Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Lockwood, Losleben, Gutzmer and Wahl. APPROVE Councilman Lockwood moved approval of the MINUTES minutes of the January 16 meeting. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 APPLICATION FOR Mayor Huber acknowledged receipt of a APPOINTMENT TO letter from Mrs. Jacquelyn David, PARKS AND 645 — 1st Avenue, in which Mrs. David RECREATION requested that she be considered for appointment COMMISSION to the Parks and Recreation Commission. MIDWEST PLANNING Mayor Huber acknowledged receipt of a letter AND RESEARCH from Mr. Jim Ruone of Midwest Planning and Research wherein Mr. Ru ne requested permission for Midwest planning to continue working��n{ith the Northland Company in t�e design of their industrialipark and at the same time continue working as the Village Planner. Mr. Ruone stated that Northla'd plans to start marketing the land and Midwest Planning will look into market research fir them. . 3 Mayor Huber stated that if Midwest Planning continues in the same manner as it has in the past with they Village being Midwest's primary concern and Northland being the s'condary concern, he can see no conflict of interest. Councilman Lockwood moved that the Villag� Council approve Midwest Planning and Research's request t� perform services -for Northland Company in the areas of site planning, site design and market research, and at the same time Midwest may continue to work as the Village's Planner. Councilman Losleben stated that he had spoken to a number of people in the Somerset View Addition and that most of the objections were either based on the fact that the project is not proposed to include curbs and gutters'and storm sewers or because they object to the cost. Councilman Wahl stated that apparently there are more people in favor of the project than agoinst it. He asked Engineer Ken Meyer if new culverts will be included in the project in the Mears Avenue and Somerset Avenue areas to help alleviate the water problem. Mt. Meyer stated that there are culverts under the main streets and it is planned that aprons will be put onithe existing culverts. There will be no change in the size of the culverts. + �' Councilman Lockwood stated, that since the feasibility hearing he has contacted approximately 60% of,the residents in the area and that the majority of those residents favor the project. He pointed out three possible alternatives to the project but he stated that none of the alternatives would be permanent and that the alternatives would only please those residents who do not wish to pay the assessment costs for the proposed improvement or those who wish to retain the rustic appearance of the area. Mayor Huber stated that he feels that the project is necessary on the basis that a majority of the people favor it and also because the ability of the Village to maintain the streets as they currently exist is diminishing. He 61so exprpssed the Council's appreciation for the responses, poth for and against the project, which have been received. ! Mayor Huber moved adoption of Resolution Number 73-09, "RESOLUTION ORDERING STREET IMPROVEMENTS TA SERVE THE SOMERSET VIEW AREA AND ORDERING FINAL PLANS AND SPE IFICATIONS THEREFOR." Councilman Lockwood seconded the motion. Ayes: 5 'Nays: 0 STREET MAINTENANCE Village streets. PARKS AND RECREATION COMMISSION APPOINTMENTS The Council briefly discussed a memo from Village Administrator Johnson outlining street maintenance costs; by areas, for �. Councilman Gutzmer moved that Mr. W. Gerald Lundeen be appointed to he Parks and Recreation Commission for a three , year term. Councilman Losleben seconded the notion. Ayes: 5 'Nays: 0 e Minutes —4— February 6, 1973 Councilman Losleben moved that Mrs. Madelyn Shipman be appointed to the Parks and Recreation Commission to complete the balance of Councilman*Losleben's term (one year) on the Commission. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 PETITION FROM The Village Council acknowledged receipt of a EAGLE RIDGE petition from residents of the Eagle Ridge area RESIDENTS requesting that the Village Council review traffic flows at the intersection of the Interstate 35E exit and Victoria Road with Trunk Highway 13 with the ultimate hope that the intersection be redesigned at some future time. Mayor Huber stated that the intersection is very bad because of poor visibility and referred the matter to the Planning Commission for study and a report to the Council. Mayor Huber also directed the Village Administrator to notify the Eagle Ridge residents of the Council action. JOINT LAW Police Chief Baldwin outlined the proposed ENFORCEMENT .Dakota County -Joint Law Enforcement Council COUNCIL Agreement for the Council. He stated that the Agree:m,ent would..allow the various law enforcement ggencies within the County to work together under County funding and that under the Agreement, the Village Council would appoint one person to the Joint Council and the Police Chief would also be a member. Village Administrator Johnson stated that the Joint Law Enforcement Council is a method of coordinating all the Police departments in Dakota County and allowing them to work jointly with State and Federal agencies. i Mayor Huber moved adoption of Resolution Number 73-10, "RESOLUTION APPROVING CONCEPT OF JOINT LAW ENFORCEMENT COUNCIL FOR `DAKOTA COUNTY." Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 SQUAD CAR BIDS Village Administrator Johnson stated that based on figures received last summer, a provision for leasing rather than purchasing a squad car for the Police Department was placed in the 1973 Budget. He further stated that the figures for leasing a squad car have escalated since the budget was prepared and that it would now be more economically feasible to purchase a squad car to replace the present car (station wagon). Councilman Gutzmer move that specifications be written for the purchase of a 1973 squa car and that bids Ibe let with March 1 being the date for opening of bids. Councilman Lockwood seFonded the motion. Ayes: 5 Nays: 0 Minutes APPLICATION FOR BUILDING PERMIT RICHLINE CO. z —5— February 6, 1973 Mr. Russell Richardson, President of the RichlinQ Company was present to request a building permit to construct an addition onto the Company's present facility. Mayor Huber stated that the north side of the building should be painted and that landscape pla�s should also be submitted. Mr. Richardson stated that the building contract calls for repainting of the entire building. He requested that he be allowed to submit a letter to the Council thereby making a commitment for appropriate landscaping. He stated that he will be out of town for some time and will not have the time to work out landscape plans at this time. Mayor Huber moved that the building permit be issued to the Richline Company based on the Building Inspector's verification of the engineer's signature on the plans and also subject to submission of a letter indicating that appropriate landscape plans will be submitted and also subject to submission of mechanical and electrical plans. Councilman Wahl seconded the motion. Ayes:`5 Nays: 0 1973 SERVICE Mr. Lee Starr and Mr,. Larry Ritenauer of CONTRACT -- Beckman, Yoder and4Seay submitted to the BECKMAN, YODER Council copies of a proposed 1973 contract AND SEAY for park planner services. The Council raised several questions regarding provisions of the contract, primarily those provisions contained in pages 5 through 8. The Mayor directed the Village Attorney to work with Beckman, Yoder and Seay to rework pages 5 through 8 of the contract, giving primary consideration to paragraph 3, page 5, paragraph B, page 7, and the top three lines of page 8, which should be changed to indicate that all original drawings, specifications and other data will remain the property of the Village. REQUEST FOR SEWER ASSESSMENT DEFERMENT — KULHANEK that no sewer this property. of the Village he recommended Village Administrator Johnson outlined for the Council a memo regarding the sewer assessment levied against property`Mr. Kulhanek owns, known as Lot 14. Ayes: 5 Nays: O MARIE AVENUE Village Administrator Johnson stated that IMPROVEMENTS on January ---Z6 he had submitted to the Council a memo outlining the dooireability of calling for a public feasibility hearing on Marie Avenue improvements from Dodd Road to Delaware Avenue, and that he had also submitted a preliminary re'ort and cloet eatimat6 which had been submitted by the Village Engineer. Mr. Johnson requested that a feasibility hearing be called for February 27. 1Q0 Councilman Gutzmor moved adoption of Resolution Number 73—II, "RESOLUTION ACCEPTING FEASIBILITY REPORT AND CALLING FOR HEARING FOR STREET IMPROVEMENTS ON MARIE AVENUE BETWEEN DODD ROAD AND DELAWARE AVENUE," the hearing to be held on February 27. Councilman Lockwood seconded the motion. Ayes:,5 Nays: O FIRE DEPARTMENT The Council acknowledged receipt of the MONTHLY REPORT Fire Department monthly'repoTt for January. HOUSE FILE 273� Village Administrator Johnson stated that METROPOLITAN Representative Raymond Ke0pe and others have AIRPORTS authored a bill which would enlarge the COMMISSION membership of the/ Metropolitan Airports MEMBERSHIP Commission. Mr. Johnson submitted to`the Council copies of the League of Minnesota Municipalities Legislative Bulletin reprint of H.F. 273 for the Council's information. Mayor Huber directed the Village Administrator to write to each of the authors of the bill expressing the Council's appreciation for the action and stating the Council's support of the bill -- the Council would be glad to testify on behalf of the bill. 'I 4 r it Minutes —7— February 6, 1973 SEWER Village Administrator Johnson outlined for RENTAL he Council a memo in which he has proposed CHARGES Q-1, new rate schedule for sewer charges for multiple dwelling, commercial and industrial users. The matter was held over for further study. RESOLUTION Village Attorney Winthrop stated that property NO. 73-11 located near Wentworth and Wachtler Avenues and known as Parcel 26147-0 is tax forfeit property and stated that the Village should adopt a resolution requesting the County to turn over this tax forfeit property to the Village for'park purposes. Mayor Huber moved adoption of•Resolution Number 73-12, "RESOLUTION AUTHORIZING -REQUEST FOR CONVEYANCE TO VILLAGE OF TAX FORFEITED PROPERTY.". Councilman Wahl seconded the motion. Ayes,:..5 Nays: 0 PARK Attorney Winthrop recommended that the Village PROPERTY Council authorize the purchase of five lots in the Friendly Hills area adjacent to the Friendly Hills park site. The present owner is the Rauenhorst Corporation and the purchase price requested for the five lots is $5,000. Councilman Gutzmer moved adoption of Resolution Number 513, "RESOLUTION AUTHORIZING PURCHASE OF ADDITIONAL PARK LAND FOR THE FRIENDLY HILLS AREA." Councilman Losleben seconded the motion. We of Richline are proud of our community and you can trust our cooperation will be extended. A further note - will you gentlemen accept my apologies for the rather urgency to our recent request for the building permit. Richline is growing, which is obvious, in people, sales, and need for larger manufacturing space. We have grown from $500,000 in yearly sales to an expected $2,000,000 in sales. Also our products are being shipped to many overseas countries. Within the past month, the United States Department of Commerce sel- ected Richline to be one of fifty United States Manufacturers to ex- hibit their products at the forth coming United States International Village of Mendota Heights t_ Page 2 February 7, 1973 Trade Conference, to be held in Moscow, Russia, during the month of May. Part is self-explanitory, as many details are being worked out to travel to this event. Mrs. Richardson and myself are included in this exhibition. AN ORDINANCE REGULATING TIIE PARKING OF MOTOR VEHICLES ON PRIVATE PROPERTY, ON PRIVATELY OWNED PARKING LOTS AND ON PARKWAYS, IN PARKS, AND UPON bTHER PUBLIC GROUNDS, AND PROVIDING A PENALTY FOR VIOLATION THEREOF , RECEIVE13 VEG 7 1973 The Village Council of the Village of Mendota Heights ordains as follows: Section 1. Consent for Private Parking. No person shall park or leave a motor vehicle standing upon the private property of any other person without first receiving consent of the owner of such' property. Section 2. Special Parking Areas. Special parking areas may be designated by the Village Council from time to time by resolution for truck parking or for taxicab parking and when so designated, no other vehicles may stand, stop, or park in such areas. Section 3. Motor Vehicles on Privately Owned Parking Lots. A. Maximum Speed. No person shall operate a motor vehicle on any privately owned parking lot or parking area within the. Village at a speed greater than is safe and reasonable under the condi- tions of traffic then existing therein, and in no event shall any such vehicle be operated in excess of a speed of 15 miles per hour. All operation and driving of motor vehicles on such parking lots or parking areas shall be done in a careful manner so that no sudden starting or erratic movement of such vehicle is deliberately engaged in by the driver. It shall be unlawful for any person to operate any motor vehicle upon such parking lot or parking areas in any manner that would consti- tute careless driving if done on a public street. No person shall engage in•any drag racing or exhibition driving on any such parking lot or parking area. B. Parking Uniformity. Parking of vehicles on such parking lots or parking areas shall conform to the markings of stalls or positions for parking which are designated on the surface of the parking area and no vehicles shall be parked or allowed to stand in any area of such parking lot or parking area which has been designated or is used as a lane for moving traffic so that such parking will interfere with the movement of traffic therein. C Si ns. The Police Department of the Village may post signs kjt at any entrance to a privately owned parking lot from a public street which shall designate one-way traffic for entrance and exit and the driver of any vehicle entering or leaving such lot shall comply with any signs so posted. D. Notice of Collision. In the event that any person who drives a motor vehicle upon such a parking lot or parking area becomes involved in a collision between the vehicle he is driving and any other vehicle or vehicles, parking upon said lot or area, such driver shall leave a notice upon each unattended vehicle with which he has collided, giving his name, address and license number. Failure on the part of any person to comply with this paragraph shall constitute a violation of this ordinance. Section 4. Vehicles on Parkways, In Parks Or Upon Public Grounds. I A. Regulations. The operator, driver, owner or person in charge of any vehicle propelled, used or driven over or upon the streets and roads of the Village must observe'all of the following regu- lations upon all parkways and within the limits of all parks and upon any publicly owned grounds in said municipality: (1) No vehicle shall be left standing or parked except in designated parking spaces, and vehicles must be parked so that an unobstructed view into the interior of the vehicle may be had at all times, and no curtains, papers or coverings of any kind shall cover or conceal the front, rear, or side windows of any parked vehicle. I (2) No vehicle shall be left standing or parked upon any foot path or in any area in which parking is restricted. (3) No person shall be in any park, and no person shall remain in or leave any vehicle in any park, or upon any parkway or public grounds between the hours of eleven O'clock P.M. and six o'clock A.M. of the following morning. Nothing in this section shall apply to persons traveling upon established driveways of parks, or upon parkways. Section 5. Person. The term "person" as used in this ordinance shall mean and include individuals, partnerships, associations or corporations. Section 6. Any person failing to comply with the provisions of this Ordinance shall be guilty of a misdemeanor and upon con- viction thereof shall be punished by a fine of not to exceed $300 or by imprisonment for not to exceed ninety days.
