Minutes of the Regular Meeting Held
Tuesday, September 17, 1974
Pursuant to due call and notice thereof, the regular meeting of the City
Council, City of Mendota Heights, was held at 8:00 o'clock P.M. in the
City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Lockwood, Losleben, Gutzmer
and Wahl.
APPROVE Councilman Wahl moved approval of the minutes of the
MINUTES September 3 meeting.

FINAL PAYMENT Councilman Losleben moved approval of the final payment
1974 STREET for the 1974 street oiling contract to Allied Blacktop
OILING Company of Minneapolis in the amount of $3,933.21.

ASSESSMENT HEARING Mayor Huber opened the meeting for the purpose of a public
1974 STREET OILING hearing on the proposed assessment roll for the 1974 Street
IMPROVEMENTS Oiling project (Improvement No. 74, Project No. 6).
Mayor Huber turned the meeting over to Public Works
Inspector Pearson for a brief history of the project.
Mr. Pearson explained that the project was performed in
order to give the residents on the streets involved better
maintenance then they have had in the recent past. He
explained the procedure followed in the scarifying and oiling
process. He stated that the total project cost was $5,430.18
and that the proposed assessment rate is $0.98 per front
foot with adjustments for corner lots and odd -shaped lots.
He stated that the project is complete, however, additional
touch-up work will be done in some of the areas.
Mayor Huber asked for questions or comments from the
audience.
Mr. Phillip Fournier, 1306 Kendon Lane, stated that Kendon
should be checked because the street surface has sunk about
one-half inch since the street was scarified and the oil is
bleeding through the street surface.
Mayor Huber acknowledged receipt of a letter from
Donald 0. Olson, 563 Hiawatha, objecting to his assessment,
and referred the letter to the Public Works Inspector for
study and response.

audience, Councilman Gutzmer moved that the hearing be
closed.

Councilman Gutzmer moved the adoption of Resolution No. 74-87,
"RESOLUTION ADOPTING ASSESSMENT ROLL FOR 1974 STREET OILING
IMPROVEMENT (IMPROVEMENT NO. 74, PROJECT NO. 6)."

SPACE STUDY City Planner Barbara Lukermann was present to discuss the
preparation of the Space Study. She stated it is her
objective to maintain a line of communication, either written
or oral, with the Council during the preparation of the study.
She outlined the process she proposes to follow, including
contacting various communities which have either completed
or are in the process of construction on municipal facilities;
working with community groups and interviewing the various
department heads. Mrs. Lukermann stated that although the
contract specifies completion of the study in 120 days, she
would like a Council reaction on that time limit or if a
different time schedule would be preferred.
Mayor Huber agreed that the 120 days would not be adequately
long for reaction. He also asked Mrs. Lukermann to make a
written report to the Council after the initial interviewing
of the department heads.
SWAN LANE Several Swan Lane residents were present to again request
renaming the street Swan Drive. After discussion of the
matter, Mayor Huber directed the City Attorney to research
the legal implications which would be involved in changing
the street.name.
MISCELLANEOUS The Council acknowledged receipt of the Police Department
monthly report for August, 1974 and the Fire Department
monthly report for August, 1974.
COMMUNICATIONS The Council acknowledged receipt of a memo from the Dakota
County Highway Engineer regarding a meeting on the Barton/
Ashman report to be held on September 18 at the West St. Paul
City Hall.
Mayor Huber acknowledged receipt of a letter from
Mr. Arvid Rued, 787 Keokuk Lane, regarding the Mendota Water
Company rate increase request, and directed that it be
placed on the October 1 agenda.
HALLOWEEN PARTY Councilman Wahl outlined plans for a City -sponsored Halloween
Party for Mendota Heights children to be held behind the
Mendota Plaza Shopping Center on Halloween evening. He stated
that no City funds would be used for the party.

ROGERS LAKE Engineer Kishel distributed a list of revised assessment

Mayor Huber directed the City Administrator to notify the

MARIE AVENUE City Engineer Kishel pointed out that during construction of
CONSTRUCTION, DODD the east section of Marie Avenue it will be necessary to
TO DELAWARE either protect or move the Mobil Oil lines. He stated that
he has discussed the matter with the Mobil Oil engineer and
he indicated they would agree to put a casing on the cables,
charging the City for the cost of the work (at a maximum of
$10,000). Mr. Kishel stated that Mobil will submit a
proposal to the City and asked for authorization to authorize
Mobil Oil to provide the work if their proposal seems
reasonable.
Mayor Huber moved that the City Engineer be authorized to
accept a proposal from the Mobil Oil Corporation to place
casing on the Mobil Oil cables and bill the City for the
work, if the proposal is reasonable.

MARIE AVENUE Engineer Kishel asked for Council recommendations on a
DESILTING POND desilting pond in the Interstate Valley (as required by the
DNR). He asked Council reaction to the size, location,
and whether it should be permanent or temporary (during the
Marie Avenue construction period).
Mayor Huber directed Mr. Kishel to work with the Park
Commission and Administrator to determine a solution.

NOTICE OF HEARING ON APPLICATION FOR
CONDITIONAL USE PERMIT
TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of the City of Mendota
Heights will meet at 8:00 P.M. on Tuesday, October 1, 1974 in the
City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota to
consider an application for conditional use permit to construct a
veterinary hospital on Lot 1 of the Einess Addition, being the
NW's of Sec. 25, in Township 28, Range 23. Otherwise described as
a parcel located on Dodd Road at the southeast intersection of
Freeway Road.
This is pursuant to City of Mendota Heights Ordinance Number 401.
Such persons as desire to be heard with reference to the proposed
conditional use will be heard at this meeting.

MENDOTA HEIGHTS PLANNING REPORT

PLANNING CONSIDERATIONS
Upon adoption of Ordinance 123, July 16, 1974, the above use is established
as a conditional one in zoning districts B-2 and B-3. The above cited ordinance
further establishes specific performance standards for granting of conditional
use permit. The applicant has submitted specific site plans for the construction
of an animal hospital on a 0.6 acre site, currently zoned B-2 and with frontage
on a state highway.
The planning considerations covered by this report include:
1 . Conformance of site plans with specific performance standards contained
in Ordinance 123.
2. Appropriateness/compati.bility of the use with abutting properties and
configuration of the site.
3. Landscaping plans for the property.
4. Conformance of drainage and grading plans with existing and future
development, dictated by the State Highway Department at this location
and by City requirements.
FINDINGS
1 . The proposed use is judged to be compatible with established and anticipated
commercial development at the northeast quadrant of T. H. 110 and T. H. 49.
The type of building to be constructed, outdoor activity, and traffic generation
features of the use are also judged compatible with residential 'development
that exists across the street. Vacant, commercially zoned properties surround
the site to the south and east.
2. Current and future access to the site for the proposed use is also found to be
excellent. At the present time Dodd Road will provide principal access.
With future upgrading of the T. H. 110 and T. H. 49 intersection principal
access will shift to Freeway Road where a second access is provided. At -
grade intersection between Freeway Road and new T.H. 49 is planned, thus
providing adequate access to the entire B-2 zoning district.

C7: Proposed changes to the site area in an exchange of properties with Mr. Birch
CT to the east are necessary to provide for continued access and effective site
utilization. Land exchange between the two property owners is proposed to be
accomplished by metes and bounds description. Legal opinion is needed to
confirm this transaction as appropriate in lieu of a replat. A new site area of
approximately 23,640 square feet, and building area of 2,060 square feet give
a floor area coverage of 0.09. All setback requirements of the zoning ordinance
are adhered to, and the provision of 11 on-site parking spaces meets minimum
parking requirements which are required at the ratio of one space for each 200
square feet of building area.
4. Construction specifications for the building have been reviewed by the Building
inspector and standards found to be in conformance with those contained in
Ordinance 123 and as required by the City's building code.
5. Landscaping plans for the site provide berming and plantings along Dodd Road
where residential development is across the street. With the addition of plantings
along the eastern property boundary (3 trees as requested by the Planning Commission
in forwarding their recommendation for approval to the site) the planting plans provide
adequate buffering and site improvements.
6. The most important consideration relates to the grading and drainage plans for the
site. initial plans reviewed by the Planning Commission require changes.
The revised plan (submitted with red ink corrections for drainage changes on eastern
side of property) raises the elevation of the building site and provides for drainage
from the building site and paved areas to run west and north to Dodd and Freeway
Roads. Remaining portions of the property will drain southeasterly toward Trunk
Highway 110.
This plan requires approval and agreements from abutting property owners which should
be provided in writing. Approval of the plans should be conditional to City Engineer
approval and also a statement in writing to the effect that the State Highway Department
has reviewed final plans, found no conflicts with their future highway improvements
plans, and agrees to a drainage flow onto state property.
7. Sewer service to the site is proposed via an extension from the western side of Trunk
Highway 49. A 10 foot sewer easement is proposed along the northern property boundary
to allow for utility extension to Mr. Birch's property to the east. This proposal is in
lieu of bringing a sewer line into Freeway Road. An agreement is necessary to have
the property owners on the east side of,Dodd Road jointly share in future obligations
for maintenance and provision of service.

Re; Proposed Rate Increase for'Mendota Water Company
Dear Members of the Council;
During July and August the above proposal has been discussed at Council
meetings of the City of Mendota Heights, Dakota County in the State of
Minnesota.
The Council has stated during these meetings that the Mendota. Water Company
is entitled to a fair return on their investment. At the Juiy'! 6th meeting,
the Council indicated that they would use the figure of $200,000.00 ( the
assessed value of fixed assets) as the amount of investment to -determine it
the Water Company was earning a fair return. In my opinion this is not a
proper or an accepted method and does not reflect a true and accurate picture.
Being in the finance brokerage business for the past 20 years, I have analized
hundreds of financial statements and have had to determine the net financial
return on investments. The accepted practice is to use actual cash investment
as related to the net worth or shareholder's equity.
There are 138 shareholders of' record at the present time. The original price
of these shares amounted to $57.00 each. The 1973 financial report,of'the
water company indicated that the shareholder's equity amounted to $104,467.00
or $757.00 per share. After„deducting the original investment of 8S7.00. it
is determined that each'share has earned $700.00. Since the copmany has been
in operation since 1957, this figure reflects an overall net return of,76.75%
per year or annual earnings of $43.75 per $57.00 invested. These earnings
are in spite of losses during fiscal years of 1972 and 1973•
The above facts reflect that the water company has enjoyed excessive earnings
on the current $7.50 monthly rate. In 1957 when these rates were imposed on
the residents of Friendly Hills, I had recently moved from an area where I
paid approximately $4.00 a quarter ( $1.33 per month} for unmetered water
on a multiple dwelling that consisted of six apartments. It is mfr contension
that the water company has charged excessive rates for 16 years.

The 1973 annual report to the stockholders shows a loss of $5,543 but you
must bear in mind that in 1973, the company -paid $5,123 in personal property
taxes for the previous three years. They also paid $2,346 in professional
services, which is not a usual -type expense. These facts must be taken into
consideration when you analixe the current statement.
The 1972 annual report showed that the company had an income of $353.00 on
which they paid an income tax of $549.00. How is this possible?
If proper and generally accepted methods are used to determine if a rate
increase is justified, it is not conceivable that the Council would be party
to allowing the water company to gouge the residents of Friendly Hills to
an even greater extent than they have in the past.
I respectfully request that the Council allow me access to the franchise of
the Mendota Water Company and to their financial reports since inception.

-- Howe reported that the new Mendota Heights Jaycee unit has
tentatively decided to build benches for all the baseball
fields, according to an approved design, and with the City
supplying only the materials and permission. Moved by
Murphy, seconded by Shipman. Passed.
2. Park Development Status (Starr)
-- Since.Starr and Franzmeier were absent, discussion postponed
to next meeting.
-3. Bond Fund Status
-- Reviewed committed funds.
-- Johnson reviewed the reasons for the purchase of the Dehrer
property (7 acres), offered to the City at County appraised
value. Howe indicated that a majority of the board was in
favor of the purchase.
-- After discussion, Fogelson moved that the Park Board request
the Council to approve condemnation of the McCloud-Allstrom
property. Seconded by Lundeen. Passed.
4. Halloween Party (Wahl)
-- Russ Wahl discussed his idea for a Halloween bonfire including
cooperation of fire department, donated hot dog buns, etc.,
and at Friendly Hills park site.
-- After much discussion, especially regarding location, Fogelson
moved that the Park and Recreation Commission support the
concept of a Halloween Party, subject to police and fire
department scrutiny, and recommending the shopping center back
yard for the bonfire. Seconded by Murphy. Passed.

The regular meeting of the Mendota Heights Planning
Commission was called to order at 8:00 P. M., Tuesday,
September 241 19741 by Chairwoman Ridder.
The following members:were present: Ridder, Culligan,
Schneeman, Stefani, Wheeler, and City Planner Barbara
Lukermann. Clemens, Ljungkull, and City Administrator
Johnson were absent.
APPROVE MINUTES Minutes of the August 27 meeting had
been submitted with the agenda. Wheeler
_moved approval of the August 27 minutes
as written. Seconded by Culligan.
All ayes.
CASE NO. 74-15 Chairwoman Ridder opened with Case #74-15
KOEPKE and introduced Barbara Lukermann. Barbara
had presented the Commission members with
her staff report, and she explained the
newest drainage map and plans given to her just prior to the
meeting by Mr. Pete Senty.' The exchange of properties was
again discussed, and Chairwoman Ridder reported that the
Council had instructed Attorney Sherman Winthrop to look into
the exchange and report back to the Council. Dr. Koepke was
in the audience and concurred with any decisions to reach
agreement. There was informal discussion concerning the
progress of the case, and it will come before the Council
for a Hearing at the October 1st meeting.
CASE 74-19 Mr. Berskow had applied for a variance prior
BERSKOW to the August 27th meeting. After hearing his
case, Chairwoman Ridder explained that the Commission
permits variances only in'hardship cases. Culligan
moved that the variance be denied, Schneeman
seconded. All ayes.
CASE NO. 74-18 Chairwoman Ridder introduced Mr. McGough
McGough who had re -submitted a preliminary subdivision
plat plan which had been approved by the
Council about three (3) years ago. Chair-
woman Ridder referred the members to page
(301) 3 of the City Ordinances, Paragraph
2.3 (3). After some discussion, and because
the approval was ruled obsolete, Chairwoman Ridder advised
Mr. McGough to confer with.Barbara Lukermann and Orvil
Johnson and re -submit his proposal to the Planning Com-
mission and a public hearing will be required.

CASE NO. 74-20 Dick Sheehy had presented each Commission
SHEEHY CONST. member a map with topographical layout for a
McDonald's Restaurant north of the Plaza.
After some discussion, the Commission re-
commended that Mr. Sheehy bring in more complete
plans, especially with regards to the drainage problem of the
shopping area and parking lots. Culligan requested that because
of a motion made at a February meeting, Orvil Johnson review
commitments made by Sheehy Construction and Mendota Plaza
Shopping Center and find out what commitments have been made
and what commitments have not been honored.
CASE NO 74-21 Harold Kuller was introduced and presented a
MINNESOTA drawing of a free-standing sign to be placed
KNITTING MILLS northeast of their building. After a short
discussion as to the size of the sign in regard
to City Ordinance 18.3 - 1=b and consultation
with Barbara Lukermann, Wheeler made a motion for approval
since the sign conforms with the Ordinance 18.3 - 1-b.
Culligan seconded. All ayes.
DAKOTA LAND Barbara Lukermann reviewed a preliminary plan
DEVELOPMENT submitted by Dakota Land Development to
replace their original plans submitted previously
to the Planning Commission. This plan would
involve thirty-two (32) individual lots rather than the fifty-
eight (58) units involved in PUD. Ms. Lukermann presented
these plans in anticipation of Dakota Land Development's
submission of them to the Commission at an early date.
WEST END Barbara Lukermann presented a memo she had
LAND USE prepared for the Commission covering planning
ideas as to the property located West of the
lakes and Resurrection Cemetery and North of the
Industrial Park. She exhibited several maps and
explained different ideas as to the use of these properties.
Mr. Carl Cummins III was also introduced to the Commission as
a representative of Acacia Cemeteries. The West End property
also includes the land acquired by M.A.C. and will include
some highway changes. With detailed maps, Barbara explained
several thoughts as to use of these properties and some dis-
cussion followed. Ms. Lukermann will do further research as
to the responsibility of the M.A.C. in restoration of these
properties and the implication of condemnation on private
re -use prior to the next meeting.
REVIEW OF PROPOSED Since the time was late, Barbara
SUBDIVISION ORDINANCE Lukermann only touched on her memo
to the Planning Commission on "Update of
Subdivision Regulations." She rec-
commended the Parks and Recreation Commission be informed so
that they may work with the Planning Commission on this matter.

the Parks Commission receive copies of Barbara Lukermann's
Memo for reaction prior to submission of report to the City

RE: LAND USE PLAN UPDATE FOR THE WESTERN NEIGHBORHOODS
This report provides a general, overview of the issues and concerns relative to future land
use plans for neighborhoods located west of Ressurection Cemetery and north of Mendota
Heights Road. Study of these issues by the Planning Commission and Staff is a first step
toward developing a plan update for this section of the City. Ideas and alternatives for
future land use designations as presented on preliminary sketch maps are meant to illustrate
possibilities, and various opportunities. These maps do not cover all possibilities, nor do
they represent specific recommendations from staff at this time. Input from present owners
and residents in the area will be requested and provided for in developing more precise
recommendations.
QUESTIONS?
1 . Should the single family residential area developed between T.H. 55 and Resurrection
Cemetery continue and expand, following upgrading of T.H. 55?
2. What are the public cost implications of retaining residential use or other types of
uses for this property? What are the feelings and needs of present residents toward
a land use change?
3. What types of land use are possible for the property now being acquired by M.A.C.
south of Victory Drive?
4'. In what direction can or should the two cemeteries expand in the future? Can their
expansion be accommodated in such a way as to effectively utilize land that can not
be used for tax generating purposes?
5: Is the quality of access as proposed by the State Highway Department for upgrading
of T.H. 55 compatible with existing and potential new development on the west
side of T.H. 55?

BACKGROUND DATA
1 . Estimated costs for installation of frontage road on east side of T. H. 55 and installation
of noise barriers - $360,000-$375,000 based on early 1974 appraisal information.
(For section north of Mendota Heights Road and Co. 31).
2. M.A.C, constraints on reuse of property south of Victory Drive - "use must not create
a hazard to air navigation and desirably that the number of individuals exposed
not be* increased" (i.e. 280 population at time of decision to acquire). M.A.C.,
FAA and State must concur with the new use plan for the neighborhood.

Mr. and Mrs. Al Berskow respectfully request of the Council Members
that they grant a five (5) foot easement on the west end of their
property for the required offset of the proposed twenty-four (24)
foot square garage to be placed on the subject property.
The request is based on the following facts:
a. The property owners have made the purchase commitment for the
twenty-four (24) foot square garage.
b. There is at present a twenty (20) foot wide easement lane
located on the west end of subject property.
C. By reducing the required setback of ten (10) feet to five (5)
feet, the property owners would be permitted to construct a
walk way around the west end of the subject home.
d. The reduction of setback to five (5) feet would permit the
property owners to place suitable landscaping in the form of
grass and shrubs at the west end of subject home, thereby
rendering the property more appealing in appearance as well as
increasing the comfort of the home through additional shading.
e. The reduction of the setback to five (5) feet would permit a
suitable driveway of an approximate twenty (20) foot width as
access to the double door garage, at the same time permitting
a suitable sidewalk and adequate landscaping between the
driveway and the house.
f. The present twenty (20) foot easement plus the requested five (5)
foot easement plus the easement of adjacent westerly lot would
produce a net easement of thirty-five (35) feet. This would
certainly be more than adequate for utility work and/or
residential access road to property north of Furlong Avenue.

In reviewing the above mentioned case, I have
reached the following conclusions.
1. As far as I can determine there is no easement
for the 20 ft. area that is mentioned in the Berskow
letter. As the attached sheet indicates, it appears
that the owner of Lot 10 is also the owner of the
West 20 feet of Lot 11. This information was reproduced
from the Dakota County computer printout of owners and
parcels.
2. In regard to a 5 foot variance, I would see no
harm in this. It is something that has been done in
the past, and I don't see any reason why this case
should be treated any differently.

Dear Orivil:
As requested, we submit herewith a feasibility study for proposed sanitary
sewer extensions to serve certain lots along Bachelor Avenue between Dodd
Road and Lansford Lane.
The study, started out to serve six lots, becomes more involved as we look
into it to the extent that we can see at least four solutions to the
problem and there may be more. Only one solution may be practical from a
cost point of view but we present four solutions so that all aspects may
be covered.
As shown on one of the attached drawings, Scheme I consists of a sewer line
installed on an easement across the back lot lines of lots 11 thru 15 and
on the side of lot 9 and across a portion of lot 8 in Somerset Park. The
sewer depth will be minimal, and in fact a segment of 50 to 100 feet may

be too shallow, namely 4 to 5 feet deep, and may require an insulated pipe
covering or mounding over the pipe. As shown on the drawing it will be
necessary to cross a corner of lot 8 which is developed and it will also
be necessary to go through an existing bituminous driveway.
This is the shortest, most direct route but will not serve lot 10 in
block 3 nor will it serve two properties on the west side of Lansford.
To do the above work will require the installation of approximately 750
feet of 9 inch pipe and appurtenances at an estimated cost of $12,500.00
including fees and contingencies. With an estimated 773 feet of assessable
frontage, the cost comes to $16.00 per assessable foot. The above costs do
not include easements which we assume will be furnished by the property
owners.
Scheme II consists of a pipe line along the back of lots 11 thru 15 and
along the south side of lot 9 to Lansford. From there, a pipe line can be
installed on Lansford to Bachelor to a proposed sewage lift station. From
there, the sewage can be pumped through a force main to the closest man-
hole on Lansford Lane. This scheme will provide service to three additional
parcels along Lansford Lane.
To do the work will require the construction of about 900 feet of 9 inch
sewers and 400 feet of force main together with a sewage lift station for
an estimated cost of $28,348.00 including fees and contingencies. With
approximately 1098 feet of assessable frontage, the unit assessable cost is
$26.00 per foot. This also does not include easements.

Scheme III considers the possibility of an all gravity system along the
rear lot lines of the lots to be served to Lansford, thence on Lansford
to Bachelor and then on Bachelor westward to eventually connect into the
interceptor sewer line in Interstate Valley. Sewer depths can vary from
nominal to 35 to 40 feet deep. A considerable amount of Bachelor Avenue
is only 30 feet wide and additional street width will have to be acquired.
Westerly of Wachtler Avenue, the sewer line can be located on City Park
property.
To do the work as proposed by this scheme will require the construction of
about 3,000 feet of 9 inch sewers and appurtenances, including street
construction or restoration, for an estimated cost of $73,000.00 including
fees and contingencies. With approximately 2,858 feet of assessable front-
age, the unit assessable cost is estimated to be about $25.00 per foot.
About 1,000 feet of assessable frontage is adjacent to the Par 3 golf Course.
No potential assessable frontage was figured for approximately 1,000 feet
of sewer lines constructed on park property.
To make this scheme a project with reasonable assessments to the abutting
properties will require the City to pick up $40,000 to $45.000 or 55% to
60% of the project costs.
Scheme IV parallels scheme III except that it is proposed to locate the
sewer line on Wachtler Avenue from Bachelor to Marie.
Because Wachtler is a designated State Aid street, any plan for constructing
sanitary sewers on this street will require a project for at least rough -
grading the roadway.

As indicated in scheme III Bachelor Avenue from Lansford to Wachtler will
have to be upgraded with right of way on the south half of the street to
be acquired.
Property on the west side of Wachtler is park property while the method of
development of land on the east side of Wachtler may preclude any frontage
being available for assessment.
To do the work as proposed in Scheme IV will require the construction of
approximately 3,000 feet of 9 inch pipe and appurtenances, including street
construction or restoration, for an estimated cost of $80,000.00 including
fees and contingencies. With a maximum 4,000 feet of potential assessable
frontage, the estimated unit cost appears to be $20.00 per foot. With
approximately 2,000 feet of frontage questionable as to benefits, it appears
that the assessable unit rate could almost double, or the City may have to
absorb up to 50% of the cost of the project. The rough grading of Wachtler
Avenue, amounting to $20,000.00 to $25,000.00, might come out of State Aid
funds, if and when they are available.
It appears that there are several ways of providing sanitary sewer facilities
for properties along Bachelor Avenue. It is apparent that something must be
done to provide sewer service for lots in block 3 of Somerset Park. At this
time it is difficult to recommend a specific scheme to follow, except that from
a cost and expedient point of view, it appears that either Schemes I or II
might be appropriate. In the case of Scheme II, because a lift station is
involved, it may be necessary for the City to assume a part of the lift
station and force main costs amounting to $10,000.00 or $12,000.00 (40% of the
project cost) so that the assessment rates will be reasonable, namely $16.00

to $17.00 per assessable foot.
We recommend and consider feasible, Scheme Il,which permits more conventional
sewer line construction and provides service to more properties which will
ultimately have to be served. After due consideration, the Council should
establish a public hearing to review the proposed project with effected
property owners.

SUBJECT: Street Sign Inventory and Minnesota Highway Safety Program
About a year ago a street sign inventory was made by Jack Anderson
Associates to determine our sign needs to comply with the Manual on
Uniform Traffic Control Devices for Streets and Highways.
Federal Highway Safety Funds have been made available to cover the
cost of purchasing and installing signs so counties and municipalities
could bring their signing into compliance. To be eligible for these
funds there are some conditions to be met. So far, we have met the
conditions that would allow us to file an application for participation.
You should be made aware, however, that there are some non-standard
signs which would have to be removed. One such sign is the "Children
Playing" type sign.
At the present time by participating in this program we would be
reimbursed for 90% of the total cost of purchasing and installing the
required signs. The City would be required to pay the remaining 10%.
The necessary forms have been completed for application. The total
cost for signs, posts and installation amount to $9,003.89. The City
would be reimbursed for 90% of this total cost.
I feel that it is reasonable for us to want to update our signs
within the City to comply with the Federal standards. I also feel that
it is in the best interests of our residents to provide them with signs
that meet the latest safety criteria.
I might add that the federal funds made available would be a
tremendous help in the first-time cost of these signs.

RESOLUTION NO.
RESOLUTION CERTIFYING DELINQUENT SANITARY SEWER
RENTAL CHARGES TO THE DAKOTA COUNTY AUDITOR FOR
COLLECTION WITH REAL ESTATE TAXES.
WHEREAS, under the provisions of Ordinance No. 803, adopted by the
City Council of the City of Mendota Heights on August 6, 1974, it is
provided that if sewer rental charges due the City for the use of the
City's sanitary sewer system are not paid within thirty (30) days after
the mailing of a statement therefore, the City Clerk shall certify the
same to the County Auditor of Dakota County and the same shall be
collected and the collection thereof enforced in the same manner in all
respects as county and state real estate taxes subject to like penalty,
costs, and interest charges; and
WHEREAS, the City Clerk has advised the City Council that the total
sewer rental charges due the City as of September 4, 1974, for sanitary
sewer service furnished the properties hereinafter described, situated
within the City have not been paid; and
WHEREAS, the City Clerk has further advised the City Council that a
written statement for said sewer rental charges due the City as of
September 4, 1974, has been sent to the last known owner of each of said
properties and that more than thirty (30) days have elapsed since the
mailing of said statement; and
WHEREAS, said properties are all situated in the City of Mendota
Heights in Dakota County, Minnesota and the legal description of said
properties, the name and address of the last known owner thereof, and
the total amount of sanitary sewer rental charges due for each of said
parcels through September 4, 1974, are more particularly described as
follows:

NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights, Minnesota as follows:
1) That the total of said sanitary sewer rental charges set forth
above is hereby adopted and confirmed as the proper unpaid
sanitary sewer rental charges due for the above described
properties through September 4, 1974, for each of said lots,
pieces and parcels of land respectively, and the charge against
each such parcel of land shall be a lien concurrent with general
taxes upon such parcels and all thereof.
2) That the total amount of said sanitary sewer rental charges
shall be payable with general taxes for the year of 1974
collectible in 1975 (now designated by statute as real estate
taxes payable in 1975).
3) That the City Clerk shall prepare and transmit to the County
Auditor a certified copy of this resolution with the request
that each of said amounts shall be extended upon the proper
tax lists of the County to be thereafter collected in the
manner provided by law.
