Minutes of the Regular Meeting,
Held Tuesday, October 2, 1973
Pursuant to due call and notice thereof, the regular meeting of the
Village Council, Village of Mendota Heights was held at 8:00 o�clock P.M.
at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The
following members were present: Mayor Huber, Councilmen'Lockwood,'Losleben,
Wahl and Gutzmer.
APPROVE Councilman Lockwood moved approval of the
MINUTES minutes of the September'18 meeting."
Councilman Losleben seconded the motion.
Ayes: 5 Nays: 0
FINAL PAYMENT Councilman Wahl moved approval of the final \payment
CERTIFICATE certificate for the 1973 Seal Coating project to
the Allied Blacktop'Company in the amount of
$11,765.37. Councilman Gutzmer seconded the, motion. -

MENDOTA PLAZA DRAINAGE Mr. Cy Sheehy was present toydiscuss drainage
problems caused by runoff from the Mendota Plaza
Shopping Center (continued from September 18). Mr. Sheehy stated that he has ,
contacted the Minnesota Highway Department relative to highway construction
which would affect his property and that the highway department has indicated
that there are no definite plans for construction prior to 1984. He further
stated that he is now planning to further develop the shopping center property.
Mr. Sheehy stated that he will return to a future Council meeting with plans
for a land fill complete with elevations and pipe sizes for a drainage system.
MISCELLANEOUS Mr. Tom Condon, 2511 Dodd Road, was present to
request permission to move an accessory building
from property located at the intersection of T.H. 49 and T.H. 55 to his
property located on Dodd Road, the building to be used for storage.
Village Administrator Johnson stated that Mr. Condon should apply for a building
moving permit so the Village staff can determine what would be involved in
relocating the building. The Council directed that this be handled on an
administrative level.
ALFONSO,.-- Mr. Dominic Alfonso, 697 So. Freeway Road, was
CONDITIONAL USE PERMIT present to request renewal of a.conditional use permit
to house pigeons in his garage (granted
September 5, 1972).

Councilman Lockwood moved that the conditional use permit granted to
Dominic Alfonso on September 5, 1972, allowing Mr. Alfonso to house
100 to 150 racing pigeons in the upper half of his garage, be renewed
for.one year. Mayor Huber seconded the motion.
Ayes: 5 Nays: 0
CORRESPONDENCE The Council acknowledged receipt of the
August, 1973 Dakota County Planning and
Development Newsletter.
The Council acknowledged receipt of a letter from School District 197
regarding a recent meeting of School District, West St. Paul, Mendota
Heights and Dakota County officials on pedestrian traffic on Delaware
Avenue. Village Administrator Johnson stated that 'the letter indicates
that school district officials have formally requested a study of the matter
by Dakota County.
LEAGUE OF MINNESOTA Village Administrator Johnson outlined a meeting
MUNICIPALITIES notice received from the League of Minnesota
MEETING NOTICE municipalities on regional meetings to be held
on October 3 and October 10.
REQUEST FOR SANITARY The Council acknowledged receipt of a letter from
SEWER AND WATER Mr. Lyall Devereaux, 1633 So. Victoria, requesting
that the Village service his home in Li . lydale with
sanitary sewer and water. I
Mayor Huber directed the Village Attorney to study the request to determine
whether the extension of sewer and water to this property would jeopardize
the Village's position in the property dispute between Mendota Heights and
Lilydale.
MISCELLANEOUS Mayor Hulf r stated that he has received a letter from
the Dakota County Administrator requesting that the
Council appoint a Village resident to be a member of a committee charged with
the responsibility of determining a good use for the present County Courthouse
after County operations are moved to the new facility.

Mayor Huber asked the Councilmen to submit names of candidates to the Village
Administrator.
PARK COMMISSION MINUTES The Council acknowledged receipt of the minutes
of the August 22 Parks and Recreation Commission
meeting.
PLANNING COMMISSION The Council acknowledged receipt of the minutes of
MINUTES the September 25 Planning Commission meeting.
PLANNING COMMISSION Mayor Huber pointed out that the Planning Commission
CASE,#73-14, CLAYTON recommended denial of the application for subdivision
of property located at 525 Mears Avenue.

Mayor Huber moved that the application for subdivision of property be
denied. Councilman Lockwood seconded the motion.
Ayes: 5 Nays: 0
PLANNING•COMMISSION Councilman Wahl moved that the application of the
CASE #73-20, SPRING Spring Company.for a sign (with channel letters) to
COMPANY be located in the Mendota Plaza be approved.
Councilman Losleben seconded the motion.
Ayes: 5 Nays: 0
SQUAD CAR Village Administrator Johnson stated that he has
received a memo from Police Chief Baldwin requesting
that the Village start the process for purchasing two squad cars for the
Police Department for 1974. Mr. Johnson outlined the procedure for th e Council.
Mayor Huber asked if any discussion has been held with the Police Chief regarding
purchasing the squads without going through the bidding procedure, hopefully
ending up with more suitable squads. Village Administrator Johnson stated that
` State law allows informal bids for purchases up to $5,000. Mayor Huber directed
the Village Administrator to begin the procedure for purchasing the;cars and
that he will contact the Administrator relative to finding alternatives to the ,
present purchasing procedure.
REVISED ZONING Village Administrator Johnson gave a brief background
ORDINANCE on the proposed revisions to the Zoning Ordinance.
He resubmitted to the Council a memo from Village
Planner Jim Ruone outlining five issues which need to be resolved prior to
Council adoption of the revised Ordinance (the memo was originally distributed
on August 21). Following are the five issues and the Council's resolution of
the issues:
1. Pages 27 & 28, Sec. 4.16: Are there any areas within the Village
,. where development would be allowed without public sanitary sewer
and water'-- if such development would not be allowed, is this
s. section required? It was the determination of the Council that
Sec. 4.16 should be deleted, which would allow the Council to
permit, by variance, development in areas which are not serviced
by public sanitary sewer and water.
2. Page 34, Sec. 5.6(4) Planning Commission Notice and Hearing on
Application for Conditional Use Permit: Should notices of Public
Hearings on Conditional Use Permits held by the Planning Commission
be published (in'addition to publishing similar notices of hearing
held by -the Village Council) in the legal newspaper? The Council
determined that the provision calling for publication of Planning
Commission hearing notices should be deleted. -
3.' Page 37, Sec. 5.7(5) Publication of Planning Commission Hearing
Notice on Rezoning: (same question as issue two). The Council
determined that the provision requiring publication of the
Planning Commission hearing notice should be deleted.

4. Page 41, Sec. 7.1(4) Permitted Uses in "R-1" District:
Does the Village want the right to store maintenance equipment,
trucks and materials in "R" districts without limitation?
The Council directed that "excluding storage of maintenance
equipment and trucks over 1� tons, stockpiling of aggregate
and open storage of material, but including fire fighting
apparatus" be deleted.
5.• Page 42, Sec. 7.2(7): Does not allow accessory structures
(other than private garages) within an "R" district except
as a conditional use. Should the ordinance allow accessory
structures up to a specific size? The Council directed that
this section be revised to allow accessory structures
up to 8 by 10 feet or 80 square feet in size.
Mayor Huber moved that a public hearing to consider the adoption of the
revised Zoning Ordinance be held at 8:00 o'clock P.M., November 6 and
directed the Village Attorney to publish the notice of hearing.

PURCHASE OF Village Attorney Winthrop stated that in the
PROPERTY process of examining the title to the
Shaughnessy/Young property it was discovered that
they do not have clear title to .18 acre of the property. He further stated
that he has suggested to the owners that $1,.000 be deducted from the proposed
$16,700 purchase price and that the contract be amended to deduct the .18 acre
with the provision that the owners will make every effort to gain clear title
to the .18 acre and if this is accomplished before December 31, 1975 the owners
will convey title to said property to the Village for a purchase.price of
$1,000.
Councilman Lockwood moved the adoption of Resolution No. 73-75, "RESOLUTION
AUTHORLZIJ]G AMENDMENT TO SHAUGHNESSY/YOUNG PURCHASE AGREEMENT." Councilman Loslebe
seconded the motion.

Council, be and are hereby allowed and the Mayor and Clerk -Treasurer of the
Village of Mendota Heights are hereby authorized and directed to issue Village
checks in payment of said claims.

Responses
We -have received a total of fourteen complaints and objections to
the assessments considered on October 9. You have received all but two
of those complaints, the later two letters are attached to this memo.
I have categorized the complaints by subject matter for your consideration.
Your further discussion of these complaints and objections may be
based upon Ed Kishel's written responses, and the thoughts and
recommendations included in this memo. It would be my suggestion that you
consider the several policy matter issues at the October 30th meeting and
then invite the several groups in for special discussion purposes either
at a special meeting between October 30 and November 6 or set aside some
time on November 6th for the supplemental hearings. There appears to.be
two major issues involved, one being the consideration of storm sewer
assessments west of Dodd Road between Lake Drive and Bluebill and the
second being the assessment of street and curb and gutters on the south
side of Bluebill where previous street surface was in place. The
following review and recommendations are submitted for your consideration.
I. STORM SEWER ASSESSING WEST OF DODD ROAD.

Letters From Curtiss E. Coates and John Lapakko were recently received,
hence are included for your consideration for the first time. Letters
-from Ron Smith and John Lapakko and their particular issues will be discussed

later, hence will not be considered in this particular section of the
memo.
-Simply stated, the six complainants questioned the advisability
of including their area which allegedly does not drain into the storm
sewer system. The allegation may be correct to a certain degree, however,
there is noquestion but what the area falls within the natural watershed
district. There is considerable precedent and much past practice
justifying the inclusion of natural drainage areas in special drainage
districts. If one were to carry this argument to the extreme, a land
owner could object to a storm sewer assessment because in fact he had a
two-inch depression in the middle of his back yard, despite'the fact that
in general his property drained to the storm sewer catch basins.
You will note in Ed's letter (handed out on October 16) that the low
area can be drained with a minimal amount of modification. I believe that
some of the people indicated their desire to drain (or fill, meaning the
same end result) the area to improve their rear yard conditions. This
of course,will involve additional dollar outlay on the part of the
property owners and will of course have to be coordinated amongst the
property owners. Most normal storm sewer systems do not include design
and underground facilities to drain rear yards, hence this is no unusual
situation. If one is to succumb to these objections, a precedent would be
set, making it virtually impossible to levy storm sewer assessments
because of objections of a similar or lesser nature. I recommend that the
assessments remain as proposed and adopted.
Ron Smith's objection to having Lot 18 included in the assessment
district has been orally withdrawn. See Ed's letter (A-1). Ron Smith has
indicated that he will not pursue his objections to having Lot 18
included.
II. STREET, CURB AND GUTTER ASSESSMENTS ON SOUTH SIDE OF BLUEBILL.
Letters have been received from the following people concerning
street assessments:

Erwin Sell, 2330 Rogers Avenue
Frederick Hughes, 2333 Rogers Avenue
This issue revolves around the allegation that the people south of
Bluebill did in fact pay for a permanent bituminous street prior= to the
Rogers Lakeside East construction. They therefore feel that they should
not be re -assessed for street improvements. It is alleged that at the
feasibility hearing they were promised that only a 25% charge would be
made for curb and gutter construction. An excerpt from the feasibility
hearing minutes on June 20, 1972 reads as follows:

"Village Engineer Ed Kishel stated that those persons
presently being assessed for street improvements will
be assessed for one-fourth of the length of their lot

for the addition of curb and gutter because of the
added benefit they will be receiving."
In view of the feasibility hearing minutes and considering that the cost
of'the street, in fact, had been paid for via previous projects, it does
seem incongruous that the total street assessment including curb and
gutter should be re -assessed against those four lots (see Ed's letter
dated October 16, 1973'and handed out on October 16). I believe that
'
a commitment had been made at the hearing indicating that only curb and
`
gutters would be assessed, hence recommend that the rather minimal fees
shown in Ed's response be levied. That is curb and gutter at $3.38 per
foot assessed against 25% of the side yard -length.
III.' SOMERSET II.
The several requests by Herb Schechter were discussed at the field '
meeting on Thursday, October 18. It is recommended that the storm sewer'
assessments be corrected and changed to reflect the exclusion of the three
lots east of Sutton and north of Marie and that the total storm sewer
assessment be reduced by $1,950 as agreed bn October 18.•' The allegation
concerning the $250 water service connection charge was satisfactorily
explained to Mr. Schechter. '
IV. HOWARD HINTERTHUER.

Coleshire despite the fact that he does have a garage and driveway off of

V. O.C. WAKEFIELD.
This oral complaint has been acknowledged (see A-3) The corrections
have been made and it is recommended that the Council formally adopt the
change for said assessment, namely $885.00 instead of $909.60.
VI JOHN LAPAKKO.

See four-page letter attached. As to Part One of his letter, my
response is that his land is no better or no worse than other land
(regardless of who owns the land) hence there is overwhelming reason to
assess at the same rate. There are undoubtedly other reasons for

justification: there would'be much danger in using a different rate or 3•
ending up with assessments that are different from those levied on other
'
lands abutting Cheri Lane. Part Two: John lists five items and they are
addressed as follows.

'1. Cost overrun. This matter has been quite thoroughly
discussed and little more can be said. Ed's response
(see A-4) includes some additional response. I

this matter.
2. Storm sewer assessment. Ed partially answers this
matter. There is very little doubt but what future
development of the area will involve drainage to
the street and into the storm sewer system. If any
changes were to be considered, possibly the north
boundary of the storm sewer district should be moved
southerly to the mid -point of the lots (in other words,
assess only the front half of the lots north of Cheri
Lane. This matter should possibly be discussed, but
I would recommend that the rear lot line be retained
as the north boundary because of consistency in
establishing drainage"districts both.now and in the
future.
3. Assessment formula. John alleges that his Lot 34
(see Ed's drawing) is substandard therefore should
not be assessed.. The net area of Lot 34 plus a small
northwest corner of Lot 35 amounts to well over ,
18,000 square feet, hence from a size standpoint, is
more than adequate. His allegation that a variance
would be needed for the lot width is correct and I
would caution that the assessments and "buildability"
of the lot be considered at the same time. A lot
of the size and shape represented by the remaining +
portion of Lot 34 certainly is developable and should
be treated as such., You will please note that no
storm sewer assessment has been levied against the
small triangular portion of Lot 35, hence there can
be no argument on this point. The small triangle does
of course add slightly to the total value of Lot 34.
There is considerable precedent for averaging the
front and rear lot lines of Lot 34 and any deviation
from Ed's formula would only add assessing problems
in the future. Therefore I recommend that -Lot 34
assessments remain as proposed and adopted.
4. Feasibility study. All costs of improvements,
including the feasibility cost must be assessed.
*5. Return of property to pre -construction condition.
Ed addresses this matter and has assured me that
both the condition of the property and lot corners
will be returned to pre -construction condition.
In conclusion, John,as a relatively large land owner, must bear
his respective portion of the costs. We obviously are not assessing John
Lapakko. The assessments (and benefitting improvements) accrue to the
land and therefore the land value is increased regardless of ownership.
The entire philosophy of special assessments is based on the premise that

improvements such as these add to the benefit of property, hence must be
assessed in as fair,and equitable manner as possible throughout the
confines of the project. I see no basis, no reason, no rationale for
changing assessment rates. Only contests and arguments from other
property owners could result by arriving at a differential assessment rate.

Gentlemen:
This letter is to question the accuracy of my assessment on the above
project. I have discussed this with Mr. Kischel and fully understand
the mechanics of how the cost was calculated.
1. My front street (Dorset) was assessed as the sum of front
length plus back length divided by 2 times $8.85/LF. In my case
this is the sum of (90' + 120') divided by 2 equals 105 LF.
At various hearings prior to the initiation of this project, I
was always advised that corner lots were assessed at the per
lineal foot rate times front length plus 1/4 of side length, not
times average front length plus 1/4 side length.
2. Early during the project, a memo was received from Mr. Johnson
of the Village regarding drives. In essence it stated that drives
would be stubbed 3' into adjacent properties as part of street costs;
and the remainder from 3' to property lines would be assessed at a
per square foot rate, with work beyond the property line to be by
homeowners' personal arrangements.,
Shortly thereafter, further instructions were received from the
Village, stating that due to the problem of numerous sizes of
entrances involved and related problems of billings, only a 3'
entrance stub was to be included with the street improvements.
Further work both to and beyond property lines was to be done by
private arrangements with the contractor.
The contractor subsequently prepared and distributed individual
estimates.

around them to pre -construction condition. My driveway which prior to this
time had a culvert to release water to the holding area east of nay driveway
# under it now no longer has a culvert (buried by contractor). The entire
area -of my driveway into the street is nothing like that area before the project
was started.

Dear Mr. Johnson:
The denial of o permit for proposed canoe channel work of the Rogers Lake
park site by the Department of Nnfunu} Resources (based upon the fear of
setting a precedent for o|in*|ng increased riparian access to public waters
and the opinion that alternative canoe serving facilities could be easily
developed) coupled with DNR granting of a permit for beach improvements
of Rogers Lake has generated the need for counoi!mmnic consideration of
changes in the scope of construction of this pork.
The following modifications have been developed by the landscape orchi4e~+
for this project and have been reviewed by the Village Park Commission.
Basic changes include the elimination of the canoe channel, channel wall,
and turning basin of Rogers Lake and improvement of the existing channel
to function as n grassed drainage way connecting one of the park's inferior
ponds to Rogers Lake. Proposed beach improvements include the removal of
offshore submerged vegetation and the replacement with sand of the muck
bottom in o portion of the swimming area. The following itemizes the pro-
posed n|forofions in the Rogers Lake pork development program. Detailed
costs associated with these changes will be available of the council meeting
on October |b.

MINUTES
The regular meeting of the Mendota Heights Planning Commission: was
called to order at 8:10 o'clock P.M., Tuesday, October 23, 1973 by
Acting -Chairwoman Ridder.
The following members were present: Ridder, Stewart, Culligan and
Schneeman. Also present: Village Planner Jim Ruone and Village
Administrator Orvil J. Johnson. Absent: Stringer, Clemens and Ljungkull.
APPROVE Minutes of the September 25 meeting had been
MINUTES submitted with the agenda. Culligan moved approval
of the September 25 minutes, seconded by Stewart.

REVIEWAL OF VILLAGE Excerpts of the October 2 Village Council meeting
COUNCIL ACTION minutes regarding planning matters were read by
Administrator Johnson. The minutes indicated that
the Village Council concurred with the Planning Commission recommendation on
Case No. 73-14 in denying the application for subdivision of property. The
minutes also indicated that the Village Council concurred with the Planning
Commission recommendation, approving the new sign for the Spring Company to be
located on the Mendota Plaza facade.
CASE NO. 73-19, Mr. John Thompson was present to discuss the requested
LILYDALE GRAND changes in the proposed parking lot. He presented a
CENTRAL CORP. memo listing nine items. The Planning Commission noted
that the parking lot shall be limited to fifty parking
stalls rather than the sixty as indicated in Mr. Thompson's memo. After
further discussion, Culligan moved: Recommend approval of the variance, allowing
off-street parking across the street from a'principal use, with the folio;:i:g
stipulations: 1.) surfaced space to allow for fifty parking stalls; 2.) dense
plantings (screening) be placed between the parking lot and T.H. 13 to
discourage indiscriminate pedestrian crossing of T.H. 13; 3.) a sign, within
the ordinance requirements, be placed at the north end indicating employee
parking only; 4.) lighting standards similar to those at Economics Lab. be used
for parking lot lighting; 5.) Mr. Thompson to furnish the Village with a copy of

CASE NO. 73-7, Chairwoman Ridder noted that the hearing was now called
PERRON REZONING to consider rezoning of the lots south of Marie Avenue
and north of Callahan Place, in particular the Lots 15-21
inclusive and Lots 28-33 inclusive, Willow Spring Addition. Mr. Richard Grayson,
representing Mrs. Perron, described the request, noting that the original request
was for a lot subdivision submitted in March, 1973. He asked that the noticed

property be considered for R-1 zoning because of past events which have
allowed the area to be developed at a density very similar to the R-1
zoning. Mrs. Perron indicated she knew of no one who would object to the
proposed zoning. Mr. Nicholas Cheesebrow and Councilman_ Wahl supported the
rezoning.
Village Planner Ruone discussed the background including a reviewal of the
1959 comprehensive plan, noting that the existing zoning is somewhat
different than proposed in the comprehensive plan. Administrator Johnson
noted that although the mailed notices were incorrect, and several home
owners indicated that they did not receive a notice, the Village Council
would hold another public hearing to further consider the matter and at that
time correct mailing list and notices would be mailed. He also suggested
that the Planning Commission consider a bigger area than the area included in
the petition.
After further discussion, Stewart moved: recommend that the Village Council
rezone the area included in the petitioned area and that a larger and more
comprehensive consideration for rezoning be continued at a later date.

CASE NO. 73-25, Mr. Bernard Friel was present to explain the history

LCS COMPANY Mr. John Lyons was present to discuss a proposed
ADDITION expansion of his manufacturing plant at 1480 Sibley
Memorial Highway. He noted that he was anxious to begin
construction and did want the Planning Commission to be aware of his expansion.
He was advised that the Village Council issues.building permits for commercial
and industrial expansion after the plans have been reviewed for ordinance
conformance. He was also advised to complete his drawings, in particular the
plot plan, and submit them for staff approval prior to the Council meeting on
November 6.
COMMUNICATIONS 1.) Minnesota Highway Department response on I-35E-
T.H. 13. Mr. VanWormer's letter dated September 25 was
acknowledged. After a short discussion, the Planning Commission requested the
Village Administrator to acknowledge Mr. VanWormer's letter and.advise him
that the Commission is still waiting for the promised report.
2.) Park and Recreation Commission letter dated October 2. A letter from
Chairman Stefani was acknowledged concerning the Park Commission's
recommendations on subdivision of property south of Marie Avenue east of I -35E.
The Park Commission was commended for taking the special interest in this
matter and it was also noted that no formal application for a subdivision has
been received at this time.
3.) The August, 1973 Dakota County Planning And Development Newsletter was
received and acknowledged.

RESOLUTION ACCEPTING DEVELOPER'S WORK ON
SOMERSET II AND RELEASING CONTRACT BOND
WHEREAS, Lassco, a general partnership, was desirous of
subdividing and developing a certain plat known as Somerset II; and
WHEREAS, said plat was approved on November 21, 1973;
and
WHEREAS, Lassco on the above mentioned date entered into an
agreement providing for the grading, installation of storm sewer
facilities, construction of a ponding area and dike, placing of
black dirt over the entire area and seeding the area, all in the
interests of surface water control, soils protection and elimination
of erosion; and
WHEREAS, Lassco, through the Travelers Indemnity Company,
provided a contract bond for $20,000 dated November 22, 1973
guaranteeing completion of the agreement details; and
WHEREAS, on October 18, 1973 the Village Council members field
inspected the platted area, observing that all details contained in
the agreement had been faithfully completed;
NOW THEREFORE IT IS HEREBY RESOLVED by the Village Council of
the Village of Mendota Heights that the members of Lassco are to be
commended for the completion of surface water control and soils
protection practices in Somerset II; and
BE IT FURTHER RESOLVED that the Village Council hereby accepts
the construction work performed by the developers as a completed project;
and
BE IT FURTHER RESOLVED THAT the aforementioned contract bond be
released since all work has been completed.

SOILS PROTECTION Chairwoman Ridder asked Village Planner Jim Ruone
ORDINANCE to advise the Commission as to the status of the Soils
Protection Ordinance. Ruone gave a short historical
account noting that a formal response and opinion from Attorney Winthrop has
not been received. It was noted that Attorney Winthrop is presently
concentrating on finishing the details of the Zoning Ordinance. The Commission
members requested that Attorney Winthrop have a response and opinion on the
Soils Protection Ordinance for discussion at the next regular meeting on
November 27. Ruone is to mail out additional copies of the Soils Protection
Ordinance to the Planning Commission members.
MISCELLANEOUS Administrator Johnson reviewed past Village activities
on Dutch Elm Disease matters in response to member
Culligan's inquiry.
The December meeting is to be held on Wednesday, December 19 because of the
regular meeting falling on Christmas Day.
KATHY RIDDER -- Mrs. Ridder reported briefly on her meeting with
HIGHWAY INVESTIGATION District 9 Engineer William Merritt. It was decided
that she and Administrator Johnson duplicate some MHD
information and be prepared for a presentation at the next meeting.
