Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Losleben, Wahl and Gutzmer.

PLANNING COMMISSION Mayor Huber opened the meeting for the purpose
CASE NO. 73-25, FRIEL of a public hearing on Bernard Friel's application
STREET VACATION for, the vacation of Pawnee Court and a 'portion of
Pueblo Drive. Village Administrator Johnson gave
a brief history of the application.
There being no comments or.objections from the audience, Councilman Gutzmer
moved that the hearing be closed. Councilman Losleben seconded the,motion.

Commission had approved Mrs. Perron's application for rezoning of Lots 15
--through 21 and Dots 28 through 33,'Willow Springs Addition and that during
the course of the Planning Commission discussion the Commission noted that it'
would be advisable to square; off the area of the zoning district. At the
r, Council meeting of November 6, 1973, the Council extended the proposed district
to include the property listed in the public notice, primarily to avoid "
p `I spot zoning..
Mayor Huber read a petition received on December 4 and signed by 23 residents
k''in objection to the inclusion of 22 acres of property owned by Independent
School District 197. Mayor Huber stated that he is in favor of a rezoning of
the entire proposed area•in order to avoid a'possible future court case over f.
the exclusion of the extended area.
Several members of the audience expressed their objection to the inclusion of
the school property and their reasons for objecting.
After a,discussion of the matter, Councilman Gutzmer moved that the hearing be
closed. Councilman Losleben seconded the motion.

Councilman Gutzmer moved the adoption of Ordinance Number 115, "AN ORDINANCEI'
TO AMEND THE ZONING ORDINANCE," rezoning the property west of Warrior Drive,
north of the rear lot line of the platted lots south of Callahan Place, south
of Marie Avenue and west of Lots 20 and 29, Willow Springs Addition.
Councilman Wahl seconded the motion.

PLANNING COMMISSION Mr. Chuck•Mertensotto, attorney for

preliminary plat. Mr. Mertensotto stated that
the County has given preliminary approval of the plat on the condition that the
s,l developers give the county seventeen feet of additional right-of-way for
'Lexington Avenue. Engineer Chuck Dahlgren stated that the rectory building
°r. property has been plotted as one lot of 29,832 square feet and that the building
will be used as a duplex. Village Administrator Johnson questioned whether the
east lot line is far enough away from the building (if it is to be used as, a
duplex). Mr. Dahlgren stated that the east lot line is approximately 20 feet
„from the rectory building.
Village Administrator Johnson pointed out the following items which should be {
taken care of before preparation of the final plat: surface water disposal plansi

including a preliminary design on street grades and complete cut and fill, and i
easements, all of which should be worked out in cooperation with the Village
Engineer; final understanding on the dedication for park contribution; and a 1'
recording on the plat that the land will incur assessments for Marie Avenue
,incumbrances. He suggested that an agreement be drawn up covering these matters'.
Mayor Huber suggested that concrete marking of some kind be placed around the
property to be dedicated as park contribution so that it can be easily

WHEREAS, the Village Council deems'it necessary and advisable to'acquire i

IT IS HEREBY RESOLVED that the Dakota County Board be requested to reclassify

IT IS FURTHER RESOLVED that the County Board be requested to provide the

RESOLUTION ACCEPTING WORK AND APPROVING FINAL
PAYMENT (IMPROVEMENT NO. 72, PROJECT NO. 6)
WHEREAS, pursuant to a written contract signed with the
Village of Mendota Heights on June 7, 1973, Valley -Rich Company,
Inc. of Rosemount, Minnesota has satisfactorily completed the

improvement of sanitary sewer, water, street and storm sewer to

serve the area known as Somerset No. 2 (Improvement No. 72,

Project No. 6) in accordance with such contract;
NOW THEREFORE IT IS HEREBY RESOLVED by the Village Council of '

are hereby directed to issue a proper order for the final payment i

AN ORDINANCE ESTABLISHING THE PLANNING COMMISSION
Section 1. Establishment of Commission. The Planning Commission
for the Village of Mendota Heights is hereby established.
'
Section 2. Composition. The Planning Commission shall consist
of 7 residents of the Village, appointed by the Mayor with the consent
of the majority of the members of the Village Council. -The members
shall serve terms of three years.,The terms shall be sta eyed so
that terms of .two membersh.al-1 exp e each yea=. At the organiza-
tional meeting of the Planning Commission held in February of each
year the Planning Commission shall elect a Chairman and a Vice Chair-
man from among ,i'ts 'members and shall appoint a• Secretary who may or
may not be a member of the Commission. The term of such officers shall
be for a'period of one year.
Section 3. Duties and Powers. The Planning Commission
shall make studies, investigations and recommendations to the Council
regarding matters affecting general matters of planning including
zoning, transportation, platting and public improvements and such
other related matters as may be assigned to it by the Village Council.
The Planning Commission shall, if requested by the Village Council,
adopt a comprehensive municipal plan for future developments and land
use, and may with consent of the Council, prepare a capital improvements
program for the purpose of determining priorities and apportioning
the costs of scheduled public improvements. The Commission shall, in
performing the aforementioped responsibilities, exhibit the initiative
in formulating plans which will be responsive to the anticipated
needs and objectives of the Village.
Section 4. Meetings, The Commission shall hold at least one
meeting each month At a time regularly established and approved by
the Village Council and shall hold such special meetings as,may be ;
necessary, for the conduct of its business. The Commission shall
adopt rules for the transaction of business and shall keep a record
of its resolutions, transactions and findings, which record shall be
maintained as a public record. The Commission shall submit to the
Village Council a true and correct copy of all of its minutes, recom-
mendations and other reports.

on the establishment,of written rules and regulations for the use,'
management and operation of'the public parks and recreational facilities,
the same to be approved by action of the Cbuncil before being put into
effect. The Commission shall, if requested by the Village Council,
prepare plans for the acquisition, development and improvement of the,,:i'
Village public parks and recreational facilities and shall, if requested
by the Village Council, deVelop a Comprehensive Plan for future park
development and open space. The Parks and Recreation Commission shall,
if requested by the Village Council, prepare a Capital Improvements

The 1973 legislature enacted laws to codify and combzne the previous
city codes'and vill.age codes in order to obtain uniformity and
consistency. Z'he legislation and new codes recognize two tlrr�es of
municipaliiies: home rule charter cities and statutory cities.

RESOLUTION IN OBJECTION TO COUNTY ACTIONS
ON DISTRIBUTION OF ROAD AND BRIDGE FUNDS
WHEREAS, legislation enacted in 1959 authorized the Dakota
County Board to distribute a portion of the road and bridge levy
to Dakota County villages and cities; and
WHEREAS, tY�is distribution practice has followed a given formula
over the years, allowing the municipal off_icials to anticipate th.eir
annual share with some degree of accuracy; and
WHEREAS� the Omnibus Tax Bill has put. a very real limit on the
amount of tax levy collectible by the municipalities, as well as the
County; and
WHEREAS, during the year 1973 all Da}cota County municipalities
were operating under the understanding that an established and known
amount was to be forthcoming from County Road and Bridge Funds; and
WHEREAS, verbal confirmation of anticipated amounts was
previously given by county officials; and
WHEREAS, in fact, the County Board of Commissioners aul.horized
distribution of 1973 Road and Bridge Funds at the December 18th meetirig,
such individual allocations being considerably less than either
anticipated or budgeted by the various municipalities� and
WI-IEREAS, such action and reduced allocations were adopted without
regard to impact on local governmental operations or without notice to
municipal officials; and•
WHEREAS, the Board of County Commissioners was �equested via
Mendota Heights Resolution Number 496, dated June 6, 1972, to continue
the existing road and bridge revenue sharing practice witlzout change
until the Omnibus Tax Bill limitations are changed;
NOW THEREFORE IT IS HEREBY RESOLVED BY the Village Coiuzcil of the
Village of D:endota Heights that the Village officials hereby express
displeasure and disappointment over the unannounced actions of the
County Board of Commissioners;
BE IT FURTHER RESOLVED that the County Board of Commissioners
and County officials be requested to exhibit a more cooperative

WHEREAS, it is the desire of the Village officials to establish
a better liaison between property owners and the Village by providing
closer construction supervision; and
WHEREAS, with the onset of development pressures within the Village,
enforcing of Zoning Ordinance requirements will become an increasingly
important obligation; and
WHEREAS, th.e detailed work involved in anticipated construction
within the Village will require closer communication and coordination
between the citizenry, the developers and the Village; and
WHEREAS, the need for a public works inspector to provide "on site"
association with all public works construction and land use controls has
become increasingly•evident;
NOW THEREFORE BE IT RESOLVED by the Village Council of the Village
of Mendota Heights that a Public Works Inspector position is herewith
created; and
BE IT FURTHER RESOLVED that the Public Works Inspector shall be
responsible to the Village Administrator, keeping him informed on all matters
