Held Tuesday, i�ay 2� 1972
-� Pursuant to due ca11 and notice thereof, the regular meeting of the
� Village Council, Village of Mendota Heights, was h�ld at 8:�0 o'cloclt
P.NI. at the Village Hall, 2010 South Lexington Avenue, Saint Paul,
Minnesota.
' Mayor Huber called the meeting to order at 8;00 o'cloc}s P.M.. The
following members were present: Mayor Huber, Councilmen Wahl and
� Blair. Councilman Lockwood had notified the Council that he would
, be delayed. Councilman Gutzmer was absent.
� SITKOFF - Mayor Iiuber moved the Council grant a variance of
` VARIANCE 8 feet to George Sitkoff to construct a new garage
; PC 72-5 22 feet from the front yard lot line of his �roperty
k� at 2222 Apache Street. '

if1E�TING - The Council acknowledged a letter from W. C. Anderson,
COUN'rY ROAD llakota County Administrator, requesting the Council
SYSTEi�i , att�nd a group meeting with other Municipal and Township
officers to express their thoughts on revenue-sharing
and cost-sharing programs relating to the Dakota County
road system and a possible bonding program for acceler-
ated road construction. The Village Administrator
advised the County of a Niendota FIeights publi� hearing
scheduled for May 23rd and arranged a change of ineeting
to May 30th at 8:00 o'clock P.:��. to be held at the Eagan
� Township Hall.
PARK COM. - A memo was received from the Paxlc. Commission reque�ting
CIVIC CENTER c3iscoritinuation of land filling at the civic center site
until plans are being formulated for the use of the prop-
erty and Commission consideration be given at that time.
The P�tayo� expressed a need for additional fill and re-
quested the Administrator to check out-the present prog-
ress and prepare a sketch of the site sho4�ing the loca-
tion of the pro�osed frontage road �nd future building
sites.
ADMIPJJ'POLIC� Councilman Blair moved appointment of Kathleen Mahoney
SECRETARY as Administrator/Polic� Chief Secretary; at a starting
APPOIN`1'MEN�I' salary of $500. per month with a six month probationary
period.

County expressing the desire of the Village Council to
transfer into Village ownership two lots that are tax
forfeit property on Caren Road; in regard to a letter
from the County Auditor indicating the lots to be
offered for sale, and inquiring of the necessary pro-
cedure to acquire these properties.

In the spring of 1969 we built a home at 562 Winston Court. At that time
Winston Court ended with a Cul de Sac and part of our property is on that
• Cul de Sac. The followin� year Winston Court went through into Ivy Falls �ast
and since that time the CuI de Sac has only been used by teen agers attempting
to make power turns, and as our mail box will attest they all did not make it.
We request that either t1ie�..Village do some grading soding & seeding up to the
present road way or close Wins,ton Court at the Cul de Sac and place barricades
there, or as a last resort vacate the Cul de Sac to the adjacent property, owners
and mark where the road should end and the grass should be�i�. I wish to thank
you in advance for your attention to this matter, and would appreciate an answer
at your earlyest convenience.

Acacia Park Area
On march 7, 1972., the Uillage Council considered the matter
of mAC acquisition of property in the light of the sewer and
water petition from the people within the subject area. At
that meeting, the Village Council decided to del.ay the
feasibility hearing for sixty days pending further action by
mAC.
The sixty days have expired and it seems prudent to again
consider the entire matter. The attached letter from
mr. Kuitu is quite self—explanatory. It does appear that
mAC is proceeding diligently toward a hearing to formally
consider the acquisition of some fifty homes. It appears
that the hearing will be held some time in late June or
early July, at which time the entire matter of acquisition
will be considered. Since 1972 construction is somewhat
questionable at this late date, it would seem advisable to
delay the sewer and water feasibility hearing for another
sixty days pending the outcome of the mAC hearing. �

you of the status of our work on the Acacia Park problem.
MAC staff and consultants have been tooking at a range of possibilities which
woulc� meet M�1C needs to protect the approach to runway 291t; M'endot�� Heights
concerns �3bout providing utilities to Acacia Park, balancEd tax base,
orderly developme;nt, and airport noise; �nd the noise and utilit�es concerns
of the �lcacia Park residents. 06viously no single soiution will be fully
satisfactory to everyonc, but wc believe that the proposal outlined in the
attache� memorandum of March 30th best meets tne multiplc concerns identi-
fied.
The Commission on /�pril 17th �uthorized a public heariny so a decision can
be rnade as quickly as possible. ihree tasks are proceedi ng in parallel �

may 15� 1972
I�� A petition requesting "a feasibility study for blacktoPping"
� was received on may 10. The petition specifically inclu�es
!� Dorset Road, Somerset Road, mears Avenue, Staples Avenue,
i� Hingham Circle, and Colshire Lane. The petition is signed by
;• twenty—five affected property owners in the area.
I understand that this petition has been in process for a
number of months, and was finally submitted in �rder that
improvements can be made as soon as possible. The street
conditicns in this area are well known by most everyone.
It appesrs that there may be considerable differences of
opinion as to methods of improvement. I believ� that the
instructions to the Engineer will need to be quite broad
and probably involve a number of alternatives.
!• It goes without saying,that the project must include more
•� than a conventional "blacktoppi�g". Certain drainage
�Q�����;e� ._____-__ ___s must be incorporated in the pro ject -- the ��.C�•l�•��•es�
� biggest question being what kind of '��' . he
� drainage courses must include certain special types of
inlets, some specific type water ways, some underground
piping, and most importantly, one or two satisfactory outlets.
The quality of this area certainly is conducive to the
street and drainage feasibilities, the big question being
what is both feasible from an economic standpoint and yet
consistent with good municipal practices.
� I trust this will receive proper discussion with appropriate
direction to the Engineer for a feasibility study.

RESOLUTION AUTHORIZING VACATION OF A
PORTION OF HAZEL STREET

WHEREAS, a petition has been duly presented to the Village Council
of the Village of Mendota Heights signed by a majority of the owners
of the property abutting upon the following described street situated
in the Village of Mendota Heights in Dakota County, Minnesota, to-wit:
Al1 that part of the street known as Hazel Street lying
Easterly of the Easterly right of way line of State
Trunk Highway No. 49 (also sometimes known as Jefferson
Highway) situated between Lots 9 and 10, and Lots 11 and
12 in Haselberger Addition.

WHEREAS, notice of a hearing on said petition has been duly published
and posted more than two weeks before the date scheduled for a hearing
on said petition all in accordance with the applicable Minnesota
Statutes, and
WHEREAS, a public hearing was held on said petition on Tuesday,
May 16, 1972, at 8:00 p.m. at the Village Hall of the Village of
Mendota Heights, and
WHEREAS, the Village Council.then proceeded to hear all persons
interested in said petition and all persons interested were afforded
an opportunity to present their views and objections to the granting
of said petition, and
WHEREAS, there were no objections presented to said petition.
NOW THEREFORE, IT IS HEREBY RESOLVED by the Village Council of
the Village of Mendota Heights, Minnesota, as follows:
1) That the vacation of that part of the street more
particularly described above situated in the Village
of Mendota Heights is in the best interests of the
public and the Village.
2) That the following described street situated in the

AN ORDINANCE AMENDING TH� VILLAGE ZONING ORDINANCE
The Village Council of the Village of Mendota Heights ordains as
follows:
Section l. Ordinance No. 32 adopted April 3, 1962, entitled
"The Zoning Ordinance of Mendota Heights, relating to a Comprehensive
Amendment and Rezoning of the Village, Amending Zoning Ordinance
No. 5 Originally Passed by the Village of Mendota Heights on May l,
1956, as Amended," being also known as the Village Zoning Ordinance,
as amended, is hereby amended to rezone from R-1 (One Family �
Residential District) to R-3A (Multiple Family Residential District)
the following described property situated within the Village of
Mendota Heights in Dakota County, Minnesota, to-wit:
All that part of the following described property,
to-wit:
That part of the Southwest Quarter (SW 1/4) of the

re�uested by the Village Council was not taken into
considerationo Inland Construction Corporation did
mention that ti�ey had not heard from Dakota County
as to their proposed�road, also mentioned was the
DVM Incorporated, a vending machine business, Fred
Dahlin was interested in a site on the �roperty.

The application for a Planned Unit Development
permit was presented by the Apache Engineering
Company, Land Architect and Site Planners. A
brochure of the proposed townhouse complex was
presented along with detailed maps, The main
question raised by the Planning Commission was the
single road as the only access to the property.
After much discussion, pro and con, the Planning
Commission moved to hold the application for one
more month.
Richard Lund moved the Hearing be continued at the
next planning meeting. Motion seconded by Annalee
Stewart.
