The proposed project will consist of the acquisition of land and the construction and equipping thereon by a Minnesota partnership to be formed in which Larry Lee will be one of the general partners, of an approximately 55, 000 square - foot � building to be used as an educational and convention facility. The Project will be located in the City of Mendota Heights, Minnesota, on Highway 110 on the real property legally described as the Southeast 1/4 of Section 27, Township 28N, Range 23, Dakota County, Minnesota. The estimated total amount of the proposed bond issue is $6,400,000. Such principal amount and interest thereon shall be payable by the City solely from the revenue pledged to the payment thereof, except that such bonds may be secured by a mortgage or other encumbrance on the project. No holder of any such bond shall ever have the right to compel any exercise of the taxing power of the City to pay the bonds or the interest thereon, nor to enforce payment against any property of the City except the project. A draft copy of the proposed application to the Energy and Economic Development Authority of the State of Minnesota for approval of the project, together with all attachments and exhibits thereto. is available for public inspection at the office of the City Clerk between the hours of 8:00 A.M. and 4:30 P.M. Members present were: Stein, Damburg, Doffing, Knittig and'Singer. Members absent were: Leffert and Schneeman. Also present were Councilmember Liz Witt and Public Works Director Jim Danielson. APPROVAL OF MINUTES Minutes of the July 9, 1985 meeting were approved as submitted. STATUS OF BIKE TRAIL Danielson reported that the first phase of the backbone CONSTRUCTION trail system is completed and in use. Doffing said the gravel portion of the trail through the lot at the corner of Timmy and Cullen looks unfinished and there was some washout in the recent rains. Doffing moved to ask the Council to allocate funds for blacktopping the Curley Add- ition segment of the trail at Timmy and Cullen. Singer seconded the motion, which passed unanimously. Ayes: 5 ' Nays: 0 SOUTHEAST AREA The Commission discussed the potential strain that develop- DEVELOPMENT ment in the southeast area of the City would put on current park facilities, and what type of park contributions by the developers would be advisable. Singer made the following recommendation: that the City Council postpone final plans for development in the southeast area until completion of the pending park study, and that the Commission be actively involved in the park development in that area. Damburg seconded. Ayes: 5 Nays: 0 Knittig and Damburg will represent the Commission at the City Council/Planning commission meeting on August 27th. PARK PLANNER HIRING Stein reported that the Council has agreed to hire a park planner and is waiting on a recommendation. Singer and Doffing synthesized proposals for the comprehensive park system plan from several services, and the Commission discussed the proposals in detail. � Ayes: 5 Nays: 0 Singer moved to recommend;�arton-Ashman Associates, Inc., to update the City's master park system pla�. Damburg seconded the motion. The Commission agreed that the contract should reflect the urgency of the project. � . August 13, 1985 Park and Rec Minutes Page Two BASKETBALL AND Danielson said that the Council favored basketball and VOLLEYBALL COURTS volleyball courts, but that he needed more information on the number of courts and bangboards to figure costs. This item will be continued to the next agenda. CHERRY HILLS DRAINAGE Danielson explained the drainage problem in Cherry Hills and the proposed solutions and funding. Knittig moved that: l. Regrading in the Wachtler property is premature and should wait completion of the park study and 2. Park funds should not be utilized to cover work done prior to completion of the aforementioned. Doffing seconded the motion. - Ayes: 5 Nays: 0 MISCELLANEOUS Doffing will attend the August 20th Council meeting. The next meeting of the Park and Recreation Commission will be September lOth. Also the garage indents into living area in back of garage to reduce square footage by 54 feet. Air conditioning value also drops because of reduced square footage, The estimated market value should be reduced from $144,700 to $133,300. Berg Code Enforcement Officer SUBJECT: Sign Permit Request for Video King (continued from August 6th) DISCUSSION I had prepared a memo to the City Council for the meeting of August 6, 1985, recommending approval of Attracta Sign's permit application. Council elected to continue the permit request to the August 20th meeting. There seemed to be some confusion as to whether or not the type of sign was permitted in a B-4 zone. The sign ordinance, Section 18.7(1)b provides for an individual sign to be 100 square feet in area. I cannot find anywhere in the ordinance where it requires the sign to be individual letters. Council has previously approved a sign for Coast to Coast and the chiropractor's off ice located in the shopping center. Both of these businesses have the same type of sign as requested by Attracta Sign for Video Update. Attracta Sign has installed the Video Update sign in order to take photos of their sign and they were also directed by me to take pictures of the existing signs at the shopping center for Council review. The applicant will be present at the meeting to answer any questions. RECOMMENDATION Again, I will recommend the approval of the sign permit for Video Update. The sign requested is a 54 square foot illuminated sign containing the message Video Update. The sign has a red background with white letters. ACTION REQUIRED If Council wishes to implement staff's recommendation, it should pass a motion approving the requested 54 square foot sign permit to Attracta Sign, Inc., so that they may install Video Update's sign. It has been aur pleasure to have raised our �amily in this wonder�'ul rura�. environment and to have enjoyed the pleasures of country living. - Presentiy yau have a proposal before yau that wil.l affect our area. I have had several meetings with Mr. Jim Riley abaut his propased development and the effec�s it will have on our community and our area. Based on current economic con3itions and th� current development of the �reeway and the airport noise problems, I believe this prapasal would b� a proper use of land in our part of the city. Being a long time resident and large landowner in M�ndota Heights, I believe the time has come for all. o� us�to mak� some decisions abaut this area. Based on t?�e d�velapment of the �freeways and the opening of �Ghe ramp on Dodd Road, the complexion of this area is changing significantly. For those af use who have been around for a Iang tim�, any change s�ems d.ramatic. Ho�vever, I believe these changes offer opportunities for our community. Certainly Mr. Riley's project is a plus for�Mendota Fleights and it wauld be to our community's advantage to expedite this matter. Danielson, Public Works Director SUBJECT: Mendota Heights Associates (Riley Housing) Case No. 85-10 DISCUSSION At the August 6, City Council meeting, Mr. Jim Riley presented informally his proposal for rezoning, and a PUD to construct eight apartment buildings on his land located in the Southeast area of Mendota Heights. The City Council indicated they felt that although the public hearing would need to be conducted August 20, no formal action would be taken on his proposal until after the - final Southeast Area Study was received from Howard Dahlgren. That report will be presented at an August 27, joint City Council and Planning Commissiori meeting. ACTION REQUIRED Conduct a public hearing to receive and review comments on Mr. Jim Riley's rezoning and PUD applications. Danielson Public Warks Director SUBJECT: Evergreen Knoll Assessment Roll Job Na. 8313 Improvement No. 83, Project No. 4 DiSCUS�ION: The final costs for the Evergreen Knol1 {Gryc} project are naw known and the a�Cached assessment roll has been prepared by staff. The major developer Mr. Gryc has requested that the costs far his portion of the project be divided equally amang his 22 lots. Staff therefore calculated his total costs using the standard City assessment procedures and divided the total costs equa�ly per his request. Mr. Larry Shaughnessy is also a large Zandowner withzn the project, and his costs have been calculated by normal assessment procedures. Several years ago the City acquired some gark land from him and there was a provision in the terms of that purchase agreement which states tha� water service would be provided to the balance af his praperty by the City at no cost. That cos� is $3,820.00 and shauld be paid for out of the Park Fund. Mr. LeRoy Hansan, who owns a piece of land at the south end of Wachtler Avenue, had some street and watermain constructed in front of his property. He is proposing to develop �his property in conjunction with Mr. ShaughnessyTs development. We propose �o assess him for the amount of street and watermain that has been installed in frant af his property. Mr. Christoffersen owns property at the intersection of Wachtler and Wentwarth. His lot is 338 feet lang and fronts Wentworth. That property has paid assessments for and is being served by sewer, water and stree� of Wentworth Avenue. Because he has a long IoC he could subdivide it and create a new Iot along Wachtler in the future, we are proposing to create assessments for that future 2ot. Staff recommends the Council defer those assessments antil such time as a new lo� is created or the land sells. Mr. Shaughnessy and Mr. Hanson also request tha� the City defer their as- sessments until such time as �hey subdivide (see attached let�er). The County has been billed for 55 percent o£ the Wachtler/Wentworth con- struction, however the street assessments which normally run abaut $30 per irant foat, are s�ill considerably higher than normal because of the high costs asso- ciated with "getting to" the development from Wachtler/Wentworth. Staff proposes to hold out $33,550.00 from these assessments and include these costs with future projects in the area that utilizes this access. Staff feels that this needs to be done in order that the street assessments for this first subdivision be more proportionate to future street assessments in the area. � RECOMI�NDATION : All the assessments are in line with the feasibility estimates and staff recommends that the City Council adopt the assessment roll as prepared. We also recommend that the City Council defer the making of assessments to the Christofferson's, Mr. LeRoy Hanson and Mr. Laurence Shaughnessy until the parcels are sold or subdivided. We have again received such a request, asking that a license for Saturday and Sunday, September 14 and 15. Hours of the beer sale will be on Saturday from 8:00 P.M. to 12:00 A.M., and on Sunday from 12:00 P.M. to 5:00 P.M. � RECOMMENDATION/ACTION REQUIRED Staff recommends that Council approve the request and waive the fee, as has been done in all past St. Peter's Church license approvals. If Council con�urs, it should pass a motion to authorize the issuance of a two-day on-sale 3.2 malt beverage license to St. Peter's Church for September 14 and 15, in conjunction with the Annual Father Galtier Days, along with waiver of the license fee. Danielson Public Works Director SUBJECT: Evergreen Knoll Assessment Roll Job No. 8313 Improvement No. 83, Project No. 4 DISCUSSION It was noticed during discussion with the developer that charges for City Administration were added in twice. That cost was $3,345 and can be deleted from the assessment roll. Engineering Secretary Ward is out sick with pneumonia this week, so the roll could not be amended to reflect that change. That cost is part of the overhead which is factored in equally to all assessments. (It amounts to about a 1� reduction to all costs). RECOMMENDATION Staff recommends that Council direct staff to modify the assessment roll to reduce the cost by $3,345 and equally distribute the reduction among all assess- ments. ACTION REQUIRED If Council concurs with staff's recommendation, they should pass a motion directing the reduction and adopt the resolution as prepared. (See earlier memo in packet). Recitals and Findings 1.1. This Council has received a praposal that the City finance a praposed project under Minnesota Statutes, Chapter 474 (the "Aet"), consisting af the acquisitian of land and constructing and equipping thereon of an approximately 55,OOQ square foot building to be used as an educational and canvention facility (the "Project") by a Minnesota partnership to be formed in whieh Larry Lee will be one of the general partners therein {the "Borrower") . 1.2. The Council previously granted prelimin�ry approval of the Prajeci pursuant to a resolution adopted September 18, 1984, fallowi.ng a public hearing held on said date. The Borrower has requested that the Council adopt another preliminary resalution with respect to the Project ta increase the amaunt af revenue bonds to be issued Lherefor to an amount not ta exceed �5.400.000. 1.3. At a public hearing. duiy noticed and held an August 20� I9$5, in accardance with the Act, on the propasel to undertake end finance the Projeet, all parties who appeared at the hearing were given an apportunity to express their views with respeet to the proposal ta undertake and finanee the Project. Based on such hearing and such ather facts and circumstances as this Counci� deems relevant, this Council hereby finds, determines end deelares as follows: (a) The welfare af the State of Minnesota requires active promotion, attraction, encouragement and development of econoznicallp sound industry and commerce thraugh governmental acts to grevent� so far as passible, emergence af blighted lands and areas of chronic unemployment, and the State has encouraged local government units to act Lo prevent such economic deterioration. (b) The Praject wauld further the gene�`al purposes cantemplated and deseribed in Section 474.U1 of the Act. (c) The existence of the Project would add to the tagx bese of the Gity, the County and the Sehool District in which the Praject is laeated; would provide increased oppartunities for employment for residents af the Citp and the surrounding area. ��, (d) This Council has been advised by a representative of the ,_ BorroMer that conventional, commercial financing to pay the cost of ' the Project if available only on a limited basie and at such high coats of borrowing that the economic feasibility of operating the Project would be significantly reduced. but that with the aid of municipal borro�ing. and its reeulting lower borrowing coat� the Project is economically more feasible. (e) The City is authorized by the Act to issue its revenue bonda to finance capital projects consisting of properties� real and/or personal, used or uaeful in connection with e revenue producing enterprise� such as that of the Borrower� and the issuance of such bonds by the City would be a substantial inducement to the Borrower to acquire and install the Project. SECTION 2. Prelimin�ry Approval of Project 2.1. On the basis of information given the City to date. it appears that it would be in the best interest of the City to issue its revenue bonds under the provisions of the Act to finance the Project in an amount not exceeding 56�400�000.00. 2.2. It is hereby determined to proceed with the Project and its financing. Preliminary approval of the Project and the issuance of revenue bonds of the City (which may be in the form of a commercial development revenue note or notes) in such amounts hereby approved is hereby granted by the City, subject to the approval of the Project by the Minnesota Energy and Economic Development Authority, the fulfillment of such other conditions as the City may require with respect to the issuance of its revenue bonds in connection with the Project, and the mutual agreement of this Council and the Borrower as to the details of the revenue bonds and provisions for their payment. In all events, it is understood, however� that the revenue bonds of the City shall not constitute a charge, lien or encumbrance, legal or equitable. upon any property of the City � except the Project, and each revenue bond, when, as and if issued � shall recite in substance that the revenue bond, inclvding interest thereon, is payable solely from the revenues received from the Project and property pledged to the payment thereof, and shall not constitute a debt of the City. 2.3. The form of the Application to the Minnesota Energy and Economic Development Authority, with attachments � is hereby approved � and the Mayor and City Clerk are authorized to execute said documents on behalf of the City. 2.4. In accordance with Section 474.1, Subdivision 7a, of the Act. the Mayor is hereby authorized and directed to submit the proposal for undertaking the Project to the Minnesota Energy and Economic Development Authority, requesting approval of the Project. The Mayor� City Clerk. City Attorney and other officers� employees and agents of the City are hereby authorized and directed to provide this Commissioner with any preliminary information the Commissioner may need for this purpose, and the City Attorney is also euthorized, in cooperation with bond counsel to be approved by the City, to initiate preparation of such documents as may be appropriate to the Project in ' • {' y rWM' e� order that, if it is epproved by the Commissioner� it may be carried forward expeditiously. SECTION 3. General 3.1. If the revenue bonds are iasued and sold. the City will enter into e lease, sale or loan agreement or similar agreement setisfying the requirements of the Act (the "Revenue Agreement") with the Borrower. Danielson Public Warks Director SUBJECT: Cherry Hilis Drainage Prablem Job No. 8425 Improvement No. 84, Project No. S DISCUSSIONz At the August 6th City Council meeting, Council me� with residents from Cherry Hi11s 2nd Addition to again discuss their drainage problem. Staff and the residents had came to an agreement an a proposed scheme to correct Cheir problem. Council agreed with the new construction scheme however funding o� the work was still unresolved. Council directed that staff study using park funds to complete the work this year. Staff presented the proposal'ta �he Park and Recreation Commission at their August 13th meeting. The Park and itecreation Commission recommended against any park related expenditure or construction on this site until after their park study is compleGed. (Barton-Aschman Study) Also at the Iast Council meeting esta.mated costs far the work were given only as a lump sum figure and tlzere were some questions as to the amoun�. I have therefore included a breakdown as an attachment to this memo. You will no�ice that well over hal� the cos�.s are for engineering �ees and easement acquisitian. Engineering has been studying the problem off and on since August 1984 and the costs have mounted up. ALTERNATIVES: 2. IJTILIZE PARK FUNDS Znitial contact has been made wi�h the Wachtler's on purchase of their l.and for a park and the Wachtler's were amendable to the sale, hqwever appraisals are being gregared now and no purchase agreements have been discussed. I� seems to staff that park negotiation should be farther along before the City attempts to make an agreement with the WachCler's on re- grading. This alternative advises delaying the work until 19$6. The park study will have been completed and the results of the bond re�erendum known. Storm water caming from the Cherry Hi1.ls Addition wa.11 have to be dealt with for park constructian anyway. As a temporary measure the Wachtler's may allow a small berm to be instalied by the vacant lot {Lat 5} to farce the water across the vacant lot and down Cherry Hills Road (see map). � 2. INITIATE PUBLIC IMPROVEMENT PROJECT Proceed with a public improvement storm water project and assess the costs to the area in Cherry Hills lst Addition that contributes runoff. Danielson, Public Works Director SUBJECT: 671 Apache Lane - Sewer Problem DISCUSSION On July 9th, Gail Penning contacted me stating that he� sewer was plugged up. She had hired a sewer cleaner to open the pipe and he told her that the problem was a broken pipe in the City-installed portion of the service lead, This is not an uncommon complaint and in the past the problem has usually been within the resident's installed portion of pipe; typically at the point of connection. I told her to have her plumber come out and correct the problem and that the City would inspect the work to determine who was at fault. The line was dug and an obstruction was moved with a rod to allow the sewer to flow. The actual location where the ob- struction was located was never uncovered. After that work was completed, Mr. Willroth, of the same address, sent the attached letter requesting that the City participate in his costs because the obstruction appeared to be in the City's portion of line. On August 2, the City was again notif ied that the line was plugged. This time Ms. Penning stated.that she expected to have the City open the line. Staff made arrangements to have the line opened and the problem corrected. That was done on August 9th, and it was discovered during that operation that there were two four inch plus sized rocks.lodged in the City constructed portion of the line. It is not absolutely conclusive, but still fairly reasonable, to expect that those rocks were put there at the time of the City's construction. �� Costs incurred to date are: Homeowner: $1,740 City: 750 (estimated) RECOMMENDED ACTION City staff recommends that the homeowner be reimbursed for costs incurred. Plaza Drive Mendota Heights, MN 55120 Dear Mr. Danielson: Per our telephone conversation of this morning, to recap the events that took place last week at our new residence located at 6'71 Apache Lane. We moved into the new house (house was just built) on July 2, 1985• � During July 4th through the �th, the house was empty as we were on vacation. On the morning of July 9th, we found approximately 1 to 2 inches of water throughout most of the basement. The water started backing up through the floor drain. I notified my plumber who put in the system. He came over that evening with a company who specializes in cleaning out plugged sewers. The man tried for approximately two hours with this machine that has various fittings to unplug the sewer. The last attempt was made with some type of fitting that had special teeth on it. This came back out with the teeth chewed off. He in- dicated that the pipe must be broke or he would have been able to un- plug it. ' On July 9th, Gail Penning, my fiance, contacted you to determine what could be done. You indicated that it was up to the home owner to re- solve the situation and if the pipe was broken on the city side, the city would be responsible for the cost. On July 1$th, I lined up Rauch Water Excavating to start digging up the sewer. We were able to deter- mine that there was no break up to the city's line. (This can be veri- fied by Tom Knuth and Tom Olund, who were present throughout the digging process.) Where my plumber hooked up to the city pipe, we took this apart and ran another snake. At approximately 10 feet into the city pipe, something was hit and it broke free, ap.ening the. s_ewer. We. c.on.tinued digging_ into_ the next day, July 16th, and dug up to within 5 to 6 feet of the city street and found no breaks in the pipe. We were going to continue dig- ging however, we hit a spring or whatever (ground water Tom Olund said) and it was impossible to continue with the mud and cave ins. Copies of the bills that I have received to date are attached. The ex- cavator has not sent his yet, however, I am estimating it at this time to be in the neighborhood of $700.00. Mr. Danielson, as we discussed on the phone, I can't really see how a family of three with three days of living time in a house could have plugged up the sewer to the point that it was. I am of the opinion that something was plugging this sewer prior to our hook up to your sewer pipe. � a I would greatly appreciate your assistance in this matter, Jim, and giving this information to the proper individuals for some type of favorable response. Danielson Public Works Director SUBJECT: Watermain Extension Mendota Heights Road East of Trunk Highway 149 Job No. 8317B Improvement No. 83, Project No. 7B DISCUSSION: Mr. and Mrs. Gangl, 2487 Dodd Road�, attended the August 6th City Coun- cil meeting to discuss making a private service connection to the trunk watermain located in front of their home. That line was installed by Mn/DOT in 1984 at the City's request. Staff and the City Council felt at that time that it would be to the City's advantage to construct this trunk watermain in conjunction with Mn/DOT's project to avoid having to disturb their con- struction at a later date. It was determined that the project would be funded by the Water Revenue Fund and private hookups could be allowed by a hookup charge or by assessments. Staff has been extra busy this past summer so no work was done to prepare an assessment roll on the project. Now, that the Gangl's need water and would prefer to pay by assessments, staff feels that we will have to fit this assessment roll in our work schedule. The City had a similar situation when a watermain was installed under I-35E along Wagon Wheel Trail. Residents adjacent to that trunk watermain construction were assessed at $18.00 per front foot. Staff feels that this cost is still a valid figure. The Gangl's at the last meeting also mentioned that the St. Paul Water hookup charge was very high ($1171.50). I checked the chart that St. Paul Water uses for charging and the figure quoted is the correct figure for the right-of-way width they have. They could reduce the cost by having their own contractor excavate the trench. That cost would be $392.50. RECOMMENDATION: Staff recommends that Council order an assessment roll be prepared and public hearing be established for 8:00 o'clock P.M., September 17; 1985. Staff will use $18.00 per front foot as the assessment rate and will recom- mend that all requested deferrments be granted. Fraze -�j City Adminis a o� � SUBJECT: Budget Detail INTRODUCTION August 15, 1985 Our budgeting format was changed rather substantially last year, from what it had been in previous years.To ensure that Council felt comfortable with the numbers that went into preparing that budget, you were provided with a rather thick and detailed document last year. Some of you had the reac.tion that you felt you had been "bludgeoned" with paper and numbers, and preferred a more abbreviated form of budget this year. The purpose of this memo is to check with you once again, before we put together the final draft budget for presen- tation at the first meeting in September. DISCUSSION Our budget is now essentially a program/service level budget, which identifies objectives and work load measures, then appropriates a budget for each department in five line items, Personal Services, Contractual Services, Commodities, Other Charges, and Capital Outlay. The f inal budget is adopted at this level of detail by Council at the first meeting in October. As an example, I have attached a copy of the budget for Road and Bridge Dept., which will be coming to you as part of the overall City budget in September. The f irst two pages of that budget (identified as forms 0-1 and 0-2 in the upper left hand corner) are all that comprise the budget as finally adopted by the Council in October. The additional six pages, comprised of forms 0-3A, 0-4, and 0-5, comprise the backup detail that goes into putting together the final numbers that appear on form 0-2. These extra forms detail the personnel costs, the contractual services, commodities and other charges, and the capital outlay. The Council would have the option to direct staff to include this backup material in the draft budget document for your review, or to leave it out. In the latter case, staff would be prepared to answer any of the detail questions you might have at our September lOth workshop session. As last year, the budget will also come to you with a rather lengthy and detailed budget message, which will highlight significant changes and policy issues in the budget, including revenue and property tax implications. RECOMMENDATION To save on the time and expense of preparing the budget document,�� as well as saving on your time in reading it, it would be my recommendation that staff prepare only the more abbreviated version for your review. Danielson Public Works Director SUBJECT: Master Park Plan Job No. 8515 DISCUSSION: The City has been in contact with the Wachtler's who own a 26+ acre . site that the City has designated as park land. The Wachtler's indicated that they were intending to sell the site as soon as possible but that they were amenable to holding it for the City until Spring of 1986 so that a bond referendum could be completed to pay for it. In the meantime we can be working with them on a purchase price and option. The Park and Recreation Commission feels that the Master Park Plan needs to be updated as a first step in preparing a bond referendum, and recommended to City Council last meeting that a consultant be hired to complete the work. The Council agreed with the Commission and directed that ;;, several firms be interviewed. The Commission met August 13th and decided on recommending Barton-Aschman Associates. (See attached proposal) RECOMMENDATION: • The Park and Recreation Commission recommends that the City Council `I hire Barton-Aschman Associates to update the City's Comprehensive Park Plan. The funding for this work to be paid for out of the Park Fund (Estimate costs: $21,300 -$27,100, including Bond issue assistance). Adjusting the appraisal to reflect this would raise the total value to about $425,000, using the County Assess�r values for the house. Mayor Lockwood HEIGHTS public hearing Associates £or variance. � Page No. 2324 August 20, 1985 opened the meeting £or the purpose of on an application from Mendota Heights rezoning, conditional use permit and Mr. Tim Erkkila, of Westwood Planning und Engineering. { reviewed the applications £or rezoning o£ the James Riley property located on the south side of Mendota Heights Road from R-lA to multiple dwelling and £or conditional use permit £or planned unit development. He stated that the developer proposes to construct an apartment pro�ect consisting of 592 units on the 69.7 acre parcel, a denaity o£ 8.5 units per acre. He alac stated that the applicant requests approval of a variance £rom the parking requirement to allow 2.08 stalls per unit. Mr. Erkilla pointed aut that the site falls entirely within airport noise zone 4, the guidelines £or which discourage single family development, and the aite is also a£fected by I-494. He then reviewed preliminary planned unit development .drawings showing proposed building locations, roadway; and landscaping. He distributed and reviewed a report - he prepared regarding social and economic impacts for the proposed Mendota Highlands development. Mr. Erkilla informed the Council that in the process a developing the preliminary plan, the developer has contacted as many immediate neighbors as possible to discuss the plan with them. The Council acknowledged letters from Dr. F.M. Owens, 2455 Delaware Avenue, and Mr. Dale Glewwe, 720 Mendote Heights Road, in aupport o£ the proposed development. Mayor Lockwood asked £or questions and comments from the audience. Mr. Raymond Kane, 2579 Deiaware, asked how many vehicles the development will generate. Mr. Riley responded that he anticipates 700 vehicles and also anticipates that the ma�ority o£ the development's traffic would use Dodd Road rather than Delaware. , Councilmember Witt cited the recreation portion of Mr `' Erkkila's report, particularly the re£erence to the park portion of the Comprehenaive Plan. She in£ormed Mr. Erkkila that the Park Commission has recommended preparation o£ an update to the Comprehensive Park Plan and that the updated plan could be qui.te different £rom the existing one. Mr. William King, 2365 Delawsre, asked when the fi.=al report will be completed. � Page No. 2325 August 20, 1985 Mrs. Michael Kennedy, 2567 Delaware, stated that proposed building 6 would be directly behind her property. She commented that when they bought their property they did so because of the rural nature of the area and she observed that at two people per unit there would be about 1,200 people living behind them. She asked what the advantage o£ multiple density woul� be over single family and stated that there are lots o£ beautiful homes built near £reeways. Mrs. Kennedy atated that she has not been contacted by the developers since before the Planning Commisaion hearing and that at the time she was contacted she auggeated that if the developer wanted to construct apartments perhaps he ahould buy their five acres alsc so that the total property could be so developed. Mr. Riley asked for Council agproval of the applications, either Alternate A or B, or that the Planning Commission be given some direction in the matter. Councilmember Blesener stated that her primary concer� is over the rental aspect. She felt that a 1000- person rental community would be community unto itsel: with no £eelin� o£ the larger community or any City involv�ment: th�r� wr�uld be na �,ridc of r�wncrahi�,. She atated that the £act that the pro�ect will supposedly be very high quality does not change her concern, it will still be a transient population. and she cannot support 600 rental units on the sub�ect property. Councilmember Cummins agreed, stating that Council ha: spent conaiderable time in the last several months on long range planning on what it would like the community to look like 20 years £rom now and that the proposal does not meet his standards on how the property should be developed. He felt that the proposed density is too grest and the rental rates ar� too low, and indicated that he would be prepared to move to re�ect the application this evening. ` Mr. Riley stated that he does not see the development's population as being transient: he has been asked and given three-years leases £or units in Lexington Heights. He also suggested that many of thc development's residents will probably ultimately purchase homes in Mendota Heights. Wi�th reference to the rental rates, he responded that at 5500 to 5700 per month he is proposing some of the higheat rental rates in the Twin City area. With regard to denaity, he stated that the proposal is about hal£ as denae as normal apartment pro�ects. He informed the Council � Page No. 2326 August 20, 1985 that the topography o£ the land does not lend itself to single family development and that siting o£ a single family development ad�acent to the freeway end directly across from 350 acres of commercially zoned property in Eagan would not be reasonable. ( •Councilmember Blesener asked how the airport noise impacts neighboring properties. She stated that ahe has a great concern over noiae impact and people buying lots to build on, then diacovering there is an airport noise problem and coming before the Council in groupa to complain about the noise. Mrs. King stated that the noise is not horrible although guests occasionally ob�ect to it.. Mr. Kane stated that his family does su£fer from the noiae, both outside and inside the home, and that he did not feel people would be willing to spend 5300,000 for a home in the area, both because o£ the airport noise and the freeway noise which he suggested will be very bad. Mr. Dale Glewwe stated that his family experiences signi£icant noise problems. He stated that the C.i has paid a great deal for the planning study and 3,� what he has seen of the dra£t it looks £avorable towards multiple dwelling development. He asked whether, i£ the proposal is denied as suggested by Councilmember Cummins, Council will then spend more money to study other potential uses. He asked whethe� Council is committed to coming up with a solution for the land use question and for the land owners, and stated that the land owners need a solution. Councilmember Cummins asked what sgreement has been reached with the Owens and King families. Mr. Riley responded that he has reviewed his proposal with them and that they agree with the proposal. He also statec that he would ultimately like to develop the entire area, including the Owens and King properties. In response to Mr. McCauley's presentation, Mayor Lockwood stated that Mr. McCauley has given Council � reasons why it would be best to buy a system and leav< the LOGIS system: better costs plus data access and more control. Councilmember Witt stated that the Cit� is at the point where it should either expand its LOGIS uses or invest in an in-house system and felt that it would be better to invest in an in-house system. l Mr. McCauley informed the Council that he and staf£ are developing an implementation plan which will be a companion to the needs assessment. In response to a question from Councilmember Cummins, Public Works Director Danielson stated that he has no� yet talked to the Wachtlers but that i£ a free easement ia granted, the temporary berm could be constructed by the Public Works crew and the cost could be financed as a general operating expense in the public works budget. Mr. Adolphus Gaddy,1387 Farmdale Road, stated that thE problem has been diacuased £or a year and that a berm and park property stopping water ia what is being discusaed. He asked why the Council dozs not considei blocking the culvert on Wachtler es was discussed in pest meetings. Responding to a question from Council- memb�r Blesener, Mr. Danielson stated that such an alternative would work - the water would be forced Page No. 2328 August 20, 1985 down the east side of Wachtler. His pre£erence, however, would be to handle the water as is currently recommended: financing the alternative suggested by Mr. Gaddy is a problem. Mr. Jerry Morson, 1442 Wachtler, stated that he has � been watching the water flow in the area for 20 years nor has he seen the scheme which suggests that a berm is necessary to keep the water £rom £lowing west. He £elt thet it would take very little ditching through Lot 5 to drain the water the way it should drain and that when Lot 5 was £illed the water was dammed from flowing in its natural direction. Mr. Gaddy stated that the Cherry Hills 2nd Addition property owners have paid for atorm sewer to catch the water and the question should be what has the lst Addition done to catch their water. Mayor Lockwood stated that the same question could be asked o£ West St. Paul, a question which could not be answered in 20 years. He pointed out that water flow: downhill and haa been flowing in the same direction into the Cherry Hills 2nd Addition for 50 years. He stated that the City cannot impede the natural fl� �: water and must find a way to direct the water bac� where it had been £lowing naturally. He stated that where the City had to rip-rap the whole Ivy Falls Creek to control the Weat St. Faul water, he believee the City should find a way to correct this problem on Lot 5 and carry the water to Cherry Hill Road and Farmdale Road. He suggested that Council should authorize the berm being done i£ the Wachtlers give permission, that progress reports on the effectivenes: of the berm be made to Council, and that a long-term solution be delayed until the park study and referendum results are available. Councilmember Witt moved to authorize installation of a berm on the Wachtler property and a ditch on Lot 5 as a temporary solution, that construction be done by City £orces and that the costs be identi£ied. He has submitted the attached drawing and Alpha , Environments have paid the fee for a rezoning and preliminary plat. As of this date, no one has officially made application far the abave requests. �� REZONING The Gould property is presently zoned B-lA, which pravides for a minimum of a five acre lot size. Because of the canfiguration af the land, the divisian under the B-lA zoning would be difficult. Mr. Lee is proposing to rezone the land to B-1, which provides f ar similar permitted uses but only requires 15,000 square feet af lot area. M � In as much as an application has riot been made yet, nor have many of the documents required by ordinance been submitted, staff can not do a comprehensive review of his request. • 4. _� �� PRELIMINARY PLAT Mr. Lee's proposal contains mast of' the infarmation required for staff review of a preliminary plat.
