Minutes of the Regular meeting
Held Tuesday, December 4, 1973
Pursuant to due call and notice thereof, the regular meeting of the village
Council., Village of Mendota Heights was held at 8:00 o'clock P.M. at the
Village Hall, 750 South Plaza Drive, Mendota.Heights, Minnesota.
Mayor Huber called the meeting to order at 8:10 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Losleben, Wahl and Gutzmer.
Councilman Lockwood had notified the Council that he would be late.
APPROVE Mayor Huber moved approval of the minutes of the
MINUTES November 20 meeting. Councilman Wahl seconded the
motion.
Ayes: 4 Nays: 0
PLANNING COMMISSION Mayor Huber opened the meeting for the purpose
CASE NO. 73-7, PERRON of a public hearing on rezoning of property at
REZONING HEARING 8:15 P.M. He noted that weather conditions were
extremely bad and that the apparent lack of
public attendance would preclude a full hearing.
After a short discussion, Councilman Losleben moved that the hearing be
continued to December 18. Councilman Gutzmer seconded the motion.

PARKS AND RECREATION Mayor Huber acknowledged receipt of the November 26
COMMISSION Parks and Recreation Commission minutes. He
expressed concern and uneasiness that the Commission
had created a sub -committee on trails, suggesting that public hearings are
preferable to sub -committees for citizen input.
TAX Mayor Huber moved that an abatement be granted
ABATEMENTS to John J. Lapakko for Parcel #27614, reducing
from $266 to nil taxes Payable in 1973.
Councilman Wahl seconded the motion.
Ayes: 4 Nays: 0
Mayor Huber moved to deny the abatements for Floyd Eiselt for Parcel No. 26865.
Councilman Losleben seconded the motion.
Ayes: 4 Nays: 0
PLANNING COMMISSION Administrator Johnson explained the two surveys
CASE NO. 73-22, submitted by Mr. Palmitessa, explaining that both
PALMITESSA SUBDIVISION parcels exceeded the 15,000 square foot requirement
however, the lot width was 98.26 feet. After
further discussion, Councilman Wahl moved that the -subdivision be approved and
a variance granted for the front yard width. Councilman Gutzmer seconded the
motion.

Mayor Huber noted that representatives of Inland
were not present at this time and the; agenda
would be continued.
SOILS PROTECTION Administrator Johnson displayed a soils protection
ORDINANCE map and briefly explained the"relationship between
the proposed ordinance and the map, which is to be
made a part of the ordinance. Mayor Huber noted that the various wetlands must be
dovetailed in with future drainage facilities as will be proposed in the Surface
Water Management Study. Councilman Gutzmer noted that he had a number of
questions concerning the ordinance, including whether this was the final form.
It was noted that the proposed ordinance had not been submitted to Attorney Winthr
for final drafting at this time. It was agreed that further soils protection
policies should be developed and that the proposed ordinance should be developed
in concert with the Surface Water Management proposals. Administrator Johnson
was directed to submit the map to Hickok and Associates, requesting that they
study the map, advising on a proposal that would satisfy both soils protection
policies and future surface water facilities. Further discussion on the
ordinance intent is to follow.
FUEL AND ENERGY Civil Defense Director Martin Baldwin appeared
COMMITTEE to advise the Council of recent Civil Defense
directives concerning fuel and energy shortages.
He noted that the State Civil Defense Director had recommended the establishment
of a Fuel and Energy Committee.
Mayor Huber noted that he had received a communication from the State Civil
Defense Director advising as to local policies and practices. Director Baldwin
and Administrator Johnson were directed to proceed, obtaining names of suppliers
willing to serve on such a committee.
APPOINTMENT OF Administrator Johnson noted that an application
VOLUNTEER FIREMAN had been received from David Noack. He noted that
David Noack would be available for day time
response, that he met all qualifications, and recommended his appointment.
Councilman Gutzmer moved that David Noack, 665 4th Avenue, be appointed to
the Volunteer Fire Department. Councilman Losleben seconded the motion.

Councilman Lockwood arrived at 9:35 o'clock P.M.
PLANNING COMMISSION After a brief introduction by Administrator Johnson,
CASE NO. 73-27, Bruce Patterson of Minnesota Valley Engineering
INLAND INDUSTRIAL PARK explained a proposed plat for Inland Industrial
Park located south of Mendota Heights Road and
east of T.H. 13. After his explanation, reports were noted from Planner
James Ruone and Engineer Ed Kishel. Mayor Huber suggested that street
right-of-way widths be 80 feet in accordance with Ed Kishel's report.
Mr. Patterson indicated that Inland would be petitioning for public facilities
in the near future. He further indicated that Inland proposed to grade the
northwesterly two or three lots in the very near future.

After further discussion, Mayor Huber moved approval of the preliminary plat
subject to the following conditions;
1. Street right-of-way width be increased to 80 feet.
2. Road surfaces be established at 44 feet.
3. The plat provide all easements as recommended by
Engineer Kishel.
4. Grade the sites so that first floor level of proposed
buildings be no less than 2 feet above street grade.
5.• Determine the location of storm sewer extension and
provide easement and/or revise lot lines.
6. Work out a park contribution proposal with
Administrator Johnson.
7. Provide firm grading plans for the proposed plat.
Councilman Gutzmer seconded the motion.

APPLICATION FOR Mr. Tom Boemer was present to explain his
BUILDING PERMIT application for a building permit for
Minnesota Knitting Mills to be placed on
proposed Lot 1 of the Inland Industrial Park. He explained the proposed
metal building, submitting an architect's rendition. He noted that the
building was to be 33,600 square feet and that he would like to start
construction immediately. A representative of Minnesota Knitting Mills was
present to further explain the manufacturing process to be conducted on the
site.
Mayor Huber moved that the building permit be approved subject to:
1. Review and approval by Administrator Johnson as to
the application meeting zoning Ordinance requirements.
2. That all necessary data be submitt(Sd to the Metropolitan
Sewer Board and approval granted.
Councilman Wahl seconded the motion.
Ayes: 5 Nays: 0
PERSONNEL Councilman Wahl moved the adoption of Resolution
RESOLUTION Number 73-95, "RESOLUTION CORRECTING RESOLUTION
NO. 73-93, SECTION 10, SICK LEAVE."
Councilman Losleben seconded the motion.
Ayes: 5 Nays: 0
STAFF APPOINTMENT The appointment of Kathleen Dierberger as clerk -
receptionist was recommended by Administrator Johnson.
Administrator Johnson noted that Phyllis Lang had requested a transfer to the
part-time Police Clerk position. Such request was granted, therefore the
full-time clerk -receptionist position was vacant at this time.
Councilman Lockwood moved that Kathleen Dierberger be appointed clerk -receptionist,
Councilman Losleben seconded the motion.

LABOR NEGOTIATIONS
Administrator Johnson noted that a master contract
with Teamsters' Union 320, Police Bargaining Unit,

was prepared by Cy Smythe. He also noted that Mr. Smythe had been instructed
to meet with the Union business agent and local police steward.
MISCELLANEOUS The Council acknowledged receipt of the Village
Engineer's Engineering Status Report for
November, 1973.
The Council acknowledged receipt of the Village Financial Statement for
October, 1973.
LIST OF CLAIMS Mayor Huber moved the Council to adopt the
following motion:
RESOLVED that the claims submitted to the Village Council for payment, a summary
of which is set forth on the list attached hereto and identified as List of
Claims submitted for payment, December 4, 1973, having been audited by the
Village Council, be and are hereby allowed and the Mayor and Clerk -Treasurer
of the Village of Mendota Heights are hereby authorized and directed to issue
Village checks in payment of said claims.
Councilman Gutzmer seconded the motion.

LICENSES Councilman Wahl moved approval of the list of
licenses, granting a license to:

Mendota Heights, Minnesota, will meet in the Council Chambers of
the Village Hall of said Village at 750 South Plaza Drive., Mendota
Heights, Minnesota, at 8:00 P.M. on Tuesday, December 18,1973, to
consider the petition heretofore filed with the Village Council to
vacate the following streets situated in the Village of Mendota
Heights in Dakota County, Minnesota, to -wit:

Re -Arrangement according to the recorded plat thereof.

Dear Mayor and Members of the Village Council:
Because of a misunderstanding as to the time
at which the council hearing on the petition to vacate
the above streets was to be scheduled, I have found that
I will be out of town at the time of the scheduled hear-
ing next Tuesday, December 18. The petition for vacation,
of course, was instigated by myself and my wife and, of
course, we would ordinarily expect to be present to an-
swer any'questions which the council might have regarding
the petition.

It is conceivable that I will be able to get
back from my out of town engagement before the conclusion
of the council meeting, but I am quite sure it will not
be before the scheduled time for the hearing at 8:00 p.m.•
I have discussed the likelihood of my inability
to be present at the meeting with both Mr. Orvil Johnson,
the Village Administrator, and with Mr. Winthrop, the Vil-
lage Attorney. I believe the matter of the vacation is
noncontroversial. Its principal purpose is to -eliminate
double frontage on several lots in Block 21, Friendly Hills
Rearrangement with a view to eventually vacating the platted

On behalf of the residents of Eagle Ridge we would like to
express our thanks for your interest in our area as demonstrated
by your tour of the area on December 3 with Mr, Elmore and myself.
The purpose of this letter is to request an adjustment in the
sewer rental charges for the Eagle Ridge Association dated
November 20, 1973, and also to request that the basis for charges
to the Association should be modified to allow for the fact that
over 95% of our water usage is not discharged into the sanitary
sewer. •
As we discussed, each townhouse in the area has individual utility
services and metering. Each owner is responsible for his own
service charges.
The Eagle Ridge Association owns all of -the common properties (grounds,
streets, walks, swimming pool, tennis court, etc.) and each town-
hous owner -(29) owns one share of the Association. The developers
(Tuminelly-Bream) own 34 shares which will be transferred to town-
house owners as new units are built and sold. A maximum of 63 shares
has been established by agreement.
Separate utility meters are used for the association. The water
meter measures only the water used for the sprinkler system for
the grounds, the swimming pool, and the cabana (party room).
The cabana has two restrooms, a kitchen, and a floor drain in the
maintenance room"which are connected to the sanitary sewer. This
building is rarely used - in 1973 not over six parties were held
in the cabana.
The swimming pool has an enclosed water circulating system. Water
pumped out of the pool at the opening and closing period is pumped
on the ground and drains into the ditch along -Victoria Road.

Run off water from the sprinkler system drains along Victoria
Road and Eagle Ridge Drive, the same as natural run off.
The Association's water charges from the St. Paul Water Department
have been -fouled up from the beginning due to the fact that no
meter readings were made. This was corrected in September and we
have paid all water bills up to -date. We plan to see that monthly
readings are made so that accurate usage can be recorded.
Per your request, we are enclosing drawings of the Eagle Ridge
Association properties, the swimming pool water circulation system,
and the sprinkler system, which we feel are self-explanatory.
If further information is required, please advise. We would be
pleased to present this information to the council if necessary.

Rate Increase
The attached letter and other information is submitted for your
information. The news article dated Thursday, November 29 was the
first public notice of a water rate increase. The letter from
Cliff Hamblin then came as no surprise.
I have prepared a comparison sheet showing the impact of the
previous December, 1972 increase and the right hand columns show the
impact of this latest increase. Although it isn't evident, there is,
as a part of the agreement, a stipulation that there will be a
9� difference between St. Paul consumption charges and those in the
suburbs for the first 50,000 cubic feet. About the only good thing
that can be said is that the precentage of premium therefore is
decreasing as the rates increase.
You will note that the increases amount7'to about 5.5%, which is
about half, of the previous percentage increase. Since the increase
affects both St. Paul and suburban customers, and our contract makes
provisions for this, I do not believe there is any legal justification
in opposing it. Other methods of opposition such as Political and
legislative might possibly be considered.
For total comparison purposes, the Friendly Hills Water Company
charges a flat $7.50 per month, entitling the user to 30,000 gallons.
