Supplies Page 1 April 2, 1974 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, April 2, 1974 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Lockwood, Losleben, Wahl and Gutzmer. APPROVE Councilman Wahl moved approval of the minutes MINUTES of the March 12 meeting. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 Councilman Losleben moved approval of the minutes of the March 19 meeting with corrections. Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 BID AWARD -- City Engineer Kishel stated that the bids for the IMPROVEMENT NO. 73, Mendota Heights Industrial Park improvements have PROJECT NO. 3 been received and tabulated, and recommended that the bid be awarded to the low bidder, Fischer Sand and Aggregate, Inc. of Apple Valley. Councilman Lockwood moved the adoption of Resolution Number 74-30, "RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR CONSTRUCTION OF SANITARY SEWER, WATER, STORM SEWER, AND OF STREET, CURB AND GUTTER IMPROVEMENTS TO SERVE MENDOTA HEIGHTS INDUSTRIAL PARK (IMPROVEMENT NO. 73, PROJECT NO. 3)," awarding the bid to Fischer Sand and Aggregate, Inc. of Apple Valley in the amount of $300,042.73. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 COMMUNICATIONS The Council acknowledged receipt of the March 14, 1974 issue of the Dakota County Courthouse News and a letter from Peter S. Ekholm, 1703 Lilac Lane, commending the Public Works Department for assisting him in resolving a sewer problem at his residence. RESIGNATION The Council acknowledged receipt of a letter of resignation from Wayne Schwanz from the Utility Leadman position, the resignation to be effective April 19. Page 2 April 2, 1974 Mayor Huber moved that Wayne Schwanz' resignation be accepted. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 DISPOSITION OF The Council discussed a memo from Mrs. Lois King, DAKOTA COUNTY the Mendota Heights representative on the committee COURTHOUSE charged with determining a future use for the old Dakota County Courthouse. The memo listed Mrs. King's recommendations on the future disposition of the Courthouse. Mayor Huber moved that the Council concurs with Mrs. King's recommendations and that Mrs. King be commended for her work on the Committee. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 PLANNING COMMISSION Councilman Wahl moved that Lawrence Culligan, APPOINTMENTS 1221 Highway 110, be reappointed to the Planning Commission for a three-year term to expire on January 31, 1977. Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 Mayor Huber stated that he had contacted Annalee Stewart regarding her reappointment to the Planning Commission. He stated that Miss Stewart's term will expire on May 4 and that in his discussions with her, Miss Stewart had not indicated a strong desire to either continue on the Commission or to leave the Commission when her present term expires. Councilman Losleben moved that Joseph Stefani, 1820 Valley Curve Road, be appointed to a three-year term to be effective on May 5, 1974 and to expire on January 31, 1977. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 PARK COMMISSION Councilman Gutzmer moved that William Allen, APPOINTMENT 900 Wagon Wheel Trail, be appointed to the Parks and Recreation Commission to be effective May 5, 1974 and to expire on January 31, 1977 (completing the balance of Joseph Stefani's unexpired term).. Mayor Huber seconded the motion. Ayes: 5 Nays: 0 FIRE SERVICE Fire Chief Siebell and several Volunteer Fire Department Officers were present to discuss a memo from the Officers Committee regarding fire service. Page 3 April 2, 1974 Administrator Johnson stated that the Officers Committee has exhibited a great deal of interest and of concern about standards of new building construction, lack of records on older buildings and concern for fire fighting techniques and records. Captain Gene Lange stated that the Officers Committee is primarily concerned with improving fire service in Mendota Heights. He stated that last fall the department initiated a program called "pre -planning" of major structures in Mendota Heights and its contract areas. Captain Lange outlined the "pre -planning" system for the Council and stated that the Officers Committee requests that the Council allow them an opportunity to check over all new construction plans for commercial and multiple dwelling construction and also recommended that the Uniform Fire Code be adopted. The Council directed the City Administrator and Officers Committee to come up with a recommendation on how the checking of construction plans should be handled -- should they be checked by the Officers Committee or Fire Marshall, and should an ordinance be drafted to provide for the checking of plans. MUTUAL AID The Council briefly discussed the matter of a proposed FIRE CONTRACT Dakota County mutual aid fire contract. Fire Chief Siebell stated that the contract which was originally proposed is being revised and should be submitted to the municipalities in the near future. REQUEST FOR Mr. Harold Baker, 666 So. Freeway Road, was present BUILDING PERMIT to request approval of an application for building permit to construct an accessory structure (summer house) on his property. After a lengthy discussion of the matter, Mayor Huber pointed out that the structure is considerably larger that the Zoning Ordinance allows, and the Council referred the matter to the Planning Commission for consideration. STORM SEWER The Council acknowledged receipt of a letter from DRAINAGE POINT Ronald P. Smith, 2357 Swan Drive, requesting an extension of storm sewer drainage piping on Lot 18, Linden Addition, and a cost estimate prepared by the City Engineer. Administrator Johnson stated that Mr. Smith must consider such items as assessments which would be levied on the back portion of Lot 18, if the - lot is subdivided, and the fact that this lot might look considerably different when the Rogers Lake level is 872.2. The practicality and advisability of building a structure on the back of the lot, if it is subdivided at some future time, will have to be decided by Mr. Smith at that time. Page 4 April 2, 1974 Mr. Smith stated that the storm sewer discharge point from Bluebill is 85 feet from the end of the lot, while the discharge point from Cheri Lane is 190 feet from the end of the lot. He contended that there is a drainage ditch at the discharge point which diminishes the value of Lot 18 and Lot 1 (owned by Bjorklund/Hansen) and that if the pipe were extended an additional 100 feet both lots could be graded over and made level. Engineer Kishel stated that the Council only assessed the easterly 100 feet of Lot 18 for utilities because this is the portion accessible from Cheri Lane and the only portion of the lot that was buildable. Mayor Huber suggested that Mr. Smith petition to have the pipe extended an additional 100 feet -- the City will not pay the $2,500 estimated cost of the project. He also urged Mr. Smith not to assume that the Council will grant permission to subdivide Lot 18 at some future date. Mr. Paul Maczko, 907 Cheri Lane, objected to extending the drainage pipe. MISCELLANEOUS Mayor Huber reported on meetings which he had attended at Minnesota Highway Department offices on future freeways in Mendota Heights. He requested Council concensus to allow Ms. Barbara Lukerman, of Midwest Planning and Research, to work with the staff on highway negotiations with the Minnesota Highway Department if this becomes necessary. The Council concensus was to agree to allow such use of professional services. SURFACE WATER The Council acknowledged receipt of a notice of a MANAGEMENT STUDY Surface Water Management Study meeting to be held MEETING at City Hall at 8:00 P.M. on Tuesday, April 9. DAKOTA COUNTY After a brief discussion of the proposed Dakota County PLATTING ORDINANCE Platting Ordinance, Councilman Losleben moved the adoption of Resolution Number 74-29, "RESOLUTION URGING DAKOTA COUNTY OFFICIALS TO CONTINUE HEARING ON PLATTING LEGISLATION." Mayor Huber seconded the motion. Ayes: 4 Nays: 0 Councilman Lockwood was out of the room when the vote was taken. MISCELLANEOUS The Council acknowledged receipt of a memo on financing from Financial.Advisor Larry Shaughnessy. LEE'S FLOOR AND Councilman Wahl pointed out that the drainage from the JANITOR BUILDING Lee's Floor and Janitor Building is draining from all sides of the lot, which is not in conformance with Council direction to Carmen Tuminelly that the Page 5 April 2, 1974 drainage must be to the south-west. The Council directed the staff to contact Mr. Tuminelly, advising him that this problem must be quickly resolved. BICENTENNIAL Mayor Huber directed that the City Administrator COMMITTEE contact the President of the Volunteer Fire Department Ladies Auxiliary to see if the Ladies Auxiliary would be interested in forming a Bicentennial Committee for the preparation of a program of activities related to the Minnesota American Revolution Bicentennial Communities Program. Councilman Losleben was appointed Council representative on Bicentennial activities. WACHTLER AVENUE Engineer Kishel stated that during the process of IMPROVEMENTS working up plans for the middle section of Marie Avenue the problem of access to the Interstate Park and to Marie Avenue from Valley Curve came up. He stated that a water connection between the new water line on Marie Avenue and the existing line on Valley Curve should be made at Wachtler Avenue, approximately 250 feet, and a grade will have to be established for Wachtler Avenue. He stated that there are two possible alternatives: to construct a full City street and install a water line; or to provide access for a water line at an established grade for future construction and possibly install an eight foot wide pedway from Valley Curve to Marie Avenue. The cost for a full street would be approximately $14,000, while the cost for grading over where the water line would go, installing a water line and eight foot pedway would cost between $9,000 and $10,000. The concensus of the Council was to construct a full City street and water line. ENGINEERING STATUS REPORT HUNTER LANE IMPROVEMENTS The Council acknowledged receipt of the Engineering Status Report for March, 1974. The Council -established a work session on Hunter Lane/ Orchard Place improvements for Monday, April 15 at 5:30 o'clock P.M. BOARD OF REVIEW Mayor Huber moved that the Board of Review meeting be scheduled for June 26 at 8:00 o'clock P.M. in the City Hall. Councilman Lockwood seconded the motion. Ayes. 5 . Nays: 0 FINANCIAL The Council acknowledged receipt of the February, 1974 STATEMENT City Financial Statement. LIST OF CLAIMS Mayor Huber moved the Council to adopt the following - motion: CA 0 Page 6 April 2, 1974 RESOLVED that the claims submitted to the City Council for -payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, April 2, 1974, having been audited by the City Council, be and are hereby allowed and the Mayor and Clerk -Treasurer of the City of Mendota Heights are hereby authorized and directed to issue City checks in payment of said claims. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 PUBLIC WORKS Administrator Johnson recommended that Chester Pearson, INSPECTOR 1192 Garden Avenue, Roseville, be appointed Public APPOINTMENT Works Inspector at an annual salary of $13,600. Councilman Losleben moved that Chester Pearson be appointed Public Works Inspector, with a six-month probationary period, at an annual salary of $13,600. Councilman Wahl seconded the motion. A call was made to your Police Department and within 2 minutes, a police car was at my home. Officer Wicks made an immediate appraisal of the situation, put in a call for an ambulance, was very calm, cool, courteous and administered emergency treatment until the ambulance arrived. I felt this letter was necessary, not only to commend Officer Wicks and the entire Police Department, but to let you know how fortunate -I feel that I live in Mendota Heights with the capable and highly efficient people available to the taxpayer. History and Type of Service For several years the League of Municipalities has entered into an agreement first with Cyrus Smythe and now with the firm, Labor Relations Associates, Inc., to provide certain labor relation services to subscriber agencies. While the agree- ment has been between the consultant and the League of Municipalities, there has been a high involvement of administrators and managers inasmuch as they are the primary recipients of this service rather than the League itself. Basically, there are two types of services provided. The general membership services include preparation of articles for publication in the League magazine; general advice and assistance to municipal officials on labor relations problems and publication of a periodic newsletter called Labor Alert to explain pertinent laws and regulations and provide other information of immediate importance. Under the second type, Labor Relations Associates, Inc. provides special services to those Twin City metropolitan area cities, counties and other government agencies which subscribe for them. These services include participation in joint Local 49 negotiations; participation in joint Local 324 negotiations and assistance in negotiations and mediation with other organized employee groups. At the present time there are 32 municipalities and other agencies participating. As you are all aware, the extent of specific services received by the muni- cipality and the amount of time devoted to any single municipality varies from year to year. ' In some years a specific city may require very little direct ser- vice while in other years, services received may far exceed the fee paid. How- ever, most participating municipalities do benefit collectively. from the assis- tance provided in one or both of the Local 49 and Local 324 negotiations. In addition, changes in pay rates and fringe benefits in one community in the metro- politan area ultimately have an effect on others, and for this reason, every com- munity should be concerned that good labor relations services are available for use to all. Thus, the fees paid by participating agencies are fixed on population rather than assessed on an actual usage basis. Review of Services and New A regiment Because of changes in the labor relations field in Minnesota in recent years, many local administrators felt that it was necessary to review closely the services which subscribers have been receiving and examine closely as well the agreement e 300 hanover building, 480 cedar street, saint pawl, minnesota 55101 C6123 222-2861 Z4 0 - 2 - with the consultant for such services. Sometime earlier I had established a Per- sonnel Management Services Committee to review all League administrative services and, through recommendations to the Board, be responsible for the on-going delivery of these services. I asked this committee, which is chaired by Wayne S. Burggraaff, City Manager of Richfield, to assume the responsibility for the review of these labor relations services and the preparation of a new agreement. The committee has a representative membership from the Twin City area as well as outstate. A list of committee members is attached to this letter. The committee did meet on a number of occasions to review these services and engaged in extended discussions with Labor Relations Associates, Inc., before finally approving a re -drafted one-year agreement for services beginning March 15, 1974. The agreement does provide for a potential 65% increase in total costs. It provides for a fixed monthly retainer of $1500 to cover office space, overhead and miscellaneous support services to the technical assistance program. The principal members of the firm would be compensated at the rate of.$21 while an associate member of the firm would be compensated at the rate of $10 per hour for consulting services rendered. The agreement provides for no other payments and limits the total payment over the one-year period to a maximum of $60,000. In previous years the cost of these services amounted to approximately $43,000, with the Metropolitan League and State League contributing a total of $6,000; metropolitan agencies contributing $4,500 and subscribers contributing $32,000. You will note in the proposed fee schedule which is attached that the fees,have in- creased for the subscriber agencies. In addition, the number of population cate- gories has been increased. This latter change was made by the Personnel Manage- ment Services Committee in an effort to more accurately reflect the extent of special services that might be provided to agencies in various population groupings. The committee has listed the following major reasons to support the increases provided for in the new agreement: 1. Labor relations legislation enacted in 1971 and amended in 1973 requires -that there be written contracts covering wages and terms and conditions of employment. This requirement has made it nec- essary for the consultant to spend substantially more time providing services for negotiations with Local 49, Local 320 and other bargain- ing units. 2.• The new labor relations legislation establishes certain requirements for handling grievances and arbitration. This is most critical since. arbitration for essential employees is binding on both parties: Again, the committee anticipates that grievances and arbitration procedures will require substantially more time on the part of the consultant. 3. Formerly, the League provided free office space to the consultant. The League no longer receives free office space itself and, therefore, cannot continue to provide this assistance to the constYltant. Thus, a portion of the increased costs reflect the'fact that the consultant must assume new office overhead costs. 4. The Metropolitan Council's contribution to initiate and sustain this program in its formative years has now expired. The Council will not be continuing its annual contribution. - 3 - There are some other general cost increases which we are all experiencing in all of our operations, but the committee is of the opinion that the foul reasons listed above reflect the major cost increases. In reviewing the schedule of the costs, I want to emphasize that the services will be provided at a specified hourly rate which the committee and I believe to be competitive for professional services of this type. Thus, Labor Relations Associates, Inc. will be paid only for services performed and the maximum annual payment may not reach the $60,000 figure specified in the agreement. In this event, subscriber fees collected during the 1974/75 agreement period will be used for labor relation services in the subsequent year and any new fee structure adjusted accordingly. The new fee schedule has been developed in such a way that if all present sub- scribers to this service continue their subscription, the total receipts of the program will be approximately $53,000. The additional contributions of $3,000 from both the State and Metropolitan Leagues for general services will provide the addi- tional funds required to almost reach the total $60,000 potential payment provided by the agreement. New subscribers are needed and I hope many will consider partici- pation. A copy of your statement for these services is attached. It is the recommenda- tion of the Personnel Management Services Committee and myself that this program is well worth your support and participation. RE: Outline of Remarks to be presented by Mendota Heights before the Metropolitan Council Physical Development Guide Committee regarding the Eagan Land Use Develop- ment Guide. The Metropolitan Council would like to have a written record of the position of Mendota Heights regarding the Eagan Plan. The following is a draft of points that I find relevant in reviewing the report, discussing with Metro staff and Eagan's planner John Voss. Mendota Heights' comments on Eagan's land use guide relate specifically to: 1. Committed land uses along either side of 1-494 that constitutes a common boundary between the two cities, with emphasis on the area lying east of 1-35E; 2. The major highway system that serves regional traffic needs through both communities; 3. The process of assessing impact and achieving joint planning of metropolitan diversified regional centers where such land uses are located on the periphery of one municipality. ' The position of Mendota Heights is that potential conflict can occur as Eagan proceeds to implement its land use plan in the northeast quadrant of the City and as the State Highway Department completes the regional transportation system of 1-494/35E and Trunk Highway 55/49. The plan, as submitted, does not satisfactorily detail either the process of joint -planning on a regional center, nor the accompanying transportation element that serves proposed land uses. We are aware that Eagan's development guide is meant to serve as a general rather than as a specific document, but nonetheless designated land uses and transportation arteries have a way of becoming 'fixed' and opportunities can be lost for achieving effective cooperative planning. Too many of the specific design criteria and circulation elements remain undefined at this time. Mendota Heights would like to reserve a right to have the plan reviewed at such time as these specifics are available and where compatibility/conflict can be analyzed in greater detail. i AREAS OF CONCERN 1 . Impact of the proposed regional shopping center of 400+ acres between Trunk Highway 49 and Delaware Avenue immediately south of 1-494. Past experience in the metropolitan area has shown that regional centers have metropolitan -wide significance and attract major concentrations of employment, traffic and peripheral commercial and high density residential uses. When these locations are sited on the boundary of one community (such as Northtown in Blaine, but adjacent to Spring Lake Park; and Maplewood Mall in Maplewood, but adjacent to White Bear Lake) the handling of feeder traffic, the detailing of specific ingress and egress points, drainage plans, noise abatement and landscaping treatments, and staging of development cannot be viewed as strictly local decisions. These decisions impact greatly on abutting municipalities and it is mandatory that the solution for the granting municipality does not become the burden of the abutting municipality. For Mendota Heights, the proposed Dayton -Hudson regional center in Eagan holds special problems with regard to the traffic carrying capacity and functions allocated to Trunk Highway 49 and Delaware Avenue. Neither of these two routes are designated on the regional transportation plan as principal arteries. Designated land uses abutting these highways in Mendota Heights are low-density single family housing, or educational institutions. Long range plans of Mendota Heights for the neighborhoods located immediately north of the proposed regional center and east of 1-35E are to develop family-oriented residential neighborhoods. The land is zoned for single family uses, and the school district has purchased a large tract of land between the freeway and Mendota Heights Road for a future elementary and junior high school . The designated uses for both Mendota Heights and Eagan should be kept compatible with cooperative detailed site planning on land use and transportation. Recent studies by the City Engineer on a Surface Water Management Plan for Mendota Heights have identified a major ground water recharge area extending through northeast Eagan and central Mendota Heights. Handling of surface water drainage from the designated industrial and regional shopping center properties should be made with due consideration of this data. 2. Roadway and Interchange plans for 1-494/1-35E and Trunk Highway 55 Both Mendota Heights and Eagan have complementary industrial uses to the east -of 1-35E with access provided between the two communities along Trunk Highway 13, Pilot Knob Road and Trunk Highway 55. The level of access to be provided by Trunk Highway 55 and the overall handling of regional traffic movements from Trunk Highway 55 into Minneapolis and the way in which these routes will serve local land uses does not appear resolved from data shown on the map. -2- Jr A potential conflict appears in the lack of designation of a major arterial status on the Metropolitan Council's transportation plan for Trunk Highway 55 and the access needs of both the proposed shopping center and the combined industrial districts. The interests of Mendota Heights would be best served by a highway design plan that minimizes the allocation of through traffic movements to the north along Trunk Highway 100 and which keeps Trunk Highway 55 from having a complicated interchange movement directly with the two freeway routes. From the Eagan map it is our understanding that Trunk Highway 55 traffic will not have a direct interchange with the freeways, but there is no clear portrayal of how through regional movements on Trunk Highway 55 to Minneapolis will be handled. From this map the function of Trunk Highway 49 to serve the proposed regional center is upgraded in a manner that may be detrimental to the residential neighborhoods to the north. Opportunity for future participation of Mendota Heights to review and coordinate local land use and circulation planning with regard to the regional transportation movements is requested.
