RE: Park Site Development, Project 2 -Competitive Bidding
Four bids for the above project were received in accordance with
advertised bidding requirements. All bids were accompanied by the
required bid bonds. The bids included:

Minneapolis
Henry 0. Mikkelson Co. is a general contractor with 24 years of experience.
His past park development work includes recent projects in Minneapolis,
St Louis Park, Burnsville and Mankato. These projects were related to
recreational structures, ice arenas, swimming pools, tennis courts, grading
and associated park facilities.
We have contacted a number of the Mikkelson firm's recent clients and
received only superlative comments concerning the quality of his work, his
performance and contractor -client relationships.
Mr. Mikkelson indicated a willingness to reduce his completion time of
340 days to this construction season (150 days) for major site work, if
the Village took a reasonable approach in applying liquidated damages claims
on items, e.g. beach excavation and seeding, which might not be totally
accomplished until the spring of 1974.
Based upon our analysis of the bids for this project, our research on the
low bidder's references, on discussions with Mr. Mikkelson, and on the
results of last night's meeting with the Village Park Board, we recommend
Councilmanic award of the base bid contract for this project tQ the
Henry 0. Mikkelson Company for a contract price of $229,700.00.

Minutes of the Regular Meeting
Held Tuesday, June 5, 1973
Pursuant to due call and notice thereof, the regular meeting of the Village
Council, Village of Mendota Heights, was held at 8:00 o'clock P.M. at the
Village Hall, 750 South Plaza Drive, Mendot� Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Lockwood, Wahl, Gutzmer and
Losleben.
APPROVE Councilman Gutzmer moved approval of the minutes of
MINUTES the May 1 meeting. Councilman Wahl seconded the
motion.

Councilman Lockwood moved approval of the minutes of the May 15 meeting.
Councilman Losleben seconded the motion.

SOMERSET NO. 2 Councilman Gutzmer moved adoption of Resolution
Number 73-42, "RESOLUTION ACCEPTING PETITION AND
ORDERING IMPROVEMENTS FOR SOMERSET NO. 2 SUBDIVISION (IMPROVEMENT NO. 72, -
PROJECT NO. 6)." Councilman Lockwood seconded the motion.

BID AWARD Village Engineer Kishel presented to the Council a
tabulation of bids recevied for improvements to serve
the Somerset No. 2 area and recommended that the bid be awarded to the lowest
bidder, Valley Rich Company, Inc. of Rosemount in the amount of $66,987.90.
Mayor Huber moved adoption of Resolution No. 73-43, "RESOLUTION ACCEPTING BIDS
AND AWARDING'CONTRACT FOR CONSTRUCTION OF SANITARY SEWERS, WATER MAINS, STORM
SEWERS AND STREET IMPROVEMENTS TO SERVE THE SOMERSET NO. 2 SUBDIVISION
(IMPROVEMENT NO. 72, PROJECT NO. 6)" Councilman Lockwood seconded the motion.

METROPOLITAN LEAGUE The Council acknowledged receipt of a notice of

PETITION FOR SEWER The Council acknowledged receipt of a letter from

Highway 110 frontage road, Hunter Lane, Culligan Lane, Orchard Place and
Lexington Avenue.
Councilman Losleben moved adoption of Resolution No. 73-44, "RESOLUTION,
DECLARING ADEQUACY OF PETITION 'AND ORDERING PREPARATION OF REPORT ON
SANITARY SEWER IMPROVEMENTS TO SERVE SECTION #27,,INCLUDING HIGHWAY 110 FRONTAGE
ROAD, HUNTER LANE, CULLIGAN LANE, ORCHARD PLACE AND LEXINGTON AVENUE."
Councilman Wahl seconded the motion.

PETITION FOR STREET The Council acknowledged receipt of a letter from

COMMUNICATIONS The Council acknowledged receipt of a letter from
Mr. Calvin Floerke, 737 Decorah Lane, requesting
that the Village parks be provided with trails for mini -bikes, cycles and
snowmobiles. Mayor Huber directed that the letter be referred to the Parks
and Recreation Commission. 1 1,
PETITION FOR The Council received a petition for street improvements
IMPROVEMENTS on Lansford Lane from the end of the pavement to the
Bachelor Avenue intersection.
Village Administrator Johnson stated that the signers of the petition are aware
that -at some time in the future sanitar 4 sewer improvements will be constructed
in 'this area and that the prevailing question is how permanent a street and curb
and gutter improvement should be constructed.
Mayor Huber moved adoption of Resolution Number 73-45, "RESOLUTION DECLARING
ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT ON STREET AND CURB AND

PLANNING COMMISSION The Council acknowledged receipt of the May 22, 1973

PLANNING. COMMISSION Village Administrator Johnson stated that the Planning

setback so that Mr. Humpal can construct a four car

garage at 699 Callahan Place. Mr. Johnson stated that the Village Planner
has prepared a report on this case and that the report was not available to
the Planning Commission when their recommendation was made.
Mayor Huber referred the matter back to the Planning Commission for their
consideration of the Planner's report and directed the Village Attorney to
prepare a report for the June 26 Planning Commission meeting on whether or not
Mr. Humpal's use for the garage would be considered a violation of Village
Ordinances pertaining to home occupations.
PLANNING COMMISSION Mr. Dennis McCardle was present to request an 8'
CASE NO. 73-13, variance from the rear yard setback requirement at
McCARDLE 2159 Fox Place so that he can make an addition onto
his existing kitchen. (Planning Commission recommended
approval).
Councilman Wahl moved approval of the application for an 8' variance from the
rear yard setback requirement at 2159 Fox Place. Councilman Losleben seconded
the motion.

SOMERSET "19" Village Administrator Johnson stated that the Planning
Commission has recommended approval of the roadway
portion of the landscape plans for Somerset "19" dated September 7, 1972. The
Council acknowledged receipt of a report from the Village Planner on the
landscape plans.
Councilman Wahl stated that according to the Midwest Planning report on the
landscape plans, many things are inadequate and that this report should be
strictly adhered to.
Councilman Losleben moved that the matter be referred back to the Planning
Commission for a determination of whether or not a variance is required for
the proposed parking area near the east building and that the Planner's
report on the landscape plans be referred to the Planning Commission for
consideration. Councilman Gutzmer seconded the motion.

PROPOSED ZONING Village Administrator Johnson stated that the Cities
ORDINANCE CHANGES -- of St. Paul and West St. Paul are considering zoning
ST. PAUL AND changes and that the Village Planner has prepared
WEST ST. PAUL a report for the Planning Commission and Village
Council outlining the effects of the proposed
changes on the Village .of Mendota Heights. It was the opinion of the Village
Planner that the proposed zoning changes would.have•.,,no adverse affects on the
Village.
Councilman Wahl requested that the Village Administrator check the proposed
rezoning east of Delaware and south of Marie.
PARKS AND RECREATION The Council acknowledged receipt of the minutes of the
COMMISSION MINUTES April 25 and May 9 Parks and Recreation Commission
meetings.
IVY HILLS -TOWNHOUSES Mr. Robert Nelson, of U.S.D.C., was present to request -
permission to construct a retaining wall and sidewalk

south of the Ivy Hills Townhouse complex and to change the original exterior design
of building C-4 from brick to aluminum siding.
Village Administrator Johnson stated that the Village'Engineer and a landscape
architect should have some input into the solution of the drainage problem for
this complex.
Mayor Huber moved the approval of a variance in the Planned Unit Development
to allow Building C-4 to be sided with aluminum siding upon the condition that
U.S.D.C., at their own expense, work with the Village Engineer, a landscape
architect and Village staff to correct the drainage problem to the satisfaction
of the Village. Councilman Gutzmer seconded the motion.

TAX FORFEIT Village Administrator Johnson stated that the County
PROPERTY has submitted to the Village a request to concur and
approve the non -conservation classification of six
parcels of tax forfeit property. Mr. Johnson recommended that this classification
be approved and that the Village ask that three of the parcels be transferred
to Village ownership: Parcel No. 27493-A1 (needed for right-of-way for
William Court); Parcel No. 27493-A (needed for further right-of-way for turning
movements between Butler and Spring); Parcel No. 28910 (to be used for
playground purposes in the Curley Addition; the Village must be prepared to
absorb the outstanding assessments amounting to $4,573.19).
The Village Council concurred with the non -conservation classification for the
six tax forfeit properties.
Mayor Huber moved adoption of Resolution No. 73-47, "RESOLUTION FILING APPLICATION
FOR CONVEYANCE OF TAX FORFEIT LANDS." Councilman Wahl seconded the motion.

WENTWORTH AVENUE Councilman Wahl moved adoption of Resolution No. 73-49,
SPEED STUDY "RESOLUTION REQUESTING A STUDY AND SPEED LIMIT
DETERMINATION FOR WENTWORTH AVENUE (COUNTY ROAD 8)."
Councilman Losleben seconded the motion.

LEAGUE OF MINNESOTA Village Administrator Johnson stated that in view of
MUNICIPALITIES the proposed L.M.M. dues increase and constitution
DUES INCREASE changes, someone should be named as an official delegate
to the League convention to be held June 29.
Mayor Huber moved that Village Administrator Johnson be named Village delegate
to the League of Minnesota Municipalities convention. Councilman Losleben
seconded the motion.

FEDERAL REVENUE Village Administrator Johnson -outlined for the Council
SHARING the proposed distribution of Federal Revenue Sharing
funds for the period from January 1, 1973 through
June 30, 1973. The breakdown is as follows:
Public Safety - $5,000; Environmental Protection - $5;000 (proposed as the first
installment on a surface water control study); Recreation - $2,000; Financial
Administration - $1,403.

As you recall, the Village Council supported the request of the
Mendota Height�.Volunteer Firemen for enabling legislation author.izing
the increase of mon�.hly pensions from $46.00 per month to $SOo00 per
month. This of course is permissive (as opposed to mandatory)
legislation and does require Viilage Council au�horization.
The L�gislature, through the efforts of Senator Knutson and
Representative Kempe, adopted Chapter No. 173, "An Act Rela�izzc� to
Retirement: Firemen's 5ervic� Pensions in the Village of Mendota
H�ights." This P.ct was signed by Governor Anderson on May 7 and
filed in the Secretary of State's office on the same date. The last
section of the Act is as follows:

1974 Requests and Demands
I am attachixzg two letters reflecting demands for the Publiq
Works Depar�ment and the Police Department. As you will note, these
letters are addressed to Mr. Cyrus Smythe, the labor negotia�or
retained by the League of Minnesota Muni.cipal.ities.
Although our own local negotiations for the past several years
have been conducted almost entirely within the confines of Mendota
Heights, there of necessity must be close coordination with other
local units of government. You will note that there are six
Public Works Departments represented by Local No. 320 and some
fifteen Police Departments represented by Local No. 320. in both
cases, West St. Paul and Inver Grove Heights are on the list.
The trend toward industry-wide joint negotiation has been
gainz.ng in past years. By centralizing all possible information,
all possible knoraledge and some au�hority with the League office,
generally satisfactory results have been obtaineda This type of
negotiating has prevailed for many, many years for the Public Wo�ks
Departments represented by Operating Engineers' Local No. 49
ancl recent changes in Teamsters° Local No. 320 have prompted simil.ar
types of nego�iations for their members.
T am reluctan� to sugges�t that the Council members become less
involved in labor negotiations, however, the full-time staff people
have in the past worked with Cy Smythe in preparing contracts for
Council consideration. If some members of the Council are especially
interes�ted in following this matter, they certainly are entitled to
meet and neqotiate with the business agenta I do, however, �elieve
tha� a more uniform and consistent contract can be negoti.ated via
a committee composed of inembers of many if not all of the
communities working with Cy Smythe. Zn view of the preceeding, I
would suggest that the Cauncil authorize the Administrator to v�ork
with Cy Smythe a.nd others in the preparation of a contract to bring
back for Vi,llage Council consideration.

with the preparation of a Comprehensive Plan for surface wai;er removal in the
Village for your consideration.
To do the work in connection with the prepara�tion of a�1an, it is necessary to
utilize the servic�s of engineers other than Bet�enburg, Townsend, Stalte and Comb,
Inc. For this purpose, we propose Eugene A. Hickol< and Associates, Inca, who vd111
v�ork with us by specializing in the hydrological aspects o�' t{1e plan.
The scope of servic�s to be provided �n connection wi�th the preparation of a Com-
prehensive P�an is as follows:
1. The area of study shall be within the Village of Mendota He�ghts.
2. The Engineer shall consider the fallowing items c4uring the study;
A. Hydrological investigatlon o-F the study area including proposed land use
development, runoff quantities and pa�tterns toge�;her with �che location of
proposeci natural ponding areas and necessary structures.
�. Water quality investigation of runoff water and t6�e e�'fect of th-is v�iater
on the natural ponding areas.
C. Definition and review of the Mendota Heights drainage with respect to re-
quirements from the MPCA, �letropolitan Council, Soil Conservation District,
Ramsey County O�en Space System and coord�nation with surrounding communi-
ties.

The engineer shall worl< closely with the Village Administrator to insur� maxi�
mum coordination of efforts.
The engineer agrees to perform professiona] engineering services to comp1ete the
comprehensive plan on �he folloGving basis:
Ii; is proposed that the project be undertaken on a time and expense basis with
a maximum total. The hourly rate shall cons�st of salary cost times a multi-
plier of 2.5 plus net outslde expenses, p1us ne�t expenses �a�d �or nutslde
Engineering services necessary to prov�de specialized data. Work involved
shal1 be invoiced monthly and due when invoiced.
As to a maximum cost for planning9 it is our estimate that the w�rk to be
completed by Eugene Hicl<ol< and Associates will not exceed $8,000.00 wh11e
that portion to be comp7eted by Bettenburg, To4vns�nd9 Stolte and Comb9 Tnc.,
will not exceed $109000.00. The above expense estlmate includes �rovision
for presentation of the report at two planning commission or council mee�tings.
The above includes providing up to 25 sets of tl�e report together with such
necessary exhibit drawings for presentation purposesa
The study w�ll commence immediately upon notice by the Village to proceeda The
preliminary re�or-� wtill be completed with-in four months thereaf�er and submltted

�1s requested, we submit herewith a supplement to our feasibility study,
dated June 18, 1973, regarding proposed bituminous surfacing of Pagel Road
soufih of tfie S,T.I-le 49 right of way 1 ine,
As indicated in our pr'evious report, it [s estimated that to construct a
2 inch bituminous surface, 20 feet wide for the proposed length of 1,150
feet, will cost approximately $�,500.Q0. For assessment purposes, we find
that there are a potential 2,O1B.8 feet of assessable frontage. Of that
amount, 1,�62.i�� feet are within the limits of Imp. 72, Proj. 2, while
656,0 feet are outside the original project. Spreading the entire cost
over the total potential assessa6le frontage will bring the unit assessable
cost to $2,23 per foot. This means that about $3,039�00 will have to be
assessed against properties within Imp. 72, Projo 2 while approximately
$19463.00 wi11 have to be financed by other means.
Based on the unit prices quoted by the Contractor for Imp, 72, Proj. 2, we
estimate that the assessment cost for sewer will be $11067 per foot and
the cost for water will be $16.32 per foot. Adding $2,23 per foot to these
figures will bring the total assessable cost for sewers, water and street
restoration to $30.22 per assessable foot. The proposed surfacing wi11
add about 8% to the sewer and w�ter assessment cost for Imp, 72, Proj. 2.
