Pursuant to due call and notice thereof, the regular
meeting of the Village Council, Village of Mendota Heights,
was held at B:OO o'clock P.M. at the Village Hall,
750 South Plaza Drive, Mendota Heights, Minnesota.

Mayor Huber called the meeting to order at 8:00 o'clock
The following 'members were present: Mayor Huber,
Councilmen 0ohl and Loolaboq. Councilman Lockwood had
the Council that he mould be late., Councilmen Gutrmor

League of Minnesota Municipalities Delegates' '
Program Outline for the 59th Annual Convention to be held
Juno 27 through June 29, and a Metropolitan Transit Commission
notice of a meeting to be held May 30 at 7:30 P.M. at the
Eagan Village Hall.
The Council also acknowledged receipt of the Fire Department
monthly report for April. ^
PLANNING Mr. Donald Smith was presanjt to request a'

The following modifications have been incorporated in the
final plans and specifications at the request of the Council
and Park Commission. I
Rogers Lake: The access point to a gravel surfaced parking
area and a walkway to a bridge to the picnic
center have been maintained. The canoe
channel will be modified. The Council discussed
an add/alternate feature which would allow
shaping of a beach area if the 1974 budget
will allow adequate expenditures for maintenance
of the beach area, lifeguards and other
necessities. Park Commission Chairman Joe Stefani
stated that funds are available for construction
of the beach area and presented to the Council a
cost analysis for the proposed swimming beach,
including proposed costs for annual budgeting
purposes. Councilman Losleben:suggested that
since the Minnesota Pollution Control Agency
has done water quality tests on Rogers Lake,
the Village should encourage the PCA to submit
a report on water quality.
Councilman Lockwood arrived at 8:35 P.M.
Marie Avenue: Mr. Ritenauer stated that the contractor will
transplant 100 pine seedlings at this site and that
drainage improvements have been made on -the plans.
A question arose about the cost of including a
water hydrant within the park and Mayor Huber
directed the Village Administrator to work out
the details and cost figures with the St. Paul
Water Department. Mr. Ritenauer''stated that the
east property line has a 3 to 1 slope and that
he proposes to use sod as the ground cover. The
Council requested that Mr. Ritenauer and Mr. Starr'
investigate the alternatives to sod which would
require less maintenance than sodding.
Interstate
Park: Mr. Ritenauer stated that a tennis court has been
included in the plans and that the picnic shelter
has been moved closer to the parking area.
Wentworth: Mr. Ritenauer described changes made to the
parking system in accordance with Park Commission
direction.
The estimated cost of the park improvement project is $189,000.
The add—alternate beach improvement estimated cost is
approximately $10,000.

Councilman Losleben moved the adoption of Resolution No. 73-41,
"RESOLUTION'APPROVING FINAL PLANS AND SPECIFICATIONS FOR PARK
IMPROVEMENTS AND CALLING FOR BIDS," with a bid date of
June 189 1973 at 2:00 P.M. in the Village offices.
CouncilmaW Wahl seconded the motion.

FRIENDLY Park Planner Lee Starr stated that the Park
MARSH Commission will hold a public meeting on
May 30 at 7:30 P.M. in the Village Hall to
discuss the Friendly Marsh park site and
proposed ponding area.

EMPLOYMENT
Village Administrator Johnson stated that
James Ayotte has•been employed in the
Public Works Department since November 27
and will complete his six—month probationary
period on May 27. Mr. Johnson recommended
that he be given permanent employment status at the rate of
$815.00 per month.
Mayor Huber moved that James Ayotte be appointed permanent
employee with a salary of $815.00 per month., effective
May 27, 1973. Councilman Lockwood seconded the motion_.

SOMERSET VIED! Village Engineer Kishel stated that Bi—Con
STREETS, IMPROVEMENT Construction Company, contractor -for
NO. 72, PROJECT Improvement No. 72, Project No. 8, has
NO. 8, CHANGE suggested that a 32" bituminous base
ORDER NO. 1 course be furnished and installed in lieu
of a 6" gravel driveway base and that the
change will be accomplished at the unit price proposed for the
6" gravel driveway base. Mr. Kishel recommended that the
suggested Change Order No. 1 be accepted and approved.
Mayor Huber moved the approval of Change Order No. 1 in the
contract for street construction, Improvement'No. 72,
Project No. 8'. Councilman Losleben seconded the motion.

LIST OF CLAIMS Councilman Lockwood moved the Council to
adopt the following motion:
RESOLVED that the claims submitted to the Village Council for
payment, a summary of which is set forth on the list attached
hereto and identified as List of Claims submitted for payment,

The 1973 Annual Meeting of the Metropolitan League of Municipalities will be
held on WEDNESDAY, JUNE 13 at 8:00 P.M. at the EDINA VILLAGE HALL, 4801 W. 50th Street,
Edina.
PLEASE MARK THIS DATE ON YOUR CALENDAR!
An official notice of the meeting with an agenda and supplementary information
will follow.
Each member municipality of the Metropolitan League is urged to send at least
one official representative.to this meeting. The meeting will provide an ex-
cellent opportunity to appraise the activities of the League during the past
year and to discuss what the League should be doing in the months to come.

E. Prepare necessary base maps for use in illustrating the comprehensive plan.
F. Compile and utilize existing topographic information (10 foot contours)
for studies and presentation.
G. Preliminary design of storm sewer system including pipe sizes, sewer loca-
tions and holding basins as well as the possibility of a tie-in to an
inter -community system.
H. Preparation of preliminary cost estimates and benefit cost analysis of the
preliminary design.
I. Preparation of a timetable and phasing priorities as to suggested stages
of construction.
3. The engineer shall work closely with the Village Administrator to insure maxi-
mum coordination'of efforts.
The engineer agrees to perform professional engineering services to complete the
comprehensive plan on the following basis:
It is proposed that the project be undertaken on a time and expense basis with
a maximum total. The hourly rate shall consist of salary cost times a multi-
plier of 2.5 plus net outside expenses, plus net expenses paid for outside
Engineering services necessary to provide specialized -data. Work involved
shall be invoiced monthly and due when invoiced.
As to a maximum cost for planning, i,t is our estimate that the work to be
completed by Eugene Hickok and Associates will not exceed $8,000.00 while
that portion to be completed by Bettenburg, Townsend, Stolte and Comb, Inc.,
will not exceed $10,000.00. The above expense estimate includes provision
for presentation of the report at two planning commission or council meetings.
The above includes providing up to 25 sets of the report together with such
necessary exhibit drawings for presentation purposes.
The study will commence immediately upon notice by the Village to proceed. The
preliminary report will be completed within four months thereafter and submitted
for Village approval before the final report is issued.
We appreciate the opportunity to submit this proposal and await your favorable
consideration.

As requested, we submit herewith a supplement to our feasibility study,
dated June 18, 1973, regarding proposed bituminous surfacing of Pagel Road
south of the S.T.H. 49 right of way line.
As indicated in our previous report, it is estimated that to construct a
2 inch bituminous surface, 20 feet wide for the proposed length of 1,150
feet, will cost approximately $4,500.00. For assessment purposes, we find
that there are a potential 2,018.8 feet of assessable frontage. Of that
amount, 1,362.8 feet are within the limits of Imp. 72, Proj. 2, while
656.0 feet are outside the original project. Spreading the entire cost
over the total potential assessable frontage will bring the unit assessable
cost to $2.23 per foot. This means that about $3,039.00 will have to be
assessed against properties within Imp. 72, Proj. 2 while approximately
$1,463.00 will have to be financed by other means.
Based on the unit prices quoted by the Contractor for Imp. 72, Proj. 2, we
estimate that the assessment cost for sewer will be $11.67 per'foot and
the cost for water will be $16.32 per foot. Adding $2.23 per foot to these
figures will bring the total assessable cost for sewers, water and street
restoration to $30.22 per assessable foot. The proposed surfacing will
add about 8% to the sewer and water assessment cost for Imp. 72, Proj. 2.

1973 LEGISLATIVE REPORT
Our 1973 'State Legislature made an effort to "hold the line" on property taxes
payable in 1974. They increased the homestead tax credit from 35% to 45% reduction
on taxes due and increased the limitation from $250 to $325. Prior to now, bonded
indebtedness was not included in this reduction and had to be added to the net amount
of property tax. The new limitation now includes any school district bonded
indebtedness within the 45% reduction but does not include any local or county bond-
ed indebtedness.
Senior Citizen's property taxes paid this year will be frozen at the 1973 payment.
on t6xes. The Senior Citizen must have reached age 65 by June 1st, 1973, to be
eligible for the "freeze". In addition, the Senior Citizens Tax Credit has been
liberalized. Prior to this year, in order to be eligible for this tax credit the
Senior Citizen's gross earnings (including Social Security) were limited to $5,000
"lincome. This has been increased to $6,000 total income. The tax credit is based on
the degree of gross income compared to the taxes paid. The greater the income will
reduce the tax credit. If a Senior Citizen's taxes are greater in 1974 than he
paid in 1973 (viiich are now "frozen"), he will be eligible for a refund of the over-
payment. Both the over -payment of property taxes and the Senior Citizens' Tax Credit
will be processed by the Income Tax Division of the Minnesota Department of Taxation.
In both instances, applications for these payments must be made to the Income Tax
Division.
The Renter Tax Credit has been increased from a maximum of $90 to $120.
The increases in agricultural, residential (both homestead and non -homestead), and
temporary seasonal residential recreational properties for 1973 are now limited
to only 5%. The three exceptions are: these types of properties that were sold
during 1972, new construction and additions to existing structures. The assessor
"can add the value of the addition to a 5% increase on the basic structure and the
lana,. If the 5% increase applied in 1973 has not reached the assessor's estimate
of m&rket value he can add another 5% (or fraction thereof) in 1974.

easterly roadway. He stated that it is Mr. Kopp/o intention to
have a minimum lot area of 15,000 square feet; however, two lots
have Ieae than the 15,000 square feet. He stated that the lot
area can be increased by mooing the lot lino'ferther north since
lots 44 and 45 and lot 47 contain more than 15,000 square feat
and there is sufficient land area for all the lots to be
15,000 square feet. Chairman Stringer stated that the linea
should have been drawn correctly on the preliminary plot so that
the problem could be resolved and Mr. Mertenootto stated that
the inadequacy of the two lots was just discovered and the
correction will be made. 0r. 0ertenootto pointed out that the
right—of—ways are OO feet and that the open space dedication
will be lO% of the net land value. .
0r. Chuck Dahlgren of Apache Engineering explained the
preliminary plat to the Commission. Several of the members
were concerned that by pushing down the hill to create lots
16 and 17 the existing ponds mould be filled in and the mood
lino along Marie Avenue would be destroyed. Mt. Stringer stated
that this aspect Of the plat does not comply with the
previously stated desire and direction of. the Commission to
preserve the ecology of the area. Mr. Stringer' further stated
that the Commission must take a firm position On the
preservation of the natural amenities. '�

fifty foot right—of—mays and Mr. Stringer stated that this
. mould be agreeable if the Engineer could be pursuadod to agree.

the ponding areas could be retained and that he will bring the
plat back with the appropriate changes.
It was the oonoonous of opinion among the Commission members
that the ponding areas should be retained. 0r. Ljungkull
approved of the proposed plat since the building of roadways
would be more feasible as the plat was proposed.
Chairman Stringer continued the hearing until June 26.

Home occupations as defined in the Zoning Ordinance are allowed in Residential
Zoning Districts (7.3 (3)) as a permitted accessory use. The Ordinance defines
a Home Occupation as:
3.2(24) Home Occupation: Any gainful occupation meeting all of
the following requirements: when engaged in only by
persons residing in their dwelling, when that occupation
is conducted in not more than one (1) room within the
principal structure, when evidence of the occupation is
not visible from the street, when the principal structure
becomes the base of operation for that occupation using
only that equipment or machinery which is usually found
in a home, and when not involving the retail sales of
products produced off the site. A professional person may
use his residence for consultation, emergency treatment or
performance of religious rites but not for the general practice
of his profession. No accessory building shall be used for
such home occupation.
The last line of this definition states, "No accessory building shall be used for such
home occupation." An accessory building is defined as: (3.2 (1)) "A . . . structure
subordinate to and serving the principal use or structure on the some lot and
customarily incidental thereto."

Dear Mr. Radabaugh:
I am enclosing herewith for filing and appropriate City Council
action, a Petition requesting the installation of °a sewer system in the
above -captioned area. I believe the signatures thereon constitute a
majority of the home owners affected by this action.
Mendota Heights has-been derelict in its civic, legal and moral
responsibility to the citizens of this neighborhood. Even though the
area is one of the earliest in the village, with the incumbent problems
of older septic tanks and drain fields, Mendota Heights has continu-
ally delayed needed improvements. This has occurred even while the
Village was aware of repeated instances of septic system overflow dis-
charges. Although I realize the policy has been to provide assistance
first to those who ask for it, such a policy is irresponsible when it
gives priority to the interests of commercial developers over the health
and well-being of children who play, walk, and wait for school buses in
streets permeated with raw sewage. This condition is so aggravated that
'its continued existence cannot be permitted.
I trust the foregoing will convey to you and the City Council our
sense of urgency, and explain why we will so appreciate your earliest
attention to this matter.

As we discussed in our meeting last Friday, we hereby request that the Village
make the following improvements to Mendota Heights Industrial Park:
1. On Mendota Heights Road:
a) Complete paving of road to full width (per State and Village
requirements) and upgrade paving to a nine ton capacity.
b) 'Install curb and gutter on both sides of the road.
2. On that portion of Transport Drive laying north of Mendota Heights
Road:
a) Grading and paving to a nine ton capacity.
b) Water, sanitary and storm sewer.
c) Concrete curb and gutter.
We have started to prepare our promotional material to market this Park and hope
to have some construction underway during the latter part of the summer. Con-
sequently we hope you can expedite this work.
We would like the cost of the work to be assessed against the benefited properties.
In view of the fact that Mendota Heights Road is a State aid road we would suggest
that two-thirds the cost of paving work be paid for out of State aid funds and
the remaining one-third assessed against the benefited property.

-- Starr passed out Outline Specifications for the
five park sites. He also handed out cost
estimates for projected development. Comments
should be communicated to G. Murphy by May 2.
-- Costs were recapped, with projected development
costs totaling approximately $19790009 as of
this meeting.

1. Tennis court lighting at Wentworth and

swimming beach. Development costs -- approximately
$11,000. Annual operating expenses would run
between $3,000 and $4,000.
-- Shipman reported on coriversation with State Health
Department.
-- After much discussion, Meierotto moved that the
Commission submit permit application to DNR for
dredging and that park contract have an add/alternate
in construction plans for excavation and sand for
a swimming beach at Rogers Lake, to take place
pending Council approval of budget; seconded by
Howe; motion passed.
B. Fireplug in Marie Avenue site
-- Starr reported increased costs in placing fireplug
in park site. After discussion Howe moved that
hydrant be added. Finn seconded. Motion passed.
C. Lighting at Interstate Park shelter
-- Starr reported excessive costs to providing
lighting at this time. Meierotto moved that lighting
be eliminated. Seconded by Murphy. Motion passed.
D. Friendly Hills Marsh Pond Concepts
-- Johnson asked Commission advice on ponding concept
to occur in conjunction with Rogers Lake water level
project.
-- After much discussion, Finn moved that decision be
postponed until the May 30 meeting where community

We are in receipt of a list consisting of five
parcels of tax forfeited property. The County
Commissioners classified these parcels as non—conservation
lands and hence would presumably be sold for private
purposes in the future if anyone is desirous of the
property. There are, however, several parcels that
should be transferred to Village ownership.
The following parcels should be requested for
transfer:
Parcel No. 26072—A1, described as the
East 30 feet of the North 1335 feet
^y of Government Lot 3, Section 26.
This strip of land thirty feet wide
and 1,335 feet long represents part
of the right—of—way of William Court.
Obviously, this should be transferred
into public ownership.
Parcel No. 27493—A, described as a
triangular lot between Butler Avenue and
Spring Street.
This triangular—shaped portion should
be transferred to public ownership
j allowing further right—of—way for
turning movements between Butler and
Spring. This m'ay not require
improvement in the near future, however,
conventional street improvements would
normally require the use of some of this
triangular—shaped property.

In conclusion, it is recommended that the Council `
concur that all five parcels be approved as non—conservation
lands for further County processing. Correspondence
requesting the above described parcels should be directed
to the County.
