A public hearing for the wetlands permits should have been
advertised as a part of this discussion, but was not. Final
action on the wetlands will need to be tabled to the meeting
of April 5th. Representatives of Anderson will be present;
Council may wish to begin the discussion on this item, or
in the alternative, table all consideration to April 5th.
10.f. Parks Bond Referendum Marketing ProcQ
The three steering committee co-chairs and I met last evening
to discuss the promotions effort. Plans are as follows:
1. Appoint a "promotions" steering committee of
approximately 20 people to arrange neighborhood
information meetings. The steering committee will
have its first meeting next Monday night.
2. Send an informational mailer to homes around the end
of March (see attached rough draft).
3. Send out glossy brochure (like that prepared last year)
just before the referendum date.
The 1988 Parks Development budget allocates $7,500 for the
referendum informational program. We will spend
approximately $2,000 with Barton-Aschman for redoing the
glossy brochure and producing new graphic illustrations for
use at the neighborhood meetings. Another $1,300 or so will
be spent on printing the brochures, and there will be mailing
costs, etc.
ACTION REQUIRED
This item is scheduled for information and discussion only.
No formal Council action is required.
10.cf. Recommendations of the City Hall Subcommittee
The subcommittee has recommendations for the Council
concerning:
1. The configuration of the receptionist desk.
2. Purchase of office systems furniture.
3. Purchase of Council chambers microphones.
4.' The Council and staff desk elevations in the council

The architects will present the committee recommendations,
and be prepared to answer council questions.
ACTION REQUIRED

Attached is a copy of the Sibley Heights final plat. Staff has re-
viewed the plat and finds that it has been prepared according to what was
approved by Council on August 18, 198q in preliminary form. Also attached
is a copy of the Developers Agreement and the feasibility report, the feasi-
bility report was presented to Council on January 5, 1988 but approval was
delayed until the final plat was prepared.
RECOMMENDATION:
Staff recommends approval of the final plat, Developer's Agreement and
feasibility report.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass motions adopting Resolution No. 88- RESOLUTION APPROVING FINAL PLAT

Mendota Heights, Minnesota, as follows:
1. That the final plat of Sibley Heights submitted at this meeting be
and the same is hereby approved.
2. That the appropriate City officials be and they are hereby author-

This Agreement, made and entered into this day of ,
19889 by and between the City of Mendota Heights, Dakota County, Minnesota,
(hereinafter called the "City") and Mr. Richard Bjorklund, 2311 Swan Drive,
Mendota Heights, MN 55120 and Mr. LeRoy M. Hanson, 530 Junction Lane,
Mendota Heights, MN '55118 (hereinafter called the "Developers").
W I T N E S S E T H:
WHEREAS, Developers propose a plat for a commercial development in
Mendota Heights to be known as Sibley Heights, consisting of twenty-four
(24) single family home lots on approximately acres in the northeast
quarter (NE 1/4) of Section 25, in Mendota Heights; and
WHEREAS, public services are needed by the Developers from Mendota
Heights in order to proceed with said development;
NOW THEREFORE, it is hereby agreed by and between the two parties as
follows:
1. Developers will petition the City for needed public improvements
(Sanitary Sewer, Storm Sewer, Watermains, and Streets). Developer
agrees to pay $3,750.00 escrow to the City as per Ordinance 1503.
Escrow to be refunded upon successful completion of a project.
2. Developers will provide at no cost to the City all needed temporary
construction easements to install said improvements and those per-
manent, right of way and easements, necessary for said public
improvements.
3. Developers will proceed immediately to commission a registered land
surveyer to place and maintain enough lot corners so that street
centerlines and all utilities can be located by City staff.
4. Developers agrees to grade site according to the grading plan
dated October 21, 1987 and protect the environment by the use of
good erosion control methods. Minimum erosion control require-
ments will consist of top dressing, seeding and mulching of dis-
turbed areas within 30 days of site work completion, as well as
the use of a sump area followed by a double row of silt fences
where concentrated surface water runoff takes place (per grading
plan).
5. Drainage along the west property line will be directed to a storm
water holding pond to be located at the southwest corner of the
site. Grading of this area will not be done until the City has
installed the overflow pipe for the pond.
6. Developers acknowledges that there will be park contribution due to
the City as per Ordinance 301, Section 6 as amended by Resolution
80-16. That contribution is to be $600 per lot or $14,400.
7. The City agrees to vacate a portion of Warrior Drive leaving only
an 80 foot wide right-of-way. The Developer agrees that the
vacation document will be filed at the same time the plat is
filed.

AND CALLING FOR HEARING ON PROPOSED SANITARY
SEWER, WATER, STORM SEWER, AND STREET IMPROVE-
MENTS TO SERVE THE SOUTHEAST AREA OF MENDOTA IIEIGII'TS
(IMPROVEMENT NO. 86, PROJECT NO. 1)
WHEREAS, the City Engineer has submitted his report to the City Council
with respect to the proposed construction of the following improvements
to serve the Southeast Area of Mendota Heights, to -wit:
The construction of an extension to the City's sanitary sewer
system, including appurtenances and incidentals thereto, and the
acquisition of easements, and the reconstruction where necessary
of streets and-easementsin the areas hereinafter more particularly
described.
The construction of a storm sewer system including appurtenances
and incidentals thereto and the acquisition of easements, in and for
the area hereinafter more particularly described.
The construction of an extension to the City's water distribution
system including appurtenances and incidentals thereto, and the acqui-
sition of easements, and the reconstruction where necessary of streets
and easements in the area hereinafter more particularly described.
The construction of street improvements consisting of the acquisi-
tion of easements and the grading, stabilization, drainage and bitumi-
nous surfacing, and the construction of concrete curbs and gutters on
the streets to be situated in the area hereinafter more particularly
described.
WHEREAS, the area proposed to be assessed for said improvements is
situated within the City of Mendota Heights in Dakota County, Minne-
sota, and is more particularly described as follows:
Land lying east of Dodd Road, west of Delaware Avenue, north of
1-494, and south of Friendly Hills and Copperfield Developments.
WHEREAS, in said report said City Engineer reported that the proposed
improvements and construction thereof were feasible and desirable and
further reported on the proposed costs of said improvements.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota as follows:
1. That the report of said City Engineer be and is hereby re-
ceived.
2. That a public hearing on said improvements be held on Tuesday,
February 1, 1988 at 7:45 o'clock P.M. at the Mendota Heights City
Hall 750 South Plaza Drive in the City of Mendota Heights.
3. That the City Clerk, with the aid and assistance of the City
Attorney, be and is hereby authorized and directed to prepare a notice
of said hearing and to cause said notice to be published and mailed to
the owners of the property situated within said area, all in accordance
with applicable Minnesota Statutes.

The following constitutes a feasibility report for the proposed con-
struction of sanitary sewer, storm sewer, watermain, and street improvements
to serve Sibley Heights. The subdivision consists of approximately 12
acres, divided into 24 lots. The Developer intends to site grade the entire
plat including building pads, streets and drainage swales, and has already
begun to remove excess common excavation. The Developer's engineer is in
the final stages of filing the finished plat following the vacation of
excess right-of-way for Warrior Drive (see November 13 memo from Public
Works Director), and having title revert to Mr. Richard Bjorkland, the
Developer.
UTILITIES
There are existing utilities in Warrior Drive which will be intercepted
to serve this subdivision. Work could begin in late spring following
completion of the site grading by the Developer. The attached drawings show
the layout of the proposed construction.
Sanitary sewers will consist of approximately 1060 lineal feet of mains
and 24 lot connections. The estimated costs for sanitary sewers is $72,000.
Watermains will consist of approximately 1,100 lineal feet of ductitle
iron main and 24 - 1" copper service connections. The estimated cost for
watermains is $58,800.
Storm sewer runoff for the entire subdivision will be collected and
directed to the existing Warrior Drive system, including a small retention
basin located at the southwest corner of the plat. This will reduce erosion
in the drainage swale along the west and south property lines. Costs for
the 740 feet of 12" and 15" concrete pipe and catchbasins will be approxi-
mately $33,600.
Streets will consist of the City's standard 30 feet wide, 7 ton driving
surface, with concrete curb and gutter and will feature two cul-de-sacs and
an eyebrow. Estimated costs for the approximately 1,200 lineal feet of
streets will be $72,000.
Cost Summary - including overhead, fees and contingencies:
Sanitary Sewer $ 72,000 or $3,000/Lot
Water 58,800 or 2,450/Lot
Storm Sewer 33,600 or 1,400/Lot
Streets 72,000 or 3,000/Lot
Estimated Total $237,600 $9,900/Lot
ASSESSMENT
The Developer has requested that the assessments be divided equally
among all the 24 lots which would be approximately $9,900 per lot. This is
on the low side of recent assessments for improvements, but the lack of any
difficulties in design and the fact that Warrior Drive brought street and
utilities right up to the site earlier (the site has already paid its
assessments for Warrior Drive and its utilities) account for the lower
assessment costs).
RECOM[MENDATION:
Developer has petitioned the City for public improvements, and staff
has completed the attached study showing that such improvements are feasible
and recommends construction of the streets and utilities to serve Sibley
Heights as shown on the attached drawing.
ACTION REQUIRED:
If Council concurs with staff recommendation, Council should pass a
motion adopting Resolution No. 88- RESOLUTION ACCEPTING ENGINEER'S RE-

DISCUSSION:
The West St. Paul Postmaster recently called to inform me that
"Boardwalk" a City street in the Park Place Addition has another street in
Eagan with the same name (see attached map for street location). He said
that although these streets are in two different cities with two different
post offices it is already causing problems. He requested that we amend our
Boardwak to be Boardwalk Court. I called Mr. Mike Halley, the Developer,
and asked if he would object to the name change; he does not.
RECOMMENDATION:
Staff .recommends that Mendota Heights comply with the West St. Paul
postmaster's request and change the name of Boardwalk to Boardwalk Court.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should

The City Council of the City of Mendota Heights, Minnesota, does hereby
ordain:
SECTION 1. The name of the street situated in the City of Mendota
Heights, Dakota County, Minnesota heretofore known and designated as
"Boardwalk" shall be and is hereby changed and renamed "Boardwalk Court" and
shall hereafter be known as "Boardwalk Court".
This ordinance shall be in full force and effect from and after its
publication according to law.
Enacted and ordained into an Ordinance this 1st day of March, 1988.

SUBJECT: Public Hearing for Mary Anderson Homes
Wetlands Permit
DISCUSSION:
Staff inadvertently neglected to publish for a public hearing for the
wetlands permits for the Mary Anderson Homes proposal. Because the notice
for the hearing needs to be both published and mailed the earliest we can
now hold it is the April 5th City Council meeting. Representatives from
Mary Anderson Homes will be available this evening should Council want a
presentation however another presentation will -have to be made at the April
5th meeting for the public hearing.
RECOMMENDATION:
Staff recommends that the matter be tabled until the April 5th City
Council meeting to allow publication for the required wetlands permit
hearing, however any major issues should be brought up tonite so that the
Developer will have time to work on addressing them. Planning Commission
Chairman Morson also said that he would be open to having the proposal sent
back to them in March if Council wanted input from the Commission on any
major Council issues.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion tabling the Mary Anderson plat and wetlands considerations to
the April 5, 1988 City Council meeting.

Bond Issue described in this brochure. The $2,500,000 Bond Issue will assure
the realization of a complete park and recreation system for the City and the
preservation of natural and scenic open space for our enjoyment and for the

and economical implementation of a well—structured park and open space plan
which meets the needs of the community.

COMMUNITY
RECREATION
AREA
A 35 acre Community Recreation Area is proposed to be acquired and developed south of Mendota Heights Road, be-
tween Dodd Road and Delaware Avenue, north of I-494. The Recreation Area Plan includes construction of two soc-
cer/football fields, two softball fields and a baseball field. Lighting, fencing and enclosed dugouts are planned for each of
the fields, and portable bleachers will be provided.
A 2,000 square foot comfort building is planned, and will provide information, concession and restroom and facilities.
The recreation area will include a picnic shelter, play structure, a 240 square foot warming house to serve a "free skating"
area, facilities for volleyball, basketball, and horse shoe courts.

TRAILS PLAN
88% of Mendota Heights' residents responding to
a June, 1984 parks survey indicated a desire for more
bicycle/pedestrian trails, making it the top priority.
The plan diagrammed below answers that need by
adding approximately 15 miles of trail and creating a
"backbone" system that connects parks, schools, the
proposed community recreation area, and retail
areas.
The Mendota Heights trails would not be an end in
themselves, but would link up with other regional
trails. The Dakota County system would be accessed
via Pilot Knob Road into Eagan. Access to the I-494
bridge crossing will lead to Fort Snelling State Park.
and the planned Minnesota Valley Trail. Access to
Lilydale Regional Park (which the City of St. Paul
proposes to upgrade) would be provided on the
north. When the State upgrades Highway 110 and
the Mendota Bridge, the Department of Transporta-
tion will construct the trail section along T.H. 110,
and bicyclists and pedestrians will have easy access
to Minnehaha Falls and the entire Minneapolis sys-
tem.
Trails will be separated from busy arterial streets.
On -road applications with striping and signage will ;
be limited to low traffic volume neighborhood
streets.

service (be it meals or days of care) to 13,488 boys and girls, men
and women. But, more important than these numbers is the kind of
care, the quality of service provided. We believe ours is a
ministry of service as we give food and clothing, as we visit the
sick and imprisoned, as we help a child learn to love and trust and
grow.

WHEREAS, the Volunteers of America, a Christian social
service organization, is celebrating its 92nd year of service
to the people of Minnesota and the nation; it is therefore
certainly appropriate for us to join in the observance of
this milestone with the commemoration of March 6-13, 1988 as
Volunteers of America Week; and,
WHEREAS, the.Volunteers of America is making a valuable
contribution of the people of Minnesota by providi.nq
residential treatment centers, programs serving autistic and
developmentally disabled children and youth; foster and group
homes for infants; children and youth; homes for elderly
and/or mentally disabled adults; senior citizen dining sites,
correctional programs, housing complexes for families, the
handicapped, and the elderly; and long-term care facilities;

compassionate, yet practical crusade, is extending spiritual
fellowship as it provides relief where it is most urgently

Pursuant to due call and notice thereof, the regular meeting of the
City Council, City of Mendota Heights, was held at 7:30 o'clock P.M.
at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M.
The following members were present: Mayor Mertensotto, Councilmembers
Blesener, Cummins, Hartmann and Witt.
AGENDA ADOPTION Councilmember Hartmann moved adoption of the
agenda for the meeting.

PUBLIC COMMENTS Mr. Joseph Maher and Mr. Harry Rubbright were
present to complain about aircraft noise over
the Mendota School area.
The Council discussed the issues of aircraft
separation and corridors. Administrator
Frazell gave a status report on corridor
location discussions.
It was Council consensus to direct the City
Administrator to try to schedule a meeting
with the Eagan City Council to discuss
aircraft corridors on February 19th or March
9th, and to request MAC representatives to be
present.
PARK REFERENDUM Councilmember Cummins, on behalf of the Parks
Program Review Committee, reviewed the
proposed recreation area and trail program f
the Council. He stated that the number of
paved parking spaces has been increased from
120 to 180 and that 40 spaces for overflow
parking in the grassy area is also proposed.
He stated that the Committee also recommends
inclusion of a free -skating area on the pond,
at an estimated cost of_$25,000 for warming
houses and lighting.
City Attorney Hart informed Council that
Centex has requested a contingency clause in
the developer's agreement. Since they must
acquire an Indirect Source Permit from the
Pollution Control Agency before the Kensington
Project can be developed, Centex will not
commit to the $750,000 recreation area
acquisition price until'the Permit is
approved. He stated that Centex has indicated
that their option on the property has been
extended because of the permit requirement and
that they will not purchase the land unless
the Permit is approved.
After discussion, Councilmember Cummins moved
adoption of Resolution No. 88-09, "RESOLUTIO*T
CALLING FOR AN ELECTION ON $2,500,000 GENER
OBLIGATION BONDS OF 1988," establishing the

polling place hours and locations, the form of
notice'and the referendum ballot.
Councilmember Hartmann seconded the motion.

SOUTHEAST AREA Public Works Director Danielson reviewed the
IMPROVEMENTS plans and specifications for Mendota Heights
Road/Huber Drive area street, sewer, water and
storm sewer improvements. He indicated that
although bids are proposed to be received on
March 25th, the contract award will not be
recommended until the Kensington Indirect
Source Permit is approved.
Councilmember Hartmann moved adoption of
Resolution No. 88-10, "RESOLUTION APPROVING
FINAL PLANS AND SPECIFICATIONS AND AUTHORIZING
ADVERTISEMENT FOR BIDS FOR IMPROVEMENTS TO
SERVE THE SOUTHEAST AREA OF MENDOTA HEIGHTS
(IMPROVEMENT NO. 86, PROJECT NO. 1)," and that
specifications for the project stipulate that
the bid may not be awarded for 60 days after
bids are received.
Councilmember Witt seconded the motion.

MARKET STUDY Council acknowledged a memo from the City
Administrator recommending that a community
market study be commissioned to determine what
the market is for commercial establishments in
Mendota Heights. Council also acknowledged a
letter from Resolution, Inc., expressing
interest in preparing such a study.
After discussion, Councilmember Witt moved to
authorize staff to solicit consultant
proposals.

TEAM BUILDING Council acknowledged and discussed a memo from
the City Administrator regarding
Council/Commission team -building. Council
directed Administrator Frazell to report back
with names of potential facilitators and a
tentative date for conducting the session in
May.
BORINGS, INC. CLAIM City Attorney Hart informed Council that
Borings, Inc. will not accept a $3,000
settlement on its claim (Centre Pointe South

project) and has informed him that if their
$6,130 claim is not approved, they will
litigate the matter. Mr. Hart informed
Council that the claim submitted by Borings is
for materials only and does not include labor
and other expenses. He recommended that the
claim be settled.
Councilmember Witt moved to direct the City
Attorney to settle the Borings, Inc. claim for
the requested amount of $6,130.
Councilmember Hartmann seconded the motion.

COUNCIL COMMENTS Councilmember Blesener asked for Council input
regarding City Hall reception desk design and
updated the Council on the City Hall
construction committee discussions on the
reception desk and office furnishings.
The Council discussed the need for a new city
logo and directed Administrator Frazell to
contact graphics design artists to determine
costs.

On December 15, 1987, the Dakota County Board of Commissioners
unanimously adopted a position paper on the use of tax increment
financing. A copy of the adopted position paper is attached.
The paper outlines the County Board's concerns about the growing
use of tax increment financing to support private development.
Although the County Board understands the cities' desire to
improve their local economies, the Board disapproves of the use
of tax increment financing for this purpose.
The County Board does support the use of tax increment financing
for true redevelopment efforts, and for promoting housing
opportunities for seniors and low and moderate income
individuals. To support these efforts, the County has
established four TIF districts through the County's Housing and
Redevelopment Authority.
The position paper will be used as the basis for the County's
review of proposed tax increment financing districts. We ask
that you consider the County's concerns as you prepare future tax
increment financing plans.

Tax Increment Financing Position Paper
The original purpose of Tax Increment Financing was to stabilize
blighted or deteriorated areas in need of redevelopment. The
financing mechanism provides for the. payment of public
improvements by capturing the increased tax revenue created by
the incentive given to private development.
The Dakota County Board accepts the use of Tax Increment
Financing for bonafide redevelopment efforts. In fact, the
County currently utilizes Tax Increment Financing to provide
housing opportunities for low and moderate income families and
seniors.
Unfortunately, in the opinion of the Dakota County Board of
Commissioners, the use of tax increment financing has deviated
from this purpose to include the public subsidy of private
development. Tax increment financing is increasingly being used
more to impact the timing and type of development than it is
being used for creating opportunities for private enterprise to
invest in redevelopment.
The Dakota County Board stands opposed to the use of tax
increment financing for projects that are not true redevelopment
projects or low and moderate and senior housing projects. This
opposition is based up6n four principles.
First, the County is concerned about the use of County tax
dollars for purely local economic development efforts. If cities
wish to provide public subsidy to private businesses for economic
development purposes, the source of that funding should come from
within the community. As it stands now, cities are spending
County and School District funds to achieve their local economic
development ends.
Tax increment financing can be used to lure businesses from one
community to another. In these cases, the community that loses
the business must actually pay through their County tax dollars,
a portion of the cost of the public improvements that were used
to entice the business from their community.
Second, tax increment financing allows the use of County tax
dollars without the County having a real voice in their
expenditure. With the current situation, the County has no say
about the use of the tax increment. Cities are only required to
inform the other taxing jurisdictions of the loss of their tax
dollars.
Third, tax increment represents an erosion of increase in the
County's available tax revenue at a time when the demand for
County services is the greatest. The County is facing severe
restrictions imposed by the State Legislature on its ability to
generate revenue. Tax increment further impedes the County's
ability to raise enough revenue to meet its fiscal needs. Dakota
County is the fastest growing County in Minnesota and, as a
result, has severe pressure to increase its level of service
provided to its citizens. Tax increment financing impedes the
County's effort to provide service.
Finally, tax increment financing plans seldom consider the direct
costs to the County to support tax increment projects. Tax
increment projects often result in increased traffic loads that
require traffic signals, road reconstruction, and other highway
improvements. The impact of the tax increment projects often
extend beyond the immediate district boundaries. It is also rare
for these external highway improvements to be considered in the
tax increment plans. In addition, tax increment also results in
higher administrative cost for the County. The County Auditor
must certify property values and perform record keeping functions
directly related to tax increment financing. The County Planning
Department is charged with the responsibility of reviewing tax
increment plans. The County receives no funding for performing
the required administrative costs.

SYNOPSIS OF MONTHLY RUNS
The fire department responded to 24 calls during the month. None of these
calls resulted in any major structural fire damage. We did respond on 3
vehicle fires that resulted in $4400.00 damage.
MONTHLY TRAINING
The monthly training was spent listen to Jim Kirvida of Custorn Fire talk
about proper pump operation and maintenance of fire pumpers. We invited
members from neighboring departments to attend and South St. Paul sent
two firefighters. It was a very informative class and was taped for future
training sessions.
The monthly rescue drill focused on rescue procedure:-:, fr!--irn vehicles.

PLANNING COMMISSION MINUTES
FEBRUARY 24, 1988
The regular meeting of the Mendota Heights Planning
Commission was held on Wednesday, February 24, 1988.
Chairman Morson called the meeting to order at 7:31 o'clock
P.M. The following members were present: Morson, Anderson,
Duggan, Henning, Krebsbach and McMonigal. Burke had advised
the Commission that he would be out of town. Also present
was Planning Consultant Howard Dahlgren and Public Works
Director Jim Danielson.

CASE NO. 88-05,
Chairman Morson called the meeting to
BREAM HOMES, PRE-
order for the purpose of a public hearing
LIMINARY PLAT FOR
to consider a preliminary plat for
VICTORIA HIGHLANDS
Bream Homes. Mr. Jim Hill, consultant,
and Howard Bream, developer, were present
for the discussion. Mr. Hill noted that
Council had approved the 37 acre
development plan some time ago for the
property south of South Ridge, and that
now the developer desires preliminary
plat and final development plan approval
for the townhomes portion of the area.
He noted there would be 32 attached

townhomes on 10 acres. Each owner would
be fee owner of a lot, and Lot 8, Block 1
is designated as open space. There
will be platted outlots beyond the first
seven lots. Access to the 32 units will
be off Marie, with a second entry also
off Marie which will be gravelled with a
break -off post for emergency use. Mr.
Hill noted that the first seven lots
would be in Phase I. He also noted that
the developer will provide a blanket
drainage and utility easement over the
common area in Lot 8, Block 1.
Public Works Director Danielson stated
that the City will require a storm sewer
easement which will be addressed in the
final plat. This would either be in the
road or over some of the lots.
Mr. Bream noted that there will be two or
three units per building lot and that two
story buildings will contain 2200-2400
square feet. Rambler homes will have
1600 - 2000 square feet, and there would
be loft spaces of between 250-500
additional square feet. The homes will
have cedar exteriors with a three car
garage option. All units will have
fireplaces and there will be some with
skylites. Townhome prices will range
from $225,000 to $300,000. Lots 3 and 4
will be ramblers and there will be 11
different types of floor plans available.
The developer will comply with all of St.
Paul Water Utility's requirements and
make the watermain a public main and be
maintained by them.
Chairman Morson noted that the driveways
with three car garaVes are 32 feet wide.
City ordinance requires 25 foot•wide
driveways. Public Works Director
Danielson noted that since this will be a
private street, the 32 foot width is
allowable.
There was discussion among the Commission
members that the preliminary plat could
be approved as shown on the drawings
presented this evening with the
understanding that it will be further
divided into as many units as shown on

the drawings tonight. There will never
be more than 32 units.
Chairman Morson asked for questions or
comments from the audience. There being
no questions or comments, Commissioner
Duggan moved to close the public hearing
at 7:52 P.M.
Commissioner Henning seconded the motion.

Commissioner Duggan expressed his desire
to have all three car garaVes have
25 foot wide driveway openings such as
shown on Lots 13 and 16 of page 3. He
noted that this driveway width '
disappeared on the landscape plan shown
on page 4, and he expressed his
preference for what was shown on page 3.
Chairman Morson noted that the entrance
sign shown on page 4 may need a variance.
Mr. Bream noted that sign plans have not
been developed yet, but if a variance is
needed, they would request one before the
Planning Commission. He noted that'the
sign will be a permanent entrance
monument.
Commissioner Krebsbach expressed concern
with the fact that there is no other
access for emergency vehicles at the
juncture of the circle roadway, in the
event the entrance road is blocked.
Mr. Hill noted that landscaping will be
kept to a minimum at that juncture and
that the roadway is 24 feet wide with a
mountable curb and meets all City codes.
Commissioner Anderson moved to recommend
to the City Council that the preliminary
plat be approved subject to the following
conditions:
1. That no greater number of units be
prepared other than the 32 units as
set forth in the PUD plan.
2. That there be a minimum 20 foot
utility easement space provided
between Outlot A and B for a storm
sewer line.

Mr. Grant gave a brief history of the
Company, and noted that there were many
constraints they encountered in trying to
develop the 70 single family homes,
especially due to the many ponds on the
site. He noted that the homes will sell
in the $250,000 to $400,000 price range.
He noted that the two larger ponds are
protected by the DNR and the two smaller
connected ponds are not DNR protected.
The two larger ponds will have a 15 foot
scenic easement around them and there
will be one 800 foot long cul-de-sac in
the northerly portion of the site. There
is one low area in the plat that will
require filling and there is a heavy tree
line on the north property line, which
will be preserved as much as possible.
The developers are very concerned with
saving as many trees as possible and they
may transplant trees along Dodd Road.
There will also be a five foot berm with
trees planted every 25 feet along Mendota
3. That there be a minimum 50 foot
utility easement space provided
between Outlot A and Outlot I for
utilities and street construction.
Commissioner Henning seconded the motion.
Commissioner Anderson amended his motion
by adding that the Commission recommended
approval of the development plan for the
Planned Unit Development.
Commissioner Henning accepted the
amendment.

CASE NO. 88-06,

the discussion.

Heights Road.
Mr. Haas noted that there will an 8 foot
by 75 foot steel core pedestrian bridge
built over the two large ponds and there
will be a walkway system throughout the
plat. Each lot averages 19,000 square
feet above water, and including water in
the square footage, there will be 25,000
square feet of lot area. Each lot has at
least 100 feet of frontage at the
building line. Mr. Haas noted that this
site will require 2.6 wetlands permit,
although 20-30% of them may never be
needed depending on the depth of the home
constructed. Perhaps only 20 or 22
wetlands permits may be needed.
Mr. Haas noted that Mr. Bernard Friel had
sent a letter to Chairman Morson
concerning the scenic easement and the
number of wetlands permits needed.
Mr. Haas added that the construction will
be done in three phases, with the
easterly portion being the first phase,
the Dodd Road portion the second phase,
and the northerly portion the third
phase. He also noted that the area where
the 8' x 75' bridge will be installed
will be filled and used as a temporary
haul road for heavy construction
equipment use in grading, etc., and to
allow access from the south portion of
the site to the north portion. He also
noted that there would be about an 8%
grade drop from Pagel Road.
Commissioner Duggan expressed concern
with the number of wetlands permits being
requested and especially the fact that
one lot would only be 25 feet from the
wetlands.
He complimented Mr. Grant and Mr. Haas on
the fine job they have proposed for the
land and added that he realized this was
a difficult parcel to develop.
Mr. Haas added that they will try to
increase the distance from the wetlands
area whenever possible. He also noted
that the walkout homes will be 8-10 feet
above the high water level and that all
ponds high water elevations will be

controlled by an outlet.
Commissioner Krebsbach suggested
combining Lots 7 and 8, Block 4, to allow
a better building pad on Lot 8, so the
home would be further from the pond.
Commissioner Henning asked why the
ordinance requires a 100 foot distance
from a wetlands area.
Planner Dahlgren said that was to
preserve the surface drainage system in
the City and that it is an arbitrary
standard. Some cities only require a 75
foot setback, and it is not a magic
number.
Mr. Haas suggested that the developers
could decrease Lot 7 by 15 feet, creating
a 90 foot wide lot, thereby increasing
Lot 8 by an additional 15 feet to allow
a home to be constructed 40 feet from the
wetlands area.
Commissioner Morson noted his desire to
see an emergency bridge across the two
larger ponds from the south to the north
for ambulance/rescue squad type vehicles.
He suggested that the steel core bride
be 10 feet wide, rather than 8 feet wide,
and felt the developers should pursue
that matter. Commissioner Krebsbach
concurred with this idea and asked if the
police or fire had commented on this
development plan.
Commissioner McMonigal asked if the
developers were aware of a park
dedication. Public Works Director
Danielson noted that they had been before
the Parks and Recreation Commission and
the Commission preferred a cash.
contribution in lieu of land.
Commissioner Henning commented on the
staggered setbacks and said he liked that
idea. Mr. Haas said they would like to
keep the staggered setbacks as shown on
page 7 of the drawings.

Mr. Steve Patrick, 737 Mendota Heights
Road, said he was generally in favor of
the plan and was pleased to see single
family development. He expressed concern
with the plantings along Dodd Road and
wanted to see more variety in the
groupings and have the trees closer than
25 feet apart. Mr. Haas noted that the
trees will be staggered and there will be
three different species.
Mr. Walt Paulson, 803 Hazel Court, was
enthused with the plan and asked how much
of the curb and gutter work would be done
in 1988.
Planner Dahlgren commented on how very
cooperative the developers were and felt
they did a super job with the plat.
There being no further comments or
questions, Commissioner Henning moved to
close the public hearing at 9:02 P.M.
Commissioner McMonigal seconded the
motion.
Commissioner Henning moved to recommend
approval of the preliminary plat for
Bridgeview Shores, Case No. 88-06, as
presented tonight, with the exception of
Lot 7, Block 4, being allowed a 10 foot
variance and having a 90 foot front yard,
so that the distance from the wetlands on
Lot 8, Block 4 would be increased an
additional 15 feet,; that the bridge over
the two larger ponds be 10 feet wide so
as to support some type of small rescue
vehicle; and that the requested wetlands
permits be approved as stated, with the
exception of Lot 8, Block 4, which should
be increased to a 40 foot setback, rather
than the original 25 foot setback from
the wetlands; and approval of the
vacation of the easterly portion of Pagel
Road. These approvals also include a 15
foot scenic easement around all water
courses in the plat, as shown on drawings
1-7, and allow for the staggered front
yard setbacks as shown on sheet 7.
Commissioner Duggan seconded the motion.

MENDAKOTA COUNTRY Mr. John Carl and Mr. Lannie Oxton were
CLUB SIGN REVIEW present to explain their proposed parking
lot revisions and proposed sign drawings
for Mendakota Country Club. Mr. Oxton
noted that the parking lot revisions were
as preferred by Planner Dahlgren and the
traffic flow is the only thing changed
from the original plan. Planner Dahlgren
felt this change is a 100% improvement
over the original plan.
Because of the small scale of the sign
drawings, the Commissioners were unable
to determine the sign size or location.
After much discussion, it was decided
that the applicants should present
readable sign drawings and have the
sign located in the proper place.
Commissioner Anderson moved to recommend
approval of the six foot front yard
setback variance for the home, a 12 foot
front yard setback for the garage,
approval of the wetlands permit to allow
the structures 10 feet from the wetlands,
and waiving of the public hearing
requirement.
Commissioner Henning seconded the motion.
Commissioner Henning moved to continue
the sign review process at a future date.

CASE NO. 88-07,
Mr. John Gelderman was present to seek

Ridgewood Park, at 1812 Valley Curve. He
noted that this lot was formerly owned by
Dr. Frank Milnar who had deposited fill
illegally on the site. Mr. Gelderman
noted that he would require a 12 foot
front yard setback for the garage and a
six foot front yard setback for the home,
as well as approval of a wetlands permit
to allow construction of the structures
within 10 feet of the wetlands. He noted
that his neighbor to the south had
approved his plans, but that his
northerly neighbor was in Florida for the
winter, and the house was rented out.
Commissioner Anderson moved to recommend
approval of the six foot front yard
setback variance for the home, a 12 foot
front yard setback for the garage,
approval of the wetlands permit to allow
the structures 10 feet from the wetlands,
and waiving of the public hearing

The estate of Edward Tilsen is in the process of transfering title of a
lot located along Trunk Highway 13 in Mendota Heights and a survey of the
lot was prepared by Paul McKinley. In preparing the survey, Paul discovered
that the City has an easement across the lot for sanitary sewer and that the
description for the easement is in error. Mr. Kenneth Tilsen, as represen-
tative of the estate, has provided the City with a new corrected easement,
now the City needs to vacate the incorrect one.
RECOMMENDATION:
A new corrected easement has been provided for the subject lot (see
attached drawing and easement). Staff recommends vacating the existing
incorrect easement.
ACTION REQUIRED:
Conduct the required public hearing and if Council desires to implement
the staff recommendation, pass a motion adopting Resolution No. 88 -
RESOLUTION APPROVING THE VACATION OF A DRAINAGE AND UTILITY EASEMENT.

EASEMENT AGREEMENT
THIS AGREEMENT, made this a -04'k day of ;%CVwfaLAJ ,
1988, by and between THE ESTATE OF EDWARD N. TILSEN, party of
the first part, and the CITY OF MENDOTA HEIGHTS, a municipal
corporation (hereinafter called the "City")
W I T N E S S E T H:
That the party of the first part, in consideration of ONE DOLLAR
AND OTHER GOOD AND VALUABLE CONSIDERATION to it in hand paid by
the City, the receipt of which is hereby acknowledged, does
hereby grant, quitclaim and convey unto the City, its successors
and assigns, the following:
A permanent utility and drainage easement, including the
right of ingress and egress for the City and its agents,
servants and contractors, over, under and across the parcels or
tracts of land lying and being in Dakota County, Minnesota, more
particularly described as follows:
The Northeasterly 10 feet and the Southeasterly 20 feet of
the following described property, to -wit:
That part of Lot 6, Auditor's Subdivision No. 2, Mendota,
according to the recorded plat thereof on file in the office
of the County Recorder, Dakota County, Minnesota, described
as follows:
Commencing at the southeast corner of the northwest quarter
of Section 23, T28N, R23W, Dakota County, Minnesota; thence
on an assumed bearing of NORTH, along the east line of said
northwest quarter, a distance of 856.00 feet; thence South
57 Degrees 22 Minutes 00 Seconds West, 680.00 feet to the
point of beginning of the parcel to be described; thence
South 57 Degrees 22 Minutes 00 Seconds West, 100.00 feet;

RESOLUTION APPROVING VACATION OF A DRAINAGE AND UTILITY EASEMENT
WHEREAS, the Estate of Edward N. Tilsen is the current record owner of a
drainage and utility easement as described as follows; and
The Northeasterly 10 feet and the Southeasterly 20 feet of the fol-
lowing described property, to -wit:
That part of Lot Six (6), Auditor's Subdivision No. 2, Mendota, ac-
cording to the recorded plat thereof on file in the office of the
County Recorder, Dakota County, Minnesota, described as follows:
Commencing at the southeast corner of the northwest quarter of Section
23, T28N, R23W, Dakota County, Minnesota; thence on an assumed bearing
of North, along the east line of said northwest quarter, a distance of
856.00 feet; thence South 57 Degrees 22 Minutes 00 Seconds West, 680.00

WHEREAS, a public hearing was held on said vacation on March 1, 1988, at
7:45 o'clock P.M., at the City Hall of the City of Mendota Heights; and
WHEREAS, the City Council then proceeded to hear all persons interested in
said vacation and all persons were afforded an opportunity to present their
views and objections to the granting of said petition.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the vacation of the drainage and utility easements described
above, situated in the City of Mendota Heights, is in the best interest of
the public and the City, and is not detrimental to the health, safety and
welfare of the community.
2. That the above described drainage and utility easements be and the
same is hereby vacated.
3. That the City Clerk be and is hereby authorized and directed to
prepare and present to the proper Dakota County officials a notice of com-
pletion of these vacation proceedings, all in accordance with the applicable
Minnesota Statutes.

DISCUSSION:

The Planning Commission conducted a public hearing at their February
meeting to consider a preliminary plat for the townhouse portion of the
Victoria Highlands Planned Unit Development. They also completed a final
review of the architecture for the units. The two main points of concern
were:
Why were nine outlots being platted instead of individual lots, and
would each outlot, as it was divided into lots, have to go through a final
plat process with a public hearing at the Planning Commission level?
1•)Mr. Bream informed the Commission that there are two types of units, a
rambler and a two story with eleven different floor plans. He stated that
because of the variety in selection of units, they needed the flexibility to
final plat each outlot as individual units were sold. He went on to ex-
plain, that they intended that this be the preliminary plat for the entire
area and that individual final plats of the outlots only be brought before
the Council. The Planning Commission agreed with this concept.
2. There are entrance monuments shown on the site plan but no details
were presented. Would Bream have to come back later for further approval of
those monuments?
Mr. Bream stated that the monuments design was not yet finalized and
that if the monuments met the requirements of the ordinance he would hope he
would not have to come back. The Planning Commission concurred.
RECOMMENDATION:
The Planning Commission voted unanimously to recommend approval of the
preliminary plat and the final Planned Unit Development Plan subject to
three conditions (seebelow).
ACTION REQUIRED:
Review the proposal with the applicant and if Council desires to imple-
ment the Planning Commission recommendation they should pass a motion ap-
proving the preliminiary plat and approving the unit design for the Planned
Unit Development subject to the following conditions:
1. That no greater number of units be prepared other than the 32 units
as set forth in the Planned Unit Development plan.
2. That there be a minimum 20 foot utility easement space provided
between Outlot A and B for a storm sewer line.
3. That there be a minimum 50 foot utility easement space provided
between Outlot A and Outlot I for utility and street construction.

In 1987 Bream Builders acquired the McCloud-Allstrom property located
in the northeast corner of Marie Avenue and Victoria Road. Bream then
submitted a proposal to develop the property as a planned unit development
with two types of housing; first, 35 single family lots were proposed on the
north part of the parcel adjacent to the existing South Ridge single family
development and secondly, 32 townhomes were to be developed along Marie
Avenue across from the emistling Eagle Ridge townhomes - The City approved
Bream's plan subject to final review of the townhouse design. Bream has now
submitted the townhouse design for City approval (attached). Staff has the
following comments on their proposal:
City Staff finds the plan acceptable as submitted subject to the fol-
lowing technical modifications:
1. Lot 8, Block 1, the common area, should be made a utilty and
drainage easement area.
2. There needs to be a minimum 20 foot utility easement space provided
between Outlot A and B for a storm sewer line.
3. There needs to be a minimum 50 foot utility easement space provided
between Outlot A and Outlot I for utilities and street construction.
ACTION REQUIRED:
Conduct a public hearing and make a recommendation to the City Council

1. The parcel is the southerly 10.2 acres of approximately a 30 acre tract,
which was previously approved for, single-family housing and townhouse
development. As you know, the single-family plat has been processed
and includes the southerly portion of a portion of a neighborhood public
park, platted in a previous subdivision several years ago in the property
immediately to the north.
2. This proposal

3. A series of seven drawings have been submitted, reduced copies of
which are attached. You will notice from looking at Sheet 2 that the
site has severe topographical constraints. This is particularly true with
respect to access because of the steep slopes that rise above Marie
Avenue as it proceeds easterly from Victoria. The only logical point to
access the site is the point at which it is being proposed, approximately
350 feet easterly of the intersection of Victoria and Marie. You will
notice that this is the only access to the site, which is the way it was
portrayed when the original PUD was approved. Though a second access
further to the east may be desirable, the terrain conditions are such
that it is totally impractical. A second access could be established
along Victoria, but it would be so close to the intersection of Victoria
and Marie that it too would be impractical. Therefore, it appears that
with the unusual conditions applicable to the site, a single access point
as proposed (and at that location) appears to be the most appropriate.
4. To the developers credit, the layout does not exploit the site. In fact,
all of the access streets serve development on only one side, which is
normally considered inefficient. This results, however, in a very
pleasant layout and retains the steep slopes along the south part of the
site (north of Marie) and the heavily, wooded area in the southeast
corner of the site.

5. Though floor plans have not been submitted, the exterior elevations of
the structures proposed suggest townhouse units of substantial quality.
Two and three car garages are featured with combinations of one and
two story elements. You will note that almost all of the units are of
a walkout design. The lot layout produces substantial back yards
utilizing ; access to the lower levels. The rear elevations shown on
Sheet 7 indicate the nature of the back yard and walkout conditions.
6. You will note in the preliminary plat that there are nine outlots
proposed for groups of dwelling units. It would appear that these are
proposed so as to provide flexibility in the layout and the division of
the individual parcels within the outlots. Each outlot consists of three
dwelling units. Two outlots are proposed to have two dwelling units per
lot. The Commission may wish to question the applicant's intentions
with respect to these lots. It has been typical practice recently,
however, to accomplish the division of the outlots later when the
specific common wall lines have been determined during and after
construction.
7. The application is for approval of the preliminary plat and the
development plan, it being a final stage of the original PUD approval.
Action on the application may include conditions that the development
be accomplished in accordance with the drawings submitted and dated
January 11, 1988, sheets 1 through 7, and subject to final staff review
of engineering and landscaping details.

Discussion
The Planning Commission conducted a public hearing at its February meeting to
consider the Bridgeview Shores preliminary plat and wetlands permits. There
were only five residents in the audience (two husband and wife teams), and
none of them had any adverse comments. The Planning Commission had received
a letter from Bernie Friel expressing concern over the number of wetlands
permits requested,.so they reviewed those requests in detail. The Planning
Commission approved of all requested permits except the 25 foot one on Lot 8,
Block 4. They directed the developer to decrease the frontage of the adjacent
lot to the north by 15 feet (leaving approximately a 90 feet frontage lot) to
provide a 40 foot setback from the wetlands on Lot 8, Block 4.
The Planning Commission also desires to have the varying front yard setbacks
as requested, and approved the setbacks as shown on Sheet 7, dated Feb. 1, 1988.
The Planning Commission then discussed the problems associated with having an
800 foot cul-de-sac. They agreed to allow the cul-de-sac if the pedestrian
bridge& from the south would be increased to 10 feet wide to accommodate light
weight emergency vehicles.
Recommendation
The Planning Commission voted unanimously to recommend approval of the
preliminary plat and wetlands permits as requested, subject to the width of
the bridge over the ponds being increased to 10 feet; Lot 8, Block 4, wetland
permit be a minimum of 40 feet setback from the wetlands (granting a 10 foot
front yard width variance for Lot 7, Block 4); the establishment of a 15 foot
scenic easement surrounding all the ponds and having staggered front yard
setbacks as shown on Sheet 7.
Action Reauired
Discuss the proposal with the applicant and if Council desires to implement
the Planning Commission's recommendations, they should pass a motion approving
the preliminary plat, wetlands permits, front yard width variance for Lot 7,
Block 4, and the front yard setback variances needed to construct the homes as
shown on Sheet 7.
If this proposal is approved by Council, staff will prepare a Developer's
Agreement documenting all the wetlands permits and other conditions and have

Approval of Preliminary Plat
1. This 47 acre tract was, as you know, recently put up for sale bathe
School District for which the buyer is Marvin H. Anderson Construction
Co. You will recall, when this property was considered by the Planning
Commission and Council for redesignation from a school site in the
Comprehensive Plan to residential development, a condition was attached
by the Council that the land be developed for single-family housing at
15,000 square feet per lot (excluding water area) and that the land not
be subject to the normal PUD consideration (for development other than
single-family housing). The applicants, representatives of Marvin H.
Anderson Construction Co., and their consultants have met with staff on
a number of occasions wherein preliminary concept plans were reviewed.
2. Because of the existence of permanent water bodies on the site, the
platting of the property for single-family lots is very difficult.
Particularly challenging is the handling of that portion of the property
north of the twin ponds in the northerly half of the site. It appears
that the only reasonable solution for the handling of this area results in
a cul-de-sac which is 800 feet from its intersection with Hazel Court
and Pagel Road on the west end. Any attempts to loop this street
results in necessitating a crossing of the narrow isthmus between the
ponds, or extending the road easterly along the shoreline, leaving
inadequate depth for development to the north property line. Though
the 800 foot cul-de-sac exceeds_ the nominal 500 foot cul-de-sac
maximum length, it appears that the cul-de-sac as proposed is the most
appropriate "solution.
3. The overall solution plats the property into 70 single-family lots. All
of the lots meet or exceed the 100 foot lot width requirement as measured
at the 30 foot building setback line. Each lot also has a minimum of
15,000 square feet of land above the high water line (where portions of
the lot include ponding areas).
4. The average lot

Thus, the overall
density
is relatively
low for a
47 acre site.
That
density (excluding
streets)
is 1.74 units
per acre.
The applicants
have
submitted a very
complete
set of plans
consisting of seven sheets
and a
development brochure with
reduced copies of the
plan and additional,

pertinent development data. The overall development proposal appears
to be of consistently high quality, producing a meticulously planned
concept.
5. The ponds on the site are part of the overall wetlands system.
Normally the development of structures are restricted to more than 100
feet from the high water line of such ponding areas. In the case of
this proposal, the applicants are seeking a number of variances for
specific lots. It has been the normal practice for the City to consider
such variances at the time of specific development proposals. However,
in this case, you will notice on Sheet 7 of the drawings that the
individual houses are proposed for each specific lot, with the distance to
the water line indicated on each water related lot.. Thus, it would
appear appropriate in this case to consider approval of the variance to
the 100 foot setback based on the plans as submitted. You will notice
that, in most cases, the setback distance to the water line exceeds -100
feet. The configuration of the topography, however, makes this almost
impossible to maintain the 100 foot setback in all cases. This is
particularly true with respect to the cul-de-sac in the far southeast
corner of the site and the site conditions along the narrow, northern
tier (north of the twin ponds in the northerly half of the site).
6. It appears in the development plan for the property, that the retention
of the existing trees has been an important factor. Though this is
difficult in the development of single-family lots in areas of
"interesting" terrain, it appears to have been done rather successfully in
this development proposal.
7. The application is for approval of the preliminary plat and approval of
variagces to the wetlands ordinance relating to setbacks to the high
water line of specific lots. Many options to the plans have been
considered by the applicant and the staff in the review of the design
for the development of this property. It would appear that the
proposed solution meets the City's development criteria in a reasonable
fashion, given the severity of the constraints of topography and ponding
areas.
8. Conditions could be included that the property be developed as
submitted in the development brochure dated March 1, 1988 and subject
to final engineering details.

SUBJECT: Mary Anderson Homes Subdivision/Wetlands Permit
Case No. 88-06
DISCUSSION:
Mary Anderson Homes has recently acquired the western portion of the
School Forest Site in the Southeast Area of Mendota Heights. They propose
to subdivide the site into 70 single family lots all meeting or exceeding
the City's minimum standards for lot size and shape. They have done a very
thorough job of preparing their application material (see attached). Staff
has reviewed their application and offers the following comments:
1. The site has three ponds and undulating terrain making it imposs-
ible site to develop without considering wetlands permits for a
number of the lots. Mary Anderson homes has listed the ones that
they consider mandatory (see attached letter). Staff has no pro-
blem with approving the permits requested. We suggest they all be
considered and approved now, with the understanding that this is it
and no future permits will be considered.
2. Mary Anderson Homes proposes to stagger the front yard setbacks to
add interest to the subdivision - not have all the homes lined up
at the minimum 30 foot setback. This is acceptable to staff however
it may cause a problem in the future if a home that is set 40 feet
back is constructed first, aur
r ordinance provides for a 30 foot
setback or an "established" setback line, by homes previously
constructed. The home constructed 40 feet back would then be the
"established" line and,�home constructed in front of it would need a
variance. If Planning Commission likes the staggered front yard
setback concept, there should be some ground rules established for
handling it (perhaps a blanket variance could be granted, if con-
structed according to the approved plan).
3. Outlot A is for constructing a sidewalk to connect the two neigh-
borhoods across the pond. This sidewalk with its bridge will be
constructed as part of Phase I and then Outlot A will be dedicated
to the City and be our maintenance responsibility in the future.
4. Outlot B is composed of_mostly
mostly the land remaining from the Mendota
Water Company lot. That lot was used for their water tower. The
City will need to sign the plat as an owner and then Outlot B will
be dedicated to the City. A portion of the roadway for Mohican
Court extended lies over the old water tower lot.
The County records still show this lot to be in the Mendota Water
Company's name and that corporation has been dissolved. The City
was supposed to have been given ownership of the lot at the time
the City took over the Friendly Hills Water System so staff is
investigating why it did not occur.
5. Bridgeview Court is shown as a long cul-de-sac that exceeds the
City's maximum 500 foot length. If the Planning Commission would
want to be able to elminate the long cul-de-sac some day - there
seems to be only one option and that would be to plat a street
north into Bernie Friel's land. Some day that land will develop
and a street could be extended through. Marvin Anderson Homes is
opposed to platting the street because it dramatically affects
their platting on the north side of Bridgview. It would probably
eliminate one lot and also create two corner lots out of the re-
maining five. These corner lots would then have 30 foot setbacks
from two streetS(Bridgeview and the newly platted unbuilt street).
6. Pagel Road, south of Hazel Court, is unbuilt and is not needed by
the City. Mary Anderson Homes has therefore asked that it be
vacated. The ownership of the east half of the right-of-way will
then revert to Mary Anderson Homes and the west half to the exist-
ing lot owneis on Hazel Court. Staff approved: of vacating Pagel
Road and.will set the required public hearing to be conducted by
the City Council.
7. The Developer held an informal meeting on February 13th with the
residents that are listed on the hearing notice. Twenty-seven
percent of the people notified showed up for the meeting and the
project was favorably received. Several items were raised that the
Developer will change to accommodate the residents, the most signi-
ficant of which is that he will now incorporate scenic easements
around the ponds to preserve wildlife habitat. All of the resi-
dents on the notification list have been sent information booklets
on the project.
8. The Developer's application documents are very complete and de-
tailed on engineering items so staff has done a fairly detailed
review of them and verbally discussed several minor changes. The
Developer has agreed to cooperate on all the requested changes so I
will not list them.
9. The Developer estimates that prices for the homes to be built in
this subdivision will be $250,000 and up.
ACTION REQUIRED:
Conduct the public hearing to consider the subdivision and wetlands
permits and make a recommendation to the City Council.

I mentioned the last time we met on Monday, February 1, that
I would send you some additional information in regards to some
of our requests.

We are requesting vacation of the east 33 feet of Pagel Road
lying South'of the South line of Hazel Court extended Easterly
to the South line of Simek re -arrangement extended Easterly.
One item I have not mentioned is in regards to trees. Every
effort will be made during development to transplant trees when
possible, provide retaining walls where necessary. Each lot will
have a tree survey made at the time of home sale. The home will
be designed as much as possible with existing tree cover in mind.
This we have done wherever we build homes. Trees are very
important to us.
Along Mendota Heights Road we are planning to have a 5 foot
high berm with 6 foot pine trees planted every 25 feet center
to center.

At their February meeting, the Planning Commission reviewed the Gelderman

The Planning Commission voted unanimously to recommend approval of
Gelderman's request.
If Council desires to implement the Planning Commission's recommendation, they
should pass a motion approving a 6 foot front yard set back variance for the
house, a 12 foot front yard set back variance for the garage, waive the
requirement for a public hearing, and grant a wetlands permit to allow construc-
tion of their house within 10 feet of a wetlands.

HISTORY:
In 1979 Dr. Frank Milnar was caught filling on Lot S, Block 1, Ridge-
wood Park without a wetlands permit., He then applied for a permit but the
permit was denied without prejudice subject to him preparing building plans
and resubmitting a new application.

Dr. Milnar has now sold this lot to Jim and Mary Gelderman. The
Geldermans have prepared the attached house plans and request that a wet-
lands permit and front yard setback variance be granted to allow them to
construct the home. Staff has the following comments on the application:
1. House plans were prepared after Mr. Gelderman consulted with staff
and we feel that they have been prepared taking into consideration
the physical constraints of the property:
a. A wetlands on the west
b. Sanitary Sewer easements on the west and north.
c. Poor soil for foundation.
d. A steep embankment from the street to the wetlands level.
e. Existing trees on the site.
2. There is a City owned storm sewer outlet on the north lot line that
was buried by the filling and needs to be extended. Mr.
Gelderman's plan show that line being extended. Any approvals
should be subject to the applicant extending that line at no ex-
pense to the City.
3. Mr. Gelderman's garage, to avoid excessive filling, encroaches 12
feet into the front yard. The lot is located on a curve and staff
feels that the front yard encroachment will not be noticable.
4. Mr. Gelderman promised staff that he would contact his affected
neighbors and get their signed concurrence to his plans. He has
not submitted evidence of doing that as of the date of this memo.
ACTION REQUIRED:
Review the application and make a recommendation to the City Council on
the 12 foot front yard setback variance, waiving the public hearing for the
wetlands permit and granting the wetlands permit to allow construction 10+
feet from a wetlands (Note: the other homes along Valley Curve are at
similar distances from the wetlands).

l. Seven or eight years ago, this property was being filled by the owner
of the land at that time, Dr. Frank Milner, who ultimately applied for
a wetlands fill permit. That permit was denied subject to the
preparation of specific building plots for the site. .Nkovv^ Dr. Milner in

plans indicating the development proposal.
2. You will nota from examination of Sheet l of the plans that the
site
has extremely difficult topography. ' The site is uhoUovv and drops
off
quickly to the west. Thus, a walkout solution is appropriate. However,
because of the nature of the terrain and the shallow conditions of
the
lot, the site plan indicates a 12 foot extension to the corner of
the
garage into the required 30 foot setback area. Given the nature of
the
terrain, it appears that the proposed site plan is roemonab1e. Because
of the curve in the roadway, it would appear that the intrusion of
the
corner of the garage in the setback will not be serious.
J. The staff has met with the applicant and its designer to review optional
solutions to the site. It would appear that the structure oo proposed
will produce a vary desirable solution on a very difficult lot.
4. Previously observed drainage conditions of the site have been solved.
A
15 foot easement for storm sewer purposes originally proposed at
the
time of the Milner consideration is proposed in the current plan.
The
plans also include the extension of the storm sewer through
this
easement to the low lands to the west.
5. Jim [}onlabnonx Public Works Director, has prepared o report, e copy of
which is attached. He notes the the site conditions and positive
development proposals. It would appear that this difficult site can be
successfully developed under the proposal as submitted by the applicant.
6. The site plans do not indicate the exact setback of the building from
the wetlands high 'water line. We will attempt to determine that prior
to the Planning Commission meeting. It would appear that positive
consideration of the proposal may be merited with the conditions that
the property developed in accordance with the plan submitted and
subject to final engineering details.

At their February 2, 1988 meeting, the City Council agreed to fund the
Northland Drive Railroad Crossing from Tax Increment Financing. Staff
informed Soo Line Railroad and asked that a formal agreement be prepared to
address funding and responsibilities of the railroad. The railroad sub-
mitted the attached agreement as requested.
The American National Bank and Trust Company which is also the escrow
agent for City Hall is proposed to be the escrow -agent for the railroad
crossing. Their charges are $750 plus $25 per check. By having an escrow
agent and keeping our money invested, the City will make $6,000 - $7,000 on
interest.
RECOMMENDATION:
Staff recommends approving the agreement with the railroad and using
the American National Bank as our escrow agent.
ACTION REQUIRED:
If Council desires to implement the staff recommendation they should
pass a motion authorizing the Mayor to execute the attached agreement and
authorizing staff to start an escrow account with the American National Bank
to fund the project.

In accordance with the Minnesota Department of Transportation Order dated
October 27, 1982, Docket No. R -3858/D-5177, the Soo Line Railroad Company will
install at the expense of the City of Mendota Heights, Minnesota, a 63' rubber
crossing and cantilevered flashing light signals with short arm gates at the
proposed Northland Drive railroad grade crossing.
The City shall deposit the estimated sum of $162,140 in escrow in accordance
with the cost estimate dated July 22, 1987. Progressive monthly bills will be
submitted to the escrow holder for payment as the work progresses. Upon
completion of the project a final bill will be issued showing the amount to be
refunded or billed to the City, depending upon actual costs. Please issue
notice to this office with name and address of escrow holder, so we can proceed
with authority to carry out this project.
As indicated in my letter of March 13, 1987, it requires approximately one year
to prepare plans, acquire materials and do the work after authority is received
to proceed.
This letter, written in duplicate, and signed by both parties shall constitute
an agreement.

SUBJECT: Order of Appraisals for Mulvihill Area Properties
On Thursday, February 18, Mayor Mertensotto, Treasurer
Shaughnessy, and I met with residents of the Mulvihill area,
to continue discussions about potential City acquisition of
their properties for redevelopment. Every area household was
represented at the meeting, and we spent approximately two
hours in detailed discussion about the process that would be
followed for acquisition and relocation, and diving the
residents an opportunity to express their individual feelings
about the project. only one homeowner indicated that he did
not wish to be relocated. The others were unanimous in -their
interest in continuing discussions, with each adding the
caveat that "it depends on the price". The meeting ended
with group indicating that they would like for the City to
keep moving forward with the process, by ordering appraisals
on the property.
Staff has met with Blake Davis of Davis and Lagerman, to
obtain a quotation on the cost of appraising the properties.
Their letter of proposal is attached, and their indicated fee
as follows:
1. Mulvihill area residential property $4,900.
2. Acacia Park Cemetery area holdings $800.
3. Separate valuation of 1. and 2. for resale to a
developer for industrial type purposes.
4. Rogers Road area - $2,600.
Attached is a map on which we have indicated the areas that
would be appraised as outlined above.
The City has previously used Davis and Lagerman for
property appraisals, and had good experience. Based on his
past experience, Mayor Mertensotto strongly recommends Davis
and Lagerman as a firm whose work has credibility and will
withstand legal scrutiny.
The Council would have the option of ordering the
appraisals by Davis and Lagerman as outlined in the attached
proposal, or directing staff to solicit additional quotations
for the services.
We will be meeting with the Rogers Road neighborhood on
March 10, and whatever the Council action this evening, we
would not direct Davis to begin appraisal of those properties
until we are convinced that the neighborhood is in support of
a current buy-out and relocation effort.
All property appraisal costs will be covered by the Tax
Increment District.
ACTION REQUIRED:
To decide whether Council wishes to go with the Davis
and Lagerman proposal, or direct staff to solicit additional
quotations.
If Council wishes to accept the proposal,
a motion authorizing Davis and Lagerman, Inc.,
property appraisals as outlined in their letter

Thank you for the opportunity to provide you with this fee
proposal for my appraisal of a number of parcels, part in the
area of the Acacia Park Cemetery and part along Rogers Road, just
east of Highway 55 in Mendota Heights. I am writing this letter
to quote what my fees would be for doing this project.
I am providing four fee quotations here. The first is in the area
of Acacia Park Cemetery and is for properties owned by private
parties other than the Acacia Park Cemetery along both the north
and south side of Acacia Boulevard and the east side of Pilot
Knob Road. For this portion I would provide you with eleven
separate appraisal reports. My reports will be full detailed
narrative reports outlining my conclusion and method of arriving
at my conclusion. To appraise all of those properties I would
charge a fee of $4,900. These parcels cover the tax identication
numbers which end as follows: 011-02, 020-02, 022-02, 030-02,
031-02, 040-02, 050-02, 051-02, 131-02, 071-02, 081-02, 070-01,
080-01, 090-01, 020-27, and 030-27. Most of the appraisal reports
cover individual tax parcels. However, because they are adjoining
tax parcels and because they are under common ownership I have
combined two or three into one report. I have combined 031, 040,
and 050-02 into one report, 051 and 131-02 into another report.
071 and 081-02 into another report, and 020 and 030-27 into one
report.
As a separate item you inquired what my fee would be to appraise
the Acacia Park Cemetery holdings in that area. These include the
south portion of tax IDY 060-01 and all of parcels 061 and
091-01. 1 would charge a fee of $800 to appraise this property
separately from the other parcels.
Further, you inquired as to what my fee would be to value all of
the first Darcels with the improvements removed for resale to a
developer. My fee to do that would be $1,200.

Finally, there are a number of parcels on the north side of
Rogers Road and along the east side of State Trunk Highway No.
55. 1 have identified six different appraisal parcels in that
location. To provide you with individual appraisal reports on
each of those six, my fee would be $2,600. Again, some of the tax
parcels would be combined because they are adjoining pieces under
common ownership. The tax parcels which I propose to appraise
here all end in the digits 00 and the three digits prior to that
are 010, 020, 030, 040, 060, 063, 068, and 067. Of these I would
combine 020 and 030 in one appraisal report and 063 and 068 in a
single report.
As I indicated to you yesterday, I could complete this appraisal
work within two months time from, the time you give me approval to
proceed. ' For your information I have attached to this letter a
copy of my qualifications resume.

Council budgeted $10,000 to implement a tree planting program in 1988.
DISCUSSION:
The spring newsletter is being prepared right now and staff is in-
cluding a short notice in the newsletter inviting residents interested in
having boulevard trees to contact City Hall. We therefore need to have
Council establish ground rules quickly so that we know what to tell them.
South St. Paul has had a tree program for twelve years so I contacted
them for advice. Between that discussion and staff's imput I offer the
following comments:
1. The cost for a 2 1/2" minimum caliper tree, planted and staked
with a one year guarantee is estimated to cost $150 per tree.
2. South St. Paul plants their trees in the boulevard for all re-
questing residents at no charge. They have not had a problem with
requesting residents not taking care of the trees. When they
tried planting trees where they were not requested, then they had a
problem.
3. If Mendota Heights would follow suit and not charge the residents,
we could plant approximately 65 trees this year ($10,000 -Ii-$150 ,^,//
65).
4. Council had initially discussed having the requesting residents
pay a portion of costs, the idea of this was to give them some
ownership so they would maintain the trees (South St. Paul has not
found that to be a problem).
ACTION REQUIRED:
Discuss the tree planting program and give staff direction on how to
implement it.
Some issues to be resolved:
1. Should there be a charge for trees and if so how much?
2. Should we plant trees only in the boulevard or should we allow
them them on private property?
3. Should we prioritize available trees on a first come first served
basis or some other way?

SUBJECT: Sub Lobbying Effort Regarding Property Tax
Reform Proposals
Most of you are probably aware that the 1988 legislature
is expected to take a serious look at major property tax
reform. Two specific proposals have been put forward, one by
Governor Perpich, and one by the Coalition of Greater
Minnesota Cities, Minneapolis and St. Paul (sometimes
referred to as the "Briggs and Morgan" plan). A major thrust
of both plans is to "equalize" the State's property tax base,
meaning that high value, low mill rate cities like Mendota
Heights will receive less State aid and rising property tax
bills.
In my opinion, the "Coalition" proposal is particularly
onerous, in that it would appear to lead to a long-term and
massive drain of State property tax subsidies from
metropolitan area suburbs to "greater Minnesota". Although
many suburban cities appear to do well in the first year of
this program, I believe most suburban officials are extremely
skeptical about the lonq-range effects, and not in support of
the program. The Association of Metropolitan Municipalities
has adopted a series of principles for property tax reform,
under which the AMM could not support either the Governor's
or the Coalition plan.
Attached is a letter from Minnetonka City Manager Jim
Miller, inviting our participation in a suburban effort to
defeat the "Coalition" plan. I would strongly recommend that
we participate!
ACTION REQUIRED
To decide if Council wishes to participate in the
suburban property tax lobbying effort, and to indicate what
city officials will attend the March 10th meeting in
Minnetonka.

Dear Mayor and City Manager:
You are invited to a meeting on March 10, 1988,,at 7:00 P.M. in the
Minnetonka Community Center (map on reverse side) to discuss an issue
of critical importance to your community.
As you are undoubtedly 'aware, property tax reform is again a
controversial issue with the Legislature. While several proposals
will"' be considered, one in particular is especially damaging to
metropolitan area suburbs.
The cities of Minneapolis and St. Paul have joined with the Coalition
of Greater Minnesota Cities (the larger outstate cities) and hired
Briggs and Morgan to develop a property tax proposal to, in their
opinion, "equalize" tax rates.
Without going into details, the proposal favors those communities
with residential values of under $68,000 per unit and lower
commercial and industrial values. The proposal would eliminate the
Homestead* Credit and Local Government Aid Programs and use that
funding for a new "Equalization” Aid Program. Generally, the more
valuation your community adds above $68,040 from residences or from
commercial and industrial development, the less relative (and in some
cases, absolute) aid your City will receive. The proposal clearly
works to the detriment of suburbs. Even those cities that don't
immediately lose would ultimately because of the proposal's bias
against higher valuations found in suburbs.
This proposal must be taken seriously. Its proponents are lobbying
hard and unless there is some effective counterbalance, at least part
of the proposal may be adopted. - Therefore, the Municipal Legislative
Commission is, suggesting that all suburbs join to 'defeat this
proposal. This is not a request to join the M.L.C. or to form another
ongoing group. Rather, the meeting will concern how we may
cooperatively work to defeat this proposal.
Please share this invitation with other members on your City Council
and join us on March 10, 1988 to review the proposal in more detail
and plan our lobbying strategy.

After the "big snowfall", staff prepared a report to Council addressing
the snowfall and listing some possible alternatives for increasing removal
efficiency. Council concluded that they would like to decrease removal time
during very heavy snowfalls to allow residents to get out of their driveways
earlier. Council directed staff to contact private contractors and arrange
for assistance after significant snowfall events (snowfalls where people
can't get out).
I contacted Pine Bend Paving, the same contractor that does some con-
tract plowing for South St. Paul and they informed me that they are fully
committed to plowing parking lots at this time, however could be available to
help after 7-8 A.M. They also informed me that costs would depend on the
machine used but probably would be $125 per hour for man and machine.
RECOMMENDATION:
Staff recommends that for the remainder of 1988 we use Pine Bend to
help out after 7-8 A.M. during heavy snowfalls and that we wait until 1989
to utilize a contractor to come when called and do a separate new plowing
route.
ACTION REQUIRED•
If Council concurs, staff will call in Pine Bend Paving when snowfalls
are so heavy that people can not get out.
