Pursuant �a due call and notice thereaf, �he regular meeting
af the Villag� Council, Village o� Mendota Heigh�s, was held at
8:QQ a'clock P.M. at the Village Hallr 2010 South Lexington Avenue,
Saint Paul, Minnesota. �
Mayor Huber cal.led the mee�ing to ord�r at B:Od ogclock P.M.
Th� follawing members were present: Mayar Huber, Councilmen
Lockwood, Gutzmer, B1air and Wahlo
Mayor,Huber called the Hearing to order at 8:02 P.M. on
5an.i�ary Sewer, Water Mainj Street, Curb and Gutter, to serve
certain properties loca�ed to•the North af Friendly Hill.s Re-
Arrangement.
Mayar Huber turned the Hearing ov�r ta Cauncilman Lockwaod
tor presentation and discu.s�ion. Cauncilman Lockwoad explained
the es�imated costs and method for assessing the various parcels
involved in the praject. '
There being no further discussions, and no objections'on the
Hearing, Councilman Lackwood moved the Hearing be closed. Motion
seconded by CounciZman Wahl.

Councilman Lockwaad maved the adoption af RESOLUTION NO. 450

An open letter to the:
Mayor and Council of Mendota Heights
There was a time when the residents of Mendota Heights were
considered an integral part of the community and many of the
�residents were involved in village concerns and were consulted
on community matters for their reaction before the Village
Council would take action. Those were the days when we had a
mayor and council who were concerned about and responsive to
the voters in the village.
Alas, that appears to be a thing of the past, as is reflected
in the newspaper article which appeared in the St. Paul Dispatch
on January 25th. Let us examine some of the things that our .
council has been doing.
A special meeting was called on December 28th - and according
to the minutes only two matters were taken up; the approval of
the;budget and the granting of a variance for Somerset 19 - a
.��•three story,apartment complex to be built in a residential area.
' • Both of these matters are of such importance to the Village that
they should have been handled at a regular meeting where the
residents coul'd have attended.
A recent opinion of the Minnesota Attorney General�s office
states in part:
Minn. Stat. S 471.705 (1969) provides ��MEETINGS OF GOVERNING ,
BODIES OPEN TO PUBLIC. Except as otherwise expressly pro-
vided by law, all meetings, including executive sessions, '
of the governing body of any school district however organized,
unorganized territory, county, city, village, town or borough
and of any board, department or commission thereof, shall be
open �to the public.�� ,
The opinion states that:
"The fundamental purpose is to prohibit actions being taken
at a secret meeting where it is impossible for the interested
public to become fully informed concerning board decisions or
to detect improper influences. The provisions are also
intended to afford the public an opportunity to present its
views to the board. However, the purpose of these provisions

�. -� is frustrated if the'public has no advance knowledge of the

`y time and place of such meetings. Thus, in order to fully
� effectuate this purpose it is necessary to imply from these .'
i- provisions a requirement that' the council give advance
notice to the public of any special meeting where matters
are to be acted upon which have not been raised at a prior
, public meeting or hearing of the council.��
On the variance which was granted at this special'meeting. The
'�;� Council was well aware that there was opposition to granting this
.is variance on the part of some of the residents and representatives
of this group have attended regular meeting after regular meeting
"' of the Village Council in order that they might be heard, if and
;° when, the matter might be considered. Instead it was done at a
�;� special meeting with no notice to these same interested repre-
� sentatives. Why?
Perhaps one should remind the Village Council that Zoning Ordinance
No. 32, the Zoning Ordinance of Mendota tieights provides that:
�'Before authorization of any variances, the request therefor
shall be referred to the Planning Commission for study con-
cerning the effect of the proposed variance upon the Compre- � +
hensive Plan. '
In considering applications for variance under this Ordinance,
�" �� the Council shall consider the advice and recommendations of
..; � �,
, the Planr�ing Commission and the effect of the pro,posed variance
^ upon health,.:,safety, and welfare of the community existing and
k � anticipated, .... That the granting of such variance will
� not merely serve as a convenience to the applicant, but is
,<
necessary to alleviate demonstrable hardship or difficulty,
the Council may grant such variance and impose conditions and
, safeguards therein.
Variances may be denied by motion of the Council and such
motion shall constitute a finding and determination by the
Village Council that the conditions required for approval
do not exist."
' �Which poses an interesting legal implication as to the action of the
. Board on December 28.
We are disappointed in Mayor Huber's comment that:
�TWe're not full-time officials like in the major cities, who
have a different response to the public.Tr
It seems that any public official, be he full or part time, is
elected by the public to serve the public and is responsible to the

Officers oF the Fire Dept. held an officer's meeting
in December, and one subject was house numbers. Is there
any possible way to get people to put these directly on the
house by the door of the street address. Also mo�e than
one home on a long driveway have arrows showing proper
entrance.
may we have some action on this in the near future.
This has been informerly discussed with some of the village
personnel. Please consider this a follow up note.

RESOLUTION NO. 464
RESOLUTION AUTHORIZING SETTLEMENT OF
APPEALS FROM COND�MNATION AY�IARDS FOR
SIBLEY HIGH SCHOOL IMPROVEM�NTS
(IMPROVEMENT 70, PROJECT 5)
WHEREAS, the Village has heretofore commenced condemnation proceedings
for the purpose of acquiring certain parcels relative to the Sibley
High School Improvement Project (Improvement 70, Project 5) which
proceedings have heretofore been known and designated as Village of
Mendota Heights v. Independent School District No. 197, et al., and
WHEREAS, both the Village and certain of the l.andowners involved
in said proceedings have heretofore filed appeals from the commissioners'
award of damages as to certain of said parcels involved in said pro-
ceedings, and
WHEREAS, as to Parcel E(S.P. 1918(100=117)903 - Imp. 70, Proj. 5)
the Commissioners awarded damages to the landowners of said parcel
in the total amount of $1,000.00 plus appraisal �ees of $250.00,
and
WHEREAS, the landowners have agreed to dismiss their appeals as to
said Parcel E in consideration for a total payment to them of $1,400.00
plus appraisal fees of $250.00, and _
WHEREAS, as to Parcel F(S.P. 1918(100=117)903 - Imp. 70, Proj. 5)
the Commissioners awarded damages to the landowners of said parcel
in the total amount of $1,050.00 plus appraisal fees of $250.00,
and
WHEREAS, the landowners have agreed to dismiss their appeals as to
said Parcel F in consideration for a total payment to them of $1,450.00
plus appraisal'fees of $250.00, and
WHEREAS, as to Parcel G(S.P. 19].8(100=117)903 - Imp. 70, Proj. 5)
the Commissioners awarded damages to the landowners of said parcel
in the total amount o� $1,200.00 plus appraisal fees of $250.00,
and '
WHEREAS, the landowners have agreed to dismiss their appeals as to
said Parcel G in consideration for a total payment to them of $1,800.00
plus appraisa]. fees of $250.00, and
WHEREAS, it appears to be in the best interests of the Village to
, settle said appeals rela�ive to the parcels hereinabove described
upon the terms hereinabove described. '
NOW THEREFORE, IT IS HEREBY RESOLVED by the Vil.lage Council of the
Va.11age of Mendota Fieights as foll.ows. .
1� That the Village hereby authorizes and approves
settlement of the appeals pending as to the above des--
cribed parcels upon the terms hereinabove set forth.
2) That the Village Attorney be and is h�reby authorized
and directed to execute any and a21 papers and documents
necessary to effectuate sai.d settlements.
