I am also aware that the approval of this project ma.y come very soon, - as early as Ma.y 23, 1972 special Council Meeting to be held at Mendota School. I am also aware that residenta (other than Rogers Lake) are alao interested in this project in that the creek, which absorbs the Rogers Lake excess, travels through their properties. (I am referring to properties north of Highway 110) For this reason, I am forwarding a copy of my file on this subject to the Ridgwood Park-Somerset Park Civic Association for review and action. I azn wri�ting this letter for the following reasons: 1) to remind the Mayor and Village Council that� in this project� they have obligations, not only to the residents adversely affected by the high water level of Rogers Lake, but also to those residents which are or may be adversely affected by the drainage. In other words, the solution of the major problem could easily result in the amplification or even creation of problems to residents now now affected by the high level of Rogers Lake. �� 2} ta infor�n �Ghe Mayor and Village Council that �he Planning Corflmissa.on is now reviewing the plans of the Midcontinent Development Corporation, to develop 114 dwel�.ing uni�ts in the Northeastern quadrant af Hight�ray 110 arzd 35�. Obviously� if �he development takes place� the water zun-off will substantially increase the ever-increasing demands made of the na�ural drainage course. 3} ta request the Mayar and Council to take �ormal action relative to �he final paragraph in my letter dated Ju1y 19� 1971, which paragraph reads: "In cancl�sian� I respectfully request that the Village 1) re-examine the candii�ion to which I refer (with regard.s the creeks behind my propbxty) and 2) prior to allowing any additional sources of water, such as additional development and lowering Rogers Lake, the Viil.age d.redge the creeks in orcler ta restore the water flow to the condition which e�s�ecl prior to sewer construc�ion and sufficiently to handle any additional waters, such as 6QQ million gallons f`rom R.ogers Lake." I am now abandoning this posture in favor o�` a request for immediate action because 1) the final a�praval af the Ragers Lake Drainage Project is, in iact, reaching a rapid culmination, and 2) the canstructian of Marie Ave. has been repea�edly deferred to the extent that the cans�ruction �iming appears to have no Substance. The members �el� that additional plan.ning and �it� design of �he area shauld be accomplished, and finaily adopted by the Village Council before any �urther material, is filled on the site. T�. was noted that �.he �i11 has progressed nar�herly �.o a cro�s- culvert in Lexington and that �urther filling would entail more drainage problems. I-� was also noted that severaZ con.cept plans, invol.ving different types o�' uses, have been circulated. Neither plan showed the propased �rantage raad, hence did not validly project future design. Johnson - Village Administrator , SUBJECT: Administrator/Police Chief Secretary Appointment Shortly after Corine Cook's resignation, I placed an order with the Minnesota Manpower Services to recruit appli�, cants for the subject positiono After several follow-up calls and an ad in the Sunday Dispatch, I received three applications. Interviews were conducted and application information verified. Manpower Services provided the per- formance testing (shorthand, typing and spelling) inf ormation. T0: � FROM: SUBJECT: � Village Council MEMO 9 � May 1, 1972 Orvil J, Johnson - Village Administrator Traffic Control at Marie Avenue and East Callahan Place At the April 18th Council Meeting, I was requested to investigate the subject intersection with regard to traffic control. A STOP sign on Marie Avenue was suggested to pro- vide a safer entrance for vehicles approaching Marie, off of East Callahan. ' Police Chief Baldwin and I viewed this intersection from all three directions, all with respect to visability, speed, safety and traffic characteristics, East Callahan intersects Marie Avenue at the very peak of a small hill or knoll, Although west bound traffic on Marie may not have lengthy sight distance prior to the intersection, if a proper left turn is executed (sharp right-angle turn) at the inter- section, then visability to the west is unlimited. East bound traffic on Marie should have no trouble in right turn maneuvers. Traffic approaching Marie from Callahan has almost un- li�ited vaiability in both east and west directions. Vehicles parked on a driveway west of the intersection may hinder visability somewhat at times, but certainly not to a dangerour degree. If excessive speeds are a problem, then the Police should partol the area more, using the Radar Speed Measuring Device to more accurately determine actual speeds. Marie Avenue retains a Munic-State Aid route designation. This implies an importance from an over-all community stand- point, and in f act, Marie Avenue will serve a very important internal east-west function once it is completed between Dodd Road and Victoriae Marie Avenue should not be considered as only a local residential street. Its current, and future use, is to serve local east-west traffic in the areas north of Trunk Highway 110. As such a carrier, traffic sho�ild only be stopped at high volume intersections.. In view of the above reasons, it is my recommenda•tion that Marie Avenue remain "as is" as far as traffic control �m r TO: Village Council y MEMO May 1, 1972 FROM: Orvil J. Johnson - Village Administrator SUBJECT: Tax Forfeit Property, Need for Village Use The attached print shows the location of two village owned lots opposite Caren Court. These are presently un- developable and apparently tax forfeited - now being used as a ponding area (and small dump ground). The attached letter from the County Auditor indicates two more lots that are tax-forfeits and to be offer.ed for� sale. These two lots are quite similar in topography to the two owned by the Village. The present pond,ing does occur on these two lots. SPR�NG OF COUNSEL You have asked our opinion with respect to the proposed construc- tion of a garage, a substantial portion of which will be used for the housing of homing pigeons. It is our understanding that the matter first came to your attention for a requested variance to allow construction of this particular garage closer to the side lot line than is permitted under the Village Zoning Ordinance. At that time, the use of the garage for the housing of homing pigeons was not called to the Council's attention. Apparently thereafter, construction was started on this garage without application for or the obtaining of a building permit from the Village. As soon as the matter was called to the attention of the Building Inspector, the property owner was ordered to discon- tinue construction of this garage. The Building Inspector has reported to us that the lower level or main level of the garage measures 94 inches in height from the garage floor to the top•of the studs or the proposed deck over the first floor garage. This amounts to a stud height of 7 feet, 10 inches which is in line with most garages constructed in the Village. This particular garage also contains a second story with a deck or second floor of 65 inches or 5 feet, 5 inches in height over the first f loor. In addition to th� second story, there will be additional height to the building in the form of a roof which comes to a slanted peak. The garage is located 44 feet, 6 inches from the landowner's home. This garage is located in a R-1 (One Family Residential District) district under the Village Zoning a � �- :� � f�� Village Council Village of Mendota Heights Page Two May 2, 1972 Ordinance (Ordinance No. 32). Under the R-1 classification, "private garages" are a permitted accessory use. Under Section 3.2(63) of the Village Zoning Ordinance, a private garage is defined as "A detached accessory building or portion of the principal building, including a carport, which is used primarily for storing passenger vehicles ..." Under Section 7.3(8) of the Village Zoning Ordinance, a permitted accessory use in the R-1 Zoning District includes: "The keeping of domestic animals for non-commercial purposes including horses for the use of the occupants of the premises, provided that any accessory building used for housing such animals shall be located not less than 100 feet from the nearest residence." Our review of the dictionary definition of "animals" would include pigeons within the classification of animals. Based on the facts which we have set forth above and the applicable provisions of the Village Zoning Ordinance, it is our opinion that the proposed garage would not be a permitted accessory building or private garage under the Village Zoning Ordinance because of the fact that the principal use will not be for the storing of passenger vehicles. To the contrary, it would appear that the principal use would be for the housing and raising of homing pigeons and that the storing of passenger vehicles will be a secondary or incidental use. � Also, it is our opinion that the proposed use of the proposed garage for the storing of homing pigeons would be in violation of Section 7.3(8) of the Village Zoning Ordinance in that the proposed structure is situated within�100 feet of the nearest residence. If you desire any further information or have any additional questions with respect to the above matter, please do not hesi- tate to call them to our attention.
