Minutes of the Regular Meeting
Held Tuesday, August 7, 1973
Pursuant to due call and notice thereof, the regular meeting of the Village
Council, Village of Mendota Heights, was held at 8:00 o'clock P.M. at the ,
Village Hall, 759 South Plaza Drive, Mendota Heights, Minnesota.
Acting.Mayor Lockwood called the meeting to order at 8:05 o'clock P.M.
The following members were present: Acting Mayor Lockwood, Councilmen Wahl,
Gutzmer and Losleben. Mayor Huber had notified the Council that he would
be late.
APPROVE Councilman Wahl moved approval of the minutes
MINUTES of the July 17 meeting. Councilman Losleben
seconded the motion.

LEE'S FLOOR AND Mr. Jim Lee, of Lee's Floor and Janitor Company,
JANITOR COMPANY and Mr. Carmen Tuminelly requested Council
consideration of their proposal to construct
a building to house Lee's Floor and Janitor
Company. The Council acknowledged receipt of a memo from Village Rl:anner
Jim Ruone on the proposed building.
Mayor Huber arrived at 8:16 o'clock P.M.
• Mr. Tuminelly stated that the building would be a one-story structure with
no basement and would be located on the Kirchner property adjacent to the
Fire Hall.
Mayor Huber directed that the matter be referred to the Planning Commission.
FINAL PAYMENT, Councilman Wahl moved the adoption of Resolution
IMPROVEMENT NO. 72, Number 73-59, "RESOLUTION ACCEPTING WORK AND
PROJECT NO. 7 APPROVING FINAL PAYMENT (IMPROVEMENT NO. 72,
PROJECT NO. 7)," approving the final payment
certificate in the amount of $579.55 to Robert W. Moore Company.
Councilman Losleben seconded the motion.

TAX ABATEMENTS County Assessor John O!Toole was present to
request approval of tax abatements on the

Councilman Gutzmer moved that an abatement be granted to Henry Rosenberger
for Parcel #26178B1a, reducing from $6,800 to $559 taxes payable in 1973.
Mayor Huber seconded the motion.

The Council referred the balance of the -requested abatements back to the "
County for reconsideration. r
MARIE AVENUE The Council acknowledged receipt of a letter
IMPROVEMENTS from Mr. Robert Maher, 646 W. Marie Avenue,
regarding proposed Marie Avenue improvements.
The Council aslo acknowledged receipt of letters from Mr. Gordon Fay, State
Aid Engineer and Mr. D.R: McFadden, District State Aid Engineer.
Mayor Huber stated that the letter from the State Aid officials indicate that
a 36' width from Dodd Road to Delaware Avenue would be approved but that
stage construction will not be approved, and that the requested 36' width
from Dodd Road to Victoria will not be approved. Mayor Huber briefly answered
the ques tions in Mr. Maher's letter.
Mayor Huber directed that a work session be scheduled for Monday, August 13 at
7:30 P.M. in the Village Hall to discuss M.S.A. financing, and requested that
the proposed Marie Avenue improvements be tabled until the August 21 meeting.
ZONING ORDINANCE Village Attorney Winthrop stated that the final
draft of the revised Zoning Ordinance has not been
completed and requested that the matter be postponed until the August 21 meeting.
KOPP/GEARMAN PLAT The Village Council acknowledged receipt of
letters from Village Engineer Kishel and Park
Commission Chairman Stefani regarding the Kopp/Gearman park donation.
Village Administrator Johnson stated that Mr. Kopp and Mr. Gearman had not been
notified that this matter would be discussed at this meeting. Mayor Huber
directed that the matter be tabled until August 21 and that Mr. Kopp and
Mr. Gearman should be notified that the matter will be discussed at that time
and should be given copies of the reports.
METROPOLITAN LEAGUE OF The Council acknowledged receipt of a notice of
MUNICIPALITIES MEETING a Metropolitan Legislative Study Group No. 4
meeting to be held on August 8 at 6:30 P.M. at
the Golden Steer. The Council delegated Village Administrator Johnson to be
the Village representative at this meeting.
ACTION PLAN Village Administrator Johnson stated that the
NEWSLETTER Minnesota Highway Department has sent to the Village
office a copy of an Action Plan Newsletter which
states that an informational meeting on the Highway Department decision making
and planning processes will be held at the State Office Building Auditorium on
Tuesday, September 4 at 7:00 P.M. The Council directed that the newsletter be
sent to Mrs. Kathy Ridder.
MARIE AVENUE PARK SITE Mayor Huber acknowledged receipt of and read a
letter from Mr. Stanley E. Karon and a petition
from 57 residents of Highland Heights stating that the pond being constructed
within the Marie Avenue Park site is unsafe and requesting that the pond be
removed or safely fenced. I
Mayor Huber requested that Park Commission Chairman Stefani call a special

Commission meeting to give the residents a background on the park
improvements and suggested that the Commission review the plans to see
if the construction of the pond is still valid and to see if a solution
can be found.
Park Commission Chairman Stefani stated that a preliminary meeting will be
held with the Village Engineer ofi August 9 and Councilman Losleben stated
that he would be present at that meeting.
PARK COMMISSION The Council acknowledged receipt of a letter
MISCELLANEOUS from Park Commission Chairman Stefani in response
to Mr. Calvin Floerke's letter requesting that
snowmobile and cycle trail systems be included in the Park improvements.
Mayor Huber directed that a copy of the letter be sent to Mr. Floerke.
PLANNING COMMISSION The Council acknowledged receipt of the
MINUTES July 24 Planning Commission minutes.
PLANNING COMMISSION Councilman Lockwood moved that a 6' sideyard
CASE NO. 73-18, HANZEL variance be granted to Mr. Charles H. Hanzel,
1970 Knob Road, so that Mr. Hanzel can construct
a garage. Councilman Losleben seconded the motion.

EAGLE RIDGE Request for approval of construction of three
townhouse units. Building Inspector Bjorklund
stated that the Council has previously approved the site plan and concept and
has :given permission to do the excavation. Mayor Huber stated that the easements
for Marie Avenue have not been received from Carmen Tuminelly as yet and
directed Mr. Bjorklund to notify Mr. Tuminelly that the Village will stop the
excavation unless the easements are received within a week.
PUBLIC Mr. Henry Rosenberger was present to discuss
the feasibility of servicing the undeveloped
property north of Somerset School and west of Dodd Road with Sanitary Sewer
and water.
BIRCH COMPANY Councilman Wahl moved that the license fee
in the amount of $25.00 submitted by the Birch
Company as an application fee for a heating license be refunded since the
application has been denied. Councilman Gutzmer seconded the motion.

SPRING COMPANY Mayor Huber directed that the Spring Company
SIGN PERMIT application for sign permit be referred to the
Planning Commission.
REQUEST FOR WATER The Council acknowledged receipt of a letter
SERVICE from the Village of Lilydale requesting water
service for the Colony Apartments and Colony
Town Houses located in Lilydale. Mayor Huber directed that the Village Engineer,
Village Administrator and Village Attorney calculate a connection charge.
CHANGE ORDER NO. 2, Mayor Huber moved the approval of Change Order
SOMERSET NO. 2 No. 2 for Somerset No. 2 (Improvement No. 72,
Project No. 6) in the amount of •$1,990.00.

Resolution No. 7360, "RESOLUTION CALLING FOR
HEARING ON PROPOSED REMOVAL OF UNSOUND AND DISEASED TREES," with a hearing
set for September 4 on the removal of dead and diseased trees in the Ivy.

HOUSE MOVING ORDINANCE Village'Administrator Johnson stated that
a proposed house moving ordinance is being
prepared for Council approval.
ROGERS LAKE OVERFLOW Councilman Gutzmer moved the adoption of
PROJECT -- MINNESOTA Resolution No. 73-62, "RESOLUTION APPROVING
HIGHWAY DEPARTMENT COOPERATIVE CONSTRUCTION AGREEMENT WITH MINNESOTA
AGREEMENT HIGHWAY DEPARTMENT." Councilman Losleben
seconded the motion.

MISCELLANEOUS Councilman Lockwood stated that '
Mr. & Mrs. William Russ have a potential buyer 4
for their property on Wachtler Avenue and would like to know the feasibility of
constructing sanitary sewer along the property. Mayor Huber directed that ;
Village Administrator Johnson contact the potential buyer to see if the buyer
would be willing to bear the cost of the installation of sewer. k;
SOMERSET 19 The Council directed Village Administrator Johnson '14
to check the east (blacktopped) parking lot at 's
Somerset 19 to see if -it conforms with Village ordinances.
HOHENSTEIN APPEAL Village Attorney Winthrop stated that District
Court has sustained the assessment levied against
the Karl Hohenstein property (Improvement No. 70, Project No. 5).
EARNEST MONEY CONTRACT Mayor Huber moved the adoption of Resolution a
No. 73-64, "RESOLUTION AUTHORIZING PURCHASE OF
SHAUGHNESSY-YOUNG PROPERTY," in the amount of $16,700. Councilman Gutzmer ;

The following sections of the proposed Village Zoning Ordinance have been
discussed by both the Village Attorney pnd the Village Planner as to whether
or not they should be deleted from the Ordinance altogether. Because many
Of these sections being questioned are of a policy nature, they are be ing
presented at this time for the Council's consideration.
1. Pages 27 and 28, Section .4;16

The purposes of this section are to proyjde fpr development (residential,
commercial and industrial) in areas throughout the Village where public
sanitary sewer and water are not gyailable. This section provides basic
guidelines for developers intending to build in areas of the Village which
do not have public sanitary sewer and water. The question was raised as
to whether there was any area within the Village where deyelopment would
be allowed without public sanitary sewer and wgter. If such development
would not be allowed, is this section required?

In the preparation of this section of the proposed Toning Qrdingnce, the
Planning Commission requested the option of holding a public hearing qn any.
request for the issuar?ce of a conditional use permit, This gdditional hearing

Many of you have expressed an interest in attending the annual Congress of Cities
meetings sponsored by the National League of Cities in San Juan, Puerto Rico,
December 2-6, 1973 and have asked if group or charter arrangements could be arranged
through the League.
After a thorough study, we feel we have come up with the best possible arrangement.
The rates listed below are for affinity groupings (any group organized for a purpose
other than that of travel) of at least forty individuals. If forty people do not
agree to participate in the affinity plan, it cannot be offered. Any individual
occupying a seat will pay the price quoted below. Children under two years may
travel free but no seating space will be reserved for them. Any municipal official
and/or that person's family are eligible to participate.
Because of the heavy air traffic to San Juan during December, flexible schedules
and dates were difficult to acquire. The flights listed below represent the best
dates and route schedules available. For purposes of comparison, the regular air
'are is $285,26 -

Many of you have expressed an interest in attending the annual Congress of Cities
meetings sponsored by the National League of Cities in San Juan, Puerto Rico,
December 2-6, 1973 and have asked if group or charter arrangements could be arranged
through the League.
After a thorough study, we feel we have come up with the best possible arrangement.
The rates listed below are for affinity groupings (any group organized for a purpose
other than that of travel) of at least forty individuals. If forty people do not
agree to Participate in the affinity plan, it cannot be offered. Any individual
Occupying a seat will pay the price quoted below. Children under two years may
travel free but no seating space will be reserved for them. Any municipal official
and/or that person's family are eligible to participate.
Because of the heavy air traffic to San Juan during December, flexible schedules
and dates were difficult to acquire. The flights listed below represent the best
dates and route schedules available. For purposes of comparison, the regular air
are is $285.26.

PAYMENT -(PROJECT ONE - PARK SITE DEVELOPMENT)
WHEREAS, pursuant to a written contract signed with the Village
of Mendota Heights on June 13, 1972, El Mac Landscaping Inc. of Anoka,
Minnesota has satisfactorily completed the improvement of Project ;
One, Park Site Development in accordance with such contract;
NOW THEREFORE IT IS HEREBY RESOLVED by the Village Council of
the Village of Mendota Heights that the work completed under said
contract is hereby accepted and approved; and

and approved for movirig by the Village Building Inspector. No
building moving permit shall be granted if the Village Building
Inspector determines that any of the following conditions exist:
a. The building, hause.or structure proposed to be moved
is too large to move without endangering persons or property
within the Village.
b. The building, house or structure proposed to be moved
is in such a state of deterioration or disrepair or is too
structurally unsafe that it cannot be moved without
endangering persons or property within the Village.
, c. The applicant's equipment proposed to be used in
moving such building, house or structure is unsafe and persons
or property within the Village would be endangered by its
use.

� d. Any of the requirements of t}�is ordinance have not
been complied ti►ith.
Section 4. Duties of Permittee.
a. The person to whom a building moving permit is granted may move
such building, house or structure covered by such permit only on the
day or days and during the hours specifically set forth in the
building moving permit. Any change in such date or hours mus� be
approved by the Village Building Inspector in writing. Vil�age
Police Department and Public Works Department shall be notified at
least 24 hours before moving commences.
b. While moving any such building, house or structure upon, across
or over any street, alley or public place, there shall be displayed
thereon appropriate warning lights, red flags and the like as to
show the extreme height and width of such building, house or structure.
ca Al1 rubbish and materials shall be removed from the original
building site of suah building, house or structure and the
excavation at such original site must be filled to existing grade
so that such premises are left in a safe and sanitary condition.
d. All foundation structures on the original site of such
building, house or structure shall be removed to a depth of
18 inches below the finished grade of the lot. The requirements
of this subsection must be�completed within five days after
such buil.ding, house or structure is moved but in all cases,
until such work has been completed, an appropria�e barricade
shall be placed around a11 excavation and the area must otherwise
be maintained in a safe.condition.
Section 5. Performancs Bond. Before a building moving permit
sha�l be issued, the-applicant ust provide the Village with a performance
bond in form satisfactory to the Village guaranteeing that
the applican� will promptly complete construction of the house,
building or structure so mov�d so that the same will meet all of the
provisions of the Village building code as well as any other applicable
ordinances of the Village. Such perfarmance bond sha11 be in an amount
equal to 150 per cent of the cost as determined by the Village Building
Inspector necessary to cover•the construction of such improvements. The
improvements of said building, house or structure shall include but
sh�ll not be limited to the following:
a. Painting. Painting all exterior walls, doors and door
frames, windows and window frames as required by the Village
Building Inspector.
b. Roofing. Install or cause to be installed new roofing
whenever in the opinion of the Village Builda_ng Inspector
the existing roof is unsightly, dilapidated or leaking.
c. Gutters. construct, install or cause to be installed
adequate roof gutters and downspouts upon such building, house or
structure. .
d. Grading and Sodding. Install or caus� to be installed a
finish grade on all parts of the premises onto which such
buildingP house or structure is moved including the planting,
or installation of live sodding on a11 parts of the plot or
parcel involved.
e. Landscaping. Install or cause to be installed proper °
landscaping upon the premises onto which such building, house
or structure is moved of a type and nature comparable to the
landscaping in �he immediate neighborhood of the lot or property
to which such building, house or structure is moved.
f. Drainage. Construct and provide all necessary and proper
drainage upon the property upan which such buildin�, house or
structure is to be situated in accordance with a plan submitted
by the applicant and approved by the Village Building Inspector.
g. General Construction. Update and improve all plumbing, hea�ing
and elec�rical equipment to meet then current speci�ications as set
forth in the Village Building Cade as well as other applicable
ordinances.
Section 6, No building moving permit shall be issued under the
provisions of this ordinance unless and until the building inspector
is satisfied that the build�ng, house or structure proposed to be
maved conforms to the general character and type of architecture
consistent with the immediate neighborhood of the 1ot or property to which �
said building, house or structure is praposed to be moved. No building�
house or structure shall be moved within the corporate limits of the Villa
of Mendota Heights except by a house mover duly licensed under the
provisions of Ordinance Na. 37 of the Village.

Section 7. Should any section, clause or provision of this
ordinance be declared by a court to be invalid, the same shall not
affect the validity of this ordinance as a whole or any part thereof
other than the part so declared to be invalid.
Section 8. Penalty. Any person violating any provision of this
ordinance shall be guilty of.a misdemeanor and shall upon conviction
thereof be punsihed by fine of not more than $300.00 or imprisonment
for not more that 90 days.
Section 9. This ordinance shall be in full force and effect
from and after its passage and publication.

MSA permits the following options on elections:
Option No. 1 -- Even year elections as per the new
law. This established four-year
Council terms and two-year Mayoral
terms. It is effective with the 1974
election. It means a conventional
election process this fall and results
in extending term of office for)

will prevail if we do not make some
other selection.
Option No. 2 -- Adopt the Uniform Election Law for
odd -year eljections. This is not possible
for 1973.4alection bg.t' can be enacted in
1974 ,bytordinancq-6nly. (Ninety day
wailing perio4, after ordinance adoption,
-public referendum only if petitioned.)
This method provides for two-year Mayor
term and four-year Council terms. This
is under Uniform Election Law M.S.A. 205.20,
I'Iielieve this would require an election in
1974 because of inapplicability to apply
during the year it's enacted.
Option No. 3 -- M.S.A. 412.022 provides for odd -year election
by public referendum. This specifies !I
four-year terms,for both Mayor and Councilmen.
t' Option No. 4 -- The new laza also provides for selecting
odd -year .elections as outlined on bottom
of page 2 of the LMM Bulletin. According
to the League, an Ordinance could be adopted
after January 1, 1974 establishing odd -year
elections, without public referendum.
Councilmen to have four-year terms, Mayor
to continue at two-year terms. This would mean
conventional 1973 election and presumably a
1974 election.

Conclusions
By doing nothing, we will end up with even -year elections and
three people being elected every even year, namely the Mayor at
every election and two Councilmen at every election.
Odd -year options allow us to select either a two-year Mayor
scheme or a four-year Mayor'scheme. Obviously if two-year terms
are selected for the Mayor, there will be three offices expiring
each election and three people would be elected each time.
If the four-year Mayor scheme is selected, this requires a public
referendum (via 412.022) and results in two positions at one odd -year
election and three at the next.
Questions:
Do you want even or odd -year elections?
If the answer is odd -year elections, do you want two
or four-year Mayor terms?
These various options are for your determination. There may be some
transitional problems, namely the length of time needed to arrive at
such a scheme, but they are available either by ordinance or referendum.
I was in error on previously discussed options. Lesson: don't
practice law or interpret legal language. The foregoing options are
the result of conversations with LMM personnel and I believe are
correct.
