Repair Page 425 September 3, 1974 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, September 3, 1974 Pursuant to due call and notice'thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following members were present: Mayor Huber, Councilmen Losleben, Wahl and Gutzmer. Councilman Lockwood had notified the Council that he would be out of town. APPROVE Councilman Wahl moved approval of the minutes of the MINUTES August 6 meeting. Mayor Huber seconded the motion. Ayes: 4 Nays: 0 Councilman Losleben moved approval of the minutes of the August 20 meeting. Mayor Huber seconded the motion. Ayes: 4 Nays: 0 Councilman Gutzmer moved approval of the minutes of the August 27 meeting. Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 ASSESSMENT ROLL, After a brief discussion, Councilman Gutzmer moved the ROGERS LAKE LEVEL adoption of Resolution Number 74-84, "RESOLUTION ADOPTING CONTROL PROJECT ASSESSMENT ROLL FOR ROGERS LAKE LEVEL CONTROL PROJECT (IMPROVEMENT NO. 72, PROJECT NO. 4)," and directed the City Engineer to prepare responses to the objections to the assessment roll for discussion on September 17. Councilman Losleben seconded the motion. Ayes: 4 Nays:O PLANNING The Council acknowledged receipt of the August 27 Planning COMMISSION Commission minutes. CASE NO. 74-15, Councilman Wahl moved that a public hearing on KOEPKE Dr. Thomas Koepke's application for conditional use permit to construct a veterinary hospital be held on October 1, and that the City Administrator be directed to study and make a recommendation on the trading of property between Dr. Koepke and Brian Birch. Councilman Losleben seconded the motion. Ayes: 4 Nays: 0 Page 426 September 3, 1974 ACQUISITION The Council acknowledged receipt of a memo from Park and OF PROPERTY Recreation Commission Chairman Kevin Howe recommending the initiation of condemnation proceedings for the acquisition of the Allstrom/McCloud property for park purposes. City Attorney Winthrop stated that although he would have no objection to going to condemnation on the property he still feels that it is possible to negotiate the property purchase. Mayor Huber moved to table the matter until October 1, pending additional negotiation. Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 MISCELLANEOUS Mayor Huber acknowledged receipt of a letter from Mr. & Mrs. Courtney Pince in objection to their assessment for the Rogers Lake Level Control Project. The City Engineer was directed to prepare a response for the September 17 meeting. ROAD AND BRIDGE The Council acknowledged receipt of a letter from the Dakota ALLOCATION County Administrator and a resolution regarding a proposal for the discontinuation of the road and bridge fund allotments. Councilman Losleben moved the adoption of Resolution Number 74-85, "RESOLUTION OPPOSING PROPOSED ELIMINATION OF ROAD AND BRIDGE DISTRIBUTION FORMULA." Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 MISCELLANEOUS The Council acknowledged receipt of a memo from the Association of Metropolitan Municipalities regarding a membership meeting to be held on September 11. Councilman Wahl and Councilman Gutzmer stated they would attend the meeting. The Council also acknowledged receipt of a memo from the Northern Dakota County Chamber of Commerce regarding an informal meeting of elected officials to be held on September 16. SWAN LANE The Council acknowledged receipt of a letter from Mr. Robert McCarthy requesting a hearing to consider renaming Swan Lane as Swan Drive. The City Administrator was directed to contact the Post Office to determine if a conflict would be caused by renaming the street. MSA FINANCING After a brief discussion, Mayor Huber moved the adoption of Resolution Number 74-86, "RESOLUTION REQUESTING COMMISSIONER OF HIGHWAYS TO APPROVE BASIS FOR FINANCING CONSTRUCTION OF MARIE AVENUE IMPROVEMENTS BETWEEN DODD ROAD AND VICTORIA AVENUE." Councilman Losleben seconded the motion. Ayes: 4 Nays: 0 Page 427 September 3, 1974 r I RAILROAD Administrator Johnson explained a letter and proposed SIGNALS Ex Parte Order from -the Minnesota Department of Public Safety regarding the installation of cantilever signals at the railroad crossing on Mendota Heights Road. Mayor Huber moved that the proposed Ex Parte Order covering installation of cantilever -type railroad crossing signals at Mendota Heights Road be approved. Councilman Wahl seconded the motion. Ayes: 4 Nays: 0 MUNICIPAL LIQUOR City Attorney Winthrop advised the Council that provisions for private on -sale liquor license issuance would require a referendum. The Council directed the Attorney to research State statutes on referendums and prepare an opinion for the City Council. MISCELLANEOUS The Council acknowledged receipt of the August, 1974 Engineering Status Report. STREET The Council acknowledged receipt of a proposed assessment roll SCARIFYING for the street scarifying and oiling project. LIST OF CLAIMS Mayor Huber moved the Council to adopt the following motion: RESOLVED that the claims submitted to the City Council for payment, a summary of which is set forth on the list attached hereto and identified as List of Claims submitted for payment, September 3, 1974, having been audited by the City Council, be and are hereby allowed and the Mayor and Clerk -Treasurer are hereby authorized and directed to issue City checks in payment of said claims. Ayes: 4 Nays: 0 BUILDING PERMIT Building Inspector Bjorklund advised the Council that Mr. William Wegner, 577 Valley Lane, has applied for a building permit to construct a new garage on the site of his present garage. He pointed out that a sideyard setback variance had been granted to Mr. Wegner for the original garage and recommended that the new building permit and associated variance be granted. Page 428 • September 3, 1974 Mayor Huber moved that the building permit and sideyard setback variance be granted provided that the new garage is no closer to the property line than the original garage. Radabaugh, City Clerk City of Mendota Heights • CITY OF MENDOTA HEIGHTS MEMO September 13, 1974 TO: City Council FROM: Chester Pearson Public Works Inspector SUBJECT: Scarifying and Oiling Assessment Roll, Improvement No. 74, Project No. 6 As you know the above project has been completed and the assessment roll has been made up. I would like to give you a short explanation of project costs and how the assessment rate was reached. The project originally included some seventeen streets. This was pared down to the six which made up the project. This may or may not ,have affected the cost. However, there were valid reasons for eliminating the streets that were left out of the project. We have made a good attempt to provide the residents with a reasonable driving surface yet tried to keep in mind the cost factor. When the project was completed and all the costs were determined, the figure was $5,430.18. The total assessable footage is 5,541. We then arrived at the assessment rate of $0.98 per front foot. It was originally mentioned that grouping of lot sizes might be considered in assessing. I felt, however, that considering the size of the project and the difference in lot sizes, it would be feasable and probably more fair to figure each lot on a front foot basis. This is the proceudre that was followed. (y. CITY OF MENDOTA HEIGHTS MEMO TO: City Council FROM: Orvil J. Johnson City Administrator SUBJECT: Swan Lane Research September 12, 1974 On September 3, discussion of Mr. McCarthy's letter resulted in a request for further researching on Swan Lane/Swan Drive recordings. A check with the Postal Department reveals that the street is recorded as Swan Drive in the postal directory. In fact, in the entire metropolitan area there are two Swan listings: Swan Avenue in North St. Paul and Swan Drive in Mendota Heights. If there was a Swan Lane listing also, one would guess that the postal officials persuaded us to use Swan Drive, so as to make a distinction. This theory is not applicable. I am obviously at a loss to explain why the postal department lists this as Swan Drive, and there is apparently no readily obtainable record indicating the method of communication back in 1957. Likewise, I am at a loss to explain how the terminology Swan Drive came into existence. I have no further recommendations or thoughts on the matter. Ask their parents, and they'll say their drivers licenses, magazine subscriptions, charge cards and bills all show•addresses on Swan Drive. - - Maps of the city given out free through the chamber of commerce list the street as Swan Drive, and it's shown on sewer re- cords and building permits as a drive. But the plat maps of the area show the three block long street as Swan Lane, and at an August meeting the Mendota Heights city council took action to confirm that de- signation, at a resident's request. A few days later, the signs at intersections along Swan were changed from Drive to Lane, and everyone lived happily ever after with- out getting their magazines. Wrong. A petition signed by five resi dents along the street asked the council to reverse its decision at last week's council meeting, because, after all, it's easier to change three signs than 300 charge cards. The council discussed it, knowing it was rather a silly problem. "They've been liv- ing there as Swan Drive, rightly or a wrongly," city attorney Sherman Winthrop said. "What they want is for the'eouneil to confirm the way they've been living." . "We're not,. ministers," mayor Don Huber quipped. The council agreed that the residents might have a point about keeping the street the name it's been called for aver 15 years. They decided the mistake was made when the original signs put up were "wrong," saying drive instead of lane, long ago. They decided to ask the Dost office whether "keeping" it Swan Lane instead of s "changing it" to Swan Drive would confuse the mails at all. The residents are shaking their heads. ; "The council has a lot better things to do i than inconvenience residents like this," Mary Smith, 2357 Swan, said. The City of Apple Valley, Burnsville, Farmington, Lakeville and Rosemount were invited and most of the communities did attend. The third of the area meetings will be held in the West St. Paul City Hall which is located one block west of Trunk Highway 3, south of Wentworth Avenue. The meeting will begin at 7:30 P.M. on September 18, 1974. The County will appreciate your attendance at the meeting. I w^s out of the country rt the time of the July 2nd hearing Cnd will be out of th,- city on September 17th also. I em not Fpposed to the oiling of the street, however, I don't feel my property should carry a full assessment for this work for the following repsons: 1- I was assessed for the extensive lowering of Garden Lane a few years back (which all prpperty owners on the street were opposed to) as it envolved a considerable cost for complete new lrndscaping from the house to the street plus construction of s new three lane drivewpy. The lower grPde level was done entirely for the benefit of drainage for property owners on upper HiPwPtha end Chippewa Avenues. In addition it was a vtry poor job and the black top breaks up each spring requiring considerable reppir. 2- My property is P corner lot which uses Garden Lane so Pierce being a dead end is of no use to me. 3- A low spot was left on Pierce Pbout 20 feet south of Garden Lane vihich forms a pool of water 30 feet long Pfter e rain. This vii, -ter stands in front of my house until it s lot.=ly seeps in the ground to my bpsement end also back under the road crusing P soft spot and eventupl breek up of the ro^d surface. While I Pm not against roPd improvement Ps such, I feel I heve elrepdy experienced more thin my share of expense for the primary benefit of other property owners.
