Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Wahl, Losleben and Gutzmer. Councilman Lockwood had notified the Council that he would be late. • APPROVE MINUTES Councilman Wahl moved approval of the minutes of the July 2 meeting with corrections. Ayes: 4 Nays: 0 STREET SCARIFYING Mayor Huber acknowledged receipt of several letters and petitions against the proposed street scarifying and oiling of Diego Lane, Miriam Street and Winston Court. He stated that'a petition against the scarifying and oiling of 'Diego Lane, Miriam Street and Winston Court has been submitted and that as part of the petition the residents asked that a bituminous surface be placed on these streets. Mayor Huber stated that this area of the City is in need of storm sewers and that it would be unfair to the residents to improve the street with a bituminous surface and then go back at a later date and cut up the streets to install storm sewers. Mr. John Fuller, 568 Winston Court, a representative of the residents signing the petition, stated that storm sewer construction -seems to be a long time away and that the streets need resurfacing now. He stated that he would be in favor of a total project, but that many of the people in the area are against storm sewers. Mayor Huber asked that Mr. Fuller go back and talk to the residents, asking them to submit a petition for storm sewers and street improvements and directed the City Administrator and Public Works Inspector to work with Mr. Fuller -on this matter. He stated that the Council could support doing 'nothing to these streets this year if a petition for street and storm sewers were submitted and plans for this could be done next year. Councilman Lockwood arrived at 8:40 o'clock P.M. COMMUNICATIONS The Council acknowledged receipt of a letter from the Association of Metropolitan Municipalities regarding 1974/75 membership dues. Page 399 July 16, 1974 Councilman Gutzmer moved that the payment of $674 for 1974/75 dues for membership in the Association of Metropolitan Municipalities be approved for payment. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 COMMUNICATIONS Mayor Huber acknowledged receipt of a letter from the Association of Metropolitan Municipalities regarding committee membership. Councilman Wahl stated that he would be interested in being a member of the Municipal Revenues Committee, and Councilman Gutzmer stated that he would be interested in being a member of the Metropolitan Agencies Committee. LILYDALE SEWER The Council acknowledged receipt of a letter from AND WATER CONNECTION Carmen Tuminelly requesting sewer and water services to property located in Lilydale.- Administrator Johnson stated -that this is a 100 foot lot north of the Sylvandale Road intersection with T.H .� 13. Mayor Huber moved that the sewer and water connection be authorized, pending approval of the City of Lilydale, with the following conditions: that the connection be to a single family residence only; that the construction of the residence begin within 120 days or the authorization for sewer and water will be revoked; and the connection charges are to be: sewer - $937.00; water - $832.50; Trunk Sewer - $547.50. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 COMMUNICATIONS The Council acknowledged receipt of a letter from the Minnesota Highway Department regarding bicycle/pedestrian ways. Councilman Losleben pointed out that the Trails Committee has submitted to the Parks and Recreation Commission a trails report and added that after the report has been discussed by the Commission and approved by the Council it could be sent to the Minnesota Highway Department as fulfillment of their requirements. PLANNING COMMISSION Mr. Richard Humpal, 599 Callahan Place, was present to CASE NO. 73-12, request that his application be changed to a variance to HUMPAL allow an attached 22 by 24 foot garage on the east side of his home and a three foot four inch variance from the front yard setback requirement. Mr. Humpal discussed the matter, with the abutting property owners and they did not express any objections to the Council members. Public Works'Inspector Pearson pointed out that there may be a problem in installing a driveway if the driveway comes out on Callahan Place. Councilman Wahl requested that Mr. Humpal submit a letter stating that no paint or contracting equipment will be stored in the garage. Councilman Wahl moved that the variance for an accessory structure and a 3'6" variance be granted. Mayor Huber Page 400 July 16, 1974 seconded the motion. After a brief discussion, Mayor Huber moved that the motion be amended to grant the variance subject to staff approval of the driveway location. Councilman Lockwood seconded the motion. After discussing the matter at length; the motions and seconds were withdrawn. Mayor Huber directed that Mr. Humpal work with the City staff on the placement of the driveway and to bring plans to the August 6 Council meeting. MENDOTA WATER Mayor Huber acknowledged receipt of a letter from the City COMPANY RATE Attorney on the legal basis for a rate increase and the INCREASE REQUEST letter was read for the audience. Mayor Huber also acknowledged receipt of a petition signed by 310 Friendly Hills residents, 45 of whom are stockholders in the Water Company, in opposition to the requested increase. Mayor Huber reminded the audience that the Council must make a decision on the increase request based on a reasonable rate of return on investment. He also stated that there is a question on whether the Mendota Water Company is a reasonably efficient operation. He pointed out that the Council should also consider looking into the pressure problems and should give consideration to the problems which might be involved in integrating the system into the St. Paul Water Department system when the franchise ends. Several members of the audience complained of poor water pressure, rusty water and other problems. Many of the residents indicated that they do not feel they are getting the service they should be entitled to under the present $7.50 rate and objected to any increase. After a lengthy discussion, Mayor Huber moved that the City Administrator and City Engineer be directed to have preliminary discussions with the St. Paul Water Department regarding integration of the Mendota Water Company system into the St. Paul system after the franchise ends, and to solicit the cooperation of the Mendota Water Company officials in checking into water pressure and service problems. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 RECESS Mayor Huber called for a recess at'9:50 o'clock P.M. The meeting was readjourned at 10:10 o'clock P.M., STREET The representatives of the residents of Diego -Lane indicated SCARIFYING they would contact the other residents who signed the petition opposing street scarifying, hopefully to bring back a petition requesting street and storm sewer improvements for the area. Councilman Gutzmer moved the adoption of Resolution Number 74-65, "RESOLUTION ORDERING 1974 STREET OILING IMPROVEMENTS," for`ttie following streets: -Furlong, Kendon Lane, Lakeview Avenue, Mayfield Heights Road, Pierce (Hiawatha), Rogers Road and Swan Lane. Ayes: 5 Mayor Huber seconded the motion. Nays: 0 Page 401 July 16, 1974 DEPARTMENT The Council acknowledged receipt of the Police Department REPORTS monthly report for June, 1974 and the Fire Department monthly report for June, 1974. ASSESSMENT PAYMENT Councilman Lockwood moved the adoption of Resolution SCHEDULE Number 74-63, "RESOLUTION ESTABLISHING ASSESSMENT PAYMENT SCHEDULE," for Tract A, Ivy Hills Falls Addition. Mayor Huber seconded the motion. Ayes: 5 Nays: 0 PUBLIC WORKS Councilman Lockwood moved the approval of the 1974/75 DEPARTMENT LABOR Labor Agreement with the Public Works Department. CONTRACT Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 SPACE STUDY The Council acknowledged receipt of a brochure from Bergstedt, Wohlberg, Bergquist and Rohkohl. Discussion of the Space Study proposals was tabled. ORCHARD LANE City Engineer Kishel outlined and explained the supplemental FEASIBILITY STUDY feasibility study for Orchard Place/Hunter Lane sanitary sewer improvements. Mayor Huber pointed out that the City Attorney should be contacted regarding the legal correctness of the proposed assessment procedure. The Council also was concerned that some of the property involved in the proposed improvement area might be under Green Acres and directed the Administrator to research this aspect. Councilman Lockwood moved the adoption of Resolution Number 74-66, "RESOLUTION ACCEPTING ENGINEER'S REPORT AND CALLING FOR HEARING ON PROPOSED CONSTRUCTION OF STREET IMPROVEMENTS AND OF AN EXTENSION TO THE CITY'S SANITARY SEWER SYSTEM FOR THE ORCHARD PLACE, HUNTER LANE, AND CULLIGA LANE AREA," the hearing to be held on August 20. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 MINNESOTA HIGHWAY In response to a Minnesota Highway Department request, DEPARTMENT Mayor Huber moved the adoption of Resolution Number 74-64, "RESOLUTION ASSURING NON -ENCROACHMENT ON T.H. 13 AND APPROVING PLANS FOR UNDERGROUND DRAINAGE SYSTEM." Ayes: 5 Nays: 0 Page 402 July 16, 1974 WACHTLER AVENUE Councilman Wahl moved that a hearing on a petition to STREET VACATION vacate a portion of Wachtler Avenue be scheduled for August 6. Mayor Huber seconded the motion. Ayes: 5 Nays: 0 MISCELLANEOUS Councilman Lockwood requested that the City Administrator check -on the status of the construction of a home being constructed on Dodd Road and Stanwich. Councilman Wahl brought up the matter of split liquor, and City Administrator Johnson stated that he would research the matter and report to the Council on August 6. Councilman Gutzmer stated that the parking situation at the Rogers Lake Beach is a problem and requested that the Administrator see what can be done to relieve the parking problems. KIRCHERT/CARLSON Councilman Losleben moved the adoption of Resolution SEWER AND WATER Number 74-67, "RESOLUTION AMENDING RESOLUTION ACCEPTING IMPROVEMENTS KIRCHERT AND CARLSON PETITION AND FEASIBILITY REPORT AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS." Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 STAFF Administrator Johnson requested approval of the employment APPOINTMENT of Mrs. Betty Anderson, 2119 Patricia Street as clerk/typist. Mayor Huber moved that Mrs. Betty Anderson be employed as clerk -typist for a probationary salary of $450 per month. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 CHANGE ORDER, Mayor Huber moved the approval of Change Order No. 2 for ROGERS LAKE LEVEL the Rogers Lake Level Control Project (Improvement CONTROL PROJECT No. 72, Project No. 4) in the amount of $369.14. Councilman Wahl seconded the motion. Ayes: 5 Nays: 0 CHANGE ORDER, INLAND INDUSTRIAL PARK - Ayes: 5 Nays: 0 1974 STREET IMPROVEMENT PROJECT Councilman Losleben moved the approval of Change Order No. 1 for the Inland Industrial Park improvements, (Improvement No. 74, Project No. 1) in the amount of $1,532.20. Councilman Gutzmer seconded the motion. City Engineer Kishel submitted final plans and specification for the 1974 Street Improvement Project (Improvement No. 74, Project No. 5). Page 403 July 16, 1974 After a discussion, Mayor Huber moved the adoption of Resolution Number 74-68, "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR 1974 STREET IMPROVEMENTS (IMPROVEMENT NO. 74, PROJECT NO. 5).1- Councilman )."Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 MARIE AVENUE Engineer Kishel stated that the Minnesota Highway IMPROVEMENTS, Department has given approval of the plans and specifications IMPROVEMENT NO._73, for Marie Avenue from Dodd to Victoria, and that the plans PROJECT NO. 2 have been submitted to the DNR and should be returned by the August 6 meeting. He asked for authorization to prepare for bid letting, pending DNR approval, hopefully setting a bid date at the August 6 meeting. Mayor Huber moved that the Engineer be authorized to begin bid -letting preparations pending approval of the DNR. Councilman Losleben seconded the motion. Ayes: 5 Nays: 0 WACHTLER AVENUE Councilman Wahl moved the adoption of Resolution Number 74-67 IMPROVEMENTS "RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS FOR WACHTLER AVENUE STREET IMPROVEMENTS BETWEEN MARIE AVENUE AND VALLEY CURVE." Councilman Lockwood seconded the motion. Ayes: 5 Nays: 0 ORDINANCE NUMBER 123 Councilman Losleben moved the adoption of Ordinance Number 123, "AN ORDINANCE AMENDING THE ZONING ORDINANCE," allowing construction of animal hospitals in B-2 and B-3 Zoning Districts as a conditional use. Councilman Gutzmer seconded the motion. Ayes: 5 Nays: 0 = ORDINANCE NUMBER 124 Councilman Gutzmer moved the adoption of Ordinance Number 124, "AN ORDINANCE AMENDING ORDINANCE NO. 43," relating to connection to the Sanitary Sewer system. Mayor Huber seconded the motion. Ayes: 5. Nays: 0 CERTIFICATE Councilman Gutzmer moved that the City Clerk be authorized REDEMPTION to redeem certificates in the amount of $100,000 from Fund 12 and $114,843.05 from the Consolidated Fund. Ayes: 3 Nays: 0 EAGLE RIDGE Mr. Carmen Tuminelly and several representatives of the ASSOCIATION Eagle Ridge Association were present to request information on future assessments for the construction of Marie Avenue. The main concern of the Association is the procedure to be used for spreading the assessments for the common area. They were concerned that the assessments might be levied against the condominiums which are the closest to Marie Avenue rather than spreading the assessments among the Association. The Council pointed out that no policy for assessing can be established at this time since the assessment hearing will most likely not be held until'1975 or 1976. It was indicated, however, that the assessments would in all probability not be charged against only the property owners nearest Marie Avenue, because the entire Association will benefit from the improvements. SPACE STUDY Discussion of the Space Study proposals was tabled until August 6. RECESS Acting Mayor Lockwood called a recess at 9:40 o'clock P.M. The meeting was readjourned at 9:45 o'clock P.M. MUNICIPAL LIQUOR Administrator Johnson outlined the history of the subject of municipal liquor, stating that in view of the media advertising proposal before the State Legislature last year very little work has gone into municipal liquor for Mendota Heights. He stated that if the Council were to decide to consider issuing private off -sale licenses rather than a municipal operation, the original Ordinances on municipal liquor would have to be rescinded. After a lengthy discussion, the matter was tabled until August 6. 1 - DISEASED TREES Administrator Johnson gave the Council a brief outline of the diseased tree situation, stating that there are 25 diseased trees on public land and 609 diseased, trees on private property. He suggested that the City work with Inver Grove Heights and West St. Paul to hire a tree expert to check trees for disease, in order to save staff time. The Council also discussed time limits for removal of diseased trees from private property, providing a dumping i - Page 407 July 30, 1974 area for trees taken down by individual property owners, a possible levy increase for removal and control of diseased trees and several other items. Councilman Wahl suggested that Harvey•Franzmeier be allowed to use his own discretion in setting time deadlines for removal of trees. Robert Meiers explained that no requests or complaints had been received in the mail and further stated that three residents had appeared before the Board prior to the meeting with questions concerning the valuations of their property. The County Assessor gave a presentation of the various increases that the County was to adjust for the year of 1974. The real estate valuations for Mendota Heights had been increased by 5%. An informative explanation of the procedure used for figuring taxes followed. The following are some of the considerations to be given and the answers that I have been able to determine. 1. There is still the need for a 3'6" front yard setback variance. 2. Letter from Mr. Humpal regarding storage. I discussed this matter with Mr. Humpal and he indicated that he would be reluctant to sign a letter of this type because it is his feeling that no other contractor in the City has provided the same. 3. Driveway Plan. I suggested a turn around on the property to Mr. Humpal to eliminate a potential safety hazard of backing onto Warrior Drive. The sketch he has provided indicates this. I checked the street elevations with Ed Kishel and he indicated to me that the centerline of future Warrior Drive would be approximately two feet above the centerline of present Callahan Place in the area of Mr. Humpal's driveway. Chairwoman Ridder recognized Mr. David Cox, 1187 Culligan Lane, from the audience, and he presented a petition to the Commission signed by thirteen property owners opposing the six lot sub- division plans of the Genz property. They are in favor of the original plan for three (3) lots facing Hunter Lane. Mr. Richard Grayson, Dr. Olin's attorney, spoke for him supporting the plat and offering to dedicate adequate property for a proposed cul-de-sac East of the Genz property. He stated that Dr. Olin would also not object to increasing the large pond on his property. Chairwoman Ridder asked Mr. Genz if he was agreeable to having only two lots on the north side in order to avoid building too close to the lowland. Mr. Genz indicated that this had been discussed earlier and he was favorable to the idea. After some discussion Chairwoman Ridder •asked for the individual Commission member's feelings. Mr. Genz's initial proposal was to create 3 deep lofts fronting along Hunter Lane,,' `. ' one lot with a frontage of 160 feet' 2 lots of 100 feet width. The second proposal was a preliminary plat showing�a cul-de-sac in the center of the property, -with 6 (5) lofts fronting.the new street.-The,plat was referred back to the engineer and planner because of considerations of: 1. Drainage conditions on the site and future needs for ponding and retention -of storm water. t 2. Future egress to other land holdings in the neighborhood to the north, south ' and east, where topographic conditions limit possibilities of subdivision for. ' remaining parcels. 3. Current sewer plans for the nei.ghborhood and potential need fora lift station - in the immediate vicinity of the Genz property. . A public hearing has now been set for August 20th, 1974 to provide sanitary sewer to the neighborhood. Engineer's plans show sewer lines to be constructed along Hunter Lane and Orchard Road, with a lift station needed in the low spot approximately along ` the southern boundary of Mr. Genz's property. This lift station would pump sewerage to the high ground further north along Hunter Lane. Assessments against benefitted properties for the sewer and road improvements are likely to be proposed with a 50% ' assessment on a front footage basis, and 50% by area. The assessments are likely to ` increase interest of remaining property owners in further subdivision' in the immediate area. GENERAL PLANNING CONSIDERATIONS AND FINDINGS: ' 1. Drainage i t - The major ponding area for the neighborhood lies on Village owned property; extended into land presently owned by L.C. Watzl . A small area of low ground g extending into the Genz property is -not considered necessary for retention of storm wafter on the property, and in odr opinion could be filled and developed i t a without jeopardizing drainage needs in the area. Such fill, however, would affect abutting property owners and would require joint planning and agreement. 2. Interior Land'Development - Future Street Patterns Because of a steep drop off from Hunter Road fio the east there are probably only 3 locations along Hunter Road where -a road could readily be constructed to provide access into interior properties - at the north end of. the Van property, in the center of the* Genz property, or on the southern boundary of the Genz: property. Provisions should be made for at least one of these points to become ` an access point for development of interior parcels. 3. Lift Station Location" , -While the station will be buried, with only a short pole and control panel above the surface, it will be necessary to acquire a small tract to accommodate the pump (maximum of 50 feet by 50 feet - potentially a little less). The location of this station should be in a rear yard, riot a front yard., and thus the specific platting design for the Genz, and potentially the-Watzl property to'the south, must be taken into consideration. From field inspections it appears most feasible to locate the lift station either on the Genz or Watzl property, With the preferred location on the Genz property which is not wooded. RECOMMENDATIONS: The attached sketch presents our recommendations as to a feasible lot layout for the Genz property, taking into account all of the above considerations. A straight street through the center of the property, butted as a temporary cul-de-sac could provide 6 lots, with lots immediately adjacent to Hunter having the greatest lot width. The proposed location for the 1 i ft station is shown in the rear yard of the southwestern -most lot... The northeastern lot would not be a buildable lot at the present time,bufi could become one with approved fill. Future development of Dr. Olin's land to the east could be achieved with either an extension of the cul-de-sac or a loop street that could 'connect back to either Hunter Lane in the north or Lexington to the east. A schematic layout of'how the Watzl property might be developed with single family lots is also shown on the sketch, for illustrative purposes only. The low land extending into the Watzl property is -part of the major ponding area for the entire neighborhood and thus the eastern part of this , property is not likely to be'developable. The tract has a total fall of about fifty-three feet (53') from the highest to the lowest points. B. VEGETATION a Most of the property is covered with hardwood trees. The applicant will use its best efforts to preserve as many of'those trees as is reasonably possible. C. WATER There is no standing water on the site. -The sub-soil provides for good vertical drainage. A temporary ponding and storm water holding area is contemplated to reduce the rate of runoff on the property. The location of this holding area wi•11 be in the Northwest corner of the property. D_ GENERAL ANALYSIS Soil patterns, water shed involvement, topography and tree cover are the major ecological concerns when it comes to land development. The general soil characteristics indicate a high suitability to develop- ment. Some continued concern to earth sculpture to prevent-excessive erosion and to permit the removal of a minimal number of trees will be required. The slopes resulting from grading and the replacement of some vegetation pattern will control erosion. ; " SECTION IV =. = CONCEPT PLAN A. MEETING THE OBJECTIVES = The contiguous properties to the West and North of the site are _ zoned for business use. The West property owned by Northern States _- Power Company has high voltage transmission lines and above ground storage tanks that obstruct the view and make for an undesirable ` neighbor to a residential neighborhood. It is therefore, the intent of the developer to promote an appropriate use for the entire property that takes into consideration a smooth transition from the Cherry Hills residential development on the East and the semi -industrial use -to the West. ` To carry out this objective, Dakota Land and Development intends to ' - `• develop a two phase project. Howe, Chairman of the Park Commission D A T E: August 1, 1974 SUBJECT: Trails Advisory Committee Report I This week we sent each of you a copy of the Trails Advisory Committee Report which was approved by the Park Commission at its July meeting. We are submitting this plan for review by the Council with the hope that .11(41 the Council will approve the plan and add it to the overall comprehensive planning program of the Village. This report, as you can see, is very well done without any cost to the city*. Many communities would hire expensive outside consultants to V develop a planias detailed as this. I would hope that the Council would consider adopting an appropriate resolution commending all the members of the Trails Committee and, in particular, the co -chairwomen, Joan Meierotto and Mary Mills. The one real advantage of this plan is that it provides a "psychological unification. " Along with an excellent park system, an up and coming recreation program, an annual park-a-rama, a trail system will contribute to a unified city of Mendota Heights. Because of the increased use of bikes and pedestrian traffic," this plan adds to the saf . ety of our residents. In fact, safe travel is one of the very important factors considered by the Trails Committee in developing this system. Please note that all bike routes are intended for pedestrian traffic as well. Neither the Trails Committee nor the Park Commission discussed in detail the cost of such a plan because there are so many variables. The cost of each trail would depend on other work being done at the time of development. For example, some of the trails might be put in on top of sewer and water easements or when other street construction is being done. I We do have some approximate costs as received from DNR. Class I Trails are estimated at cost currently approximately $10, 000 per mile.• Class 2 Trails cost approximately $1, 500 to $2, 000 per mile and Class 3 Trails utilizing existing streets where low vehicular traffic and signs only cost vary from $7 to $20 a mile. When the Park plans were first developed, we did not estimate complete costs, again because of the variables. It was only after developing detail plans and ' I Memorandum A Page 2 August l,'1974 • 1, IL preparing for a bond issue that more accurate cost -figures were developed. We would request that the Council review this overall plan in that light and not reject the plan merely because cost figures 1 are not included at this time. The Trails Committee lists a street -by -street description of the trails, The report lists the trails in order of their recommended priority. Obviously, additional planning may change the order. In fact, the Park Commission has already recommended that a trail be developed from the northeast corner of Wentworth Park to the First Avenue North area. This would permit all residents from both sides of Dodd Road north of Wentworth to utilize the Wentworth Park without having to use Dodd Road. The Park Committee- will be exploring this trail in more detail in, the coming months and. undoubtedly, will be making a recommendation to the Council. awl There is a strong possibility that there will be Federal and State funds available in developing this comprehensive trail system. Recognizing it may be premature to ask your approval of the attached resolution prior to or in conjunction with your taking action on the Trails Report, but also noting that points of contact with other communities are unlikely to be controversial issues, we ask your favorable action on the attached proposed resolution. It was our intent to run the dedication ceremony without cost to the city f111 and the objective i7as accomplished. Total expenses for the program•were Pr $2,054.16 with total income of $2,066.38, for a net profit of $11.77. -We received donations from various organizations of $1,205. The Mendota Plaza donated $705.13 from the festivities they sponsored. The tennis tourna- ment registration fees amounted to $154.25 and the balance of $2.00 was from miscellaneous income. If at all possible, funds should be set aside in the Park Commission's budget to cover some expenses for next year's* program. Mrs. Hughes did submit, in more detail,.a final report concerning each of the various activities with additional"recommendations for next year. The Commission will be discussing plans for next year's festivities at its September meeting, and will be submitting a proposal to the Council some- time after that. The last emergency occurred on July 6, 1974, when my wife passed away. I knew that this was going to happen and in some ways it was less difficult, for me than the first two emergencies when she suffered brain siezures. The important thing about this is the unfailing kindness and consideration demonstrated by the police to both of us during and after each emergency. However, there was a point or -two regarding ownderohip and the charter I would like to insure I have co.rrent and then raise a possible t;olution to the current problems. 1. The water company was capitalized at 9'52000000.00 17 years ago. 2. They were allowed to depreciate their assets over 25 years which equate to 4% per year.. They were guarenteed their full rSturn on capital at that rate even though the investors did not n ve that much money in the company, 3. in eight years the company automatically reverts to the city at -0- cost to the city 4. By charter they are guarenteed a reasonable return on their investment. 5. The people running the company are all part-time employees and cannot supply the services full time employees could supply. If the above are true, than the company has a net book value - (original capitalization less depreciation) of $64,000. $200,000 136,000 less depreciation (.04x$200,000 x 17 years) $ 64,000 There are approximately 230 homes and 2 commercial accounts receiving ;water from the water company. At this time, that would equate toP276 per house, not taking the commercial accounts into consideration. My proposal is to buy the company out now, rather than wait the eight years and switch to the St. Paul Water system. From discussions regarding rates l,qst night, I gathered each home owner would more than save the approximate $300 it would cost to buy out the company and the added cost of hooking up to St. Paul water will be there regardless of when the conversion is made -and I am sure the hook up cost would be less ex3ensizee today than in eight years. At the meeting you proposed a study be made for future hook up t) St. Paul water. If a buy out is legal at this time, could the study be extended to a current hook up? An early buy out would solve everyones problems. It would.: 1. Put the service in professional hands 2. Insure uniform service 3. Put all people in the village on the same rate structure eliminating the need for council. intervention 4. Solve a future problem .regarding equipment. The entire system would be St. Pauls responsibility 5. It would give the stockholders money so the could invest it to realize a return on their. investments I don't feel a petition would be any value at this time because we don't have approximations of the cost. However, :if one is needed in the .future when costs are formulated, I will be more than happy to supply one.
