Pursuant to due call and notice thereof, the regular meeting
of the Uillage Council, Village of inendota Heights, was .�
held at 8:00 o'clock P.m. at the Village Hall, 750 Smuth Plaza
Drive, mendota Heights, minnesota.
mayor Hu6er called the me�ting to order at 8:00 o'clock P.m.
' The following members were present: mayor Huber, Councilmen
Lockwood, Gutzmer and Wahl. Councilman Blair had notified ,
the Council that he would be absent.

easements have been•received f,�om mr. Jeff Zachman,

Willow SRrings Addition,,and mrs. E. R. Shields,
owner of Parcel Number 27681, Lot 25, Willow Springs
Addition for sanitary sewer extension, Improvement .'
Number 72, Project IVumber 7.
mr. Kishel further statecl that mr. Dick Parranto, Uillage .
�ppraiser, has obtained an option to acquire the west thirty feet
of Lot l, Gangl's First Addition for $600, but that the option
will only be granted if the $672.87 assessment against the
property is cancelled. He also stated that mr. Parranto has
obtained conatruction easements for the adjacent area for $42.00.
mr. Kishel stated that he has negotiated with the Robert W. moore
Company to construct the sewer at a cos� of $4,200, and that with

recommended that the Uillage Council authorize the Uillage

and that the necessary resolutions be adopted so that the project
can be started.

Uillage Administrator Johnson-stated that the subject had been
�, thoroughly studied and that the Village will be much better
off under the SAC system tMan it is under the present billing"'
system since the SAC sys•tem will reduce the Uillage's metro
Sewer Bill by at least �50f . •
WATER The Village Administrator stated that a new
RATE rat� schedule has been received from the St., Paul
INCREASE Water Department listing an increase in water
rates effective December 1, 1972. He outlined the
differences between the current and the new rates for demand
and consumption charges. •
Councilman Wahl stated,that he would like to see the Council
ask. the Water Department how such a large increase can be
justified. mayor Huber•suggested that Councilman Wahl and any:
other interested Councilmen check with the Department to determine
the justification of the increase. ' . �

viewed their excellent presentation relative to the
mendota Heights project. We also express gratitude to the
mayor and Uillage Council for urging our participation
and encouraging our comments to the multi—dimensional
presentation. Since October 2, 1972, our way of thinking
has travelled through the states of admiration, reflection,
analysis, and now, constructive cooperation.
It is in this latter mood that we have formally
prepared our expressions, posi�tions, and policies
relative to the project. This document will shortly be
transmitted to the prospective developers.

SUBJECT: 1973 Salary Adjustments

The 1971 Legislature enacted new legislation in the
form of a Public Employees Labor Relations Act. In addition
to formalizing and structuring labor negotiations with
organized employees, another thrust of the Act was to
formulate wage patterns that were �nore in tune with budgetary
procedures. Although our budget was adopted in October,
labqr negotiations were proceeding and were ultimately
agreed upon shortly thereafter. In line with the intent
of the Act, it is desireable �o have wage rates established
prior to the beginning of th� calendar year. This memo
is therefore be�ng submitted in order to formalize the
salary rates prior to 1973.
The Council negotiating committee met on five occasions
with representatives of the Teamsters Union. On the fifth
meeting an oral agreement was reached on both Public Works
and Police salaries. In addition to a gross pay increase,
I was requested to procure quota.tions on long—term disability
insurance. The cost of any insurance plan accepted by the
organiz�d employees was t,o be deducted from the gross increases.
In addition to procuring insurance quotations, the business
ac�ent and I were to work out the language of a new and
more sophisticated labor agreement in compliance with the
Public Employees Labor Relations Act. The Public Works
contract has been drafte.d and is ready for submittal to
the Unipn for its perusal and, hopefully, acceptance. The
Police �ontract is being drafted at the present time.

are across—the—board for other patrolman
positions and sergeant, and leadman

These amounts have been •agreed upon by the committee with no
other fringe benefits or working condition changes. It is
recommended that the mayor and Administrator be authorized
to sign the two union agreements.
In addition to the foregoing labor negotiations, I am'
�roposing salary adjustments for the non--union personnel.
The following chart indicates a comparison with other
similar pqsitions in the metro area and also compares the
recommended increases with a 5� salary increase. You will
note that there have bee� three adjustments that are
considerably above and below the 5� standard. These special
adjustments are being recommended because of the disparity
between cuzrent salaries and comparisons with the metro
salary survey figures. These reco�rnmended figures have
been discussed with the department heads and have been
arrived at with mutual discussion and acceptance. There is
no intent of additional fringe benefits, changes in working
conditions or insurance discussions with the non—union
personnel.
It is my opinion that the present personnel are
qualified and dedicated people. Their willingness to work
and concern themselves with Uillage affairs beyond
the call of duty is to be commended. I am, therefore,
recommending 1973 salary rates as per the following chart:

Th� above salary increases are within the 1973
budgeted salary totals, they do comply with the current
wage—price concepts, and should allow us to continue with
a fairly—paid group of public employees, therefore, I
recommend the acceptance of both the labor agreements and
salary changes as proposed.

Sewer Assessment Deferment
mr. and mrsa fiuss have inquired on several occasions
conc�rning sewer assessments on their 21.48 acres at
1401 Wachtler Road. The sewer and wate� construction �
for the Cherry Hills area involved� sewer and water improvements
on Wachtler Road, hence their property was benefitted. When
the asaessments for this project were levied, the County
records indicated that the 21.48 acres were owned by
the Lowery Hill Construction Company, hence sewer assessments
were levied against the entire 21,48 acres. Water assessments
are not an issue.
The actual breakdown of sewer asses�ments (lateral
sewer� amounted to �4,215.75 on the north one—third of
the property and $8,339.25 on the south two—thirds of the
property.
Since the sewer assessments were levied, the entire
property has reverted back to the Russ owhership and they
are therefo�e requesting that the sewer lateral assessment
be deferred as was done to other "rur�l'! property. I
believe that they have paid one year's levy on the sewer
asSessment. There has been no discussio� as to whether
a refund should be granted for the amount already paid,
but it does appear that at least the future assessments
should be deferred to treat them in a manner which is
consistent with other similar propertieso Uppn further
discussion of this matter, a resolution will be prepared
reflecting Council desires.

RESOLUTION REQUESTING SPLIT LIQUOR
LEGISLATION

WHEREAS, the Village of inendota Heights has adopted
Ordinance I�umber 103 providing for the establishment of
a municipal "off—sale" liquor store; and
WHEREAS9 it is anticipated that such store would
provide additional revenues for other governmental
services; and

UJHEREAS, ('fISA 3400353, subd. 5 does not authorize
the issuance of "on—sale" liquor licenses to private
persons when the municipality operates a municipal
"off—sale" store; and
WHEREAS, it is anticipated that private development
in certain areas of th� Uillage will request private
"on—sale" licenses in conjunction with other commercial
enterprises; end
WHEREAS, such development would seem proper and
fitting in areas which are zoned for such uses,
NOW THEREFORE BE IT RESOLUED by the Uillage Council
of the Village of inendota Heights that the Uillage Council
does hereby petition and request the 1973 Legislature to
amend such prohibiting legislation or enact a special
bill� authorizing and permitting �Iendota.Heights to
operate a municipal "off—sale" liquor store and issue
private "on—sale11 licenses; and

be sent to Representative Ray Kempe and Senator Howard Knutsone

RESOLUTION APPROVING FINAL PLAT FOR
SOmERSET N0. 2 `
UJHEREAS, those persons known as Lassco have previausly
presented a preliminary plat for Somerset No. 2.and
obtained proper approval; and
WHEREAS, the i�inal plat has now been submitted
for final approval;
NOW THEREFORE IT IS HEREBY RESOLUEp by the Uillage
Council, Uillage of inendota Heights, minnesota that the
Uillage Council does hereby approv�e said plat and authorizes
the mayor and Clerk to sign said plat;
BE IT FURTHER RESOLUED that the Uillage of inendota
Heights recognizes the acceptance of the outlot and
Lots l, 2 and 3, Block l, for both pond�ng area and the
en�ire fulfillment of park ��d open—spaci� dedication�
BE IT FURTHER RESOLVED that no building permits are
to be issued until central sewer and water is available,
especially including Lots 2 and 6, Block 3, which may
involve special construction;
BE IT FUf�THER RESOLUED that the developers are to be
cqmmende�l for the cooperative and timely effort extended
in providing the ponding area and erosion control measures.

RESOLUTIOIV ACCEPTING GRADING PLAIV AND
PERFORmANCE BONDS
WHEREAS, the final plat for Somerset No. 2 has
been approved by the Uillage Council; and
WHEREAS, the developers have provided plans and
specificatio�s for the,grading, ponding area construction
and certain storm sewer facili.ty constr�ction; and
WHEREAS9 such plans and specifications and attached
memorandum of Issues meets expected development procedures;
and +
WHEREAS, the developers will provide a performance
bond to guarantee the grading, ponding area construction
a�d storm sewer construction in accordance with said plan�
and specifications;
NOW THEl�EFORE IT IS HEREBY RESOLUED by the Village
Council of the Uillage of inendota Heights that said grading
plan, ponding aree construction and partial storm sewer
construction plans and specifications are hereby approved;
BE IT FURTHER RESOLUED that a performance bond, approved
by the Uillage Attorney, shall be submitted prior to site
improvement construction.
