We have your letter of February 16, 1972 regarding Mendota Heights/
MAC noise abatement discussions. Since our meeting of some weeks past
regarding the Pilot 1Cnob - Acacia Park area, our staff and consultants -
have been canvassing various avenues which might be taken to alleviate
the problem at hand. - .
Amongst others, we have consulted with the FAA and the Minnesota
Department of Aeronautics. As it happens the land in question, be-
cause of its locatimn at a higher elevation off the end of Wold-
Chamberlain Field itunway 29R/11L, poses a control problem in the
protection of approaches to this runway. There is a possibility
that a Federal Grant in Aid project under the 1g73 ADAP Pragram
(commencing July 1, 1972) might be available for the acquisition of
tliis property thus insuring the control of this approach area.
Procedurally,an application would have to be made to the FAA and the
State for such a project. This, with MAC approval, we hope to do.
We ask the cooperation of your Village to maintain the status quo as
to this property for the present, until we have more specifically
researched the matter, after which we will be in touch with you agai

Northern States Power Company has submitted a
new street lighting contract to become effective
April 1, 1972. Notice of Termination of the old
contract was received Sept. 27, 1971 as per contract
conditions. There are several changes in the new
contract such as: '�
1— The contract is continuous for 5 year periods
unless terminated by written notice 30 days prior
to the expiration of any 5 year•period.
2— Three street lighting lists are included; one
listing fifteen 7,000 lumen"lights, one listing eight
11,000 lumen lights and one listing two 21,000 lumen
ornamental lights at Lexington and TH 110.
3— The rate schedule is:
� 7,000 lumen $3.95 per month or $47.40/yr.
11,000 lumen $4.90 " " " $58.50�yr.
21,000 lumen $3.50 " " " $42.00/yr.
These rates are 6/ higher than the old contract.

RESOLVED That the Village Council of the Village of

proposal of NORTHERN STATES POWER COMPANY, a Minnesota
corporation, to furnish street lighting service withall lights located
or to be located in said Village, and hereby approves all rates, terms,
conditions, and specifications in the Street Lighting Ccntract made a
part of the proposal of said company and the proper officers of the
Village are hereby authorized and directed to execute the aforesaid
Contract for and in the name of the Village, and to affix the corporate

At the Council meeting of February 15, 1972, we were directed to mafce a study of
and inctude as part of the above sewer and water project, tFie requirement for
storm sewers to serve the new street south of the shopping center. In the pro-
cess, we were furnished the proposed plans for the Mid-America State.Bank facili--
ties which indicated how they are going to use tf�eir property. A field study
also revealed surface water flows along the back side of tf�e properties on tf�e
south side of the new street plus the great flows coming off of Aztec Lane and
Creek Avenue in Friendly Hills. What originally appeared to be a relatively nor-
mal storm sewer problem has increased in scope as is shown on the attached draw-
ing.
As indicated, surface wate�s�flow off of Dodd Road along the back lot lines be-
tween Friendly Hills and the propeLty south of the Shoppin.g Center to the end of
Aztec Lane. Great quantities of surface waters also flow down t[ie streets in a
northeasterly direction along Creek Avenue and Aztec Lane to the northerly end
of Aztec where it spills into an open ditch running easterly across proposed
S.T.H. 49.
Our study proposes the installation of underground pipelines along the new street,
across Mid-America property adjacent to an existing sanitary sewer easement to
the end of Aztec Lane, there picking up all surface waters in tf�e area by con-
structing a large pipeline eastward to the Highway right of way. Because this is
a natural drainage draw, it is anticipated that when Highway 49 is constructed
the Highway Department will have to plan a drainage structure to inctude all flows
from the west, thus continuing the Village System. �

Because of the existing surface water conditions, our design becomes greater than
normal for serving the new street south of the Shopping Center. It is suggested
that because the assessable area in tfiis project is limited, and because it is
not advisable to involve tfie properties located in the Friendly Hills Subdivision
even though they contribute surface waters,�tfiat tF�e assessa6le area within the
scope of the project be assessed on tf�e 6asis of some of our previous storm sewer
projects,.and .that tF�e balance of cost be carried as a part of tf�e general obliga-
tion of the Village.
To do .the work as proposed and as shown on tF�e attached drawing, will require the
construction of approximately 890 feet of 12 inch to 3b inch pipe and appurten-
ances for an estimated cost of $13,587.00, including fees and contingencies.
With approximately 187.,222 square feet of assessa6le property available at an
assessable rate of five cents (5�) per square foot, assessments will recover
$9,361.00 leaving $4,226.00 or 310 to be carried on general o6ligation.
In`spite of the costs involved, the storm sewer construction is needed for the
successful development of the proposed new street and the development of the Mid-
America Bank Corporation facilities. We believe the above project is needed and
is feasible and herewith recommend same for construction.
Unless otherwise directed, we propose to include the storm sewer construction as
part of the sanitary sewer, water main and street construction now being planned
for .the new connecting road between old and new Highway 49 on the south side of
the Shopping Center.
After review by the Council, there is still time for a public hearing prior to
cont•ract award for the construction. Because there is great need to proceed with
the balance of utility and street construction as soon as possi6le, we request
that the above matter be .given consideration at the earliest possi6le time.

- variance had been granted.at''the meeting held October 3, 1967, but

" � matter was referred to the Planning Commission for review and action
to be sure of current and valid conditions. The Council recommends
� the Planning Commission be advised of Document No. 13487 dated 8-9-56
, recorded with the Register of Deeds, in regard to rules, regulations,
. and restrictions on building�in Friendly Hills.
Urban Systems Development Corporation was Xepresented requesting
change in a proposed Planned Unit Development at Ivy Falls. The
matter.was referred to the Planning Commission.
, Mayor Huber presented two plaques to �dward C. Stringer, former
Councilman of the Village of Mendota Heights, for his outstand�ng�
service,to the Village and for playing a large part in the planning
and development of the community. .
� Councilman Gutzmer moved adoption of RESOLUTION NO. 463 entitled
"RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR FURNISHII�G TWO
1972 POLICE SQUAD CARS". The contract was awarded to Fury Motors, Inc.
,of South Saint Paul. The low bid was in the amount of $5,795.00 with
the deletion of the split seat - Proposal II. Motion seconded by �
Mayor Huber. .Vote: Ayes - 5; Nays - 0.
Mayor Huber moved the Council establish a Hearing on the application
of Phyllis Ettinger for a Conditional Use Permit to allow a Nursery
School in an R-1 zoning district. Such hearing to be held on Tuesday, .
March 7,�1972, at 8:00 o'clock P.M.. Motion seconded by Councilman
Wahl. Vote: Ayes - 5; Nays - 0. �
John Turner,�Vice President of Mid-America Bank Corporation and�
Howard.Hanson an associate were present to,explain their site plans
and to seek permission to construct a 2-story office building on
property immediately south of the Mendota Plaza Sliopping Center. The
building would contain the Mid-America State Bank'and office space to,
be leased. John Sullivan, a representative of Rauenhorst Corporation,
was present on the matter and will be a contracto�•for the proposed
building. Upon completionG;of the construction plans, they are to be
submitted to the Village Engineer and Building Inspector for purposes
of,resolving the drainage problems in the area of��the proposed site
and for recommendation to the Council:• . ' �

to invest $100,000. of Consolidated Improvement Funds in Time Savings
