Acting Mayor Lockwood called the meeting to order at 8:00 o'clock P.M. OATH Acting Mayor Lockwood•administered the OF Oath of Office to�James P. Losleben who .OFFICE was,elected to the office of Councilman. ROLL The following members were present: CALL Acting Mayor Lockwood, Councilmen Wahl and, Losleben. Mayor Huber had notified the Council that he would be out of town. Councilman Gutzmer was absent due to illness. APPROVE. Councilman Wahl moved approval of the MINUTES minutes of the December 19 Council meeting. ` Acting Mayor Lockwood seconded the motion. Ayes: 3 Nays: 0 METRDPOLITAN Acting Mayor Lockwood acknowledged receipt of AIRPORTS of a notice of a meeting to beheld at 7:30 P.M. COMMISSION January 2, 1973 at the Acacia Park'Cemetery MEETING NOTICE Chapel. Acting'Mayor Lockwood stated that the meeting is being held by the Metropolitan Airports Commission to advise the homeowners in the area to be acquired by MAC of the acquisition procedures. He further stated that the Village Administrator would be -in attendance at the meeting to monitor the proceedings. INCREASED The Council acknowledged receipt of a letter NSP GAS RATES from Northern States Power Company which, listed the following gas rate schedule:,rates for General Service after January 5, 1973 will be 13.10 per Mcf and 11.770 per Mcf for Interruptible Service; after January 25, the rate for General Service will be 14.30 per Mcf and the.rates for Interruptible Service will be 12.960 per Mcf. 0 0 . J. -Raveling and Mr. Gerald Rummel COMMISSION Councilman Losleben suggested that the Community Planning Seminar outlined on Page 8 could be of benefit to the members of the Planning Commission and other Village officials. SKELLY) Acting Mayor Lockwood directed the Village Administrator to advise the members of•the Planning Commission of the Seminar and to request that someone from the Commission attend the Seminar. a z• SENATE COMMITTEE The Council acknowledged receipt of a letter ON METROPOLITAN from Senator John C..*Chenoweth, Chairman of AND URBAN the Committee on Metropolitan and Urban Affairs. AFFAIRS -For the benefit of the audience, Acting mayor Lockwood read the letter which stated that beginning in early January the Committee will hold a series of hearings on metropolitan issues and that the hearings are for the purpose of providing a review and analysis of the issues and the governmental units involved,in metropolitan decisions. PLANNING Th'e Council acknowledged receipt of the COMMISSION minutes of the December 27, 1972 Planning MINUTES Commission meeting. PLANNING Mr. -Alfred J. -Raveling and Mr. Gerald Rummel COMMISSION were present to request a conditional use permit CASE #72-24 — for rental of trucks and trailers at the RAVELING Country Club Skelly Station at Highway 110 (COUNTRY CLUB and Highway 49. SKELLY) Acting Mayor Lockwood stated that the matter has been before the Planning Commission and that at their meeting on December 27, the Planning Commission recommended approval of the conditional use permit subject to six specified conditions. Councilman Wahl stated that he felt that the first condition,' which would allow a maximum of fifteen trucks and/or trailers or any combination thereof, should be amended to .allow a maximum ` Minutes —3 -, January 2, 1973 of ten units.' He further stated that he had done some research on other stations which rent U—Haul•equipment and that generally• such stations maintain ten to twelve units•maximum. Mr. Rummel stated that..the maximum number of rental units allowed should not be conditional upon the practices of other stations. He also stated that the Planning Commission did not stipulate the number of each'type of•unit which would be allowed because'it was felt that due to the limited space allowed there is no possibility:, that all, or•even a large number, of the units would be trucks. ., Councilman Wahl stated that he felt that the Council would be too liberal in allowing fifteen rental units. He also suggested that•the fifth condition be changed so that the conditional -use ' Permit wbul-d expire when the current lessee terminates his lease, and that any new,lessee, of the station would have to apply for- a new conditional use permit. ` Councilman Losleben stated that he feels that there should be a time limit set for t'he fourth' coQditign-, the -construction of ' a fence -and the planting of the hedge: Acting mayor Lockwood suggested that may 15,'1973 be stipulated as the deadline date.` Acting mayor Lockwood moved adoption of Resolution Number 73-01, "•RESOLUTION APPROVING AND ISSUING CONDITIONAL USE PERMIT FOR''' TRUCK AND TRAILER RENTAL,"•amending the six conditions set by.the Planning Commission to include the suggestions made by the Council. Powell, COMMISSION was present to request approval of the final CASE #72-33 -- plat of Block 9, T.T. Smith's Subdivision POWELL No. 3. Village Engineer•Kishel requested that he be supplied with : a transparency after the plat has been executed. Councilman Wahl moved apprpval of the final plat of the { Rearrangement of Block 9, T.T. He further stated, ?;Ft that the bill also provides for a lump sum pension in an 'amount''' not .to exceed $400 per year of, service. Mr.. Winthrop -also ". noted that in order- for the,proposed bill' to be put into effect, Minutes 6 January 2, 1973 the Legislature must pass the bill; however, the bill must be approved by the Village Council after it has been adopted by the Legislature. Councilman Wahl mooed that the proposed bill relating to the Fire Department Relief Association, increasing the Volunteer Fire Department pension plan to a maximum of $80 per month be endorsed by the Village Council and that the bill be presented to Senator Knutson and Representative Kempe with a request that they sponsor such special legislation. Ayes: 3 Nays: 0 FIR[ DEPARTMENT ORDINANCE Acting Mayor Lockwood stated that he would like to have some revisions mode in the current Fire Department Ordinance'. Village Administrator Johnson stated that among the needed revisions is a Board of Trustees to administer the Relief Association Funds. Fire Chief Siebell requested that u fire lane ordinance be drafted. Acting Mayor Lockwood directed the Village Administrator to draft a proposed fire lane ordinance for Council review. It was the concensus of the Council that such an ordinance Should be drafted. Our support and views are best stated in our letter of may 13, 1972. (Copy attached) In addition, however, we also ask the Village Council to consider aspects of our original park plans which, in fact, include water containment areas in the Friendly Hills park sites as well as Interstate Park site. Project The Park Commission is aware of the history and o7,Eanizat1on of this project and is in support of its objective. This memo then serves to outline our views prior to the May 23, 1972 hearing on this subject. Our points of concern are as follows 1c, Rogers Lake provides one of the ras.in park sites in. the Village and the park will be developed for the benefit of all the residents of nerdota Heights, Of particular concern is the proposed svirming beac,h at the north end which, of course, will be extremely vulnerable to fluctuations in water level. No lake shore development can take place until a permanent shore line is established. 2® The entire west shore of Rogers Lake, now cl-sied by the Highway Department, will likely be added to our parkland, The water level here will then also be of concern, 3 Damage has been done and is being done, by the high water level,to • trees and vegetation along the entire shore. The above 3 points are, of course, in support of the project, and the Mendota Heights Park Conmission urges the Village Council to authorize the project, However, the Park Commission cannot terrdnate its evaluation of the project at that point. In addition to being concerned about the adverse effects of the high water level, so too rust the Commission be as equally concerned about the impact the lowering of the lake has en other park and - the nature thereof :and the devolonrent thereof. Ordinary and necessary maintenance and operating expenses for: 1. Public eofoty. (including law enforcement, fire protection, and building code enforcement); 2.
