Minutes of the Regular Meeting
Held Tuesday, November 5, 1974
Pursuant to due call and notice thereof, the regular meeting of the City
Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the
City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Lockwood, Losleben, Wahl and
Gutzmer.
EMPLOYMENT City Administrator Johnson stated that Mrs. Marna Johnson
CHANGES has terminated her employment as bookkeeper, effective
on November 1, and that several applications for the position
were received and interviews have been conducted.
Mr. Johnson recommended that Mrs. Joanne Cobian be appointed
to the position of bookkeeper at a salary of $670 per month.
On the recommendation of the City Administrator,
Councilman Lockwood moved that Mrs. Joanne Cobian be employed
as bookkeeper at a salary of $670 per month.
Councilman Gutzmer seconded the motion.

CHANGE ORDER After a brief discussion, Mayor Huber moved the approval of
IMPROVEMENT NO. 74 Change Order No. 1 for the 1974 Street Resurfacing Project,
PROJECT NO. 5 Improvement No. 74, Project No. 5, in the amount of
$2,986.16.
Councilman Wahl seconded the motion.

FINAL PAYMENT Councilman Losleben moved the adoption of Resolution
No. 74-94, "RESOLUTION ACCEPTING WORK AND APPROVING FINAL
PAYMENT (IMPROVEMENT NO. 74, PROJECT NO. 5)."
Councilman Gutzmer seconded the motion.
Ayes: 5
Nays: 0
MENDOTA WATER Mayor Huber acknowledged receipt of a letter from
COMPANY Mr. John McGirl, attorney for the Mendota Water Company,
regarding system improvements. The Council also acknowledged
receipt of a memo from Mr. Lawrence Shaughnessy, City Financial
Advisor, regarding the Company's rate increase request.
Mrs. Leonard Dahl, 749 Decorah, complained about the redness
of the water being supplied to her home and submitted samples
of the water.
Mayor Huber suggested that the Council hold a special
meeting to discuss the requested rate increase and asked
the Council members to study the memo from Mr. Shaughnessy

prior to such meeting.
After a brief discussion, Councilman Lockwood moved that the
City Council hold a special meeting on Monday, December 9 at
8:00 P.M. to discuss the rate increase request, conditional
upon the ability of the Mendota Water Company officials to be
in attendance at the meeting.
Councilman Wahl seconded the motion.

COMMUNICATIONS Mayor Huber acknowledged receipt of a letter from
Mr. Arvid Rued, 787 Keokuk Lane, regarding the Mendota Water
Company rate increase request, and a letter from
Mr. Bernard Friel regarding water pressure and volume
improvements in the service to his home.
The Council acknowledged receipt of a letter from the Office
of Local and Urban Affairs advising the City officials that
the application for Lawcon funding for acquisition and
development of Valley Park has been denied.
The Council also acknowledged receipt of the following: a
petition for sanitary sewer improvements for the Dodd Road/
Freeway Road area; and the Association of Metropolitan
Municipalities newsletter for October, 1974.
PAUL MACZKO The Council acknowledged receipt of a letter from the
attorneys representing Mr. Paul Maczko in regard to the
Rogers Lake Overflow Project. Mayor Huber noted that the
matter is being processed and directed the City Administrator
and City Attorney to continue working on the matter.
POLICE DEPARTMENT The Council acknowledged receipt of the Police Department
REPORT monthly report for September, 1974.
PLANNING The Council acknowledged receipt of the minutes of the
COMMISSION October 22 Planning Commission meeting.
CASE NO. 74-17, Mr. William Price, representing Dakota Land and Development,
DAKOTA LAND AND presented preliminary plans for the development of the Russ
DEVELOPMENT property located on Wachtler Avenue. Mr. Price stated that
the land is proposed to be divided into lots of a minimum
of 15,000 square feet, most of the lots to consist of 17,000
to 22,000 square feet. Mr. Price stated that his firm has done
preliminary investigation on sanitary sewer layouts, and
outlined the alternatives for the Council. He also outlined
possibilities for drainage/storm sewer facilities, proposing
the construction of a temporary holding pond in the woods at
the back of the property.
Councilman Wahl expressed concern over the length of the
cul-de-sac extending from Farmdale Road and suggested that this
be dead -ended rather than ending in a cul-de-sac.

Administrator Johnson pointed out the possibility of very
high noise levels resulting from the proximity of the
back of the property to the NSP tank farm. The Council
discussed various alternatives for protecting future home
owners from high noise levels. Mayor Huber suggested that a
variance from the 15,000 square foot lot size could be
considered to allow for moving the lots further away from
the tank farm, and utilizing the trees at the rear of the
property as a noise barrier.
The Council suggested to Mr. Price that the developers should
work towards developing a solution to the noise problem,
including contacting NSP for assistance. The Council directed
the City Engineer to work with Mr. Price on a drainage system
plan for the property.
CASE NO. 74-18, City Administrator Johnson gave the Council a brief history of
MC GOUGH the Jerry McGough application for subdivision of five acres of
property along Butler Avenue. Mr. Johnson stated that both
the Park and Recreation Commission and Planning Commission have
considered the preliminary plat and that the Planning Commissior
discussion centered mainly on the park considerations. He
pointed out that the biggest item of concern would be the
problem of traffic circulation -- should Butler be extended?
Park Commission Chairman Howe stated that he would be in
favor of acquiring Lots 1, 2, 3 and 4 for expansion of the
present park land and opposes any extension of Butler since
if Butler were extended many of the present park facilities
would have to be relocated.
Mr. Richard Foreman, 688 Woodridge Drive, presented a petition
from residents of the Ivy Falls area opposing extending
Butler Avenue because of relocation of present park facilities,
possible reduction in the size of the Ivy Hills Park and
the possibility of additional traffic in the area.
Mr. Amos Martin, 700 Woodridge Drive, stated his opposition
to extending Butler Avenue.
Councilman Gutzmer stated he would be opposed to extending
Butler because of the effects vehicular traffic would have
on the present park facilities; he favors acquisition of the
four lots for park expansion.
Mayor Huber stated that the Council will take the matter under
advisement and referred the application to the Park Commission
for additional information on proposed development of the park.
RECESS The Council meeting was recessed at 10:30 o'clock P.M.
The meeting was readjourned at 10:45 o'clock P.M.
CASE NO. 74-24, On the recommendation of the Planning Commission,
HIPP Councilman Lockwood moved that the application submitted
by August Hipp, 2124 Aztec Lane, for a three foot variance
from the front -yard setback requirement be approved.

PARK PROJECT Park Planner Lee Starr was present to explain a proposed
CHANGE ORDER Change Order to the Park Project No. 2 contract.
Administrator Johnson pointed out that the items listed on
the change order were the result of discussions between the
Planner, Park Commission, contractor and staff, and recommended
the Change Order be approved.
After a lengthy discussion, Councilman Gutzmer moved the
approval of Change Order No. 5 in the amount of $1,342.00.

FINAL PAYMENT Park Planner Starr recommended that the contractor for
PARK PROJECT Park Project No. 2 construction be authorized to submit for
NO. 2 processing his certificate for final payment for work completed
on the park project. He recommended that $1,000 be retained
from the final payment until the spring of 1975 so that the
Planner can make sure that the planted materials are
well-established, healthy and have -survived the winter.
DAKOTA COUNTY Ms. Nan McKay, of the Dakota County Housing and Redevelopment
HRA Authority, made a presentation of the Dakota County rent
subsidy program. She explained that the program only
involves subsidizing rent for low-income families, in
housing presently used for rental purposes., and does not
involve construction of any type of housing.
Mayor Huber expressed concern that this type of program might
encourage "unauthorized" use of homes not presently used
(or allowed to be used) for rental purposes.
Councilman Lockwood moved the adoption of Resolution
Number 74-95, "RESOLUTION APPROVING DAKOTA COUNTY PROGRAM OF
RENTAL ASSISTANCE."

MARIE AVENUE City Attorney Winthrop advised the Council that meetings
with the McClouds relative to acquisition of property
for Marie Avenue right-of-way have been unsuccessful. He
further stated that the plaintiffs have been advised that
work on the section of Marie Avenue between Eagle Ridge Drive
and Dodd Road will commence on November 8 and that the
plaintiffs and the McClouds are to meet to negotiate the
property acquisition while construction on this section
proceeds.
TEMPCO Mr. Peter Kronan, of Tempco Manufacturing, was present to
request approval of a building permit for expansion of the
present Tempco building. The Council members pointed out
that no landscaping (screening) has been done at the rear
of the Tempco property, the driveway should be blacktopped,
and the current outside storage at the Tempco property is in
violation of City ordinances.
Mr. Kronan stated that the landscaping is not possible because

the property is lower than the abutting street. He also
stated that the company cannot afford either the landscaping
or the blacktopping.
The Council directed that the City Administrator and
Building Inspector work with Mr. Kronan to develop some type
of plan which would be acceptable.
FEASIBILITY The City Engineer and Administrator outlined for the Council
STUDY the need for street and drainage improvements in the First,
Second, Third and Fourth Avenue, Laura, Clement and Vandall
area, and recommended that the Engineer be directed to
prepare a feasibility report on such improvements.
After a brief discussion, Councilman Gutzmer moved the
adoption of Resolution No. 74-96, "RESOLUTION ORDERING
PREPARATION OF REPORT ON IMPROVEMENTS."
Councilman Losleben seconded the motion.

KIRCHERT/CARLSON City Engineer Kishel presented final plans and specifications
for sanitary sewer and water improvements to serve the
Kirchert and Carlson properties (Improvement No. 74,
Project No. 4).
Mayor Huber moved the adoption of Resolution Number 74-97,
"RESOLUTION ORDERING SANITARY SEWER AND WATER IMPROVEMENTS
FOR KIRCHERT/CARLSON PROPERTY AND APPROVING PLANS AND
SPECIFICATIONS THEREFOR (IMPROVEMENT NO. 74, PROJECT NO. 4)."
Councilman Losleben seconded the motion.

CHANGE ORDER, Engineer Kishel recommended the approval of Change Order
IMPROVEMENT 73, No. 1 for Improvement No. 73, Project No. 3, to include
PROJECT 3 construction of the improvements to serve the Kirchert/Carlson
properties.
Mayor Huber moved the approval of the Change Order No. 1,
Improvement No. 73, Project No. 3, in the amount of $6,002.50.
Councilman Losleben seconded the motion.

MISCELLANEOUS The Council acknowledged receipt of the October, 1974
Engineering Status Report.
MENDOTA WATER Councilman Losleben moved the adoption of Ordinance No. 203,
COMPANY "AN ORDINANCE AMENDING ORDINANCE NO. 201," to allow for an
extension of the Mendota Water Company franchise to serve
the Kirchert/Carlson properties.
Councilman Lockwood seconded the motion.

MAC AWARD City Attorney Winthrop stated that the Commissioner's
Award, in connection with the Metropolitan Airports
Commission acquisition of the Pilot Knob Park site,
in the amount of $27,500 can be released upon acceptance of
award if the City waives the right to appeal, and
Mr. Winthrop recommended that the award be accepted.
Councilman Wahl moved that the Commissioner's Award of
$27,500 be accepted and that the City waives the right
of appeal.
Councilman Losleben seconded the motion.

EMPLOYMENT Administrator Johnson stated that Chester Pearson has
STATUS satisfactorily completed a six-month probationary period as
Public Works Inspector and recommended that he be given
permanent employment status.
Mayor Huber moved that Chester Pearson be given permanent
employment status as Public Works Inspector.
Councilman Lockwood seconded the motion.
Ayes: 5

VOLUNTEER FIRE The Council members discussed the applications for appointment
DEPARTMENT to the Volunteer Fire Department from Thomas Olund and
Peter Kovacs.
Mayor Huber moved that the two applicants be appointed to
the Volunteer Fire Department.
Councilman Lockwood seconded the motion.
Councilman Gutzmer questioned the necessity for a thirty -man
complement and Administrator Johnson stated that both
Insurance Services and City experience points to the need
for additional day -time response availability and that each
of the applicants would be available for day -time response.
After a brief discussion, Councilman Lockwood withdrew
his second to the motion.
Mayor Huber withdrew the motion to appoint the two applicants
to the Fire Department.
The Council directed the City Administrator to prepare
a written recommendation on the number of Volunteer Firemen
needed to provide necessary fire services.
CANVASSING BOARD Mayor Huber moved that an Election Canvassing Board meeting
be held on Thursday, November 7 at 5:15 o'clock P.M.

MISCELLANEOUS City Administrator Johnson stated that the County Assessor
has contacted him relative to establishing a meeting date
to informally discuss abatements, and requested that the
Council members set a date for the meeting.
The Council members requested.that,the County Assessor be
present at the City offices on Thursday, November 14 at
4:45 P.M. to discuss abatements.
MENDOTA HEIGHTS Public Works Inspector Pearson requested that the City
ROAD SPEED LIMIT Council adopt a resolution requesting the Minnesota Highway
Department to establish a forty mile -per -hour speed limit
on Mendota Heights Road from Highway 49 to Highway 55.
Councilman Lockwood moved the adoption of Resolution No. 74-98,
"RESOLUTION REQUESTING ESTABLISHMENT OF SPEED LIMITS FOR
MENDOTA HEIGHTS ROAD."
Councilman Gutzmer seconded the motion.

RHEIN EASEMENT Public Works Inspector Pearson stated that in order to proceed
with the Kirchert/Carlson sewer and water improvements,
it will be necessary to obtain a permanent easement from
Paul and Judith Rhein in the amount of $300, and recommended
that the easement be acquired.
Councilman Wahl moved that the City acquire a permanent
easement from Mr. and Mrs. Paul Rhein in the amount of $300.
Councilman Losleben seconded the motion.

MISCELLANEOUS The Council acknowledged receipt of the September, 1974
Financial Statement.
LIST OF CLAIMS Councilman Losleben moved the adoption of the following
motion:
RESOLVED that the claims submitted to the City Council for
payment, a summary of which is set forth on the list attached
hereto and identified as List of Claims submitted for payment,
November 5, 1974, having been audited by the City Council,
be and are hereby allowed and the Mayor and Clerk -Treasurer
are hereby authorized and directed to issue City checks in
payment of said claims.

BUILDING PERMIT After a brief discussion, Councilman Wahl moved that the
MORATORIUM City Attorney be directed to prepare a resolution establishing
a 120 day moratorium on the issuance of building permits
in the area bounded by TH 55, TH 110, Resurrection Cemetery
and Mendota Heights Road.
Councilman Gutzmer seconded the motion.

RADIO ALERTING City Administrator Johnson outlined his memo on a proposed
SYSTEM radio alerting system for the Volunteer Fire Department,
and recommended that the staff be directed to prepare
specifications for the purchase of "personal pager" type
radio units.
Councilman Lockwood moved that the concept of personal
pagers for the Volunteer Fire Department be accepted and
approved.

Held on November 19, 1974
Pursuant to due call and notice thereof, the regular meeting of the City
Council, City of Mendota Heights, was held at 8:00 o'clock P.M. at the
City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Huber called the meeting to order at 8:00 o'clock P.M. The following
members were present: Mayor Huber, Councilmen Lockwood, Losleben, Gutzmer
and Wahl.
TAX ABATEMENTS County Assessor O'Toole was present to request approval of
several tax abatements.
Councilman Wahl moved that abatements be granted to the
following:
Alice R. Booth, for Parcel No. 27-22450-030-02, reducing
assessed value from 21,600 to 21,400 for taxes payable in 1974.
Harry Johnson, for Parcel No. 27-22450-040-02, reducing
assessed value from 21,800 to 21,320 for taxes payable in 1974.
William F. Mazzitello, for Parcel No. 27-22450-050-02, reducing
assessed value from 22,800 to 20,200 for taxes payable in 1974.

HEARING -- Mayor Huber opened the meeting for the purpose of a hearing on
BACHELOR AVENUE proposed sanitary sewer (and associated street restoration)
SANITARY SEWER improvements to serve the Bachelor Avenue area. Mayor Huber
turned the meeting over to the City Administrator for a
brief history and description of the proposed improvements.
Administrator Johnson stated that the proposed project was
initiated by a petition received on May 10. He noted
that hearing notices had been mailed.to all abutting property
owners and had been published in the West St. Paul Sun. He
stated that four schemes for servicing the area had been
prepared as part of the feasibility study and a fifth plan
has been prepared since the receipt of the study.
Administrator Johnson and the City Engineer explained the five
proposals for the audience, including the engineering details,
service area and estimated cost.
Mayor Huber asked for questions and comments from the audience.

Mr. John Fahey, 1709 Lansford Lane, stated his opposition
to Scheme 1 and that he favors Scheme 5. He also asked about
the possibility of street and water improvements in
conjunction with Scheme 5.
Mr. Alois Manthe, 1715 Lansford Lane, stated that he
favors Scheme 5, the other schemes would be too costly.
Mr. and Mrs. Emil Slowinski, 806 Bachelor, opposed any
proposal except Scheme 5.
Mrs. Anthoy Strauss, 717 Stanwich, asked about additional
cost figures for street and water improvements.
Dr. C. N. McCloud and David McCloud opposed all proposals
except Scheme 5, and firmly opposes Schemes 3 and 4.
Mr. Anthony Strauss, 717 Stanwich, stated that Scheme 5
is the best scheme because it would eliminate a temporary -type
insulated sewer.
Mr. John Jantzen, 1722 Lansford Lane, expressed his opposition
to all schemes except Scheme 5.
Mayor Huber asked that anyone having objections to the
proposed project submit a letter to the Council or sign
a list provided by the City Clerk. I-,

audience, Mayor Huber moved that the hearing be closed.

URBAN COUNCIL Mr. John Klein, Project Director for the Urban Council on
ON MOBILITY Mobility, was present to request permission to erect a
twelve by twenty-five foot porta-panel mobile sign on
property owned by Gould, Inc. at the southeast corner of
TH 13 and TH 55. He explained that the sign would
"advertise" important meeting dates related to highway
construction and that the sign would be used at this location
intermittently until June of 1975. Mr. Klein outlined the
goals and membership of his group.
Mayor Huber asked if the City officials will be provided with
information on the number and location of respondents to the
sign and Mr. Klein stated that such information would be
available.
Councilman Losleben moved that a variance be granted to allow
the use of a 12 by 25 foot mobile sign at the requested
location intermittently through June of 1975, contingent
upon proper permission from the property owners.

an interim Space Study prepared by the City Planner and

MISCELLANEOUS The Council members acknowledged receipt of a Northern Dakota
County Chamber of Commerce newsletter regarding a general
membership meeting to be held on Thursday, November 21.
ASSESSMENT SPLIT Administrator Johnson stated that information has been
received from the County Assessor, requesting authority
for an assessment split for property owned by Carmen Tuminelly
and Harvey Bream in the Eagle Ridge Development. He pointed out
that several months ago the developers had presented plans for
development of the area to the Planning Commission and
City Council. He stated that the County Assessor's request
indicates that the developers plan to divide the parcel into
three parcels. Mr. Johnson asked that the Council formally
refuse to split the assessments on the property.
It was the concensus of the Council that if there is a basis
for denial, the assessment split request should be refused.
MISCELLANEOUS Councilman Wahl gave the Council a brief report on the
Halloween Bonfire.
Councilman Losleben again requested that an ordinance be
drafted to control balcony barbecues. Administrator Johnson
was directed to request a copy of the proposed City of
West St. Paul ordinance regulating this activity.
MC GOUGH PROPERTY After a brief discussion, the Council referred Planning
Commission Case No. 74-18, McGough subdivision, back to
the Planning Commission for additional information on street
considerations for this area.
PROPERTY City Attorney Winthrop stated that in August of 1974 the
ACQUISITION Council approved the purchase of seven acres of the
Dehrer/Rahn property on Marie Avenue and recommended that
the Council adopt a resolution approving the purchase. The
purchase price would be $12,600 subject to payment of taxes
and assessments by the owners.

SEWER RENTAL The Council acknowledged receipt of a memo from the
ADJUSTMENT Public Works Inspector regarding a request from Gould, Inc.
to adjust their quarterly sewer bill to reflect a charge
similar to the third quarter charge last year. Mr. Pearson
Pointed out that the raise in the bill was apparently the
result of a leak in a two-inch underground pipe. He
recommended that the bill be reduced by $713.00.
Mayor Huber moved that the third quarter sewer rental for
Gould, Inc. be reduced to $1,094.

TO: Mayors and clerks of cities served by Northern States Power Company
SUBJECT: Status Report: results of meeting November 8 of affected cities
Representatives of about 50 of the cities served by Northern States Power Company
met November 8th to discuss possible alternative courses of action in response to the
anticipated filing of a general rate increase by NSP early in 1975. Agreement was
virtually unanimous that the affected cities should join together to take whatever
actions are necessary to insure that all the important policy questions inherent in the
rate filing are properly scrutinized and that the interests of consumers are adequately
protected. There are several factors that make such participation crucial: First,
this will be the Public Service Commission's first electric rate case under the new
law and important precedents will undoubtedly be set; second, the commission and its
staff are relatively new and untried; and third, the proposed rate increase is likely
to be substantial.
There was also general agreement among the cities represented to support the use
of the Suburban Rate Authority as the vehicle through which cities who wish to parti-
cipate can present a united front and provide expert advice on behalf of consumers to
the'Public ServicE Commission.
The Suburban Rate Authority (SRA) is a joint powers agency of 18 member cities
from suburban Hennepin and Anoka counties, formed about 10 years ago to represent those
cities in gas rate matters. As a result of their participation in gas rate regulation,
the SRA members and staff have evolved very considerable expertise in the complex and
specialized matters that are involved in utility rate -making. Further, the SRA has
substantial financial assets which the members may determine to use to assist in
mounting the electric rate case.
Possible changes in the SRA joint powers agreement had already been under con-
sideration by the SRA members, which would permit any city in the Twin Cities area to
join the SRA and would also permit the SRA to represent individual cities outside
the Twin Cities area before the Public Service Commission on a request basis. At
the November 8th meeting, an Ad Hoe Committee was appointed, chaired by Bruce Nawrocki,
League Vice President, and with representatives from Minneapolis, St. Paul, outstate
communities and representatives of the SRA. The Ad Hoc Committee will meet to discuss
how to proceed in the NSP rate case and what changes in SRA structure, operations and
financing should be considered to make the SRA a suitable vehicle tc represent the
interests of participating cities.
According to persons familiar with utility rate regulation proceedings, the cost
of providing the necessary technical expertise on a consulting basis to critically
examine the NSP rate filing and do offer testimony on behalf of the affected cities
and consumers for this case, will be substantial. One knowledgeable estimate put it
in the neighborhood of $50,000. Hswever, the amount that individual cities would need
to contribute to this effort is not yet known, since it depends upon a number of
factors including a more precise estimate of the cost and a determination by the SRA
�C cities of the amount of current SRA assets which can be used in mounting the case.

As noted in a previous mailing, the next General Membership Meeting of
the Association of Metropolitan Municipalities will be 7:30 P.M., Thursday,
December 12, 19742 at the Ste Louis Park Recreation Center, 5005 West 36th
Street, St. Louis Park. (map on reverse side)
The main item of business will be consideration of the Legislative Policy
Recommendations proposed by�the Board of Directors. You previously re-
ceived the Recommendation relating to Municipal Revenues and Expenditures.
Enclosed are the Recommendations concerning the Metropolitan Council com-
prehensive planning process and the Grant Review process. These Recommen-
dations HAVE NOT been acted upon as yet by the Board of Directors and are
subject to change.
We will also briefly recognize and honor former members of the Board of
Directors of the Metropolitan and Suburban Leagues who served so faith-
fully in that capacity prior to the merger.
Adoption of the Legislative policies for the Association is probably the
most important activity for the whole year, and I would encourage each
member city to have their full compliment of delegates present at the
December 12th meeting.

Gentlemen:
I attended a meeting in our offices on Tuesday, November 26 pertaining to the
above subject. In attendance were members of the Mendota Hei;hts Cross Country
Ski Club, two men from the Department of Natural Resources, and my fellow
councilmen Russ Wahl.
At this meeting, we heard ?-Tr. Bill Morrissey of the DNIR explain about a Grant
In Aid Program available to Mendota Heights. This is a brand new program which
has funding to the tune of $25,000 for this year. Presently $5,000 of that money
has been allocated to three different local governments. The remaining money
is available for applicants on a first come first served basis. Each local unit
of government can apply more than once each year.
The Grant -- In Aid Program is for the development of' cross cotintry skiing trails.
Both development costs and maintenance costs are included for possible funding.
In fact, projected maintenance costs can be stated in the application form.
Should the projected maintenance money not all be used, the money does not need
to be returned to the DNR. The local unit of government controls as to what to
do with the money. The amount of money applied for will be funded on a 65%
basis. That is, the local unit of government will supply 35% of the money and the
MIR will supply 65% of the money.
Any labor done on a volunteer basis or on a paid basis qualifies for cost of
development or maintenance. Other types of costs that comply_ for reimbursement•
are as follows:
Equipment rental for grooming of trails during the season.
Volunteer labor on a schedule of 53.n0/hour submitted on a work schedule form.
Signs and posts for marking the trail are available at no charge.
Rental of toilet facilities.
-Facilities constructed for ski trails.
Cost of warming house on percentage of use basis.
Cost of additional snow plowing for access to facilities or ski trails.
Other miscellaneous construction costs and maintenance.
For us to make application for these funds, we need to send in three conies of
the application with the signature of the City Administrator and the 'tayor. We
also need to pass a resolution supporting the request of these funds by the City
of :Mendota 'Heights. Also, easement papers must be received from n_rivate property
owners'. These easements may be temporary or permanent.
Just a note along that aspect, a state law was passed in the last le-7,islattire
wherein people on private property for recreational purposes have no liability
risk. As lona, as the private property owners do not charge for the use of their
property on a fee basis, they are held free of liability for the permita4function
which in this case is cross country skiing.
I have tried to summarize the meeting
a very quickly. Ply personal recor.nendation
is that we make Application for these funds and, that we make this application
as soon as possible. This money is available on a first come first serve -basis,
therefore, the sooner we get our application in the sooner we will have our money.
At some point in time, we will have to make a determination as to whether we T-yant
to administer this coney through the City Administrator or through the local Park
Board or just release the funds to the ski club for their use. Personally, I
think the Park Board ought to handle the activity.
I would even -o so far as to sa- that -7e should look very closely at the possibility
of buying a snowmobile and associated groomer for the trail system. We then could
get reimbursed for the use of the snowinobile on a charge basis under the funding,
program. This snowmobile could be a Police Department vehicle. I think we have
all had lots of calls about snowr.obilers in the "Village. The response of our
Police Department has been inadequate since they do not have a vehicle to pursue
a snowmobiler in violation across some of our open lands. This snowmobile could
be used for that purpose.
hope the above comments allow us to discuss the Grant -- In Aid Program intelli-
gently at our next council neeting and vote for approving the request.

Application is hereby made for a permit to deposit approximately
fifteen hundred (1,500) yards of clean gravel fill on Lot 18,
Linden Addition, where indicated by the stakes placed by the
Minnesota Department of Natural Resources on November 26, 1974.
The area where the fill would be placed would not adversely affect
any adjacent land and allow the owner to further develop the lot
for residential sale purposes.
It is the owner's intention to file with the City a subdivision
proposal for two or three building 'sites which use appears to be
reasonable in light of the surrounding land uses.
On November 26, 1974 I contracted for the above project including
the fill material, the loader, five trucks and a bulldozer to
finish grade the site on the basis of the existing grade and tapered
down to the North where the fill would be placed. It is aniticipated
that the fill area would be the rear yards of said building sites.
Your attention is appreciated in that the contractor is waiting to
fulfill the balance of his contract.
I believe the above permit request to be reasonable and that it will
enhance the looks of said site, make the site more attractive from

4.11 Farming Operations.
All farms currently in existence will be permitted to continue operation
after the abolition of the Farm Residence District within the Village,
subject to the following conditions:
4.11(1) Agriculture, excepting commercial animal farms, fur farms, kennels and
poultry farms, but including truck gardening and other horticultural uses,
is a permitted use in the district in which an existing operation is located,
provided -'that any new private stable or other new building in which farm
animals are kept shall be a distance of one hundred (100) feet or more
from any other lot in an "R" District.
4.11(2) Limited sales of products produced may be conducted on the premises from
a roadside stand but such stand shall not exceed one (1). story in height or
five hundred (500) square feet in floor area, and no portion of any such
stand shall be located or erected nearer than fifty (50) feet from any
street line.
4.T2 Land Reclamation
Under this Ordinance Land Reclamation is the reclaiming of land by
depositing of material so as to elevate the grade. Land reclamation
shall be permitted only by a conditional use permit in all districts.
Any lot or parcel upon which four hundred (400) cubic yards or more of fill
is to be deposited shall be land reclamation. The permit shall include
as a condition thereof a. -finished grade plan which will not adversely
affect the adjacent land, and as conditions thereof shall regulate the
type of fill permitted, program for rodent control, plan for fire control
and general maintenance of the site, controls of vehicular ingress and
egress, and for control ofmaterial 'dispersed from wind or hauling of
material to or from the site.
4.13 Mining
The extraction of sand, gravel, or other material from the land in the
amount of four hundred (400) cubic yards or more and removal thereof from
the site without processing shall be mining. In all districts the
conduct of mining shall be permitted only upon issuance of a conditional
use permit. Such permit shall include, as a condition thereof, a plan
for a finished grade which will not adversely affect the_ surrounding
land or the development of the site on which the mining is being con-
ducted, and the route of trucks moving to and from the sites.

SUBJECT: Summary of Planning Commission Meeting,
November 26, 1974
This summary/report is submitted in lieu of prepared minutes
because of staff, timing and other problems. A very brief summary of
the activities goes as follows.
1. A special work meeting has been called for
Wednesday, December 18 to discuss thoroughfare
needs at two places:
a.) In the McGough Plat/Butler Avenue area.
b.) In the Emerson area between Wachtler and
Dodd Road.
In both cases, Planner Lukermann and
Engineer Kishel will provide input for
Planning Commission discussion.
c.) In addition to collector streets, the
Planning Commission is also scheduled to
discuss the proposed updating of subdivision
regulations.
2. No less than four hearings are currently scheduled
for discussion for the next regular meeting scheduled
on January 14. These hearings involve:
a.) A preliminary plat hearing on the Riley/Bancroft
subdivision. This was placed before the Planning
Commission in preliminary form and is to receive
Planning Commission hearing on January 14.
b.) Dick Poore has requested a subdivision scheme
for his property east of Dodd Road. This hearing
is also scheduled for January 14.

C. Harold Nielsen has submitted a preliminary
plat for property west of Lexington, north
of Orchard Lane. This hearing is also
scheduled for January 14.
d. A Conditional Use hearing is scheduled for
Sheehy's fill and ponding area proposal
for January 14. His current proposal is to
fill on the northwest corner for a
McDonald restaurant and provide a drainage/
settling pond in the southeast corner; all
in the interest of expanding and cleaning up
run-off waters.
It is obvious that staff reports will be necessary
for these four discussions. In order to more
intelligently provide information for the hearings
Planner Lukermann and Engineer Kishel will be asked
to provide preliminary reports involving traffic
considerations, utilities, drainage, etc.
3. Brian Solem has applied for a variance, but upon
further investigation, a conditional use permit
must be granted. A hearing for his request will
be set up for the February meeting.

RESOLUTION NO.
RESOLUTION APPROVING FINAL PLAT
WHEREAS, Carl Genz had submitted a plat for consideration on
June 12, 1974; and
WHEREAS, the Planning Commission approved the preliminary plat
subject to several recommended changes; and
WHEREAS, the final plat presented on December 3, 1974 reflects
the recommended changes; and
WHEREAS, the platter has offered the amount of $300 per lot as
park contribution; and
WHEREAS, he has agreed to sell the east 108.5 feet of Lot 2,
Block 1 for a sewer lift station site; and
WHEREAS, other platting considerations have been net;
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that the Mayor and City Clerk are authorized
to sign the plat subject to the receipt of the deed for the lift
station site.
