CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Special Council Workshop Held Tuesday, October 30, 1990 Pursuant to due call and notice thereof, the special Council Workshop of the City Council, City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. ,.� •Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. ., The following members were present: Mayor Mertensotto, ' Councilmembers Anderson, Blesener, Cummins and Hartmann. City Administrator Tom Lawell and Councilmember Candidate Jill Smith were also present. COMPARABLE WORTH ADJUSTMENTS Mayor Mertensotto asked for a summary of the topic to date. Administrator Lawell responded by providing a recap of the Council's prior discussions held September 4, 1990 and October 2, 1990. Administrator Lawell reviewed the structure of the City's existing personnel and position classification system, and explained its roots in the Comparable Worth/Pay Equity framework which developed in 1985. Council reviewed a scattergram of the City's personnel system and discussed the position classification system and pay matrix as it affects three current City employees - Guy Kullander, Klayton Eckles and Kevin Batchelder. Questions regarding retroactive pay adjustments and placement on the pay matrix were raised and discussed. Specific circumstances regarding each of the three employees were discussed. In addition, Council discussed the issue of department head compensation as well. Based on the convers�tion conducted, Council requested that formal action on pay adjustments for Mr. Kullander, Mr. Eckles and Mr. Batchelder be scheduled for the November 6, 1990 Council meeting. DISCUSSION OF LABOR NEGOTIATION ISSUES Council discussed the upcoming labor negotiation sessions with our Public Works and Police Officer employees. Both contracts expire on December 31, 1990. Council discussed the settlement parameters which are generally acceptable and directed staff to meet with the bargaining units to initiate the discussion. COUNCIL COMMENTS ye� Council briefly discussed recent communications from Centex Homes and a draft compromise plan for the Southeast Area which Centex wishes to have considered. Council suggested that the plan be reviewed by the Planning Commission at its next meeting. Council was also made aware that Centex intends to meet with interested area neighbors to present the new development concept prior to the Planning Commission meeting. ADJOURN There being no further business to come before the Council, Councilmember Cummins moved that the meeting be adjourned. Councilmember Anderson seconded the motion. Only one call resulted in any property loss damages which oc- curred on September 28th at 2:50 in the morning at 23 Salem Church Road in Sunfish Lake. The fire department responded to a routine fire alarm activation. The house was checked and we attempted to reset the fire alarm however it would not reset upon a much deeper investigation it was found there was an actual fire in the heating unit in the pool area that is attached but in a separate area of the house. The fire was confined to this heating unit and the estimated damage was $700. Damage to the structure was minimal and there was little to no smoke damage. MON`1�Y TRAINING During the month of September the training department conducted its first Mendota Heights Fire Truck Rodeo to test our drivers in various skills needed for operating and driving the fire pumpers. With the courtesy of Gould Battery we were able to hold our rodeo in the parking lot. It was a very successful and very informative��rain- ing session. � SPI3CIAL TRAINING During the month of September the three new members of the fire department started their Firefighter I training through Dakota County Vo-Tech. d� CITY OF MENDOTA HEIGHTS MEMO October 17, 1990 TO: Mayor, City Council, City Administrator FROM: Paul R. Berg J�1`-,v G� Code Enforcement Officer SUBJECT: Fence permit application 1938 Dodd Road ==,D' INTRODUCTION Dr. Tom Koepke has submitted a permit application, site plan and letter of request to install a 6' chain link fence on his property. (See Attached) DISCUSSION The requested fence is proposed to be placed 6 inches in from the NW property line of Dr. Tom's property and tie into a previously approved existing fence. Council should note that a small portion of existing fence will be removed since that portion of land doesn't belong to Dr. Tom. Ordinance 401 Section 4.8 (3) Business and Industrial Fences states the following: Fences may be located on a lot line to a heighth of six (6) feet. Since the fence as proposed meets the requirements of the City�s Zoning Ordinance staff would recommend City Council approve the fence permit. ACTION REQUIRED If City Council wishes to implement the staff recommendation to approve the proposed fence it should pass a motion of approval. �� � M�,�do�a -�-I�i �j�S �ir�al �Io�gpi a� • � • October 25, 1990 Paul Berg, Code Enforcement Officer Mayor and City Council Members Dear City Staff Members, I have an application with the city to continue the fencing along the back (east) side of my property. � y.. .if� �i �� i This fence would be six feet like the other fence along the back of the original building, however, it will not have the jump prevention wires along the top. I will also need to tear down some of the original fence to make it correspond with the new property line established in the Birch/Koepke land deal. Just this week you can start to imagine the parking area for the new addition. The curbs are being poured this week. The landscaped area along the back fence and the parking lot curb will be planted in blue spruce trees (next spring). This willmake it just like the rest of the back property line of my property. No thought is being given to any fence along Freeway Road: This would not be esthetically pleasing. Birch trees and blue spruce trees will be planted in all the landscaped area of the new addition. Nothing will be done this year. The project just took too long. I am going to contact Southview Design to come up with some type of natural looking landscaping for the corner of Dodd Road and Freeway Road inthe location of the culverts. A difficult area to make esthetically pleasing and I will need professional assistance. No formal open house will be planned for the new addition. I am too much of an introvert for such a showy event. But, any of you are welcome to stop by some late afternoon, evening, or weekend to tour the new addition to the animal hospital. I am very very pleased with the quality of the work being done by Langer Construction Company. I enjoy showing off the animal hospital complex. I do not anticipate the interior being competed until sometime in late December. Thanks foryour interest in the application. Danielson, Public Works Dir c Kevin Batchelder, Administrative Assis n kc�� SUBJECT: Batesville Casket Building Permit DISCUSSION ��: Mr. Gene Happe, represen.ting Batesville Casket Company, was before Council at their October 2nd meeting requesting a Minor Comprehensive Plan Amendment, rezoning and building permit approval. Council approved the Comprehensive Plan Amendment, the rezoning and building permit, subject to Metropolitan Council concurrence on the Comprehensive Plan Amendment. The City has now received approval from the Metropolitan Council to implement the Comprehensive Plan Amendment (see attached letter). The building permit approval was also subject to the exterior material, other than the concrete panels, being of an earth tone color and that they receive City Council review and approval on a future consent agenda. The developer has now submitted examples of the proposed materials and colors that they would like to use. These materials will be available Tuesday evening for Council review. ACTION REOIIIRED Review the proposed Batesville Casket exterior materials and if acceptable authorize staff to issue the full building permit. The proposed addition requires two setback variances, a rear yard setback of one half foot (0.5') and a three foot (3') side yard abutting a street variance. See attached staff inemos and plans. Mr. Kueppers has also submitted a letter with additional signatures (see attached). RECOMMENDATION The Planning Commission voted unanimously to recommend approval of the requested setback variances. ACTION REOUIRED If Council desires to implement the Planning Commission recommendation, they should pass a motion approving a one half foot (0.5') rear yard setback and a three foot (3') side yard abutting a street variance for 1096 Avanti Drive. The requested Variance is 3 feet into the West set-back area and 0.5 feet into the rear set-back area. The Ordinance presently provides for a 30 foot set-back from both the West property line and the rear property line. If the Variance is granted, the actual.set-back will be 27 feet from the West property line and 29.5 feet from the rear property line. Attached to this Application is a completed copy of your Planning Request Form, and a Site Plan. We built our new home on this site in 1987. We occupy the home ourselves; our five children are all adults and live elsewhere. In recent years Mrs. Kueppers has become a Manufacturer's Repre- sentative for a line of cards and stationery goods and has to maintain an office in our home. She has been using finished space in the basement of our home, but it is not satisfactory because the only daylight comes from two small casement windows set high on the wall, and they are mostly below the outside grade, next to a so-called window well. And it is difficult to maintain proper heat in the space during•the Wintertime, and it is damp in the Summertime. Better office space is essential and we want to get it by putting the addition on the rear (South side) of our home. It will be fully-windowed on three sides and be bright and airy, and can be suitably heated and cooled by our existing hot-air furnace and air conditioning units. Why do we need the Variance? To alleviate the hardship inherent in the present physical situation. Mrs. Kueppers and the Con- tractor have determined that"the room should have inside dimen- sions of not less than 12 feet by 18 feet. That is to accommodate the office desk and chair, and a fairly large workta- ble and office storage cabinets. Al1 of these furnishings are The Planning Commission and City Council October 10, 1990 Page Two essential for the office, and are presently in place in the basement office space (some storage of samples will be continued in wall cabinets which will remain in the basement). A finished room of that size requires outside dimensions of 12.5 feet by 19 feet. The 19 foot length would extend 3 feet into the West set-back area, and cannot be moved any farther to the East because the bay window in the living room area of the house protrudes out from the South wall of the house and effectively prohibits a more Easterly location for the porch. It simply cannot be set any farther to the East. Another consideration is the fact that th�` appearance of our home would become almost grotesque if we make a straight-line extension of the West wall, which is already 62 feet long; it would become a straight-line wall 74.5 feet in length. � You will note from the Site Plan that our yard is fully screened along the rear lot line.� It is lined with an irregular row of Amur Maples and Chinese Elm, which are 6-10 feet high. Our East line is fully screened by reason of a 6 foot tight wood fence constructed by the neighbor who lives on the East side of us. There are foundation plantings all along the West side of our home, and we would continue those along the West wall of the� porch. About two years ago we planted three Ash trees in the open area on the West side of our home, between the home and the Lexington Avenue bike path. These trees are now about 12 feet high, and will become fairly large in due course. They are shown on the Site Plan. They will tend to minimize the sighting of the 3-foot Variance. We ask that you also note that our home.is presently situated 80 feet back from the center line of Lexington Avenue. That is because Lexington Avenue has been dedicated to a 50 foot width on the East side of the center line, putting our West property line 50 feet back from the center line. Most streets are only 33 feet wide on each side, so our home is actually about 17 feet further from the center line of the street than most homes. Our Variance would only take 3 of those 17 feet. Our neighbors to the East, the South and the West have all given their written consent to the.granting of the requested Variances. CITY OF MENDOTA HEIGHTS MEMO November 2, 1990 TO: Mayor and City Council FROM: Tom Lawell, City Administ���' SU&TECT: Personnel Classification Adjustments INTRODIICTION z;,r,• Over the past several months Council has on various occasions discussed the City's compensation system and three employees who have recently been evaluated via our position classification process. Background information on this issue was provided at Council workshops held October 2, 1990 and October 30, 1990. It is the intent of this memo to outline compensation adjustments proposed for Guy Kullander, Klayton Eckles and Kevin Batchelder. DISCU3SION/RECOMMENDATION All three employees received authorization to complete Time Spent Profiles (TSP) in late 1989 in recognition of significant changes in the qualifications and expectations required of their positions. The TSP is a written instrument developed by the City in conjunction with Control Data and the Metropolitan Area Managers Association (MAMA) to address requirements of the Minnesota Pay Equity Act of 1985. In recognition of the position evaluations recently compl�eted, it is recommended that the following personnel adjustments be approved. Guy Kullander - Enaineering Technician Mr. Kullander filed a system wide appeal to the Control Data/MAMA Personnel Committee in 1986. In recognition of incurred delays and resultant under compensated duties, Mr. Kullander is recommended to receive a salary adjustment to Step E of Grade XXI retroactively effective to January 1, 1989. Klayton Eckles - Civil Engineer I Mr. Eckles received his engineering registration in late 1989 and subsequently completed a revised TSP. Mr. Eckles is recommended to receive a salary adjustment to Step D of Grade XXX effective for the pay period beginning November 5, 1990. Although Mr. Eckles has only served as a registered engineer for • A � approximately one year, it is suggested that placement at Step D is appropriate based on his previous four years of employment with the City. Mr. Eckles will be eligible for step advancement to Step E of Grade XXX in November 1991. Kevin Batchelder - Administrative Assistant Mr. Batchelder joined the City in January 1989 and has since completed a TSP for inclusion in the City's personnel system. Mr. Batchelder is recommended to receive a salary adjustment to Step C of Grade XXVII retroactively effective to January 1, 1990. Mr. Batchelder will be eligible for advancement to Step D of Grade XXVII as of his regular employment anniversary date. BIIDGET IMPLICATIONS Council may recall that salary contingency funds were allocated for the envisioned pay adjustments in both 1990 and 1951 Budgets. More specifically, a sum of $5,000 was budgeted as part of the Engineering Fund in both 1990 and 1991 to address compensation adjustments within the Engineering Department. Salary adjustment funds were not specifically set aside in the General Fund in either year. The accumulative 1990 affect on each fund is illustrated below: Enctineering Fund Allocated Amount $5,000.00 Recommended Adjustments 57,567.00 Unbudgeted Amount $2,567.00 General Fund - 0 - $2,483.00 $2,483.00 With respect to the unbudgeted Engineering Fund amount, it is recommended that this amount be allocated from the Engineering Fund balance. With respect to the unbudgeted General Fund amount, it is recommended that this amount be allocated from the Administrative Contingency Line Item for 1990. Given the nominal sums involved, these allocations should have no adverse affect on our overall operations. ACTION REQIIIRED Should the Council wish to implement the above described recommendation, it should make a motion amending the City's position classification system in accordance with the specifics outlined above. INTRODIICTION �. `. As we head into the holiday season, a number of employees have inquired about the City's designated holidays and their observance. The City's personnel code which applies to all nonunion employees provides for certain designated and non-designated holidays. It is the intent of this memo to establish the holiday observance dates for the balance of the year. niscvssiorr The remaining City holidays for 1990 are as follows: Monday, November 12th - Veteran's Day Thursday, November 22 - Thanksgiving Day Tuesday, December 25 - Christmas Day In addition, all nonunion City employees are also provided two floating holidays - one of which may be designated by the City Council as a fixed date when City Offices will be closed. Given that Christmas falls on a Tuesday this year it appears reasonable and advisable that City Offices be closed on Monday, December 24, 1990 as well. Danielson, Public Works Direc or Kevin Batchelder, Administrative Assista� �(„� SUBJECT: CASE NO. 90-38: Leiser (Strub) - Minor Amendment to CUP and Plan Approval DISCUSSION At the October 16, 1990 City Council meeting, Mr. Bill Strub and representatives appeared before the Council for a Minor Amendment to Mr. Strub's CUP for PUD (see attached plans and memos). At the meeting, the City Council authorized staff to issue the foundation permit, however, the Council did not act on the Minor Amendment to the CUP for PUD or for the plan approval and building permit. The City Council requested that the developer present a landscape plan and a building design plan that was more consistent with the existing neighboring building for�consideration at their November 6th meeting. The developer has submitted the revised plan addressing the Council's concerns (see attached booklet). RECOMMENDATION Because this is a Minor Amendment to the final plan for a CUP for PUD, this item did not appear at the Planning Commission. The City Council, at its October 16th meeting, discussed conditioning any approval for an amendment on the applicant applying for a replat, within four months, to rearrange the lot lines to totally enclose parking and fencing within their lot. This condition will require a public hearing at the Planning Commission. Periodically the Police Department receives donations from •, various organizations in recognition of the important service they provide. Expenditure of these donated funds is generally left to the members of the Department and they have typically chose to purchase items which are very useful in the performance of their everyday duties. This item is included on the agenda to inform the City Council of a recommended use of donated funds recently brought forth by the Department. DzscUsszort Attached for your review please find a brief inemo from Chief Delmont which sets forth a program whereby our Police Officers who voluntarily convert to Department approved semi automatic pistols be reimbursed a portion of the cost of the conversion. This reimbursement would be limited to a maximum of $350 per officer and would be allocated from the Police Department "benefit fund" which currently has a balance of approximately $8,000. Chief Delmont commends the officers for their commitment to move to this new equipment, and fully supports the,conversion. Under the recommendation, the donation funds are being used to help modernize and update equipment used within the Department at no cost to the City's General Fund. _ RECOMMENDATION Chief Delmont and I both recommend that the Council support the reimbursement program as outlined in the attached memo. The members of the Department have elected to spend a portion of their "gift" money to �; defray up to $350 of the costs associated with the Departments transition from revolvers to semi-automatic pistols. HISTORY Each year , the Department receives a number of unsolicited contributions. Our prtmary benefactor has been the Mendota VFW, although smaller gifts have been received from citizens. The money has been donated for the purpose of purchasing items for the Officers that the City cannot, or will not fund. In the recent past we have used money from this fund to pay for binoculars for each squad, "unlock tools" to help forgetful citizens, Alco-Sensors for roadside breath tests, individually engraved rechargable flashlights, registration fees for the Departments softball teams, and equipment for the exercise room. At the present time, the balance in that fund stands at $7,959.10. DISCUSSION Ztvo years ago I instituted a policy allowing officers to change over to semi-automatic pistols. At the time, I felt that this was too expensive an endeavor for the City to fund and , as a result, the policy required the Officers to attend an approved training cour�e, restrict their gun choices to one of several approved models, qualify with that firearm on the range, and p,�v for the �uns themselves. The approved handguns range in price from $400 to $650. In spite of these restrlctions, 12 of our 15 Officers complied and are now carrying the latest in equipment. at no cost to the City. In order to reward the commitrnent and sacrifice of �he participating Officers, and to make it financially possible for the rema;ni � Officers to join in, I suggest that their request for reimbursement of $350 per Officer out of their fund be allowed. This reimbursement will be limited to Officers who purchase firearms that comply with the Departments policy.
