Huber Mayor SUBJECT: 1976 Police Negotiations with Local 320; and 1976 Public Works Salary Negotiations I regret that I will be unable to be in attendance at the November 4 meeting at which the above subjects should be covered. However, I do have a recommendation for the Council. A detailed review of the past joint negotiations conducted through the M.A.M.A. appear to many of the metropolitan communities as possibly not the most desireable method of negotiating these contracts. It is for that reason and others that I would like to have the Council agree to conduct our own negotiations with the employee groups this year and return the proper forms to the M.A.M.A. group. Further, I would like to see City Administrator Orvil Johnson and Jim Losleben accept the nomination to form a negotiating committee for Mendota Heights. In the suggested limit of one Councilman only to the committee, I am recognizing the possible conflict with the open meeting law should we enlarge the committee. I would hope that this particular proposal could, without extensive deliberation, be approved by the City Council at the meeting of Tuesday, November 4. Adoption of I-494 Resolution Iloward Dahlgren, Subcommittee member, remarked that, based on the extensive amount of information and data that the Subcommittee has received and the innumerable excellent sources that have been at the meetings in thV last three months, capped off by the lucid summary by Mr. Wolsfeld, the Subcommittee from St. Paul should be ready to make recommendations with respect to 494 in a more specific way from last week when the route was adopted as a corridor. Mr. (Dahlgren suggested that it is essential that we complete the missing link in the 494 circumferential system as it now exists. Ile than made the, follov+i:ig motion: MOTION: It was moved by Iloward Dahlgren and seconded by Donald Huber that the Subcommittee recommend to the TAB and Metropolitan (:ouncil, and ultimately to the legislature, that we build 494 from its present terminus in East Bloomington to the Mississippi River in St. Paul, along the existing general right-of-way as partially acquired and as currently proposed under the following conditions: 1) That the interstate system in this orea be a minimum 6 -lana facility. 7.) That there be complete, full interchange; facilities betwren 494 and 35E. 3) Thiit the riirr!ct interchange between I:ighwiiy 55,am1 the: 494-351; f.u:ilitil::; bu de-emphasiz(:d with .ecus provided by local minor arterial routes. 4) That we retain Highway 55 in its present right-of-way alignment on a long-term projected basis, thereby eliminating the dual/dual concept. 5) That we plan for a second bridge to be constructed across the Mississippi River to accommodate future traffic needs at 494 and the Mississippi River in South St. Paul. 6) That the basic design solution to be constructed in the corridor outlined be generally based on the first stage development proposal as presented by the Minnesota Highway Department during the course of these sessions. 7) That all construction shall be accomplished in a manner so as to provide maximum concern for the deleterious impact of noise, vibrations, and air pollution on contiguous properties and through the corridor. The motion was voted on and passed unanimously. in the discussion following the adoption of the resolution, there was concern expressed in relation to Sunfish Lake. Chairman Johnson noted that the option to amend the resolution should definitely remain open. Other Business Chairman Johnson referred to the evening's agenda and noted that the discussion on the first part of the draft report prupiirml by thn Coordinative staff would be delayed due to the time constraints. Mr. Merritt Linzie remarked that he had some preliminary air quality data on 35E that would be available to the Subcommittee members. Adjournment Being no further business before the Subcommittee, the meeting was adjourned at 10:10 p.m. Page 586 October 7, 1975 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, October 7, 1975 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Gutzmer, Losleben, Lockwood and Wahl. APPROVAL OF Councilman Wahl moved approval of the minutes of the MINUTES September 16 meeting as corrected. Councilman Gutzmer seconded the motion. Ayes. 5 Nays: 0 FINAL PAYMENT, After a brief discussion, Councilman Lockwood moved the CULLEN AVENUE adoption of Resolution No. 75-79, "RESOLUTION ACCEPTING WORK IMPROVEMENTS AND APPROVING FINAL PAYMENT (IMPROVEMENT NO. 75, PROJECT NO. awarding final payment of $5,203.00 to Pine Bend Paving, Inc. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 BID OPENING AND Financial Advisor Larry Shaughnessy opened the bids received or AWARD, BOND SALE the sale of $300,000 permanent improvement bonds. Councilman Lockwood moved the adoption of Resolution No. 75-80, "RESOLUTION ACCEPTING BID ON SALE OF $300,000 GENERAL OBLIGATI{ IMPROVEMENT BONDS OF 1975 PROVIDING FOR THEIR ISSUANCE AND LEVYING A TAX FOR THE PAYMENT THEREOF," awarding the bid to Juran and Moody, Inc. Councilman Losleben seconded the motion. MENTS After a brief discussion, Councilman Losleben moved the adoption of Resolution No. 75-81, "RESOLUTION ACCEPTING BIDS Page 587 October 7 ,1975 AND AWARDING CONTRACT FOR CHERRY HILLS SECOND ADDITION IMPROVEMENTS (IMPROVEMENT NO. 75, PROJECT NO. 2)," awarding the bid to the Robert W. Moore Company in the amount of $215,560.30. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 COMMUNICATIONS The Council acknowledged receipt of a letter from Senator Hubert Humphrey regarding a meeting of the Land Use and Physical Development Subcommittee to be held at the Eagan City Hall on October 15, 1975. The Council also acknowledged receipt of a letter from the Dakota County Planning Director regarding a meeting of the Dakota County Planning Advisory Commission to be held on Octobez 9 for a discussion of the Regional Park Master Plan proposals. DEPARTMENT REPORTS The Council acknowledged receipt of the Police Department monthly report for July and August, and the Fire Department monthly report for September, 1975. uOivRAISSION REPORTS The Council acknowledged receipt of the Park and Recreation Commission minutes for August 27 and September 24, 1975. PLANNING The Council acknowledged receipt of the Planning Commission COMMISSION minutes for the September 23 meeting. CASE NO. 75-16, Mayor Huber opened the meeting for the purpose of a hearing McLONALD'S; CASE on an application for Conditional Use Permit for fast food NO. 75-17, restaurant submitted by the McDonald's Corporation. SHEEHY City Administrator Johnson outlined the history of the McDonald's application for conditional use permit, as well as for variances for parking setback and sign height. Mr. Johnson reviewed reports submitted by Planner Dahlgren regarding the applications, and referred specifically to paragraphs 2 and 3 of the October 7 report. McDonald's requested a two -foot concrete curb on the southerly lot line rather than a ten foot green area (setback). Mr. Johnson also referred to the Planner's comment on McDonald's request for a variance for height of the pylon "Golden Arches" sign. McDonald's application is for a 39 foot high sign (25 foot pole) rather than the 25 foot ordinance limitation. The sign is to be located at the northeast corner of the McDonald's site. Admin- istrator Johnson also referred the Council to a proposed resolution regarding the conditional use permit. Mr. Randy Berg, representing McDonald's, outlined for the Council a drawing of the proposed site and building. He also answered several questions for the Council. In conjunction with the McDonald's application, the Council discussed a request for subdivision of property submitted by Richard Sheehy The preliminary plat concerns the area north of the existing shopping center. Administrator Johnson noted portions of the Planner's report, particularly the division of the property into three lots, and the fact that the McDonald's ingress and egress does not penetrate the shopping center site. The plat is divided into Lot 1, which will be the pond site, Lot2, which Page 588 October 7, 1975 is the McDonald's site, and Lot 3, which is the shopping center site. There was considerable discussion on the curbing proposed to be constructed on the Sheehy property; on the continuation of an asphalt surface behind and around the shoppi center building to accommodate peak McDonald's traffic; and on the division of the property into three lots. Mr. Sheehy explained his reasons for wanting the pinned -type concrete. He also objected to a suggestion that he supply additional landscaping in addition to that shown on his plans. CThe Council members opposed bituminous curbing or pinned-concre curbs. Mayor Huber objected to the division of the property into three lots and requested that the property be divided into only two lots, one lot for the McDonald's site, and the other for the shopping center and pond site. After a brief discussion, Mr. Sheehy agreed to plat the property into the two lots as requested by the Council rather than the three lots as proposed. Mayor Huber, the Council and City Administrator drew several revisions on the Sheehy site plan and preliminary plat for incorporation into the final plans. There being no questions or comments from the audience, Mayor Huber moved that the -hearing be closed. Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 The hearing was closed at 10:10 o'clock P.M. Councilman Losleben moved approval of the application for variances for setback and sign height for McDonald's. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 Councilman Gutzmer moved the adoption of Resolution No. 75-82, "RESOLUTION GRANTING CONDITIONAL USE PERMIT TO MCDONALD'S CORPORATION FOR FAST-FOOD RESTAURANT," as amended. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 Mayor Huber moved that the preliminary plat for the Sheehy property be approved subject to the revisions .drawn by the Council and subject to receipt of a performance bond in favor of the City, the project completion date and bond amount to be determined by the City staff. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 Case No. 75-22, The Council briefly discussed the application from SCHNEIDER Julius Schneider to subdivide Lots 1 and 2, Block 4, T.T. Smith Subdivision No. 2. The Council discussed the possibility that there have been some deferred assessments on the property and also the drainage characteristics. Mayor Huber moved approval of the preliminary plat subject to payment of all assessments on the property and inclusion of proper drainage easements on the final plat. Councilman Losleben seconded the motion. Ayes; 5 Nays. 0 Page 589 October 7, 1975 CASE NO. 75-24, Mr. and Mrs. David Bye were present to request approval of a BYE variance from the lot size requirement for Lot 12, Block 2, John H. Morrison Addition. The lot is 60 feet by 125 feet. After a brief discussion, Councilman Wahl moved approval of the lot size variance, subject to payment of any deferred assessments. Councilman Gutzmer seconded the motion. Ayes: 5 C- Nays: 0 MARIE AVENUE After a brief discussion, Mayor Huber moved that the completion IMPROVEMENTS date for construction of Marie Avenue improvements (Improvement No. 73, Project No. 2) be extended to November 1, 1975. Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 MISCELLANEOUS The Council acknowledged receipt of the Engineering Status Report for September, 1975. TENNIS COURTS The Council acknowledged receipt of the plans and specifications for tennis courts proposed to be constructed at Rogers Lake and on the property to be acquired from J. McGough. After a brief discussion, Councilman Losleben moved that the staff be directed to advertise for bids for tennis courts construction, the bid opening to be held on October 20. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 IVY FALLS WEST Engineer Kishel presented the final plans and specifications AUDITION for the Ivy Falls West sanitary sewer improvements. The City Attorney pointed out that prior to construction of the improvements, it will be necessary for James Riley to submit easements for cutting and sloping; and a letter from Mr. Riley certifying that he is the owner of the property. The Council concurred with the recommendation. After a brief discussion, Councilman Losleben moved the adoption of Resolution No. 75-83, "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR IVY FALLS WEST ADDITION IMPROVEMENTS (IMPROVEMENT NO. 75, PROJECT NO. 3)." Councilman Gutzmer seconded the motion. Page 591 October 7, 1975 SURPLUS Public Works Inspector Pearson explained his memo and request EQUIPMENT that the 1956 Diamond T dump truck be declared surplus equipment and be disposed of. After a brief discussion, Councilman Gutzmer moved that the 1956 Diamond T be declared surplus equipment and that the Public Works Inspector be authorized to accept bids*for the sale of the truck. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 DELAWARE AVENUE City Administrator Johnson explained that the total financial PEDWAY obligation for the Delaware Avenue pedway construction amounts to approximately $41,000. The Mendota Heigh is financial obligation would be one-third of the construction cost. He recommended that the Council authorize financial participation in the project. Ayes: 5 Nays: 0 C. E. T. A. Councilman Lockwood seconded the motion. Administrator Johnson outlined his memo regarding a salary increase for the CETA employee, Daniel Loiselle. After a brief discussion, Councilman Losleben moved that Daniel Loiselle be granted a salary increase from $650 to $728 per month, retroactive to August 1, 1975. Councilman Gutzmer seconded the motion. Administrator Johnson outlined the 1975 Agreement with the Police Department and Local 320 and recommended that it be approved. Mayor Huber moved that the Mayor and Clerk be authorized to execute the 1975 Labor Contract with the Police Department. Councilman Losleben seconded the motion. SUNFISH LAKE The Council acknowledged receipt of a memo from City Planner COMPREHENSIVE PLAN Howard Dahlgren regarding the Comprehensive Plan for Sunfish Lake referred to Mendota Heights by the.Metropolitan Council. Mr. Dahlgren's report noted that the Comprehensive Plan does not include a land use plan or graphics, and only a minimal amount of long range planning. In the memo, and also verbally at the meeting, Mr. Dahlgren recommended that the City request the Metropolitan Council not to review the Plan in its present form and request that additional information be requested to augment the Comprehensive Plan. The Council also discussed concerns on future freeway construction. In particular, the Council expressed concern for additional information on any policies or plans which might relate to the development of I-494 through Sunfish Lake and future plans for provisions for public utilities and emergency services which might directly affect Mendota Heights. Councilman Wahl moved that a letter be submitted to the Metropolitan Council, requesting an opportunity to review any material submitted by Sunfish Lake in the future which might augment the Comprehensive Plan; and that pending such review Mendota Heights reserves the right to call for a hearing if it determined that elements of the plan are incompatible with the interests of Mendota Heights. ACACIA PARK Mr. Lyons and Mr. George Rossbach, representing the Acacia CEMETERY Park Cemetery, were present to request approval to construct a proposed equipment and operations building. It is basically a concrete block structure which Acacia feels will be aestheti- cally acceptable. It is proposed to construct the structure on low ground behind the Lyons residence. Considerable discussion was given to future development possibilities in the M.A.C. area,;and the City's responsibility to plan for orderly redevelopment of the area. As a result of the discussion, it was determined that the Acacia Park Cemetery must apply for rezoning prior to consideration of construction of the proposed building. The Acacia representatives were advised that an application for rezoning must be submitted and must be brought before the Planning Commission. PROBATIONARY Administrator Johnson stated that Mrs. Carol Bakka was EMPLOYEE employed as part-time police clerk since May 8. Her six-month probationary period will expire on November 8. Mr. Johnson recommended that Mrs. Bakka be given permanent employment status at a salary of $2.97 per hour, effective November 1. Engineer Kishel recommended that the bid be awarded to the low bidder, Daily and Son, Inc. in the amount of $49,987.12. _ Attorney Winthrop stated that $7,000 has been contributed by residents of the Ivy Falls area towards the purchase of a . 180 foot by 400 foot parcel of property from Jerome McGough. He noted that PORT VARIANCE a variance was granted in the past for construction of the existing garage which allowed for a side and rear yard variance of 4 feet and 19 feet. An application for variance now is needed for the location of the proposed carport which would be constructed in line with the existing garage and would not violate the eastern side yard minimum requirement. The application of variance is needed to build the car- port 19 feet instead of the required 30 feet rear yard setback. The attached sketch locates the subject property within the Smith Subdivision Number 3, Block 3, Lots 8 and 0. and also on the attached survey dated August 9, 1955 is the location of the existing home and the proposed location of a 20 by 24 foot garage. The proposed location of said garage is within 3 feet of the south property line. 2. Emerson Avenue to the north of the subject and the alley to the south have not been improved to date. One reason for this is the presence of the low marshy area located east of thb subject Platted land north of Emerson has been laid out in such a manner so as not to necessitate the improvement of Emerson Avenue. 3. The applicant has further proposed to locate the garage as shown because the lay of the lana north of the existing home would require additional earth work to provide a drive from Clement Street to the garage. Locating the garage southeast of the house would mitigate this impact on the landscape by the required site grading. This location while minimizing site degradation does create the problem of a three foot setback on the southern property line. When viewed from the standpoint that the alley will not likely be improved in the future and in fact potentially vacated this would allow the applicant an additional 10 feet; hence providing a 13 foot setback 'from the southern property line. It would therefore appear based upon the above planning considerations that the variance is an appropriate request. RE: Wetland Systems Ordinance On October 10, 1975, Mr. Orville Johnson and Mrs. Kathy Ridder met with us in regard to their concerns on the general matter of wetland ordinances and run-off water management. Mrs. Ridder voiced the concern for having a set of enforceable rules and regulations pertinent to land development within and/or near areas designated as being hydrologically sensitive. We have worked with similar inquiries and have prepared Wetland Systems Ordinances. A Wetland Systems Ordinance sensitive to a specific community differs from wetlands ordinances generally in terms of comprehensiveness, i.e., the Wetland Systems Ordinance attemps to relate all aspects of surface water run- off, channel flowage, water ponding area, lake basin areas, subsurface water movement, and evapo-transpiration. The Wetland Systems Ordinance takes into consideration all of the above elements and through evaluation of these elements, district boundaries are delineated. Because of the significance of the preservation/protection of wetland systems, these districts are superimposed and supersede existing district boundaries. This is briefly the scope of a Wetland Systems Ordinance and what initiated this memorandum. Backqround Information Significant to the establishment of Wetland Systems Ordinance is the understanding that the elements being controlled or regulated are natural drainageways, canals, marshes, lake beds, and river cuts as ►cell as artificial devices such as culverts, excavated ponding areas, and urban environments which affect the rate of run-off. Regulations and performance standards pertaining to the above elements in a Wetland Systems Ordinance attempt to accomplish two symbiotic goals, protection and preservation primarily of natural water conductors and containing elements and the ultimate quality of water resources. It is clearly understood that the natural water cycle is not able to alter and purify at rates required to meet the water appropriation demands of intensly developed metropolitan areas. Technology has further complicated matters by its solutions to the management of -- -_ surface water run-off. These solutions have been of positive impact economically, socially and with regard to certain elements of the physical environment, however, they have not facilitated the natural mechanisms of recycling water resources. Contaminated water supplies A. A city of Mendota Heights October 23, 1975 Page Two and supplies economically unfeasible for reuse have and are becoming of such a magnitude that other methods of water resource management must be considered. The Wetland Systems Ordinance is intended to provide a basis for regulations with performance standards*to supplement the effort of surface water management programs and plans. Following is an outline of such an ordinace: Wetland Svstems Ordinance npfinitinnq Purpose and Intent A district relating to lowlands, marshes, wetlands, drainage - ways, water bodies, and watercourses regulating alterations and development of such lands and providing for the issuance of permits therefore, and especially to: 1. Reduce danger to health, safety, and welfare, etc. 2. Restrict and control of land development. 3. Designation of suitable land uses which are compatible to preservation of wetland systems. 4. Regulate the run-off of surface water. 5. Regulate the alteration of wetland systems. 6. Prevent the development of structures in areas which will adversely affect the designated wetland systems. District Application 1. Districts, as designated on the official Wetland Systems Map, shall be applied to and be superimposed upon all residential, commercial, and industrial districts. 2. Further definition of the established boundaries relative to geographical, hydrological, and surfacial geology. Designation of Permitted and Prohibited Ues Within the District Development Regulation -=l. Conditional Use Permit applications and wetland systems impact plan. 2. Removal of wetland systems from -district. Official Action To make such an ordinance effective and enforceable for the City of Mendota Heights, additional inventory of the soil series and the subsequent evaluation of these soils for their intrinsic hydrological relationships should be conducted in liaison with the City Engineer. The results of this inventory and evaluation must then -be integrated with the currently adopted surface water management study .to establish concurrence with that study of those areas for such uses, and to subsequently delineate the wetland systems districts. This Wetland Systo,ms District Map must also ultimately correlate with the Comprehensive Plan. This type of effort because of magnitude and impact must be con^tinted with total cognizance of the land use, engineering and env=:3nmental goals and objectives already established by the City. This adjustment for the 1974 charges has resulted in a net overpayment or underpayment and is reflected on your statement of charges for 1976 in the section enti- tled "OTHER CREDITS AND CHARGES". The total annual estimated charges to your municipality are to be remit- ted to the Metropolitan Waste Control Commission in twelve equal monthly installments due on the first day of each month. The Commission will bill you by mailing a monthly invoice approximately one month prior to due date. The first installment is due on or before January 1, 1976. The laws of Minnesota for 1975, Chapter 13, Section 84 require each municipality to adopt a system of charges to assure that each user will pay its proportionate share of the costs allocated to the municipality by the Commission. This requirement was instituted in 1973 in order for the Commission to meet the requirements of the Federal Water Pollu- tion Control Act of 1972 and to maintain eligibility for construction grants from the United States Environmental Protection Agency. Federal statute and regulations require that after approval of a user charge system by the Commissi-on and EPA, each municipality is to review their system of charges annually to ensure that each user is continu- ing to pay its proportionate share of costs for use of the disposal system. The Commission requests your municipality to review the sys- tem of charges for the costs allocated in the 1976 Cost Allocation, and if any changes are required in your system of charges, they should be submitted to the Commission for review and approval.
