Mayor Huber called the meeting to order at 8:10 o'clock P.M. The following members were present: Mayor Huber, Councilmen Lockwood, Losleben, Wahl and Gutzmer. APPROVE Councilman Lockwood moved approval of the minutes of MINUTES the October 30 meeting with correction. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 Councilman Wahl moved approval of the minutes of the November 6 meeting with corrections. Councilman Losleben seconded the motion. PLANNING COMMISSION The Council acknowledged receipt of a letter from APPOINTMENT Planning Commission Chairman Edward Stringer in which Mr. Stringer expressed his desire to resign from the Planning Commission. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 Mayor Huber moved that Mr. Raymond Wheeler, 1426 Farmdale Road, be appointed to the Planning Commission to serve the remainder of Edward Stringer's term. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 SQUAD CAR PURCHASE Village Administrator Johnson stated that quotations have been received from three automotive dealers on the purchase of a new Police squad car. He stated that of the three bids, the bid received from,Fury Motors, Inc. for a Plymouth Satellite was the lowest and most closely met the specifications for the new squad. Councilman Lockwood moved that the Village Administrator be authorized to purchase a 1974 Plymouth Satellite (squad car) from Fury Motors, Inc. for the purchase price of $3,669.40. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 PERSONNEL RESOLUTION Councilman Gutzmer moved the adoption of Resolution No. 73-93, "RESOLUTION ESTABLISHING A PERSONNEL CODE FOR EMPLOYEES OF THE VILLAGE OF MENDOTA HEIGHTS," incorporating the changes recommended by the Village Administrator. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 SURFACE WATER The Council called for a work meeting to be held MANAGEMENT STUDY in the Village offices on November 27 at 7:00 A.M. for the purpose of discussing the Surface Water Management Study. I OUTSIDE WATER Village Administrator Johnson outlined a memo to CONNECTION CHARGES the Council regarding water connection charges I for the Inland Apartments in Lilydale and recommended adoption of a proposed resolution establishing connection charges for properties outside of Mendota Heights. Councilman Gutzmer moved the adoption of Resolution Number 73-94, "RESOLUTION ESTABLISHING OUTSIDE WATER CONNECTION CHARGES." Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 MISCELLANEOUS Councilman Gutzmer moved that Mrs. Lois King be appointed as the Village representative on the Dakota County Committee on the future Disposition of the County Courthouse. Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 FRIENDLY MARSH councilman Losleben stated that -he has received POND several requests from *Friendly Hills residents to increase the depth of the pond to more than the proposed three foot depth. He stated that this will reduce the possibility of the pond drying up and becoming'overgrown with weeds and will create a passive'park area with a wildlife habitat setting. ti •t Minutes -3- November 20, 1973 Village Engineer Kishel stated that if a change is desired, it must be determined with the contractor whether the change would be within the scope of the contract and the contractor should be notified of the change as soon as possible since work on the pond has already begun. He suggested that if the pond depth is made greater, the north shoreline of the pond should be extended, pulling the pond farther from the homes in Friendly Hills. Councilman Losleben moved that the pond be dredged to a five or six foot de pth, within the confines of the construction contract and at no additional cost, and if feasible, the pond area should be reduced in size, pulling the pond farther north and away from the residential area. VILLAGE OF MENDOTA HEIGHTS PLANNING COMMISSION MINUTES November 27, 1973 The regular meeting of the Mendota Heights Planning Commission was called to order at 8:05 o'clock P.M., Tuesday, November 27, 1973 by Acting Chairwoman Ridder. The following members were present: Ridder, Clemens, Stewart and Wheeler. Arriving after call to order were members Schneeman, Culligan and Ljungkull. Also present were Village Planner Jim Ruone and Village Administrator Orvil Johnson. Chairwoman Ridder introduced new member Raymond Wheeler to the members and the audience. She noted that Chairman Ed Stringer had submitted a letter of resignation to Mayor Huber and noted that the Council had appointed Mr. Wheeler to fill his unexpired term. Several members expressed their appreciation to Mr. Stringer for his past years of service to the Village. Stewart moved, seconded by Clemens, that a letter of appreciation be sent to Mr. Stringer. Motion carried unanimously. APPROVE MINUTES Minutes of the October 23 meeting had been submitted with the agenda. Stewart moved approval of the October 23 minutes. Seconded by Ridder. All Ayes. CHAIRMANSHIP Member Stewart moved, seconded by Clemens, that Mrs. Ridder be permanent chairwoman until the next organizational meeting. Ayes: 6 Nays:. 0 Chairwoman Ridder noted that Item number 5 on Council action would be considered later in the agenda. CASE NO. 73-22, Chairwoman Ridder noted that this was the time for PALMITESSA a public hearing to consider subdivision of the SUBDIVISION HEARING Palmitessa property fronting on Sibley Highway northeasterly of Lexington. A certified survey of one of the two parcels was presented by the Village Administrator. He noted that the remaining parcel was not completely described on the survey, leaving some doubt as to the exact dimensions and size. After some discussion, and hearing no response from the audience, Culligan moved, seconded by Clemens, that the application for subdivision be recommended for approval with the following conditions: 1) that a complete survey of the two parcels be submitted; and 2) that a variance be granted, reducing the lot width from 100 feet to approximately 98 feet for both parcels. All Ayes. CASE NO. 73-26, Mr. Simek explained his application to the Commission. SIMEK SUBDIVISION It was noted that the next meeting would be on I ` Planning Commission Minutes -2- November 27, 1973 December 19 and therefore the hearing is to be established for December 19. Mr. Simek noted that an abstractor's list of property owners will be delivered to the Village prior to December 6. Mr. James Losleben reminded the Commission members that a drijinage easement should be obtained, providing for drainage along the division line." Further details will be discussed at the hearing. INLAND INDUSTRIAL Mr. Bruce Patterson of Minnesota Valley Engineering PARK was present to explain a preliminary plat for the Inland Industrial Park. He noted that Mr. Edes had been contacted relative to the extension of Northland Drive. He also noted that the Minnesota Highway Department has granted access off the new T.H. 13 right-of-way. Planner Jim Ruone noted thAt some portions of the area had slopes as steep as 330 and 400 which may involve difficult development. The Village Administrator noted that the proposed platting was presented because of a proposed industrial building to be located on Mendota Heights Road on future Lot 1. A copy of the plat will be submitted to Engineer Kishel for his comments and Planner Ruone will review lot sizes and other zoning requirements. Administrator Johnson also noted that a 10% park contribution would be required as a condition of plat approval. Plat and staff reports will be submitted at the December 4 Council meeting. DISCUSSION OF Chairwoman Ridder noted that she had visited with MENDOTA HEIGHTS MHD District 9 officials and read a memo submitted by HIGHWAY PLANS Mr. Merritt. A copy of said memo and federal environmental requirement pamphlets were submitted to all members. The large Minnesota Highway Department map showing proposed freeways was posted for discussion purposes. After explanation of Mr. Merritt's memo, Mayor Huber was asked to further elaborate.on'Highway Department plans and their impact on Mendota Heights. Mayor Huber reviewed the many meetings he has attended in an attempt to work out reasonable plans with the Highway Department. He noted that lawsuits seem to stop construction and that he is attempting to work out compromises toward the end of reasonable highway construction in the foreseeable future. Chairwoman Ridder thanked Mayor Huber for his presentation and urged Cbmmission participation in both Metropolitan Council and Metropolitan Transit Commission meetings. She noted that the Planning Commission members will be placed on mailing lists for both agencies. ZONING ORDINANCE Copies of the Zoning Ordinance adopted by the Council on November 6 were distributed to all members. SOILS PROTECTION Attorney Winthrop's opinion on the proposed Soils ORDINANCE Protection Ordinance was read and discussed. Further discussion included various court decisions and the impact this ordinance may have on land development*in Mendota Heights. Stewart moved, seconded by Ljungkull, that the proposed ordinance be submitted to the Village Council for their consideration and adoption. All Ayes. 4. Planning Commission Minutes -3- November 27, 1973 VILLAGE COUNCIL Administrator Johnson read excerpts from the MEETING ACTION November 6 Council meeting minutes as concerns Planning Commission matters. A short presentation was made by Chairwoman Ridder concerning the Perron rezoning. She explained the reason that the Village Council enlarged the rezoning area in view of past community history. COMMUNICATIONS The several communications were acknowledged. CASE NO. 73-4 AND Attorney Mertensotto was present to discuss the CASE NO. 73-15 proposed Kopp/Dearman platting. He noted that the County Engineer has not indicated the final requirements for right-of-way on Lexington Avenue. It appears that the County will not accept a 17 foot easement.
