Minutes of the Special Meeting Held
Tuesday, June 11, 1974
Pursuant to due call and notice thereof, the special meeting of the City
Council, City of Mendota Heights was held at 8:00 o'clock P.M. at the
City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Acting Mayor Lockwood called the meeting to order at 8:00 o'clock P.M. The
following members were present: Acting Mayor Lockwood, -Councilmen Gutzmer
and Losleben. Councilman Wahl had notified the Council that he would be
out of town. Mayor Huber had notified the Council that he would be absent.
HEARING -- 1974 Acting Mayor Lockwood opened the meeting for the purpose
STREET IMPROVEMENT of a feasibility hearing on proposed 1974 street
PROJECT improvements and turned the meeting over to City
Administrator Johnson for an explanation of the proposed
project.
Administrator Johnson gave the residents a brief history
of the proposed improvements, stating that it is proposed
to resurface the following streets with a two-inch
bituminous surface:
South Lane from TH 110 Frontage Road to South Freeway
Road
Knob Road from TH 110 to its terminus approximately
900 feet north thereof
Callahan Place from Marie Avenue to Marie Avenue
Ivy Falls Avenue from Dodd Road to Sylvandale
Road
Sunset Lane from Dodd Road to its terminus approximately
1,000 feet westerly thereof
Ashley Lane from Dodd Road to Delaware Avenue
Norma Lane from Delaware Avenue to Ashley Avenue
Kay Avenue from Victoria Road (TH 110 Frontage Road) to
Walsh Lane
Walsh Lane from Victoria Road (TH 110 Frontage Road) to
its terminus approximately 1,000 feet northward thereof
The estimated cost of the project is $70,000 with an
estimated front footage cost of $5.00. It is proposed to
install a three-foot deep apron at each driveway, however
the project will not involve any drainage improvements.
Acting Mayor Lockwood acknowledged receipt of a letter from
Mr. Robert Reardon, 11 Beebe Avenue, stating his opposition
to the proposed improvement of Ashley Lane. The Council
also acknowledged receipt of a petition from eleven
property owners objecting to the proposed improvement of
Ivy Falls Avenue.

Acting Mayor Lockwood asked for questions or comments from
the audience. Comments were received from the following
residents.
Hugh Cosgrove, 647 Sunset Lane, asked for information on
maintenance costs.
George Joseph, 1915 Walsh Lane, is opposed to the project.
Roy LaPean, 620 Callahan Place, stated that he is in favor
of the improvements if a cul-de-sac is constructed on
Callahan Place. ,
Richard Anderson, 1945 Walsh Lane, asked the amount of
assessable footage on Walsh Lane.
John Baker, 1929 Knob Road, asked if the residents will
receive a notice of the cost involved after the construction
contract has been awarded.
Mrs. Don Smith, 611 Ivy Falls Avenue, asked if the street
reconstruction would hold up under heavy traffic.
Russell Waldo, 696 Callahan Place, asked about assessment
policies on corner lots.
Edmund Stein, 622 Ivy Falls Avenue, stated that he would
prefer scarifying over the proposed project.
Don Anderson, 645 Ivy Falls Avenue, suggested using gravel
and oil rather than resurfacing as it is proposed.
Herbert P. Lau, 506 Norma Lane, stated that he is in favor
of the proposed improvements.
Mrs. Evelyn Fischer, 1153 Delaware Avenue, stated that she
would object to the project if the cost is over $7.00
per foot.
Edmund Stein., 622•Ivy-Falls Avenue, asked if the Council would
reject the project if the actual cost exceeds the estimated
cost.
Mrs. Vernon A. Gunderson, 1916 Walsh Lane, stated that
she is in favor of the proposed improvements.
Neal Quehl, 1968 South Lane, asked about drainage on_South
Lane.
Don Schuldt, 635 Highway 110, objected to any street
improvements on Knob Road.
Mrs. Helen Adams, 649 Highway 110, was concerned about the
cost of the improvements.
Martin Reitz, 1954 Knob Road, stated that he is in favor
of the proposed improvements.
Herman Marthaler, 1957 Knob Road, stated that he is in
favor of the proposed improvements.
Bernard Breskamp, 1958 Knob Road, stated that he is in
favor of the proposed project.
John Baker, 1929 Knob Road, stated that he is in'favor of
the proposed improvements.
Richard Humpal, 599 Callahan Place, stated that'he is in
favor of the proposed improvements and a cul-de-sac on
Callahan Place.
The Council answered the questions from the audience and
stated that no decision would be made at this meeting,
but that the matter would be considered again on June 18.

file written objections on lists supplied by the Cldrk.
There being no further questions or comments from the
audience, Councilman Gutzmer moved that the hearing be
closed and that the meeting be adjourned.

Held Tuesday, June 18, 1974
Pursuant to due call and notice thereof, the regular meeting of the City
Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the City
Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. '
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Losleben, and Gutzmer.
Councilman Wahl had notified the Council that he would be absent.
Councilman Lockwood had notified the Council that he would be late.
APPROVE Councilman• Losleben moved the approval of the minutes
MINUTES of the June 4 meeting.
Councilman Gutzmer seconded the motion.

HEARING -- WACHTLER Mayor Huber opened the meeting for the purpose of a
AVENUE STREET feasibility hearing on the proposed improvement of Wachtler
IMPROVEMENTS Avenue between Marie Avenue and Valley Curve Road.
Mayor Huber turned the meeting over to City Administrator
Johnson for a brief history.
Administrator Johnson stated that notices of the proposed
improvement had been mailed to the residents involved and
had been published in the official newspaper. He stated
that during the preparation of the Marie Avenue plans it
became apparent that this section of Wachtler should be
completed in order to give access onto Marie Avenue from
the Bunker Hills area. The hearing was called to notify
the two affected property owners that they may be assessed
with a sideyard assessment for the project. It is proposed
to construct a thirty foot street without curb and gutters.
Mayor Huber asked for questions or comments from the
audience.
Richard Sherlock, 1822 Valley Curve Road, asked about •
drainage, the possibility of curbs and gutters and the
timing.of the construction.
Brian Birch, 755 Willow Lane, submitted a letter objecting
to the proposed improvement.
Mayor Huber stated that anyone wishing to submit written
objections to the project could state his name and
objection on a list provided by the City Clerk.
There being no further questions or comments, Mayor Huber
moved that the hearing be closed.
Councilman Gutzmer seconded the motion.

The Council acknowledged receipt of a petition from residents

Council also acknowledged receipt of a petition from
residents on Callahan Place objecting to the proposed
improvements unless a dead end and cul-de-sac on the east
of Callahan Place are included in the project.
Mr. Dave Eckstrom, 975 Kay Avenue stated that the Walsh Lane
petition would represent one-third of the residents. and that
he is completely in favor of the proposed improvements.
Mrs. Francis Filipczak, 1905 Walsh Lane, stated that she is
a new property owner and signed the petition for two
reasons: because she felt she should consider the opinion
of the other residents on Walsh Lane and because of the
financial burden on some of the property owners who signed
the petition. She stated that she is not personally opposed
to the improvements.
The Council discussed at length the objections received and
the problems which would arise if the improvements are not
ordered in at this time. Engineer Kishel explained for the
residents on Callahan Place a proposal to install a dividing
meridian at the intersection of Warrior Drive and Callahan
Place when Warrior Drive is constructed. -
Mr. Roy LaPean, 620 Callahan Place, stated that he believes
the residents on Callahan would be in favor of the project
if such a meridian would be constructed on Warrior Drive and
also requested that East Callahan from Callahan Place and
Warrior Drive to Marie Avenue not be included in the project.
Councilman Gutzmer moved that the project be approved with

"RESOLUTION ORDERING PROPOSED CONSTRUCTION OF WACHTLER

CURS7.E AND ORDERING PLANS AND SPECIFICATIONS THEREFOR."
Councilman Lockwood seconded the motion.

City Administrator Johnson gave the Council a brief outline

of the hearing held on June 11. He stated that the Council

Councilman Lockwood gave the Council a brief analysis on the
comments received on the proposed improvements, stating that
the major objections came from residents of Ivy Falls Avenue
and Callahan Place—Councilman Lockwood stated that most of
the residents on Ivy Falls who objected seemed to feel that
some other type of approach would be favorable to street
oiling; the residents on Callahan Place seemed to object
only if no provisions are made for a cul-de-sac at the end
of Callahan at Warrior Drive.
The Council acknowledged receipt of a petition from residents

Council also acknowledged receipt of a petition from

After considerable discussion, Councilman Gutzmer moved to
amend the original motion to include all of the streets in
the original proposal with the exception of East Callahan,
moving the adoption of Resolution Number 74-57, "RESOLUTION
ORDERING 1974 STREET -IMPROVEMENTS AND ORDERING PLANS AND
Vote on amended SPECIFICATIONS THEREFOR (IMPROVEMENT NO. 74, PROJECT NO. 5)."
motion: Mayor Huber seconded the motion.

RECESS Mayor Huber called a recess at 9:45 o'clock P.M.
The meeting was readjourned at 9:52 o'clock P.M.
FIRE DEPARTMENT The Council acknowledged receipt of the Fire Department
REPORT monthly report for May, 1974.
PARK-A-RAMA The Council acknowledged receipt of a brochure outlining
Park -A -Rama activities. Administrator Johnson pointed out
that the dedication ceremonies will be held on June 30
between 7:00 and 8:00 P.M.
LABOR Administrator Johnson stated that at the May 21 meeting
NEGOTIATIONS the Council approved the labor contract for 1974/75 with the
Public Works Department with the exception of a tenth
holiday. Mr. Johnson stated that he has been advised by
the Union Business Agent that the granting of the tenth
holiday is relatively consistent among municipalities, and
is part of the Operating Engineers' contract, and that if the
,tenth holiday (Good Friday) is not granted, the City will be
requested to enter into binding arbitration or allow the right
to strike.
After considerable discussion on the matter,
Councilman Losleben moved that the Public Works Department
contract for 1974-1975 be approved, including a provision
allowing a tenth holiday (Good Friday) in 1975.

DEFERRED Attorney Winthrop stated that the IRS has requested some
COMPENSATION PLAN technical changes in the Deferred Compensation Plan and
asked that the.Council approve the execution of amendments
to the Plan which would incorporate the IRS changes.

Mayor Huber moved that the amendment to the Deferred
Compensation Plan be approved.

SPACE STUDY Administrator Johnson distributed to the Council a Space
Study proposal submitted by Midwest Planning and Research.
LEE'S FLOOR AND Councilman Gutzmer pointed out that the water from the Lee's
JANITOR SERVICE Floor and Janitor building is not draining properly and the
drainage plan is not in accordance with the plans approved
by the Council.
The Council directed the Administrator to work with the
building inspector and city attorney to see what can be
done about the drainage problems.
CARLSON/KIRCHERT Councilman Losleben stated that he has spoken to the Kircherts
SEWER AND WATER regarding the second residence on their property and that
the Kircherts are reluctant to turn the second residence into
a garage after the present tenants move. He stated that the
Kircherts will agree not to rent out the structure but wish
to be able to use the house for visiting relatives and friends
for short periods of time.
The Council directed the City Attorney to prepare a new resolu-
tion which would define the use of a "temporary" residence,
and restricting the use of the second residence.
CHANGE ORDER, Councilman Lockwood moved the approval of Change Order
ROGERS LAKE LEVEL Number 1, Rogers Lake Level Control Project, for the,
CONTROL PROJECT furnishing and installation of retaining walls on the inlet
structure at Rogers Lake, in the amount of $559.72.
Councilman Gutzmer seconded the motion.

BOARD OF REVIEW City Clerk -Treasurer Radabaugh reminded the Council members
that the annual Board of Review will be held on June 26
at 8:00 P.M. at City Hall.
TEMPORARY Financial Advisor Larry Shaughnessy was present to explain
IMPROVEMENT BONDS to the Council the current improvement costs and the
financing necessary. He requested the Council to authorize
bids for $645,000 temporary improvement bonds.
Mayor Huber moved the adoption of Resolution Number 74-58,
"RESOLUTION AUTHORIZING THE FINANCING OF•1974 IMPROVEMENTS."
Councilman Gutzmer seconded the motion.

LIST OF CLAIMS Councilman Losleben moved the Council to adopt the following
motion:
RESOLVED that the claims submitted to the City Council for
payment, a summary of which is set forth on the list
attached hereto and identified as List of Claims submitted
for payment, June18, 1974, having been audited by the City
Council, be and are hereby allowed and the Mayor and
Clerk -Treasurer are hereby authorized and directed to issue
City checks in payment of said claims.

INLAND CONSTRUCTION Building Inspector Bjorklund presented plans for Inland
BUILDING PLANS Construction Company for a building to be located in the
industrial park. The Council briefly reviewed the plans and
noted that several changes would have to be made in the plans
before any approval would be given, as the plans do not meet
the requirements of the Zoning Ordinance.

Re: Street Scarifying and Oiling
Dear Resident:
During the past several months your City Council has been discussing
the matter of street maintenance problems. The level or amount of street
maintenance has been a continual problem, both from satisfying the traffic
needs and from a financing standpoint. The legislative action in 1971
freezing the local taxing limit, and other recent demands on the City
budget such as park improvements and park maintenance has severely limited
the monies available for street maintenance. Now in order to do a more
adequate job of street maintenance, the City Council has found it necessary
to revert to the old practice of assessing for street maintenance activities.
This letter then constitutes a notice to you that the City Council will
hold a hearing on:

750 South Plaza Drive
to discuss the need for scarifying and oiling your street. A legal notice
was published in the West St. Paul Sun on June 3 indicating a list of
streets on which we propose to do major maintenance activities. Your street
is contained in the notice.
We are proposing to spend additional effort in reshaping your street.
It is proposed that your street be scarified, that more oil be applied,
re-laid with a road grader and rolled with a rubber -tired roller to provide
a more satisfactory street surface. This process will eliminate dusty
conditions, also eliminating the chuck -holes for a period of time, and will
thus provide a better driving surface than has been provided in recent years.
This type of maintenance will cost considerably more than the present
maintenance practice. Because of the additional work and limited budget, it
will be necessary to assess the cost of this operation to the abutting
property owners. It is estimated that the cost of this work will be
approximately $100 per lot.
The purpose of the hearing on July 2 is to give you an opportunity to
hear in further detail the proposed work, how it will affect the total street
maintenance program, and will allow you an opportunity to voice your -support
or objection to this proposal.

MINUTES
June 25, 1974
The regular meeting of the Mendota Heights Planning Commission was called
to order at 8:00 o'clock P.M., Tuesday, June 25, 1974 by Chairwoman Ridder.
The following members were present: Ridder, Clemens, Wheeler, Schneeman,
Culligan, Ljungkull and Stefani. Also present were City Administrator Johnson
and City Planner Barbara Lukermann.-
APPROVE MINUTES Minutes of the May 28 meeting had been submitted with
the agenda. Ljungkull moved approval of the May 28
minutes. Seconded by Wheeler. All Ayes.
CASE NO. 74-6, Chairwoman Ridder opened the meeting for the purpose of a
GENZ hearing on subdivision of approximately 2.84 acres of
property located on Hunter Lane. Mr. Genz presented
preliminary plans for subdividing the property into six lots. His original
proposal was for three lots, however he changed the plan to six lots because of
Commission comments ori April 23. —
The Commission received the following comments from the audience.
Mr. James Olin, 1140 Orchard Place, asked that the proposed road be
dead -ended rather than constructing a cul-de-sac so that he can
eventually develop his property adjacent to the Genz property.
Mr. William Mulvihill, 1171 Highway 110, stated that the three -lot
scheme made sense but that he has no objection to the present plans.
The Commission members were concerned about drainage details, the buildability of
the back of Lots 3 and 4, right-of-way dedication and access to the east.
Mr. Genz stated that he will combine lots 2 and 3. '
Ljungkull moved that the hearing be continued to July 23 and that the staff be
directed to study the plans and make recommendations at the July 23 meeting.
Culligan seconded the motion. All ayes.
CASE NO. 74-11, The Commission discussed the Park Commission minutes of
WACHTLER AVENUE June 19 regarding the effect of -the requested vacation on
VACATION trail considerations and also considered a report from
the City Planner which supported the requested vacation of
Wachtler Avenue between Hilltop Road and Valley Curve. It was the concensus of
the Commission that the vacation of this portion of Wachtler will not jeopardize
the future trail system or the City's thoroughfare system.
Stefani moved recommending approval of the vacation of Wachtler Avenue between
Hilltop Road and Valley Curve. Culligan seconded the motion. All ayes.
CASE NO. 73-12, Mr. Him►pal stated that he did not appear before the
HUMPAL Commission in June of 1973 because a neighbor feared that
if the driveway was placed on the east side of the lot it
might jeopardize the construction of a cul-de-sac on Callahan Place." He stated
that he is now requesting permission to construct a detached two -car garage on

the west side of his house. He will install an eight -foot door rather than
the standard seven -foot door to accommodate parking his boat in the garage.
The Commission was concerned about the possibility that the garage might be
used for paint storage and Mr. Humpal stated that he has other facilities for
storing paint and generally he has paint delivered to the site, so he would not
be storing paint in the garage.

CASE NO. 74-13, Mr. Casper Capser, 569 Kirchner, was present to request
CAPSER an eight -foot sideyard variance to construct a garage.
Mr. Capser stated that he will remove, -his present garage
when he builds the new garage. The Commission also acknowledged receipt of a
letter from Mark J. Waldo, 557 Junction Lane, stating that he has no objection
to the variance.
Wheeler moved recommending approval of an eight -foot sideyard variance.
Ljungkull seconded the motion. All ayes.
CASE NO. 74-14, Mr. Stewart Anderson was present to request approval to
HI -TEMPO construct a ski-shop/garden furniture store in a B-2
district (just east of the Carriage House). He stated
that the major business conducted by Hi -Tempo is sporting goods sales but during
four months of the year they would like to sell patio furniture. He submitted
preliminary plans for the building and stated that they would like to construct
a translucent -type patio fence next to the property line and that the furniture
displays would be outside but in an enclosed patio.
The Commission acknowledged receipt of a report from the City Planner regarding
this type of use in a B-2 district. It was the concensus that this type of
operation would not constitute outdoor furniture sales and would be a permitted
use within a B-2 zoning district.
Clemens moved recommending approval to allow construction of a ski -shop/ garden
furniture store in a B-2 district. Ljungkull seconded the motion. All ayes.
CASE NO. 74-15, Dr. Tom Koepke was present to request an amendment to the
KOEPKE Zoning Ordinance to allow an animal hospital in a B-2
District. He stated that he has contacted several smaller
municipalities and that animal hospitals are generally considered a conditional
use. The Commission acknowledged receipt of a report from the City Planner
recommending that this be considered a conditional use within B-2 and B-3
Districts.
Ljungkull moved recommending amending the Zoning Ordinance to allow animal
hospitals as a conditional use in B-2 and B-3 Districts. Wheeler seconded the
motion. All ayes.
The Commission advised Dr. Koepke to consult with the City Planner for construction
requirements and come back to the August meeting with construction plans if the
Zoning Ordinance amendment is approved by the City Council.
CASE NO. 74-16, Mr. Harvey Bream was present to request concept approval
BREAM (EAGLE of preliminary development plans for Lot 1, Block 1,
RIDGE) Eagle Ridge Plat 3 and Lot'l, Block 2, Eagle Ridge Plat'3,'
proposing that 16 townhouse units be constructed on each

section. Mr. Bream stated that the units will be virtually the same type of
construction as those already constructed in Eagle Ridge. In response to
Mrs. Lukermann's question regarding open space and recreation facilities,'
Mr. Bream stated that the original concept provided that recreation facilities
for all of the units would be constructed on Lot 1, Block 2, and that no
other provision would be made. Mr. Bream also stated that when the PUD was
originally approved the plan was for 56 townhouse units and 144 apartments. He
requested that he now be allowed to construct 61 townhouse units, and that only
134 apartments would be constructed in the future.
Stefani moved to recommend approval of the concept and that the matter be
referred to the City Planner for study and recommendation. Ljungkull seconded
the motion. All Ayes.
CASE NO. 74-17, Mr. Robert Laddusaw was present to outline a preliminary
DAKOTA LAND AND proposal for development of 30 acres of property located
DEVELOPMENT on Wachtler Avenue. He stated that several alternatives
are being considered but that the most favorable—
proposal would be for construction of single family residences on the front
portion of the property and that they would like to request rezoning to B-3
the back portion so that apartment units can be constructed along the north-
westerly portion to provide a buffer zone between the residences and the
NSP tank farm. '
It was the concensus of the Commission that Mr. Laddusaw meet with the Cherry.
Hills Association to get their reaction to this type of proposal and that he
should make application for a PUD.
MISCELLANEOUS The Commission expressed concern that the sign on the
Farmers Insurance office has not been removed from the
building yet and directed the Administrator to advise the Council if the sign
is not removed by July 2.
Chairwoman Ridder distributed to the Commission copies of the City Planner's
report on Shoreline Protection Regulations and asked the Administrator to stress
the importance and necessity for adoption of a soils protection ordinance.
COUNCIL ACTION ON Administrator Johnson advised the Commission of action
PLANNING COMMISSION taken at the June 4 Council meeting on Planning Commission
CASES cases referred from May 28.

Vacation of Wachtler Avenue
Between Hilltop Road and Valley Curve
PLANNING CONSIDERATIONS:
The petition to vacate one block length of Wachtler Avenue south of Marie involves
three sets of considerations:
1 . The ability to provide public access to all lots of record following vacation.
2. The impact on local circu.lation within the neighborhood.
3. The impact on community circulation systems insofar as Wachtler has a
collector/thoroughfare function in the City.
FINDINGS:
1 . The Ridgewood Park and Somerset Hills Plats have been reviewed, with
the finding that proposed vacation will not leave any lot of record without
access to a public street. Following vacation, however, Lot 9 of Block 3
of Ridgewood Park will have less than the minimum required frontage on a -
public street (75 feet rather than 100 feet).
2. The topographic characteristics of the neighborhood, with heavily rolling
terrain, make this a quiet and relatively isolated residential area. No
adverse impact to neighborhood circulation needs from the proposed vacation
can be identified. Hilltop and Valley Curve will provide an internal loop
street for the neighborhood, with a short stub of Wachtler leading to Marie Avenue.
Construction of the full length of Wachtler in the neighborhood would not add
1 significantly to either convenient local movement or enhance the aesthetic
quality of the area for residents.
3. The most significant issue relates to the function of Wachtler in. the City's
thoroughfare system. North of Wentworth to Trunk Highway 13 the
highway is a county road, and the stretch between Wentworth and Marie is
nowscheduled to be part of the Municipal State Aid System. The proposed
vacation would thus terminate the collector/thoroughfare function of Wachtler
at Marie.

This would not conflict with the City's Thoroughfare Plan as prepared in 1960,
and since implemented.
A basic principal in thoroughfare planning is that the collector/secondary
thoroughfare connect with the major thoroughfare system. This is achieved
under the plan with Wachtler connecting between Trunk Highway 13 and
Marie. Marie then connects between Lexington and Trunk Highway 49.
No direct connection between Wachtler and Trunk Highway 110 south of
Marie can be achieved because of the limited access function of this latter
highway.
Further upgrading and realignment of Trunk Highway 49 slightly to the east
of the present street will have the affect of further isolating this residential
neighborhood. Principal ingress and egress to the neighborhood will most
likely come from Marie Avenue in -the north. The neighborhood will be
surrounded by limited access highways on three remaining sides.
It would be our finding that the thoroughfare function of Wachtler logically
terminates at Marie.

Dear Mrs. Anderson:
This letter serves to summarize my earlier telephone conversation with you regarding the
potential use of property zoned B-2 in Mendota Heights for a ski shop/garden furniture
store. In reviewing this request against the ordinance I find that the proposed sporting
goods use is permitted in the existing B-2 classification, but that furniture sales are listed
only as permitted uses in the B-3 district. Dependent upon the space allocation for these
two types of uses within a building and the nature of the use in terms of outdoor displays,
etc., it may or may not be necessary to apply for a rezoning to a B-3 classification.
In Mendota Heights the Council reviews all commercial building permit applications.
Given the borderline case of your request I would advise that you proceed to develop
your plans and make application for the building permit under existing zoning. Your
plans should be as complete as possible so as to answer critical questions as to the
handling of ingress and egress, on-site parking, landscaping and landscape buffering of
any outdoor display areas. Extensive outdoor activities would give greater reason for
necessitating a rezoning to a more general business classification. I would also advise
that you check with the building inspector with regard to specific construction standards
and materials that must be used. The quality of the use and its compatibility with
abutting uses represent this important area of concern in the community.

MENDOTA HEIGHTS PLANNING REPORT
Zoning Ordinance Amendment re.
ANIMAL HOSPITALS (Veterinary Clinics)
INTRODUCTION
The Mendota Heights Zoning Ordinance presently contains no specific provisions for the
location or operation of Animal Hospitals in any zoning district. Such a use should be
identified, and the ordinance amended to adequately control the operation of the use in
light of public health and welfare concerns.
Present zoning practise in suburban areas is to identify animal hospitals as a permitted or
conditional use in General Business Districts - i.e, the "B-3" District as used in Mendota
Heights. A limited number of communities allow the use, as a conditional use only,in more
restrictive business districts. It is not a retail type of use, and thus is not included in the .
list of permitted or conditional uses in strictly retail centers or districts.
PLANNING CONSIDERATIONS AND RECOMMENDATIONS:
It would be recommended that "Animal Hospital" be identified as a Conditional Use within
Mendota Heights in the "B-2" and "B-3" zoning districts, with an identical listing of
considerations that must be reviewed in both districts.
The information listed below describes conditions/considerations for the amendment. Building
specifications for noise control should be reviewed with the Building Inspector.

ANIMAL HOSPITAL (Veterinary Clinic)
Facility for the diagnosis, treatment and medical care of small animals,
in which all professional services are conducted within an enclosed building
and which excludes the kenneling of such animals except for a time period
necessary to provide the medical care.
The granting of a permit for an Animal Hospital shall be conditioned by
the following standards:
1. No noise from the operation of the facility shall be discernible
beyond the boundaries of the lot on which the use is conducted.

To achieve noise control, the facility shall be of masonry
construction with outside walls at least 8" thick, and with a
precast concrete roof.
2. Odor control will require a ventilation system designed so that
no odors or organisms will spread between wards or to the outside
air. An air conditioning system may be required, with windows
double glazed with fixed sash.
3. An approved system for the storage and disposal of dead animals
off the premises shall be filed with the City -Council in the
interests of public health.
4. Large dog facilities for indoor exercise of these animals shall be
provided for. No outside pens shall be permitted.
5. When abutting 9 residential district, an approved screening and
landscaping 'plan shall be filed and developed along the property
boundary lines that abut the "R" District.
6. Hours at which the facility will be open to the public for the
receiving and pick up of animals shol I be approved by -the City
Council to insure compatibility with surrounding land uses. .
Off-street parking facilities shall be provided, of at least the ratio
required for professional offices under Section 18.4 (4) q. of the
Zoning Ordinance of one space for each two hundred (200) square feet
of floor area in the building.

Park Development Status
-- Commission members expressed any concerns they had regarding
park development to Starr who will look into them. They included:
1. Actual distance dredged at Rogers Lake -- Starr indicated
that distances were estimates since the work was done
before the lake water level was lowered.
2. Tennis court nets -- Commission concensus was that Wilson
top quality fiber nets should be purchased and that
contract specifications should be met (one fiber, one
metal net at each site).
3. Some slag mixed in the wood chips at Valley Park.
4. Swings too close to path and playground equipment too close
together at Rogers Lake. Lesson learned.
5. Wing -nuts exposed on shelter at Valley Park.
6. No pitching mounds -- informed by Starr they were not in
contract.
-- Allen moved that all criticisms be in by July 8 so that
contractor can make changes and so that final review and approval can
take place at July 24 meeting. Seconded by Murphy. Passed.
Wachtler Vacation
-- Joan Meierotto, Chairman of the Trails Advisory Committee,
briefed the Commission on the Committee's activities.
-- Meierotto indicated that the land, requested to be vacated, was
not necessary to the proposed trail system.

Park Commission Minutes
-2- June 19, 1974
-- Murphy moved that the Planning Commission be advised that the
Park Commission has no interest in the specified land. Seconded by Finn.
Passed.
-- More discussion regarding the trails report ensued. The Park
Board expressed interest in receiving the information gathered by the
Trails group.
Park Dedication
-- Howe reported on general, and Johnson followed up with specific,
reports on Park -a -Rama activities.
Tennis and Beach Regulations
-- Commission reviewed tennis and beach regulations to be posted
at park sites, with the most discussion concerning the use of toys or
inflatables at Rogers Lake. On the basis of calls to other communities
it was decided that no toys or inflatables will be allowed.

-- Allen moved that bike racks accommodating approximately 50 bikes
be installed at Rogers Lake Park. Seconded by Finn. Passed.
Pilot Knob Replacement
-- Johnson reviewed status of present site and suggested commission
members start thinking of replacement site. .
-- The question was raised as to whether the replacement had to be
a new site or an addition to an existing site. Action: Johnson to check
HUD requirements.
Ivy Hills Park
-- After some discussion, Finn moved that the Park Board request the
City to actively pursue the acquisition of land adjacent to Ivy Hills Park

-- Starr asked whether the Commission desired an application to be
submitted to the Office of Local and Urban Affairs for a grant. Commission
members discussed requirements and potential acquisition and development parcels.
-- Finn moved that the application be'submitted covering the acquisition
and development (passive, pedway, bridge) of lands adjacent to Valley Park.
Fogelson seconded. Passed.
Horses in.Parks
-- The question of horses in City parks was raised and discussed. The
Commission decided to continue to the next meeting and in the meantime find
out precedents.

Dear Mr. Johnson:
As instructed by the Park Board, I am submitting the preliminary LAWCON
application for Valley Park acquisition and development to you for
Councilmanic consideration. The application includes the following:
ACQUISITION_
1. 13 -acre parcel adjacent to existing Valley Park facilities. This
tract is located west of the Wachtler Avenue right-of-way and north
of Marie Avenue.*
2. 21 -acre tract including valley bottom lands between Marie Avenue
and Highway 110.*
3. 22 -acre trail easement extending along the existing drainage course
from the Wachtler-Wentworth Avenue curve to Wentworth Park.
* These areas were included in previous HUD and LAWCON applications.
DEVELOPMENT
1. Approximately 2.3 miles of woodchip -surfaced hiking and ski trail
facilities and six bridges to be constructed within the proposed
acquisition areas and*on lands owned by the city in the Interstate
;Valley.
Estimated costs for these activities include $97,500 for acquisition and
$40,200 for trails development.- Funding is being requested on the
following basis:
