Minutes of the Annual Board of
Review Held Tuesday, June 26, 1973
Pursuant fo due ca11 and notice thereof, the Villaqe Council, ViZZage of
Mendota Heights held its annual Board of Review meeting at the Village
Ha1Z, 750 South P.Zaza Drive, Saint Paul, Minnesota.
The meeting was called to order by Acting Mayor Lockwood at 8:00 o'clock P.M.
The following memi�ers were present: Acting Mayor Lockwood, Councilmen Wahl
and Losleben. Mayor Huber and Councilman Gutzmer notified the Council that
they wouZd be unab.Ze to attend.
The Dakota County Assessor's office was represented by John J. O'Too1e,
Gordon Daggett and Thomas Kirer. The Count� Assessor's records were
opened for review.
Acting Mayor Lockwood, as Chairman of. the Board of Review, turned the
meeting over to Assessor John J. O'Too1e. Mr. O'TooZe gave a presentation
of the various increases that the County was to adjust for the year .
of 1973. The County Assessor had increased the real estate valuations for
Mendota Heights by 10�, but the Z972 State Legislature passed laws whereas
there would be an increase of onZy 5� for 1973 and 5� for 1974. The
County Assessor had to reassess aI1 properties in Dakota Count� at the 5�
levy and send out new notices to a1.Z residents. If the 5� increase appZied
in 1973 has not reached the Assessor's estimate of market value he can add
another 5� or fraction thereof in 1974. Mr. O'Toole recommended that those
residents who had any questions on their valuations present their
app.Zications at the County Court in Hastings, Minnesota.
Councilman Losleben moved the Council to approve the following abatements
as recomrnended by the County Assessor:

on real portion from $5,400 to $3,600.
Kodicor, Inc. Court case tried in Nennepin County found

to be assessed as personal property.

Pursuant to due ca11 and notice thereof, the regular meeting of the
Village Council, Village of Mendota Heights, was held at 8:00 o'clock
P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights,
Minnesota. .
Acting Mayor Lockwood called the meeting to order at 8:00 o'clock P.M.

a modification in park site development plans
for the Rogers Lake site until Ju1y 17.
The Council acknowledged receipt of the
June 26 Planning Commission minutes.
PLANNING COMMISSION Application for subdivision of property Zocated
CASE NO. 73-4, north of the Mendota Elementary School to
KOPP Marie Avenue. Mr. Chuck Mertensotto presented to
the Council a combined preliminary plat for
Lexington Highland East (Kopp) and Lexington Highland West (Gearman).
Councilman Wah1 stated that the matter of grades and 1ot eZevations should
be referred to the Village Engineer.
The Council also questioned whether the proposed dedication of land to the
Vi.Zlage is of appropriate value in view of the fact that the 1.4 acre
Kopp dedication and the 3.44 acre Gearman dedication is spread over a Zong
strip of land along Marie Avenue which would primarily serve as a buffer area
and which would need a considerable arr�ounf of maintenance. Park Commission
Cha�.rman Stefani stated that the property miqht be more of a liability to
the Vi1.Zage than an asset because of the maintenance costs.
The Council was also concerned that a11 the Iots in the Kopp plat might not
be 15,000 square feet and pointed out that each of the lots must be
15,000 square feet on the final p1at.
Councilrr�an Gutzmer moved that the matter be referred to the Village Engineer
and the Parks and Recreation Commission for further study and report.

Building Inspec�or Bjorklund stated that the test could and should have been
taken prior to his applica�ior�. Councilman Wah1 stated that the previously
established polic� should be enfoxced. '
Aeting Ma�ox Lackwoad asked Mr. BjorkZund to inspect the ,job Mr. Bireh has
begun and Mr. Bjorklund stated that a heating inspector from St. Paul and the
gas �nspector wauld have to do the inspection. Acting Mayor Lockwood directed
Mr. Bi,�ch to make whatevez� preparations are necessary to take the license
test and to bring ta the CounciZ evidence of his competencz� as a heating
contractor.

Power Natural Gas -
Late in 1970, Northern Sfiates Power informed municipal governments
where they hold gas franchises that the company was going to raise the
rates to consumers. Most municipal councils allowed the rate increase
to become effective, since the alternative was a costly ($80,000 to
�100,000) rate case.
While the conununities did allow the increase, there was a realiza-
tion that if enough communities joined together under the Joint Powers
Ac� tl�at as a grnup ttie eommuniti�s coul� effec�ivel� gathex �acts and
malce infnrmal decisions regarding rates and other regulatory issues such
as use of public rights-of-way ax�d priority of sales. Also at this tiine
of energy crisis the collective communities coulci become an interested
party in matters of gas supply to Nortllern 5tates Power by Northern
Natural Gas Company and other suppliers.

In early 1971, the cities of Roseville, North St. Paul, Maplewood,
New Brighton, White Bear Lake, Stillwater, Winona and St. Cloud formed a
study group to pursue the possibility of establishing the Minnesota Gas
Rate Regulatory Board. After a year's study, the hiring of legal counsel,
Crawford, Anderson & 0'Connor, 211 Stassen Office Centre, 33 East ��7entworth
Avenue, West St. Paul, Minnesota 55118, and the firm of Touche Ross and
Company, 780 Northstar Center, Minneapolis, Minnesota 55402, as the Board's
utility rate consultant, the communities listed above did by Joint Powers
Agreement establish the Minnesota Gas Rate Regulatory Board. The success
of.the Suburban Rate Authority in Hennepin County and the difficulty of
creating effective state utility controls were important considerations
in the establishment of the Board.
The next undertaking of the Board is to negotiate a"common" or "master°'
franchise between member governments and Northem States Powero
It is important to the ultimate success of our efforts that all the
communities in Minnesota served by Northern States Power gas are aware of •
the Board's activities and are participating in the Board's activities.
A�unding Agreement has been executed with Northern States Power and
it is anticipated that most, if not all, of the Board's activities will be
financed by cash advances from the company which will be later recovered
through revenues genarated in member communities.

We estimate that approximately 33% of the construc�ion cost is due to oversizing and

Mendota Hei Qhts f',oad
The upgrading of i1endota Heights Road in the vlcinity of the Industrial Park has
been petitioned for. A logical segment should extend from S.T.H. 55 to High��Jay 13.
The proposed upgrading will consist of 4vldening the existin, 24 foot driving sur-
face to 44 fee-t, placement of concrete curb and gutter, increasing the struc�tur�l
strength of the driving surface by placing additional bituminous ba.se and bitumin-
ous vrearing course at�d doing other related rrork. To do the proposed work will cost
approximately $i23,�00.d0, including fees �nd contingencies. 4Jith approximately
8492 feet of potenti�� assessable frontage, vre estimate the unit assessaf�le cos�
to be �14.00 or $15.00 per foot, if assessed 1Q0%.
The matier of whether state aid �'unds are availabl� or should be made available is
something for the Village Counci1 to determine. First stac,�e construction of Me�dota
Heights Road was paid for hy State /',id funds exre�t for �2.50 per foot paid by ch�
adjacent properties. An added cost of $14.00 to $15.00 per foot is still a reason-
able assessment cost for the type af street being furnished. l�Je recommend �hat the
entir� cost of upgrading ;"�ndota Neights Road be assessed against the adjacent
assessuble property.
T�e above projects, and they may be considered separately, are needed, are feasible
and are herewith recc�mrnended for construc�tion. In that there are several property
o4vners involved, ���e recommend thai tN7e Council take action to establish a public
hearing on the matter.
