CITY OF MENDOTA HEIGHTS r DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 84 - RESOLUTION COMMENDING THE HENRY SIBLEY HIGH SCHOOL BAND FOR OUTSTANDING PERFORMANCE WHEREAS, the Henry Sibley High School Marching Band just completed a tour of several Eastern and Mid -Western state's; and WHEREAS, the band had the opportunity to play in several competitive parade events;--and,--- WHEREAS, the band was awarded numerous honors during that tour, in- cluding: 1st Place in the Liberty Bell Parade, held July 3rd in Philadelphia. 1st Place in the National Independence Day Festival, held July 4th in Washington, D.C. 1st Place and Judges Trophy for most outstanding unit in the Howard County, Maryland 4th of July Parade. 1st Place in the Bel Air, Maryland 4th of July Parade. 1st Place in the Dundalk, Maryland Heritage Parade; and WHEREAS, this lfst-_ of impressive accomplishments, along with other appearances by the band has brought honor and distinction to Mendota Heights and the other communities in School District #197: ' NOW THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of Mendota Heights, that on behalf of the citizens of their community, appropriate congratulations and thanks are hereby extended to Director Jeff Carver and all of the members of the Henry Sibley High School Marching Band. Fr ?- City Admi istrator July 13, 1984 RE: Resolution Commending Henry Sibley Band As most oT you are probably aware, the Henry Sibley Band recently completed a tour to the East, where they won numerous first place awards for their performance. Councilman Mertensotto has suggested that Council present the , band with a resolution ofcommendation for its accomplishments. A proposed resolution is attached for Council consideration. Kr.'Kevin Roach, a.section leader, will be present to accept the resolution on behalf of the band.' CITY OF MENDOTA HEIGHTS PLANNING COMMISSION MINUTES July 11, 1984 The meeting was called to order by Chairperson Kruse at 9:03 P.M. The following members were present: Kruse, Burke, Stefani, Morson, and Henning. CASE #84-12, Johnson A Public Hearing was opened by Chairman Kruse Brothers Construction Application for Wetlands The project manager for Johnson Brothers, David and CUP for filling Prusak, said that the proposal was to place kVisitation, and Convent approximately 180,000 cubic yards of fill roperty) material on the convent property, leveling and shaping so that it would match the higher ground property to the east. He said that the fill would begin after this years crop had been harvested off the property; and the filling would continue through next year: The topsoil would be placed in berms along the southside of Mendota Heights Road, so that the visitation convent and school could use them for mther landscaping projects later. Mr. John Hill, from the Visitation Board of Directors, said the convent had requested it this way to keep dirt off the other property for the time being, but that it would be a short hall across the street for other landscaping projects later on. Commissioner Burke asked what would be done with the organic soil from the sewage ponds Prusak responded that if it was suitable, it would be retained for topsoil, and if not, it would be used on the construction site.' Chairperson Kruse indicated that he thought 900 ft. berms were a bit high along the road, and could obstruct sight lines. He said his preference would be that the berms be kept no higher than an eleva- tion of 898 ft. Mr. Kent Edwards of Hazel Ct. questioned whether the filling of these ponds would disturb wildlife habitats. Prusak responded that these ponds had been dried up for some time, and were actually sewer ponds that did not support wild - lite. Della Gang] of 2484 Dodd Rd. indicated that she had property near the sewage area, and hoped that the natural drainage wouldn't change. Motion by Commissioner Henning was seconded by Com- missioner Morson to close the public hearing at 9:18. A motion by Commissioner Stefani was seconded by Com- missioner Morson to recommend approval for the Wet- lands and Conditional Use Permits for Johnson Brothers 45 indicated on the plans, with the stipulation Ayes: 6 Nays: 0 CASE #84-13, Johnson Brothers Construction Application for CUP for filling (Indep. School Dist. #197 Property) that the berms south of the Mendota Heights Rd. be at elevation of 898 ft. Motion passed unani- mously. Public hearing was opened by Chairperson Kruse at 9:22 P.M. Prusak began by saying that when these contour maps were drawn, he was not aware of the 100 ft. setback requirement from wetlands, which is in- volved in this area. He said it was not the contrac- tors intent to seek a wetlands permit, so that they would revise the contour maps to show no change in constructio.n within 100 ft. of the existing pond. Ken Edwards of Hazel Court asked what the purpose of the filling was. Prusak responded that it was to serve two purposes, to provide a noise barrier from the highway for residential areas in the north, and that the school district was in favor of the fill because it made the property more developable at a later date. Alton Dugan, 813 Hazel Court, asked how the con- tractor intended to avoid any interference with the ponds. Prusak responded that erosion control was planned in the project, that being stakes_ with silt screen stops approximately 3 ft. high around the area. This soil erosion measure would be left in place until the seeding and other topographical vegetation took over. Chairperson Kruse indicated that the applicant would need to redo the contours to show them staying away from the- wetland area. Commissioner Henning asked if anyone had any problems with the proposal. Mr. Edwards responded that he had no particular problem with the filling, but didn't believe that it was going to create much of a sound barrier for the neighborhoods. Ginger Simek, 814 Hazel Court asked him about the possibility of planting trees along the side as a noise and visual barrier. Planning consultant John Shardlow responded 'that.this would be on.private school district property, and it was not really the obligation of either Johnson Brothers or the school district to put trees in. Motion by Commissioner Morson seconded by Commissioner Burke to close the public hearing at 8:44 P.M. Motion passed unanimously. Motion by Commissioner Morson seconded by Commissioner Henning to recommend Ayes: 6 Nays: 0 V approval of the Conditional Use Permit, conditionp' on the outcome providing adequate contour maps showing that the work would not be within 100 ft. or the wetlands. Several items of communications were presented; Letter dated May 21, 1984 from Anita Benda Stech regarding responses to communications from Rite and Continental; letters from the Highland Villager's publisher and editor regarding news article; letter dated May 25, 1984, from Continental con- firming the statements made at the May 23, 1984 meeting; letter from Herbst and Thue with a letter from O'Neill, Burke and O'Neill to Michael J. Hoover, Director of the Lawyers Responsibility Board.; MCCB meeting agenda for June 8, 1984 and the MCCB minutes of the May 11, 1984 meeting. Items of interest in the 5/11/84 minutes included information regarding the St. Paul franchise and the Regional Channel; memorandum dated June 1, 1984 from Herbst & Thue regarding proposed Federal Cable Television Legislation; letter and brochure from CTIC regarding address change; letter from Continental dated June 6, 1984 regarding the Court of Appeals decision regarding Continental's St. Paul cable communications franchise. Lanegran moved, seconded by Witt to receive the above communications. Voting: 9 ayes, O,nays. Motion carried. Chairmgp Zemke asked Robert Sachs of Continental4,Cablevision to bring the Commission up to date on the -Court of Appeals matter. Sachs stated that Norwest had taken an appeal from the Cable Board's issu- ance of Continental's certificate to the Court of Appeals and they had a motion before the Court of Appeals asking the court to stay the effective- ness of the certificate, while the court reviewed the issues Norwest raised. The City of St. Paul or Continental did not have the opportunity to address these issues. The Court of Appeals did not grant the stay but ruled on the issues and said that the Cable Board should have afforded Norwest a con- tested case hearing. The City of St. Paul, the Attorney General's Office and Continental have filed separate appeals to that ruling to the Minnesota Supreme Court arguing that the Court did not follow its own rules in af- fording the parties to address the issues and that the result seems to suggest that the Cable Board has no discression in the future in deciding whether or not to have a contested case proceeding. If the Supreme Court does not hear the case it will go back to the Cable Board which has twice unanimously -affirmed St. Paul's process and award. Continental is presently moving forward in building the St. Paul cable system. Sachs also stated in regard to the Northern Dakota County system that even if - Continental was delayed in St. Paul, as long as Continental is not providing service they could still build the head end and trunk to serve Northern Dakota County. Continental has started preliminary activities for Northern Dakota County, so -that if energies need to be diverted, without amending the proposal in anyway, Continental would apply these to Northern Dakota County and construct the system ahead of schedule. Lanegran asked Sachs if Continental asked for due haste when they filed for appeal. Sachs responded they -did not because it is apparent from the pleadings, the importance of the matter and being that the City of St. Paul and the Attor- ney General are involved Continental did not ask for due haste. Henderson asked Sachs to explain the Attorney General's involvement in this matter. Sachs stated that the Attorney General is the legal counsel for the Cable Board. Tatone asked Sachs if there is a stay in St. Paul and the head end is built in St. Paul to serve Northern Dakota County, how does Continental propose to pay for the head end in St. Paul for use by Northern Dakota County. Sachs responded that the parent company is carrying St. Paul until there are revenues from St. Paul, so Continental will treat Northern Dakota County as indicated in the proposal. Tatone asked what would happen if Continental lost and the bid was awarded to someone else. Sachs stated that Continental would lease the head end to another company. If Continental saw this as a risk they would not commit the money or the energy in moving forward. John Gibbs, legal counsel, stated there are some head ends in Minnesota that are outside the cities they serve. 2 Anita Stech, technical consultant, asked Sachs if Continental has utility clearance. Sachs stated that they have and are working closely with the utility company and have advanced the priority for the distance from the head end to Nor- thern Dakota County. Continental signed the utility agreement on May 11, 1984. 5. In absence of Craig Kinney, Chairman Zemke submitted a statement from the City of Mendota Heights in the amount of $36.93 and a statement from Anita Stech in the amount of $8,381.05. After considerable discussion, Tatone moved, seconded by Hanson to pay the City of Mendota Heights' bill in the amount of $36.93 and pay Anita Stech $4,042.00 and table the balance of the bill until receipt of an itemized statement showing CTIC costs, Stech's cost in regard to proposal and evalua- tion and those items over and above proposal evaluation, and the contract between the Commission and Stech. Voting: 9 ayes, 0 nays. Motion carried. 6. After some discussion the Commission and Gibbs stated the following correc- tions are to be made to the Findings of Fact in Franchise Selection resolu- tion: 1. Page 1, Paragraph 1, Line 3, correct spelling of Statutes. 2. Page 1, Paragraph 1, Line 4, correct spelling of Mendota. 3. Page 1, Item A, Line 1, delete "The". 4. Page 2, Paragraph 1, Line 1, correct spelling of applicants'. 5. Page 3, Item 14, Line 2, should read "participating in the "review" process". 6. Page 3, Item 15, Line 2, change Cable Television Information Center to CTIC. Gibbs stated that the purpose of drafting the findings was to outline the process that was followed to assure in these findings all the required steps under state law and referenced that the Commission did those. It referred to the consultant's reports, the state standards in order to make a deci- sion, represents the unanimous weighted vote and set forth both representa- tions of both applicants after the Commission's decision. This documents what information was considered in making a decision. Tatone moved, seconded by Lanegran to move the resolution. Voting: 9 ayes, 0 nays. Motion carried. Lanegran asked if the resolution is submitted to the Cable Board. Gibbs responded that it is as a courtesy with a letter from the Chairman of the Commission but that it is included as an exhibit to the franchise ordinance. 3 r 7. Gibbs stated that the Commission should appoint 3-4 members of the commis- sion to serve on a committee to work with legal counsel on how to proceed with negotiations, set ground rules, policy decisions, and legal drafting of the franchise ordinance. The preliminary franchise ordinance will be used. He also stated that a report will come back to the commission and then it should be presented to the City Attorneys prior to submitting to City Coun- cils for adoption. Henderson asked if O'Neill, Burke and O'Neill are representing Lilydale and Mendota. Chairman Zemke stated that when O'Neill, Burke and O'Neill resigned from representing Rite they also stated that they would not represent Mendota or Lilydale on cable matters. After some discussion, Witt moved, seconded by Harrison to appoint Paul Tatone, Virginia Lanegran, Dave Zemke and Ken Henderson to the Franchise Ordinance,.Draft Committee. Voting: 9 ayes, 0 nays. Motion carried. 8. Henderson moved, seconded by Hanson to tentatively set the next full Commis- sion -meeting -for July 18, 1984. Voting: 9 ayes, 0 nays. Motion carried. 9. Stech addressed the commission by thanking them for their confidence in her and that she enjoyed working with the commission during the process. 10. Tatone moved, seconded by Hanson to adjourn. SYNOPSIS OF MONTHEY RUNS The department responded to 18 calls during the month of June. Only one call resulted . in aproperty loss fire: On June 18th the department was called to the Milwaukee Railroad tracks on the east end of Mendota were they found a caboose fully involved. The interior of the car was completely burned out. There was signs of vandalism prior to the fire. The police -department is working with members of the railroad's police in an effort to identify a male subject seen running from the scene. The loss was set at $20,000. The department was called to two rescue incidents., both located on the cloverleaf at hiways 494 and 55. In both incidents persons had to be extricated from the over- turned vehicles. SYNOPSIS OF TRAINING The monthly training was made up to two sessions of burning drills at a house on the 494 right-of-way. Fraze vz - City Administrator RE: Planning Case #84-12 Wetlands and CUP for filling on Visitation Convent property INTRODUCTION: Johnson Brothers, the Mn/Dot contractor constructing 494 has applied for wetlands and conditional use permits for placing approximately 180,000 cubic yards of "fill material on the Visitation Convent property south of Mendota Heights road. BACKGROUND: Please see the attached reports by the Director of Public Works and City Planner for a more detailed discussion of the issue. The Planning Commission held the required public hearing at a special meeting on July 11th. Several neighboring residents raised questions but seemed to have their concerns satisfied, and no one objected to the fill proposal. The Commission did feel thatthe topsoil berms south of Mendota Heights Rd. 'should be no higher than 898 feet elevation. RECOMMENDATION: The Planning Commission voted unanimously to recommend approval of the wetland and conditional use permits, with the stipulation that the topsoil berm south of Mendota Heights Rd. be limited to an elevation of 898 feet. DEVELOPER'S AGREEMENT: Attached is a developer's agreement, asproposal by staff, that sets conditions for the fill work, and protects the City's interests through a security'instrument=•arid escrow deposit for_staffltime. While these areas are not actually true wetlands, it would appear to, be more expedient to issue the permit than to rAclassify the lagoons. These lagoons at present are not part of any existing sanitary sewage system and serve no storm drainage function. 3. The applicant has submitted grading and erosion control plans illustrating the proposed filling operation. The applicant proposes to raise and level the area to an elevation approximately 22 feet above the proposed elevation of I-494. The grades of the site are proposed to be approximately 1 1/2%. Slopes along I-494 are proposed to be 3 to 1 slopes. 4. The proposed grading plan takes into account the filling done on the Tousignant property located immediately to the west. There is an area located to the east of the proposed fill site and west of T.H. 149 that is not to be disturbed. Trees within this area are proposed to remain. 5. Erosion control measures have been proposed around the north, east, and south boundaries of the fill area. In our opinion, these measures are adequate and if properly maintained, they will trap all sediment which could otherwise leave the property. 6. The proposed filling should increase the development potential of the property, since both the existing sewage lagoons and existing slope conditions currently limit development potential. This proposal will raise the property located immediately north of proposed Mendota Heights Road about 14 feet. A stand of trees in the NW corner of the site is proposed for preservation. Placement of this fill material and the preservation of these trees should mitigate the impact of I-494. 3. Erosion control measures have been proposed to eliminate the transport of sediment away from•the site. Since that time, staff has received no written comments but has received a few telephone calls. The following is a brief summary of calls and subject matter discussed. Mike Kluznik - 1057 Chippewa has a triangular lot facing both Chippewa and John Streets with 246.10 feet on John and 251.5 feet on Chippewa. His con- cern was the amount of assessment and the fact that Chippewa is wider and a collector street, it should be paid for by the City. When John Street was paved, Mr. Kluznik was not assessed for that side of his property. Assessments have not been computed but it is not likely that full frontage along Chippewa will be assessed. Myron Gabhart - 546 Fremont, with about 190 feet of frontage, called to indicate that he is in favor of doing a surfacing project. Emo ene Peters - 1085 Delaware, faces Delaware with a long side lot on Ellen Street. When Ellen Street was lastsurfaced in 1977, this lot was not assessed. She is not in favor of resurfacing Ellen Street. Staff may con- sider assessing on basis of side lot police (25% of 177.35 feet). Party (No Name) - on Delaware, has double lot facing Chippewa and Dela- ware inquired about assessment procedure. Has no complaint and will not attend the hearing. Party at 591 Hiawatha was concerned if the project included the dead end portion of Hiawatha (where their property is located). He indicated that he is in favor of the project. RECOMMENDATION: None ACTION REQUIRED: None. This is informational only. L7 CITY OF MENDOTA HEIGHTS MEMO June 14, 1984 TO: Mayor, City Council and City Administrator FROM: James E. Danielson Public Works Director SUBJECT: Bituminous Street Maintenance Project Mini -Feasibility Job No. 7843 Improvement No. 79, Project No. 3 DISCUSSION: In early 1978, the City was contacted by property owners regarding surface water problems along Hiawatha Avenue and vicinity. During the course of the next year Council discussed_the matter, ordered and received a fusibility report which included a storm sewer study that also involved street reconstruction on Fremont, Hiawatha and Garden Lane. The August 24, 1979 feasibility report estimated that the proposed storm sewers for the area would cost some $67,400 while street reconstruction was estimated to cost $117,240. The Council, at the April 15, 1980 meeting, discussed the subject with a few Hiawatha Avenue neighbors who expressed little interest in a large project and the project was dropped. With a 4 or 5 year lapse, we can expect a 25% to 30% increase in the 1979 estimated costs. This means that storm sewers could cost $87,620 and streets could cost $152,412. On an assessment basis, this could mean an assessment of $0.19 per square foot for storm sewer and $42.00 to $43.00 per assessable foot for street construction. A representative lot in the area would be 80 feet by 120 feet or 9,600 square feet = $1,824 for storm sewer and 80 feet of frontage = $3,440 for street construction. The total assessment would be $5,264. Since these costs seem prohibitive we have studied doing another maintenance project similar to Ivy Falls. We feel a feasible alternative would be a 2" - 2 1/2" overlay with some limited base reconstruction. If this type of project were completed for Chippewa Avenue, Ellen Street, Garden Lane, Hiawatha Street and Fremont Street, the total,estimated cost would be $130,000. Estimating the total frontage, the approximate assessment would be $15.50 per assessable foot. (80' lot X $15.50 = $1240.00) We need to qualify this alternative by saying that with this type of pro- ject, present drainage problems would remain and the life of the overlaid streets would be less than the life of newly reconstructed streets. 1 RECOMMENDATION: While the Ivy Falls overlay project is not very "old" yet, and no long term conclusion can be made, staff still feels the project was successful and would recommend doing a similar project in this area. This project is totally without resident's request or input and staff recom- mends an informational meeting with the affected residents be held before a formal feasibility report is ordered. ACTION REQUIRED: If Council wishes to implement the staff recommendation a date should be set and staff directed to send notices to affected residents. 2 • CITY OF MENDOTA HEIGHTS TO: Mayor, City Council and FROM: Edward F. Kishel City Engineer SUBJECT: Brookside Lane Street Acquisition Job No. 8417 INTRODUCTION: City A 'nis rator June 25, 1984 In September 1953, Brookside Lane east of Laura Lane was vacated by Dis- trict Court Order. Recently, the adjacent property owners requested that the vacated south one half of the street be acquired for street maintenance pur- poses. DISri NgTnm- On May 9, 1984, staff prepared the attached memo requesting Council author- ization for the reacquisition of that portion of street fronting three individual homesites, approval was granted and staff proceeded with the paper work. In the process of obtaining Quit Claim Deeds, Francis Stelter, 644 Brook- side Lane inquired as to the status of assessments which were levied against his property for previous public improvement projects. Research revealed that four ptojects were involved, namely, sanitary sewers, water mains, storm sewers and streets. All but one were assessed on a front footage basis and had no bearing on the street vacation. Storm Sewers (Ivy Falls Creek Improvements in 1979) were assessed on a square foot basis which included the area of the vacated street because it was considered to be private property. Now that they will be giving property back to the City, property which has been assessed, it is fitting and proper that consideration be given to readjusting the assessments based on the areas involved. Kishel City Engineer SUBJECT: Street Acquisition Brookside Lane Job No. 8417 INTRODUCTION: In September 1953, Brookside Lane east of Laura Lane was vacated by a District Court Order. The vacation order was not recorded until July 1974. Prior to the recording, the City obtained a sewer and water ease- ment over the vacated street, said easement being filed on October 22, 1962. Thus the City had a sewer and water easement and maintained the dead end street to serve landlocked properties on what was actually private property. Some time ago, Francis Stelter, 644 Brookside Lane, contacted City Hall with the request that the City take steps to reacquire that street right of way on the south half of the vacated street so that the City can legally maintain the paved street. nTgriigCTnN- Some time ago, staff requested a legal search of the matter by the City Attorney. Finally on March 14, 1984, the City Attorney submitted the attached report outlining the situation to date. The City Administrator then directed staff to follow through in an effort to re-establish the right of way for a paved street on the south half of the previously vacated street. Three (3) property owners, affected by the vacation, were recently contacted in writing and given an explaination of the situation and were requested to respond to a City proposal to obtain the needed street right of way by Quit -Claim Deed (rather than a street easement). All owners have now responded affirmatively. RECOMMENDATION: Staff recommends that the City Attorney be directed to prepare the necessary quit claim deeds, to have staff negotiate the property owner's signatures and to record the documents after approval by the City Council. Thet firefighters were also abie to respond to 151 calls and take part in a total of over 1,000 hours of training without injury. The continuing training in proper fire suppression tactics and the continuous upgrading of the fire turnout gear is responsible in part for our safety record. PROPERTY DAMAGE Total property damage estimates for the 151 calls responded to were set at $40,600. Of this amount, slightly over $7,000 was in Mendota Heights. The major property damage loss for the year was the Lilydale School House, located in lower Lilydale. The owners of this structure, Ramsey County Park Commission, estimated the value of the building at $25,000. NUMBER OF FIRE CALLS INCREASED In our annual report for the years 1981 and 1982, we reported a decrease from the 1980 high of 163 calls. In 1983 we have an increase of approximately 187, with a total of 151 calls. TRENDS In past annual reports, under this heading, we have addressed the subject of "Actual" and "False" fire calls. In 1982 we reported a reduction in the number of false calls from 477 in 1981, to 35.37 in 1982. This year we must report an increase in the number of false calls from 35.37 in 1982 to 48.47 in 1983. All fire calls received are broken down into the two main classifications of actual or false calls. The actual calls are then broken down into seven categories. False calls are broken down into four classifications. These four classifications are Criminal Intent calls, Alarm System Malfunction - Commercial calls, Alarm System Malfunction - Residential calls, and the broad classification of Good Intent calls. The first classification, Criminal Intent calls, has never been a serious problem for our department. We have experienced one or two calls a year for the past four or five years. The two classifications of Alarm Malfunctions accounted for just less than 257 of our calls in 1981, 18.87 of our calls in 1982, and 29.8% of our calls in 1983. Each year we see additional fire alarm systems being installed in both residential and commercial buildings. Throughout the metropolitan area, elected city officials, city admin- istrators and public safety department heads are expressing a concern over the increasing number of false alarms. The Mendota Heights Police department shows an increase in 1983 of approximately 507 in the number of false intrusion alarms. In 1982, they experienced approximately one false alarm call per day. In 1983, that average went to 1.5 calls per day. In an effort to control this increased number of false alarms, Chief Delmont has initiated a program of sending a letter to the property owner of each false alarm, expressing his concern over the false alarm. If we are to address the problem of false alarms strictly from a monetary viewpoint, we will find a sizeable difference in the monetary cost to the City between the false alarms answered by the Police department and those answered by the Fire department.._ In the case .ofTthe Police department,.there is an additional _ Section 1, Page Two cost to the City for extra gasoline, wear and tear on the equipment, and occasionally overtime for the officers responding at the end of a shift. The main concern relating to Police department responses is that of safety of the officers and the fact that while responding and handling false alarm calls, they are taken away from other Police duties.' The monetary expense to the Fire department, on the other hand, should be the concern of those charged with the administration.of the Fire department. Unlike false alarms to the Police department, a false alarm to the Fire department results in a direct financial cost to the City. If we apply the same costs that we use in billing the Minnesota DOT and the railroads for services rendered, we would come up with the following costs. We send 2.35 pieces .of apparatus to the average call. This means that $45.00 per hour per piece of apparatus, totals an outlay of $105.75. Our average man-hours per fire is 18.05, times a cost of $7.00 per hour, equals $126.35. These combined costs equal $232.10 per call. We take this times 45 false alarm calls in*1983 and we come up with a total cost to the City of $10,444.50. We know that if we i are going tobenefit from the existence of fire alarm systems in our City, that we are going to have to expect a certain number of false alarms. We know that the larger the percentage of property protected by alarm systems, the less exposure our firefighters will have to serious fires. In addition to this, we should experience a lower property loss as a result of serious fires. On the other hand, we may wish to address the financial cost of the ever increasing number of false alarms. There is one additional trend that we would like to address in this report. This trend deals with actual calls, namely vehicle fires, vehicle accidents, and general rescue calls. During 1981 and 1982, we averaged approx- imately 23% of our calls in these three classifications. In 1983, the percentage dropped to 15.2%. The greatest decrease was in rescue calls. The average for 1981 and 1982.was 8%. In 1983, this dropped to 3.3% of our total calls. There has been some concern expressed in the past about operating a rescue truck.' I believe these .statistics bear up the fact that the department is well in'control of the use of their rescue truck and that it will not become a burden to the department in the foreseeable future. MANPOWER RESPONSE To monitor our manpower response we break down all our calls into three general classifications. The classifications are: Daytime fires, Nighttime fires, and Weekend fires. The average response to these three classifications have varied little in the last three years. In 1983 we had an average of 11.02 men for each of the two classifications that we have to monitor closely, the Weekday fires and the Weekend fires. Our records show that on the average call, we have adequate manpower for the two critical classifications. // y RESPONSE TIME A quick and safe response to each fire emergency is very important. The average structural fire doubles in intensity every 60 seconds. The sooner we receive the alarm and the quicker we can respond to the scene, the less serious the fire will be. Response time is equally important in other emergencies in which the fire department is asked to respond. In studying the response time Section 1, Page Three for the past -three years, we discover a continuous decline in the time it takes the department to respond to a scene. In 1981, it was 6.18 minutes. When we compare the Mendota Heights only calls, we find that in 1981 our response time was 5.90 minutes. 'In -1983, we received a total of 120 calls in Mendota Heights, nine of these calls were cancelled before apparatus reached the scene. Our records show that of the 111 calls where apparatus reached the scene, 34 of the calls were answered in four minutes or less. DEPARTMENT COMPLEMENT The Fire department ended 1983 with 31 active members. Four new members joined the department in 1983. They are Allen Valencour, Patrick Knight, Keith Stein and Edward Adrian. These four firefighters have received.extensive training during their first year on the department and should be valuable additions to the overall strength of the department. TRAINING The department continues to accelerate its efforts to train qualified firefighters. During 1983 there were over 1000 manhours devoted to in-house training. In addition to this, the department continued to send firefighters to the Dakota County Vo -Tec Firefighter I schools. In addition to the intense training with the department's equipment, six firefighters were equipped with bunker pants. The response to this additional protection has been very good, and the department plans to buy additional bunker pants in 1984. EQUIPMENT There were two major purchases of equipment in 1983. The new tanker truck 'should be very valuable in fire suppression in areas where we do not have a public water system. The tanker was also assigned first responder status during the heavy snowfall late in 1983. It was the policy of the department to respond this tanker due to the fact that many of the fire hydrants were covered with snow. The second major equipment purchased during 1983 was the installation at two intersections of 3M Opticom systems. The first system !gas put into operation at the intersection of Mendota Heights Road and TH 55. The second installation, late in the year, was at the intersection of TH 149/110. Both systems are working very well and the department personnel is becoming acquainted with the operation of the system. The systems will provide safe crossings at both intersections and should reduce response time to the far southwest industrial area and the far northeast residential areas of the City. SYNOPSIS OF MAJOR CALLS In 1983 the department did not respond to any major fires within Mendota Heights. Early on the morning of May 20, 1983, the department received a call to lower Lilydale and found the abandoned Lilydale School fully engulfed. The loss at,this fire was set at $25,000. On December 26, 1983, the department received a mutual aid request from the Eagan Fire department for assistance at two quad -home fires in their city. SECTION 2 LOOKING FORWARD TO 1984 TRAINING The department will continue its two hour per month in-house training sessions. We anticipate that we will use an addition to 1,000 hours for this type of training. The department will also continue to send firefighters, especially the new members, to the Dakota County Vo -Tec Firefighter I classes. It is also hoped that in the fall of 1984, that the Vo -Tec will commence Firefighter II classes, at which time we will take part in that program. MANPOWER On January 1st, 1984, our active membership numbered 31. It is anti- cipated that there will be several resignations from the department during 1984. Efforts are now underway to secure replacements so that the department will maintain approximately 31 members. EQUIPMENT The main capital outlay for 1984 will be the renovation of the Pumper 42286 (Squrt). This unit will require some modification to correct some failures in the boom. The department is also scheduled to buy a large quantity of hose and other miscellaneous pieces of equipment. NEW HOME The year 1984 will bring about the realization for the new fire station. Plans will be completed, the land purchased, bids awarded, and construction started by May 1st, 1984. It is projected that the completion date should be in December, 1984. This will enable us -to more closely tie budget appropriations to the accomplishment of specific Council goals and objectives for the City. The purpos�,of this memo and agenda item is to solicit some pre- liminary Council input as to priority issues for 1985, so that staff can address and incorporate those into the draft budget document to be considered. oy Council later this summer. The purpose is also to seek Council concurrence on dates for budget study sessions and public hearings. TIMES FOR COUNCIL BUDGET REVIEW AND HEARINGS Attached is.a budget preparation calendar from which the staff has been working. You will notice four dates of Council involvement: August 21 - Public Hearing or General Revenue'Sharing August 25 - Workshop to review proposed budget September 4 - Public Hearing on budget and use of revenue sharing October 2 - Adoption of levy resolution All of these dates except August 25, are regularly scheduled Council meetings. I understand that in past years, Council has reviewed individual department budgets at the end of two or three regular Council meetings. Because this year's budget will be somewhat different in format, and will relate more closely to specific goals and objectives, I am proposing that we hold a Saturday morning workshop to review the entire document as one package. Department heads would come to present and answer questions about individual budgets, but we would also spend some time discussing such things as tax implications, longer -range financial strategies,and how the budget as a whole contributes to our goals for the community. I think a "one shot" approach contributes to the budget being treated as what it really is, the paramount planning document and implementation strategy for the City. If Council concurs with the recommendation for a workshop session and August 25th is not mutually convenient for everyone, we could agree on another date. We also need to set August 21 as the date for a public hearing (input) on uses of Several Revenue Sharing, and September 4th as the date for the hearing on the City's proposed use of Several Revenue Sharing. BUDGET ISSUES IDENTIFIED BY COUNCIL: Council was asked to complete a brief survey of budget priorities for 1985. Following is my "analysis" of the results. Summar The purpose of this list of issues is to serve as a basis. for discussion about particular issues Council would like to see addressed in the 1985 budget. The objective of the discussion, at this point, is not to design a comprehensive program to address any issue. Rather, it is simply to give staff some idea of things to keep in mind as we prepare the draft budget. More substantive decisions on -funding levels and priorities wi•11 come with budget review. I would suggest that we go over the lists of items very briefly to determine where there is a true contensus of Council interest, and whether we have left out any important issues. Case No. 84-13, Johnson Brothers CUP for filling on I..S.D 197 property Mr. Jim Losleben, 815 Hazel Court, has expressed opposition to"this project. In my discussion with him, one of the questions raised was whether the City Planner had given an opinion as to whether this property couldn't be developed with eiisting contours. City Planner Howard Dahlgren was out this morning on another matter, so we took the opportunity to visit -the property: Mr. Dahlgren's professional opinion is that it is almost always preferable to have residential development above the grade of any abutting street. Therefore, he feels that the pro- posed filling of the property would be preferable if it is assumed that site will one day be developed.. 7c. Northend street improvements Attached are two additional letters and a neighborhood petition that have been received in our office. 7g. Evergreen Knolls Bid Award Attached is a memo, tabulation of bids and proposed bid award resolution for the Evergreen Knolls Addition, and adjacent areas, public improvements. Council adoption of the resolution to award the bid to Orfei and Sons for their low bid of $312,367.77 is recommended. 8d. Northland Drive extension City Planner Howard Dahlgren, Public Works Director Jim Danielson, and I met with Mr. Parrantoand Mr. Linville this morning concerning the exten- sion of Northland Drive through the subject property. For the reasom5cited in Howard's case report, staff continues to feel that Plan A is the preferred solution. Mssrs. Parranto and Linville -will be present to discuss whether their proposed use on the property might be able to be accomodated with this alignment. Council is not obligated to make a final determination on this matter this evening. In fact,.it is staff's recommendation that we meet with other affected property owners in the area to determine future development plans, and how:: the street layout might fit into those plans. 8g. Resolution authorizing preparation of assessment role for the Kingsley Estates Property Attached is a.proposed resolution. Adoption of such a resolution is required by M.S.N. 429 for improvement•.projects. J U L 17 1984 GiL666Mi%II I have two concerns about the proposed street maintenance on Chippewa Avenue. First, residents should not be billed for 100% of the cost of the work done on that street. In the past, such projects were only partially paid for by residents living on Chippewa. Apparently, the rationale for this was that it connects two state highways and carries heavier traffic than the typical residential street in this community. Not.only is it busier, but it is also wider than most other residential streets. Related to this fact is the problem of speeding motorists. I am sure that the Council will take both of these factors into consideration when the maintenance project is approved. Residents on Chippewa should be equitably assessed. With the improved surface, the problem of speeding motorists will only worsen. Thank you. Danielson, Public Works Director SUBJECT: Evergreen Knoll - Bid Award DISCUSSION: Bids were received today, July 17, 1984, to install sewers, water & streets in the Evergreen Knoll Addition (Gryc). Four bids were -received and they ranged from $330,963.17 to $453,177.00. The Bid Tabulation is attached. The Engineer'-s'Estimate for this project was $313,062.00. The low bid, submitted by Orfei & Sons, is 5.7% above the Engineer's Estimate. Staff has included two alternates in the bid to reduce the price of the project should bids come in high. Alternate A was to use plastic pipe for the small diameter storm water leads - most communities now -are doing this and Mendota Heights already did on the Ivy Falls overlay project. Using plastic reduces the bid by $8,717.40. Alternate B was to use treated wood retaining walls at Wachtler and Wentworth instead of a .new design concrete block (Loffelstein). The resident nearest the wall prefers the wood design. Using wood reduces the wall costs $9878.00 Staff would include both alternates, thus reducing the bid to $312,367.77. Dave Ross, the developer's representative feels this is a good bid and has requested the City award the contract: Staff has --also been working with Dakota County to'get their participa- tion in the reconstructing of the Wachtler/Wentworth (County Road 8) Curve. The County has agreed to participate and they have prepared the necessary agreement for City execution to provide for that participation. (55% of CR 8 reconstruction costs). RECOMMENDATION: Staff recommends Council accept the low bid including the two Alternates A & B and award the Contract to Orfef & Sons Inc. of St. Paul in the amount of $312,367.77. Staff further recommends that Council execute the agreement prepared by Dakota County providing for County participation in this project. Swanson, City Clerk ,e COUNTY OF DAKOTA Department of the Highway REEMENT FOR HIGHWAY CONSTRUCTION THIS AGREEMENT made this day of 19 , -:by and between the County of Dakota, a Municipal Corporation of the State of Minnesota, acting by and through its County Board of Commissioners, herein- after referred to as the "County"; and the City of Mendota Heights, a Municipal Corporation of the County of Dakota, State of Minnesota, acting by and through its City Council and hereinafter referred to as the "City". WHEREAS, both the City and County feel that the welfare and safety of their citizens will be well served by the construction/improvement of County Road 8, Project No. City Project, said construction being legally des- cribed as follows: Reconstruct CR 8 at the point where it makes a 900curve changing from Wachtler Avenue to Wentworth Avenue by re- constructing it to a "T" intersection with the new City street (Wachtler Avenue extended). NOW THEREFORE: 1. The City hereby agrees to design and construct/improve said County Road 8. 2. The parties agree that the costs of engineering, grading, land- scaping, drainage, aggregate base, bituminous surface, concrete curb and gutter, acquisition of right-of-way easements and slope easements, and relocation or adjustment of sidewalks, sanitary sewer, storm sewer, water mains and appur- tenances shall be shared in.the amount of fifty-five percent (55%) by the County and forty-five percent (45%) by the City for the area encompassing the full width of the County Road 8. 3. The City agrees to pay all installation costs for new sanitary sewer, storm sewer, water mains and appurtenances, sidewalks, or other pub- lic utilities installed by the City except that the cost of catch basins and leads for surface drainage shall be shared by the parties as described in pro- vision 2. 4. The parties agree that partial payments by the County to the City shall be made in accordance with Minnesota Department of Transportation Standard Specification No. 1906 as amended, which is incorporated into this agreement by referencq. The City will act as the paying agent for all pay- ments to the Contractor. The City will provide the County with an itemized voucher after each payment to the Contractor and the County hereby agrees to reimburse the City for its share of each estimate within thirty (30) days from said payment to the Contractor. Final payment will be made to the Contractor no later than three (3) months following satisfactory completion of said Con- tract. Upon presentation of a proper claim by the City, it is further agreed that the County will reimburse the City for its share of all related engineer- ing claims, and all other approved claims associated with the construction of said roadway within thirty (30) days from the presentation of .the claim. 5. The City agrees.that if at a later time the necessity arises for excavation of the road to repair or install sewer, water pipe, or other utilities, it will have the area excavated properly filled and have the road surface returned to its former condition after the necessary construction is completed. The City further agrees that if it should employ its own Contrac- tor the above described water, sewer, or other utilities projects, that it shall hold the County harmless from any and all liability incurred due to the construction and/or installation of said water and sewer pipe, or other -2- utilities projects. Should the City fail to have the road surface properly replaced, it is hereby agreed that the County Highway Engineer may have the work done and the City hereby agrees to pay for it within thirty (30) days following receipt of a properly executed bill. 6. The City hereby agrees to abide by and enforce any regulations of the Federal Highway Administration of the United States of America and the Commissioner of Transportation of the State of Minnesota when such regulations apply. 7. The parties agree that*the City may partially block said road within the corporate limits of the City at such time as it becomes necessary for the performance of the Contract under this Agreement and, in cases of emergency, such road may be wholly blocked and the passage of traffic there- on be prevented by the City.
