Minutes of the Regular Meeting
Held Tuesday, July 15, 1975
Pursuant to due call and notice thereof, the regular meeting of the City
Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the City
Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.

Mayor Huber called the meeting to order at 8:10 -o'clock P.M. The following
members were present: Mayor Huber, Councilmen Gutzmer, Lockwood, Losleben and
Wahl.
APPROVE Councilman Wahl moved approval of the minutes of the
MINUTES July 1 meeting.

HEARING --
Administrator Johnson stated that the hearing on the
MENDOTA HEIGHTS
assessment roll for the Mendota Heights Industrial Park
INDUSTRIAL PARK
improvements held on July 1 was continued for a discussion
IMPROVEMENTS
of an adjustment of assessment for three properties. He
pointed out that easements acquired in 1965 included conditions
to the easement agreements stipulating that there would be no
future assessments. The properties involved are the Tempco,
Northwest Plastics (Schaak Electronics) and Richline properties.
Mayor Huber pointed out that the agreements established a
maximum assessing limitation and that the limitation has not
been reached, so the assessments for the three properties
should be adjusted to reflect only the balance of assessments
attributable as a result of the maximum limitations established
in the easement agreements. The Council concurred with this
recommendation. Mayor Huber asked for questions and comments
from the audience.
There being no questions or comments from the audience,
Councilman Wahl moved that the hearing be closed.

Councilman Lockwood moved the adoption of Resolution No. 75-58,
"RESOLUTION ADOPTING AND CONFIRMING ASSESSMENT ROLL FOR
MENDOTA HEIGHTS INDUSTRIAL PARK IMPROVEMENTS (IMPROVEMENT
NO. 73, PROJECT NO. 3.)"

1974 STREET The Council acknowledged receipt of a letter from
IMPROVEMENT Mr. Russell Richardson, 1910 Knob Road, in objection to his
PROJECT assessment for street improvements. The Council briefly
discussed the objection and determined that the assessment
is correct in view of the benefit received. Engineer Kishel
pointed out that the assessment for the Russell Wahl property
at 631 Callahan Place, is incorrect and should be adjusted
from $734.66 to $770.47.
After a brief discussion, Councilman Gutzmer moved the
correction of the Wahl asessment and the adoption of
Resolution No. 75-59, "RESOLUTION ADOPTING AND CONFIRMING
ASSESSMENTS FOR 1974 STREET IMPROVEMENTS (IMPROVEMENT NO. 74,
PROJECT NO. 5)."
Councilman Losleben seconded the motion.

RECESS Mayor Huber called a recess at 8:25 o'clock P.M.
The meeting readjourned at 8:30 o'clock P.M.
FURLONG AREA The Council acknowledged receipt of a petition in opposition
IMPROVEMENTS to proposed Furlong area sewer and water improvements and
a memo from the City Planner regarding the proposed improvements.
The Council also acknowledged receipt of letters from
Mr. and Mrs. Bernard Biessener and Mr. and Mrs. Joseph Perron
in favor of the proposed improvements. Administrator Johnson
read the memo•for the audience. Public Works Inspector Pearson
stated that he and a County sanitation employee, John Curry,
made a field trip of the area to determine what type of
problems exist. He stated that he did see evidence that some
septic 'systems are full and talked to several residents who
complained of having to have their systems pumped at two-month
intervals. No evidence of sewage flowing onto the ground was
found. He pointed out that the exact percentage of problems
and the incidence of pumping onto the street is not known.
The Council discussed the proposed improvements and several
Council members pointed out that in view of the opposing
petition, high costs, and apparent lack of majority interest
in improvements, it would be premature to initiate the improvement
project at this time. No action was taken on the proposed project
RECESS Mayor Huber called a recess at 9:00 o'clock P.M.
The meeting was readjourned at 9:05 o'clock P.M.
CLEMENT/VANDALL Mayor Huber outlined the proposed improvements to serve the
AREA IMPROVEMENTS Clement/Vandall area. The proposal includes construction of
thirty foot width streets on the east and west streets, curb
and gutters on First Avenue, thirty foot width construction on
a portion of Clement and a portion of Vandall, and eighteen foot
construction on the balance of the north -south streets. The
proposal also includes partial storm sewer construction. He
also outlined the proposed ponding area, bike and pedestrian
path.

Mayor Huber pointed out that the Council must work out
extensive plans for access into the park for the residents in
the area and that the ponding area location is important to
encourage wildlife, so this must be given much consideration.
Councilman Lockwood stated that he objects to the inclusion
of curb and gutters on First Avenue and cannot support the
project as outlined.
After discussion, Mayor Huber moved the adoption of Resolution
No. 75-60, "RESOLUTION ORDERING CONSTRUCTION OF STREET AND
STORM SEWER IMPROVEMENTS TO SERVE THE CLEMENT/VANDALL AREA
(IMPROVEMENT NO. 74, PROJECT NO. 8.)"
Councilman Losleben seconded the motion.
RECESS Mayor Huber called a recess at 9:17 o'clock P.M.
The meeting readjourned at 9:22 o'clock P.M.
DELAWARE AVENUE The Council acknowledged receipt of a letter from Dakota
PEDESTRIAN WAY County Highway Engineer Gabiou regarding an increase in the
estimated cost for construction of the Delaware Avenue pedway.
The new estimate is $41,544.64 (without consideration of
easement costs) as compared to the original $30,000 estimate.
Administrator Johnson stated that he advised the County that the
City would be reluctant to have the Public Works Inspector
acquire right-of-way for the City that may not be used.
Mr. Gabiou had advised Mr. Johnson that he could not justify
putting the project up for bid until the right-of-way is
acquired. Administrator Johnson pointed out that the agreement
states that the three governmental units who signed the agreement
have the right to refuse to accept the bid within thirty days
after bid opening.
PARK AND RECREATION
COMMISSION
After a lengthy discussion, the Council concurred that the
Public Works Inspector should proceed with right-of-way and
easement negotiations and that the Administrator should
recommend to the Dakota County Highway Engineer that he proceed
with the bidding procedure.
The Council acknowledged receipt of the June 25, 1975 Park
and Recreation Commission minutes. Several members of the Council
noted that the terminology in the minutes did not reflect the
correct advisory status of the Commission. The Council directed
the City Administrator to remind the Park and Recreation
Commission of the Commission's advisory status, and the
correct reflection in future minutes that the Commission actions
are to be recommendations to the Coun-cil.
DEPARTMENT The Council acknowledged receipt of the Police and Fire
REPORTS Department monthly reports for June, 1975.
NORTHEAST AREA The Council briefly discussed the drainage problems and street
PROPOSED conditions in the northeast area of the City. It was pointed
IMPROVEMENTS out by several Council members that on several occasions the
drainage problems could have caused serious safety hazards.

As a result of the discussion, Mayor Huber moved the adoption
of Resolution No. 75-61, "RESOLUTION ORDERING PREPARATION OF
REPORT ON IMPROVEMENTS."
Councilman Gutzmer seconded the motion.

PUBLIC SAFETY The Council discussed at length the recommendation to establish
PERSONNEL a Detective/Fire Marshall position. The matter was continued
from July 1. Administrator Johnson again stated that the
position would provide expertise in areas which are not now
receiving proper consideration. Councilman Losleben indicated
that he would favor the establishment of a Public Safety
Director position rather than the proposed position.
Councilman Gutzmer stated that he is in favor of the position
since it would give the City a day -time fire marshall to
perform inspection and plan checking duties and to attend the
schools necessary in order to bring more expertise to the
Department as well as to provide detective services in the
Police Department. The position could provide the technical
assistance necessary for both departments and which is not now
possible.
Administrator Johnson stated that he would like some direction
from the Council so that budgeting for the position can be
considered. It was the concensus of the Council that the
position should be considered further during the budget
preparation process.
PROPERTY Administrator Johnson stated that he has met with
ACQUISITION Mr. Jerry McGough to again discuss the acquisition of property
adjacent to the Ivy Falls Park. Mr. Johnson stated that
Mr. McGough is now asking $37,800 for the property rather than
$35,000 since the Council has stated it will not waive the
park donation requirement for the plat. Mayor Huber again
pointed out that the Council is firm on the price of $28,000
(the Ivy Falls residents stated they will contribute $7,000
towards the property acquisition).
Administrator Johnson stated also that he is to meet with
Mr. Tom Curley during the week to negotiate for the acquisition
of property in Curley`s Valley View, and that Richard Allen
has been given an earnest money contract for signature for
purchase of his lot.
CIVIL DEFENSE After a brief discussion, Councilman Losleben moved the
ORDI1'NCE adoption of Ordinance No. 132 (codified as Ordinance No. 111),
"AN ORDINANCE ESTABLISHING A CITY CIVIL=DEFENSE AGENCY." _
Councilman Wahl seconded the motion.

LABOR NEGOTIATIONS Administrator Johnson recommended that the City Council
authorize Cy Sheehy (Labor Relations Associates) and the
Metropolitan Area Managers Association to represent the City
in 1976 Public Works contract negotiations.

Association and Labor Relations Associates for 1976 Public
Works contract negotiations.

RECONSTRUCTION adoption of Resolution No. 75-62, "RESOLUTION APPROVING M.H.D.

ENGINEERING STATUS The Council acknowledged receipt of the June, 1975 Engineering
REPORT Status Report.
CULLEN AVENUE The Council acknowledged receipt of a feasibility report for
the proposed extension of Cullen Avenue.
Councilman Losleben moved the adoption of Resolution No. 75-63,
"RESOLUTION ACCEPTING ENGINEER'S REPORT AND CALLING FOR HEARING
ON PROPOSED CONSTRUCTION OF THE EXTENSION OF CULLEN AVENUE FROM
THERESA STREET TO LEXINGTON AVENUE," the hearing to be held
on August 12. -

We are going to begin construction on lots 9 thru 15 in Somerset Park,
located on the south side of Bach%--lor Ave. In the past we have overlooked
the parking situation of cars on both sides of Bachelor Ave due to the par
3 -golf course. This situation occures in the early evening hours and on
weekends during the summer. It will be a great annoyance for the future
people who will live on the south side of Bachelor Ave. and it also creates
a severe hazzard due to the narrowing of the road when cars are parked on both
sides.
We do therefore request that this section of Bachelor Ave. be posted with
proper signs to allow parking on the north side of Bachlor Ave. only.

MEMORANDUM
TO: City Council, City of Mendota Heights
ATTENTION: Orville Johnson, City Manager
RE: Objectives for Area Transportation Study Committee

The following is a suggested outline of the basic points to be included
in a statement of objectives representing the interests of the City of
Mendota Heights as relates to the Metropolitan Council's current Trans-
portation Advisory Committee.
1. An efficient transportation system is highly essential to the overall
welfare of the Metropolitan Area and every community and citizen with-
in it.
2. The system should be designed and built so as to recognize the fact
that the most efficient, functional, and compatible transportation
system is one that maintains a balance of the use of freeways,
highways, expressways, thoroughfares, mass transit, bicycles and
pedestrian routes, each performing its appropriate function
according to need and location.
3. Mass Transit should be encouraged as a supplement but not a replacement
for the basic freeway system as currently proposed. Recognize that
many communities have already made'sacrifices in terms of allowing
freeways to be constructed. Let us minimize such sacrifices but be
realistic in terms.of its adverse affect in all the communities in
the area. No Communities should be allowed to destroy a vital link
in a well conceived route system.
4. It is important to,maintain the overall integrity of the proposed
Federal Aid Interstate System as originally designed. No one -
link in the proposed system should be allowed to be dropped as -a -
convenience'to a single community.

5. Each link in the 4rea to -be studied should be designed so as to -
adequately handlgVnticipated traffic projected on the best avail-
able method. Design.of each link to be studied shall be consistent
with the design level of the system of which it is a part, consistent
with its assigned design role. '

6. The details of each link under consideration should be designed
utilizing the best technology for minimizing the adverse effects
of vehicular use including sound control, visual control, and
aesthetic impact on existing contiguous development.
7. The basic freeway system as originally proposed in the Twin City
Metropolitan Area should be recognized as a minimal Federal Aid
Interstate System serving the area. The destruction of any of
its circumferential or radial routes will have severe adverse
influence on the Metropolitan Area as.a whole.
8. The design for the entire Federal Aid Interstate System should be
agreed upon and constructed as soon as possible. Long delays have
been grossly unfair and disruptive to many communities, in particular
the Northern Dakota County area, having severe adverse influence
on the orderly planning for and development of communities within
the areas affected.
With respect to the City of Mendota Heights direct concern,the following
statements are offered:
1. The City of Mendota Heights endorses the construction of 35E as a
continuous and vital part of the 35W - 35E Alternative Northerly
Route System to and thru the Cities of St. Paul and Minneapolis.
2. The City of Mendota Heights endorses the completion of the circum-
ferential route by the construction of Interstate 494 thru the City
of Mendota Heights in a manner consistent with design capacity needs.
3. The City expresses specific concern regarding the design of 494, 35E,
and Highway 55,..emphasizing the need to minimize the scope and comp-
lexity of the geometrics and extensive right-of-way required.
4. The City endorses the u.se of design standards emphasizing the use
of the system for local transportation needs with emphasis on
-reduced speeds, and maximum design compatiblity with contiguous
local land areas. -
5. The City disavows the right of any one community to destroy the over--
all integrity of this system but recognizes the right of any commu-
nity to insist upon use of the highest.standards of design creating
acceptable Yevels of compatibility with.the local development
interests-.

The regular meeting of the Mendota Heights Planning Commission
was called to order at 8:00 P.M., Tuesday, July 22, 1975, by
Chairwoman Ridder.
The following members were present: Chairwoman Ridder, Wheeler,
Clemens, Crecelius, and Culligan. Stefani and Schneeman arrived
late. Also present: Planning Consultant Dahlgren.
APPROVE MINUTES The minutes of the June 24 meeting had been
submitted to the members with the agenda.
[wheeler moved, seconded by Clemens, that the minutes be approved
as submitted. Voting: All Ayes.
CASE NO. 75-11, Chairwoman Ridder opened the hearing required
MANN for the subdivision of Lot 3, more commonly
known as 1954 South Lane, and asked for
questions and comments from the audience. There being no one from
the audience who wished to be heard, and no further questions or
comments from the Commission members, Wheeler moved, seconded by
Clemens, that the hearing be closed and that the subdivision be
recommended for approval. Voting: All Ayes.
CASE NO. 75-16, Chairwoman Ridder opened the hearing required
MC DONALD'S CORP. for the application for conditional use permit
for the McDonald's fast-food restaurant at
the location of Hwy. 110 and Hwy. 49. Randy Berg and Richard Engstrom
from McDonald's were present. Chairwoman Ridder asked for questions
or comments from the audience. There was considerable discussion
amongst Mr. Berg, Consultant Dahlgren, and the members as to'the
problems of the application. There had been no request for subdivision
from owner Dick Sheehy, and Chairwoman Ridder said that the Planning
Commission could make exception only if the subdivider so requests.
Mr. Sheehy was not present at the meeting to discuss this. Consultant
Dahlgren discussed the site in question pointing out that there is
a discrepancy in the property descriptions. The legal description
on the McDonald's site plan does not coincide to the land described
on the Sheehy grading and landscaping plans. There was discussion
on the traffic problem that would be created, especially the entrance
and exit on Dodd Road. Suggestions were made to consider some other
kind of access to the McDonald's parking lot with an island to divide
ingress and egress for McDonald's from the ingress and egress for the
total shopping center parking area. There was also discussion on the
sign heighth variance application submitted by the McDonald's people.
They would like a sign that would be 39 feet.high, which is 14 feet
more than is permitted. They feel that since there are ascending
slopes going both east and west on Highway 110, the location of the
restaurant would be at the lowest point on the road. The Commission
Planning Commission Minutes -2- July 22, 1975
pointed out that since the restaurant is proposed to serve mainly
area residents, the 25 foot sign should be adequate. In addition,
Consultant Dahlgren recommended that a green area be situated between
the McDonald's parking area (at the south end) and the Mendota Plaza
parking area, that the exact legal status of the ponding area be
determined, and that the parking area setbacks be defined as 10 feet
from the green areas (or that a setback variance be requested).
Berg will contact Sheehy regarding the subdivision application.
After more discussion, Wheeler moved, seconded by Ridder, that the
hearing be continued at the next regular meeting to be held August
26. Voting: All Ayes.
CASE NO. 75-10, Mr. Harvey Bream was present to discuss his
BREAM HOMES application for preliminary plat approval for
Somerset No. 3. Consultant Dahlgren reviewed
the area in question and suggested some minor revisions to the plat.
Those revisions are as follows:
A. Southwest lot line of Outlot A will be changed as
shown to allow City access to culverts under Marie
Avenue.
B. Lot 1 will be eliminated and the west property line
of Lot 2 will be changed so that there will be no
interference with the ballfield in the park.
C. The lot lines for Lots 4, 5, 6, 8, and Outlot B will
be changed to provide better lots and to adjust for
the elimination of Lot 1.
D. The location of the intersection of Bachelor Avenue
and "Trail Road" has not been determined as yet. The
developer will attempt to situate the road in such a
manner as to save several trees which might be within
the right-of-way of the street as drawn. Also, it is
proposed to align the street so that the centerline
would be thirty feet from the lot lines of both Lot 1,
Block 3 and the park property. (At the request of the
developer, it is proposed to name "Wachtler Avenue" as
"Trail Road".)
These recommendations have been referred to the Park Commission for
their review. Ridder moved, seconded by Clemens, that a subdivision
hearing be held on August 26. Voting: All Ayes.
MISCELLANEOUS The Commission discussed the unauthorized sale
of used cars from 772 Ridge Place.and determined

SUBJECT: Municipal Facilities Task Force Committee Establishment
Attached is a copy of a proposed resolution establishing the
municipal facilities task force committee, and also a copy of the recommended
"charges" to the committee. The residents listed in the resolution have
indicated their willingness to serve on the committee and have also accepted
the charges as being feasible and realistic.
You will note that three appointments have not yet been determined.
The Clement-Vandall/Cherry Hills area, Rogers Lake area and the very north
end of the City are not represented on the committee. I would therefore
recommend the appointment of a resident from each of these areas.
I would recommend your adoption of the proposed resolution and charge,
as well as the appointment of the remaining three memebers, so that the
committee may begin its tasks.
