Synopsis of Monthly Runs: The department responded to 20 calls this month. One call resulted in a structural loss of $7,000.00. This call was to Fotomark, Inc. When the first pumper arrived the loading dock area was fully involved. We were able to extinguish the fire within a few minutes, keeping the majority of the damage confined to the loading area. We also responded to two calls in which our new tanker was utilized. The first was a mutual aid call to Eagan on Blue Gentian Road. An abandoned house was fully involved. The other was a van fire on . ' Highway 55 in front of Al's Boarding Kennels. The tanker was used to supply water to extinguish the van fire. Training The monthly drill was used to practice relay operations in non -hydrant areas. This was done by using the tanker to haul water to the drop tank ands then pumping the water. 600 feet*.to another apparatus at the simulated fire. Stat. 216B.16(1) BEFORE THE MINNESOTA PUBLIC UTILITIES COMMISSION STATE OF MINNESOTA In the Matter of the Northern States Power Company, Minneapolis, Minnesota, Miscellaneous Rate Change to Reflect the New Gas Supply Arrangement to be in Effect November 1, 1984 Docket No. G002/M-84-412 NOTICE OF APPLICATION FOR MISCELLANEOUS RATE CHANGE On July 27, 1984, Northern States Power Company (NSP) filed with the Minnesota Public Utilities Commission a notice of a change in natural gas rates pursuant to Minnesota Statute 216B.16. NSP intends to place the new rates into effect on November 2, 1984. The reason for the rate change filing is a new natural gas pipeline supply arrangement for all of NSP's,customers in the State of Minnesota. This new arrangement has been approved by the Federal Energy Regulatory Commission (FERC) to be effective November 1, 1984. After that date, NSP will be using the saTru-t natural gas pipeline supply, and the same manufactured gas (peak shaving) facilities, to serve all its Minnesota gas customers. Previously, customers in Moorhead, East Grand Forks and Dilworth, Minnesota; were served with pipeline gas imported from Canada, and had different rates - from other NSP Minnesota gas customers. The effect of the rate filing is a $1,213,900 reduction in rates to NSP customers. NSP designed the rates to combine the Moorhead, East Grand Forks and Dilworth, Minnesota customers, who comprised NSP's MH system, with the remainder of NSP's customers, the NN system. The MK system receives about a $713,900 reduction and the NN system about a $500,000 reduction. NSP will receive the same revenue net of gas supply costs from all customers on the redesigned rates after this proposal goes into effect, as it would have if there had been no combining of the N14 and MM system rates. Since the two systems no longer have separate sources of pipeline supply and peak shaving, there is no longer a basis for having separate rates. Under the proposal, no residential customer receives a rate increase. There will be small increases for some customers in other classes of service. After review of the resolutions, the Minnesota Municipal Board hereby makes and files the following Findings of Fact, Conclusions of Law, and Order. FINDINGS OF FACT 1. That a resolution supporting detachment of certain properties was received from the City of Eagan and a resolution supporting annexation of said property was received from the City of Mendota Heights. 2. The. resolutions contained all the information required by statute including a description of the territory proposed for detachment and annexation, which is as follows: That portion of the Northwest Quarter of the Northwest Quarter of Section 3, Township 27 North,•:Range 23 West of the fourth principal meridian, Dakota County, Minnesota;"lying north of Highway 494, and All that part of the east one-half of the Northwest Quarter of Section 3, -2 - Township 27, Range 23 lying north of the northerly right-of-way of Minnesota Trunk Highway No. 494, and All that part of the Northwest Quarter of the Northeast Quarter of Section 3, Township 27, Range 23, lying north of the northerly right-of-way line of Minnesota Trunk Highway No. 494. 3. The area proposed for detachment is situated within the City of Eagan and abuts the municipal boundary of the City of Medota Heights. CONCLUSIONS OF LAW 1. The Minnesota Municipal Board duly acquired and now has juridication of the within proceeding. 2. An order should be issued by the Minnesota Municipal Board concurrently detaching and annexing the area described herein. O R D E R 1. IT IS HEREBY ORDERED: That the property described herein in Findings of Fact 2 be, and the same hereby is, detached from the City of Eagan and annexed to the City of Mendota Heights, the same as if it had originally been made a part thereof. 2. APPROVAL OF Minutes of the May 8, 1984 meeting were approved as submitted. MINUTES VACANT LOT IN The commission reiterated its former position on the Curley Addition CURLEY'S ADDITION property. That is, that the lot should be sold by the City as a home site, with some of the proceeds used to build a trail along the northwest side of the lot, and the remainder used for park and trail construction. WACHTLER Stein reported that Mayor Lockwood would be meeting with'a PROPERTY representative of the Wachtler estate to discuss the future status of the proposed park land. PARK BUDGET The Commission approved the 1985 budget. RECREATION The summer recreation program was reviewed with the following PROGRAM comments and suggestions: - Art in the Park was enjoyed in the neighborhoods where it was offered. - Could there be a winter volleyball program for adults. - It was suggested that T -ball coaches be trained to educate the kids better to the game. - More tumbling and gymnastics for pre-school age children? - More slow -pitch teams? MISCELLANEOUS Knittig will attend the next meeting of the City Council on August 22nd. The next meeting of the Park and Recreation Commission will be September 18, at 7:30 P.M. in the Engineering Conference Room. Danielson Public Works Director SUBJECT: Salt Storage Shed Mn/DOT Maintenance Garage Conditional Use Permit Case No. 84-15 DISCUSSION: The Planning Commission at their August 28th meeting held a public hearing to consider a Conditional Use Permit for a 100' X 30' salt storage shed to be located at the Mn/DOT Maintenance facility, 2520 Pilot Knob Road. (See the attached staff memos) There was no public present for comment and the Commission recommended approval of the permit subject to the following conditions: 1. The work be accomplished according to the plan submitted that evening. (It was different from the one in the packet in that it had a retention pond shown on it for salt settling). 2. Exterior structure be totally dark brown (roof and walls). 3. A detailed landscape plan be prepared maximizing coniferous plantings along the west and south boundaries adjacent to the salt storage area. 4. The landscape plan receive staff approval. RECOMMENDATION• Staff concurs with the Planning Commission and recommends approval of the Conditional Use Permit to construct the 100' X 30' salt storage shed with the above stated conditions. Danielson Public Works Director August 21, 1984 S BJECT: Salt Storage Shed at 2520 Pilot Knob Road Conditional Use Permit Case 484-15 INTRODUCTION: Mn/DOT worked with the City several years ago to locate and construct a maintenance facility within the City's Industrial Park. At the Planners direc- tion they located their facility on the north end of the MAC site. At the time of these negotiations Mn/DOT had discussed that they would need a salt storage shed to be located some place on their property. DISCUSSION: Mn/DOT has leveled an area on the west portion of their site to use for their sand/salt operation. The site is at a lower elevation and is somewhat concealed from the view of the rest of the MAC site. They need a building to store salt, so they have submitted plans for a 100' x 30' storage building. The zoning ordinance requires a CUP for an accessory structure in the Industrial Zone. Staff has met with Mn/DOT officials and have made some recommendations on site plan changes relative to landscaping and paving. Mn/DOT has made these changes and submitted the plans for Staff review. ACTION REQUIRED: Conduct a public hearing, and, based on input from the Public and Planning Commission, make a recommendation to the City Council. This property is zoned Industrial and is part of ant' approximately 12 acre tract sold to the Minnesota Department of Transportation by the Metropolitan Airports Commission. As you know, approximately the easterly three-quarters of the site is occupied by the existing new maintenance facility designed to house maintenance equipment, personnel, and administrative offices for this portion of the district. 2. They propose at this time to construct a "salt storage building" which would be 30 feet by 100 feet in size. the structure is proposed to be a metal building on an asphalt pad. This portion of the site will also accommodate exterior stock piles of sand. Access to the site will be via a roadway to be constructed from the west end of the existing maintenance equipment area. The roadway to be constructed is with a six foot slope, running from an elevation of approximately 854 to 840. Copies of the site plan and grading plan are attached as submitted by Mn/DOT for the Planning Commission and Council's review. 3. One area of concern which we have discussed with representatives of the department is the maintenance of the severe slopes 'which will be created by the regrading of the land. These slopes will be up to a 2:1 grade on which they propose to plant Crown Vetch. We suggest that Crown Vetch works better as a surface cover if combined with hydro -mulching, and the planting of a legume, such as Bird's Foot Trefoil. Perhaps Mn/DOT would chose to -consider the specifications for this planting cover more carefully and come back with a proposal based on their experience. 4. The storage area and the roadway is proposed to be constructed of bituminous, and you will notice the grading plan indicates a section of storm sewer to be constructed from the west central portion of the storage area to drain under the 2:1 embankment and into the existing wooded area. There appears to be no provision for handling the drainage from that point and we are concerned about he possibility of erosion with that concentration of water which drains the entire asphalt area. 5. Though the building is designed to cover the salt stock pile, salt is frequently stored outside at some such facilities and sometimes covered with polyethylene. We suggest that the City discuss with Mn/DOT CASE NUMBER: 84-15 APPLICANT:' MN/DOT Page 2 representatives the possibility of salt. brine being allowed to drain through the drainage system and into the wooded area to the west. A solution to this could be a salt brine pond, where the brine is allowed to evaporate, leaving a residual behind. If brine is allowed to run through the storm sewer system, tree growth and plant material in the drainageway will die, thus, --creating a more serious condition for erosion and a deleterious impact on the appearance of the land in general. 6. We also suggest the provisions for a greater amount of screening on the south side of the site, which will ultimately be contiguous to a new industrial site when the remainder of the property is developed. such screening could impede the view of the external stockpile at ground level or from one story building. If structures are constructed higher, however, the view of the exterior storage area will be difficult to screen. 7. Representatives of Mn/DOT indicate that when plans were initially discussed for the development of a maintenance facility, that they mentioned the ultimate development of a salt storage building and exterior storage area for sand, etc. We recall 11 no plans indicating such storage facilities and frankly do not recall their having been mentioned.. It is probably true., however,, that the storage of such material is related to the maintenance facility function. Perhaps a solution is one of carefully developing the facility so as to minimize the aesthetic impact, and maximize the effort to screen the facilities and control the run-off so as to prevent erosion and desecration of the land. Danielson Public Works Director SUBJECT: Visitation Convent, Fill and Wetlands Permit Case No. 84-12 DISCUSSION: At the August 21, 1984 City Council meeting Johnson Brothers Contractors and Visitation Convent were granted, based on new evidence submitted that evening, a reconsideration of their wetlands and fill permits that were denied at the July 17, 1984 City Council meeting. Because both of these permits required public hearings, so in order to give the public the opportunity to also review the new evidence, Council ordered new hearings before making a new decision on the matter. RECOMMENDATION• Staff recommends approval of the wetlands and fill permits conditioned upon Visitation Convent signing the application with Johnson Brothers and Johnson Brothers executing the Developer's Agreement with the City. ACTION REQUIRED• Conduct the public hearing to review the reconsideration of the fill and wetlands permits and based upon public input and Council concerns being met, act upon the request. Formal action required is to approve fill and wetlands permits and the attached Developer's Agreement. Private land characteristics; B. Public land characteristics; C. Public investments such as sewer and watermains, street surfacing, curb and gutters and storm sewer facilities. 1 Any deterioration of adjacent property due to erosion, silting, soil deposition or degradation shall be corrected immediately upon written direction from the Public Works Director. a. To insure filling, grading, finishing and landscaping the area according to the approved plans (Exhibits 1, 2, 3, and 4) and to insure repair of any damage to City facilities (street cleaning, street repair, storm sewer cleaning4 water repair) or damages to private land, the Developer shall post a performance bond or letter of�credit with the City in the amount of $20,000. Danielson Public Works Director SUBJECT: Variance and Wetlands Permit 1190 Sylvandale Case No. 84-16 DISCUSSION: David Marich appeared before the Planning Commission in August to request two setback variances and a Wetlands Permit in order to construct a home for Frank Mulaney at 1190 Sylvandale Road. (See the attached memos) One of the variances was for a front yard setback. Howard Dahlgren pointed out in the meeting that the front yard setback requirement would be reduced on a corner lot with section 4.6(4)c of the Zoning Ordinance. This ordinance allows for the minimum setback on corner lots to be increased by not less than 1/2 of the distance in excess of thirty (30) of the front yard of the nearest building. The nearest building is Mrs. Anderson's and she is setback 55 feet. (55' - 30 = 25 X 0.5 = 12.5 30 + 12.5 = 42.5 or say 42') The proposed home is at 30 feet therefore a 12 foot variance will be required. RECOMMENDATION Planning Commission and staff recommend waiving the requirement for a public hearing and granting the wetlands permit and granting a 12 foot front yard and 7 foot sideyard variance. Danielson Public Works Director August 21, 1984 BJEC, : Variance and Wetlands Permit, 1190 Sylvandale Road ry Case 482-16 INTRODUCTION: A large lot owned by Charlotte Anderson of 645 Ivy Falls Ave. was subdivided in May of 1984. It was pointed out by Staff that at the time of granting the sub- division that a wetlands permit would be necessary when a building permit applica- tion was applied for. DISCUSSION: Mr. David Marich has been hired by Mr. Frank Mullaney to design and construct a single family dwelling on the newly created lot. Mr. Marich has designed a very large and expensive home for this lot, and because of the proposed home size and unique design, he is unable to meet several of the City's ordinance requirements: 1. The home is placed 55' from the drainage way. (100' required) Staff feels that siting this home at this location poses no threat to the drainage way. The basement floor elevation has been designed to be 1.2' above the top of the curb near the culvert so that in the event the culvert is blocked, the water will go over the curb and onto the road and not into the house. 2. Front yard setback. Staff has noticed by checking City aerial photos that the approximate established front yard setback on the north side of Ivy Falls Ave. is 50'. Mr. Marich is pro- posing a 30' setback. The front of the house will be oriented to face Sylvandale Avenue rather than Ivy Falls Avenue, therefore, the property line adjacent to Ivy Falls Avenue will function as a side yard rather than a front yard. Staff feels that granting this 20' variance will pose no technical difficulties, in addition, Mrs. Charlotte Anderson, the adjacent neighbor to the east, is not opposed to the 30' setback. 3. Rear yard setback. This lot is virtually a square lot. The north lot line is the legal rear lot line, however, because the house is oriented towards Sylvandale Road, the East lot line functions as his rear lot line. RECOMMENDATION: Staff recommends granting the Wetlands front yard setback an -2 - the waiving of the public hearing for the wetlands permit and Permit, Staff also recommends granting variances for 20' d a 7' rear yard setback. • PLANNING REPORT DATE : , CASE NUMBER: APPLICANT: LOCATION: ACTION REQUESTED: PLANNING CONSIDERATIONS: 28 August 1984 84-16 Frank Mullaney (David.Marrich) Northeast Corner of Sylvandale Road and Ivy Falls Avenue Approval of Wetlands Permit Variance to Rear Yard Setback 1. The property in question is a large single family lot recently platted with a frontage of 140 feet on Ivy Falls Avenue and a depth of 148.74 feet along sylvandale Road. The owner of the property (Frank Mullaney) is one of the founders of the Control Data Corporation and proposes to build a substantial house on the property. Two design considerations affect the site plan as prepared by the owner's architect: a. The owners want the home fronting toward Sylvandale Road so as to be visually a part of the Ivy Falls Addition; and b. the owner would desire the garage door not to be visible from the front of the house (the front oriented southwesterly toward the Ivy Falls Addition). 2. We have discussed :the siting of the home with the applicant's architect and we believe the home is now well located, so as to achieve these objectives. You will notice on the attached site plan that they propose a loop driveway off Sylvandale Road, with an extension of this drive to the south end of he house for access to the garage doors which would be oriented toward Ivy Falls Avenue. The home at this point, is set back the appropriate 30 feet. Legally, Ivy Falls Avenue is the frontage, it being the smaller dimension along the two rights-of-way. Thus, such a driveway can legally be in the "front yard" oriented toward Ivy Falls Avenue. 3. To the northeast of the house is Ivy Falls Creek, or a portion thereof, which will be 55 feet from the northwesterly corner of the house. As you know, the Wetlands Ordinance calls for a 100 foot setback from such a drainageway. Thus, a variance to the Wetlands Ordinance is requested for this purpose. The creek is located in a controlled ditch and it would appear that the construction of the home closer than 100 feet in this instance would not impair the function of the drainageway. 4. You will notice that northerly most corner of the house will be 23 feet from the northerly property line. This being the "rear yard", a 30 foot setback is required by ordinance. Thus, a variance of seven feet is requested for this dimension. CASE NUMBER: 84-16 • APPLICANT:* Frank Mullaney Page 2 5. Obviously, a proposed home could be constructed fronting on Ivy Falls Avenue without a variance of any kind. One could conclude, however, that the construction of this substantial home on this lot will be an asset to the neighborhood and the community, in general. Inasmuch as the variances do not seem to impair use of surrounding land by others, or infringe on the public welfare, perhaps the assets created by the construction of the home on' the site as proposed• would merit a positive approach to this proposal. q. Kermit McRae, District 9 Engineer, has asked whether the cities of Mendota Heights and Eagan wish to have a dedication ceremony. If so, the ceremony would be arranged by the Mn/DOT public relations department. ACTION REQUIRED To consider whether we wish to have a dedication ceremony for the interstate highways, and so notify District 9. Frazell City Administrator August 29, 1984 SUBJECT:Proposed City Policy on Council Elections As I am sure Council would concur, the staff should and must remain absolutely neutral with regard to Council elections. However, as the 'bustodians" of City information, records, and resources, staff often will be called upon to have some level of interaction with Council candidates, both incumbents and challengers. In order to avoid putting the staff in the position of having to make sensitive judgement calls, I am proposing that the attached policy be adopted. The policy is brief, and certainly not exhaustive. However, it does provide some guidelines for the type of information and resources which will be made available to candidates for elective office. If adopted by Council, this policy would be distributed to candidates at the time of filing. ACTION REQUIRED If Council concurs that the City ought to have some policy with regard to elections, it should consider the attached proposal, making any amendments deemed appropriate, then pass a motion adopting the policy. In an effdrt to be fair and equitable to all candidates, both incumbents and challengers, the following guidelines are hereby adopted: 1. Upon filing for an elective office, the name of the ,,a�d date will be placed on the mailing list to receive aliM?' ation materials sent collectively to the City Council, including ed-4—Al agenda packets for Council meetings. These materials will be provided at City expense. One exception would be confidential items (i.e. personnel concerns, pending litigation, etc.) 2. The City Administrator will make himself and other staff mem- bers reasonably available to Council candidates to provide general and factual information about City operations, programs, and procedures, and policies. If the staff receives a request for information thaU in the City Administrator's opinion would require a significant devotion of time and/or monies to produce, the request will be brought to the City Council for a decision. If the Council decides to order preparation of the material, copies will be furnished to all Councilmembers and Council candidates., 3. As a public service, the issue of the City newsletter distributed immediately prior to the election will list the candidates for each office, along with a brief biographical sketch. The news- letter will not be used as a vechicle to promote any candidates, nor the policies which they espouse. This restriction applies to the "Citizen Forum" section, as well as regular articles. Berg Code Enforcement Officer SUBJECT: Schaak Electronics Warehouse Sale, 1415 Mendota Heights Rd. 8/24 - 8/26/84 INTRODUCTION: Schaak Electronics, 1415 Mendota Heights Road, has had their annual three day warehouse sale on August 24th - 26th, 1984. HISTORY: Schaak has in the past requested permission from City Council to hold their warehouse sale since retail sales are not allowed in the Indus- trial Zone. DISCUSSION: Staff had noticed that early in the week of August 20th - 26th that tents were being erected in preparation for their sale. During the staff meeting on August 22nd, I was advised to check with Schaak to see why they had not requested permission for their sale from City Council this year as they have in the past. I first tried to contact Lawrence J. Castriotta, Executive Vice President, and found that he is no longer employed by Schaak. Mr. Castriotta had been the person working with staff for the sale approval. At that point I was transferred to Paul Geunther, President of Schaak. Mr. Guenther referred me to Mr. Oleh Artym, the new Executive Vice President for Schaak. I have had a conversation with Mr. Artym and he assures me that the lack of a re- quest for the warehouse sale was an oversight and Schaak will in the future give the City notification of any future warehouse sales. RECOMMENDATION: This memo is basically for City Council information of what has happened. Staff recommends that if Schaak has any further warehouse sales, they should be directed to notify staff and Council with a letter of request to be sub- mitted a minimum of 30 days prior to the sale. ACTION REQUIRED: If City Council is in concurrence with Staff's recommendation, they should direct staff to notify Schaak about the proper course of action in the event they have warehouse sales in the future.
