Minutes of the Election Canvassing Board
Meeting Held November 7, 1974
Pursuant to due call and notice thereof, the City Council of the City of
.Mendota Heights sat as the Election Canvassing Board; the meeting was held
at 5:15 o'clock P.M. at the City Hall, 750 South Plaza Drive, Mendota Heights,
Minnesota.
Mayor Huber called the meeting to order at 5:15 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Gutzmer, Losleben, Lockwood
and Wahl.
Mayor Huber moved that the Canvassing Board approve the
results of the counting and canvass of votes by ballot
at the annual General Election of the City of Mendota
Heights, held November 5, 1974. The minutes of the City
Election, submitted by the Clerk of Election, showed the
following results:

NOTICE OF HEARING ON PROPOSED CONSTRUCTION
OF AN EXTENSION TO THE CITY'S SANITARY SEWER
SYSTEM AND STREET IMPROVEMENTS FOR A PORTION
OF BACHELOR AVENUE, WACHTLER AVENUE, AND
LANSFORD LANE
TO WHOM IT MAY CONCERN:
WHEREAS, the City Council of the City of Mendota Heights, Dakota
County, Minnesota, deems it necessary and desirable to consider con-
struction of the improvements hereinafter described.
NOW THEREFORE, notice is hereby given that the City Council of the
City of Mendota Heights will hold a public hearing on said improvements
at the following time and place within the said City:
Date and Time: Tuesday, November, 19* 1974
8:00 o'clock P.M.
Location: Mendota Heights City Hall
750 South Plaza Drive

The general nature of the improvements is:
The construction of an extension to the City's sanitary
sewer system, including appurtenances and incidentals
thereto, the restoration of streets, and the acquisition
of easements to serve the area hereinafter more particularly
described, and
The construction of street improvements consisting of
the acquisition of easements and the grading, stabiliza-
tion, drainage and bituminous surfacing and the construction
of concrete curbs and gutters on the streets located in the
area hereinafter described, and
The area proposed to be assessed for said improvements is situated
within the City of Mendota Heights in,Dakota County, Minnesota, and
is more particularly described as follows:
All properties abutting on Bachelor Avenue from
Dodd Road to Wachtler Avenue, on Wachtler Avenue from
Bachelor Avenue to Marie Avenue, and on Lansford Lane
from Bachelor Avenue to a point approximately 250 feet
southerly thereof.
The total estimated cost of each of said improvements is as follows:
Sanitary Sewer $50,000.00
Street Improvements $50,000.00
It is proposed to assess every lot, piece or parcel of land benefited
by.said improvement whether abutting thereon or not, based upon bene-
fits received without regard to cash valuation.
Persons desiring to be heard with reference to the proposed improvement
should be present at this hearing.
This Council proposes to proceed under and pursuant to the authority
granted by Minnesota Statutes 1973, Section 429, as amended.

Re: Sanitary Sewers and Street Construction
Bachelor/Wachtler Avenue
Dear Resident:
On Tuesday, November 19, 1974 at 8:00 o'clock P.M. the City Council
will hold a feasibility hearing regarding the above mentioned project.
The purpose of this letter is to advise you of some of the aspects of
the proposed project. Four different proposals for servicing this area
have been prepared and will be presented and discussed at the hearing.
There may be other suggestions which could also be considered,•'The four
proposals range from a very minimal project to a more extensive project
that would serve a large area. The following comments will give you a
very brief explanation of the area involved in each proposal.
Proposal I consists of a sewer line installed on an easement
across the back lot lines of Lots 11 through 15, along the side of Lot 9
and across a portion of Lot 8,in Somerset Park. The sewer would be
fairly shallow and may require insulating. This line would connect to
the existing sewer line on Lansford Lane.
Proposal II consists of installing a sewer line on an easement
across the back of Lots 11 through 15 and along the side of Lot 9 to
Lansford Lane. The sewer line would then go north to Bachelor to a
proposed sewage lift station. The lift station would pump the sewage
south to the first existing manhole. This proposal would provide
service to three additional parcels along Lansford Lane.
Proposal III includes the sewer along the rear lot lines to Lansford,
north on Lansford to Bachelor, then westward on Bachelor to eventually
connect into the interceptor sewer line in Interstate Valley. This
proposal involves a'larger total cost figure and would also provide a
larger service area.
Proposal IV is much the same as Proposal III except that when the
sewer reaches'Wachtler Avenue on Bachelor the line would extend south on
Wachtler to Marie Avenue. Again, the total cost of this proposal is
greater but also provides a larger service area.
As mentioned above, the foregoing are proposals, under consideration.
There has been no determination by the City Council or staff officials as
Bachelor/Wachtler Avenue -2- November 4, 1974
to how this area would best be served, therefore your comments and
participation at the hearing would be welcomed and desired.

-- Shipman moved and Fogelson seconded motion to adopt Park Ordinance
with the following clarifications:
a.) Section 6 -- remove word "attire."
b.) Section 8 -- insert instead, "no horses .... allowed in
(cultivated) areas of the parks except for specifically
designated and/or posted exceptions." Passed. .
-- Finn moved, Murphy seconded that Marie Park hockey rink be authorized
for horse training activities during summer months. Passed.
Summer Recreation
-- Consideration given to request for a mens' slo-pitch softball league;
seeking support and coordination of Park Board for scheduling of
fields.
Action: Selander to check with Mend -Eagan for schedules.
Action: Franzmeier/Selander to inventory available fields.
Winter Recreation
-- Selander reported he is ready to hire rink attendants.
Park Contract
-- Finn moved, Fogelson seconded motion to recommend Council authorization
of Change Order to park contract providing for $1,342 beyond original
contract price. Passed.
-- Also, Finn moved, Fogelson seconded motion to recommend Council
authorize final payment to contractor, reducing hold -back to $1,000.
Passed.
Ivy Hills Park
-- Presentation by J. McGough regarding his proposed development and its
affect on Ivy Hills Park, including discussion of Butler Avenue
vacation and City acquisition of four lots.
'+ Park Commission Minutes -2- October 23, 1974
-- After much discussion, it was moved by Finn, seconded by Fogelson
that Chairman Howe write a letter to the Council expressing the
concerns of Park Board regarding this subject, including the
suggestion that Midwest Planning should do a study regarding the
need for road (since the question of acquisition hinges on
vacation of road). Passed.
-- Decided that at present there are too many "unknowns" to make
specific recommendations.

-- Howe requested that action be taken to reserve musicians for 1975
Park -a -Rama. Action: Fogelson.
Cross -Country Skiing
-- Presentation by L. Greenberg regarding proposal for marking and
clearing cross country trails in parks, with outside limit of
$150 aid in project.
-- Finn moved, Murphy seconded motion that cross country ski group,
may clear trails, with Franzmeier approval, specifically in
Valley and Friendly Hills Park. Passed.
Rogers Lake
-- Franzmeier announced that entrance road to park was being widened
and one slough filled in.
Budget
-- Johnson briefly reviewed budget approved by Council.

RESOLUTION NO.
RESOLUTION RESCINDING RESOLUTION NUMBER 74-90,
AND RE-ESTABLISHING THE 1974 TAX LEVY, COLLECTIBLE
IN 1975 -
WHEREAS, Resolution Number 74-90 was based on preliminary Local
Government Aid data; and
WHEREAS, documented Local Government Aid data received from the
Department of Revenues on October 8, 1974 differed from the preliminary
data; and
WHEREAS, the levy must be re-established to reflect an increase in
1975 Local Government Aids;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Mendota Heights, that Resolution Number 74-90, entitled "Resolution
Approving 1974 Tax Levy, Collectible in 1975," be and is hereby
rescinded in its entirety; and
BE IT FURTHER RESOLVED that the Dakota County records be corrected
and the following sums of money be levied for the current year, collectible
in 1975, upon the taxable property in said City of Mendota Heights for the
following purposes:
General Fund $325,920.00
Civil Defense Fund 500.00
Firemen's Relief Association 10,100.00
Debt Service
Park Bonds 354,000.00
Total Tax Levy $371,520.00
Provision has been made by the City for payment of $26,620 as the City's
contributory share of the Public Employees' Retirement Fund, as provided
for in Minnesota Statutes Annotated, Sections 353.01 et. seq. No further
levy is required for this purpose.
The City Clerk is hereby instructed to transmit a certified copy of this
Resolution to the County Auditor of Dakota County, Minnesota.

SUBJECT: Volunteer Fire Department
Establishment of Total Membership
In late 1972 and early 1973 the City Council considered changes
to the ordinance establishing the Volunteer Fire Department. During
this discussion period, a number of changes in the original ordinance
were considered, one change being the number of firemen to be on the
Volunteer Fire Department. In the old ordinance, the maximum number
was restricted to twenty-five volunteers. There seemed to be little
reason or justification for a fixed figure of twenty-five as
established in the old ordinance. The amending ordinance was passed
on March 6, 1973 with this type of language: "the Volunteer Fire
Department shall consist of a chief and assistant chief, a fire
marshall and such number of firemen as the Village Council from time
to time shall authorize."
During the past year to year and a half I have been applying mild
pressures to fire department members encouraging the recruitment of
day -time volunteers. Three new members were approved by the City
Council within the last year. During this time we have not discussed
a maximum total membership, however, the figure of thirty has come up
from time to time. As you may or may not recall, our largest deficiency
as determined by the Insurance Services, is manpower and in particular
day -time response manpower. The total number of volunteer response as
suggested by the Insurance Services is somewhat hard to understand and
will not even be quoted at this point.
After giving consideration to actual day -time response, to past
experience, to Insurance Services recommendations, to the fiscal
relationship of increased numbers (current costs and pension costs);
I believe that the fire department roster should be established at
thirty, excluding the named officers. At the present time there are
twenty-six volunteer firemen, exclusive of the chief and assistant chief.
Establishing a total of thirty would allow for the recruitment of four
more day -time members. Considering recent appointments and anticipated
further appointments, the future training responsibilities, the new duty
assignments, and in general, the "shake -down" resulting from this many
new members will require considerable effort by the Fire Department
officials.
In conclusion I recommend establishing a roster of thirty firemen,
exclusive of the named officers, and approval of the two previously
submitted applications, namely Tom Olund and Peter Kovacs. This will
leave two unfilled positions.

RESOLUTION ESTABLISHING 120 DAY MORATORIUM
ON BUILDING AND DEVELOPMENT IN THE AREA
BOUNDED BY STATE TRUNK HIGHWAY NO. 55, STATE
TRUNK HIGHWAY NO. 110, RESURRECTION CEMETERY
AND MENDOTA HEIGHTS ROAD
WHEREAS, the Southwesterly portion of Mendota Heights bounded by State
Trunk Highway No. 55, State Trunk Highway No. 110, Resurrection Cemetery
and Mendota Heights Road is undergoing a radical land use change
because of:
a. The acquisition by the Metropolitan Airport Commission
of 53 homes situated on approximately 73 acres for -
air transportation privileges;
b. The planned improvement and realignment of State Trunk
Highway No. 13 and State Trunk Highway No. 55;
C. The planned highway improvements involving State Trunk
Highway 110, State Trunk Highway 55 and State Trunk
Highway 13 between Acacia Cemetery and Resurrection
Cemetery;
and

WHEREAS,'existing dwellings situated in said area -will become more
isolated and in a location more difficult to provide the normal govern-
mental services such as education, police protection, fire protection,
recreational amenities and the many other services expected by the
citizenry; and
WHEREAS, the total impact of air transportation and land transportation
facilities in said area is disrupting past land development trends in
said area; and
WHEREAS, the City Council deems such planned improvements to be dis-
ruptive of past planning policies and worthy of future development
plans; and
WHEREAS, any unplanned development within said area would add to the
problems presently existing in such area and would -tend to cause addi-
tional human suffering;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Mendota Heights that the City Council hereby declares a moratorium on
any future development within the area hereinabove described for a period
of 120 days from the date hereof; and
BE IT FURTHER RESOLVED that the City Building Inspector shall refuse to
issue building permits within said area during said period; and

BE IT FURTHER RESOLVED that the Planning Commission and City Council
shall forthwith pursue whatever additional planning is necessary for
the area, taking into account the numerous factors affecting land
development within said area.

RE: Abatement of Sewer Charge for Gould, Inc.
We received a letter from Gould, Inc., on November 41
19741, requesting an abatement on their sewer rental charge. The
abatement was asked for based on the following circumstances:
The,Gould facility has a 2 inch plastic underground
pipe feeding their lawn sprinkling system. This line comes out
of the building in the southeast corner. For some period of
time, they noticed a water build up in the low area on the east
and north sides of their building. At first, they did not
associate these accumulations with the sprinkler system. Appar-
antly they did spend some time determining where the water was
coming from. In October they found a split in the 2" plastic
line on the sprinkler system.
I have made a personal visit to the facility where
Mr. Carl Anderson, the building manager, explained the problem
to me, and pointed out the area where the break had occurred
as well as the area where the water had accumulated. From this
visit, I see no way that this water could have entered our sewer
system. _
I have also reviewed the past billings for the facility
with Gil. From this review, I feel that the usage had a normal
pattern until the latest billin_g_which would reflect the leakage
of the sprinkler system.
The bill for the period involved is in the amount of
$11807.00. This amount represents a $713.00 increase over the
same three month' period last year. After reviewing the past
billings and the visit to their facility, I do feel that a
reduction on the billing in question would be reasonable and
fair.
Being that the rates have not increased in the past
year and that I can see no real change in the operation of the
facility, a reduction of $713.00 would seem appropriate.
I might add that the break has been repaired and that
the reduction would apply to only the billing for the one
period:
I believe a motion would be required for the adjustment
of the billing for the period of July, August and September, and
authorizing the City Clerk to issue an adjusted bill to Gould, Inc.
