SUBJECT: CAO Modified Site Plan Review for 1055 Douglas Road
DISCUSSION
Mr. Harold Specktor, Specktor Construction, on behalf of Patrick
Brennan, 1055 Douglas Road, has submitted building and site plans requesting
approval of a building permit to construct a 14' x 24' three season porch
addition to the rear of the Brennan home (see site plan).
Staff has reviewed the plans and made a site visit and finds that the
proposed addition is well in excess of the required 40 foot setback from a
40% slope or bluffline. In fact, the proposed addition is setback 41'9"
from the rear lot line and staff estimates that a 40% slope is another 40'
to 50` from the Brennan's rear lot line.
RECOMMENDATION
Staff would recommend approval of the permit as requested and waiving of
the $100 CAO modified site plan fee as required by ordinance, since it does
not appear that the Brennan property has any physical characteristics as
definied in the CAO.
ACTION REQUIRED
The action required is if City Council wishes to implement the staff
recommendations to
l. Approve the Modified CAO site plan review
2. Waive the CAO fee
it should pass a motion approving the issuance of the building permit as requested.

The CiGy Cauncil, pursuan� to an application therefor, by resolution
adopted December $, 19�6, appraved the subdivisian af the property
into Parcels A& B by splitting Lat 3. Parcel A is Lot 4 and the
west 30 feet of Lot 3; Parcel B is Lo� 2 and that part af Lot 3
which lies east o� the west 3p feet �hereof. Parcel A is shown on
the survey marked Attachment l; Parcel B is shown on the survey
marked Attachment 2.
Several years ago (probably 1981) the owner of Lot 1, Block 3,
Furlong Addition �ons�ructed improvements consis�ing of, among
others, a concrete driveway. Following cons�ruction comple�ion, iC
was diseavered that the driveway eneroached upon a portion of Lot 2,

Minutes of the Annual Board of Review
� Held Monday, June 10, 1985
Pursuant to due call and notice thereof, the City Council of the City of
Mendota Heights met as the Board of Review at 7:30 o'clock P,M. at the City
Hall, 750 South Plaza Drive, Mendota Heights, Minnesota. Mayor Lockwood
called the meeting to order at 7:30 P.M.
Mayor Lockwood called the meeting to order at 7:35 o'clock P.M. The following
members were present: Mayor Lockwood, Councilmembers Blesener, Cummins and
Hartmann. Councilmember Witt arrived at 7:37 P.M.
Mayor Lockwood turned the meeting over to Assistant County Assessor Bill
Peterson. Assessor Peterson informed the audience that he and several ther
assistant assessors were present to review� the estimated 1985 marke�alues.
Mr. Peterson stated that the Assessor's office has attempted to raise the
estimated market value level in Mendota Heights to a more equitable basis with
the rest of the County. He indicated that the estimated values for 1985 have
been increased by 5% on single family, 10% for townhouses and commercial/
industrial properties and 10% on vacant land. A sales ratio study indicated
that Mendota Heights property valuations ran at 80% while 84 to 85% is the
median County ratio. He stated that state law requires that estimated market
values be 100% of market value: the County has not arrived at 100% because the
market is not stable enough. He indicated that unless the County raises the
valuations to a high enough level the State will initiate an increase. Mr.
Peterson informed the Council that a physical re-evaluation of the City will
occur this year and that the Assessor's goal for estimated market values will
probably be 87%.
The Board acknowledged receipt of letters on behalf of Mr. & Mrs. Robert
Ridder, Mr. & Mrs. Frank Muehlegger and Mr. & Mrs. Roy Svee appealing market
values placed on their properties.
Mr. Peterson distributed copies of a comparison of tax assessments for 1985
values. Mr. Peterson and the assistant assessors then met with individual
property owners wishing to discuss valuations.
ADJOURN There being no further business to come before the Board,

SIIBJECT: Appointment of Summer Code Enforcement Intern
At the meeting of May 7th, Council authorized the expenditure of up to
$3,000 for the purpose af employing a summer code enforcement intern. As
you will recall, the purpose zn hiring tfiis gersan is ta 'istep up" our
enforcement of zoning and nuisance ordinances, such as lots avergrown with
weeds, 3unk vehicles, etc.
We sent notices of this internship oppartunity to area community colleges
that have a code enforcement program, and received �wo resumes in respanse,
one from North Hennepin Gommunity College in Braoklyn Park, and one from Inver
Hills in iver Grove Heights. Code Enforcement Officer Berg and I interviewed
the applicants on the morning of Monday, June lOth.
After completing our inCerviews, we are recommending to Council the
apgaintment of Mr, Paul Heimkes. As a resident of narthern Eagan, Mr. Heimkes
has a��ended District 197 schools, located in Mendota Heights, and is quite
familiar with the area. He is near completion af his Associate of Arts degree
3n Building Inspection/Construction Management at Inver Hills College, and
will be completing his degree next year. Holding this summer internship with
Mendota Heights wi12 enable him �a gazn bo�h direct code enfarcement experience,
and meet a hours requirement for obtaining his Level I certification as a
Minnesota Bui3d3ng Official.
Mr. Heimkes is currently employed as a draftsperson with Thomgson Lighting
Protection Company in Lilydale, and inzends to continue that emplayment on a
part-time basis whi2e warking for us. While this might �nitially sound like
a conflict, I think it is actually benefi�ial to us. As our first summer intern
code enforcement officer, we are uncertain as to how much time the job is going
to take. Since Paul wil� have back-up empZoyment, we wi11 feel less obligated
to praviding him with a full-Cime summer job, in the event we find it does not
take that many hours.
Paul will be present at Tuesday's Council meeting to be introduced to the
Council.
Council had indicated that in connection with hiring a summer cade enforce-
ment intern, it wished to notify the public of our increased efforts at code
enforcemenC. We will prepare a press release for the local news media, and will
also write an article far the Heights HiliCes, which wi11 be out in early to mid-
July.

BACKGROUND
June 11, 1985
At its April 21st meeting, Council considered a final draft of the
proposed Comprehensive Guide Plan Amendment - Housing Element. Concern
was raised about adequate notice to surrounding neighbors of possible
deviation from zoning standards (i.e., 15� density and postponed garage
construction) to encourage low and moderate cost housing.
Council requested Councilmembers Blesener and Cummins to work with
staff to redraft the proposed language to address these concerns. Attached
for your consideration is a proposed amendment, drafted by staff and approved
by Jann and Buzz.
�;EW SUBDIVISION
:The first attachment is page 23 as submitted on April 21st. To insure
that subdivision 3d. applies only to new developments, and that the surrounding
property owners have an oo�ortunity to be aware of a�d cn:;�eient on ar_y such pro-
posed developmenC, it ie recommended that the first line be amended as follows:
From: "For single family homes the City will grant ..."
To: "For new single family subdivisions the City may grant ..."
As all applications for subdivisions require a public hearing before Planning
Co�ission, the surrounding public would have ample opportunity to be aware of
and comment on the proposed project.
EXISTING SINGLE FAMILY LOTS
Although the density issue would not normally apply to existing platted
lots, the garage construction postponement might.
The requirement of a garage (2 car with 440 square feet) was just adopted
in January, 1983; prior to that time a garage was listed only as a permitted
accessory use to a principal structure. Section 5.5 (copy attached) of the zoning
code provides for the variance process from strict enforcement of the code and
it is staff's opinion that waiver of the garage requirement could be processed
under this section, particularly if specifically referenced in the Comprehensive
Plan. To allow for that option, it is suggested that a new subsection 3e. be
added as follows:

3e. For existing platted single family lots, the City may consider
a variance to waive the requirement for construction of a garage,
where such waiver results in construction of a house affordable
to a moderate income household, and is not inconsistent with the
character of the surrounding neighborhood. Space for a future
garage and driveway constructed with adequate parking shall be
required.
This would provide the Planning Cotmnission and Council the opportunity
to review each case individually, and require whatever neighborhood concurrence
they deemed appropriate for the situation. We did not feel a formal public
hearing requirement would be advisable because:
1. The cost to the applicant to provide an abstractor's certificate
of surrounding properties would offset some of the savings
that is supposed to create the affordable house.
2. It could be potentially embarassing to the applicant family to
"advertise" the fact that they are applying for a variance on the
basis of their moderate income.
Existing subsection 3e. then becomes 3f.

The final attachment is a summarized redraft incorporating all of these
changes.
PAGE 20 CHANGE
Mayor Lockwood has pointed out that the beginning language on page 20 is
redundant. Staff recommends resolving this by deleting the second paragraph
that begins "The cost of market rate housing ..."
ACTION REQUIRED
If Council concurs with the above suggestions, it should pass a motion
approving the Comprehensive Guide Plan Amendment - Housing Element as amended
on pages 20 and 23, and forwarding it to the Metropolitan Council. �

PARK AND RECREATION COMMISS�ION
P1INUTES, JUNE 11, 1985
The regular meeting of the Park and Recreation Comnission was called to
order by Vice-Chair Schneeman at 7:30 P.M. The following'members were present:
Schneeman, Goffing, Knittig and Singer. Absent were Leffert and Stein. Also
present was Jim Danielson.
APPROVAL OF Citing the need to contain more information than was in-
MINUTES cluded in the May 14 minutes, the Commission directed
the Secretary to follow the same style as in previous
meetings. Upon changing "Johnny on the Spot" to portable
toilet in the P4aintenance Report, the minutes were approved.
BIKE TRAIL BID Jim Danielson reported that Preferred Paving of Waconia
was awarded the bid for the portion of the bike trail on
Lexington Avenue. Their's was the lowest of seven bids
ranging from $53,772 to $92,000. They are scheduled to
start on Monday, June 17. A ground breaking ceremony with
City dignitaries, Commission and Company Representatives is
scheduled for 1:00 P.M. at Roger's Lake Park.
Related to these developments, Mr. Curley has agreed to
allow the City to use his lot as part of the proposed bike
trail between Lexington Avenue and Mary Adele. However,
the license may be revoked at any time.
I.NFORMATION UPDATE The Commission reviewed the information update sent by City
Administrator Frazell.
Tree Transplating - While the Commission applauded the use
of the trees, they felt that this could set a precedent
for other sections of park property.
I-494 - The Commission was brought up to date on the
potential plans for development between 494 and Mendota
Heights Road. Although the Commission will look at all
planning options, the Commission reiterated its policy
of developing trails as the first priority and developing
� a large multi-use park as the next priority.
Dakota County Grant - The Commission applauded Jim
, Danielson's efforts which resorted in a$15,000 grant
from Dakota County toward the construction cost of the
Lexington Avenue Bike Trail.
MENDOTA�INTERCHANGE The Commission reviewed the memo from Mr. Danielson
TRAIL regarding the inclusion of bike trails in the Mendota
Interchange Project. Trails are being incorporated
into the design but the upgrading of the

questionable.
The Commission reviewed the proposed project of inter-
spersing residences with the Mendakota Golf Course.
Although Howard Dahlgren's proposal calls for a
neighborhood park, the Commission wishes to review
the site plan before a decision is made.
Not all of the Commission members had received the matrix
by which the surveys could be tallied in a consistent
and useful manner. Therefore, members agreed to process
a number of forms after the meeting adjourned and the
results could be disclosed at the July meeting.
The tennis court of Roger's Lake is being repaved.
Since the majority of City Council business does not
affect the Park and Recreation Commission, the Commission
felt that a representative should be appointed for those
particular sessions when pertinent information was
scheduled on the agenda. However, members were encouraged
to attend on there own.
There being no further business to come before the
Commission the meeting was adjourned.

SUBJECT: Sign Permit Request for 1948 Dodd Road (Video King)
INTRODUCTION:
Mr. Kent Stoefen of Video King, Inc., has submitted a sign permit applic-
ation, site plan, and a letter of request. He is seeking the granting of a
sign permit so that he can install a 4' x 24' sign on the building his business
occupies at 1948 Dodd Road.
DISCUSSION:
Video King was granted a sign permit by Council on November 8, 1984, for the
same size sign as noted above. What Mr. Stoefen is proposing with this sign
application is to install a second sign on the side of his building that can be
seen from TH 110 (Note: first sign installed on the Dodd Road frontage). (See
site plan). Mr. Stoefen was in to see Planner Dahlgren and staff about having
an additional sign and Planner and staff were in agreement that this could be
allowed due to the fact that the building has a view from both Dodd Road and
TH 110.
RECOMMENDATION:

SUBJECT: Anderson/Curley Sanitary Sewer and Water Extension
Plans and Specifications, Job No. 8426, Imp. 85, Proj. No. 1
DISCUSSION
At the May 21st meeting, Council accepted the feasibility report for
installing utilities to 1755 and 1751 Lexington Avenue and ordered staff
to prepare the plans and specifications. Because this project is so small,
it is felt that it would be more economical and the City would have better
control if it were completed with two contracts; a utility contract (estimated
to cost $12,000) and a paving contract (estimated cost of $2,500).
The plans and specifications have been prepared for the utility contract
and the plan is attached for your review. The specs will be available Tuesday
evening. Because the estimated cost for both of these projects is less than
$15,000, the contracts may be by sealed bids or by direct negotiation (no adver-
tising requirement).
RECOMMENDATION
Staff recommends that Council approve the plans and specs and order bids.
Staff would receive sealed bids on the utility contract on July 10, 1985. We
would then negotiate with a paving contractor to patch Lexington Avenue and the
driveways after the utility contractor completes his work.

RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS
AND AUTHORIZI�G INVITATION FOR BIDS FOR SANITARY SEWERS AND
WATER SERVICES TO SERVE THE ANDERSEN/CURLEY PROPERTIES
(IMPROVMENT N0. 85, PROJECT N0. 1)
WHEREAS, the City Engineer reported that the proposed improvements and
construction thereof were feasible and desirable and further reported on the
proposed costs of said improvements and construction thereof; and
WHEREAS, the City Council has heretofore directed that the City Engineer
proceed with the preparation of plans and specifications thereof; and
WHEREAS, the City Engineer has prepared plans and specifications for said
improvements and has presented such plans and specifications to the City
Council for approval.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota, as follows:
1. That the plans and specifications for said improvements be and
they are hereby in all respects approvede
2. That the City Clerk with the aid and assistance of the City Engi-
neer be and is hereby authorized and directed to invite bids for said
improvements all in accordance with the applicable Minnesota Statutes,
such bids to be received at the City Hall of the City of Mendota
Heights by 9:00 o'clock A.M., Wednesday, July 10, 1985, at which time
they will be publicly opened in the City Council Chambers of the City
Hall by the City Engineer will then be tabulated, and will then be
considered by the City Council at its next regular Council meeting.�-

SUBJECT: Landscaping Marie/Summit - Open Space
HISTORY
The Council has been trying to develop and implement a landscaping plan
for the Marie/Summit "Open Space Park". The Park and Recreation Commission
has been reluctant to recommend spending the money.
As part of United Properties Southridge Business Center, the City had
to remove 12 ash and spruce trees in a short time frame or lose them.
Therefore, at the 6-4 Council meeting, the Council authorized renting a
tree spade and the trees were moved to the Marie/Summit Open Space on June 5
and 6, 1985.
DISCUSSION
Landscaping of this lot was again discussed at the June llth Park and Rec
meeting. It was the concensus of the Commission that with the addition of these
trees, the landscaping of the lot was now satisfactory. They knew that sumac
bushes were also desired on the lot and the Commission was not opposed to their
planting if it could be accomplished at little or no cost.
A1 Singer offered some sumac bushes from the Dodge Nature Center. City
crews could transplant them to the area as their workload permits. '
ACTION REQUIRED
If Council concurs with the Park and Recreation recommendation, no action
is required. It would be understood that City crews would relocate some sumac
bushes into the area as their workload permits.

SYNOPSIS OF MONTHLY RUNS
The Department responded to '•16 calls during the past month. Five of
these calls were false.alarms, six were medicals, and three were vehicle fires.
The major loss was to a vehicle located at 1639 James�Road. A 1973 Opel was
a total loss. Damage was set at $1,000. �
SYNOPSIS OF MONTHLY TRAINING
The department was split into two groups: one group, taught by Ken Noack,
went out to the Public Works Garage and worked with ladders. The second group,
taught by Jamie Lerbs, went to the Ridder property and drilled in fighting
magnesium fires. This session was an excellent session and everyone learned a lot.
