SUBJECT: Ivy Hill Planned Unit Development Amendment
DISCUSSION:
Clapp-Thomssen recently received permission from the City to plat Lot H of
the original Ivy Hill Addition into four buildable lots. Richard Bjorkland is
presently constructing townhomes on them. At the time of platting, Clapp-
Thomssen had negotiations with the neighbors immediately to the south about how
the open space between them would be handled. Those existing townhouses are only
1-2 feet from the lot line and their owners were concerned about the space. It
was decided at that time that the new townhouses would either join the existing
townhomes association or would transfer a strip of land to them to provide for a
buffer zone. The new townhouses did not join the existing association, so a
transfer of land is now taking place. They are proposing to transfer a fifty
foot strip (except near Ivy Hill Drive where some new guest parking spaces are
being constructed). The transferred land will be used for open space only, no
construction will occur on it.
RECOMMENDATION:
Staff recommends that this request be processed as a minor amendment to the
Planned Unit Development plan under Ordinance 401, Section 19.10(1). Under that
section Council may authorize such a change.
ACTION REQUIRED:
If Council wishes to implement the staff recommendation it should pass a
motion adopting Resolution No. 85- , Approving The Lot Division Of Lot S,
Block 1, Clapp-Thomssen ivy Hill 2nd.

WHEREAS, Clapp-Thomssen Company owner of Lot 5, Block 1, Clapp-Thomssen ivy
Hill 2nd, Section 13, Townshi.p 28 North, Range 23 West, Dakota County, Minnesota,
has requested from the City to divide that lot according to Certificate of Survey
prepared by Kurth Surveying, Inc., dated June 17, 1985; and
WHEREAS, the City Council has reviewed said lot division and finds the same
to be in order.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota that the lot division submitted at this meeting be and
the same is hereby approved.

PARK AND RECREATION COMMISSION
MINUTES
July 9, 1985
The regular meeting of the Park and Recreation Commission was called to order
by Chairperson Stein at 7:35 P.M. The following members were present: Stein,
Singer, Doffing, Leffert, and new member Carol Damberg. Absent were: Schneeman
and Knittig. Also present were Jim Danielson, Public Works Director, Dewey
Selander, Recreation Director and Liz Witt, Councilmember.
APPROVAL OF Minutes of the June llth meeting were approved with one
MINUTES change - newly appointed member Carol Damberg was absent.
COMPREHENSIVE Councilmember Liz Witt presented a plan to hire park planner
PARK STUDY David A. Kirscht Associates for a fee of $23,400 to update
the City's master park system plan. The fee would also
include preparation of schematic plans for two proposed site
acquisitions (see letter #1). After a great deal of discussion,
a motion was made by Robert Leffert to recommend to the City
Council the concept only of hiring a park planner using park
monies to satisfy the fees incurred. Alan Singer seconded the
motion. Upon vote, motion passed unanimously.

PARK SURVEY Discussion was held concerning the recent park survey. The
survey indicated that bike/walking trails are the most impor-
tant area of improvement sought by those who returned the
survey. Chairperson Stein also asked that the secretary
record in the minutes that basketball courts and volleyball
courts also were high on the list of improvements and that the
City Council consider funding these two improvements (see recent
park and recreation survey responses, June 1985 -��2).
CITY HALL COMMITTEE Chairperson Stein was asked by City Administrator Frazell to
request volunteers from the Park and Recreation Commission for
membership on the City Hall Task Force Committee. Robert
Doffing and Alan Singer both volunteered to serve on this
task force.
WACHTLER MEETING A meeting with Mr. Joe Wachtler and his attorney was held
with Park Chairperson Stein and City Administrator Frazell
concerning purchase of the Wachtler property by the City of
Mendota Heights. Both the Wachtler family and the City will
have individual appraisals of the property prepared and will
continue their discussions.
BIKE TRAIL UPDATE Commissioner poffing reported on the trail breaking ceremony on
June lSth, and that the contractor has commenced construction
of the proposed bike trails.
Public Works Director Danielson received a memo from Allen Moe
(see memo 4�3) Senior Planner for Dakota County concerning the
Park and Recreation Commission Minutes, July 9, 1985 Page 2
capital improvements schedule for 1985 to 1989, regarding bike-
way construction. Mr. Danielson was asked to respond to th 1
memo in a most positive and affirmative manner. i
MAINTENANCE REPORT Question arose as to who is to maintain the ballfields at
Henry Sibley High School, At present, both Mend-Eagan and
Mendota Heights Park and Rec use the fields and it is not clear
whose responsibility it is to maintain the fields.
It was also recommended to Dewey Selander to have more sand
placed around the play structures in each of the parks.
RECREATION PROGRAMS Dewey Selander reported "all is going well with recreation
programs."
COUNCIL REPRESENTATIVE Commissioner poffing volunteered to attend the July 16th Counci]
meeting and Commissioner Leffert to attend the August 6th
Council meeting. .
ADJOURN There being no further business to come before the Commission,
the meeting was adjourned.

Minutes of the Special Meeting
Held Tuesday, July 9, 1985
The special meeting of the Mendota Heights City Council was held at 7:30 o'clock
P.M. at City Hall, 750 South Plaza Drive, Mendota Heights, Minnesota.
` Mayor Lockwood called the meeting to order at 7:36 P.M. The following members
were present: Mayor Lockwood, Councilmembers Blesener, Hartmann, Cummins.
Councilmember Witt arrived at 7:50 P.M.

YORKTON DEVELOP- Mr. Larry Lee, developer, and Mr. Pat Pelstring, financial
MENT CORP. adviser, were present to discuss the Alpha Environments
project proposed for the Gould property site.
Mr. Lee said that he would be purchasing the strip of land
currently owned by Resurrection Cemetery, which would make
his total parcel approximately 46 acres. He said that the
City had approved $5 million in IDB authority for the Alpha
Environments project in the previous year.
City Finance Consultant Larry Shaughnessy indicated that Mendota
Heights has 3.165 million dollars in IDB authority, and that
Mr. Pelstring was working with Washington County HRA to obtain
the additional authorizatiorwlauthority. He indicated that to
satisfy federal law, the Council would need to hold a public
hearing on the increase in the total IDB authority above the
$5 million that ha d previously been approved.
Mr. Lee explained that his Conference Center would be operated
by Alpha Environments Inc., which is headed up by Mr. Steve
Musado.. M.�.. Lee sa.id. th.at h_e and h.is. par-tner-s- wou-].d. be both
owners of the building, and part-owners of ttie business itself.
Mr. Pelstring said that he was confident that Mendota Heights
could get the necessary IDB application authority from Washington
County. He then explained their proposal whereby the City's tax
increment district would up front the money for all of the
utilities to the site, as well as site development costs in
the total amount of approximately $850,000. Their proposal is
that half or $425,000, would be a direct write down subsidy from
the tax increment district, and that the other �425,000 would be
repaid by the developer to the City over a 10 year period at 87
interest. Mr. Pelstring said that this would provide a cash
flow back to the City of $60 -$63,000 per year, and that there
were statutorially no limit on the use of these funds. They
would be available for use at Council discretion. He said that
under law there are two ways to recoup those monies. First, to
special assess the developer for the $425,000 of improvements,
but the special assessment payments come to the City as general
revenue, rather than repayment of special assessment bonds which
are taken care of by the tax increment district.

The second option is a payment in lieu of taxes made by the
developer to the City. Mr. Pelstring said that the proposal
was of interest to the developer because the entire tax increment
amount is considered an equity position in the project, and enab�l�
the developer to leverage a larger loan.
Financial Advisor Shaughnessy said that the Yorkton proposal was
a departure from our past use of tax increment financing.�
Historically, the City has used tax increment financing to under-
write the unusual utility cost associated with development of a
particular site, but that the City gets none of that back in
terms of a repaid loan, except its allowable administrative cost
for the tax increment district. He said that it appeared the
utility assessments on this project would be approximately twice
that on a normal piece of developable property, so our past
practice would be to underwrite those extraordinary costs.
Mr. Shaughnessy also said that in his estimation, the annual tax
payments from the project to the City would be in the range of
$120,000, as opposed to the $300,000 Mr. Pelstring had suggested.
Mr. Lee explained that he was also going to be building a"high-
tech" office building on this site of 40,000 square feet, which
would be a lab/research type facility. He said that they hoped
to have the Alpha Environments Conference Center operational in
a year.
Mr. Shaughnessy said that we will know by next Wednesday whether
or not we will get our IDB allocation request from Washington
County HRA, and that the Council should probably act at its
meeting of July 16 to call a public hearing for the next meeting
to increase the IDB authority from $5 to $6 million dollars.
Mr. Lee said that he also has two hospitals that are`interested
in putting satellite medical clinics on the property, Health
Resources Inc., and the Baptist Hospital Fund. He indicated
that either would build a general services type clinic with OB/
gyn, internists, etc.
Mr. Lee said that he is proposing to serve the property with a
100 foot divided boulevard coming directly off TH 110, then
circling back east to Lexington. He said that he would be
platting the one lot for the Alpha Environments Center, and then
showing the rest as outlot in his preliminary plat. Ultimately,
he hopes to have six buildings on the currently owned site, and
a potential for four more on the property currently owned by
Resurrection. He said that he was thinking in terms of one of
these being a 10 story office building, and envisioned that there
would ultimately be approximately 600,000 square feet of finishe�
space on the property.
There was a concensus of the Council to take action at the Ji
16 meeting to call for the public hearing on IDB authority.

PROPOSED SEWER Public Works Director Danielson explained the way that sewage
RATE INCREASES from Mendota Heights flows under the Mississippi River through
three pipes, and into the MWCC system. He explained that the
MWCC had traditionally only thought one of the pipes was
carrying any significant amount of flow, but upon beginning to
meter a second pipe in 1984, they found that the flow going into
that line was quite substantial.
Mayor Lockwood said that he thought the community may have a
real problem with people who have sump pumps and drain tiles
going directly into ehe sanitary sewer system.
Mr. Danielson said that the MWCC figures show that we are getting
an inflow/infiltration of almost 1007 of water consumption.
The I/I study done earlier by the City indicated that it was aboui
507. He said that staff was beginning to be suspicious that we
just simply liave a lot of little holes in inflow rather than one
big hole.
Financial Consultant Shaughnessy then discussed the implications
for sewer billings. He said that the City had held its sewer
rate constant for the past several years, and that those revenues
had been able to cover the M[dCC bill, plus have $125,000 for
maintenance. However, he said that in 1986, the City's MWCC
bill would go from $266,000 to $456,000, including a$36,000
debit for excess flows that were metered in the last half of
1984. In 1987, he s��id that the City would be picking up ful.l
flow deficit for 1985 and would be looking at an MWCC bill of
approximately $520,000, minus some unknown credit due to under-
expenditure by the MWCC. �
He said that the current rate structure would raise approximatel�-
$320,000 in 1986. He also said that by increasing sewer revenues
30� in the third quarter of T985, and continuing through 1986,
we would raise a total of $148,000 additional revenue for a total
or $468,000 for payment of the 1986 MWCC bill. He said that an
additional 15� would likely be needed in the last quarter of 1986
to meet the 1987 MWCC bill.
Mr. Shaughnessy said that if the Council wished to take action
similar to that recommended by staff, itwould have to adopt an
ordinance the last meeting in August in order to put in in
effect for the third quarter billings.
Mr. Shaughnessy then gave a presentation of current and proposed
Mendota Heights sewer rates compared to those of other surroundins
communities. He then presented three optional ways of structur-
ing the increased sewer revenues, ranging from a percent incre<ise
on all levels of useage, to one that keeps the minimum for small
users at basically existing levels, but increases the flow ch�rge
beyond that point.
Mayor Lockwood said that he felt the City had been penalizing
the small users for several years, and that maybe as a part of
our rate restructuring, there s ould actually be a decrease for

Other Council members, however, felt that in the face of an
emergency problem and very sizeable sewer increase, everyone
should have to pay a little of the burden, and that it would
not be a time to be looking at reducing rates for some categories
of users.
Generally, there was a concensus to leave the minimum quarterly
charge at its current $20.00, then step up the rates from there
� to create the necessary extra revenues.
Staff was directed to prepare a presentation on the problem for
the public and press at the July 16th Council meeting, and to
lay out some options for Council. It was agreed that Council
would then plan to try to take action by the second meeting in
August.

Councilmember Blesener moved that the meeting be adjourned.

DISCUSSION:
A bid opening was conducted at 9:15 A.M, on July 10, 1985, to receive bids
for the Tuminelly's Hunter Lane Addition utility project. There were seven plan
holders but only two bidders. The low bid was well below the $12,000 Engineer's
Estimate. (See attached Resolution) The low bidder has done �aork for the City
before and we were satisfied with the results.
REC0�IMENDATION :
Staff recommends that Ro-So Contracting, Inc. be awarded the Tuminelly's
Hunter Lane Addition utility contract for their bid amount of $9,515.00

SUBJECT: Deck Permit for 1830 Eagle Ridge Drive, Unit 1006
DISCUSSION
Robert Koles of Minnehaha Falls Nursery has made application on behalf of
Harry Collin, owner of Unit 1006 at the Eagle Point condo building. As Council
may recall, Eagle Point Condo was approved under the PUD section of our zoning
ordinance. At the time of final approval, staff was not aware that decks might
be proposed for first floor occupants. Under Section 19.10, Amendments of Final
Development Plan, minor changes may be authorized by City Council. Staff feels
that a deck addition would fit under the above mentioned ordinance section.
RECOMMENDATION
Staff would recommend City Council approve the minor change of adding a deck for
Unit 1006, subject to the Eagle Point Association being in agreement with the
construction of the proposed deck, plans and specifications being submitted for staff
review and the contractor meeting City license requirements.
ACTION REQUIRED
If Council wisfies to implement the staff recommendation to approve the deck
permit as requested, it should pass a motion approving the requested permit.

The Evergreen Knoll project (Gryc) has been completed and enough of the
costs are now knownfor staff to prepare an assessment roll. An assessment
hearing has to be conducted no later than the August 20th City Council
meeting in order for the roll to be certified at the County in October. (If
we do not meet this deadline we will not be able to certify until 1986)
The originally estimated per lot assessment for the project was
$14,000. The contract for the work came in at S-6 percent over the estimate
however the developer requested the City accept the bid and proceed. We
then had the "wall" problem along Wachtler and Wentworth Avenues and that
increased the costs slightly. We have told Jim Gryc, the developer, that
the final per lot assessment would not be over $15,000 and we are confident
it will not.
RECOMMENDATION:
Staff recommends that Council order the preparation of an assessment
roll and set the required public hearing for August 20, 1985 at 7:45 P.M.
ACTION REQUIRED:
If Council wishes to implement the staff recommendation it should pass
a motion adopting Resolution No. 85- , Resolution Ordering The Prepara-

WHEREAS, contracts have heretofore been let for the construction of the
following described improvement:
The construction of sanitary sewer, storm sewer, water, street,
curb and gutter improvements to serve Evergreen Knoll and adjacent
areas (which improvements have heretofore been known and desig-
nated as Improvement No. 83, Project No. 4).
and
WHEREAS, the construction of said improvements has been substantially
completed.
NOT THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights as follows:

DISCUSSION
At City Council's direction, the Planning Co�nission has reconsidered a revised
Kurtz subdivision. They have reversed their previous recommendation and now
recommend approval of the revised plan, subject to ttie foll`owing conditions:
1. That no future setback variances be applied for.
2. Tl}at the surrounding property owners be notf ied of the time and date that
the matter is to be reconsidered by the City Council. (Staff sent notices
on July 11, 1985).
3. That the driveway and easement locations be addressed by the applicant.
Subject to any approvals, a park dedication and utility hookup costs will be due
on the new lot:
l. Park contribution would be $600.
2. Because the original lot was assessed as a standard 100 foot frontage lot,
utility hookup costs for this new lot will be calculated and due at the
time utilities are needed.
ACTION REQUIRED
Consideration should be given to hearing comments from any affected neighbors
who attend.. The Council then needs to consider comments from the Planning Commission,
audience, and other Councilmembers, and act on the preliminary plat application.
A motion is all that is required if approval is made. A resolution that states
reasons for denial should be prepared if that is Council's decision.

DISCUSSION:
Attached is a letter from Rob Meyer, Y399 Clement reqnesting that some
new s.top and yield signs be placed in his neighborhood. I have spoken
briefly with Chief Delmont about this request and he reports that, although
there may have been some close calls, there is no record of accidents. The
Chief and I both recognize the unusual street layout may cause some problems
at lst Avenue and Clement and also that Emerson should be consideredfor a
through street. (Stops at all entering streets)
RECONI�IENDATION :
Staff recommends that Council direct staff to complete a comprehensive
study of traffic control in the lst Avenue, Emerson neigt-iborhood. That
report could be completed for a September Council meeting.
ACTION REQUIRED:
There is no official action required at this time. If Council agrees
with the staff recommendation they should direct that the study be prepared.

I a,m writing to request a change in traffic signage in the�
Iv� F�.11s �.rea. Specifically, changing the existing "YIELD" signs
at 1st & Clement and Medora & Emerson to "STOP" signs and adding a
"YILZD" sign at 1st & Clement, facing east on 1st.
The purpese of the signs would be to increase the safety of
the area by reducing speeds and providing more control and
direction for motorists. A secondary purpose is to discourage the
"shortcut" effect from Hwy 13 to Dodd Road.
In talking with the neighbors, it appears that both the
amount and type of traffic have changed since the original "YIELD"
si�ns were erected. Some of the factors contributing to higher
volume of traffic ir�clude:
1. Recer.t placement of a. stop sign at the Wachtler/Wentworth
intersection �

I understand some type of study or traffic survey is usually
done to determine if a stop sign is necessary. While this will
determine the number of vehicles, there are several qualitative

1. Volune of Pe�estrian traffic.
There is a significant amount of foot, bicycle and
tricycle traffic using the roadways in this area. In
addition, both Clement & Medora are utilized by kids of �
all ages for ball games and other play.

exceed the speed limit on the long stretches of road

Tre intersection at P�edora & Emerson is no longer as
"open" as it once wa� due to a new house.
5. Poorly designed intersection.
The intersection at 1st & Clement is particularily
unwieldly due to the jog at the corner. I have
tiitnessed several near miss collisions and been involved
in one.
Since I am unfamiliar with the process a request like this

SUBJECT: Fire Service Contracts
HISTORY
For several years, the City has billed our service area of Sunfish Lake, Lily-
dale and Mendota for fire service based on a formula which included the frequency
of service and the taxable assessed value applied against the actual operating
expenses and depreciation component from two years previous.
At least two items in the formula might be considered for change:
l. Use of market value in place of taxable value. (The use of taxable value
is not necessarily a true index of the loss sustained by fire). This would
drop the Mendota Heights percent from 87.397 to 86.16� and spread about
$1,200 against the other contract cities.
2. Adjust actual operating expenses from two years previous (i.e., 1984) by
adding the budgeted increase of the department for the current year
(i.e., 1985). This figure would then be adjusted to actual in the future.
In view of the rather rapid increase the past couple of years in fire expenses,
this brings the service billing a bit more in line with current expenses. If
this was applied to 1986 billings, ttie service area would be billed an
additional $900.
Current service contracts for 1985 total $19,509. Based on the existing formula,
they would total about $22,441 in 1986. If the changes are made, the total would
be about $24,550.
ACTION REQUIRED
Advise staff of Council preference as to billing service contract area. We
will then negotiate with the concerned communities regarding 1986 billings.

DISCUSSION:
A bid opening was conducted at 9:00 A.M, on July 10, 1985 to receive
bids for the Andersen/Curley Utility Project. There were seven planholders
but only two bidders, Ceca Utilities of Burnsville for $17,493 and Ro-So
Contracting, Inc. of Centerville for $18,429. (The Engineer's Estimate was
$12,000) The low bid of $17,493 is $5493 over the Engineer's Estimate.
Staff recommends that Council reject all bids and, because the contract is
still estimated to be less than $15,000, authorize staff to work with
interested contractors to negotiate an acceptable bid. Staff will be
contacting all bidders and planholders between now and the Council meeting
date to try and have some new proposals for your review. I have contacted
Mr. Andersen and he still wants the project to go if we can negotiate a more
reasonable price. Mr. Curley is out of town until July 16th.
RECONII�IENDATION :
Staff recommends that all bids be rejected and that staff be authorized
to negotiate with interested contractors to secure a more reasonable bid.
ACTION REQUIRED:
If Council wishes to implement the staff recommendation they should

Earlier in the year, some of you had raised the question o� Council salaries.
As we informed you at that time, state statute stipulates that any inerease in
Council sal.aries cannat take effeet until aftex the next electian (November, 198b).
However, I indicated that when•we got th.e an,nual elected officials salary survey
from the Associatian of Metrapali.tan. Municipalities, I would pass it on.
Attached is a copy of that page oi the survey for cities with papulations �rom
7i500 to 10,000. In setting staff salaries, we have established a practice of
comparing ourselves ta those cities between 5,000 to 10,000 in the meCro area.
I have taken the liberty of underlining in the survey thase eommunities which fall
within this population group, and ai.so have �wo regular Cauncil meetings per month
as do we,
0� the underlined graup, the average salary for mayor is $2,883, and far a council-
mernber, $2,13$. This is as compared Co the $2,400 for Mayar and $1,800 for Council-
member in Mendota Heights.
Council could take action this year to amend future Council salaries. However,
as indicated above, the change would noC take effect unCil a€ter the November election
in 19$b.

On May 2, Kevin, Jim and I met with the MWCC to determine the extent
of our sewer flow problems, what corrective actions the City might take, and
how future billings might be affected. The scope of the problem seems to be
much greater than we had expected. Actual sewer meter readings are running at
clos e to 600M gallons per year. However for 1984, the actual billing, as
adjusted, will be for 516M gallons, with 520M gallons for 1985. To show the
scope of the problem our 1984 metered water consumption was about 330M gallons.
The MWCC has indicated that for 1985 there will be about an 87 overall
credit in 1987 for budget underruns and volume reductions. These will apply
against our 1987 billing. In all of my figures and comparisons, we have
eliminated the credits we receive for the sale of the Mendota Sewer trunk.
These amount to $35,000 a year, with $10,000 applied to Trunk Sewer Debt and
$25,000 to Utility Reserve.
The following tat�le outlines the past two year sewer billings from MWCC,
with our best estimates for the next three years.

As you can see from the comparisons, the rates in Mendota Heights rate with
the lowest. Our minimum provides for a rather large minimum useage. In view of
the rather large projected increase, it might be advisable to consider a lesser
percentage increase for our smaller users and reduce the volume at the minimal
billing level. This would, to some extent, aid senior citizens. At this time,
the following is a distribution of our user billings:

21-29/100 cu. ft. 307 or 675 customers

CORRECTIVE ACTIONS

Steps are currently being talcen by the sewer and engineering departments
ta try to identify the unusual inflow to the sewer system. The current voiume
far exceeds Chat identified a.n the inflow study. As results are discavered,
we will be reporting and suggesting any possible correcCive actions ta the
Council. One major source of the high volume could be �he raof drains andjor
sump pumps that c�nnect to the �ewer. Consideration cauld be given to a surcharge
to Chose residents sa connected if they can be identified.
STAGE ACTION:
1. Adopt resalution to increase rates appraximately 307, effective
3rd quarter 1985. (Octaber lst billing).
2. April, 19$6, determine actual 1985 increase from MWCC. Determine
need for 19$7.
3. Based on present information, an additional increase of abaut 15%
will be needed in 3rd or 4th quarter, 19$6.
An addi:tional effect w311 be an increased tax levy frorn $50,000 to $60,000
or $65,OQ0 for MWGC debt service to pravide adequate revenue to sewer department
for utility maintenance.
ACTION REQUIRED:
Ta effect an increase in the 3rd quarter oi 1985, a determination of rates should
be made by the second meeting in August. I wauld suggest �hat staff be directed to
study the effect of ane ar twa of the alternative rate methods and propose a new
resolution at the August 6th meeting.

4ur summer code enforcement intern, Paul Heimkes, has now sent out approximately
g3 letters to people with overgrawn lots, debris on their lots, etc. Many of those
Ietters have naw reached the ariginal IO day time Iine for cleaning it up. While
many people are complying, there are of course, those who are not responding, and
with whom we will have to take further fallaw-up action.
Our first step will be a personal contact to encourage their cooperation in
abating the nuisance. However, we w3.11 a].so begin to enforce th.e pravisions af
our weed and nuisance ordinanceSwhich provide remedies for those who do nat cooperate.
Under the avergrown weed ordinance, the City has the authority ta have the property
mowed, then assess the cost of that mowing as a lien against the property with the
annual property tax statement.
Dealing with junk and debris situations is•somewhat more complex, since
diff erent kinds af situatians are dealt with in numerous City ardinances, including
some police ordinances, the zoning cade, and general nuisance ordinances. However,
continued vio],ations of these situatians are generally cansidered to be misdemeanors,
subject ta penalties of up to $500 ta $700. Where we are nat getting vo2untary
cooperation, it would be our intent to turn these over to the C.ity Attorn.ey for
prosecution.
Staff intention is ta get on with enforcing our ardinances as they are written
an the books. Unless Council directs otherwise, we will proceed to do so.

During our goal setting review, we decided that the City should update its
Park System Plan in preparation for a bond referendum next Spring. As I have
previously informed you, Councilmember Witt, Park ChairStein, and I met with Mr.
David Kirscht, a landscape architect, to discuss our needs and solicit a proposal
� for services. His proposal is attached.
The Park Commission reviewed the proposal at its meeting of July 9th, and
concurred that it would be advisable to conduct such a study. They were, however,
desirous of considering a couple of other proposals.
The Commission asked that Council authorize staff to solicit proposals from
Damon Farber, another park-oriented landscape architect (who is also working with
architects Lindberg-Pierce�on the City Hall project), and from Dahlgren,Shardlow,
and Uban, Inc. The proposals of the three would then be reviewed and the principles
interviewed by Jim Danielson and me, as well as A1 Singer and Bob Doffing of the Park
Commission. It might also be appropriate to have a Council representative on the
review committee. The Committee would then make a reco�endation to Council for
appointment. ,
Because of the urgency of getting the study started to prepare for a bond
issue, the Commission is proposing a process more "speeded up" than that we might
otherwise use in selecting a consultant. The purpose of this memo is to seek Council
concurrence with that process.
COST AND FINANCIAL IMPACT
The Kirscht proposal carries of fee of $23,400 plus expenses, so it seems
reasonable to expect the costs will be in the $20 -$25,000 range. It would be
funded by the Special Park Fund. '

SUBJECT: Appraisals for Wachtler Park Property and Old Fire Station Redevelopment Site
The City needs to obtain market value appraisals for two upcoming projec�ts. -
First is the 25 acre Wachtler property site on Wachtler Avenue which has been
proposed for acquisition as a major community park. As I have previously informed
Council, Mayor Lockwood, Park Commission Chair Stein, and I have met with the
Wachtler family, who have indicated their interest in selling the property to the
City. At our luncheon meeting a few weeks ago, it was agreed that the City would
proceed to obtain a market value appraisal on the property, after wliich we would
proceed to discuss the terms and conditions under which the City might acquire the
property.
The second needed appraisal is for the buildings and land for the fire station area
redevelopment project. Those buildings are the old Mendota Heights Fire Station,
Harry Kirchner's gas station, and the store adjoining the gas station, which is also
owned by Harry Kirchner. One of the recommendations from the citizen's task force
report for the Central Commercial Area, was that these three properties should be
acquired by the City and redeveloped for a use compatible with the surrounding
residential neighborhood. This project is also identified in the City's adopted �; .

tax increment redevelopment plan. Mr. Kirchner has expressed to me his interest ';��'
and willingness in selling the properties to the City. We also need to •�;�;;�;;°'.;
obtain an appraisal on the value of the old fire station, since the tax increment �
district will be paying the City's general fund for the value of that building as
a part of the redevelopment project. . � � -'

This letter is in reply to.your request for an estimated Market Valuation of
the above–mentioned properties in Mendota Heights. Legal descriptions will
be used to further identify the properties involved in the finished repor"ts.

The appraisal will cover those items normally considered to be real e"state
but will not cover any piping, storage tanks, dispensers, handling, or
related equipment in properties ��1, ��2, and 4�4. The appraisal will cover
piping, pumps, storage tanks, and those items necessary to the operation of
the gasoline station in property 4�3. �M
The purpose of the appraisal is to estimate Market Values as defined
hereafter. The function of the appraisal is to act as an aid in City
decisions concerning acquisition or refinancing of the subject properties.
The total fee for the real estate involved will be $3,300.00 based on $60.00
per hour. Any hours fewer than 55 hours wil_1 be credited at $60.00 per hour
up to a maximum of 10 hours ($600). A separate fee up to a maximum of
$550.00 will be charged for the fixture part of �3 for piping, storage
tanks, etc. The app.raisals will consist of an original and one copy for
each property which appraisals are to be delivered within four weeks (sooner
if possible) of notification to proceed. Payment is due within 30 days of
delivery of the appraisals.

Market Value is the highest price estimated in terms of money
which the land will bring if exposed for sale in the open market
with a reasonable time allowed to find a purchaser buying with
knowledge of all the uses and purposes to which it is best
adapted and for which it�is capable of being used.
Regardless of the exact wording of the definition, Market Value contemplates
the consummation of a sale and the passing of full title from seller to
buyer by deed, under conditions whereby:
1. Buyer and seller are free of undue stimulus and are motivated
by no more than the reactions of typical owners;
2. Both parties are well informed or well advised and act
prudently each for what he considers his own best interest;
3. A reasonable time is allowed to test the market; and
4. Payment is made in cash or in accordance with financing terms
available in the community for the property type in its
locale.
The appraisal is to be made in proper narrative form and consistent with the
Code of Ethics as set forth by both the National Board of Realtors and by
the Society of Real Estate Appraisers. A portion of the above code contains
the following statement: "It is understood that the appraiser is to make
the appraisal without any predetermined value or conclusions, and that the
appraiser has no interest, present or contemplated, in the property; and
that the agpraiser's employment is not contingent upon the amount of value
reported."

Mr. and Mrs. Robert Alvarez, 1167 Dodd Road, were issued a building permit
to construct a 12'x12` play structure in their back yard. They would like
to build a roof over the play structure. That roof would exceed the 15 foot
maximum allowable height for an accessory structure in a residential zone.
Mr. Alvarez is requesting to be allowed to have his gable roof 21 feet
above average grade. Staff does not know if this 21 feet is to the ridge
of the roof or the mean distance ( a point half way between the soffit and
the ridge ). This question needs to be answered so that staff, Planning
Commission and Council can have an accurate dimension to determine what the
height variance is.
The applicant has acquired signatures of approval from three of his
neighbors.
ACTION REQUIRED
The Commission should review the requested proposal with the applicant and
make a recommendation to Council.

SUBJECT: Case 85-19, Palmer, Wetland Permit and Variance
DISCUSSION
Mr. and Mrs. Jerry Palmer are proposing to build a home at 1515 Vandal
Street. This location is a corner lot located at Vandal and 3� Avenue. 3� Avenue
is a platted but unbuilt street that has a sanitary sewer running down the center
of it. 3� Avenue has not been vacated because of the sanitary sewer line but also
has not been constructed because it leads into a wetlands. These wetlands are
owned by the Somerset 19 Condominiums and are part of their open space.
Where the Palmers are proposing to construct their home is within a City
designated wetlands area. The location, however, appears to create no problem
with the wetlands system. (Council approved a similar permit for a home on 4th and
Vandal in 1980, and there have been no problems associated with that construction.)
The Palmers also desire to construct the home 20 feet from the right-of-way
from 3� Avenue. To do this requires a 10 foot variance. Staff feels that 3� Avenue
will not be constructed because of the wetlands and can find no other reason not to
allow the 10 foot variance.
ACTION REQUIRED
Review the submitted material, discuss concerns with applicants and make a
recommendation to the City Council on the wetlands permit and variance request.

SUBJECT: Case No. 85-17, Spanjers, Preliminary Plat for Valley Curve Estates
DISCUSSION
Mr. John J. Spanjers, 1824 Valley Curve, owns 3.163 acres of
land on which his present home site exists. He proposes to divide his land into five
additional new home sites.
Staff has reviewed the proposed plat and has the following comments:
1. A public improvement project needs to be petitioned for addressing
sanitary Sewer, water, and storm sewer for the site.
2. A drainage easement needs to be shown on the plat along the creek bed.
,
3. The lot sizes are in excess of the minimum 15,000 square foot requirement.
However, because of the location of the existing dwelling, front yard
setback variances will need to be considered along Marie Avenue.
4. Wetland permits will be necessary if new homes are sited within 100
feet of the creek.
5. The lots along Marie Avenue are adjacent to the City's at-grade bridge.
That bridge was constructed because of a very deep section of peat and the home
that are proposed there would also be on suspected poor soil. Soil borings
should be taken. �
6. The five new lots created would require $3,000 in park contribution due at
the time the final plat is approved.
ACTION REQUIRED
Conduct a public hearing and based on public input and Commission members
comments, make a recommendation to the City Council on the subdivision, wetlands
permits and front yard setback variance.

DISCUSSION
Ron Ettinger, 1588 South Victoria Road, is proposing to replace an existing
worn out, rusted barbed wire f-ence with a new ced�ar split rair ferice. The pYoposed
new fence is to be located 15 feet in from his property line adjacent to Victoria
Road, starting at his north property line and going south for a distance of 1,035
feet, also 192 feet of fence will be installed to his east property line (see site
plan).
The fence is proposed to be 42 inches high. The maximum allowable fence
height adjacent to a front lot line is 30 inches, thus a minor conditional use permit
is required. The Ettinger property is adjacent to property in Lilydale and 35E,
therefore there are no affected Mendota Heights residents. Staff feels that the
public hearing requirement should be waived.
ACTION REQUIRED .
Review the proposal with the applicant and make a recommendation to the
City Council.

It appears that the maximum width shown is 242.58 feet.

leaves a building depth of 92.58 feet, which seems somewhat narrow for
a business-type building use.
7. Utility service leads ta the existing buildings are not shown on the
drawings and staff suspects they cross the new lot. Staff suggests they
be located and easements be prepared.

Because the appraisal quote gotten from Bob Hutchinson was higher than
expected, staff has obtained another quote for comparison. We asked Dan Dwyer
who is a Mendota Heights residents that lives next to Jim Stein and is an
experienced municipal land appraisor to give us that quote.
We did not get together with Dan until yesterday so there was not
enough time for him to prepare a written quote. Dan called me today with
the following:

praisor so the options to the Council are as follows:
1. Select one appraisor to do all the work either by chance (flipping
a coin) or by another method some member of the Council might have.

RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR
CONSTRUCTION OF SANITARY SEWERS AND WATER SERVICES
TO SERVE ANDERSEN/CURLEY PROPERTIES
(IMI'ROVEMENT N0. 85, PROJECT N0. 1)
WHEREAS, pursuant to a bid by direct negotiation for the proposed construction
of Sanitary Sewers and Water Services to serve Andersen/Curley Properties (which
improvements have heretofore been known and designated as Improvement No. 85,
Project No. 1, Job No. 8426), bids were received and tabulated according
to law and the following bids were received:

WHEREAS, the City Engineer recommended that the low bid submitted by Orfei &
Sons, Inc. of St. Paul, Minnesota, be accepted.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota
Heights, Minnesota, as follows:
1. That the bid of Orfei & Sons, Inc. of St. Paul, Minnesota, submitted for
the construction of the above described improvements be and the same is
hereby accepted.
2. That the Mayor and Clerk are hereby authorized and directed to
execute and deliver any and all contracts and documents necessary to
consummate the awarding of said bids.
Adopted by the City Council of the City of Mendota Heights this 16th day of July,
1985.

�, . BE IT �RESl7LVED by the City Council of the City of Mendata Heights,
Minnesota (the'"City"), as follows:
SECTION 1. ,
Recitals
1.1. Larry Lee, on behalf of a Minnesota partnership to be formed i.n which
he will be one of the general partners {the "Barrower"}, has advised this
-•�� �• � Council of the desire af the Borrower to acquire land in the City and
construet and equip thereon an spproximately 55, OOQ square foot bui�ding to be
used as an educatian and conventian facility t"p'lrojeCt"}.
_, 1.2. The City is authorized by Minnesota Statutes, Chapter 474 tthe "Act"},
to issue its revenue bonds ta finance capital projeets, such as the Project, -
which eortstitutes praperty, real and/or personal, used or useful in conneetion
with a revenue producing enterprise as contemplated by Minnesota Statutes,
Sectian 474 .02 , Subd . 2 C a) .
1,3. The City previausly granted preliminary approval of the Projeet and the
-issuance of revenue bonds therefor in an amount not exceeding $5,000,000.
, The Borrower subsequently requested that the City issue its revenue bonds in
an amount not exceeding Six Mzllion Faur Hundred Thousand and 00/I00 Dallars
(�6,400,000) to finance all or a portion of the cost of the Project.
SECTICIN 2.
Public Hearin�
2.1. Seetion 474.01, Subdivision 7B, of the Aet requires that prior to
submission of an applicatian to the Energy and Economic Development Authority
requesting approval of the Project as required by Seetion �74.01, Subdivisian
7A, of the Act, this Council shall conduct a public hearing an the praposal to
undertake and finance the Projeet. Pursuant to that provision, a publie
hearing on the proposal to underta.ke and finance the Projeet is called and
shall be held on August 20, 1985, at ?.30 a'elc�ek P.M. at the City Hall, 754
South Plaza Drive, Mendota Heights, Minnesota.

in the official newspaper of the City and in a newspaper of general circulation

NOTICE IS HEREBY GIVEN that the City Coiuneil of the City of Mendota
Heights, Minnesota, wi11 meet an August 20, 1985, at ?:30 o'c2ock_. P.,M. �,. at the
City Hall, 750 South Plaza Drive, Mendata Heights, Minnesota� for the purpase
of condueting a publie heering on a proposal that the City issue revenue
bonds, in one or more series, under the Municipal Industrial Development Act,
Minnesota Statutes, Chapter 474, as amended, in order to finanee the cost of a
project. The proposed project will consist of the acquisition of land and the
construetion and equipping thereon by a Minnesota partnership to be formed in
which Larry Lee will be one of the general gartners, of an appraximately
55,000 square foot building to be used as an educational and convention
facility. The Project will be loeated in the City af Mendota Heights,
Minnesota, an Highway 110 an the real property legally described as the
Southeast 114 of Seetion 27, Township 28N, Range 23, Dakota County,
Minnesota. The estimated total amount of the proposed bond issue is
$6,44Q,OOQ. Sueh prineipal arnonnt and interest thereon shall be payable by
the City sole.ly from the revenue pledged to the payment thereof� except that
sueh bonds may be secured by a mortgage or other eneumbranee on the
project. No holder of any such bond shall ever have the right to compel, any
exercise of the taxing power of the City to pay the bands or the interest
thereon, nor to enforce payment against any property of the Ci#y exeept �the .
project. '
A draft copy of the proposed application ta the Energy and Econamic
Development Authority of the State af Minnesota for approval of the projeet,
together with all attachments and exhibits thereto, is available for public
inspection at the office of the City Clerk be#ween the hours of 8:OQ A.M. and
4:30 P.M.

RESOLUTION CALLING FOR HEARING ON ASSESSMENT ROLL
FOR EVERGREEN KNOLL AND ADJACENT AREA IMPROVEMENTS
(IMPROVEMENT N0. 83, PROJECT N0. 4)
, WHEREAS, contracts have heretofore been let for the construction of the .
following described improvements:
The construction of sanitary sewer, storm sewer, water, street,
curb and gutter improvements to serve Evergreen Knoll and adjacent
areas (which improvements have heretofore been known and desig-
nated as Improvement No. 83, Project No. 4).
and
WHEREAS, the construction of said improvements has been substantially
completed; and
WHEREAS, the City Clerk, with the aid and assistance of the City Engi-
neer, was previously directed by the City Council to prepare the as-
sessment roll for the above described improvements; and
�dHEREAS, the City Clerk has notified the City Council that a proposed
assessment roll for the above described improvements has been completed
and filed in her office f or public inspection.
NOW TH�REFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, �linnesota, as follows:
1. That a public hearing on said proposed assessment roll shall
be held at the Mendota Heights City Hall at 750 South Plaza Drive,
in the City of Mendota Heights, on Tuesday, August 20, 1985, at
7:45 o'clock P.�1.
2. That the City Clerk, with the aid and assistance of the City
Attorney, is hereby authorized and directed to prepare and attend to
the publication and mailing of the necessary notices of said hearing,
all in accordance with the applicable Minnesota Statutes.
Adopted by the City Council of the City of Mendota Heights this 16th

Pursuant ta due call and notice thereaf, the regul.ar meeting of the Ci.ty
Council, City of Mendata Heights, was held at 7:30 o'c2ack P.M. at City

Mayor Lockwood called the meeting to orcter at 7:38 o'clock P.M. The

1984 AUDIT REPORT Auditor Steve Laible, from Peat, Marwick and
Mitchell, reviewed the 1984 Audit Report for the
Council, highlighting the improvement in the
readability of the report, the auditor's opinion
letter and a summary of the enterprise funds.
Mayor Lockwood thanked Mr. Laible for his
presentation and Mr. Laible noted that if there
were any questions throughout the year, his firm
would be available to answer them.
CITIZEN REQUEST The Council acknowledged a letter from Mr. Rob
Meyer, 1399 Clement, requesting new stop and yield
signs be placed in his neighborhood.

Staff was directed to thank Mr. Meyer for his
letter and advise him of study results.
TUMINELLY BID AWARD Councilmember Cummins moved the adoption of
Resolution No. 85-48, "RESOLUTION ACCEPTING BIDS
AND AWARDING CONTRACT FOR CONSTRUCTION OF SANITARY
� SEWERS AND WATER SERVICES TO SERVE TUMINELLY'S
HUNTER LANE ADDITION (IMPROVEMENT N0. 83, PROJECT
N0. 1)", awarding the bid to Ro-So Contracting,
Inc., for the low bid of $9,515.00.
Councilman Hartmann seconded the motion.

IVY HILL PUD AMENDMENT Mr. Jep Knox, 1095 Ivy Hill Drive, was present for
the discussion regarding a planned unit development
amendment for Lot H of the Clapp Thomssen ivy
Hill 2nd development. He advised the Council that
when the original PUD was approved, the plans
called for four foot porches on the buildings. The
homeowners wanted 10 foot porches, thus there is
now only one to two feet of open space between the
porches and the property line. This strip of land
is now being transferred to the townhouse owners.
Councilmember Blesener moved the adoption of
Resolution No. 85-49, "RESOLUTION APPROVING THE LOT
DIVISION OF LOT 5, BLOCK 1, CLAPP-THOMSSEN IVY HILL
2ND, SECTION 13, TOWNSHIP 28 NORTH, RANGE 23 WFST".
Mayor Lockwood seconded the motion.

CASE 85-05, KURTZ, Mr. Michael Kurtz was present to request
SUBDIVISION reconsideration of his subdivision proposal for
property west of Hunter Lane at Orchard Place. He
advised the Council that he proposes to create
three lots out of two large lots, and that he plans
to impose very strict covenants on the lots,
similar to North Oaks, Edina, and Culligan's Valley
View Oak. He also plans to extensively remodel the
,� two existing homes on the lots, one of which is his
'� home and the other which is rented at the present
time. He felt that a substantial home could be
built on the proposed center lot and he noted that
the Planning Commission had recently recommended
approval of his plans with 100 feet of frontage at
the building line.
It was noted by the Council that the Planning
Commission recommendation was contingent upon the

condition that no future setback variances be
applied for.
Dr. Steven Hunter, a member of the audience, stated
that there would be variances applied for, that
there was no way someone could build a home on the
center lot and not want it in line with the
existing homes on either side of it.
Mr. John Phillips, 1835 Hunter Lane, reminded the
Council that he is still the owner of the subject
property, and that Mr. Kurtz purchased it on a
contract for deed which would be paid off next
year. He stated that he has lived in the area f or
32 years and was against the development. He felt
that the addition of a third home would destroy the
character of the neighborhood and he was not in
favor of three homeowners sharing a single driveway
to the property. He noted that the majority of the
neighbors were against the proposal.
Dr. Steven Hunter, who owns 1 3/4 acres of land,
felt that Mr. Kurtz's proposal was f or pure
speculation and should be laid out as his reason
for the proposal. He noted that he was speaking
for his father, Dr. Samuel Hunter, as well, and
called the proposal a feasible moneymaker. He
noted that if he were in the same position, he
would attempt the same thing.
Councilmember Cummins felt that the single access
to the three lots would not be a good precedent to
set.
Mayor Lockwood stated that it would be his desire
to deny the request without prejudice, if a firm
plan for division of the center lot and certainty
of where the home would be exactly placed would be
prepared. Councilmember Cummins agreed with Mayor
Lockwood. Councilmember Hartmann somewhat agreed
with the statement and felt that the proposed plan
would change the character of the neighborhood. He
also would like to see a firm plan for development
which could be endorsed by the neighbors. City
Attorney Tom Hart noted that Mr. Kurtz may have to
start over with his plans if too much time elapses,
and that would mean appearing before the Planning
Commission and notifying neighbors again of a
proposed public hearing.
Mr. Kurtz questioned how his proposal could be

denied when he had met all the City's requirements.
Mayor Lockwood noted that his proposal has
aesthetic problems and probably would require a
variance for a 20 foot setback to the 40% critical
area slope, which requires a 40 foot setback.
Mayor Lockwood moved to deny the subdivision as
requested, without prejudice. He stated that the
Council would reconsider a new plan if there is no
doubt as to the placement of the home on the center
lot and if a majority of the neighbors endorsed the
plan.
Councilmember Hartmann seconded the motion.
Councilmember Blesener agreed with the motion
except the necessity of requiring the endorsement
of a majority of the neighbors.
Councilmember Hartmann stated that he would not be
in favor of granting a variance to the 40% slope
required 40 foot setback.
Councilmember Cummins felt there would be no
problem granting a variance if the proposed home is
in keeping with the neighborhood.

EAGLE RIDGE DECK The Council acknowledged and discussed a memo
PERMIT requesting approval of a building permit to add a
deck t� 1830 Eagle Ridge, Unit 1006. Two
homeowners in the audience noted that the deck
addition had been approved by the Eagle Point Board
of Directors. They stated that the deck was in the
original plan, but was not constructed earlier.
They wished to construct the deck at the present
. time. They pointed out that there will be a
similar request at the August 6th meeting, and
after discussion, the Council concurred that this
request should be placed on the Consent Calendar.
C Councilmember Cummins moved approval of the deck
permit as requested.
Councilman Hartmann seconded the motion.

FIRE SERVICE CONTRACTS The Council briefly discussed a memo from Financial
Advisor Shaughnessy relative to alternative methods
of billing Sunfish Lake, Mendota and Lilydale for
fire service. After discussion, staff was directed

to contact the involved communities regarding 1986
billings.
MWCC SEWER BILLINGS Financial Advisor Shaughnessy reviewed proposed
alternatives relative to the increases in the
City's billings from the Metropolitan Waste Control
` Commission. He advised the Council that a rate
t, increase effective the third quarter of 1985 is
proposed to cover the increased costs to MWCC. He
also noted a possible need for an additional rate
increase in the third or fourth quarter of 1986.
Councilmember Blesener indicated she would prefer
to see a single rate increase large enough to cover
both 1986 and 1987 costs, rather than two increases
over the next year.

Public Works Director Danielson explained how the
MWCC monitors the flow from the City.
Financial Advisor Shaughnessy advised the Council
that staff will return with two or three suggested
rate proposals and a new resolution of rate changes
at the second meeting in August or the first
meeting in September.
EVERGREEN KNOLLS Councilmember Cummins moved the adoption of

WACHTLER AND FIRE The Council discussed a memo relative to appraisals
for the Wachtler property and the old fire station
site, Included with the memo was an appraisal
proposal from Hutchinson appraisals for a.proposed
fee of $3,300 to appraise these properties.
STATION APPRAISALS
Mayor Lockwood reminded the Council of a previous
appraisal from Vince Dolan for the Wachtler

property which could be updated, and Councilmember
Hartmann advised of a possible appraisal on the old
fire station site and adjacent buildings, which
occurred when the City had an option to purchase
the gas station and store on Dodd Road.
It was the concensus of the Council for staff to
research and update the old appraisals prior to any
formal action being taken.
PARKS MASTER PLAN STUDY The Council discussed a memo pertaining to a parks
master plan study, and noted a proposal from
David Kirscht, landscape architect, who would
� prepare a study for $23,4Q0. It was noted that the
Park Commission had already reviewed the proposal
and it was the desire of the Commission to solicit
proposals from Damon Farber and Dahlgren, Shardlow,
and Uban, Inc. A committee would then be formed to
review the proposals for a recommendation to the
Council.
It was the Council's wish to not solicit a proposal
from Dahlgren, Shardlow and Uban, Inc., but the
Council concurred that additional proposals should
be solicited.
Staff was directed to solicit six or seven
proposals on an informal basis to present for
review.
BID AWARD, ANDERSEN/ Councilmember Cummins moved adoption of Resolution
CURLEY No. 85-52, "RESOLUTION ACCEPTING BIDS AND AWARDING
CONTRACT FOR CONSTRUCTION OF SANITARY SEWERS AND
WATER SERVICES TO SERVE ANDERSEN/CURLEY PROPERTIES
(IMPROVEI�NT N0. 85, PROJECT N0. 1)", awarding the
bid to Orfei and Sons, Inc., for their low bid of
$14,900.48.

CITIZEN'S COMMITTEE The Council acknowledged a list of potential
volunteers for the City Hall Citizen's Committee
(, and indicated that they did not desire background
information on each individual.
SALARY SURVEY The Council acknowledged a memo from City
Administrator Frazell regarding a survey of
elected officials salaries. The Council indicated
that this item should be discussed during budget
meetings and at a time when the full Council is
present.

Minutes of the Joint Meeting
Held Tuesday, July 23, 1985
A joint workshop meeting between the City Council and Planning Commission was
� held at 7:00 P.M., at City Hall, 750 South Plaza Drive, Mendota Heights,
Minnesota. Members present were Mayor Lockwood, Councilmembers Blesener,
Cummins, Hartmann and Witt, and Planning Commission members Kruse, Burke,
Henning, McMonigal, Morson and Stefani. Commissioner Frank had advised the staff
that he would be unable to attend the meeting.
Mayor Lockwood opened the meeting at 7:06 o'clock P.M. for the purpose of
discussing a preliminary report on the South East Area Study, which had been
prepared by Dahlgren, Shardlow, and Uban, Inc.
SOUTH EAST AREA STUDY Planner Dahlgren noted that he and Phil Carlson and
Elizabeth Morson of his staff were present to offer
information pertaining to the preliminary study.
Mayor Lockwood noted for the audience that the study
area is bounded generally by the Friendly Hills area on
the north, by I-494 on the south, by Delaware on the
east and by a portion of land lying westerly of Dodd
Road, at I-494.
Planner Dahlgren noted that his staff had contacted a
majority of the homeowners in the area and that the
information received from the homeowners was very
helpful in preparing the report. He noted that the
results are preliminary at this time. He then turned
the meeting over to his assistant Phil Carlson, who then
gave a 50 minute slide presentation, going over the
drawings and proposals that were contained in the
preliminary study.
Planner Carlson noted that there were four basic land
use concepts that were put together.
Concept A showed the area in its existing zoning. He
noted that this concept contained the lowest intensity
for development, but felt that having single family
homes adjacent to I-494 would not be an appropriate use
for the area.
Concept B showed apartments all along the southern
boundary of the freeway, with a small number of
townhouses in the southeast corner of the area. This
concept contained single family development north of
Mendota Heights Road.

Concept C showed a small office development west of Dodd
Road and a mix of apartments and townhouses east of Dodd
to Delaware. He felt that this concept made good
planning sense.
Concept D showed office use, with possibly 500 - 900,000
square feet of office space west of Dodd. East of Dodd,
Tandem Corporation was proposing a small neighborhood
business/commercial use for residents of Mr. Riley's
proposed apartments and townhouses. He noted that
townhouses were proposed for Mr. King's property and
northerly of the King property, Tandem was proposing
single family development.
Mr. Jack Anderson, a traffic engineer commissioned by
Dahlgren, Shardlow and Uban, spoke noting that the
�' traffic estimates were prepared on the entire study area
and that traffic volumes were based on full development.
He noted that 10 trips per day per dwelling were
projected for the Decorah/Dodd, Pagel Road/Dodd�and
Huber Drive/Delaware area. He also noted that in the
year 2000, 50% of the trips in the area would travel
south to I-494. At present, 78% travel northerly to TH
110.
Planner Carlson then noted that the traffic volumes
could be compared with the four basic concepts with more
intense development generating greater traffic
generally.
Planning Commission Chairperson Kruse asked what the
current traffic numbers were. Planner Carlson
apologized for not including them in the report, but
noted that traffic counts were taken at peak morning
hours of July 9, 10, and 11 at the corners of
Decorah/Dodd, Keokuk/Dodd, and Huber/Delaware. He noted
that there were no counts taken on the interstate yet.
Mayor Lockwood asked what is the traffic count in the
morning hours at Dodd and South Plaza Drive. He felt
that this information should be included in the report.
Councilmember Cummins noted that he would like to see
sets of numbers both actual and anticipated on Dodd Road
in addition to what is there now.
Planner Dahlgren noted that 10,000 vehicles are proposed
on Dodd in 1995, with f ull development as the land is
presently zoned. He was asked if additional stop lights
would become necessary at Dodd/South Plaza Drive,
Dodd/Mendota Heights Road, or podd/Decorah.

Planning Commissioner Stefani expressed concern over
future drainage within the development.
Councilmember Witt noted that it was the Council's
intention that there be no commercial development east
of Dodd Road, and she hoped that Tandem didn't get too
comfortable with their project as proposed in Concept D.
She also noted that the City is undertaking a master
park plan study and felt that the Park and Recreation
Commission should conduct a joint meeting with the
Planning Commission regarding the proposals presented.
Mayor Lockwood asked what plan should be preferred.
Councilmember Cummins noted that he favored Concept B
with a change to commercial development west of Dodd
Road. City Administrator Frazell felt that this plan
may possibly reduce traffic northerly on Dodd Road.
Councilmember Blesener asked what would happen to the
medium density residental on the northeast corner of
Dodd and Mendota Heights Road.
Councilmember Hartmann asked if single family
development is prohibited in Airport Zone 3 south and
west of Dodd and Mendota Heights Road.
Mayor Lockwood thanked Planner Dahlgren and his firm for
their work on the preliminary report and noted that
before any changes were made, public hearings would be
conducted regarding any rezoning. He invited interested
residents to call City Hall or submit letters regarding
any concerns they may have and thanked them for their
presence at the meeting.
Mr. Charles Mertensotto asked what are the City's
objectives for rezoning this area and what is the
financial impact on the City's services.
Mr. James Losleben stated that he is disappointed that
the City is in such a rush concerning this land. He
felt that the City should move slowly and take its time.
Dr. Ted Owens noted that moving slowly is what destroyed
the Amesbury project a few years ago.

Council, Mayor Lockwood adjourned the meeting.

SYNOPSIS OF MONTHLX RUNS
F3.re department responded to 15 calls during the monCh ai June. Twa
af �he cails were propana gas leaks. The most serious call was to a car fire
on Hwy. 55 near George's Golf Tee. The first engine arriving £ound the
en�ine compartment of a Buick LeSabre fully involved, Damage was estimated
at $840.00.
SYNOPSIS dF MONTHLY TRAINING
The month's drill was spent giving new members an opporCunity to
experience �he heat af a fire. The department used the brush pile on the
Ridder property to provide the heaC and the rook3es advanced hose lines inta
the fire to knack it down.
The manthly rescue drill was used to preplan rescue procedures at Tvy
Fal1s. We have had people fall down into the fal.ls in the gasC and we felt
that the more we preplan evacuation of victims, the quicker we can get them
out.
