Minutes of the Special Meeting
Held Tuesday, October 30, 1973
Pursuant to due call and notice thereof, the special meeting of the
Village -Council, Village of Mendota Heights was held at 8:00 o'clock P.M.
at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Acting Mayor Lockwood called the meeting to order at 8:09 o'clock P.M. The
following members were present: Acting Mayor Lockwood, Councilmen Losleben,
Gutzmer and Wahl. Mayor Huber had notified the Council that he would be
absent. '
BID AWARD -- Acting Mayor Lockwood moved the adoption of {
ROGERS LAKE Resolution No. 73-85, "RESOLUTION ACCEPTING BIDS AND
LEVEL CONTROL AWARDING CONTRACT FOR CONSTRUCTION OF DRAINAGE '
PROJECT SYSTEM AND LAKE LEVEL CONTROL SYSTEM FOR ROGER'S
LAKE (IMPROVEMENT NO. 72, PROJECT NO. 4),"
conditional upon final approval from the Minnesota Highway Department,awarding
the bid to Lametti & Sons, Inc. in the amount of $141,620. Councilman Gutzmer
seconded the motion.

The Council called for a work session on Monday, November 5 at 4:00 o'clock P.M. ,
in the Village offices to discuss the matter of catch basins on Wagon Wheel }'
Trail being included in the Rogers Lake Level Control Project.
PURCHASE OF Village Attorney Winthrop stated that he has negotiate:
PROPERTY the purchase of two easements, in connection with the

Rogers Lake Overflow Project, over property owned by ;
Muskey, Tansey and Stacker. The negotiated price for a permanent 30 foot easement

and a temporary 50 foot easement is $550. As one alternative, the owners of the
property offered to give the entire 8.27 acre parcel of property to the Village
and sell the easement to the Village for $1,500.
Councilman Losleben stated that this property could have some value as a part of
the park system and suggested that $1,000 of the price be paid from the`Park
Bond Issue, the balance to be charged against the Rogers Lake Overflow Project.
Councilman Gutzmer moved the adoption of Resolution No. 73-86, "RESOLUTION
PROVIDING FOR PURCHASE OF STACKER/TANSEY PROPERTY," in the amount of $1,500.
Councilman Losleben seconded the motion.

PURCHASE OF Village Attorney Winthrop stated that he has negotiates
PROPERTY for the purchase of 2.6 acres of property owned by
the Wachtler family and .7 acres owned by
Gustav Webber located at Wentworth and Wachtler Avenues. The purchase price
would be $9,000 for the 2.6 acre parcel and $3,100 for the .7 acre parcel. He
also stated that as part of the purchase agreement, the Village must have a
survey made, and the price will vary (based on $4,000 per acre) if the present
measurements do not agree with the survey. Another consideration of the contract ,

is that the Village must agree to deem that this purchase of property will
satisfy the required park contribution if the adjacent Wachtler property is
ever developed.
Councilman Losleben moved the adoption of Resolution No. 73-87, "RESOLUTION
PROVIDING FOR PURCHASE OF WACHTLER PROPERTY." Councilman Gutzmer seconded the
motion.

METROPOLITAN LEAGUE The Council acknowledged receipt of a Metropolitan
OF MUNICIPALITIES League of Municipalities notice of a Labor
Conference for Elected Officials to be held on

SOMERSET II Councilman Losleben moved the adoption of
Resolution No. 73-88, "RESOLUTION ACCEPTING
DEVELOPER'S WORK ON SOMERSET II AND RELEASING CONTRACT BOND." Acting Mayor
Lockwood seconded the motion.

LEE'S FLOOR AND JANITOR Councilman Gutzmer moved that the revised plot plan

dated October 17 be accepted. Councilman Losleben

EMPLOYEE ATTITUDE Village Administrator Johnson outlined a memo on
SURVEY a proposed employee attitude survey for Village
employees which would be prepared and administered
by the League of Minnesota Municipalities. The League would fund 50% of the
cost of the survey, the Village must fund the remaining 50%.
Councilman Wahl moved that the Village Administrator be authorized to enter into
a contract with the League of Minnesota Municipalities for an employee attitude
survey for Village employees. Councilman Losleben seconded the motion.

FIRE PROTECTION RATE The matter of an increase in fire protection
INCREASE rates for Lilydale, Mendota and Sunfish Lake was
tabled until the November 6 meeting.
ASSESSMENT COMPLAINTS The Council acknowledged receipt of ,letters from
R.J. Wolters, 11 Dorset Road, John Lapakko,
2295 Dodd Road and Curtiss E. Coates, 2361 Dodd Road in objection to assessments.•'t
Village Engineer Kishel stated that Mr. Wolters' objection had been taken care
of. Mr. Wolters had paid the contractor for driveway improvements and was also
assessed for the driveway improvements: the contractor has agreed to return the
$100 payment for driveway construction.
The Council discussed the assessment complaints received on the 1973 assessment
rolls and a memo from the Village Administrator regarding the complaints. A
special work meeting was set for Monday, November 5 at 7:30 P.M. in the Village

offices for the purpose of discussing the objections with the persons who

submitted letters. No contact will be made and no discussion was held on
letters received from those residents involved in a District Court Appeal on
the assessment roll for Rogers Lakeside East.
The Council directed the Village Administrator to contact Erwin Sell and
Frederick Hughes and inform them that the assessments levied against their'
`
properties would be adjusted to reflect a $3.38 per foot assessment against
25% of the side yard length of their properties (for curb and gutter
improvements). The Village Administrator was also directed to contact
R.J. Wolters, advising him that the contractor will refund $100 to him.

the Council, Councilman Losleben moved that the
meeting be adjourned. Councilman Gutzmer seconded the motion.

Pursuant to due call and notice thereof, the regular meeting of the
Village•Council, Village of Mendota Heights was held at 8:00 o'clock P.M. _S
at the Village Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The `
following members were present: Mayor Huber, Councilmen Lockwood, Losleben,

APPROVE MINUTES Councilman Wahl moved the approval of the minutes
of the October 9 meeting as corrected.

ZONING ORDINANCE Mayor Huber opened the meeting for the purpose
of a public hearing on the proposed revised g,
` Zoning Ordinance. Village Administrator Johnson gave a brief history of the
process which culminated in the proposed revised ordinance, stating that
modifications in zoning districts are not under consideration as part of the
hearing. Copies of the revised Zoning Ordinance were made available to the '..!
audience. Mayor Huber asked for comments or questions from the audience.
Mrs. Tobey Lapakko, 1671 So. Victoria, asked some general questions which
were answgred by the Council.

Meeting Held Wednesday, November 7, 1973
Pursuant to due call and notice thereof, the Village Council of the
Village of Mendota Heights, sat as the Election Canvassing Board, the
meeting was held 7:30 o'clock P.M. at the Village Hall, 750 South Plaza
Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 7:30 o'clock P.M. The
'following members were present: Mayor Huber, Councilmen Lockwood, Losleben
and Wahl., Councilman Gutzmer was absent.

Mayor Huber moved that the Canvassing Board approve the results of the
counting and canvass of votes by ballot at the General Election of the
Village of Mendota Heights held November 6, 1973. The minutes of the
Village Election submitted by the Clerk of Election showed the following

F PAYMENT (IMPROVEMENT NO. 72, PROJECT NO. 2)

WHEREAS, pursuant to a written contract signed with the Village
;of Mendota Heights on August 21, 1972, Beatson and Kelly, Inc. of
St. Paul, Minnesota has satisfactorily completed the construction of
sanitary sewer, water, street and storm sewer improvements to serve
the Pagel Road area in accordance with such contract;
NOW THEREFORE IT IS HEREBY RESOLVED by the Village Council of
the Village of Mendota Heights that the work completed under said
contract is hereby accepted and approved; and
IT IS FURTHER RESOLVED that the Mayor and Village Clerk are
hereby directed to issue a proper order for the final payment on
such contract, in the amount of $9,764.69, taking the contractor's,
receipt in full.,
