Y��• F: 't t� 97- r; VILLAGE OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, July 17, 1973 Pursuant to due call and notice thereof, the regular meeting of the Village Council, Village of Mendota Heights, was held at 8:00 o'clock P.M. at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Losleben, Wahl, and Gutzmer. Councilman Lockwood arrived late. - APPROVE Councilman Wahl moved approval of the minutes of MINUTES the June 26 Board of Review. Councilman Losleben seconded the motion.. Ayes: 4 Nays: 0 Councilman Losleben moved approval of the minutes of the July 3, 1973 meeting. Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 JOINT MINNESOTA The Council acknowledged receipt of a letter from the GAS RATE Joint Minnesota Gas Rate Regulatory Board. REGULATORY BOARD Village Administrator Johnson stated that appartenly there are some differences between this concept and the electric franchise and requested that the matter be tabled until August 7 so that a Board member may appear at that meeting. The matter was tabled until August 7. Councilman Lockwood arrived at 8:05 P.M. ROGERS LAKE The Council briefly discussed the final plans and LEVEL CONTROL specifications for the Rogers Lake Level Control project. The Council pointed out that a stilling pond will be constructed in Friendly Marsh, the pond level to be 832.0 and the level at the bottom of the pond to be 829.0. The Council stressed the point that the area to be disturbed around the pond will be reseeded and the area will be,kept mowed and maintained for safety and visibility purposes. Mayor Huber moved the adoption of Resolution Number 73-54, "RESOLUTION ORDERING CONSTRUCTION OF DRAINAGE SYSTEM AND LAKE LEVEL CONTROL SYSTEM FOR ROGERS LAKE TOGETHER WITH DITCH CLEANING AND STILL POND CONSTRUCTION (IMPROVEMENT NO. 72, PROJECT NUMBER 4)." Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 Councilman Gutzmer moved the adoption of Resolution Number 73-55, "RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS FOR CONSTRUCTION OF DRAINAGE SYSTEM AND LAKE LEVEL CONTROL SYSTEM FOR ROGERS LAKE TOGETHER WITH DITCH CLEANING AND STILL POND CONSTRUCTION (IMPROVEMENT NUMBER 72, PROJECT NUMBER 4)." M.l ti•YI ixe'1:'1:V Minutes -2- July 17, 1973 Councilman Losleben stated that something should be done about the problem of runoff waters from the Mendota Plaza. Village Administrator Johnson was directed to study the situation and make a recommendation to the Council. CHANGE ORDER NO. 1 Mr. Larry Ritenour and Mr. Lee Starr, Park Planners, PARK IMPROVEMENT were present to request approval of a change order PROJECT to the park improvement project to allow for modification: in the depth of the inlet and channel in the Rogers Lake Park. -It was pointed out that the change order would not involve any additional cost. I Councilman Losleben moved the approval of Change Order Number one for Park Improvement Project No. 2. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 LILYDALE LAW SUIT Village Attorney Winthrop stated that a tentative settlement on two parcels involved in the boundary dispute between the Village of Mendota Heights and Lilydale has been reached. The two parcels of land are located on Lexington Avenue and are owned by Inland Construction Corporation. As part of the settlement, the parcels of land can be developed only for single family or multiple dwelling (four-story condominium) use and that no more than 49 units can be built on either of the two parcels. Under the terms of the agreement, the Village must state that it will dismiss the lawsuit with prejudice and gives up any claim to jurisdiction over the two parcels. Mayor Huber moved the adoption of Resolution Number 73-56, "RESOLUTION AUTHORIZING SETTLEMENT OF LILYDALE LAW SUIT.' Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 INLAND CONSTRUCTION Village Attorney Winthrop stated that Inland COMPANY Construction Company has requested that they be allowed to hook onto the Village's water system to service the two parcels of land owned by Inland and located on Lexington Avenue. He further stated that a resolution should be adopted expressing the Village's intent to service the property and authorizing the Village Engineer to prepare a proposed assessment figure. Councilman Gutzmer moved the adoption of Resolution Number 73-57, "RESOLUTION AUTHORIZING INLAND CONSTRUCTION CORPORATION TO CONNECT TO THE VILLAGE MUNICIPAL WATER SYSTEM." Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 POLICE DEPARTMENT The Council acknowledged receipt of the Police MONTHLY REPORT Department monthly report for June, 1973. BUILDING PERMITVillageVillage Clerk -Treasurer Radabaugh stated that ALBERT HANSON Mr. Albert Hanson, 1595 Wachtler Avenue, has applied for a building permit to construct a new home at his present address, with the intent of moving or razing his present home after the new home has been completed. The Council directed the Village Attorney to prepare a letter for Mr. Hanson's signature stating that the present structure will be moved•or.razed-when the new home is Feady for occupancy and further stating that the new home will be hooked up to the sanitary sewer system. Minutes -3- July 17, 1973 PLANNING AND The Council acknowledged receipt of the June,.1973 DEVELOPMENT Dakota County Planning and Development Newsletter. NEWSLETTER CORRESPONDENCE The Council acknowledged receipt of a letter from the League of Minnesota Municipalities regarding policy and legislative committees. TUMINELLY, INC, Mr. Carmen Tuminelly was present regarding the exterior VICTOR COMPTOMETER surface and screening around the air conditioning unit on the Victor Comptometer Building. The Council also acknowledged receipt of a letter from Mr. Tuminelly regarding this matter. Mr. Tuminelly promised the Council that the building will be surfaced with stucco -type material and the mechanical unit will be screened by the end of July. SOMERSET "19" Mayor Huber directed Mr. Tuminelly and Mr. Bream to appear at the July 24 Planning Commission meeting to request a variance for the parking lots at Somerset "19" and for approval of the landscape and planting plans. BIRCH COMPANY HEATING The Council acknowledged receipt of five letters LICENSE (presented by Mr. Birch) as evidence of his competency as a heating contractor. Mr. Birch stated that three of the letters were written by suppliers and two are from clients. Mayor Huber questioned whether the recommendation of a supplier would be a valid testimonial to Mr. Birch's competency. Village Attorney Winthrop stated that the Village ordinances require that an applicant for a"license must satisfy the Council that he is competent in his field. He also pointed out that with regard to heating licenses, the Council has in the past made it a practice to require that the applicant pass the test given by a Class A city as proof of competency., Building Inspector Bjorklund stated that the heating inspector from St. Paul and Frank Eha, the gas inspector, had done an inspection on a house on Dodd Road in which Mr. Birch is installing a heating unit. The inspectors indicated that a letter would be forwarded to the Village on the results of the inspection; however, no letter has been received to date. The Council pointed out that at the July 3 meeting, the Council had requested that Mr. Birch make arrangements to take the license test and that he submit letters of proof of competency to the Council. Mayor Huber moved- that the Birch Company application for a heating license be denied. Councilman Gutzmer seconded the motion. Councilman Gutzmer moved the adoption of Resolution Number 73-58, "RESOLUTION ACCEPTING ENGINEER'S REPORT AND CALLING FOR HEARING ONIPROPOSED CONSTRUCTION OF AN EXTENSION TO THE VILLAGE WATER DISTRIBUTION SYSTEM, SANITARY AND STORM SEWER SYSTEM AND STREET, CURB AND GUTTER IMPROVEMENTS TO SERVE PROPERTIES ABUTTING ON MENDOTA HEIGHTS ROAD FROM STATE TRUNK HIGHWAY NUMBER 13 TO STATE TRUNK HIGHWAY NUMBER 55 AND TRANSPORT DRIVE FROM MENDOTA HEIGHTS ROAD TO PILOT KNOB ROAD (S.A.R. This established four-year Council terms and two-year Mayoral terms. Option No. 2-- Adopt the Uniform Electio�. i,aw for odd-year el�ctions. This is not possible for 197�,.election bu�'can be enacted in 1974 ,by ordinance,�bnly. (Ninety day waiting perioc�.af�er ordinance adoption, public refe�endum only if petitioned.) This metl��od provicles for two-year Mayor term and four-year Council terms. This is unfler Uniform Election Law M.S.A. 205.20. I believe this would require an election in 1974 because of inapplicability to apply during the year it's enacted. Opti.on No. 3-- M.S.A. 412.022 provides for odd-year election by public referendum. This specifies - four-year term�s for both Mayor and Councilmen. .` Option No. 4-- The new la�a also provides for selecting odd-year elections as outlined on bottom of page 2 of the LMM Bulletin. According to the I�eague, an Ordinance could be adopted after January 1, 1974 establishing odd-year elections, without public referendum. Councilmen to have four-year terms, Mayor to continue at two-year terms. This would mean conventional 1973 election and presumably a 1974 election. b � f f � Election Options -2- August 10, 1973 Conclusions By doing nothing, we will end up with even-year elections and three people being elected every even year, namely the Mayor at every election and two Councilmen at every election. Odd-year options allow us to select either a two-year Mayor scheme or a four-year Mayor'scheme. Obviously if two-year terms are selected for the Mayor, there will be three offices expiring each election and three people would be elected each time. If the four-year Mayor scheme is selected, this requires a public referendum (via 412.022) and results in two positions at one odd-year election and three at the next. Questions: Do you want even or odd-year elections? If the answer is odd-year elections, do you want two or four-�ear Mayor terms? These various options are for your determination. There may be some transitional problems, namely the length of time needed to arrive a� such a scheme, but they are available either by ordinance or referendum. The dedication of and the acceptance of the proposed green space for Village use will cause financial problems when assessments for street and utility improvements are made. A total of about 1900 feet along Marie and Lexington are involved. 6. It appears that municipal sanitary sewers cart be provided to all parcels in the proposed plat but adverse street grades in some places may cause deeper than normal construction. 7. Water service can be made available to all parcels but numerous dead end streets with cul-de-sacs will cause dead end lines or the need for easements over private property to close loops. 8. Control of surface water runoff is going to be difficult to maintain. It appears that proposed street grades slope to the cul-de-sacs where water will be trapped. This means possible easements over private property to dis- pose of surface waters or the dedication of publicly owned corridors to serve the same purpose. 9. To properly install utilities on Marie Avenue, it will be necessary to grade Marie to fit future proposed grades. This will entail a considerable amount of grading and will open up some potential surface water problems. 10. The preliminary development plan submitted indicates some potential street grades. These grades appear to conform with existing ground levels so that grading can be minimized. This applies to all streets except the easterly one on the Kopp portion which will have some heavy cutting to meet proposed Marie Avenue. 11. The proposed plat has its share of cul-de-sacs which are always a problem in the case of snow removal. 12. Summit Lane, running south from Overlook Road, will enter onto Marie Avenue about 80 feet east of where the easterly -street in the Kopp portion buts into Marie Avenue. -This means an offset of streets on what might be a busy thoroughfare when Marie Avenue is developed. The development of a roadway along the easterly property line of the Kopp parcel might make for a more logical extension southward into and through school property. , The above are a few thoughts put together with respect to the proposed plat. Apparently through some mistake of mine, it was mislaid. However, I will answer your letter broken down into three segments as you have listed them: Segment No. 1: We will approve the construction of the 36 feet wide street face a curb to face a curb with restrictive parking. We will not consider stage construction as outlined in you letter. We feel that the problem of erosion on the side of the proposed bituminous surface would be to intensive and cause to many main- tenance problems. Segment No. 2: We will approve a 44 foot width street face a curb to face a curb. Segment No. 3: On this section, we will also approve a 44 foot width street. Ed Kishel, responses to Mayor Huber's letter of July 13, 1973. You will note that Mr. Pay has authorized a 36' wide roadway for Marie Avenue between Delaware Avenue and Dodd Road, but is insistent on a 44' roadway between Dodd Road and Lexington Avenue. At the same time, Mr.. Fay states that "We will not consider stage construction as outlined in you (sic.) letter. We feel that the problem of erosion on the side of the proposed bituminous surface would be to (sic.) intensive and cause to (sic.) many maintenance problems." Obviously Mr. Fay has overlooked the fact that we do not now have any erosion problems on the existing 30' roadway. The fact that the black - topping of the present roadway will create "intensive" erosion, is, at the very least, presumptuous and not at all likely, if even possible. Also,note that in Mr. McFadden's letter (second to the last paragraph) projected. "traffic of 1500-2000'VPD" (vehicles per day) is his "valid" rea- son for denying a roadway of less than 44 feet. This projection of 150Q- 2000 vehicles per day was apparently made in 1965 by Mr. Kischel to justify inclusion of Marie Avenue as part of the Municipal State -Aid Street system. The estimated traffic count is not based on any known facts. There is not nor has there ever been a traffic study authorized, taken, completed, pro- jected or considered in the proposed "improvement" that would justify any improvement to accommodate any projected additional vehicular traffic on Marie Avenue. Let's look at the facts involved in the present proposed "improvements" to Marie Avenue: .1. State law declares that any village, city, township, etc., with a population of over 5,000 is entitled to participate in the Municipal State - Aid Street fund. 2. In late 1965, the Village of Mendota Ileights had a population of 5,028 and thereby qualified as a participant in the Municipal State -Aid Street fund. 3. In 1965, in order to claim its share of the fund, the Village Council declared that Mendota Heights Road (from Highway 13 to Highway 55), Marie Avenue (from Delaware to Lexington), and Wachtler Avenue (from Marie Avenue to Wentworth -a non-existant street) were to be the Municipal State Aid Streets in Mendota Heights. Please keep in mind that this action by the Village Council took place nearly eight years ago. Also in 1965, the Village Council convinced the State that an I -35E overpass at Marie Avenue was required because, among other things, of the projected traffic ofJ500 - 2000 vehicles per day. At the same time the Village Council promised the State that Marie Avenue between Lexington and Dodd Road would be completed within five years of the final approval of the I -35E --Marie Avenue grade level which was approved in 1965. Late in 1965 a State Aid Road Construction bond issued in the amount of $175,000 was completed, but construction of Marie Avenue between Dodd and Lexington was never started nor has it been started at this date, 8 years later. Therefore, in order to show the State (which is responsible to the Federal Government for construction of the I -35E overpass) that Marie Avenue is finally being improved, the Village Council has decided to start the "improvement" on Marie Avenue between Delaware and Dodd Road. Justification by the council for this "improvement" is the projected 1500 - 2000 VPD estimate made back in 1965. In review of these facts, I suggest that there are a number of different approaches that could be taken in lieu of accepting the 36' street: 1) If the Council were to complete Segments #2 and #3 .first (Dodd Road to Lexington Avenue), take a valid, professionally conduces traffic count that would verify the 1500 - 2000 VPD projec�ion, we would certainly have no objection to a 36' street between Dodd and Delaware. 2) If Mr. Gordon Fay or his associates could prove to us that stage construction would result in "intensive" erosion, we would certainly abandon our request for stage construction. 3) If the State Highway Department conducted an environmental impact study that proved to us that the rural atmosphere of our area would not be injured or fatally destroyed, we would willingly accept an extensive roadway improvement. If the Village Council chooses to igncre any or all of the: above alternatives and votes in the 36' street as proposed, I personally am willing to seek a temporary court injunction to prevent the proposed con- struction until all three of the above items are completed to our complete satisfaction. Please be aware that the "standard M.S.A. appurtanceSiR5 referred to in Mayor I-Iuber's letter to Mr. Fay have never been explained to us, no have we•received the Council's decision on storm sewer installation. We have also not been told whether we are to be assessed for the additional width to meet M.S.A. standards (remember Orville Johr..son recommended an assessment 2 -of $15 per front foot including the use of State Aid funds). For unknown reasons the Council Meeting scheduled for Tuesday, July 31st, was put over until Tuesday, August 7th, at which time this project 73-1 will most likely be discussed. If you do not want to accept the 36' wide street, M.S.A. appurtanantces, anp` unknown assessment policy, and most likely a storm sewer system, I respectfully suggest that you attend the August 7th meeting to voice your personal opinions.
