Const. booklet Page 469 December 23, 1974 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Special Meeting Held on Monday, December 23, 1974 Pursuant to due call and notice thereof, the special meeting of the City Council, City of Mendota Heights, was held at 5:00 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 5:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Gutzmer, Lockwood, Losleben and Wahl. MARIE AVENUE Mayor Huber reported on the status of the CONSTRUCTION dispute existing with respect to the location IMP. #73 of Marie Avenue between I -35E and Victoria PROJ.' #2 Avenue. Mayor Huber reported that a tentative settlement of the dispute had been reached with representatives of the Eagle Ridge residents and the McClouds and Allstroms. After extensive discussion on the subject, Councilman Lockwood moved the adoption of Resolution Number 74-108 "Resolution Providing For Settlement of Marie Avenue Road Dispute." Councilman Gutzmer seconded the motion. The resolution was thereupon unanimously adopted. Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 There being no further business to come before the Council, Councilman Wahl moved that the Special meeting be adjourned. Councilman Losleben seconded the motion. Page 488 February 18, 1975 CITY OF MENDOTA HEIGIiTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, February 18, 1975 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Gutzmer, Losleben and Wahl. Councilman Lockwood had notified the Council that he would be out of town. APPROVE Councilman Wahl moved approval of the minutes of the MINUTES February 4 meeting. Councilman Gutzmer seconded the motion. Ayes: 4 Nays: 0 BID OPENING AND Mr. Lawrence Shaughnessy, Jr., City Financial Advisor, opened BID AWARD the bids received for the sale of $360,000 State Aid Road Bonds. The following represent the various banks and bond brokers bidding on the issue: First National Bank of St. Paul, bid $303,750.30 with an interest rate of 6.314%; Dain, Kalman and Quail bid $306,025.75 with an interest rate of 6.36%; First National Bank of Minneapolis bid $297,484.38, with an interest rate of 6.1847%; American National Bank of St. Paul bid $295,958.13 with an interest rate of 6.152%; Piper, Jaffray and Hopwood bid $307,742.45 with an interest rate of 6.398%; Juran and Moody, Inc. bid $299,473.75 with an interest rate of 6.226%. Mayor Huber moved the adoption of Resolution No. 75-16, "RESOLUTION AWARDING SALE OF $360,000 STATE AID ROAD BONDS OF 1975," awarding the bid to the American National Bank of St. Paul. Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 HEARING -- Mayor Huber opened the meeting for the purpose of a hearing BACHELOR AVENUE on proposed Bachelor Avenue/Lansford Lane improvements. IMPROVEMENTS Public Works Inspector Pearson gave a brief history of the proposed project and stated that hearing notices had been mailed to all property owners to be affected by the proposed improvements and that the notice had been published in the official newspaper. Engineer Kishel described the proposed improvements and the location of the proposed sanitary sewer and water lines. He stated that the estimated costs are as follows: Sanitary sewer, $18.50 per assessible foot; water mains, $8.00 per foot; street construction, $15.50 per front foot; storm sewer $.055 per square foot. Page 489 February 18, 1975 Mayor Iiuber asked for questions and comments from the audience. Mr. Eugene Schway, representing Par 3 Golf, Inc., asked whether the assessments which would be charged to the Golf Course can be deferred. Mayor Huber pointed out that questions of this nature could not be answered until the assessment hearing. There being no further questions or comments from the audience, Mayor Huber stated that anyone having objections should place his name and objection on a list provided by the Clerk or should submit his objection in writing to the City offices. Mayor Huber moved that the hearing be closed. Councilman Losleben seconded the motion. Ayes: 4 Nays: 0 The hearing was closed at 8:21 o'clock P.M. Councilman Gutzmer moved the adoption of Resolution No. 75-17, "RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER EXTENSIONS, WATER MAIN EXTENSIONS, STORM SEWER AND STREET CONSTRUCTION FOR A PORTION OF BACHELOR AVENUE AND LANSFORD LANE (IMPROVEMENT NO. 74, PROJECT NO. 7)." Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 CASE NO. 74-27, Mr. Richard Poore was present to request approval of the POORE preliminary plat for subdivision of Lot 38, Auditor's Subdivision No. 3. Mayor Huber stated that in order to retain the right to dedicate street right--of-way to the Poore residence if Lot 38 is again subdivided, in the future, Mr. Poore should retain a 60 foot strip of property from Dodd Road along the south edge of the proposed new lot. Mr. Poore stated that he would be willing to retain the 60 foot strip. Councilman Losleben moved the approval of the preliminary plat subject to Mr. Poore's retention of a 60 foot wide strip of land from Dodd Road to his property along the south edge of the new lot. Councilman Gutzmer seconded the motion. Ayes: 4 Nays: 0 PARK COMMISSION Councilman Wahl moved that Mrs. Elizabeth Witt, 605 W. Marie, APPOINTMENT be appointed to the Park and Recreation Commission to complete Mrs. Fogelson's unexpired term, the appointment to be effective immediately and to expire on January 31, 1977. Councilman Gutzmer seconded the motion. Mayor Huber stated that the report should be given serious consideration after approval of the final plat of the McGough property. PARK USE ORDINANCE Councilman Wahl moved the adoption of Ordinance No. 129, "AN ORDINANCE REGULATING THE USE OF PUBLIC PARKS IN THE CITY OF MENDOTA HEIGHTS AND IMPOSING PENALTIES FOR VIOLATION THEREOF." Councilman Losleben seconded the motion. Page 491 February 18, 1975 HEARING -- Mayor Huber opened the meeting for the purpose of a hearing LEXINGTON HIGHLAND on proposed sanitary sewer, watermain, street, curb and gutter EAST AND WEST and storm sewer improvements to serve the area known as Lexington Highland East and West. Mayor Huber turned the meeting over to the City Engineer and Public Works Inspector for an explanation of the proposed project. Public Works Inspector Pearson gave a brief history of the proposed project, and stated that hearing notices had been mailed to the property owners to be affected by the proposed project and had been published in the official newspaper. Engineer Kishel stated that it is proposed to construct sanitary sewer, watermain, storm sewer, street and curb and gutter improvements in the area known as Lexington Highland East and West. It is also proposed to construct sanitary sewer on a portion of Victoria Road. He stated that sanitary sewer and water lines would be constructed on Marie Avenue from Lexington Avenue to Lilac Lane and that after the construction is completed, Marie Avenue would be reconstruc- ted to its present condition. He listed the estimated costs of the project as follows: sanitary sewer, $14.50 per foot; watermain construction, $11.11 per front foot; sewer service connection, $200 to $250 each, watermain connection, $250 to $300 each; street, curb and gutters, $13.00 to $13.50 per front foot; storm sewer, $.07 to $.075 per square foot. Mayor Huber asked for questions or comments from the audience. Mr. Carroll Small, 1789 South Victoria, requested information about how the sanitary sewer and water assessments would affect his property at Lilac Lane and Marie Avenue. Several residents expressed concern aoubt how the construction would affect Marie Avenue. There being no further questions or comments from the audience, Mayor Huber stated that anyone objecting to the proposed project should list his name and objection on a sheet provided by the City Clerk or should submit a written objection to the City offices. PETITION FOR The Council acknowledged receipt of a petition for public IMPROVEMENTS improvements to serve the area known as Cherry Hills Second Addition. Page 492 February 18, 1975 Mayor Huber moved the adoption of Resolution No. 75-18, "RESOLUTION DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT." Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 WARRIOR DRIVE' The Council acknowledged receipt of a feasibility study for the extension of Warrior Drive. Several members of the audience expressed concern over the possible safety hazard at the intersection of Marie Avenue and Warrior Drive extended. Mrs. Phyllis Steuve, 642 Callahan Place, suggested that the alignment be moved easterly onto the School District property so that Warrior Drive would intersect Marie at a safer point. She suggested that a copy of the report be submitted to the Superintendent of Schools for discussion and study by the School Board prior to approval of the feasibility study. Mayor Huber directed that a copy of the feasibility report be submitted to Dr. Anderson for School Board comments. FINAL PLANS, City Engineer Kishel presented and explained for the Council BACHELOR AVENUE the final plans and specifications for the Bachelor Avenue/ Lansford Lane improvements. After a brief discussion, Councilman Losleben moved the . adoption of Resolution No. 74-19, "RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR BACHELOR AVENUE AND LANSFORD LANE IMPROVEMENTS (IMPROVEMENT NO. 74, PROJECT 7) ." It has had preliminary endorsement by all of the governmental boards and councils involved. Final approval will be acted on, as appropriate, after the public hearing of Monday, March 10, 1975. The cost of the project Is to be borne totally by the School District, the City of Mendota Heights, and the City of West Saint Paul, and will not be assessed to the property owners. The design seems to be the mini- mum acceptable solution in terms of safety and effect on the environmental makeup of the area. If you wish additional -information prior to the meeting, please call my office or the appropriate official in any of the effected governmental units. MINNESOTA 55433 TELEPHONE: 612.437.3191 EXT 29 . Dakota County has completed its survey of Delaware Avenue (C.S.A.H. 63 ) from T. H. 110 to Emerson Avenue. We have evaluated several options as to location and design of a bikeway - pedway to serve students and other pedestrians in this area. Our study weighed such factors as safety, environmental impact, serviceability, cost of construction, maintenance, etc. We also gave consideration as to proper location of the facility in proportion to benefits desired. We are recommending the construction of an 8 foot wide, bituminous surfaced shoulder on the west side of Delaware from T. H. 110 to Wentworth Avenue and on the east side of Delaware from Wentworth to Emerson. This width will be adequate to accommodate both bicycles and pedestrians as well as provide a space for emergency parking of automotive vehicles. The west shoulder location is preferred since the high school is located on that side; the students approaching from the west who wish to use the walk -way will not have to cross the road; a majority of students approaching the school from the east, reside north of Wentworth Avenue and must cross Delaware at some location, therefore the safest crossing is at Wentworth where they wil I have the protection of a 4 -way "thru stop" intersection; the east side of Delaware north of Wentworth has been constructed with a boulevard over a good share of it's length and is readily adaptable to walk -way construction, furthermore, the only homes in this area are on the east side of the county road; the construction encroachment is about the same on either side of Delaware south from Wentworth; the tree and shrubbery removal is minimal with one clump of 5" Elm and a bush on the west side south of Wentworth or no trees but 55 lineal feet of hedge at three locations on the east side of Delaware. Dr. R. D. Anderson . Page 2 December 18, 1974 We have estimated the cost of the 8 foot bituminous surfaced bikeway -walkway with a G" gravel base to be approximately $ 30,000.00. This assumes a small ( $ 2,000 - $ 4,000 ) allowance for construction easements or retaining walls. County policy identifies walkways as local service and not eligible for county financial participation even though we recognize the need to separate pedestrian -bicycle traffic from vehicular transportation. I believe this relatively small expenditure has a very high benefit potential,, especially since the burden of cost does not fall on one community. I am confident that the Board of County Commissioners will give their approval to the construction of the walk- way on county highway right of way as soon as you submit your request to the Board. This project should begin in the early Summer so that.it can be completed well before Fall term in 1975. County staff has prepared plan drawings for your use in explaining the proposed project to abutting property owners and other members of your official communities. Huber Mayor, City of Mendota Heights 750 South Plaza Drive Mendota Heights, Minnesota 55120 HAND ^Uy W Dear Mayor Huber: In Jim Losleb'en's report of December 6, 1974, which was presented on December 6, there were six items on page three that were discussed. I would like to comment on items 1, 2, 4, 5, and 6. Item 1 As agreed, I wrote to Don Blaisdell concerning specifications and prints on the water system. In his answer of December 27, 1974, he said there were never any specifications but rather • set of prints, copies of which were furnished to Ed Kishel • number of years ago. He can prepare more for the city if they cannot be located. Don is quite sure that the mains are Class 150 Cast Iron Pipe with Mechanical Joints. Type K copper service was also used throughout. Item 2 To the best of our knowledge, all of the complaints have been satisfied either through mechanical or chemical means. The use of Aquadene and chlorine continues as preventative maint- enance. Item 4 A program for water meter repair and calibration was started during the last half of 1974 and will continue until all meters have been changed. The water service is flushed each time a meter is removed. Item 5 No complaints of service or maintenance problems have been received by the company since October. The main break of early February was reported by phone to the city even though the police department was aware of it before the company. Sicbell CITY OF MENDOTA HEIGHTS V PLANNING COMMISSION MINUTES February 25, 1975 The regular meeting of the Mendota Heights Planning Commission was cal/led to order at 8:05 P.M., Tuesday, February 25, 1975, by Chairwoman Ridder. The following members were present: Ridder, Stefani, Schneeman, Crecelius, City Administrator Johnson and City Planner Steve Ryan. Commission members Culligan, Clemens, and Wheeler were absent. The minutes of the January 28th meeting were submitted to the members with the agenda. Schneeman moved the minutes be approved as written and Crecelius seconded. All ayes. Chairwoman Ridder opened the meeting for the election and Stefani acted as chairman, and made the motion to reelect Mrs. Robert Ridder Chairwoman for 1975. Schneeman seconded the motion. All ayes. Schneeman made the motion to reelect Lawrence Culligan as the Vice Chairman. Stefani seconded the motion. All ayes. I Chairwoman Ridder requested that Mr. Johnson appoint someone from the staff to act as Secretary to the Planning Commission. CASE NO. 74-25 - Mr. Nielsen was introduced and explained his NIELSEN Preliminary -Plat Plan for the public Hearing. The Commission questioned as to individual lot sizes and insists on a minimum of 15,000 Sq. Ft. with 100 Ft_ frontage. Mrs. McBride identified herself as a property owner of the last house in Mendota on Highway #13 bordering Mendota Heights. She questioned the run-off on the 10 Ft. easement on her property. Mr. Mikkelson identified himself as owner of property just South of the Nielsen plat. He is also concerned about the drainage, and will the filling on Lots 11 - 14 force water on to his property? Joan Meierotto explained park dedication to Mr. Nielsen and plans for the Trails Committee to secure a trail to and from Lilydale. The Commission advised Mr. Nielsen to obtain more de- tailed drainage plans from McLagen and with some revision on plans concerning 16t sizes and grading plans. They also advised consultation with Ed Kishel.. The Hearing was continued until the next meeting on March 25th. Minutes -2- February 25, 1975 Chairwoman Ridder acknowledged Mrs. McBride and other concerned neighbors who wanted to go on record as desiring access to their properties adjacent to the Riley -Bancroft Sub- division Plat. 'They were advised to return with a plan for access and egress. CASE NO. 74-20 - Mr. Sheehy explained his maps and plans for fill, SHEEHY ponding, and fencing for the MacDonald site. After some discussion, Schneeman moved to re- commend approval of the Conditional Use Permit__ subject to the followinq conditions: Stefani seconded. 1. Ponding area be graded with 3:1 slopes, fenced with 6' high chain mesh fence and shrubbery planted on outside of fence to improve appearance. Construction of the dike, overflow and trap shall be substantially as described in a Hickok report dated October, 1974. 2. Surface drainage allowed on existing bituminous parking lot, however, all drains into the pond shall be through underground piping; ie, pickup points shall be located along north side of existing lot and on proposed building site. 3. Proposed building site shall be curbed and drained to prevent any water draining directly into the existing drainage way. Fill slopes shall be 3:1, completely covered with vegetation to prevent erosion and located in such a manner so as not to interfere with existing drainage capacity. 4. Additional landscaping in the form of at least nine 2 - 22 inch green ash trees shall be added to the existing shopping center site. The motion passed with all ayes. CASE NO. 75-2 - Mr. Terry Kall'in explained his application for a variance for a side yard set -back. After a short discussion, Stefani moved that the Commission recommend the variance be granted. Crecelius seconded. All ayes. Chairwoman Ridder brought up the Surface Water Management Study, and after a short discussion with the members, it was agreed to set a date, March 11, 1975, for a special meeting with the Council to review the Study. The Subdivision Regulations. are to be discussed at the next regular meeting on March 25th. Case #75-2 In reviewing the above request, I see no real objection against the request. There is one matter, however, that I feel could be asked of the applicant. I In talking to'l,Mr. Kallin'by phone, I found that the westerly part of the house has the garage attached with the driveway to go south to 2nd Avenue. This would put the driveway only about 20 feet from the right of way for Clement Street. With the driveway this close to a corner, I feel it does constitute somewhat of a traffic hazard. I would recommend that the applicant be asked to reverse the plan on the house, putting the garage on the easterly side thereby the driveway would be a safe distance from the corner. If for good reason, the plan change could not be done., I would feel that approval would still be in order. J CITY OF MENDO`I'A HEIGHTS MEMO TO: City Council February 281 1975 FROM: Orvil J. Johnson, City Administrator SUBJECT: Roger's Lake Beach Expansion The matter�of expanding the beach has been discussed since crowded days last July and August. There seemed to be unanswered questions and allegations such as: 1. Do we have enough money? 2. The entrance road is too narrow. 3. The parking lot isn't big enough. 4. Do, in `fact, need more beach? 5. Can weafford it? Many of these questions and problems are more or less resolved now. 1. Yes, we do have enough money to construct the expansion. Funds from the Bond Issue and Park Contributions are more than adequate to buy and complete Ivy Park expansion, plus expand the beach. 2. The entrance road is being widened with various waste materials and City labor. 3. Parking is being expanded west of the pond, off of Wagon Wheel Trail with waste materials and City labor. 4. Since this is the only natural beach in the area, it seems appropriate to have a facility of adequate size, rather than a token one. 5. We can afford the expansion. Harvey is presently obtaining cost estimates that will be available Tuesday evening. We think the cost of expansion will be about $5,000.00. Additional maintenance and life guarding will be.minimal, if any. We are contemplating dredging and putting a "sand -blanket" on an additional 110 feet of beach east of the existing beach. Total width (beach and underwater) would be some 75 to 85 feet. The DNR has been contacted, insists on another application but has indicated early favorable processing, once received. Park and Recreation Committee members earlier indicated a desire to see this work done. Funding figures were just recently assembled and transmitted to Chairman Howe. The Committee, at the Wednesday meeting, discussed beach expansion, and the consensus was to proceed with expansion. The specific action recommended for March 4th is the authorization and direction to proceed with the DNR application. The construction'work should be done while the lake is frozen and before the frost goes out. In another instance, we are recommending that new streets be established to provide for better traffic circulation. In some locations, consideration will have to be given to the installation of sanitary sewers, water mains and services prior to any proposed street construction. I This report will give consideration to: 1. The proposed construction of 30 foot wide bituminous surfaced I streets with concrete curb and gutter for most all of the streets in the area as a basic plan. 2.. The limitation of street width on Laura and Brookside where construction difficulties make it more feasible to build a narrow .country style street, and on 3rd Avenue west of Clement where a 40 - foot right of way limits the street width and type. a 3. The 'proposed construction of an extension of Upper Colonial Drive in Cherry Hills to and across Vandal] Street as shown. 4. The proposed construction of Clement from 3rd to 4th Avenues and the construction of 4th Avenue from Clement to Vandall. 5. The installation of underground storm sewers where needed together, with open ditch runoff where available. 13 Mr. Oryil .1, Johnson 3 14 February 1975 As an alternate{to the above proposed construction, this report also gives consideration to the following: 1. The�lnstallation of 22 foot wide country style bituminous surfacing on all streets made a part of this project as a means of I holding'down the initial cost and resultant assessments. i 2. The+installation of limited storm sewers as needed and the use of culverts and open drainage where possible. Attached hereto are three (3) drawings which indicate: 1. Existing street and utility locations. 2. Proposed street construction, Scheme 1, utilizing basic 30 foot wide streets with concrete curb and gutter and storm sewers. 3. Proposed street construction, Scheme 11, utilizing basic 22 foot wide surface with limited storm sewers, culverts and open ditching for drainage. Discussion - Scheme 1 As shown on the attached drawing, Scheme 1 utilizes 30 foot wide bituminous surfaced streets with concrete curbs and gutters except where physical limitations prohibit this width. On those streets, we suggest a 22 foot wide bituminous street surface without curb and gutter. It is proposed by this Scheme, that where driving surfaces do not exist on platted street right of way, new streets be constructed to serve the abutting property. Mr. Orvil J, Johnson 4 - 14 February 1975 We suggest that consideration be given to the extension of Upper Colonial Drive to Clement'Street as a means of providing traffic circulation through the area. Although 'the plat maps do not show a street in this location, a 60 foot easement was acquired when sanitary sewers were installed, thus making the easement availablefor street construction. Our cost estimates and present thinking include the proposed complete construction of extended Upper Colonial Drive together with the new portions of Clement and 4th Avenues. Your attention is called to the fact that unstable ground conditions in these proposed street locations require sub -cutting and filling, and possibly should be constructed in stages using excavation, stabilized fill and a gravel base as first stage construction and after adequate settlement has been reached to be followed by concrete curb, gutter and paving two to three years later. As part of the proposed construction of Scheme 1, we have included a storm sewer system. The planned system constitutes approximately 25% of the total project.. As has been done on other similar projects, we are separating the assessment costs for streets and storm sewers. To do the street construction as shown on Scheme I drawing will require the installation of approximately 40,000 square yards of bituminous pavement, 20,000 feet of concrete curb and gutter and related items at an estimated cost of $345,000.00. With approximately 15,300 feet of assessable frontage available, the unit assessable cost is estimated to be $22.60 per foot. Storm sewers are estimated to cost $107,000.00. With approximately 2,150,000 r Mr. Orvil J, Johnson 5 14 February 1975 1 square feet of assessable property within the project drainage district, the unit assessable cost comes out to $0,05 per square foot. The total financing cost for Scheme I is $452,000.00. Because of a proposed mixture of street types, it is estimated that those streets which receive 22 foot country style construction will be assessed at a lesser rate, approximately $10.00 to $12.00 per front foot. Discussion - Scheme II Scheme II proposes basic 22 foot wide country style street surfacing on all streets in the area including the proposed construction of completely new streets on existing right of way as shown on the attached drawing. It proposes limited storm sewer piping and utilizes open ditches and culverts I for surface water runoff. To do street construction as shown on the attached drawing for Scheme II, will require the installation of approximately 30,000 square yards of bituminous surfacing and related construction for an estimated cost of $242,000.00 including fees and contingencies. With an estimated 15,300 feet of assessable frontage available, the unit assessable cost will be approximately $16.00 per foot. 1 Earlier, we commented on the need to consider the installation of sewer and water extensions together with several connections where none exist and where new pavement will be installed. Such extensions and service install- ations can be done in a normal manner with average construction costs and Mr. Oryil J, Johnson - 6 14 February 1975 assessments, At this time we estimate an assessment rate for sanitary sewers to be $12.00 to $14,00 per foot, water mains $11,00 to $12.00 per foot, and sewer and water services at about $250.00 to $300.00 each. Obviously there can be several combinations of construction types and assessable costs depending upon a determination of just what work will be ordered. To determine this, we suggest a work session with the Council and then a public hearing should be established to get input from all interested parties. With some sort of a directive as to what type of construction might be wanted, and in what location, it will then be possible to determine more accurate cost and assessment figures. The proposed 30 foot wide bituminous streets with curb and gutter and underground storm sewers is the ideal method to use. The 22 foot country style streets with culverts and open ditches is the minimum suggested method. The estimated unit assessable costs as indicated above appear to be in line with recent projects of a similar nature. i The area under discussion is developing steadily and requires upgraded streets. A project of this nature is needed and is feasible. It is herewith recommended that the Council take steps to initiate a project by conducting such hearings as are necessary to authorize a project.
