explained that the dredged areas north of the Friendly Hills

the main concern of the letter. He stated -that this -area is
presently the'discharge'area for'the•Rogers Lake line and
that the Commission is fearful that when the'Rogers Lake
level project,'•is planned, no„consideration will be given to
'diverting water• into': these dredged areas. ;

Huber suggested that each of the Councilmen study

Councilman Losleben moved that Kevin Howe be reappointed
to the Parks and Recreation Commission for a term of.three
years, commencing on February 19 1973. Councilman Lockwood

PUBLIC Mr. Joseph Kulhanek, 95.3 Wagon Wheel Trail,
was'present to request deferment of the sanitary
sewer' assessment levied'' , against Lot 14',Parcel 26314, Caroline's`
Lake View Addition. :He stated that since the Council deferred
making the water assessment on this lot, he feels that the sewer
assessment should also be deferred. He-further stated that he
has contacted the Department of Natural Resources and.that he has
received a letter from them stating that Lot.14 is part of the ,
public waters of Rogers Lake. He also stated that th.e lot is
' •
completely under water.
Mayor Huber stated that he would like•to delay making a•
decision on the matter until after a decision has been reached
by the DNR on the Village's application to lower Rogers,Lake.

mayor Huber directed the.Village Administrator to study_th'
matter and to bring a•report to the Council after the DNR
decision has been received.
Councilman Lockwood pointed out that this is a very old assessment
.'which was levied in connection.with the Trunk Sewer System,
Improvement 4, Project 7D.
PUBLIC Mrs. Marilyn Nelson requested that the'Council
do something about the problem-of vehicles
being parked so close to the road at the Gulf Station on
Lexington Avenue and Highway 110.

Mayor ;Huber directed the Village Administrator to check the
setback regulations for that-area at the time the Station was '
constructed.
FEDERAL REVENUE Councilman Lockwood moved•the adoption of

ORDINANCE the departments of the Village, with the.
exception of -the Volunteer Fire Department,
have been placed under the Village Administrator, but up until_"'

this time, the Fire Department still adheres to the guidelines''
set forth under -the original Fire Department Ordinance. He
further stated that since the Volunteer.Fire Department is
a Village expenditure, he directed the Village Administrator to•
update the Fire Department ordinance to' mire, closely' align
the department with the other Village departments.

Village Administrator Johnson stated that the present•ordinan'ce
was copied directly from the League of Minnesota Municipalities
model ordinance. He further stated that the League also
listed some alternatives which could be inserted in the
ordinance, depending on the structure of the Village. He
noted the' -following differences or additions included in =.
the proposed ordinance.
Section 2', A,ppointments,.the wording was taken directly
from -one of the'League alternatives.
Section 3, Duties of Chief, some additional responsibilities
were included, providing for additional' reporting to,the'
Council and to the Administrator. Also, under the old
`.`
ordinance, the Chief,: Acting' Chief and Captain were to have
'
_been available twenty—four hours a day -- this has been "

deleted from the proposed ordinance because it is impractical.
Section 9, Special Organizations, subsection (a) is the same'
as the existing ordinance; subsections (b) and (c) were copied
from the Coon Rapids.Volunteer Fire,Department Ordinance and
provide for the election of officers of special organizations.--,
and the functions and duties of the officers of such special
organizations.
Section 11, Equipment, is a completely new section..
Mayor Huber stated that the wording in Section 2, Appointments;"
should be changed in line four to read "... takeinto consideration

•recommendations of the Village Administrator an� members of the'
Department,•"•and that line ten'should read 11 ... �ake into
consideration recommendations of the Village AdTinistrator."

Mayor Huber requested that copies be made available for

of $42,334 for MSA streets, and that for -the year 1973 the
Village will receive x.$53,625 allotment -- an increase of

sufficient funds to build-the east section of Marie Avenue,
from Dodd Road to Delaware Avenue, and that•Larry Shaughnessy, Jr.
Village Financial Advisor, will give him an outline on the,
financing for the-west section. Mr. Johnson also suggested that
perhaps a more firm policy on assessments on MSA street

construct a bicycle path along Marie Avenue in conjunction with th
proposed street improvements, and Village,Engineer Kishel
responded that construction of sidewalks, at least on the south

side of Marie Avenue, is being considered but that an expenditure

BECKMAN, YODER Village Administrator Johnson outlined for the

PLANNING Mr. Richard Bjorklund was present to request
COMMISSION an 818" variance from the 30' sideyard setback
CASE #72-34, requirement;forf a lot he owns located on the

BJORKLUND northwest corner of 4th Avenue and Dodd Road.
Mr. Bjorklund submitted a letter in which he
listed 50 homes north of Wentworth Avenue on corner lots which wer
constructed closer to the lot line than the stipulated 30'
rsetback.
He stated that the home which is proposed to be
constructed on this lot would cost approximately $45,000 and

that.the .future owner wishes to have the home face on Dodd Road.

He pointed out that the'owners of the property adjoining this
lot have no objection to the,variance'req'uest.

Councilman Wahl' ob jected to approval - of the. variance since the, , •,
variance had been turned down by the Planning'Commission; it is
also.his feeling that the variance could not be justified simply"
because there are other homes -in the area which do not comply
with the setback requirement..
Mayor Huber moved that a variance of 818" from the 30'
sideyard setback. requirement be granted for the south (4th~Avenue)
side of the lot located on the northwest corner of 4th Avenue
and Dodd Road. Councilman Lockwood seconded the motion....

LOWER Councilman Lockwood stated that the Village
MINNESOTA has thirty days left in which to draft an
RIVER WATERSHED ordinance covering the protection of the,
DISTRICT Lower Minnesota River Watershed District; if
ORDINANCE no ordinance is drafted, -the State has the
option -of drafting one for the Village.
mayorHuber directed the Village Administrator to contact
Attorney Haik and•to determine whether the State–drafted ordinance
would-be reasonably protective: if the ordinance is determined-'
•to be sufficiently protective,.he feels that the',Village.should
accept the State–drafted ordinance.
MISCELLANEOUS Councilman Wahl stated'that there is currentl'y',
no'Villege ordinance pertaining to enclosing
roof -top 'mechanical devices, and stated that he feels ,there shoulc
be some provision made which would cover such enclosures., He`•,

ointed out the appearance of the Tuminelly Office Center --
there is currently no enclosure around the roof-top•devices --,
and requested that Mr. Tuminelly be contacted and directed to
enclose the devices.. ' '
INVESTMENTS` Mayor Huber moved that the Village Clerk—
Treasurer be•authorized to -invest $100.9000
-in time savings certificates for projects -known as'12-07'and
that the Clerk–Treasurer be authorized to invest $229304 in
time'savings certificates for the fund known as Federal
Revenue Sharing.Fund. Councilman Wahl seconded the'motion:`

RESOLVED that the claims submitted to the Village Council for
payment, a summary of which is set forth on the -list attached
hereto and•identified as List of Claims submitted for payment,
January 169 1973, having been audited by the Village Council,
be and are hereby allowed and ;the Mayor and Clerk–Treasurer
of the Village of Mendota Heights,are hereby authorized and
directed'to issue Village checks in payment of said claims. A

Mayor Huber called the meeting to order at 8:00 o'clock P.M.
The following members were present: Mayor Huber, Councilmen
Lockwood, Gutzmer, Losleben and.Wahl.
HEARING --- Mayor Huber pointed'out that the purpose
SOMERSET"VIEW of the meeting is to conduct a hearing \

IMPROVEMENTS in the area known as the Somerset View.-,.

Addition. He stated that the hearing
was brought about by a petition received from people in the
area who are interested in obtaining cost figures for'street

improvement. He further stated that the Village Engineer has

prepared several reports outlining proposals for street
improvements for the area. He indicated that the Village
Administrator will explain the most economic proposal and that

after the explanation, the Council will hear comments and
questions from the audience. He requested that all comments

or questions be of a general nature and that anyone having

the coming week and that no decision on the project will be ,

Mayor Huber turned the meeting over to Village Administrator JohnE
for an explanation of the proposed.improvements.
Mr. Johnson gave a brief history of the proposed project and
stated that street improvements consisting of grading,
stabilization and bituminous sufracing are proposed for
Beebe. Avenue between Dodd and Delaware, Mears Avenue between

Coleshire Lane between Dodd and Dorset, Somerset Road between

An unidentified resident asked if culverts will be required of
those residents who don't have them at present. Mayor Huber
answered that culverts are not port of the project because
the inclusion of culverts mould rai,se the cost of the project

back to the original $29.00`por foot estimate. |
' Orro Wakefield, 5 Hingham Circle, asked whose responsibility
it is to keep the culverts open -- and stated that port of the
drainage problem exists because the culverts are not kept open.
' Mayor Huber responded that the Village maintains the culverts `

- .driveway culverts. '

Village Administrator Johnson stated that the $77,000 figure ' |
was included in the latter to indicate what the coot mould
be for the lowest grade, pooroat,type of /construction -- the
cost mould be approximately $7.50 per foot -- as opposed to
the proposed �l2B4OOO figure which would enable the construction

of streets that are as structurally sound as.aVy other residential!
street being built in the Village at this time. . � |

Mrs. Carolyn Lillo, 551 Emerson Avenue, asked if there is any
protection against reassessment for those people who own
double frontage lots. She wondered if those residents would
be reassessed for frontage at the other end of their lots
if at some future date construction is proposed for those
streets excluded from this proposed project. mayor Huber repliec
that assessments would only be made for construction on streets
on which the residence fronts. In the case of Emerson Avenue,
if Emerson is designated as a State Aid, Street at some time in t
future and is improved through State Aid Funds there would only
be nominal assessments. Village Administrator Johnson stated
that the Council would be reluctant to assess any double facing
lots for the cost of construction on both streets.
Dr. James Henry, 13 Dorset Road, stated that the streets have
adequately served the residents for the past 25 years and
requested that a poll be taken of the audience.
Robert Edman, 2 Dorset Road, asked if the Council will proceed
with the project even if the majority of the residents are again s;
it. mayor Huber replied that that question will be answered when
the Council votes on the issue.
Elroy Isaacson, 573 Emerson Avenue, asked why sodding was include'
in the project. Village Administrator Johnson stated that in ordt
to do proper excavation with a front—end loader, there must be a
minimum of six inches of work space between the edge of the
mat and the excavating area -- after the construction is
completed if sod is not installed there will be a six—inch
strip of mud along the streets. If the contractor puts black
dirt along the base it is likely that the edge of the street
would be a water—way during rainy periods and water would get
under the base of the street.
Harold Latham replied that the ruts in the streets are caused by
school buses and asked why something could not be done about the
school bus routing.
Councilman Lockwood stated that garbage and fuel oil trucks are
a similar problem but that little if anything can be done about
this type of problem. He stated that the Council must keep an ope
mind on this proposed project: this area is no different from
other areas of the Village where street improvements are needed
and the burden for such improvements must be borne at some time.
He pointed out that this project was petitioned for because of
the drainage problems and because some people are tired of the
poor street conditions. He stated that in fairness to those
people who want something better in terms of drainage and good
streets, something must be done -- nothing can be done about the
drainage because of economics, but perhaps with this proposed
project, these people will at least have streets equal to streets
in other residential areas.
Minutes -4- January 23, 1973
mrs. Jo Lockwood, 2 Hingham Circle, stated that she has not
heard any comments in favor of the project up to this point
and asked that those in favor of the project express their
reasons.
Arthur miller, 1 Dorset. Road, stated that he would like to
have a real estate appraiser state whether this improvement
would add to house values. He also asked whether this area
is one of the last to petition for street improvements.
Mayor Huber listed the streets in the Village which had been
improved.
Richard Bjorklund, 1260 Dodd Road, stated that he is definitely
in favor of the project. He further stated that people must,
realize that if this project is delayed for five years or more
the total cost will be much greater: the residents of this
area deserve good streets now. He also commented that the
construction will enhance and benefit all of the property included
in the project.
Mrs. Arthur miller, 1 Dorset Road, stated that it would be
illogical to let the streets remain in their present condition
and that if the project is delayed much longer the cost
will become even greater.
mayor Huber stated that anyone opposing the proposed project
may sign his name and address on a list which will be supplied
by the Clerk—Treasurer after the hearing.
ADJOURN There being no further discussion
or comments, Councilman Lockwood moved
that the meeting be adjourned.• Councilman Wahl seconded the
motion.

I have been a resident of Mendota Heights for thirteen years
and in that time have seen the population grow from 5,028
to 6,565, of which presently 2,655 are children. The need
for adequate parks and recreation has grown correspondingly.
Our dependency on surrounding communities for recreational
facilities is a thing of the past and it is time that we
meet our own -obligations. As a concerned resident I would
like to help.

Honorable Mayor and Council:
Over the last six years Midwest Planning and Research, Inc. has worked
with the Northland Company in the design of their industrial park located in
Mendota Heights. During this period of time, Midwest has also worked
for the Village providing technical planning assilstance in all phases of
planning. This arrangement was with the full knowledge and consent
of the Village Council..
It is my understanding that the Village Council prepared a letter to Midwest
several years ago regarding this working arrangement, but I have been un-
able to locate it in our files. Because of my inabiliWto find this letter
and even more important, the long period of time yAich has elapsed since
this arrangement was first agreed to, I feel this matter should be brought
before the Village Council for their consideration again.
The working arrangement Midwest would like to continue would allow
members of our staff, other than myself, to work with the Northland
Company in the continuing, development of their industrial park property,
' with all work done for the Northland Company, subject to the approval of the
Village Council in the same manner as any other developer.
If the Village Council feels that a conflict of interest would exist, any
further dealing with the Northland Company with regards to Mendota Heights
would not be considered.

called to order by Acting Chairwoman Ridder at 8:05 p.m. ori Wednesday,
January 24, 1973.

the required size and that the road layout seems to be the best of
all possibilities, giving good access to all the lots. Mr. 'Kopp
wants to subdivide the property into 31 platted lots."

Mrs. Ridder.said that the problem.is that Marie Avenue will be an
east -west thorofare through the Village, and if closed off, where
would there be access to Mendota Elementray School. Mr. Ruane said
that any road that runs to a school should be of the primary nature.
The only access to the school now is from the service road off
Lexington Avenue.
Mr. Kopp said that if la street is forced into the plans, then he
would not be interested in developing it because the street would

result in a dead end terminating in the school parking lot.
Mrs. Ridder suggested discussing the plans with the road engineer
to'see what future plans are proposed for a road by the school.
She suggested postponing the matter until the next meeting. }
Mr. Johnson and Mr. Ruone are to review.the prospects and discuss

them with the school district.
Mr. Schneeman moved that the'case be set for a public hearing at

BE IT FURTHER RESOLVED, that said Council 'bf the City of West Saint
Paul also requests that - the Dakota County Board of Commissioners actively
consider the.purchase of land and.construction of a recycling plant; and
BE IT FURTHER RESOLVED,,that copies of said Resolutions be forwarded l
to all communities and governmental divisions within Dakota County,
urging that said communities and governmental divisions adopt similar

WHEREAS, the West Saint Paul City Council on September 23, 1971,
adopted the following Resolution No. 71-150:
"WHEREAS, the'problems involved with solid waste disposal have
become increasingly evident recently, and
WHEREAS, the number of sites available for the dumping of solid
waste is becoming limited, and
WHEREAS, it has been determined that certain materials can be
effectively and economically recycled, and
WHEREAS, the West Saint Paul City Council is aware of the impending
necessity for more effective solid waste disposal and recycling,

Paul, requests the Dakota County•Board of Commissioners to consider• the
purchase of land for the purpose of a future recycling plant."

Dear Major Huber:
We are opposed to the proposed construction of streets
in the Somerset View Addition because a new grade would
only serve to prevent water from crossing from the east
side of Somerset Road to the west side where a catch basin
is located.
In addition to this, we believe that, with improved
roads, there will be an increase in through traffic from
Dodd Road to Delaware.
Ile have been satisfied with the roads that we presently
have. With a little improved maintenance, we think they
will continue to serve us for some 'time to come. I can
,find better uses for $1300 -at this point.

This letter is to confirm my telephone call of yesterday,
in which I indicated my strong; support of the proposed street -
paving project for the Somerset View area. In so doing I iden-
tify myself with a sizeable group of responsible- citizens •echo
have been attempting for several years now to get our -streets
'paved. The issue seems to have eluded us repeatedly, and we
have remained silent spectators as the problem has been deferred
and studied, year after year. Speaking for myself, I have had
enough discussion and study. I sense that many of my neighbors
feel the same way. 'Ne would like to see a responsive Council
take positive action at the earliest possible time to bring the
streets of Somerset View up to standards of construction and
maintenance which will* at 1 -east compare favorably with those of
-the rest of the Village.

Gentlemen:
This letter is to advise the Council of the desire of the Robert Wolters
family, residing at 11 Dorset Road in the Somerset View Addition, to be
duly recorded as "pro" road improvement and in favor of the currently
proposed $128,000.00 improvement:
We further request two pertinent items be reviewed and included in this
project.
1. The intersection of Dorset Road and Mears Avenue be made a 2 -way,
or more preferably, a 4 -way stop. The blatant misuse of these two
streets as "speedway shortcuts" to Highway 49 must be curtailed. Our
children have had enough close calls. I fepr that the street improve-
mprovements
mentswill increase their jeopardy.
2. Currently, the portion of our property parallel to Dorset Road
receives the sand run-off from the street'•and plugged culverts during
each moderately heavy rain. Raking the gravel from the grass is not
the most desirable summertime project. Any possible means of
relieving this problem would be appreciated.

I want to thank you and the Council members for the well conducted public
hearing on -the street improvements in the Somerset View Area. Considering
my past record with my neighbors, I felt I did well to keep my mouth shut,

and am glad Dick Bjorklund finally came to the defense'of those of us that
feel something has'to be done. Another few minutes and I would have been
in trouble.

After having driven the streets for some 18 years, I think it is time that '

we deserve "something better". 'I think the compromise to the existing

width is reasonable, and believe the only way we can expect to maintain the
appearance and value of the neighborhood, is to bo ahead with the improve-

consider that this area is about the only one in the Village where the

property owners have maintained their lots to the road, it is reasonable

.I was one of the original signers requesting that the condition
of the streets in the Somerset View ar6a be investigated. I
commend you and the Council for your investigation, and concur

with your recommendation that the streets be resurfaced at the
present width. '
I also concur with your course of action taken regarding Emerson.
The one point I do question, however, is proceeding with the im-
provement of the other streets while Emerson is left in its
present condition. I am afraid of a significant increase in
thru-traffic on Mears and Staples. This,,I feel, would be very
detrimental to the occupants of the neighborhood unless stop ;
signs are provided at all intersections on Mears and Staples.

In conclusion, I give your street improvement program a conditional
support, the condition being whether Emerson is impioved at the
same time, or stop signs are provided at all intersections on
Mears and Staples.

the necessity of two-way stop signs
on Dorset Road and Mears to stop
THRU speed traffic from Dodd Road
and vice versa. (Ivy Falls stop
signs -do an effective job). Good
or bad roads, this is an immediate
need!
The road study sounds feasible. We
would surely like to avoid this big
expense, but do acknowledge the roads
need improvement. If the work is
done, believe it should be the
cheapest, basic standard quality job,
with no frills or sod - also roads
no wider than 18-22 feet.

WHEREAS, e resolution of the Village Council adopted
on December 5, 1972, fixed a dote for a Council hearing on
the proposed improvement of:

WHEREAS, the Village Engineer reported that the proposed
improvements consisting of grading, stabilization, and
bituminous surfacing of the streets in the Somerset View area
are feasible and deoireabla and reported the proposed cost
of said improvements; and
WHEREAS, the hearing was held on January 23, 1973 at
which hearing all persons desiring to be hoard were given
an opportunity to be heard;

NOW THEREFORE IT IS HEREBY RESOLVED by the Village Council
of the Village of Mendota Heights that such improvement is
hereby ordered as proposed in the resoluti/n adopted
December S, 1972; '
BE IT FURTHER RESOLVED that the Village Engineer is hereby
instructed to proceed with the preparation of the necessary

RESOLUTION NO.
RESOLUTION APPROVING CONCEPT 'OF JOINT LAW
ENFORCEMENT COUNCIL FOR DAKOTA COUNTY
WHEREAS, a Joint Law Enforcement Council has
been proposed for Dakota County; and
WHEREAS, a Joint Law Enforcement Council would
enable municipalities to collectively initiate programs
which could not otherwise be initiated on an individual
basis;
NOW THEREFORE IT IS HEREBY RESOLVED by the Village
Council of 'the Village of Mendota Heights that the
concept of a Joint Law Enforcement Council to serve
Dakota County is hereby approved;
BE IT FURTHER RESOLVED that the Village Council
herewith encourages all other municipalities located
within Dakota County to endorse and approve the concept
of a Joint Law Enforcement Council.
Adopted by the Village Council of the Village of Mendota
Heights this day of February, 1973.

SUBJECT: Joseph Kulhanek, 953 Wagon Wheel Trail
Request for Sewer Assessment Deferment
On January 16 Mr. Kulhanek appeared at the Council
meeting requesting that a previously levied sewer
assessment be deferred. One of his arguments is in the
form of a letter from the Department of Natural Resources
noting that "A permit would be required to do any work
in the bed of a public water below the normal high water
level and it is a policy of the Department not to allow
any filling on the beds of public waters below the high
water level." The several assessments levied against
his two lots have been researched and the following
information is submitted for your consideration.
In September, 1969 sewer levies were established
as follows:
Lot 14 (the undeveloped lot
partially under water)
$1,152.50 Trunk Sewer Assessment
Lot 15 (lot with house)
$1,025.00 Trunk Sewer Assessment
$2,080.00 Lateral Sewer Assessment and
service connection
$3,105.00
The records indicated that an assessment of $3,352.50
was originally calculated for Lot 14 for sewer in
September, 1969. The final assessment sheets, however,
indicate that only $1,152.50 was assessed. By deduction
it is assumed that the lateral assessment of $10.00 per
foot against the 220 foot width, equalling $2,200.00

was judged not equitable and hence was dropped.
Since the sewer assessment of $1,152.50 equals
the Trunk Sewer assessment rate for Lot 14, and since the
records do not reflect a lateral assessment against the
220 feet, one can only come to the conclusion that only
a Trunk Sewer assessment has been levied against Lot 14
and, in fact, any normal search of the records would
reveal no lateral assessment (levied or deferred) against
said Lot 14.
Our checking also revealed that in October, 1971
water assessments were levied as follows:
Lot 14 -- assessment deferred
Lot 15 -- $2,290.00
In conclusion then, it is recommended that the
current Trunk Sewer assessment not be deferred and that
the records be officially modified to show a deferred
assessment of $2,200.00 against Lot 14. It must be
remembered that any possible change in Rogers Lake
elevation would also enhance the value of Lot 14 which may
in fact make it a buildable lot in the future.

METROPOLITAN AIRPORTS COMMISSION MEMBERSHIP.
H.F. 273 would broaden the membership
on the Metropolitan Airports Commission as
follows: two members of the Minneapolis City
Council; one member of the Bloomington City
Council; one member of the Mendota Heights
Village Council; one member of the Richfield
City Council (all such members to be appointed
by their respective councils); one additional
member from each of the cities of Minneapolis
and St. Paul who is a freeholder, has resided
in the city for at least ten years, and holds
no public office other than notary public and
to be appointed by the mayor with council ap-
proval; and one member to be appointed by the
Governor who would be the chairman.
Terms of incumbents would terminate on
the first Monday in January, 1974 with the new
commissioners tobe appointed on or before that'
time for six-year terms, except that terms of
commissioners who are municipal Council
members would terminate when they cease to be
council members. Vacancies would be filled in
the manner provided for original appointments
and for the unexpired term.

JOINT LAW ENFORCEMENT COUNCIL AGREEMENT
The undersigned governmental units, namely all Municipalities
and/or Villages, and the Gounty of Dakota hereby recognize the need
to prepare to deal adequately with current crime problems and
problems of law enforcement which could intensify with continuing
population growth and changes and which are of a regional nature
and are occurring or likely to occur within the region represented
by Dakota County.
WHEREAS, they likewise recognize that they do all have the power
to and do in fact maintain police departments and police personnel,
and
WHEREAS, one of the stated purposes of this Council shall be to
preserve the authority and responsibility of local law enforcement
to the extent to which it is practical and economical, and
WHEREAS, the undersigned governmental units recognize that
pursuant to the provisions of the Joint Exercise of Powers Act,
Section 471.59 Minnesota Statutes Annotated, that they do have
the authority to enter into this agreement where they are jointly
and cooperatively exercising a power common to all of the contracting
parties and pursuant to this and in order to insure that a proper
regional organization be established representative of the various
municipalities involved with authority and responsibility to
research and study problems of law enforcement of a regional nature,
together with the authority and power to implement such regional
services as hereinafter set forth and that the parties hereto do
hereby establish the following organization with the management
authority vested therein as set forth as follows:
1) The name shall be: DAKOTA COUNTY JOINT LAW ENFORCEMENT COUNCIL.
2) That it would be subject to the management of a council whose
membership would be constituted by appointment on' an annual basis
by each of the participating governmehtal units of their Chief of
Police together with bne'other individual to be appointed by the
Village or City Council, and that the County would be represented
by the Sheriff and one other individual to be appointed by the

(d) That the Council shall have the authority
to make application for State and Federal funds, to
enter into contracts with various State and Federal
agencies in regard to the expenditure of such funds; the
Council shall have the authority to make application to
and receive funds from various foundations, organizations,
or individuals to assist the Council in carrying out its
responsibilities; the Council shall have the authority
to receive funds from any local governmental units to
assist it in carrying out its responsibilities.
(e) The Council shall prepare a budget detailing
the anticipated expenditures for each calendar year and
shall submit said budget to the County Board by
September lst. The County Board shall have the authority
to make such alterations in the budget as they deem proper
and necessary and shall proceed to levy taxes as needed
to fund the budget as approved.
(f) Any new programs may be initiated by the Council
upon majority vote of its members at any regular meeting
of the Council.
(4) That the Village of Mendota Heights may withdraw from
this Agreement upon ninety (90) days written notice to the
Council.
IN WITNESS WHEREOF, we, the undersigned, on behalf of our
governmental units, do hereby bind ourselves in accordance with
the terms and conditions of this agreement, executed
