MINUTES - JULY 17, 1985
1. The meeting was called to order by Chairman Dave Zemke at 7:35 o'clock P.M.

Also present was John Gibbs, legal counsel and Gene Simmons, Fran
Zeuli, Tim Page, Jan Foerster, and Dick Bear of Continental Cable-
vision.
Henderson moved, seconded by Hanson to approve the agenda. Voting 8
ayes, 0 nays. Motion carried.
Tatone moved, seconded by Hanson, to approve the minutes of the May 19,
and the June 19, 1985 minutes. Voting: 8 ayes, 0 nays. Motion carried.
Tatone moved, seconded by Henderson to accept the June 19, 1985 min-
utes of the Executive Committee. Voting: 8 ayes, 0 nays. Motion
carried.
4. There were no communications to the Commission.
5. Chairman Zemke addressed the Cable Administrator position description.
He stated the the Executive Committee ratified the description.
Hanson indicated continued concern about the position description.
Lanegran asked what were Hanson's concerns on the position description.
Hanson indicated that he had previously stated that he felt the salary
for the Cable Administrator was too high and that he still felt that
way.
Zemke stated that the salary should be commenserate with the indivi-
dual's experience and that the salary range as proposed would give the
commission that option.
Zemke stated that the proposed procedure would be the applicants�send-
ing resumes, personnel committee would screen the resumes and interview
applicants felt to be qualified and that the final interviews would be
by the full Cort�nission as well as the establishing of a salary for the
individual.
Tatone stated that during the process of designing the position de-
scrip-tion research was done to find out the salaries of current Cable
Administrators and that the salary proposed was in the middle of the
salaries researched.
Henderson stated that considerable experience should be considered as a
related field or degree. He stated that he felt that the Commission
did not want an entry level person because it would not serve the
purpose of the Commission.
Lanegran moved, seconded by Baird to ratify the Cable Administrator's
position description. Voting: 7 ayes, 0 nays, 1 abstention. Motion
carried. ..
6. Lanegran asked when the cable administrator opening would be published
and the time frame for receiving applications. She also stated that
the advertisement should read "resumes should be post-marked by" or a
definite time and day should be specified.
Zemke stated that the Executive Committee recommended publication in
NATOA News, Nations Cities Weekly, Minnesota Cities, and the St. Paul
and Minneapolis newspapers.
Henderson stated the final receiving date should be two (2) weeks after
the last publication.
After some discussion, Henderson meoved, seconded by Walker to ratify
the Classified Advertisement for Cable Administrator position with the
correction of "Resume to be received no later than 4:30 P.M." two::weeks
after the last publication. Voting: 8 ayes, 0 nays. Motion carried.
Tatone moved, seconded by Walker that the Cable Administrator position
advertisement should be advertised in NATOA News, Nations Cities
Weekly, Minnesota Cities, and the St. Paul and Minneapolis Newspaper,
but that it should not be published in any publication that comes out
after September 15, 1985 and that the advertisement be changed to„�
reflect that resumes will be received no later than 4:00 P.M. September
30, 1985. Voting: 8 ayes, 0 nays. Motion carried.
7. Fran Zeuli of Continental Cablevision addressed the Commission by
introducing Dick Bear, construction manager, Tim Page, construction
aerial supervisor, Jan Foerster, construction engineering project coor-
dinator and Gene Simmons, quality assurance manager.
Dick Bear stated he is responsible for the correct installation of the
cable system. He stated that Continental Cablevision has submitted to
.NSP and Northwestern Bell permit requests for a total of 93 miles and
that Continental plans to install 270 aerial miles and 90 underground
miles in the initial service area.

Lanegran asked if any af the permits have been granted and if they are
granCed all at once ar piece meal.
Bear sta�ed that no pertnits have been granted to date but anticipate
them to be granted shortly and that they come piece mea1.
Bear explained the form Continenta� is suggesting the cities use for
permit applications.
It was stated tha�, the Commissian should have a copy of the completed
permit.
Bear stated that Jan Foerster and he have mad� a visit to some af the
cities in regard to what the cities will need and what Continen�al will
need from the cities. The schedule indicates that Con�inental will
meet with aIl citi.es within the next two weeks.
Henderson askec3 if the constructian sta£f is staffed as grojected hy
this time.
Zeu1i s�ated that staff will be added as the need arises.
Jan Foerster stated that she is the contact person f or any engineering
questions in regard to permits etc.
Tim Page stated that he works with the utilities �o make sure the poles
have space for cable. If the poles da nat have adequate space, Conti-
nenCal has to replace �hose poles. Construction is anticipated to
start September 1, 1985.
Gene Simmons stated that he deals wi.th the quality of installation,
complain�.s, etc. He s�ated that his group will promptly address each
complaint received and resolve the problem as soon as possible. If it
is required, to assure hameowner satisfaction, they will wark at night
when the homeowner is home to make sure �he outlet is installed where
the homeawner wants it. It will nat be installed unless the homeowner
is available for approval. They also inspect from the drop cable ta
the installati.on in the hflme, plus the utilities also do inspec�.ions.
Tatone asked if a sub-contractor has been selected.
Bear stated that �hey were in that process right now and wi11 make a
selectian by August 23, 1985. US Cable is the sub-constractor for the
St. Paul System and that they will hire from the local union hall.
Henderson asked if the sta£i members present at the meeting are totally
assigned ta Northern Dakata County, St. Paul pr bath.
Bear stated that he has assignments in both, that Zeuli, Page and
Foerster are tota3.ly Narthern Dakota County.
Zeuli. stated that in the next 4-5 weeks they will be meeting with the �
cities to prpvide them with an update on the franchise and construction
and wiil pravide a11 cities with a constrnction map far their infarma-
tion.
Zeuli stated that public relations personnel have made numerous p�r_,esen—
tations to organizations in Northern Dakota County.
8. Zemke stated that the personnel committee met with Kevin Frazell, City
Administrator of Mendota Heights regarding space for the Cable Adminis—
trator and providing services. He also stated that they are going to
explore some other alternatives as well.
Zemke presented the Commission with a bill from Herbst & Thue in the
amount of $1,855.35 for legal services.
Tatone moved, seconded by Henderson to pay the Herbst & Thue bill in
the amount of $1,855.35. Voting: 8 ayes, 0 nays. Motion carried.
Zemke stated that the Mendota Heights and Lilydale City Councils have
approved the budget. He asked that if the other cities have approved
the budget that a letter be sent to the Commission indicating approval.
Zemke stated that the next meeting would be August 21, 1985 at 7:30
P.M, at Mendota Heights City Hall.

SUBJECT: Replacement of Typewriter
Introduction
We propose to replace the Police Secretary's typewriter with an IBM-PC Computer.
History
The IBM Selectric Typewriter in the Police Department is 10 years old and has been
in for repair three (3) times this year. The last time it was in, it was gone
for three (3) weeks and when it was returned the problem had not been corrected.
The repair people recommended that it be replaced. A new Memory Writer would
cost approximately $1400.
Discussion
We are presently involved in a computer study that will result in a City-wide
computer system. At this point it has focused in on IBM equipment that is
compatible with the computers now being used by the Admini�st�ation and Engineering
departments.As it appears that we will be buying IBM computers for the Police
Department in the near future, it seems appropriate and cost efficient that
we do so now, rather than throw away $1400 for a typewriter that will be
obsolete in 1-l� years.
The Equipment Certificate Fund for the Police Department for 1985 includes
$40,000 for computer equipment.

DISCUSSION:
At the May 21, 1985 meeting, Council accepted the feasibility report
for installing utilities to Carmen Tuminelly's Hunter Lane Addition and
ordered staff to prepare the plans and specifications.
The plans and specifications have been prepared and the plan is
attached for�your review. The specifications will be available Tuesday
evening.
This project is estimated to cost less than $15,000 (Engineer's Esti-
mate $14,000) and the contract can be by sealed bids or direct negotiation.
RECONA�IENDAT ION :
Staff recommends that Council approve the plans and specifications and
and authorize invitation for bids. Staff would receive bids at 9:15 A.M, on
Wednesday, July 10, 1985 and request Council approval on July 16th.
ACTION REQUIRED•
If Council wishes to implement the staff recommendation, they should
pass a motion adopting Resolution No. 85- , Resolution Approving Final

Dear Mayor and Council P�Iembers :
I represent P�iles and Eleanore Bredvold. They live at 1281
Lakeview Avenue, Mendota Heights. Their home is on Lake LeA�ay.
The Bredvolds previously appeared before you to make you aware
of the flooding problem concerning Lake LeP�ay. In March of 1985,
your engineering department indicated that the lake level was
at an elevation of 839 feet or more. The flooding of Lake LeMay
has inundated a considerable portion of the Bredvolds property,
has jeopardized the stability of the lakeshore, has jeopardized
a number of oak trees on the Bredvolds property, and, in fact,
has created the real hazard of endangering the driveway access
to the property. A representative from the P�innesota Department
of Natural Resources visited the Bredvolds in June of 1985; at
that time the lake was still in a flooding condition and many
hardwood trees, including several oak trees in the two to four
foot diameter range, were inundated. The representative from the
Minnesota Department of Natural Resources stated that based upon
the evidence he saw, the lake is well above the natural ordinary
high water level.
The problem has been identified,namely, the flooding of Lake LeP�ay.
At this point, we believe that a number of steps should be under-
taken by the City to seek a solution to the problem. To that end,
we ask that the City explore both a long-term and short-term
solution. The ultimate goal is to have in place a surface water
management program for the area so as to stop the flooding of Lake
LeMay.
In our judgment, the long-term solution requires that the City
explore what public improvements should be constructed in the area
to alleviate the flooding problem. The steps leading to that long
term solution include the following:

l. We ask that the City consult with the Depart-
ment of Natural Resources and establish with
the Department the natural ordinary high water
level for Lake LeD4ay.

3. The Ci.tyshould order a feasibility report pursuant
to Chapter 429 of the i�iinnesota Statutes to deter-
mine the necessary public improvements that have to
be made in order to (a) stabilize the lakeshore,
(b) control the water level, (c) minimize flooding
damage, and (d) control the amount of water that
flows from surrounding land areas into Lake LeMay.
4. As part of the feasibility report, the City Engineer-
ing Department can prepare cost estimates for the
public improvement work that needs to be done.
5. The City can also then determine what portion of the
cost will be borne by the City and what portion will
be borne by affected landowners.
6. A central element of the feasibility report would
be to identify the land contributing to the problem.
T�7e ask that the City explore under both Chapter 429
and Chapter 444 of the statutes what land would ul-
timatel_y be assessed either by way of special assess-
ments or by way of a storm water tax district. Chapter
444 of the statutes allows the City to create a storm
water taxing district where the cost of the improvement
is paid by ad valorem taxes on that land within the
district. Thus, I request that the City explore a11
avenues of financing the project under both Chapters
429 and 444.
7. In addition, we ask that the City explore other
mechanisms of financing the project, perhaps through
any available state funding programs.
3. Once the Engineering Department, through the feasi-
bility report, has identified the projects that need
to be constructed to solve the problem and once the
assessable land under Chapter 429 has been identified

or the storm water district under Chapter 444
has been identified, the next step would be
to calculate the proposed assessments or taxes
that landowners would pay with respect to the
cost of the projects. This would be for that
portion of the projects paid for by the land-
owners and not by the City.
9. Another element of the feasibility report would
be to establish a timeframe for making the improve-
ments. It may be worthwhile in this instance to
do a comparison of timeframes and cost estimates,
if the engineering department believes that the
two are related.
Once the above steps are completed, the City and the landowners
will be in a position to know what is is going to cost to solve
the problem, who may be paying for solving the problem and what
the cost will be to the landowners and to the City. The Council
will then be in a position to determine whether the City should
order the public improvements.
�ae realize that the steps outlined above may take some time to
complete. In the meantime, the Bredvolds have a very legitimate
concerning about springtime flooding. Thus, we believe that there
should be in place a short-term, temporary response to this problem.
To that end, we as the following:
A. That the City �ngineering Department explore
and report to the City Council within a
month whether any temporary outlet from Lake
LeMay can be established.
B, That the Engineering Department identify and
report to the Bredvolds as to whether any
local permits need to be obtained so that
a portion o� the Bredvolds property can be
filled in order to protect the driveway
access. The temporary short-term solution
is, at the very least, to protect driveway
access to the Bredvolcls property. A form of
a dike would have to be established parallel
to the driveway. We ask that the City in-
dicate to the Bredvolds the �aillingness of
the City to provide any labor or fill materials
in order to shore-up the driveway access.

C. That the Engineering,Department report to
the City within a month as to any emergency
plans that it has in case the flooding
again occurs in the springtime and the drive-
way access is cutoff. The Bredvolds are
deeply concerned that if this problem re-
occurs in the springtime, there has to be
some emergency plan in place to protect access
so that emergency vehicles, such as fire and
police, can get to the home.
Tae kindly ask that this petition be placed on the Council agenda
for August 6, 1.985. At that time, William Price from Suburban
Engineering will join me at the Council r�eeting to answer any
questions that you may have concerning either the substance or
the procedural aspects of our request.
Tn7e thank you in advance for consideration of this matter. By
v�orking together in an orderly and methodical process through
the feasibility report, we believe that the problem can be solved.

1. The Ettingers have for many years owned a 6.2 acre site east
of Vietoria in the triangle formed with its interseetion
with the rxght-af-way of 35E. The site is utilized as a
residenee and a flay care center.
The nartherly portion of the property has an existing,
rusting, barb wire fenee whieh the Ettingers propose to
replaee with a new, cedar split rail fence.
The proposed new fenee will have posts 48 inehes high with
the rails 42 inehes high. The Zoning Ordinanee allows for
fences in the frant yard of residential praper�ies to be 3Q
inches high with the posts extending a maximum 6 inehes
above that (3 feet). Yau wi12 note from the drawings
submitted that the fence proposed to be set baek 15 feet
from the public right-of-way of Vietoria Avenue. The 30
ineh height {with the 36 ineh posts} are allowed to be
plaeed right up to the right-of-way line.
It would appear obvious that the replaeement of the old barb
wire fenee with a new split rail fence will be an attraetive
addition to this part of the neighborhood. As mueh as the
fenee is an open-type rail fenee and is set baek i5 feet
from the right-of-way wau2d suggest that the additianal
height will not be of great eonsequenee.
The property aeross the street is in the City of Lilydale,
and the property to the .east is occupied by right-of-way
I-35E, Thus, it would appear that no eontiguous or nearby
single family homes could be adversely affected by the
praposal.

1. Mr. Alvarez has construeted an elevated ehildren's play
house in his baek yard with a floor which is elevated 9 feet
above the ground. He wishes to put a roof on this structure
which indieates wi21 p].aee the t4p of the Gable 21 feet from
ground level. Mendota Heights Zoning Ordinance requires,
like many other cammunities, a minimum height of 15 feet for
aceessory structures which in most cases is a free standing
garage.
A 15 faat maximum is measured at the mean height of a Gat�le
raof whieh, in this case, wou2d appear to be approximately
18.5 feet. Thus, the height is 3•5 feet above the required
maximum.
The applicant has submitted a statement signed by three of
the immediate neighbors. A copy of that statement is
attaehed for your consicieration.
Innovative structures as propased here, in our experience,
are usually not a signifieant problem. Where appropriately
placed an large parcels, they add interest and character to
a residential area. We suggest Members of the Planning
Commission and Council may wish ta view the site with these
gaints in mind,

1. Property in question is a 89.9$ foot lot (frontage on
Vandall Street), with a depth of 180 feet (on 3 1/2 Avenue).
Three and One Half Avenue is a platted street but not
developed. To the west of this property is a large wetlands
which is owned by the Somerset Nineteen people which
provided the land area to aehieve the density possible in
the Somerset Nineteen to acheive the density possible in the
Somerset Nineteen Planned Unit Development. Thus, it is a
permanent wetland appropriately planned for permanent
retention. The City's Wentworth Park also oecupies the
southerly portion of the wetlands. With these conditions,
it is anticipated that 3 1/2 Avenue will never be
constructed, as is also true of the Street to the west of
the property in question. You will note on the attached
sketch indicating the location of the property that these
streets not construeted are indicated with a shaded pattern.
The Palmers propose to place their home 10 feet eloser to 3
1/2 Avenue than would normally be required. Thus the
propose setback is 20 feet rather than 30 feet. In as much
as it is highly unlikely that 3 1/2 Avenue will never be
construeted, we suggest that the 10 foot varianee is
appropriate. Attaehed is a statement from the Palmers along
with plans of the house proposed for construction on the
site. �
The hardship here required for the variance is the fact that
the lot having been platted many years ago is undersized as
a corner lot. The lot has 89 feet of frontage rather than
the normally required 100 feet on Vandall Street.
The home is placed as close as it can and should be� to
Vandall Street (30 feet back from the property line) and
thus would appear to conform to the Wetlands Requirements to
the maximum extent that is reasonable. On the attached
topographical map, we have indicated the location of the
wetlands line . In as much as these lots were platted long
before the establishment of the� wetlands preservation
system, the variance proposed here would seem reasonable and
consistent with previous variances allowed on a similar
property to the south.

1. Economics Laboratory Property, Mendota Heights, is a 25.247
aere parcel zoned B-1A, west of Walker Avenue, and south of
Trunk Highway 13. The pareel was developed by Economics
Laboratory in the early 1960s and is occupied by three
prineipal structures, two of which are joined by a
connecting link. The principal use of these structures is
for a pilot produetion plant and research facility.
The B-1A zone is a large-scale office park zone in whieh the
research and development facilities oecupying the site are a
permitted use. At one time, Economics Laboratory considered
moving more of their administrative facilities to the site,
but ultimately built sueh facilities in Downtown St. Paul.
The site is, of course, overly large for the facilities that
oceupy the site and Economies Laboratory has decided to sell
off a 5.269 acre parcel with 1,051.93 feet of frontage on
Trunk Highway 13 and 321.92 feet of frontage on Walker
Avenue. The zoning district calls for a minimum of 5 acre
lot and a frontage of 300 feet. Being a corner lot, the
smallest dimension on a street frontage is legally the front
of the lot. Thus, in this case, the front lot line is the
frontage on Walker Avenue.
It is likely in the City's interest to have
intensely developed. Unless Economies Laboratory
develop additional facilities of their own on the

best means of achieving that objective.

Because of the odd placement of the buildings on the
property (not being clustered) it is difficult to carve out
a reasonable portion for sale. The problem with the lot
proposed is that the depth off Trunk Highway 13 is 242.58
feet. It would, of eourse, be more desirable if this depth

were greater and this is the reason why we have suggested to
the Economics Laboratory that they seek a varianee allowing
for the new lot line to be within 25 feet of the northerly
most building. The side yard setback required in the B-1A
District is 50 feet and, thus theoretieally, this lot line
should have been placed 25 feet further to the northwest.
This, however, would make the lot more shallow (as it
relates to Trunk Highway 13). We feel that the lot will
have more developmental potential if the 25 foot variance is
granted, thus allowing for 25 feet of additional depth for
the new lot (indicated as parcel A on the attached survey).
Though the survey is very complete in other details, it does
not indicate the proposed location for services to the lot.
City water and sewer are available on Trunk Highway 13. The
exact location of proposed service connections to the lot
will likely be determined at such time as the pareel is sold
and considered for development.
Your Publie Works Direetor, Jim Danielson, is concerned that
there may be existing sewer and water services extending
through the lot to serve one or more of the existing
struetures. The Planning Commission and Couneil may wish to
question the applicant regarding this concern. If such is
the case, a more appropriate easement should be filed with
the land division preserving these service corridors.
We may anticipate an ensuing problem in the actual
development of the pareel as zoned as mueh as the front yard
setback is 100 feet, rear yard setback is 60 feet, and the
side yard setback is 50 feet. If the parcel is developed by
a single user, it may be possible to adhere to these
setbacks. However, because the parcel is long and narrow,
it may be difficult to site appropriate structures on the
property conforming to the 100 foot setback that would be
required both on Walker and Trunk Highway 13. It may be
that the City's B-1 zone, which requires 30 feet of setbaek
from the street, may be appropriate for this parcel
particularly if it is to be divided further by ultimate
users. The City may wish to simply wait until• a
developer/user proposes to build on the property. At that
time other variances could be considered or the land may be
rezoned to B-1 similar to the small office park under
development further to the southwest on Trunk Highway 13 in
Mendota Heights.
The Subdivision Ordinance states that if parcels larger than
5 acres are created, the land may need not be platted. Sueh
is the case here. If the land is to be further divided,
however, it would be appropriate to plat the entire site.

The regular meeting of the Mendota Heights Planning Commission was called to order
�at 8:52 o'clock P.M., following a joint City Council/Planning Commission workshop.
Members present were Kruse, Burke, Henning, McMonigal, Morson and Stefani. Frank
had notified the Commission that he would be unable to attend the meeting. Also
present were Planing Consultant Howard Dahlgren and Public Works Director Jim
Danielson.
APPROVAL OF MINUTES

Minutes of the June 25th meeting had been submitted
previously.
Commissioner Stefani moved to approve the minutes as
submitted.
Commissioner Morson seconded the motion.
HEARING, CASE 85-17, Chairperson Kruse called the meeting to order for the purpose
SPANJERS, SUBDIVISION of a public hearing on an application by Mr. George Spanjers
for the subdivision of Lot 7, Somerset Hills. This parcel
is located between Marie Avenue and Valley Curve, east of
Wachtler Avenue. Mr. Spanjers was present and noted that
it is his intention to drain water into the creek toward
Wachtler on the south side of Marie Avenue. He plans to
create-five new building lots, with three fronting on Marie
and two fronting on Valley Curve.
Commissioner Stefani stated that he had no objection to the
subdivision, only to the drainage. He wondered how much
water will flow out if this land is developed.
Public�Works Director Danielson advised the Commission that
he recommends that the developer petition the City for
a study for utilities to serve the area.
It was noted that the house on Lot 6 would be 30 feet from
the creek, whereas 100 feet from a creek is required by the
Wetlands ordinance. Mr. Spanjers noted that the eastern lots
will not need fill, but some of the lower lots may require
f illing. He also noted that there will be some clearing done
but that he intends to leave a line of trees along Marie Ave.
He also noted that he ma.y build on Lot 4 this year, but he
isn't certain at this time.
Chairperson Kruse asked for questions and comments from the
audience.
Mr. John Bland, 1850 Elb Lane, asked what the condition of
the subsoil is. He felt that soil borings should be done.
A woman living in the area stated that she would like to
see the property developed to eliminate the traffic hazard
from the wooded area.

Planner Dahlgren noted three serious conditions which he
felt should be considered: 1

1. the combination of lots 5 and 6 due to the probable
need for a variance from the wetlands setback.
2. the need for a drainage easement by the City.
3. the need for soil tests.
Mr. David Duddleston noted that he preferred to see the two
lots combined.
Mr. Bland stated that a proposed drawing should be displayed
for the audience. Chair Kruse said that would be done next
month.
There being no further questions or comments from the audience
Commissioner Henning moved to continue the public hearing
to the August 27 meeting, with Mr. Spanjers and staff to
review Planner Dahlgren's comments.

CASE 4�85-15, ECONOMICS Chairperson Kruse called the meeting to order for the purpose
LABORATORY, SUBDIVISION of a public hearing on an application from Economics
HEARING Laboratory for the subdivision of 5.269 acres of land fro
their parcel located on TH 13. Mr. Robert Hain was present
to answer any questions. He noted that the subdivision was
proposed in order to make a more saleable piece of property �::,
that the land is considered excess land by Econ Lab. He also
noted that the zoning would remain the same as is, B-lA,
The Commission poin,ted out that the question of the utility
easement needs to be resolved.
Chairperson Kruse asked for questions or comments from the
audience.
Mr. Hanson, TH 13 and Wachtler, asked if this land can be
subdivided. He suggested that staff check the deed to see
if this is allowed. Planner Dahlgren noted that less than
5 acres could not be subdivided.
Mr. Tom Bader, 1407 Wachtler, asked what are the permitted
uses in B-lA districts. Planner Dahlgren responded that
this is a business park, with no retail, wholesale, gas
stations or restaurants allowed.
Mr. Andy Freeman, 1362 Cherry Hill Road asked what the height-
limitation is. Planner Dahlgren stated that the height of
a structure shall not exceed 4 stories or 45 feet, whiche
is greater.

Mr. Gary Hagstrom, 1312 Wachlter expressed concern over the
increased traffic along Wachtler. He asked who the proposed
buyer for the parcel would be and what is his proposed use
for the site. Mr. Hain advised that there is no proposed
buyer at this time, therefore he does not know what the•
intended use would be.
Mr. Freeman agreed that there would be increased traffic
and saf ety hazards in the area if this subdivision is
approved.
Mrs. Paige Hagstrom, 1312 Wachtler, noted that there is
heavy traffic on Wachtler, especially during early morning
or late afternoon hours, as employees are arriving or leaving
Economics Laboratory. Mr. Hain noted that there are 190t
employees working at the site.
Mr. Hagstrom asked that staff research what assurances were
given to Econ Lab prior to building permit approval before
any action is taken by the Planning Commission.
There being no further questions or comments, Commissioner
Morson moved to close the public hearing at 9:43 P.M.
Commissioner McMonigal seconded the motion.

Commissioner Morson moved to recommend approval of the propose
subdivision as shown and to recommend approval of a 25 foot
side yard variance and a 57.42 foot lot width variance.
Commissioner McMonigal seconded the motion.
Commissioner Stefani offered a friendly amendment to include
that providing that the original approval of that site did not
include or specify a buffer zone which would not negate a
buffer zone. The amendment was accepted as presented.
Commissioner Kruse stated that he was not sure that the
5 acre parcel would be rezoned if it was sold. Staff was
directed to make a report to the City Council on their
research.

HEARING, CASE 85-10, Chairperson Kruse called the meeting to order for the purpose
M.H. ASSOCIATES, of a continued public heariig on an application by Mr. Jim
REZONING, CUP, VARIANCE, Riley for the rezoning and a conditional use permit for a
OTHER planned unit development for land located on the south sdde
of Mendota Heights Road, between Dodd Road and Delaware Ave.
Mr. Riley presented a chart showing the occupancy rate,
ages, percentages and incomes of tenants in the Lexington
Heights Apartments and stated that the same would be
anticipated for his new proposal. He noted that the average
income of renters is $35,000 and that these people represent
good, quality people.

Mr. Riley anticipates the same level of rental rates for ,
his proposal as he has in Lexington Heights. He noted that
Mendota Heights Road extended would be at the same location
as proposed, through Mr. King's land. Mr. Riley also
noted that he would like to see Concept D of the South East
Area Study adopted. He noted that all of his land is-in
Zone 4 of the air noise zones. He would install the same
noise attenuation measures as he did in Lexington Heights but
the roof line would be more rustic in keeping with the
character of the land. He noted that the aesthetics along
the eastern boundary have been resolved with the King family.
He advised that he is proposing 592 units in 4 phases, with
about 150 units added per year. Total occupancy will be
about 1,000 people.
Several questions arose regarding Concepts B and D relative
to the King land and whether apartments would be extended
around the pond if the King land is bought by Mr. Riley.
Mr. King noted that Concepts A, B, C, and D aren't even
closely related and he felt that the Planning Commission
would be premature in approving a rezoning at the present
time.
Chairperson Kruse noted that the Planning Commission is at
the end of its 60 day time period for a public hearing. 1
Riley felt that the Commission should make a decision tonigc��
so that he wouldn`t have to return again, and said that he
hoped to be able to start construction yet this year.
Mr. Dale Glewwe, 720 Mendota Heights Road, stated that he
had been notified of the McNulty project several years ago,
and again for this project. He fel.t that development should
be encouraged and not allowed to die as McNulty's did. He
suggested that the Planning Commission should move ahead
at some point.
Mr. King stated that he was not against development of any
kind.
There being no further questions or comments, Commissioner
Morson moved to close the public hearing at 10:25 P.M.

Commissioner Morson moved to recommend denial of the rezoning,
conditional use permit, variance, and amendment to the
Comprehensive Plan, based on the pending South East Area
Study before the City Council.

CASE �185-18, ALVAREZ, Mr. and Mrs. Robert Alvarez, 1167 Dodd Road, were unable
' VARIANCE to be present for the requested variance, but a good friend
of their's appeared in their place. The Alvarez's requested
a variance to the height structure for an elevated child's
play house constructed in Mr. Alvarez's back yard. He
wished to roof the structure, with the top of the gable 21 fee
from ground level. A 15 foot maximum is measured at the
mean height of a gable roof which woulfl appear to be
approximately 18.5 feet. Thus the height would be 3.5 feet
above the required maximum. Signatures of three of the
adjoining neighbors were submitted in approval of his
proposal.
Commissioner Morson moved to recommend approval of a 3.5
foot variance to the height structure as requested.
Commissioner Burke seconded the motion.

CASE 85-19, PALMER Mr. Jerry Palmer, 1515 Vandall Street, was present to request
WETLANDS PERMIT approval of a 20 foot setback from a dedicated street, in
order to allow construction of a home on Lot 1, Block 1,
Noack Replat. He noted that no soil tests had been performed,
even though his lot is abutting a wetlands area. He stated
that the proposed basement will be four feet below grade.
Commissioner McMonigal noted that two homes one block away
on 3rd Avenue have no basements and run pumps 24 hours a day.
Mr. Palmer noted that he spoke to the homeowner two lots
south of his and he has no water problems with their split
level home. Chairperson Kruse suggested the applicant
investigate the water table on his lot.
Commissioner Burke moved to recommend approval of a 10 foot
variance to the 30 foot setback to 3�Z Avenue right-of-way,
waiving the public hearing requirement and recommending
approval of the wetlands permit as requested.
Commissioner Hennint� seconded the motion.

CASE ��85-20, ETTINGER� Mr. Ronald Ettinger, 1588 South Victoria, was present to
CONDITIONAL USE PERMIT request approval of his request for a minor conditional
FOR FENCE use permit to allow replacement of a rusty, barbed wire
fence with a split rail cedar fence on the north and east
portions of his property on Victoria.
Commissioner Stefani moved to recommend approval of the minor
conditional use permit �to allow installation of a split rail
cedar fence up to 48 inches to the top of the post and
waiving the public hearing requirement.

The Planning Commission recommends that the City Council waive the
requirement for a public hearing and grant the Country Day School the needed
Conditional Use Permit.

Jim Ri1ey canvinced the Planning Cammissian to act on his Rezaning,

recommend denying it {a 4-2 vote). The majority of the Planning Commi.ssion

Staff was unable to publish the City Council hearing in time for the

DISCUSSION:
The Planning Commission at their July meeting reviewed a wetlands
permit application from the Palmer's. (See attached staff reports) �There
was some concern conveyed to the Palmers about adequate precautions being
taken to assure they have a dry basement.
RECONII�IENDATION :
The Planning Commission recommends to the City Council that a Wetlands
Permit be granted to allow Mr. and Mrs. Palmer to construct a new home at
1515 Vandall Street and that a 10 foot side yard variance be granted on 3
1/2 Avenue.
ACTION REQUIRED:
If Council wishes to implement the Planning Commission recommendation

SUBJECT: Economics Laboratory Subdivision
Case No. 85-15
DISCUSSION:
The Planning Commission conducted a public hearing at their July
meeting to consider the Econo mics Laboratory subdivision request (attached).
There were several neighbors present at the hearing and their major concern
was that there would be increased traffic on Wachtler Avenue as a result of
this increased development. The residents also recalled a promise from
Economics Laboratory at the time they got approval to construct their second
building, to maintain a specified amount amount of open space as a buffer
from the residential areas. That building was constructed in 1969 and staff
has researched the City Council minutes for sometime previous to the
construction for any Council action on the permit. We were unable to locate
any.
RECOMNIENDATION :
The Planning Commission recommends that the City Council allow
Econom:i.cs Laboratory to subdivide their land as requested.
ACTION REQUIRED:

Mr. Dean Flackey, owner of Premier Builders, Inc, has submitted plans

Heights. As Council may recall, the Lencowski's were granted a variance to their
lot size on November 8, 1984. (See attached letter advising Council approval).
HISTORY
At the time the variance had been reviewed and a memo submitted to Planning
Commission and City Council, it was not known by staff that there were wetlands
on the Lencowski property. A wetlands area was not addressed by Planner Dahlgren
in his report either. A low area on the property was noted by me on July 16, 1985,
during an onsite visit of an adjacent lot which a contractor was proposing to move
a home on to. I then came back to the office and checked the off icial wetlands
map and found that this low area to the rear of the lot was designated as wetlands.
On July 18, 1985, the permit application and plans had been submitted for
permit approval for the Lencowski lot. I then called the builder and made him
aware that a wetlands permit would be necessary prior to issuance of the requested
building permit. �
DISCUSSION
In order to issue the building permit as requested, the builder and Lencowski's
would have to meet with staff and Planner Dahlgren, submit their materials by
August 16, meet with the Planning Commission on August 27 and meet with the City
Council on September 3. This is the normal process. However, the Lencowski's
were advised by the City that all that was necessary for a building permit was to
submit plans. It should be noted that although the construction will occur within
10 feet of the wetlands boundary, staff can see that there will be no adverse
affect to the wetlands system. (See attached d�awing). NOTE: The applicant
should be re�i�ded that no filling� of �h�.�.w�t].ands-area is veing� con�idered,
only construction of the home 10 feet frem tre wetlar._ds boundary.
The applicant has requested that staff recommend that Council waive the
Planning Commission review of the wetlands permit and that Council consider the wetlands
permit at the August 6th City Council meeting.
ALTERNATIVES
l. Council may review the wetlands permit on August 6, or
2. Require applicant to meet with the Planning Commission on August 27, and
with the City Council on September 3.

RECOMMENDATION
Staff supports the applicants request to have Council consider the granting
of the wetlands permit due to the fact that the wetlands, in staff's opinion, won't
be adversely affected. In addition, the extra amount of time to go before the
Planning Commission, then the City Council, would impose the hardship of a late
start on construction of the Lencowski's proposed home.
ACTION REQUIRED
If Council wishes to implement the staff recommendation of waiving the
Planning Commission review of the wetlands permit, it should pass a motion approving
the wetlands permit allowing construction of the home to be 10 feet from the
wetlands boundary and waiving of Planning Commission review.

On the consent agenda of July 2nd, Council approved the sale of two
surplus squads, 1983 Dodges, at the August Hennepin County Auction. We have now
had second thoughts.
STAFF CAR
First, staff proposes that we keep one car as a"pool" vehicle for City
employee use. There seems to be increasing occasions where employees are asked
to drive on City business (i.e., post office, engineering f ield inspections, elections,
summer code enforcement intern). Because of IRS regulations, we recently reduced
our reimbursement rate to 20.5G, which is inadequate compensation. Having a staff
car available would make much of the personal mileage reimbursement unnecessary.
The cost of keeping the vehicle would be the foregone $1,200 to $1,500 sale
price, plus minor incidentals for City decals, tax-exempt plates, etc.
SALE OF SECOND CAR
We are also proposing that, rather than participate in the Hennepin County
auction, we simply advertise for sealed offers. Hennepin County requires that we
provide two employees for the entire eleven hours of the auction. Obviously, it
seems a little ridiculous to pay 22 hoursof overtime to sell one car!

July 25, 1985
Mr. John Coonan, 2303 Swan Lane has came in to see me on several
occasions to complain that the City's storm ditch adjacent to his property
(see map) is eroding and causing his lawn to slide. This sliding has made
depressions in his yard and damaged his sprinkler system. Mr. Coonan would
like the City to correct the situation. His proposals are to either extend
the pipe closer to Rogers Lake and fill the ditch or build a wall along his
side of the ditch to support his lawn. I promised Mr. Coonan to do a
"quick" study of the situation and present some estimated costs to the City
Council so that he could ask for action.
We looked at two alternatives; one, extend the pipe all the way to
Rogers Lake and fill the ditch (Scheme I) and two, extend the pipe a short
distance to reroute the drainage ditch farther away from Mr. Coonan's property.

The City has been dealing with the residents of the Cherry Hills 2nd
Addition for several years concerning runoff coming across their subdivision
for the Cherry Hills lst Addition. Staff proposed several alternatives last
October and the one selected for further study involved plugging a County
culvert. The County has been slow to respond to a request from the City and
residents for assistance/approval on that alternative.
Staff therefore has been meeting with the residents to formulate a
different plan. We have now formulated a scheme that utilizes a low area on
the Wachtler farm south of the Cherry Hills 2nd Addition (see map). The new
plan proposes to regrade the Wachtler property and direct all of the Cherry
Hills lst Addition water into an existing low area. An overflow ditch would
be installed on the west end of the low area to allow for the escape of
excess water in the event of extreme flooding. The approximate cost for
this option including fees and easement acquisition is $12,000. The resi-
dents and staff both feel this new proposal is the best alternative. The
affected residents will be at the meeting to discuss the alternative and
request action.
Funding of this work is still an unresolved issue. There are two
methods that come to mind.
1. An assessment project with the Cherry Hills lst Addition people
involved.
2. The Wachtler property is identified as a park site and the grading
that is proposed might be useful toward the future park develop-
ment. The cost of the regrading might be tied into development of
the park. However, this would mean postponing the project until
(and if) the City acquires the Wachtler property.
ACTION REQUIRED:
Review this current scheme with the residents and select a course of
action.

if the chairpersan is already designaCed. Therefare, I would urge that Council
strongly cansider selecting one of the appointees to serve as chairperson.
I expect that the arch3tect and s�aff will be prepared to call the f irst
meeting of the comm3ttee either the last week in August or the first week of
September.

Staff has recently completed preparation of the plans and specifications for
Mendota Heights Road improvements. These improvements would involve upgrading the
roadway from a 24 foot wide rural street to a 52 foot wide urban street with curb
and gutter. In addition, an 8 foot wide bike trail would be installed along the
south side of the upgraded street.
The estimated construction cost for the street improvements, storm sewer
improvements and the bike trail is $140,000. Our MSA funding would cover street
and sewer improvement, and the County has offered to fund the bike trail construction.
This would still leave about $400,000 unsp.ent in the MSA account.
RECOMMENDATION
In order for the Mendota Heights Road improvements to be completed this year,
staff feels it would be necessary to receive bids by August 29, 1985. 'i'herefore,
staff recommends Council approval of plans and specifications at the August 6th
Council meeting.

Mr. Daniel Patrick Barrett, 1654 Diane Road, has applied for appointment
to the Mendota Heights Fire Department, and was approved by the department at
their general meeting of July 17th.
Dan is a 1973 graduate of Simley High School in Inver Grove Heights. He
and his family have lived at their current Mendota Heights address for approx-
imately two years. Dan is employed with Republic Airlines as a supervisor
over the ground service cleaning and catering crew, and was encouraged to join
the Mendota Heights Fire Department by a co-worker, Randy McNamara.
Dan has been cleared by the Airport Medical Clinic for duty as f irefighter.
His appointment will bring the strength of the department to 32 of the 34
authorized positions.

SUBJECT: Sewer Rate Increase
For the past three months we have been exploring methods suggested to
revise our Sewer Service Rates for the second half of 1985 and for 1986 to
. meet the proposed sewer billing increase from Metropolitan Waste Control
Commission.
We have explored in detail the four methods proposed in our memo of
July 11 along with several other methods to arrive at a residential billing
total of about 270,000 and commercial billings of about 155,000. Based on
the following distribution of users:

It would appear that option three of our memo would come the closest to
our needs for a balanced increase.

the present 23.40 or 31 percent. This would be about in line with the average
for our five neighboring communities. Commercial and Industrial rates would
have a 20 percent base increase in meter charge with the same,.90 per 100 cubic
feet for volume.

Our suggesiian included in the attached resalution is•a surchage far users
that have roof drains, �oundation drains or sump pumps connected to the sewer.
Whiie ii will be difficult ta identify aiI such users, we feel that this
source creates a goad share af our inflow problem and such a charge would
help offset the additional use fram this source. The charge propased is far
an additional minimum billing af $22.00 per quarter.
ACTION •
If Council agrees to modify rates effective July 1, 1985, adopt
Resolution 85- . First billing under revised rates wi]1 be October 1, 1985.

SUBJECT: Sign Permit for Video Update in Mendota Plaza
INTRODUCTION
Attracta Sign Inc., on behalf of Video Update, a vide tape rental business
located in the Mendota Plaza Shopping Center across from Country Club Market,
has submitted an application requesting approval of a sign permit.
DISCUSSION
I have reviewed the application and find it to be in compliance with the
City`s sign ordinance. The sign will be installed on the building facing TH 110
and it will be three feet high and 18 feet long (54 square feet). The maximum
allowable sign size is 100 square feet.
RECOMMENDATION
Staff recommends approval of the illuminated sign permit as requested.
ACTION REQUESTED
If Council wishes to implement staff's recommendation, it should pass a
motion approving the requested 54 square foot sign permit to Attracta Sign so
that they may install Video Update's sign. �

RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS AND AUTHORIZING
ADVERTISEMENT FOR BIDS FOR CONSTRUCTION OF MENI}OTA HEIGHTS ROAD
BETWEEN LEXINGTON AVENUE AND TRUNK HIGHWAY 55
(IMPROVEMENT N0. 84, PROJECT N0. 6)
WHEREAS, the City Council has authorized the construction of Mendota Heights
Road between Lexington Avenue and Trunk Highway 55 and such improvements as
descibed as follows:
The construction of street improvements consisting of the grading,
stabilization, drainage and bituminous surfacing, and the construction
of concrete curbs and gutters on the street in the area above de-
scribed;
and
WHEREAS, the cost of the construction of such improvements will be paid from
apportionments to the City from the Municipal State Aid street fund pursuant
to Minnesota Statutes, Section 162.09 et. seq. and Dakota County; and
WHEREAS, no assessments are proposed in connection with such construction;
and
WHEREAS, the City Council has heretofore directed that the City Engineer
proceed with the preparation of plans and specifications thereof; and
WHEREAS, the City Engineer has prepared the plans and specifications for
said improvements and has presented such plans and specifications to the
City Council for approval.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That it is advisable, feasible, expedient and necessary that the
City of Mendota Heights construct the above described improvements.
2. That the plans and specifications for said improvements be and they
are hereby in all respects approved.
3: That the City Clerk with the aid and assistance of the City Engi-
neer be and is hereby authorized and directed to advertise f or bids for
said improvements all in accordance with the applicable Minnesota
Statutes, such bids to be received at the City Hall of the City of
Mendota Heights by 10:00 o'clock A.M. on Thursday, August 29, 1985, at
which time they will be publicly opened in the City Council Chambers of
the City Hall by the City Engineer, will then be tabulated, and will
then be considered by the City Council at its next regular Council
meeting.

RESOLUTION SETTING SEWER RENTAL CHARGES FOR SINGLE FAMILY
DWELLINGS, MULTIPLE DWELLINGS, AMENITY STRUCTURES, SCHOOLS,
CHURCHES, PUBLIC BUILDINGS, COMMERCIAL AND INDUSTRIAL USERS
WHEREAS, Ordinance No. 803 provides that the sewer rental charges for the
use of the City municipal sewer system by any single family residenc�, duplex
school, church, public building, multiple family dwelling, commercial or
industri.al user shall be determined from time to time by Resolution of the City
Counci�l ; and
WHEREAS, it is desirable that users pay on the basis of sewage generated; and
WHEREAS, a portion of the Mendota Heights real estate tax is levied to
supplement the operation of the City's utility system, and this portion of the
tax averages approximately 14 percent of the sewer service charge.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights that the following schedule of sewer rates be established:
I. Single Family Residence, including Townhouses with individual sewer and
water services: -
A. Dwellings served by a central water system:
1. Sewer charge shall be based on water useage during the
immediately preceding November, December and January based on
the total of the following:
(i) A minimum of $22.00 per quarter shall be charged for
water useage of 20 100 cubic feet or less;
(ii) Water useage in excess of 20 100 cubic feet shall be at
the rate of 90� per 100 cubic feet. For the purposes of
this resolution, 100 cubic feet shall be deemed equal to
748 U.S. Gallons.
B. Dwellings served by on-site, individual wells shall pay a flat
charge of $22.00 per quarter.
� C. Owellings with a roof drain, foundation drain or sump pump
connected to the municipal sewer system shall pay a surcharge
for such use equal to a minimum .charge of $22.00 ner quarter.
II. Residential Complexes, including Multiple Dwellings, Duplexes, Townhouses,
Apartments, Condominiums, and Amenity Structures with less than one sewer
and water service per dwelling unit:
A. $22.00 per Dwelling Unit per quarter, or

B. 90¢ per 100 cubic feet of water used in the immediately preceding
November, December and January quarter, whichever is iarger.
Commercial, Industria], Church, Public Building or Schaol
A. Sewer rental shall be based on water used during the previaus quarter.
The rate appiicable shall be as follows:

immediately following the last month of the quarter.
BE :IT FURTHER RESOLVED that Resolution No. 83-102, adopted on November 15th,
1983, be and the same is hereby rescinded in its entirety.

The area proposed to be assessed for said improvements is situated
within the City of Mendota Heights in Dakota County, Minnesota, and is
more particularly described as follows:
Land abutting the East line of Section 23, Township 28 North,
Range 23 West and South of Wentworth Avenue (CR 8) and North of
Bachelor Avenue together with the West 211.74 feet of the East
566.85 feet of Lot 36, and the West 1 acre of Lot 36, together
with the East 1 acre of the West 2 acres of Lot 36, as well as
Lots 39, 40, 41, and 42, of Auditors Subdivision No. 3, Section
24, Township 28 North, Range 23 West.
It is proposed to assess every lot, piece or parcel of land benefited
by said improvements whether abutting thereon or not based upon bene-
fits received without regard to cash valuation in accordance with the
proposed assessment roll thereof which is now on file with the City
Clerk of the City of Mendota Heights at the City Hall of said City and
which assessment roll is open to public inspection.
Persons desiring to be heard with reference to the proposed assessments
should be present at this hearing,
Written or oral objections to said proposed assessments will be con-
sidered at the meeting.
An owner may appeal an assessment to District Court pursuant to Minne-
sota Statutes Section 429.081 by serving notice of the appeal upon the
Mayor or Clerk of the City within 30 days after the adoption of the
assessment roll and filing such notice with the District Court within
10 days after service upon the Mayor or Clerk; however no appeal may be
taken as to the amount of any individual assessment unless a written
objection signed by the affected property owner is filed with the City
Clerk prior to the assessment hearing or presented to the presiding
officer at the hearing.
You are hereby advised of the provisions of Minnesota Statutes, Sec-
tions 435.193, 435.194, 435.195 which provides for the possiblity of a
deferral of special assessments in the case of hardship for senior
citizens.

LEMAY LAKE DRATNAGE The Council acknowledged end discussed a memo from the
Public Worka Director and a letter from Mr. Timothy
Kuntz, attorney for Mr. & Mrs. Miles Bredvold,
relative to LeMay Lake flooding. Mr. Kuntz, preaent
for the diacussion along with the Bredvolds and their
consultant engineer, Bill Price, asked that staff be
� directed to prepare a feasibility study to determine e
long-term solution to the problem and alao a8ked that
the City establiah a temporary, emergency outlet to
provide relief next apring.
Mr. Price stated that the water was within a foot of
the Bredvold driveway and garage last apring and that
a 100-year old oak hns been loat because of the flood-
ing. He informed the Council that there has been an
inordinate rise in the lake level in the recent past.
He stated that the owners of the property across Lake-
view from the Bredvolds have also expressed interest
in getting something done and stated that in his
opinion an outlet is needed.
Public Works Director Danielson confirmed that there
is no lake outlet at this time. He stated that some
of the requested study has already been done as part
of other pro�ect atudies but indicated that funding a
solution is a question and that the assessment
district area. £inancing and conatruction timing all
need to be addressed.
After discussion, Mayor Lockwood moved to direct stafi
to prepare a report on temporary outlet/emergency
flooding plana, to prepare a feaaibility study on lake
level control and to meet with the Bredvolds and the
City Planner relative to a wetlands permit applicatior
for driveway filling.

wetlands hearing requirement and grant approval of a

In response to a question from Councilmember Blesener,
Mr. Hayne stated that Economics Laboratory ha8 no
control over what will go on the lot - that the only
control is the City's Zoning Ordinance. In response

Works Director Danielson atated that sanitary sewer
crosaes the property line and an easement is
necessary.

The Council expressed concern over the water table and
cautioned the Palmers about potentisl wet basement
problems which they might experience.

1515 Vandall Street 20 feet from 3 1/2 Avenue.

CASE NO. 85-10, Mr. James Riley waa present to inform the Council on
MENDOTA HEIGHTS his proposal to construct an apartment development on
ASSOCIATES property he owns located on the south aide of Mendota
( Heighta Road between Dodd and Delaware. He atated
� that he proposes to construct a 600 unit apartment
complex in four phases, 2 buildings per phase, over
three to five years. He in£ormed the Council that he
proposes a density of 8.5 units per acre in contrast
to the Lexington Heights Apartment complex 12.5 unit
per acre denaity and indicated that because of
potential tax law changea in January, approvsl of the
pro�ect is necessary thia year. .,.,
Police Chief Delmont responded to a Council question
over the number of calls for aervice from the
Lexington Heighta Apartment complex to the Police
Department. He indicated that the level of police
staffing should be 1.5 police officers per 1,000
residents and that if the pro�ect were approved the
City would need to hire one additional police officer.
Councilmember Blesener wss concerned that, i£ the
pro�ect were approved and constructed, 10i of the
City's population (a population incresae of 1,000
apartment residenta) would have no community identity.
Mr. Irving Clark, owner of 9 acres of property
immediately west o£ the Riley site, stated,that he
cannot be present for the August 20th hearing on the
proposal and asked to be permitted to comment this
evening. He pointed out that the City Planner has
been retained to prepare a study o£ the southeast area
and that the draft of the study, present to the
Planning Commisaion, presented four concepts for
development, one of which was apartments.���He felt
that there is no way the City can expect single family
development to go along the freeway and that it aeems
that a reaaonable tranaition from the reaidential area
to com�mercisl development would be to tak�•the step
requested and develop multiple, thereby avoiding
pressure for commercial development. He atated that
he underatanda the concerna about 1,004 new people in
multiple dwelling unita but suggeated that.,what is
changing the character o£ the community is��not
multiple development but rather the freeways. I

the proposal, indicated that he is not involved wi

while two Park Commiasion members had indicated
interest, each of the commissions should be
represented by only one member, and that A1 Singer
should be the Park Commission representative.

1. The property in question is a 3.163 acre si�e, originally
platted as Lot 7 af th� Summerset Hills Addition. Xou will
note from Iooking at�the attaehed sketeh indicating the
property laeatian and the properties in the vicinity of the
site, that this pareez zs the largest lot of a series of
very large iots in �his ariginal subdzvisian. Most of these
lots are occupied by substantial homes occupying �the
original lots.
Mr. Spangers' Lat 7�is, of course, capable of further
develapment. This development gotential was largely ereated
by the eanstruetian af Marie Avenue whieh was planned as an
eastwest tharoughfare in the original comprehensive plan
eonnecting the east side to the west side of 35E for �he
neighborhoods north of.Trunk Highway 11Q.
The land division, of �course, is further eomplicated by the
existence of the drainage way thraugh the site whieh,
unfortunately, in the plan proposed is not uti3ized as a
rear lot line. If the plan is approved as submitted, it
will be very important=ta aequire easements in this drainage
way so as to proteet the rights of the City to its
perpetuity and maintenanee,
We met with represent�tives of the applieants at City Hall
in the process of� our normal review of planning
applieatians. We suggested that the land south of the creek
(fronting on Valley C�rve} should be developed into two lots
rather than three. The suggestion is that Lots 5 and 6 be
made a sin�3e lot wi�h a rear lot line at the creek
alignment. This will `a7.so make it easier for a further home
site to conform more r�early to the 100 foot setback required
in the We�lands Ordinance. A secondary benefit will be one
of ereating a 2arger illusian of spaee between homes, more
consistent with the large lots to the south of Valley Curve.
If this were done, the three new lots proposed on Marie �
Avenue would have greater depth with a rear lot line at the
ereek. You will note that the depth of two of these lots
(between Lots 2 and 3) is only 122 feet.
Your Publie Works Dir�etor points out that a publie sewer
project should be in'itiated to provide services for this
plat. They also note the need for the easement along the
creek alignment. Another serious matter of concern (noted
by the Engineers) is a question of soil conditions. Where
bad soil is suspected is appropriate to require soil tests
prior to approval of the plat. We suggested such tests
should be taken in as much as their results can materially
affect an appropriate and practical design for the use of
the land. .
In as much as an existing house is setbaek substantially
further than the required 30 feet, aecording to the City
Zoning Ordinance, this: would impact on the future setbacks
' of contiguous Lots. In this case, we do not feel that is a
' significant problem but the owner should be made aware of
this condition. An appropriate time to consider variances
will be as the Lots are proposed for specific home
construetion. Under no.rmal conditions, it is not desirable
to plaee single fam�ly home frontage on major local
thoroughfares such as �arie Avenue. It would, however, in
this case be impractical to gain access to the land north of
the creek off of Valley Curve. There are, as you know, a
number of homes fronting on Marie Avenue to the east
partieularly. It would appear that in this case such
frontage will be unav�idable. In some cases, communities
e approved plats with requirement that there would be a
turn-around in the driveway so as to eliminate the need to
back out onto the major thoroughfare. If the lots fronting
on Marie Avenue are made deeper (by extending the rear lot
line to the Creek) these homes could be set baek further
' than the 30 feet and appropriate provisions for a driveway
turn-around on the lot could be made.

SYNOPSIS OF MONTHLY RUNS
Ttte Fire Department resganded to 22 calls duzing the month of 3uly. Five ai the
calls were grass or brush fires, three af which were an Warrior Drive. The anly fire
that resulted in a monetary Ioss was on July 17. This ca11 invoived a pickup truck
fully involved. The loss was estimated at $240Q.
The two calls in the "other" category invoived a mutual aid call Ca the
Warren Eustis FIouse on Blue Gentian Road. The tanker and ane pumper were called
upon to help fight a fire on the roaf, The secand was to the Ramsey County
Parlc in lower Lilydale, where a tree stump was found burn3.ng. The scene was turned
aver to St. Paul Fire.

The monthly rescue drill was taught by John Lapakko. The class focused on
medical terminology and definition.
