Dear Mayor and Council:
As your new president, it is my privilege to enclose this brief note along with your
League dues statement for the 1974-75 dues year which begins September 1.. As a member
of the League Board of Directors for the last couple of years, I have been proud of
the way the membership has responded to bring the League through a very difficult
period. Not only have we survived the separation from the University with its atten-
dant financial and other adjustments, but we have done so without diminishing the
momentum we had built up over the preceding several years.
From time to time, someone who has not been active in the League expresses doubt con-
cerning the ability of the League to successfully represent the needs and interests of
our diverse municipal membership. However, those who participate in League activities
quickly realize that all member cities, regardless of size or geographic location,
have far more interests in common than they have interests which are different.
Furthermore, as Abraham Lincoln aptly said, "If we don't hang together, we shall
certainly hang separately."
During the more than sixty years the League has been in existence, a whole range of
services has been developed which in one way or another provide tangible benefits
to all of our members. Unfortunately, not all of our members use these services to
the fullest advantage. I urge each of you to review your use of these services to
make sure that your city is taking full advantage of your League membership. I also
urge you to continue your League membership as the best form of insurance available
to preserve significant decision making authority at the municipal level.

RESOLUTION NO. HAND OUT
RESOLUTION AUTHORIZING ISSUANCE OF BUILDING
PERMIT
WHEREAS, James Riley has made application for a building permit to
build a dwelling structure on a parcel commonly numbered as 26184-A;
and
WHEREAS, other parcels involved in a plat proposed by James Riley
include Parcel Numbers 26824, 26183-B, allegedly under the control of
James Riley and other parcels numbered as 26823, 26184-C, and 26184-D
and owned by persons other than James Riley; and
WHEREAS, a dwelling structure was authorized on Parcel No. 26823
in past years, a tentative plat being proposed at that time, but said
proposal failed to materialize, and as a result no dedicated or public
right-of-way is provided to said dwelling; and
WHEREAS, James Riley proposes to build northerly of the previously
mentioned dwelling, expecting and intending to extend an existing
driveway to the new dwelling despite the fact that no public dedication
for public right-of-way has been made available; and
WHEREAS, she proposed dwelling structure will only be accessable
from First Avenue at present; and
WHEREAS, there is common agreement between the City Council and
James Riley as to potential problems of development, both with his
structure and future land development;
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that the City Council authorizes the issuance
of a building permit subject to the following conditions and requirements:
1. That the proposed dwelling will be temporarily
identified as 735 First Avenue;
2. That an access easement across Parcel No. 26824
providing access to Parcels 26823, 26184-C and
26184-D be submitted to the City Attorney and
approved as to form;
3. That emergency vehicular service and other normal
municipal services will be provided only upon the
pleasure of the department head providing such
service, depending upon the condition of the
private access road from First Avenue northerly
toward the existing dwelling and the proposed
Riley dwelling;
Resolution No. -2-
4. That a complete and adequate on-site sewer
system be installed as per state specifications
and that the water supply for the proposed
dwelling may be connected to other private
sources for a period of one year, and
thereafter the source of water must consist
of either:
a. Supply from domestic distribution
system; or
b. Construction of a well as per state
specifications.
5. The process of platting will be pursued,
acknowledging that this special authorization
for dwelling construction poses potential
problems and such problems may have to be
solved at the expense, either financially or
otherwise, of Mr. Riley;
6. That Mr. Riley shall contribute the sum of
$300 as park contribution at this time, such
sum shall be credited to the eventual total
park contribution attributable to final
platting.

SUBJECT: New Utility Pick -bp Truck

A year ago, in preparing the 1974 budget, a request was made
for a new pick-up truck for servicing the sewer and water utilities.
The justification for this truck was considered in depth and was so
reported, and included in the 1974 budget. The adopted budget in-
cluded a utility truck in the amount of $4,000 as capitol expenditure.
Bruce and Chet have reviewed the current needs, and have prepared
,a tentative set of specifications for a one -ton truck and utility
body. The proposed truck would be a short wheel base conventional
chassis with a typical utility type body; It would replace the ex-
isting conventional pick-up used by the sewer and water personnel.
The proposed vehicle and utility body would provide a much -better,
organized way of carrying the servicing equipment, the necessary
OSHA equipment for safety purposes., and provide a more waterproof
carrier for such equipment.
I recommend the purchase of this equipment by receivi.ng quotations,
from various truck dealers on the cab and chassis.and once the
chassis is purchased to go through a similar quotation process with
I the several body suppliers. Most current estimates of cost are as
follows:
Cab and Chassis $31300
Utility Body 1-600
The above estimate exceeds the 1974 allocation by $900.00.
I Several changes and savings have been incorporated in the total
public works operations so far in 1974, and I'm quite confident
I that we will be able to maintain our 1974 budget., despite the
$900.00 difference.
Therefore, I recommend authorization to purchase equipment as
per the above method.

SUBJECT: Research on Swan Lane
Response to Petition received August 6, 1974
At the regular Council meeting of August 6, 1974, a petition
to re -name Swan Lane was considered. The petitioners state that
a sign "Swan Drive" was erected over fifteen (15) years ago, hence
the street should be officially designated as such. Discussion of
the petition resulted in direction to staff to research the matter.
A review of our "master cards" and sewer billing addresses
indicates that the residences are in fact recorded as being on
Swan Drive. I suspect that the official building permit applica-
tions and the official building permits have been recorded as
Swan Drive. As a result, our several listings do show as "Swan Drive."
This practice may have started when the Swan Drive sign was erected.
I also reviewed the many maps that are used daily and weekly
by various segments of the public. The ten (10) attached prints
indicate quite clearly that, at least on mapsjthe designated public
way has been known and declared to be Swan Lane. I did not find a
map or drawing indicating the name Swan Drive. I am not aware of
any formal name changing procedure, hence I can only assume that
officially it is Swan Lane.
It appears that the various typed records have been recorded
in a manner that is inconsistent with the platted and mapped
documents. In order to resolve the matter either:
(1) The Council can, by Ordinance, rename the
street, thereby causing new signs to be
erected, but the changing of the map de-
signations will linger on for years, the
actual plat maps never to reflect the change.
or
(2) The Council declare that no official change
is to be,made suggesting that all records,
both private and public, be changed to
reflect the platted record.

CT: Mendota Water Company Rate Request
On July 16, 1974, the City Council continued discussion on
the subject matter. The final conclusion and direction was
for staff to:
1. Investigate pressure and service complaints
2. Investigate the feasibility and cost of integrating
the system with the existing city-wide water
distribution system.
We have been pursuing these directions.
Chet gave you some preliminary information on August 6th. His
attached memo provides further information and findings. From the
attached information and further verbal elaboration, I trust that
you will come to this conclusion:
The Mendota Water system appears to contain _
large amounts of foreign material within the
piping - so much, in fact, that the water service
(rate of flow 'to -the water meter) is seriously
impeded to some customers.
We have only made random tests, hence draw the above conclusion
from a limited number of tests. Hence, we are not able to draw
any conclusion as to the extent or scope of the problem. There
is a problem however, and Mendota Water should pursue the extent
and take corrective action.
On the second staff charge - I did finally obtain a print of
the system that is alleged to be current and correct. As of this
date, I have not received a set of construction specifications.
As soon as I get the specifications, I will be in a position to
meet with the St. Paul water department officials.
I have discussed the above matters and the rate request with
Larry Shaugnessy and others. Without going into detail and
reasoning in this memo, I would suggest the following sequence
and action:
1. Make the official finding that there are
deficiencies and apparent lack of maintenance
procedures in the Mendota Water system.

2. Acknowledge that past maintenance operations
and costs have probably not been sufficient,
and that future maintenance activities must
be increased, with resultant increased costs.
3. Authorize a temporary rate increase in the amount,
requested (6 months possibly) with the provisions
that:
(a) Immediate plans be made, for corrective
action, and that corr.ectiveaction be
substantially completed in the temporary
time span. -- I
(b) A plan of improvements and estimated
costs be submitted in response to
forthcoming St. Paul Water Department
comments.
4. Reconsider the Mendota Water Company's response
and finances -at the end of the temporary time
period and make final determination at that time.

SUBJECT: Friendly Hills Water Pressure Report
As requested by the Council, in the past few weeks we have
made an investigation into the water pressure problems as related
by solme of the residents of the Friendly Hills area.
Starting on July 26, 1974, we ran a series of pressure and flow
readings at several homes. A copy of these tests were given to -
the Council at the last meeting. We also checked main valves and
curb stops to make sure that these were fully open.
In the next step, we removed the meters of two homes only to
find that the volume of water supplied to the house from the
service seemed to be inadequate.
We�then took some test readings in other areas of Friendly Hills -
and also on homes that are on the St. Paul system.
After taking all the tests and reviewing them, it was my opinion
that ithe problem was in the service line itself from the main
to the house.
The next step was to,dig up the services at the corporation
stop Iat 744 and 762 Mohican.
When the service pipe was disconnected at 744 Mohican, we found
a very restricted opening in the corp stop and also in the service
pipe itself. Both were restricted by a thick coating of a rust type
material. It was not a hard or granular type of scale but rather
a soft type of material that would break down when rubbed between
your fingers. r
We then ran an electricians fish tape into the service line
from the main to the curb stop.and from the meter valve back to
within 10 feet of the curb stop. We then flushed the complete
service line thoroughly. The water coming out of 'the service pipe
during the flushing procedure was extremely rusty colored and had
particles of rust contained in the water.
After flushing the service line the meter was installed and
the system put back in service. We then took pressure and flow
readings. They are shown on the attached sheet.
We did disconnect the service line at the corp stop at 762 Mohican
in the presence of Ed Lavigne so that he could observe what we
found The condition found was the same as that of 744 Mohican
although it did not appear to be quite as severe.

In I conclusioni I would say that based on our findings that the
Mendota Water Co. does indeed have some serious problems in their
system. I would suggest that the Mendota Water Co. should take ,
somelcorrective measures to provide their customers with a clean
water supply and in sufficient volume. I would suggest that
perhalps Mr. LaVigne or some other of his personnel might contact
somelknowledgeable people in the water service field for some
advice concerning their problem.
I am now in the process of contacting some people who I feel
are aware of these types of problems and will try to assist in
giving any direction which may be appropriate.

SUBJECT: Scarifying and Oiling Project
Before starting the above project, all the streets involved
were reviewed to determine the amount of work required for each.
At that time it was determined that Mayfield Heights Road pre-
sented the greatest problem in regard to the proposed type project.
We then left this street to be the last worked on.
Mayfield Heights Road presents many different problems
compared to the other streets in the project. Some of these are
a very steep grade, surface drainage, and the amount of bituminous
material on the street now. With all these facts taken into
consideration, I feel that scarifying this street is not a very
good proposition.
Other methods of surfacing were considered, but the cost
is prohibitive when the end result is considered. I also contacted
one of the residents on the street to see if there might be the
possibility of 100% petition so a hearing could be waived and
include the street in the surfacing project. He stated that he
was sure 100% petition was not possible.
In view of all these facts, I would like to suggest that
you consider dropping Mayfield Heights Road off the scarifying
project for this year and try to include it in any surfacing_._
project we may have next year. I might add that the residents
I talked to seemed to favor either a permanent type surface or
do nothing at this time.

WHEREAS, the City Council of the City of Mendota Heights, Dakota County,
Minnesota, deems it necessary and desirable to consider construction
of the improvements hereinafter described.
NOW THEREFORE, notice is hereby given that the City Council of the
City of Mendota Heights will hold a public hearing on said improvements
at the following time and place within the said City:

The construction of street -improvements consisting of the
acquisition of easements and the grading, stabilization,

sewer system, including appurtenances and incidentals
thereto, and the acquisition of easements to serve the
area hereinafter more particularly described.
The area proposed to be assessed for said improvements is situated
within the City of Mendota Heights in Dakota County, Minnesota, and
is more particularly described as follows:
All properties situated within the following described area
located in the City of Mendota Heights, Minnesota, to -wit:
A line commencing at the center of the intersection of
Lexington Avenue and Overlook Road, thence proceeding west-
ward to the westerly City limits of Mendota Heights; thence,
following the City limits in a southwesterly and southerly
direction to the north right of way line of State Trunk
Highway 110; thence easterly along said right of way line
to a point approximately 660 feet easterly of the center of
Lexington Avenue; thence, north along the line 660 feet east
of Lexington Avenue to the center of Marie Avenue; thence
westerly along the center of Marie Avenue to a point 435 feet
east of the centerline of Lexington Avenue; thence, northernly
