DISCUSSION:
This rezoning/subdivision request was tabled from the August Planning
Commission meeting because the applicant, Mr. Lee, had not submitted his
drawings in time for staff to complete a thorough review.
Engineering has now completed a review and makes the following com-
ments:
1. Drainage easements need to be added to the final plat to accommo-
date GNB's surface water drainage.
2. The 35 foot driveway, drainage and utility easement along Trunk
Highway 110 east of the new roadway needs to be increased to 45 feet
wide.
3. It needs to be determined if the drainage pond on lots 5, 6, and 7
will be under public or private control and the details of its reten-
tion capacity need to be finalized (that will be done in conjunction
with staff's design of the storm water system.
4. A 30 foot radius should be platted on the Southwest corner of Lot
2, Block 2.
5. The site will need a sanitary sewer lift station and the developer
would like to have the station located in a center median at the
intersection of Centre Point Drive .and Trunk Highway 110. Staff is
studying that request, however if it is not feasible a'small piece of
land will need to be dedicated to the City for the lift station ad-
jacent to the road.
6. The developer intends to get an entrance permit from Mn/DOT to
have Centre Point Drive connect with Trunk Highway 110. If we are
unable to get that permit wider easements will be necessary to allow
for the construction of a temporary cul-de-sac until the Trunk Highway
110 frontage road is built.
7. The slopes adjacent ta Resurrection Cemetery are steep at several
points and an erosion contral glan neeck to be developed to protect the
grave si�es. Tha� plan should be made part of the Developer's
Agreement.
RECOI�IENDATION:
From an engineering standpaint staff sees no reason to further delay
this project.
AGTI4N REQUIRED:
Review the proposal and make a recommendation to the City Cauncil.

At the September 3, 1485, Mendota Heights City Council meeting, �fie
Council considered a request by Mr. George Spanjers, 1824 Valley Curve to
subtEivide his 3.16 acre lot into six new lots, The Planning Commission had
conducted a public hearing in July at which time there was littl� input fram
the nezghborhood. The Planning Commissian unanimously recommended approval
of the request to the City Council.
The public hearing notices for the hearing were sent, as required by
law, to landowners within a 350 Eoot radius of the affected property. How-
ever, the Gauncil f elt that a wider area af notificatian shauld be accom-
plished beiore they made their final decision on the matter. They therefore
direcCed s�aff to send invitatians ta the residents living wi.thin the entire
Bunker Hi7,1s neighborhood. The Spanjers subdivision will again be discussed
by the Mendota Heights City Council on September 17, 1985, a� approximately
$:30 P.M. in the Mendota Heights City Council Chambers located at 75Q South
Plaza Drive.

DISCUSSION•
In 1984 Mn/DOT installed a trunk watermain for the City in conjuction
with I-494 construction. Costs for that watermain construction are to be
approximately $231,000 and are to be funded by the Water Revenue Fund and
the attached assessment roll. Also attached is the information letter that
was sent to landowners abutting the project.

RECOMNN�NDATION:
Approve the assessment roll as prepared.
ACTION REQUIRED:
Conduct a public hearing (staff will be prepared to present the
details of the proposed assessment roll) and based on input from the public
hearing amend the assessment roll or adopt the one presented.

Dear Mr. and Mrs. Gangl:
Last year the City installed water mains in the area of Highway 149 and
Mendota Heights Road as a part of the Mn/DOT Improvement in this area.� Our
normal procedure for property owners who wish to make use of the water is to
compute a hookup charge which would be equal to a normal water assessment
and which would be payable in full at the time the hookup was made.
Several area property owners have expressed a desire to hookup but
would rather pay for the water in the normal 19 year assessment manner.
Because of this, the Council has called an assessment hearing to be held on
September 17. An assessment roll has been prepared in the usual manner to
reflect the amount that would be due for normal water service. As many
property owners do not desire the service at this time, the normal procedure
is to permit deferrment of the assessments upon request.
The deferred assessments are then brought current at the time service ,
is requested, a request for property division is processed, or the property
changes hands. This payment would be for previous due principal payments
plus 10% simple interest. The balance of the assessment would then run for
the remaining term, up to 19 years from 1985.
If you wish to have a deferment considered f or your property, please
advise us prior to September 13 and it will be acted upon at the September
17th hearing.
If you do not advise us of your interest in deferment and Council
adopts the assessment roll, the assessment will become payable with your
1987 taxes.

SUBJECT: Traffic Signs on lst Avenue and Clement Street
DISCUSSION:
At the September 3rd City Council meeting staff recommended the
placement of two stop signs for east and westbound traffic on lst Avenue at
Clement Street. The Council opted to forego staff's recommendation in favor
of a stop sign only at lst Avenue for southbound traffic on Clement Street.
Staff has reanalyzed the situation and has the following comments:
1. A traffic count was done at the intersection and it was determined
that roughly 2 out of 3 cars are traveling from ist Avenue to Clement
Street or visa versa, while. 1 in 3 cars are traveling straight
through the intersection on lst Avenue.
2. Due to the unusual intersection configuration and poor sight
distances a southbound car on Clement Street stopped at lst Avenue
would have to pull out into the intersection to see east down lst
Avenue. Thus a stop sign only on Clement Street would not alleviate the
problem of two cars meeting in the intersection.
3. Although staff's original proposal would require more cars to stop,
it would reduce the accident potential of the intersection; cars would
be required to stop where there is a clear line of sight onto Clement
Street, and only southbound Clement Street would be a through street.
RECONAZENDAT ION :
Staff still recommends the original proposal of two stop signs on lst
Avenue with Clement Street given the right-of-way.
ACTION REQUIRED:
Tf the Council wishes to enact the staff's recommendation the Council
should adopt Ordinance No. , AN ORDINANCE AMENDING ORDINANCE N0. 1113
(Attachment A). If the Council wishes to enact the option proposed at the
September 3rd City Council meeting the Council should adopt Ordinance No.

INTRODUCTION
Since last December, we have delayed our issue of Equipment Certificates
pending a better handle on the prices for the new radio system. A total of
$95,000 of the issue was to be applied towards the radio purchase. It now
appears that the system cost will be within estimates, and we should proceed
with the issue of the Certificates and work back towards our usual two year
schedule of issuing Certifcates.

This will hold our estimated mill rate close to the 1 mill level and permit
the next issue in the spring of 1987 to fit into the 1 mill level. The 1987
Issue will include the 1986 Expenditures along with the budget for 1987. A
subsequent issue in December of 1988 will bring us back to our usual schedule
of having Equipment Financing completed before the end of the budget year.

SUBJECT: Sign Permit for 790 South Plaza Drive - Children's Country Day School
DISCUSSION
Mr. Ronald Ettinger, of Children's Country Day School, has applied for a
48 square foot sign to be installed on the building located at 790 South Plaza
Drive. The sign consists of individual white plastic letters, 15 inches high.
They are fastened on the lower portion of the mansard roof. The sign message
is Children's Country Day School, is 3' x 16' and contains 48 square feet (see
sketch on reverse).
Signs in the B-1 district may contain 50 square feet. Therefore, the sign is
in compliance with the zoning ordinance. Mr. Ettinger will bring in a picture of the
sign for Council's review and comment. .
RECOMMENDATION
Since the sign meets zoning ordinance requirements, staff recommends approval
of the sign permit as requested.
ACTION REQUESTED
If Council wishes to implement the staff recommendation to approve the sign
permit, it should pass a motion directing the building official to issue the sign
permit as requested.

SUBJECT: Radar Purchase
Introduction
We had planned to replace our existing radar units (2) by purchasing one in
1985 and one in 1986, using Equipment Certificate money. We now wish to
replace both units in 1985.
History
The units we need to replace are now 13 and 6 years old respectively. One is
operational and the other is out of service because of repeated failure and
cost of repair. The operational unit has been sent to the factory for repair
twice in 1985 and is reaching the point of diminishing return. We eventually
would like to replace these units and add a third unit so all marked squads
would be equipped the same. We have dedicated Equipment Certificate funds in
1985 ($2,200) and 1986 ($2,250) for the purchase of the two replacement units.
Discussion
Our patrol officers have evaluated the three major brands of police radar and
they have rated the Kustom KR-10 as the one they prefer. Next in line (but
quite a bit behind the KR-10) was the Decatur MVR-724. Both have identical
net costs. (Quotations enclosed). The difference is that Kustom's bid is
only good until October 1. At that time we can expect an increase of about
$400.00 per unit. In order to get the radar that the officers prefer at a
price we can afford, I would like to purchase two units (Kustom KR-10 SP) now.

Recommendations
Officers will make better use of a product they have confidence in and the City
requires the use of radar on a daily basis for enforcement, surveys and traffic
control in high accident areas. We have budgeted for two hand-held radios in
1985, but we will not buy them this year giving us a"surplus" of $4,000. I
recommend that we purchase two radars in 1985 for $2,790. (Quotations are attached.)
Action Required
If Council concurs with staff recommendation, they should pass a motion
authorizing purchase of two Kustom KR-10 radar units, at a cost not to exceed
$2,790.

Minutes of the Special Joint Planning Commission/
City Council Meeting Held Tuesday, September 10, 1985
� Pursuant to due call and notice thereof, the special joint meeting of the
Mendota Heights City Council and Planning Commission was held on September 10,
1985, at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 7:05 P.M. The following members
were present: Mayor Lockwood, Councilmembers Blesener, Cummins, Hartmann and Witt.
Also present were Commission members Kruse, Burke, McMonigal, Morson, Frank, and
Henning. Absent was Stefani.
AGENDA ADOPTION Councilmember Hartmann moved adoption of the agenda as
submitted.
Councilmember Blesener seconded the motion.

SOUTH EAST AREA STUDY City Planner Dahlgren gave a presentation on statistics on
those of age 60 and older and 75 and older in suburban
areas. He pointed out that their representation in the
suburbs had grown very dramatically in the last few years,
and that the last census showed almost 20� of the Mendot:�
Heights population is in the 55 and over category. He
said that because of the large numbers of single family
homes, unmarried couples, and older citizens, there had
been a considerably increased demand for rental housing.
Providing apartments such as Jim Riley is requesting is
really a matter of whether or not we want to provide thc3t
kind of housing alternative in the community.
Planner Dahlgren also presented some aerial photographs of
a single family development in Woodbury which is built <irour
a pond similar to that proposed by Tandem Corporation for
the Opus property. He pointed out the pathways around the
ponds.

Commissioner Joe� Stefani had sent a letter indicating t}�c�t
he was generally in favor of Concept B-2.
Councilmember Witt said th�t she personally did not feel
that there was a need for the neighborhood commercial
development in the south east area. Councilmember Blesener
added that perhaps the City should rather try to encourr�ge
people to shop in the 110/149 <�rea, if we want to build
that up as our central commercial area. Planner Dahlgren
responded that the city's long range planning has always
been to concentrate commercial development in that area.

Commissioner Henning asked about the densities that woulu
be allowed under the MR designation. Planner Dahlgren
responded that that would be a new designation in the
city's Comprehensive Plan, and would be in the 3-4 unit
per acre category. He added that the City's existing
R-2 zoning district allows duplexes on 15,000 square
foot lots and R-3 is up to 10 units per acre.
Councilmember Cummins asked if the Commission and Council
had a general concensus on one of the concepts, would it
be possible to delay specific rezoning for a case by case
basis. Planner Dahlgren responded that the way to
control specific development is through the approval of
plats and planned unit development agreements. He added
that it really is important that the City "do things
right" by adopting a long range plan that can be clearly
understood by the developers and surrounding citizens.
Planner Dahlgren reported that after the City would adopt
any change in its comprehensive plan, it would be sent to
the Metropolitan Council, who has up to 10 days to make a
"negative declaration" that the proposed change does not
have significant impact on a metropolitan system.
Councilmember Witt asked if it would be possible to cha
the comprehensive plan once again, should the condition.

responded that the Council would be free to change the
comprehensive plan any time it wanted to.
City Administrator Frazell reported on a discussion he had
had with City Attorney Tom Hart regarding comprehensive
land use designation versus zoning. He said that while
current state statute is clear that the zoning is the
prevailing designation, that legislation might be changed
in the 1986 legislature. Mr. Frazell said that there had
also been court cases that had gone both ways on which was
the prevailing designation. In general, he said that it
was the City Attorney`s opinion that any court review of
an issue would hinge on whether the Council had been
reasonable in its deliberations or whether it was arbit-
rary and capricious. He cautioned the Council and Commissi�:
that if a change in designation is made in the Comprehensit•�
Plan, that would imply a commitment to give reasonable
consideration to a proposal that was consistent with that
designation, whether or not the rezoning had actually
taken place.
Councilmember Cummins asked whether it might be possible
to move the proposed park site further south into that
area proposed for apartments, then make the park site �
single family neighborhood. Planner Dahlgren responded
that the particular site now owned by School District No.
197 had been selected, because it is relatively flat land

which would accommodate the types of active play f.ields
that are needed. He said that it is usually preferable
to have residential neighborhoods completely surrounding
a park, rather than having it next door to the freeway.
Mayor Lockwood said that he felt that there was general
concensus on the B-1/B-lA designation for the Visitation/
Tousignant property west of Dodd Road, and everyone seemed
to agree that all of the area south of Mendota Heights

Commissioner Henning said that he thought the airport
noise would be a problem for large lot uses in the area.
Councilmember Hartmann added that he did not expect that
the airport noise situation was going to get any better in
the near future.
Mayor Lockwood said that the potential of adding 590
apartment units in this area was shocking to some.
Cbuncilmember Blesener said that she thought the Council and
Commission should be looking at what the City wants, and
not just reacting to specific development proposals which
have been presented.
Commissioner Kruse said that he thought there should be
some concern about the total density increase in the area,
and that it might be a wise process to narrow in on just
how much density the City wanted to accommodate in the
area.
Councilmember Cummins asked if there was any reason that
the far south east corner couldn't be shown as low density
residential also, rather than medium density. Planner
Dahlgren responded that the'proposed use was a transition
zone, both from the freeway and from the apartments to
the west. City Administrator Frazell added that there
was also the concern with consistency with the Metropolitan
Council noise contour zoning.
Planner Dahlgren reiterated that many older people are
selling their homes, and choosing to rent apartments as
- opposed to buying condominiums or townhomes. He said that
approach seems to make more sense in times of low inflation.
He added that the subject land is about the only parcel
in Mendota Heights that would make any sense at all for
development of rental units, and that the land was
relatively isolated for access and could be accommodated witl
out disturbing existing single family neighborhoods.
Councilmember Cummins said that he wouldn't personally
support a wholesale rezoning as a part of this project, and
would prefer to use the planned unit development approach
on a case by case basis. Commissioner Henning responded

that the question of a preferred pattern of land use wz
still a decision that had to be made.
Commissioner Kruse said that he feels there is a place for
apartments in this area, primarily because of airport
and freeway noise, and he was in favor of developing some.
Commissioner Frank added that he really didn't think anyone
would want to use this land to build a single family home,
and the question may really be one of allowing apartment
development or expecting the land to remain vacant.
Commissioner Henning added that if the development did
not take place by Jim Riley, there would likely be someone
else coming in with a similar proposal in the future.
Planner Dahlgren cautioned that the City would not want the
wrong land use pattern to get started in this area, which
could happen if one large lot house was built out here.
He indicated it was important to make the best use of what
you have, and that this land seemed to be ideally suited
for multi-family residential. He said there was definitely
a strong market for apartments in the area, as evidenced
by how quickly Lexington Heights had filled up.
Commissioner Henning said that he generally liked the B-2
concept, and saw little problem with it.
Mayor Lockwood noted that the staff report had shown thaL
the high density residential use would provide a net tax
gain to the City.
Commissioner Kruse said that he generally agreed with the
high density residential and neighborhood commercial desig-
nations in Concept B-2.
Councilmember Blesener said that she was in favor of puttinr�
the denser uses in the area next to the freeway, but not
necessarily in favor of going as high as 10 units per acre.
Councilmember Hartmann said that he could support the high
density residential designation, and personally had no
problem with the neighborhood commercial designation, since
there was no other practical use for that land.
Councilmember Cummins said that he would like to see the
low density residential designation go as far south as
Mendota Heights Road, and not show MR north of it. He
said that he would like to get some neighborhood feedback
on the proposed commercial development, and suggested that
the Council and Commission not try to make any final
decisions until after a public hearing. For the purpose
of a public hearing and comment, Councilmember Cummins �
that the B-2 Concept was generally OK with him, but he .ld
like to see the LR designation moved all the way south to
Mendota Heights Road.

Councilmember Witt said that she would be willing to
throw out Concept B-2 for public comment, but was not
personally in favor oE the neighborhood commercial area.
Commissioner Kruse said that the Tandem proposal is
before the Planning Commission at its next meeting, and
questioned whether it might be possible for the Commission
to go ahead and give preliminary approval to their first
platted area, since that portion did not seem to be much
in dispute. There was a general concensus that the
Commission could do so, conditioned upon the Council and
Commission later deciding to make appropriate changes in
the Comprehensive Plan.
Councilmember Witt moved to set a public hearing for
September 24, at 8:00 P.M.
Counci:lmember Hartmann seconded the motion.
Commissioner Kruse indicated that the Planning Commission
would hold its regular meeting at 6:30 P.M. so as to try
to be done in time for the 8:00 o'clock public hearing.
Developer Jim Riley questioned the appropriateness of the
line that had been shown between the MR and HR districts.
The Council and Commission indicated that the present
meeting was not a public hearing, and they were not
amenable to getting into the details at this time.
ADJOURN There being no further business to come before the
Council, Councilmember Hartmann moved that the meeting
be adjourned.

1. Mr. Larry Lee, at our request, came to our office this
afternoon (Thursday, September 5) and reviewed with us his
proposed development plans for the tract of land westerly of
the Gould structure, which consists of 32.27 acres purchased
from the Gould interest, plus 14 acres purchased from
Catholic Cemeteries, Inc. This makes a total of 46.27
acres.
We have met with Mr. Larry Lee, President of Yorkton,
Limited, a number of times regarding the development of this
property and feel that the proposed development plan will be
an appropriate addition to the City of Mendota Heights. The
planning proposal includes a north/south road with 100 feet
of right-of-way width to.project south from Trunk Highway
110 and then proceeds easterly contiguous to the south
boundary of the existing Gould office structure on Lexington
Avenue. The 100 foot right-of-way will accommodate the
divided roadway, which will make an attractive entrance and
penetration into the site with a view off of Trunk Highway
110. The east/west right-of-way is 60 feet in width, which
is being kept at that relatively narrow right-of-way so as
to maximize the depth of the remaining property to the
south. These lots, you will note from the plat, wi�ll be
243 feet in depth. Ideally, such properties would be more
appropriately platted at approximately 300 feet in depth if
property is available.
The plat proposes the division of the lot into a total of
eleven lots, plus one lot to accommodate the existing Gould
development. The Gould people are joining the in the plat
so that the Gould property, too, will receive a lot number
replacing the existing metes and bounds description. You
will note that an additional 22 feet of right-of-way is

being dedicated on the west side of Lexington Avenue to
accommodate ultimate expansion and improvement for that
street as may be necessary in the future.
You will note, too, the reservation of Outlot A along the
north side of the property. This outlot is being reserved
for future sale to MN/DOT for the purposes of expanding and
ultimate improvement to Trunk Highway 110. This improvement
will include the construction of a service road which will
run from Lexington Avenue westerly to a new intersection
somewhat east of the existing intersection with Trunk
Highway 55 and 110. The configuration of Outlot A is in
agreement with MN/Dot and is consistent with the previously
reviewed and approved plans by the City of Mendota Heights
with respect to this portion of Trunk Highway 110.
Some of the lots along the northern tier will not have
permanent access to a public street until such time as the
Trunk Highway 110 improvement is accomplished. This is
anticipated to be approximately in the year of 1988. You
will note the existence of an easement indicated as 35 feet
in width along the north side of lots 3 and 4 of Block 2.
This easement is for the purpose of providing temporary
access to lot 4 until such time as the service road is
completed. You will also notice an easement on the west
side of the North-south Street, which will provide interim
access to the North-south Street from the existing curb cut
in the median opposite the old farm house on the northwest
corner of the site.
The preliminary plat has been reviewed by the Engineering
Staff and we understand it to be acceptable, subject to�the
provision of certain easements for storm drainage. and
ponding purposes. This storm drainage plan is currently
under design by Hedlund Engineering Services, Inc. who have
prepared the preliminary plat and have done the engineering
work on this site development. It would be appropriate for
the Planning Commission and Couneil to consider approval of
the preliminary plat subject to Engineering Staff review of
final engineering details, including provision for
appropriate easements for drainage and utilities.
The property is currently zoned' B-1-A, which is a
large-scale office park zone, requiring a minimum of 5 acre
lot sizes. Obviously, some of the smaller lots proposed in
this plat do not meet that minimum. We have no problem with
the rezoning of the land from B-1-A to B-1 on this site.
The B-1 District allows for a wider range of uses, including
banks, medical buildings, hospitals, clinics, etc: Some of
the potential users proposed for the site are included in
the latter list, one of which will likely be a medical
office building.
A 60,800 square foot convention center is proposed on lot 5,
Block 1, a 7.24 acre site. We have asked that Mr. Lee
include a copy of the site plan for this structure with this

packet. Construction is proposed for that structure yet
this fall. This convention center will be operated by Alpha
Environments, Inc., headed by Steve Masotto. Mr. Masotto
has had eight years experience with the Marriott Hotel
people and seven years previous to that working with the
Radisson Inns. This structure will be a three story
building constructed of glass and brick. Mr. Lee informs us
that colored renderings of this building will be available
at the Planning Commission meeting. Working drawings for
this structure are currently underway, pr�epared by David
Todd Runyan and Associates, Inc., Architects. Approval of
development of this site for the convention center is not
the subject of this application but, hopefully, it is
indicative of the level of quality proposed for ultimate
development in the business center.
Mr. Lee has indicated his desire to construct a restaurant
on one of the sites of the development, possibly the far
northeasterly, triangular-shaped parcel which is slightly
more than 1 acre in size. Such development would not likely
oceur until the service road system is complete, sometime
after 19$$• At that time, the restaurant site would have to
be considered for rezoning (B-2, in this case). The other
option would be to add a restaurant as a conditional use in
the B-1 zone, which may also be an appropriate course of"
action.
The proposal, then, is for approval of the preliminary plat
and rezoning from B-1-A to B-1. The Planning Commission and
Council may wish to consider approval of the preliminary
plat subject to Engineering Staff review and approval of the
rezoning from B-1-A to B-1.

DISCUSSION:
The Planning Commission at their September 10, 19$S special meeting
unanimously voted to recommend approval of rezoning the "Gould Site" located
at Trunk Highway 110 anci Lexingtan Avenue fram B-lA (S acre minimum lot
sizes) to B--1 (15,000 square feet).
They also recommended approval of the preliminary plat (see attached
staff inemo) .
There is a requirement for the City Council to conduct a publ.ic hearing
on the rezoning request however there was nat sufficient time fram the
Planning Commission approval date for staff to publish for this meeting.
There is no requirement for a public hearing an the subdivision request and
Mr. Lee, the applicant has requested to proceed with the Council review of
that subdivision in advance of the rezoning public hearing. He is in a time
deadline far some financing ar bonding approvals for his project and needs
to know if there is general Council approval of his proposal.
RECOI�IENDATION:
Inasmuch as there has been no public adversity and unanimous Planning
Commission approval, staff feels that Council could review and give Mr. Lee
approval of his preliminary plat subject to a rezoning approval at the
October lst public hearing.
ACTION REQUTRED:
If Council wishes to implement the staff recommendation they should
review and approve the Centre Point South preliminary plat subject �a a

The regular meeting of the Park and Recreation Commission was called to order
by Chairman Stein at 7:30 P.M, on September 10, 1985. The following members were
present: Stein, Damberg, Doffing, Knittig, Leffert, Schneeman and Singer. Also
present were Barry Warner of Barton-Aschman Associates, Inc., and Public Works
Director Jim Danielson.
APPROVAL OF Minutes of the August 13, 1985 meeting were approved as submitted

COMPREHENSIVE PARK Barry Warner, Sr. Associate with Barton-Aschman, Inc., made a
STUDY presentation concerning time frame, various phases of the study,
and completion of the proposal and contract. Discussion con-
tinued on bond issues and available land for park use.
RILEY APT. PROJECT Discussion was held regarding proposed Riley apartment project
near I-494. A request was submitted to ask the City Council to
allow the Park and Recreation Commission to be involved in the
discussion of the project. A request also was made of City
Council to allow the Commission members to each receive a copy
of the South East Area Study.
WACHTLER PROPERTY Discussion was held on the proposal of offer to purchase the
property owned by the Wachtler family for use as a park and
recreation area.

BIKE TRAIL An update was presented on the bike trails. After discussion,
the commission saw a need for additional work on various parts
of the bike trail. It was requested of Jim Danielson to study
the problems and report back to the commission.

OTHER BUSINESS A request was made of Mr. Danielson to provide each commissior
member with a completed 1986 budget.
Discussion was held on a letter received by City Administrator
Frazell concerning the lowering of the level of Rogers Lake.

We have negotiated a new method of calculating fire contract costs with
Lilydale and propose to apply the same theory to Sunfish Lake and Mendota.
The current contract is based on actual cost of two years ago, current
assessed value and call frequency. The change is to phase in current costs over
' a two year period. This will produce about $23,650 of revenue which was figured
in the budget revenues. For comparison, the charges will be as follows:

LCS Company, 148Q Sibley Memorial Highway, is requesting Council approval
of a 70 foot by I.00 faot addition to their existing facility. FootingJfoundation,
site, landscape, floor, and building elevation plans have been subm3.tted and mee�
building code requirements. The additian will be a pa�nted, smaath conerete bloc2t
to match the existing building.
LCS`s owner and the arch3,tec� discussed thai.s proposal with staff and Planner
Dahlgren. Zoning items such as setbacks, parking and landscaping appear satisfactary.
The only question was whether ar not painted concrete block would be an acceptable
ex�erior finish. Under requirements for all B and I zoning, 4,17(3)g subsequent
� additions and ather buildings or structures constructed sha21 be canstructed af
materials comparable in quality and appearance to those used in the original
costructian and shal2 be designed in a manner conforming with �he ozigznal architectura.

After checking records, I found that permi�s were issued to 14$0 Sibley
Memarial Highway in 1963, far the original building, and far additians to the
bui.lding in 1965, 196$ and 1973. I assume these permits were approved by
Council prior to 3ssuance by Dick Bjorklund.
The present request is far Council approval of the full building permi�,
subject ta s�aff review. This has been done an a number of germits in the
industra.al park for United Properties and other developers.
RECQMMENDATION
Staff recommends Council approval af both the footingJfoundation permiC, and
the full building permit, subject ta staff review, as well as Council approval of the
construction materials. - �

The City of Mendota Heights is eligible for County and State funding
assistance for any landfill abatement related projects. Total avazlable
funding is $1.50 per household or about $4,100.00 per year. Landfill
abatement projects include projects such as paper drives, aluminum collectio
or leaf composting. It was suggested �hat �.he cities of West St. Paul,
South St. Paul, Inver Grove �ieights, and Mendota Heights pool our monies
together to create a joint coaperative leaf compasting project.
Inver Grove Heights has dane much of the planning and preliminary
studies for such a compasCing site. They have proposed a cen�ral location
in the northwest corner of Inver �rove Heights be used as the site. The
estimated annual cost for land, equipment, materials, and labor is
approximately $41,000. This is just s�.ightly above Che total availab3.e
funding between the four cities. The excess monies needed would be
groportionally split among the faur cities, thus Mendota Heights, with its
comparitively small size, wou].d have to con�ribute a minimal amount, a few
hundred dollars at the most.
More important than �.he obvious service this program provides to the
community, it is a response to the recent legislation passed that will
prahibit yard wastes in sanitary landfills. We also benefit because an
Inver Grove Heights sa.te means Mendota Heights wauld not have ta deal w5.th
many of the problems associated wiCh such a project.

A home, owned by Mr. & Mrs. Don McCluney and located at 1502 Vandall,
is nearing completion and a sewer permit has been requested. No sewer
service was installed to serve the property in the past, and in the
process of determining sewer location it was discovered that the property
has never been assessed £or the right to connect. A sanitary sewer
pro�ect constructed in 1969 extended the sewer system to the centerline o£
"No Name Street" from Clement Avenue. The construction plans originally
included construction the full length of "No Name Street," however, that
portion easterly from Vandall was deleted from the final plans. We have
done considerable reaearch into the pro�ect files, minutes and resolutions
and can £ind no indication as to why this section was deleted. The
McCluney property can and Cbecause the atructure is nearing completion and
can aoon be occupied) should be aerviced by tapping into the sewer main at
the intersection of Vandall and "No Name Street." The assesament or
connection charge requires Council consideration and approval.
DISCUSSION
The McCluney sewer connection is unique in that, while a sewer
connection is possible, the eanitary line does not run along either side
of this corner lot. The property owners are therefore faced with
installing a very long C150 foot) and expensive CS2,900) service lead.
Staff has considered various bases on which to calculate a sewer rate
has discussed whether collection should be considered a one-time
connection charge or whether it should be assessed. We have also m�t
Mr. & Mrs. McCluney, who were completely unaware that there wes any
potential liability for easessment. The abstract and title searches
per£ormed on their behal£ at the time they purchesed the property
indicated that the utilities were available and that there were no
outstanding or pending assessments against the property.

Staff has prepared the attached drawings which indicate existing
sewer and water lines in the area and which depict those properties which
have never been assessed and/or cannot currently be aerved by those
utilities. It seems reasonable to asaume that at some future time
utilities will need to be extended along "No Name Street," and this

property will be affected: The McCluney property was assessed for 57 _�E�
of frontage on "No Name Street" (Lot 8) at the time water was installed is
Vandall. The remaining property, Lot 7 and 15 feet af Lot 16 will be
assessible under any future water pro�ect on "No Name Street."
It is the concensus of staff thet the rate for sanitary sewer for
this property ahould be based on an average o£ recent assessment rates foz
sanitary sewer: 518.33 per front foot. We also feel that, given the
unuaual circumstances and the extenaive cost the homeowners must bear for
installing the lengthy service lead, the charge of �2,364.57 for full
frontage along the un-named atreet should be treated as an assessment
collectible over 19 years rather than as a one-time connection charge.
The McCluneys agree that at such time as utilities are extended along the
un-named atreet,'this aewer assessment and original water assessment will
be treated as a credit against such future pro�ect assessment. The
property owners have given us a written waiver which will allow the
property to be assessed without public hearing and certified for
' collection beginning in 1986.
RECOMMENDATION
We recommend adoption of the attached "RESOLUTION ADOPTING AND
CONFIRMING SANITARY SEWER ASSESSMENT FOR PART OF LOT 6 AND ALL OF LOTS 7
AND 8, BLOCK 4, T.T. SMITH'S SUBDIVISION N0. 4," on the basis of 518.33

WHEREAS, the City Clerlc, with the assistance of the CiGy Engineer, has
calculated the praper amaunt to be special.ly assessed far the casts incurred
to date with respect ta Improvement No. 85, Project No. S, construction af

each such assessment as to �anitary sewer shall be payable in equal amounts
extending over a periad of nineteen {19} y,ears; the first af said install-
ments, together wa.th interest on the entire assessment commencing thirty
(34) days from the date hereof to December 31, 19$5, to be payable with
general taxes for the year 19$5, coll.ectible in I986 (now designated as real
estate taxes payab].e in 1986), and one of each of the remaining install-
ments, together with one yearts a.nterest on that and a21 other unpaid in-
stallmen�s, to be payable with general taxes for each consecutive year
thereafter until the entire assessment is paid; and
BE IT FURTHER RESOLVED, that the Clerk shall prepare and transmit to the
County Auditor a certified duplicate of said assessment roll with each then
unpaid installment and interest set f orth separately, to be extended upon
the proper tax lists of the County, and the County Auditor shall thereafter
collect said assessments in the manner provided by law.

SUBJECT: CAO 85-OS, Modified Site Plan Approval - 1037 Douglas Road
INTRODUCTION
Tom 0'Malley of T.C. Builders, Inc., on behalf of David Sloane, has submitted
an application and site plan for modified site plan approval for 1037 Douglas Road.
This parcel is located on the easterly 20 feet of Lot 11 and all of Lot 12, Block 3,
Tilsen's Highland Heights Plat ��3.
DISCUSSION
This property falls within the boundary of Ordinance ��403, Critical Area
Overlay District Ordinance. Section 2.3C-Modifications: In the case of a minor
development and/or change involving a single family dwelling unit and if the site
plan conforms to the standards of the Critical Area Overlay District Ordinance, the
City Administrator shall bring the request to the attention of the City Council
at it's next regular meeting following receipt of an application for Critical
Area Ordinance consideration. The City Council shall review such request and may,
if it so desires, exempt the applicant from complying with any inappropriate require-
ments of this ordinance.
RECOMMENDATION
Staff has reviewed the site plan as submitted by Paul McGinley of Paul
McLagan and Sons Land Surveyors. Both myself and engineering have reviewed the
site plan and find that the location of the proposed dwelling conforms to zoning
and CAO ordinance requirements and we can see no reason why the approval should
not be granted.
ACTION REQUIRED
If Council wishes to implement the staff`s recommendation to approve the
modified site plan review, it should pass a motion of approval so that staff
may issue the building permit as requested.

SUBJECT: Trunk Watermain Assessment Hearing

DISCUSSION:
Staff invited affected landowners to submit requests for deferments on
this project because it was a watermain that was constructed primarily as a
system improvement, It is planned that Water Revenue Fund is to pay for the
oversizing of the projec� and also carry the entire amount until such time
as assessments are received.
Requests for deferments have been received from all affected owners
except the Gangls and the Gotts. The Gotts propose to pay up their amount
because they are in the process of selling to the Visitation Monastery (see
attached requests).
Staff has been reviewing the assessment amounts and has noticed that
two of them, although they follow the City's assessment policy, may be
inappropriate.
1. Carl Case owns an (approximately 35 foot by 100 foot).,piece of
property at the southeast quadrant of Dodd Road and Mendota
Heights Road. That land is small because Mn/DOT acquired the
greater majority of it for right-of-way. The remaining land is
not large enough to be buildable. Council may want to consider
not assessing the piece at all. �
2. The Independen� School District #197 has three separate pieces of
property located north of Mendota Heights Road. The piece located
at the intersection of Dodd Road and Mendota Heights Road has
frontage on both. We followed our assessment policy and assessed
them for both streets. In reality the portion along Dodd Road
probably would not be able to utilize the watermain because it is
located on the�west side of Dodd Road. Even if they are able to
use it, it would be at great expense because they would need to
. "jack" under tl�e highway. 520' X$18.00 =$9,360 is the amount
along Dodd Road.
We will not be able:to file these assessments in time for certification
with the 1986 taxes anyway so if the Council wants to consider this roll

further there is no pressing need to act on it this evening. We tried to
hurry it through only to accomodate the Gangls and they now inform us that
they will not be connecting until spring.
Staff feels that all the requ�sted deferment s can be approved and the
funding of the project be accomplished by utilizing the Water Revenue Fund.
Because of I-494 completion much of this property will be developing in the
next few years and assessments paid at that time. Perhaps the Independent
School District 197 property deferment which is a large amount should be
looked at closely. We don't know how soon the property will develop and
with interest the amount due grows rapidly.
RECONII�IENDATION:
Reduce the assessment to Independent School District #197, parcel no.
27-03500-010-79 by $9,360 and approve the corrected roll. Approve the
requested deferments.
ACTION REQUIRED:
See September 6th memo. Staff has prepared a resolution approval all
the requested deferments.

The City Council of the City Mendota Heights, Minnesota, ordains
as follows:
SECTION 1. Ordinance No. 1113, known and referred to as "An
Ordinance Establishing Stop and Yield Intersections Within The City of
Mendota Heights" is hereby amended in the following respects:
The following streets are hereby added to Section 1 of said
Ordinance, "THROUGH STREETS AND STOP INTERSECTIONS,"

RESOLUTION N0. 85
RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS
FOR WATERMAIN TRUNK LINE ALONG TRUNK HIGHWAY 149 AND
MENDOTA HEIGHTS ROAD
(IMPROVEMENT N0. 83, PROJECT N0. 7B)
BE IT RESOLVED by the City Council of the City of Mendota Heights as
follows:
WHEREAS, the City Clerk, with the assistance of the City Engineer, has
calculated the proper amount to be specially assessed for the costs incurred
to date with respect to Improvement No. 83, Project No.7B construction of
watermain trunk line to serve the following described property situated in
the City of Mendota Heights, Dakota County, Minnesota, more particularly
described as follows:
Al1 land adjacent to Trunk Highway 149 (Dodd Road) from Lake Drive
South to Mendota Heights Road and Mendota Heights Road East of Trunk
Highway 149.
WHEREAS, the proposed assessment roll has been on file with the Clerk and at
all times since its filing has been open for public inspection; and notice
thereof has been duly published and mailed as required by law. Said notice
stated the date, time and place of such meeting; the general nature of the
improvement; the area proposed to be assessed; that the proposed assessment
roll has been on file with the Clerk; and that written or oral objections
thereto by any property owner would be considered; and
WHEREAS, said hearing was held at 8:00 o'clock P.M. on September 17, 1985,
at the City Hall in the City of Mendota Heights, Minnesota; and
WHEREAS, the Mayor announced that the hearing was open for the consideration
of objections, if any, to said proposed assessments; and
WHEREAS, all persons present were then given an opportunity to present oral
objections, and all written objections theretofore filed with the Clerk were
presented and considered.
NOW THEREFORE, this Council, having heard and considered all objections so
presented, and being f ully advised in the premises, and having made all
necessary adjustments and corrections, finds that each of the lots, pieces
and parcels of land enumberated in the proposed assessment roll was and is
specially benefited by the construction of said improvements in not less
than the amount of the assessment, as corrected, set opposite the descrip-
tion of each such lot, piece and parcel of land, respectively, and that such
amount so set out is hereby levied against each of the respective lots,
pieces and parcels of land therein described; and

BE IT FURTHER RESOLVED, that the proposed assessment roll is hereby adopted
and confirmed as the proper special assessment for each of said lots, pieces
and parcels of land respectively, and the assesement against each parcel,
together with interest at the rate of ten percent (10%) per annum accruing
on the full amount thereof from time to time unpaid, shall be a lien concur-
rent with general taxes upon such parcel and all thereof. The total amount
of each such assessment as to watermains shall be payable in equal amounts
extending over a period of nineteen (19) years, the first of said install-
ments, together with interest on the entire assessment commencing thirty
(30) days from the date hereof to December 31, 1986, to be payable with
general taxes for the year 1986, collectible in 1987 (now designated as real
estate taxes payable in 1987), and one of each of the remaining install-
ments, together with one year's interest on that and all other unpaid in-
stallments, to be payable with general taxes for each consecutive year
thereafter until the entire assessment is paid; and
BE IT FURTHER RESOLVED, that prior to October 17, 1985, the owner of any
lot, piece or parcel of land assessed hereby may at any time pay the whole
of such assessment, without interest to the City Treasurer; and
BE IT FURTHER RESOLVED, that the Clerk shall prepare and transmit to the
County Auditor a certified duplicate of said assessment roll with each then
unpaid installment and interest set forth separately, to be extended upon
the proper tax lists of the County, and the County Auditor shall thereafter
collect said assessments in the manner provided by law.
Adopted by the City Council of the City of Mendota Heights this 17th day of
September 1985.

SYN4PSIS OF MONTHLY CALLS

The department responded to 21 calls this month. As of the end ot this manth, we
have responded to 14 more ca11s than last year. This is an incre�se of 11.3�. We
had one structure fzre this month that resu�ted in a fire loss on August 28 at
1630 hours. The fire department was called to � fire at 235Q Rogers Ave. Upon
arrival, the men faund the house filled with smake and a fire in a chair in the
basement of the house. The fire was extinguished immediately and contained to
the chair and a safa. Cause of the fire was determined to be a woodburning stove.
Damage was estimated at $1200.
SYNQPSIS OF MONTHLY DRILL
The manthly drill consisted af the graup being split in half. Ona half dril2ed
using the boat in water rescue on the river. The other group was expased to a
magnesium fire and �aught how to extin�uish such a fire.
. The monthly rescue drill dealt with paCient assessment. This is one of the
. f irst steps needed in treating an injured persan.

The City's new segment of backbone bike trail that was constructed this
�� summer goes through the Curley neighborhood, following Mary Adele Avenue and
Timmy Street. There are presently no homes constructed on the north side of
Mary Adele, therefore very few cars ever park there. Staff feels that there
would be very little if any inconvenience to the residents if the north side
of Mary Adele were to be reserved for trail purposes only.
RECOMMENDATION:
Staff recommends that Council adopt a new ordinance adding the north

side of Mary Adele Avenue to the City's "no parking zone."
ACTION REQUIRED:
If Council wishes to enact the staff's recommendation the Council

AN ORDINANCE PROHIBITING PARKING ON THE NORTH SIDE OF
MARY ADELE AVENUE BETWEEN TININIY STREET AND PATRICIA STREET
SECTION 1. No person shall park or leave standing any motor vehicle on
the north side of Mary Adele Avenue between Timmy Street and Patricia
Street.
SECTION 2. DEFINITIONS
For the purpose of this Ordinance:
2.1 "Motor vehicle" shall be deemed to mean any self-propelled vehicle
not operated exclusively upon railroad tracks and any vehicle pro-
pelled or drawn by a self-propelled vehicle.
2.2 "Person" shall be deemed to mean and include individuals, partner-
ships, associations or corporations.
SECTION 3. Any person failing to comply with the provisions of this
ordinance shall be guilty of a misdemeanor and upon conviction thereof shall
be punished by a fine of not to exceed $500 or by imprisonment for not to
exceed 90 days.

CounciZ, City of Mendota Heights, was held at 7.00 o'clock P.M. �t City Hall,
750 South Plaza Drive, Mendota Heights, M�nne�ota.
Mayor Lockwood called the meeting to order at 7:�0 o'clock P.M. The fol2owinc
members were present: Mayar Lackwaod, Councilmembers Bleaener, Cummins,
Hartmann and Witt.
BUDGfiT DiSCUSSZQN Tressurer Shaughnessy reviewed praposed 1986 generel
fund revenues and inform�d the Council of a proposed
change in the police �ervice charges to Mendota and
Lilydale, recommended to be 534,912 and �49r200
re�pectively, and changea in the Adminiatration LOGIS
and contingency line item� to offset the �3,958
reduction from what was prop��ed as police contract
revenues in the preliminary budget. He distributed s
summary of ma�ar increases or n�w services propased ii
the budget document and stated that a.3 mill levy
increa�e wouid be required to finence the propased
general fund expenditures.
The Council then reviewed the prnposed departmental
budgets with staff representatives of each af the
departments. Treasurer Shaughne�sy and Administrator
F'razell reviewed the "other f und" budget proposals.
After discussinn, it was Council concensus ta direct
staff to prepare a firtalized budget documen� for
actoptinn at the next meeting ar an October 1st.

SUBJECT: Change in 1985 Holiday Schedule
Among the 11 City holidays is Columbus Day, which this year falls on
Monday, October 14. Columbus Day is an optional holiday under state statute,
so that we are not obligated to close the offices on that day.
Last year, we decided to forego the Columbus Day holiday, so that we
could be closed on the day before Christmas, which was Monday. There seems
to be a concensus among the employees, that once again, they would like to
have the option of working on Columbus Day, then taking some other day off
later in 1985. However, rather than designating a particular day this year,
it would simply become a second floating holiday. Some may choose to take
Columbus Day, while others might opt for the day after Thanksgiving, or
some day during the Christmas/New Year's season.
In addition to providing a popular option for the employees, this
would also result in the City offices being open one day more than they
would be should we strictly follow the holiday schedule.
ACTION REQUIRED
Assuming the Council has no objections to this plan, no further action
is required. I will implement it administratively.
