated
conditional use.
Subdivision 2. Public Hearings. Public hearings on the
granting of conditional use permits shall be held in the
manner provided in Section 462.357, subd. 3.
I believe that the above -quoted statute represents, in part, a
legislative codification of the issues raised in Chandler. This
statute explicitly allows a planned unit development by a
conditional use permit; the statutorily mandated notice and
hearing provisions "fairly provide for airing the topic" in that
the statute incorporates the same notice and hearing requirements
that one applicable to a rezoning, namely those found in Minn.
Stat. 462.357, subd. 3.
Section 9. CONCLUSION. The Mendota Heights procedure for
granting a planned unit development by a conditional use permit,
without a rezoning, is authorized by the Minn. Stat. 462.3595 and
is supported by the other authorities cited in this memorandum.
In granting such a permit, the City must follow the same notice
and hearing requirements that are provided for a rezoning. Unless
otherwise provided by ordinance, the granting of a conditional use
permit requires only a majority vote of the Council.
I have not been asked to review the notice and hearing procedures
that were followed and, therefore, I express no opinion as to
whether they meet the statutory requirements.

RE: Planned Unit Developments
In the early days of the practice of land use zoning in this country and abroad,
residential development took the form of each principal structure being placed on a
separate lot. The larger proportion of development today continues to be handled in
this way. Each zoning district prescribed minimum yard requirements (sometimes called
setbacks) for the front, sides, and rear. Height, bulk, parking, percent of maximum land
coverage (usually referred to as floor area ratio), and most importantly the amount of
land required per unit was established for each such lot. Most communities developed
several residential districts, each with a different amount of land area required per unit
(usually referred to as density).
During the post World War II era many residential developments were being accomplished
as "projects" involving a group of buildings laid out on a single site, without each
building having its own front, side, and rear lot lines. Thus, there evolved the
technique of controlling such developments through the review of a plan known as a
"Planned Unit Development" (PUD). The unit, of course, refers to housing units.
The key element of such a plan is the allowance for flexibility in the placement of the
units and the concentration of the units, but always in accordance with the underlying
density prescribed by the zoning district applied to the land. The concept is most
useful in providing flexibility to maintain part of a site as open space and concentrate
the units in other areas of the land in question.
An early and classic example of the success of this approach is the Ivy Falls
Townhouses of Mendota Heights. In this case, a 7 acre park was conserved and
dedicated to the City. The density of the overall land remained the same as
single-family (the R-1 zone) and the townhouses were concentrated on the easterly

portion of the site. Thus, the procedure is not a rezoning. It is a means for providing
a better solution as to desien, but entirely under the control of the City in the same
way that a plat is subject to such control.
A more recent example of a PUD done within the zoning district in which it is located
is that of Summerset 19. Here the developers concentrated the development at the
intersection of two major thoroughfares in the form of modified townhouses, with the
retention of a large area of wetlands. The density remained the same as if they were
single-family houses built on the entire site.
The Planned Unit Development concept has been applied throughout the United States,
and there are significant examples of its use in most of the Twin City suburban
communities. It is a well understood and well used approach to provide a more flexible
and imaginative solution to a site, frequently retaining significant open -space, much of
which may be sensitive to the ecological environment.
The use of a PUD procedure is an overlay control in the same way that the application
of a preliminary plat is overlaid upon an R-1 zone for single-family development. The
approval process and subsequent action on a preliminary plat is similar to that of a
PUD. It is not a rezoning, but a method of proposing development allowing for
different building arrangements, but conforming to the prescribed zoning density. This is
the technique that is used throughout the United Stated and much of Europe.

Request for Feasibility Report
Ivy Hills Park Reach (Tributary of Ivy Creek)
DISCUSSION:
At the Ivy Falls Creek informal public hearing on June 7, 1988, it was
determined that the area suffering the most severe damage during the 1987
"super storm" was the Ivy Hill Park Reach. Other areas suffered less severe
damage, or have since been repaired. Since the Ivy Hill Park Reach receives
a significant amount of runoff from West St. Paul, any solution to the storm
water problem should address this West St. Paul water runoff. The Lower
Mississippi Water Management Organization is an ideal mechanism to use for
studying this intercommunity storm water problem, so Council should consider
requesting the water management organization to complete a feasibility
report.
This project was anticipated by Water Management Organization and costs
for the report have already been estimated by Barr Engineering, the Board's
Engineer. The estimated cost for doing the drainage study and feasibility
report is $30,000. This cost will be financed initially by the WMO and
then, after a cost distribution is determined, billed to the Cities. A
cooperative agreement will probably then be prepared between West St. Paul
and Mendota Heights to complete the project. The WMO has several higher
priority projects that they are working on right now so this project would
not be able to be studied until this winter.
Council requested a creek tour before the July 19th meeting so I have
made arrangements with Mr.' Jack Brassard, 1205 Sylvandale Road to conduct
that tour at 6:00 P.M. before the Council meeting.
ACTION REQUIRED:
Conduct the continued informal hearing and should Council desire to go
forward with the first step of a public improvement and order a feasibility
study they should pass a motion adopting Resolution No. 88- , RESOLUTION
REQUESTING THE LOWER MISSISSIPPI RIVER WATER MANAGEMENT ORGANIZATION TO
COMPLETE A FEASIBILITY STUDY ON THE IVY HILL PARK REACH.

HOCKEY FENCES Bids for adding a chain link fence to the Friendly
FRIENDLY HILLS PARK Hills Hockey rink were reviewed and not acted on
because of the lack of a quorum.
BIKE TRAIL THROUGH Jim Danielson presented the bike trail plans for
FRIENDLY HILLS extention through Friendly Hills Park to the Com-
mission. It was the concensus of the members pre-
sent that the bike trail would be a good addition,
providing more direct access for the Friendly Hills
neighborhood to the Mendota Heights Road bike
trail.
PARK SURVEY UPDATE John Huber gave the Commission an update on the
progress of the committee that is preparing a park
survey to be sent to the residents to solicit input
on what park facilities are needed. Commissioner
Stein pointed out that the City has already hired
Barton-Aschman to tell us what park facilities are
needed. He feels we should be educating residents
on what is needed not asking them.
1989 BUDGET REVIEW The 1989 budget was discussed and the Commission
did not have any specific budget requests. They
felt Mend -Eagan and City staff had done a good job
handling recreation needs this year.

DISCUSSION:
Attached is a proposed assessment roll for the Business Park Street
Lighting project. Assessment rates were reduced by about 507. from the
feasibility report by utilization of Tax Increment Financing and M.S.A.
funding.
To distribute the assessments equitably staff established a new
assessment formula using both the frontage and area to calculate a
contribution:
Percent of Contribution = Lot Frontage X Lot Area
Total Sum of Frontage X Area
RECOMMENDATION:
Staff recommends that the attached assessment roll be approved and an
assessment hearing be called.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should

(IMPROVEMENT NO. 86, PROJECT NO. 11)
WHEREAS, contracts have heretofore been let for the construction of the following
described improvements:
The construction of commercial district street lighting to serve
Mendota Heights Industrial/Business Park, Carew Business Center, Inland
Industrial Park, Medallion Industrial Park, Yorkton Centre Pointe South
and Northland Plaza (which improvements have heretofore been known and
designated as -Improvement No. 86, Project No. 11)
and
WHEREAS, the construction of said improvements has been completed; and
WHEREAS, the City Clerk, with the aid and assistance of the Public Works Direc-
tor, was previously directed by the City Council to prepare the assessment roll
for the above described improvements; and .
WHEREAS, the City Clerk has notified the City Council that a proposed assessment
roll for the above described improvements has been completed and filed in her
office for public inspection.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota
Heights, Minnesota, as follows:
1. That a public hearing on said proposed assessment roll shall be
held at the Mendota Heights City Hall at 750 South Plaza Drive, in the
City of Mendota Heights, on Tuesday, August 16, 1988, at 8:15 o'clock
P.M. or as soon as possible thereafter.
2. That the City Clerk, with the aid and assistance of the City Attorney,
is hereby authorized and directed to prepare and attend to the publication
and mailing of the necessary notices of said hearing, all in accordance with
the applicable Minnesota Statutes.
Adopted by the City Council of the City of Mendota Heights this 19th day of
July, 1988.

SUBJECT: Seal Coating for 1988
DISCUSSION:
The City budgeted $50,000 for seal coating this year and staff
to allocate spending it in three different ways:
proposes
1. Seal Coat - Staff proposes to seal coat the Curley Addition and
Tilsen Highland Heights neighborhoods with the standard "buckshot" applica-
tion (see map). Estimated cost is $20,000.
2. Slurry Seal - The Apache Court and Apache Lane streets in Dela-
ware Crossing are structurally sound but have badly eroded surfaces. Staff
is investigating sealing these streets with a slurry seal (a very thin
overlay). No one in the Twin Cities area has the equipment to do this,
however a Wisconsin contractor will be in town later this month to apply a
slurry seal at the airport and we are discussing with him the possibility of
doing our streets at the same time. Estimated cost is $10,000.
3. Overlay - The blacktop surface at the "backlot" of the Public
Works Garage that is used for storage has failed. We propose to overlay
that lot and expand it by 30 feet. Estimated cost is $10,000.
4. The remaining $10,000 will be used to patch the streets in the
seal coated areas, pay for City Engineering assistance and as a contingency.
RECOMMENDATION:
Staff recommends Council approve the Seal Coat plans and specifications
this evening and order bids. f
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion to approve the plans and specifications and authorize staff to
advertise for bit and to receive the bids at 9:30 A.M., Monday, August 1,
1988. 1

DISCUSSION:
Mr. Dick Putnam has petitioned.the City to provide public improve-
ments to the proposed Copperfield IV subdivision. In order to do so, a
feasibility report and preparation of plans and specifications are;
necessary.
Given the small size and ease of serving this project, and considering
the developer is very concerned about completing the project this
construction season, it would be reasonable to complete the feasibility
report, and plans and specifications simultaneously.
RECOMMENDATION•
Staff recommends that Council order staff to begin the preparation of a
feasibility report and plans and specifications for Copperfield IV.',
ACTION REQUIRED:
If Council concurs with the staff recommendation they should pass a
motion adopting Resolution No. 88- , RESOLUTION ACCEPTING PETITION AND
ORDERING PREPARATION OF FEASIBILITY REPORT FOR COPPERFIELD IV.

FEASIBILITY REPORT FOR COPPERFIELD IV
i
WHEREAS, a petition has been filed with the City Council requesting
sanitary sewer, storm sewer, water and street improvements to serve
Copperfield IV and adjacent areas.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the above described petition be and is hereby accepted by
the City Council of the City of Mendota Heights.
2. That the City Engineer be and is hereby authorized and dir-
ected to prepare a feasibility study as to whether said proposed im-
provements are feasible, whether said improvements should best be made
as proposed or in connection with some other improvement, and as to the
estimated cost of said improvement.
Adopted by the City Council of the City of Mendota Heights this 19th day
of July, 1988.

SUBJECT: Award of City Hall Telephone System Bid
Attached is a memo from telephone consultant Bill Burke,
tabulating the bids which were received on the phone system
for the new city hall, and making a recommendation for award.
SYSTEM I
Bill's memo analyzes the three lowest bids and sets
forth his reasons for rejecting the bottom two, from Iwatsu
and Walker Poets respectively. He recommends that we award
the bid to AirComm/T.S.I. for a Tie Ultracom AT System in the
amount of $12,518. I
WIRING BID
Wiring for the system was set forth in the
specifications as a separate bid item. However, the low bid
from Iwatsu was made contingent on their receiving the award
for the phone system itself. Therefore, Bill recommends that
we award the wiring bid to the second low bidder, Wahl & Wahl
Inc., in the amount of $3,012.
FINANCIAL AND BUDGET IMPACT
The total amount of the bid for the two items combined
is $15,530. Based on past experience, Bill recommends that
the Council authorize a deviation of up to 5% from this I
amount during installation, as some changes are inevitable.
This would amount to about $750 in potential additional
expense, bringing the maximum cost to $16,280. The amount
allocated in the city hall project budget for the phone
system is $25,000.
ACTION REQUIRED:
If Council concurs in the recommendations, it should
accept the telephone system bids as presented by consultant
Bill Burke, and award the system purchase to AirComm/T.SII.
in the amount of $12,518, and the wiring and jack
installation bid to Wahl & Wahl, Inc., in the amount of
$3,012.

SUBJECT: Recommendation for Contract Awards - New City Hall Telephone System
You will recall that the City Hall Telephone System R.F.P. asked for separate
bids for the "Telephone System", and the "Wiring and Jacks". Nine proposals
were received for the Telephone System, and eleven proposals were received
for the Wiring and Jacks, including bids from two wiring only contractors.
The ranking of all bids received is shown on Attachment A.
TELEPHONE SYSTEM
The Telephone System bids were reviewed in rank order in order to determine
whether the proposal met the Telephone Specifications. The results are as
follows:
Advanced Telecommunications Technologies, Inc._
I recommend rejection of their proposal for two reasons:
Section 10 Paragraph 12 of the R.F.P. included the following statement:
Furthermore, the bidder must include a manufacturer's statement
guaranteeing that all components of the system being proposed will be
available for additions and maintenance to the system for a minimum of
five years from the date of installation.
The following is an exerpt from the 6-17-88 letter from Iwatsu America,
Inc. to the City of Mendota Heights included in the proposal:
Except for unforeseen circumstances such as discontinuance:'of components
by other manufacturers, we would assume that spare or suitable parts
would be available for as long as ten years.
I do not consider this statement to be acceptable, or meeting the specification.
2. Section 12.4 of the R.F.P. listed features that the Telephone System
must have. On page 9, the following station feature was specified:
Ring Transfer Arrangement: Operate Key to activate programmed ringing
for a line or lines that normally do not ring at that station. L.E.D.
Indicator when feature is activated. 11
In a 6-24-88 meeting with them, they admitted that they could not provide
this feature as it was intended.
I consider this feature to be critically important for thelease of the
system operation as it applies to daytime backup operation, and
occasional "night" operation by various individuals.

Action Telecom, Inc.
I recommend rejection of their proposal for the following reason:
Section 12.4 of the R.F.P. listed features that the Telephone System
must have. On page 8, the following station feature was specified:
Intercom: Option, where desired:
Hands free answer back - both on hook and off hook
In the "Exceptions To Speeifications" portion of their proposal, item 1.
Poets does not offer off -hook voice announce.
I consider this to be a very viable option for the station users.
AirComm/TSI
I recommend acceptance of their proposal. It meets all requirements of the
R.F.P. in a satisfactory manner.
AirComm, Inc. has been in business for twenty years. AirComm/TSI is now a
"company store", and Tie is one of the two top manufacturers of small business
telephone systems in the United States.
Attached is a copy of their completed "Telephone System Cost Sheet Specification
Attachment C".
WIRING AND JACKS
Wahl & Wahl, Inc.
I recommend acceptance of their proposal. It meets all requirement's of the
R.F.P. in a satisfactory manner.
Wahl & Wahl, Inc. has been in business for over fifty years, and is'experienced
in the office automation industry.
Attached is a copy of their completed "Telephone System Cost Sheet '-
Specification Attachment C".
CONCLUSION
Assuming concurrence with the above two recommendations, the total 'base bids
for the complete installation would be as follows:
Telephone System $12,518.00
Wiring and Jacks $ 3,012.00
TOTAL $15,530.00
No payment terms were specified in either of the above proposals. Therefore,
the terms are negotiable. I would recommend that Purchase Orders be issued
for the base bids, with complete payments after satisfactory completion of
the work.
Some minor variation (additions and/or deletions) will undoubtedlylbe required.
Each proposal contains unit costs for additions and deletions. I recommend
that the City Council pre -authorize variations of plus or minus 5% to the base
bids to allow for these possible variations.

RESOLUTION APPROVING VACATION OF A STREET RIGHT-OF-WAY
WHEREAS, the City of Mendota Heights is the current record owner of a street
right-of-way as described as follows; and
That part of vacated Eugenia Avenue as dedicated within the plat of
Cherokee Park Heights described as lying Easterly of the southwesterly
extension of the northwesterly line of Lot 1, Block 1, said Cherokee
Park Heights and lying Westerly of the southwesterly extension of the
southeasterly line of Lot 2, said Block 1, reserving the described
property for a drainage and utility easement.
WHEREAS, a notice of hearing on said vacation has been duly published and
posted more than two weeks before the date scheduled for the hearing on said
vacation, all in accordance with the applicable Minnesota Statutes; and
WHEREAS, a public hearing was held on said vacation on July 5, 1988, at
8:15 o'clock P.M., at the City Hall of the City of Mendota Heights;' and
WHEREAS, the City Council then proceeded to hear all persons interested in
said vacation and all persons were afforded an opportunity to present their
views and objections to the granting of said petition.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the vacation of the street right-of-way described above, sit-
uated in the City of Mendota Heights, is in the best interest of the public
and the City, and is not detrimental to the health, safety and welfare of
the community.
2. That the above described street right-of-way be and the same is
hereby vacated, reserving the above described property for a drainage and
utility easement.
3. That the City Clerk be and is hereby authorized and directed to
prepare and present to the proper Dakota County officials a notice of com-
pletion of these vacation proceedings, all in accordance with the applicable
Minnesota Statutes.
Adopted by the City Council of the City of Mendota Heights this 19th day of

Construction of three fire hydrants to serve the Lexington Heights
Apartment complex has been completed. The total project cost that 'should be
assessed is $28,784.60. The feasiblity estimate of the project was�$22,000.
The increase in the project cost were due to difficulties working with the
Owner, to unforseen field conditions. The plat consists of three lots and
the costs were distributed equally which amounts to $9,595.00 per lot. The
interest rate for this project is eight percent.
RECOMMENDATION:

Original estimates are not comparable because the design was changed, but
one feasibility estimate of $24,000 for a project of comparable size. This
larger lot should be platted into three lots at a future date and the
assessments will be divided accordingly at that time.
RECOMMENDATION:
Staff recommends that Council approve the attached assessment roll as
prepared.

has arrived at an assessment of $10,837.82 per lot. The feasibility estimate
was $12,830 per lot. The interest rate for this project is eightfpercent.
RECOMMENDATION:

Attached are C.G. Rein's plans that have been amended to meet the
Council's desire to have the buildings setback from Dodd Road rightLof-way a
minimum of 100 feet. They have also rerouted their access road to exit
through the City's parkland onto Mendakota Drive. An easement agreement
will have to be drafted between the City and the Developer to allow the road
through the park and to allow construction of the two entrance monuents.
Mr. Bernie Friel has contacted the City and informed us that he feels
the City has effected a zoning change by approving this project. He feels
this zoning change was improper because it was by 3/5 vote. He also feels
that the City Attorney's office has a conflict in the matter and should not
offer advice. Mr. Friel intends to have an attorney present at the meeting
to discuss these two facts with the Council.
Because of the possibility of a conflict, Staff has contactedian inde-
pendent attorney (Mr. Tim Kuntz) and will have his written opinion on the
matter available for Tuesday evenings meeting. We will also have him pre-
sent at the meeting to answer any questions.
ACTION REQUIRED:
Review the current site plan and should Council desire to approve the
request, they should pass a motion adopting Resolution No. 88- ,,RESOLU-

RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A PLANNED
UNIT DEVELOPMENT
WHEREAS, in its deliberations on Planning Case No. 86-
11, the City Council has previously determined the Mendakota
Estates Planned Unit Development to be consistent with the
Comprehensive Land Use Plan of the community, specifically
that section allowing for housing styles and types different
than specified in the underlying zoning under the planned
unit development provision of the zoning ordinance, Ordinance
No. 401; and
WHEREAS, by Resolution 86-51, the Council, upon
recommedation of the Planning Commission, has previously
determined that the construction of 140 residential units in
the Mendakota Estates Planned Unit Development is consistent
with the number of units allowed by the underlying R-1 zoning
designation on the property; and
WHEREAS, the Mendakota Estates
provides for construction of up to
residential units on Outlot A; and

applied for a conditional use permit and preliminary

City of Mendota Heights, that the following findings are made
concerning the application:

unified treatment of the development possibilities
for this property.
The development plan maximizes the preservation of
open 'space on the site, and harmonizes with existing
and proposed development in areas surrounding the
project site, including a country club clubhouse and
fairways, city fire station, commercial development,
high powered electrical transmission lines and
substation, a State trunk highway, and single family
neighborhoods: I
3. The C.G. Rein Company, financial backer of the
project, has a demonstrated record of financial
capability to complete projects of this scale.
BE IT FURTHER RESOLVED by the City Council of the City
of Mendota Heights that, based on the above findings, the
conditional use permit and preliminary development plan for
the proposed project is hereby approved subject to the
following conditions:
1. That the project is developed in accordance with
drawings as submitted.
2. That 1.67 acres of property be dedicated to thelCity
as public park land, as shown in the application
materials.
3. That final engineering and landscaping plans be
approved by the City staff, with special attention
being given to the landscaping in the southeast part
of the site to protect as much as possible single
family neighborhoods to the south and east.

The Indirect Source Permit has been issued and the City has executed a
Developers Agreement with Centex to allow development of the Southeast Area.
Centex has submitted the attached final plat to begin Phase I of their Manor
Homes. Staff has reviewed the plat and finds that it conforms to the
preliminary plat approved. Park dedication for this plat will be laAd and
part will be a portion of the dedicated for the entire Southeast Area PUD.
Negotiations are presently underway with the Developer to design thelsize
and location of the park.
RECOMMENDATION:
Subject to Dakota County concurrence, staff recommends approval of the
final plat as submitted.

One of the City's in luential residents (Kevin) often travels north on
Delaware Avenue to go on Trunk Highway 110. There is only a gravel
shoulder as a right turn lane and he suggests that the intersection would be
much improved if a right turn lane were paved. Delaware is a County Road
and the City needs to request the County to complete the work.
RECOMMENDATION:
Because of the growing amount of traffic using Delaware from the south—
east area development staff recommends that the Delaware intersection with
Trunk Highway 110 be improved by having a right turn lane added. We hope
that this small amount of paving could be done out of the County maintenance
budget with no cost to the City.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion requesting that Dakota County pave a right turn lane for north
bound traffic on Delaware Avenue at its intersection with Trunk Highway 110.

Re: Participation in Property Tax Lawsuit
Attached is a memo from the Municipal Legislative Commission
(MLC) describing their legal challenge to the 1988 property
tax bill. The Association of Metropolitan Municipalities
have voted in join in the suit as well. The Commission
lawsuit is based on their contention that distribution of the
"disparity aid" portion of the tax bill is unconstitutional.
As Council and staff have previously discussed, the 1988 tax
reform legislation is detrimental to property owners in
Mendota Heights, and similarly situated entities with high
values, but low mill rates. It is also detrimental to the
metropolitan area as a whole. The law purports to "equalize"
tax burdens around the State, but in defining equity only in
terms of mill rates, fails to recognize the sizeable and
growing disparity in net taxes paid by homeowners in the
metropolitan area, versus those in other areas of the State.
It also fails to recognize the past decisions that officials
in differing cities have made on spending and service levels,
and to hold them accountable accordingly.
Based on our discussions, and the presentation by MLC
representative Bob Renner, Council has indicated its desire
to support the legal challenge, including a financial
contribution of $2,500. MLC member cities are being assessed
$ .10 per capita, which in our case would be about $850.
However, they have also increased their basic dues. Since we
have not previously supported the MLC, an organization
working on behalf of cities similar to Mendota Heights, a
higher contribution to this effort may be appropriate.
ACTION REQUIRED
If Council wishes to participate, a proposed resolution is
attached. You may wish to consider the amount of financial

RESOLUTION SUPPORTING LEGAL CHALLENGE OF THE
1988 PROPERTY TAX LEGISLATION
WHEREAS, the City of Mendota Heights has long endeavored
to control spending levels, and maintain reasonable taxes in
the community; and
WHEREAS, the Minnesota Legislature, for the past several
sessions, has continued to pass property tax bills that
penalize cities like Mendota Heights; and
WHEREAS, the 1988 Legislature passed a property tax
reform bill that will eventually lead to substantially higher
property tax bills for Mendota Heights residents; and
WHEREAS, that bill purports to equalize tax burdens
around the State, but fails to take into account the
substantially higher tax bills already being paid by
residents of cities such as Mendota Heights; and
WHEREAS, 64% of State revenues are now collected in the
metropolitan area, while only 46% of the total aids and
credits to local governments are returned to the metropolitan
area; and
WHEREAS, the 1988 tax bill will result in the shift of
even more monies from the metropolitan area to the remainder
of the State; and
WHEREAS, the Municipal Legislative Commission and the
Association of Metropolitan Municipalities have voted to
undertake a legal challenge to the constitutionality of the
1988 tax bill.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of Mendota Heights that the Council supports the
legal challenge to the tax bill, and hereby authorizes the
payment of $2,500 from the General Fund balance to the
Municipal Legislative Commission to assist in defraying the
cost of the lawsuit.
BE IT FURTHER RESOLVED by the City Council of the City
of Mendota Heights that the legislators representing the City
of Mendota Heights are hereby petitioned to actively pursue
passage of a more equitable property tax bill during the 1989
session.

Minnesota Constitution Article X, Section 1, reads in part:
"Taxes shall be uniform upon the same class of subjects and
shall be levied and collected for public purposes...
(emphasis added)
Article 4, Section 26, Subd. 3 of the 1988 Omnibus Tax Bill *
establishes a "disparity reduction aid" which has the effect of
"buying down" local government mill rates to approximately 128
mills. The cost of this program is $63.2 million in 1989. If the
combined mill rate of schools, counties and cities exceeds 128
mills, -the State will provide disparity aid to local units of
government to be used to reduce the mill rate to 128.
This policy is not in itself unconstitutional. If the State
Legislature desires to establish a statewide maximum mill rate,
they have the constitutional authority to do so. However, the
method the Legislature adopted to distribute disparity aid creates
anonuniform tax on the same class of subjects and is therefore
constitutionally flawed.
A nonuniform tax result occurs because disparity aid is distributed
to local units of government but the aid cannot be used to lower
the tax rate citywide or countywide or throughout the school
district but rather it can be used only to lower the tax rate
within a portion of a city, county or school district.
The result is that a taxpayer living in a home with.identical
market values and receiving identical local services will pay a
higher tax rate living on the west side of the street than one
living on the east side of the street. This results in an
unconstitutional distribution, and the Court will be asked to
enjoin the distribution of these funds.

The City of Smith, which levies 181 of the total levy of 138 mills, would
receive 189 of the disparity aid,.

The County of Jones, which levies 279 of the total levy, would -receive 279
of the disparity aid.
279 x $200,000 - $54,000.
School District E, which levies 55% of the total levy, would receive 559 of
the disparity aid.
559 x $200,000 - $110,000.
If the City of Smith and the County of Jones were authorized by statute to
spread this aid citywide and countywide, there would not be a
constitutional question. But the law requires that the aid be spread only
in the portion of the city and county where the mill rate exceeds 128
mills, i.e., within the boundaries of School District E.
After the distribution of disparity aid, the effective tax rates (and
equivalent mill rates) would appear as illustrated below:

The constitutional argument will be that a person residing in a $68,000
home in the City of Smith would pay a nonuniform tax for identical city
services -- $136.00 vs. $122.40.
The same person would also pay a nonuniform county tax -- $204.00 vs.
$103.60 for identical county services.
The same person would pay a unlf5lr7Il school tax, even though the amounts are
different for the same home. Since the taxpayer is in a dJJJmxeat school
district, they are not considered within the same class of subjects and
therefore this portion of the distribution would be constitutional.

Gene Lane has obtained quotes for two types of radio towers (see
pictures).

2. PI Rod $2,500
One advantage of the mono pole over the PI Rod is that it is a safer
pole because it is more difficult to climb. If the PI Road is selected it
is recommended that a safety shroud be installed around the base to make it
less climbable.
ACTION REQUIRED:
We need a new radio tower for City Hall, review the pole types and
prices and select one. Funding for the pole will be included in upcoming
transfer to City Hall fund.

We live at 1096 Avanti Drive in Mendota Heights, which is at the
corner of Lexington Avenue and Avanti Drive. The area around the
intersection is very dark at night. It is almost impossible to
see the location of the intersection when approaching on
Lexington Avenue. We are wondering if we could get a "alley
light" installed at either or both of the electric power poles
which are nearby on Lexington Avenue.
Many years ago we arranged to have an "alley light" placed behind
our home in the Crocus Hill area of St. Paul, and it was very
helpful. We paid the cost with a part of our monthly NSP
electric bill. Do you have such a program which we could use
near our new residence? We would be glad to pay the monthly
charge; or it may be that we will contact several of our
neighbors to share in the charge.
