Adjourn Page No. 3138 October 15, 1991 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Regular Meeting Held Tuesday, October 15, 1991 Pursuant to due call and notice thereof, the regular meeting of the City Council, City of Mendota Heights, was held at 7:30 o'clock P.M. at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Mertensotto, Councilmembers Blesener, Cummins, Koch and Smith. Councilmember Blesener seconded the motion. Councilmember Cummins moved approval of the minutes of the October 1, 1991 regular meeting with corrections. Councilmember Smith seconded the motion. Councilmember Smith moved approval of the consent calendar for the meeting along with authorization for execution of any necessary documents contained therein. a. J• Approval of the list of claims dated October 15, 1991 and totalling $194,666.65. Councilmember Koch seconded the motion. Mr. Joe Maegher was present with respect to air noise. He asked for information on location of the noise monitors, and if any are proposed to be located north of T.H. 110. Administrative Assistant Batchelder responded, stating that permanent monitors were approved for Mohican Court, the Furlong area and the Curley's neighborhood. He explained that MAC will also have "roving" monitors, capable of taking readings from anywhere in the City, available, and that the City has informed MAC of potential sites for the monitors in Mr. Maegher's neighborhood and near Sibley, as well as other sites south of T.H. 110. He informed Mr. Maegher that he does not know the timetable for these monitors. Mayor Mertensotto stated that he believes MAC has indicated it would be at least a year before the movable monitors will be available. He also explained that the purpose of the monitors is to determine noise intensity, not to determine where aircraft are flying. Mr. Maegher was particularly concerned over increased air traffic from runway 4. He asked what has transpired on the air noise issue in 1 v BOND SALE Page No. 3140 October 15, 1991 the past three years and why the City must share in noise over Highland Park. He also asked where the northern boundary of the corridor is. Mayor Mertensotto stated that he has received more complaints about aircraft noise during the test period than he did before the test. He further stated that he does not think much has changed. He pointed out that he has spent four years on the aircraft noise problem and there is not very much the City can do about it - in his judgment the noise in Mendota Heights has not been alleviated because the procedure for non -simultaneous departure has not been followed. He stated that the reason for the noise problem is that the south boundary was established by a memorandum in the 1970's but no north boundary has been established. Although the situation is totally inequitable, there is nothing Mendota Heights can do about it. He suggested that an air noise litigation fund be established in the hope that $25,000 to $30,000 can be raised through contributions from residents. Donations would be recorded so that they can be returned if the fund is not used. The purpose of the fund would be to take MAC and the FAA to federal district court to find out what is so indelible about the southern boundary which the agencies have refused to change. Mayor Mertensotto informed Council of a letter he received from a Northwest Airlines Captain. Mr. Maegher stated that if a litigation fund is established, he will contribute. Mayor Mertensotto stated that he sees no alternative but to attack the matter head on and not at the expense of the tax -payers. He informed Council that he has asked the City Administrator to explore setting up an escrow fund. Council acknowledged and discussed tabulations of bids received for the sale of $1,015,000 Park Bonds and $1,030,000 Improvement Bonds. Councilmember Blesener moved adoption of Resolution No. 91-76, "RESOLUTION ACCEPTING BID ON SALE OF $1,030,000 GENERAL OBLIGATION IMPROVEMENT BONDS OF 1991, PROVIDING FOR THEIR ISSUANCE AND LEVYING A TAX FOR THE PAYMENT Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 BID AWARD, BRIDGEVIEW SHORES 3RD ADDITION Ayes: 5 Nays: 0 HEARING - EASEMENT VACATION (KENSINGTON) Page No. 3141 October 15, 1991 THEREOF," awarding the sale Investment Services, et al, interest rate of 6.053%. Councilmember Koch seconded to Norwest for their low net the motion. Councilmember Cummins moved adoption of Resolution No. 91-77, "RESOLUTION ACCEPTING BID ON SALE OF $1,015,000 GENERAL OBLIGATION PARK BONDS OF 1991, PROVIDING FOR THEIR ISSUANCE AND LEVYING A TAX FOR THE PAYMENT THEREOF," awarding the sale to Piper Jaffray & Hopwood, Inc., et al, for their low net interest rate of 6.255%. Councilmember Smith seconded the motion. Public Works Director Danielson reviewed a tabulation of bids received for improvements to serve the Bridgeview Shores Third Addition. Mayor Mertensotto informed Council that Bernard Friel had notified him that he and Marvin Anderson Homes are involved in a boundary dispute and that the Bridgeview Shores contractor has been working on his property. Public Works Director Danielson responded that he is aware of the dispute but felt that that is a different issue from installation of the public improvements. He pointed out that the lots abutting Mr. Friel's property are large and that the dispute involves the rear lot lines, which would not be affected by the improvement project. Councilmember Cummins moved adoption of Resolution No. 91-78, "RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR CONSTRUCTION OF SANITARY SEWER, WATER, STORM SEWER AND STREET CONSTRUCTION TO SERVE BRIDGEVIEW SHORES 3RD ADDITION (IMPROVEMENT NO. 91, PROJECT NO. 5)," awarding the contract to Excel Utilities for their low bid of $138,922.50. Councilmember Blesener seconded the motion. Mayor Mertensotto opened the meeting for the purpose of_.a public hearing on an application from Centex Homes for vacation of a drainage Ayes: 5 Nays: 0 Ayes: 5 Nays: 0 MENDOTA INTERCHANGE STORM SEWER Page No. 3142 October 15, 1991 and utility easement across the easterly lot line of Lot 5, Block 2, Kensington PUD. Mayor Mertensotto asked for questions and comments from the audience. There being no questions or comments, Councilmember Cummins moved that the hearing be closed. Councilmember Smith seconded the motion. Councilmember Blesener moved adoption of Resolution No. 91-79, "RESOLUTION APPROVING VACATION OF A DRAINAGE AND UTILITY EASEMENT." Councilmember Smith seconded the motion. Council acknowledged a report from Engineer Eckles regarding storm sewer cost sharing for the Mendota Interchange highway project. In his report, Mr. Eckles informed Council that Mn/DOT proposes an $803,000 cost to the City and recommended that the City retain Barr Engineering, for a cost not to exceed $11,000, to prepare a city storm water plan and assist staff in negotiating a significant reduction in the cost proposed by Mn/DOT. Mayor Mertensotto asked how the storm sewer cost will be financed. Treasurer Shaughnessy responded that the Tax Increment Plan provides the ability to finance cost of storm sewer improvements and that he would propose that financing be primarily by Tax Increment funding and to a lesser degree by assessment. He informed Council that it appears that the majority of the land affected is cemetery property. He further stated that while the preliminary figure from Mn/DOT is astronomical, it is hoped that by the time the project is bid the City staff will have negotiated a much smaller final figure. Mayor Mertensotto stated that the letter from Barr Engineering to Public Works Director Danielson is appropriately stated - Barr would make a presentation to Council and Council would select an option. He stated that he does not want Barr to meet with Mn/DOT until Council has discussed and selected an option. Ayes: 5 Nays: 0 REVIEW BOARD PROCESS Page No. 3143 October 15, 1991 Councilmember Cummins moved to reject the Mn/DOT proposal for the assessment against the City and to retain Barr Engineering for an amount not to exceed $11,000, with the understanding that Barr will appear before Council for review and selection of an option before meeting with Mn/DOT. Councilmember Smith seconded the motion. Council acknowledged a memo from Administrator Lawell and a letter from County Assessor Pulju with respect to implementation of a revised Review Board process which would transfer City Review Board duties to the Dakota County Board of Equalization. Mayor Mertensotto stated that he does not agree with the proposal and was not aware that the County went before the legislature for adoption of legislation to allow the revised process. He further stated that while he realizes that the local Board procedures are costly to the County, but in most cases there is a follow up on valuations of properties questioned at the Review Board meeting. He stated that what he does not like is that Council would be giving up rights as a Review Board and another avenue for people to be heard by their local elected officials would be taken away. He noted that he would be willing to work with the County on streamlining procedures so that residents can appear locally and sign written inquiries, and then let the County respond to them and make appointments to see the properties. He did not see the benefit in making the process more removed from the residents. Councilmember Cummins agreed, stating that Council has too few opportunities to meet with the tax payers. He suggested that Council might watch for a year and see what happens in other cities which adopt the new procedures before Council takes the irrevocable step of implementing the procedures. Mayor Mertensotto stated that he agrees that the existing process is burdensome for the Assessor's Office and would gladly work with the County to streamline the process. ADJOURN Ayes: 5 Nays: 0 Page No. 3144 October 15, 1991 Councilmember Blesener stated that she agrees with the statements about tax -payers addressing the Council but that the thrust of the proposal is to better serve the residents so that they do not have to sit at the Board of Review for three or four hours before meeting with an assessor. It was the consensus that the Administrator be directed to communicate to the Assessors Office that they should make it clear to residents that they have the option to submit written notice of objection to valuations in lieu of attending the Board of Review. Staff was directed to include an article in the Heights Highlites to inform residents that Council has elected not to transfer local Board of Review powers to the County. CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA PLANNING COMMISSION SPECIAL MEETING MINUTES OCTOBER 19, 1991 A special meeting of the Mendota Heights Planning Commission was held on Saturday, October 19, 1991, beginning at the City Hall Conference Room, 1101 Victoria Curve. The meeting was called to order at 9:00 o'clock A.M. The following Commission members were present: Friel, Dreelan, Krebsbach and Tilsen. Also present were Public Works Director Jim Danielson and Administrative Assistant Kevin Batchelder. CASE NO. 91-35 KNAEBLE SUBDIVISION CONTINUED PUBLIC HEARING ADJOURN The Commission reviewed the revised preliminary plat plan submitted by the applicant. The Commission discussed the applicant's response to Outlot A, city sewer and water, elevations, tree survey and Wetlands Ordinance. The Planning Commission visited the site at 1760 Dodd Road. At the site the Planning Commission reviewed property lines and the stakes for the proposed houses. The Planning Commission discussed the alignment of the new lots with the neighbors and the owners who were present during the tour. The Planning Commission also toured the Ridder property. The Planning Commission also toured the wetlands area at the end of Ridgewood Court. There being no further business, the Planning Commission adjourned their special meeting at 11:00 o'clock A.M. Respectfully submitted, Kevin Batchelder Administrative Assistant CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA PLANNING COMMISSION MINUTES OCTOBER 22, 1991 - The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, October 22, 1991, in the City Hall Council Chambers, at 7:45 o'clock P.M. The following members were present: Friel, Dwyer, Krebsbach and Duggan. Commissioner Koll had informed the Commission she would be absent. Commissioner Dreelan informed the Commission she would be late. Commissioner Tilsen was unexcused. Also present were Public Works Director Jim Danielson, Planning Consultant John Uban, Administrative Assistant Kevin Batchelder and Senior Secretary Kim Blaeser. APPROVAL OF MINUTES Commissioner Duggan moved approval of the September 24, 1991, Minutes. Commissioner Friel seconded the motion. AYES: 4 NAYS: 0 Commissioner Friel moved approval of the October 19, 1991, Special Meeting Minutes, with corrections. Commissioner Krebsbach seconded the motion. AYES: 4 NAYS: 0 CASE NO. 91-38: LANDKAMER - VARIANCE Mr. John Landkamer was present to discuss his request for a seven foot (7') side yard setback variance and an eight foot (8') front yard "housekeeping" variance to allow construction of a single -stall garage. He explained that he will be demolishing the existing single -stall garage and replacing it with a slightly larger single -stall garage. Chair Dwyer explained that because Mr. Landkamer was unable to receive signatures of consent from all of his neighbors within one hundred feet (100') of his property, that the Planning Commission is conducting a public hearing for this Case. Chair Dwyer opened the meeting for public comment. AYES: 5 NAYS: 0 October 22, 1991 Page 4 with the proposal. She further commented that they are willing to work with the City Engineering Department. She stated that they feel that this plan will be aesthetically pleasing and that preservation of the Wetlands is important. Chair Dwyer opened the meeting to the public hearing. Mr.- Jim Fischer,* 1758 Dodd Road, stated that he has no problem with the proposal. He stated that he wants to see the stream stay the way it is. Commissioner Duggan moved to close the hearing. Commissioner Krebsbach seconded the motion. In response to a question from Commissioner Duggan, Mr. Knaeble stated that the distance between garage to garage will be of the typical house pad. He stated that it will be fifteen feet (15'). Commissioner Friel expressed concerns relating to the preservation of trees and the Wetlands. Mr. Knaeble stated that there has been a tree survey completed. He stated that about four (4) trees will be eliminated. Commissioner Duggan stated that he would like, to see those trees replaced with trees of like value. Commissioner Krebsbach questioned Mr. Knaeble if he anticipates a possible subdivision at the end of the proposed driveway. Mr. Knaeble stated that at this time he does not and that that would entail the City granting easements and more Wetlands Permits. In response to a question from Commissioner Dreelan, Public Works Director Danielson stated that City code requires a minimum of twenty feet (20') between a in length for a driveway. Planning Consultant Uban stated that the existing driveway is fifty-two feet (52') and that the proposed driveway is scaled at forty-two feet (42') Commissioner Krebsbach questioned if future development (to the south) were developed, would a cul-de-sac be constructed. Commissioner Krebsbach stated that criteria should be addressed now for how the City will address flag lots. She stated that in the future other requests may come in to AYES: 5 NAYS: 0 AYES: 5 NAYS: 0 AYES: 5 NAYS: 0 October 22, 1991 Page 5 related to flag lots and the City should start setting standards regarding access, setbacks, preservations of trees, etc. Chair Dwyer stated that he felt the question was one of the comfort level of the Planning Commission in allowing this development and its affect on the surrounding property. Chair Dwyer stated that most concerns have been addressed and this development won't affect the development of the surrounding property. In response to a question from Commissioner Friel, Mr. Knaeble stated that they anticipate construction starting in the Spring. Commissioner Friel moved to recommend that the City Council grant the Wetlands Permit and to approve the preliminary plat conditioned upon Outlot A being combined with the property to the south. Commissioner Dreelan seconded the motion. Commissioner Krebsbach moved to recommend that the City Council consider purchasing the vacant lot on the corner of Marie Avenue and Dodd Road to prevent future development and to provide access off of Marie Avenue. Commissioner Friel seconded the motion. Commissioner Krebsbach moved to recommend that the City Council request the State of Minnesota to replace the trees on the southeast corner of Marie Avenue and Dodd Road with trees of like value. Commissioner Friel seconded the motion. Public Works Director Danielson stated that the State did submit plans for the drainage work they would be correcting on the corner of Marie Avenue and Dodd Road. He stated that the State did not indicate the amount of trees they would be removing. October 22, 1991 Page 6 MISCELLANEOUS Chair Dwyer stated that Commissioner Friel had submitted a letter to both Public Works Director Danielson and himself requesting that the procedure of final platting be given to the Planning Commission for their review at the time of the request. He further stated that Commissioner Friel is requesting that the section on land and reclamation within City Ordinance No. 401 be revised. Commissioner Krebsbach suggested that these items be postponed for discussion at the November meeting so that all of the Commission could be given an opportunity to review Commissioner Friel's suggestions. Planning Consultant Uban stated that he has prepared Ordinances on tree preservation. He stated that if the Commission so desires, he would prepare a sample Ordinance and submit it to the Commission at their November meeting. Chair Dwyer directed City staff to include both a sample of a tree preservation ordinance and Commissioner Friel's letter of request on the November Planning Commission Agenda. None of the calls resulted in any serious property loss to real estate. The department did respond to a vehicle fire on September 3, 1991 at 8:54 P.M. Upon fire department arrival at the Scenic Overlook on Highway 13 the vehicle was found fully involved. Fire investigation revealed that the vehicle was stolen and the evidence at the scene showed that the vehicle fire was intentionally set. A can of what appeared to be lighter fluid was found on the passenger side of the vehicle. The 1984 Mercury Cougar was listed as a total loss. TRAINING The monthly departmental was spent familiarizing all firefighters with the techniques involved in relay pumping. This procedure involves utilizing two or more pumpers and moving large volumes of water from a main water source to a remote area. This type of operation would be utilized in the areas of Mendota, Sunfish Lake and on large structure fires in the Industrial Park. The drill was conducted on Enterprise Drive. The monthly squad drills were reviewing the Standard Operating Procedures for fighting structure fires within our protection area. Firefighters were expected to pull the proper hose lines off the attack truck and supply the attack truck with water from the responding second truck. OTHER NEWS On Friday, September 27, 1991, the department took delivery of its new Equipment/Command Vehicle. CITY OF MENDOTA HEIGHTS MEMO TO: Mayor, City Council and City Admini FROM: James E. Danielson 1) Public Works SUBJECT: Kensington DISCUSSION: Change October 31, 1991 Dr. Owens, whose land was being developed as part of the Kensing- ton PUD, approached the City before the lawsuit settlement was reached with Centex to request that a lot be created including his homesite. He requested that this subdivision be allowed as a lot split (without platting). Council agreed to allow his subdi- vision provided that this lot then be included as a platted lot when the Centex plat was finalized. The Centex PUD was approved before Dr. Owens could finalize his lot split and Dr. Owens' homesite was included as a lot within their plat. This plat is currently being reviewed by the County and they are insisting that Dr. Owens dedicate an addi- tional 17 feet of right-of-way (making a total 50 feet) along Delaware Avenue. Dr. Owens feels very strongly that he does not want to dedicate this additional 17 feet to the County, he has a significant oak tree and some shrubs that would then be on County right-of-way. He feels hoodwinked by the City, he did not under- stand that agreeing to plat his homesite as a lot would require dedicating more right-of-way to the County. He contacted City Hall and the Mayor to complain. I called the County to see what the options were, and the only way the County will not require the additional right-of-way dedication is if Dr. Owens' lot is platted as an "Exception". We therefore agreed to allow Centex to plat Dr. Owen's property as an excep- tion. ACTION REQUIRED: None. For Council information only. Danie Public Works Di =C' or SUBJECT: Kensington Grading Job No. 8917 DISCUSSION: Council at their October 8, 1991 meeting awarded a purchase order to Centex Homes from them to complete the mass grading of Kensington Park. During discussion on the matter, the Mayor asked if the entire site would be stripped of all organic or swamp material before any filling began. I answered that I thought that it would be. In the purchase order I prepared with Centex, I included that all black dirt and organic material would be stripped from the site before any filling began. There is a low area on the park site adjacent to the freeway that Centex had originally not intended to strip before filling. Upon learning that we wanted all organic material removed, they dug some test holes in the area and found the depth of organic material to be 2-3 feet deep throughout. Removing this material will increase their cut by over 3,000 cubic yards. Centex requests an additional $2,600 or $0.85 a cubic yard to complete this work. RECOMMENDATION: I recommend that this organic material be removed before filling and that Centex be paid for doing the work at a cost not exceed $2,600. ACTION REQUIRED: If Council desires to implement the recommendation they need to pass a motion authorizing staff to increase the scope of work on the original Kensington Grading purchase order to Centex to provide for the removal of an additional 3,000+ cubic yards of organic material at a cost of $2,600. JED:dfw CITY OF MENDOTA HEIGHTS MEMO October 31, 1991 To: Mayor, City Council and City Administ From: Kevin Batchelder, Administrative Assist Subject: Purchase of Additional Recycling Containers INTRODUCTION The purpose of this memorandum is to request the authorization to purchase 1,500 additional recycling containers. DISCUSSION Since our curbside recycling program began in 1989, the City of Mendota Heights has purchased 3,200 recycling bins. Our voluntary recycling program has now reached approximately 3,000 participating households and we are getting low in inventory to meet demand. Dakota County has informed the local communities to expect a replacement rate of five percent (5%) annually. The city has replaced approximately 200 bins due to theft or loss. The 1990 Census count estimated that there are 3,401 households in Mendota Heights and we are growing slowly with housing starts in the neighborhood of 75 to 100 per year. The additional 1,500 recycling bins would allow the City to cover all new housing starts and to have replacement stock for the foreseeable future. Our 1991 Joint Powers Agreement with Dakota County includes $7,500 for purchase of recycling containers. Rehrig-Pacific, our original container vendor, has lowered the price on bins once again. The price per container has been lowered from an original $5.01 in 1989, to $4.30 in 1990 to $3.61 in 1991 due to a decrease in resin material prices. The bin is made from recycled plastic. 1,500 recycling containers $5,415 (at $3.61 per bin delivered) ACTION REQUIRED If Council so desires, they should pass a motion to approve the purchase of 1,500 Husky -lite recycling containers from Rehrig- Pacific Company for the total cost of $5,415. CITY OF MENDOTA HEIGHTS MEMO TO: Mayor, City Council and City Admini FROM: Tom Olund Public Works Superintendent SUBJECT: Backhoe Replacement DISCUSSION: 30, 1991 The City's existing backhoe/loader is now 14 years old. The backhoe is a street department piece of equipment, that is'vital to the operation of all departments, it is used equally by all. In the winter the backhoe is used for mixing and loading the sand and salt that is used for deicing streets. This past year the backhoe was down for repairs often and was a cause for delay in completing several important projects. Now the tires are in need of replacement and the transmission jumps out of 1st and 2nd gear while in use. We need a reliable piece of equipment to mix and load sand and salt for winter. A new backhoe was approved for purchase within the preliminary 1992 budget, the final budget document does not get adopted until the December 3, 1991 Council meeting. We have spoken with our preferred backhoe supplier and they tell us that unless they could find what we want on a lot somewhere, it would be several months before one could be manufactured. We are in urgent need of a new backhoe and ask that Council grant us approval to bid and order one as soon as possible. Suppliers, even if we order the backhoe in 1991, would not bill the City until after January 1992. RECOMMENDATION: The existing backhoe is old, very unreliable and now in need of new tires and transmission work. I recommend that we purchase a new machine as soon as possible to avoid having to spend any more repair money on the existing machine. The new machine is estimated to cost $78,000, with approximately $10,000 to be recovered as trade-in. Funding for the backhoe is proposed to be by equipment certificates. ACTION REQUIRED: If Council desires to implement the recommendation they need to pass a motion authorizing staff to solicit bids for 1992 budgeted equipment in advance of final budget adoption. There were five homes located in this area that are being acquired as part of the City',s Tax Increment Financing (TIF) plan. The T.I.F. plan is to, upon each homeowner's re- quest, acquire and clear the area of all the homes and redevelop it as commercial. We are currently taking bids to move the Shouveiller home from the site, we would like to have the home gone before winter. This improvement requires a side yard setback variance of seven feet (7') to reconstruct the garage at its existing location. The front yard setback is non -conforming and requires a "housekeeping" variance of eight feet (8'). The Planning Commission closed the public hearing and expressed no concerns about Mr. Landkamers's proposed improvement. RECOMMENDATION The Planning Commission voted 4-0 to recommend that City Council approve a side yard setback variance of seven feet (7') and a front yard setback variance of eight feet (8') to allow reconstruction of a single car garage as proposed in Case File No. 91-38. Landkamer 659 Third Avenue Front and Side Yard Setback Variance The applicant is proposing to replace the existing, attached, single -stall garage on his property at the above address. The existing garage is in relatively poor condition and does not have adequate room for typical residential storage or work space. The applicant proposes to demolish the existing garage and construct a new single -stall garage of slightly larger dimensions. The applicant's site plan illustrates the dimension of the new garage as compared to the existing structure. The proposed garage will maintain the same side yard setback as the previous structure (3 feet), but will extend 8 inches closer to the front lot line. In addition, the rear 13 feet 6 inches of the new garage is to be extended 4 feet further west, essentially wrapping the garage space around this corner of the house. The subject property is legally non -conforming with respect to the side yard setback for the existing garage as well as the front yard setback for the house itself. The existing garage is located within 3 feet of the eastern property line. In addition, the house on this property is setback roughly 22 feet from the front lot line (the garage portion is set back further than the house and does not encroach on the required front yard). The corresponding setback requirements in the Mendota Heights Zoning Ordinance are 10 feet and 30 feet respectively. A 7 -foot side yard setback variance is necessary to allow the proposed reconstruction. The subject porperty is located in an area that was platted with substandard lots. Many of the lots on this block have the same substandard dimensions as the subject property. In some cases lots have been combined to create larger lots to meet the minimum lot dimensions required in the Ordinance. The Section map for this area also indicates a 20 -foot platted alley running down the rear property lines of the lots on this block. This alley was never built and the right of way for it has since been vacated. Landkamer Variance DISCUSSION 22 October 1991 Page 2 Before we get into discussing the specific variance criteria, there are some issues we would like to clarify related to the property's legal non -conforming status. First, as stated earlier, the house on this property has two non -conforming setbacks. Only one of these, the side yard setback, is affected by the proposed garage reconstruction. The house also extends 8 feet into the required front yard. The City has, in the past, pursued the policy of granting variances for other substandard setbacks, on legal non -conforming lots, at the same time they are reviewing a variance request for an unrelated condition. These are sometimes called "housekeeping variances". Generally, they serve the purpose of sanctioning or justifying a condition that a variance would have been granted for had the Zoning Ordinance been in place when the lot was developed. Another way of thinking of this is that by granting this type of variance, the City is saying that they would like to see this condition continue. This point is especially important in the case where a non -conforming structure is severely damaged. Section 4.3(4) of the Mendota Heights Zoning Ordinance basically says that if a non -conforming structure is damaged either by fire, flood, explosion or other event (not the actions of the owner) and the damage to the structure exceeds 50 percent or more of its value, then the structure may only be reconstructed in accordance with the provisions of the Ordinance. Therefore, if the City believes the current location is appropriate and would want to allow the structure to be reconstructed to a similar condition as it was before the fire, then the necessary housekeeping variances should be granted. In the case of the subject property, there is no reason why the house could not have been built to the required setback. However, the adjacent homes on both sides of the subject property are built to the same setback and, therefore, the City would probably want to allow the structure to be rebuilt in its current location in order to preserve the uniform aesthetic character of this area. Thus, an 8 -foot variance to the front yard setback would be appropriate for this property. Another issue related to the fact that the property is non -conforming has to do with one of the criterion for granting a variance, which requires that variances not be contrary to the intent of the Zoning Ordinance. Generally, the intent with respect to non -conforming structures is to gradually eliminate them or alter them to bring them into conformance with the Ordinance. This idea is supported by several statements in Section 4.3 of the Zoning Ordinance such as Section 4.3(4) described above. This thinking certainly applies when an owner proposes to demolish a non -conforming structure for redevelopment. However, Section 4.3(10) of the Zoning Ordinance allows for alterations to a legal non -conforming structure when those alterations improve the livability of the structure, provided these alterations do not increase the number of dwelling units or the bulk of the building. Clearly, the additional storage and work space provided by the garage expansion constitutes an improvement to the overall livability of the home on the subject property as well as its appearance. The question for the the Planning Commission is whether the proposed reconstruction of the garage exceeds the intent of the term "alterations" as used in this section of the Ordinance. In addition, the bulk of the proposed garage is slightly increased over the existing structure and would, therefore, be • considered an intensification of a non -conforming use. In this case, the increase in bulk is so small that we believe it is of little consequence. VARIANCE CRITERIA i Landkamer Variance 22 October 1991 Page 3 We believe the applicant's request for a 7 -foot side yard setback variance is consistent with the criteria set forth in the Ordinance in several important ways. The principal purpose of the variance is to allow for the reasonable and intended use of property in cases where strict application of the provisions of the ordinance would prevent such use due to some unique characteristic of the property. Clearly, a garage is part of what would be considered reasonable use of a single-family lot in a suburban area. In fact, the City has further defined reasonable use of a single-family lot to include two -stall garages by requiring them for new homes built in the City (see Section 4.18(4)). The applicant is proposing only a single -stall garage, the dimensions of which (275 square feet) are only slightly greater than the minimum 12 -foot by 20 -foot (240 square feet). The key factor to consider when reviewing variances is the existence of a "hardship" or "practical difficulty" that is the result of characteristics that are unique to the property. The characteristics unique to this lot include the fact that at 7,500 square feet it is only half the size of the minimum lot required by the Zoning Ordinance. More importantly, the width of the lot is only 60 feet as compared to the 100 -foot minimum required by ordinance. The 10 -foot side yard setback was established based on the 100 -foot lot width. In addition, the existing home and garage on the property were built prior to the adoption of the Ordinance. As a result of these factors, it would be impossible to accommodate an attached garage on the property without violating the setback regulations in the Zoning Ordinance. One option that was reviewed was to demolish the existing garage and construct a freestanding structure elsewhere on the property to eliminate the non -conforming condition. In the case of Mr. Landkamer's property, the only available location would be in the rear of the lot where there is more room to provide the required side and rear yard setbacks. There are several factors that make this option undesirable. First, the alley that was platted for this area was never built and was subsequently vacated, therefore, locating a garage at the rear of the lot would require lengthening the driveway to provide access to the structure. This would result in additional impervious surface and storm water runoff, increase the amount of maintenance (snow shoveling, etc.), and substantially increase the cost of the project. Second, and perhaps more importantly, most of the other homes on this block have the garages up near the front of the lot, as is the case on the subject property. This is one of the elements that creates a unified character for the neighborhood and results in relatively uncluttered space in the 'rear yards of the lots in this area. Therefore, to locate a garage in the rear yard of the subject property would be inconsistent with the character of the surrounding neighborhood. Granting the variance would preserve the existing character of the neighborhood. The proposed garage reconstruction will improve the appearance of the existing home from the surrounding homes and from Third Avenue. The proposed structure, like the existing structure, would be relatively well screened from the surrounding properties due to both the existing vegetation and the fact that it is staggered back on the property. All but two of the adjacent land owners have signed the applicant's consent form indicating they have reviewed the plans for the project and are not opposed to it. In addition, the Planning Commission also conducted a special meeting site visit on Saturday, October 19th, that was attended by the applicants and area neighbors. Issues that the Planning Commission desired to address with the special meeting included impact on the existing trees, impact on the surrounding properties, drainage, wet soils and flag lots. The minutes provide a good discussion of these issues. See attached September 30th staff letter and October 14th applicant response. A soil report is also included. The Planning Commission was also concerned about how the subdivision, and flag lots in particular, fit into any master plan for this area. A street circulation plan had recently been completed in conjunction with the Gesell Subdivision in 1990. That street circulation plan was reviewed by the Planning Commission and is attached for Council review. The Planning Commission felt the Knaeble proposal could occur without affecting development, or impacting, surrounding properties. As we discussed in our meeting, we understand that the City is concerned about the ultimate disposition of Outlot A. Based on the City's suggestion, we have now shown Outlot A as part of our proposed Lot 3. 2. At our meeting on September 30th, we discussed the proposed sanitary sewer with the City Engineer, Jim Danielson. As we discussed with him, the revised Preliminary Plat shows the proposed 6" sanitary sewer that will serve the two proposed houses. Based on the City's as-builts, this sewer will provide gravity sewer service to the basements of both proposed homes, and will have approximately 2.2 feet of cover at the creek crossing. The applicant proposes to subdivide the subject property into three single-family lots, two of which would be flag lots. The preliminary plat drawing shows all three lots utilizing the same 15 -foot access drive, which would run along the south side of the property and enter onto Dodd Road in roughly the same location as the current driveway. Lot 1 would include the existing home owned by Mr. and Mrs. Walker. 2. The proposed lots meet all of the minimum lot requirements within the R-1 District except for Lots 2 and 3, which do not meet the criteria (100 feet). The applicant is requesting a variance for each of these lots. In addition, the property is traversed by two small drainage ways that are identified on the City's Wetland Systems Map. The applicant is requesting a wetland permit to allow the installation of a culvert to accommodate the proposed access drive for Lots 2 and 3 and to allow construction of the proposed single-family homes to within 80 feet of the centerline of the drainage ways. The latter is being requested even though the footprints of the proposed homes, as shown on the Preliminary Plat, do not encroach upon the 100 -foot protected area. Apparently the developers would like to have some flexibility in the exact location and size of the potential homes. Peter Knaeble, Case No. 91-35 Page 2 3. The subject property is a long narrow parcel located east of Dodd Road in an area that has remained predominantly large lot single-family in character. While the property is zoned R-1 it is situated within an area for which no planned pattern of roadways has been defined. This area, which is over 1/4 mile in size is bounded on the west by Dodd Road, on the south by Marie Avenue on the east by Delaware Avenue and on the north by Wentworth Avenue (see attached map). This region contains one of the City's few remaining large contiguous tracts of R -1A zoning. One of the reasons this portion of the City has remained unplanned is the existence of a large wetland system that encompasses much of the central part of the area. Several scenarios for providing roadways through the area have been examined, but no official plan has been adopted. The issue of how to best provide roadways through this area becomes more crucial as properties, like the subject property, around its perimeter are subdivided. The City should consider establishing a master plan to guide the overall development of this area. 4. Due to its long narrow shape, the subject property could be better developed if it were combined with other adjacent properties in a fashion that would allow for the dedication of a public roadway. Such an arrangement could eliminate the need for flag lots and could also contribute to the establishment of a roadway system that could serve a larger area. Obviously, such an arrangement would require not only the establishment of a master plan for the area, but also the cooperation and coordinated effort of surrounding property owners. 5. On this note, the staff has already had inquiries regarding subdivision from the adjacent property owners to the south who met with us at our September 16th office hours meeting. This property has similar characteristics as the subject property and its subdivision would require similar variances and wetland permits. The combination of these two lots would provide enough room to dedicate the public right-of-way necessary to install a cul-de-sac and thereby eliminate the need for flag lots on either property. The fact that the adjacent property owners are contemplating subdividing their property raises the question of whether there might not be others in this area who would be willing to cooperate in a broader effort. At the very least, we believe it would be prudent to continue the Applicant's request to allow time for them to discuss the possibility of collaborating with the adjacent property owners to the south. Should the City approve the Peter Knaeble, Case No. 91-35 Page 3 applicant's variance and wetland permit, they would be hard pressed to refuse the same requests from other property owners in this area. 6. In the interim, we would recommend that the City reexamine the issue of how to provide a system of roads for the surrounding area in a manner that accomplishes the City's development objectives most efficiently and with the least environmental impact. 7. Having said this, it is important to note that the applicant has the right to have his proposal reviewed on its own merits. As we mentioned in the first paragraph, the proposed lots meet all but one of the lot size criteria in the zoning ordinance. Lots 2 and 3 are flag lots and do not meet the minimum lot width requirement. The primary concern with flag lots is that they result in homes that are isolated making emergency and fire service more difficult. In the case of the proposed Preliminary Plat, the access drive is particularly long and narrow. The longest flag neck is 452 feet in length. There are several other lots of similar configuration as the subject property within the unplanned area described earlier. By allowing flag lots in this instance the City could be opening the door for many such requests. 8. The Preliminary Plat also shows a small outlot. Such parcels can be a problem in that they are not owned by any of the residents and tend to be left unmaintained. This land should either be incorporated into one of the other lots or could perhaps be offered to the adjacent property owner under some agreement. 9. Permanent access easements would also be required over the narrow portions of Lots 2 and 3. Lot 3 would have to include access easements for both Lots 1 and 2 since it appears that Lot 1 will continue to utilize the existing curb cut onto Dodd Road. Similarly, Lot 2 would have to include access easements for Lots 1 and 3. 10. With respect to the wetland permits, the principal concern would be for the loss of trees on the property. There are significant stands of trees in the areas adjacent to both creeks. According to the Preliminary Plat drawing, there would be no trees affected by locating a house within 80 feet of the creek on Lot 3. However, the plan shows a continuous stand of trees in the area of the creek that runs through Lot 2. The proposed lots are spacious, over twice the minimum size required by the ordinance. There is plenty of room on these lots to accommodate a large home without having to encroach on the 100 -foot wetland protection area. We see no reason to grant wetland permits to allow the construction of the homes on Lots 2 and 3 as requested by Peter Knaeble, Case No. 91-35 Page 4 granting wetland permits, even when no need is demonstrated, the value of the ordinance will be severely undermined. 11. In summary, we have serious concerns about the' precedent that would be set by granting the variances necessary to allow the proposed flag lots. This .concern is related both to the issue of access for emergency and fire vehicles and to the potential impact this precedent would have on the development pattern within the surrounding area. DISCUSSION: Mr. Peter Knaeble is purchasing a 3 acre parcel from Lloyd and Lucille Walker, at 1760 Dodd Road, for the purpose of developing through subdivision. Mr. Knaeble has met with staff on several occasions to prepare the plan attached. The lot is long and narrow with two drainage ways running through the lot that restrict development options. Mr. Knaeble proposes to develop his lot by creating three lots, one of which contains the existing home. Two new flag lots are proposed to be served by a common driveway. The new lots are proposed to be located at the eastern end of the property. See attached plans and report. The existing barn and shed shown on the plans are proposed to be removed. All the lots exceed the minimum area requirements for an R-1 zone, however, because of the flag lot configuration they lack the minimum 100' frontage on a public street requirement. The proposed lots do have more than ample frontage if calculated at the building setback. The proposed houses are shown to be setback at the required 100' for the Wetlands boundary. However, the applicant has indicated that potential buyers have shown interest in larger houses and/or decks than shown on the plan. Therefore, the applicant is requesting Wetlands Permits to build within 80' of the two drainage ways. After public notices were sent out, the neighbor to the south, Mr. Fred Peterson, of 1770 Dodd Road met with staff to review the proposal and discuss his development options in light of this proposal. See attached site plan of 1770 Dodd Road. The applicant has shown an outlot on the preliminary plat. This outlot is proposed to be available for combining with Mr. Peterson's parcel to the south to assist potential development option. Daniel Public Works Dir October 28, 1991 SUBJECT: Ivy Falls Creek Improvement - Phase I (Brassard) Job No. 8814A DISCUSSION: During the preparation of the plans for the Ivy Falls Creek Improvements adjacent to the Brassard residence it was discovered that the creek generally follows rear lot lines. The lots on the south side (the side Mr. Brassard is on) have a twenty (20) foot wide plat-• ted easement for the creek. The lots on the north side were created in an earlier plat and have no easements. In order to complete all the creek work in Phases I and II, easements will need to be acquired from all the homes on the north. Right now in order to do any work on Phase I, an easement from the lot north of Mr. Brassard will be need- ed. The lot north of Mr. Brassard is owned by Dr. Francis Denis. Dr. Denis is generally not in favor of the project and specifically does not want the creek to be realigned through a portion of his property. He also does not want any of his trees removed, however Dr. Denis has said that he would consider signing an easement under the following conditions: 1. The creek is improved along its existing alignment. 2. None of his trees are removed. 3. Satisfactory compensation be paid him for the easement. My response to each of his requests are as follows: 1. The creek can be improved along the existing alignment however, it will increase the costs an estimated $10,000 and the City will lose the benefits gained by straightening the creek (less chance for erosion). 2. All of Dr. Denis' trees can be saved, however, one of Mr. Brassard's greatest concerns was that the large cottonwood tree located at the bend in the creek was badly undermined and could fall on his house. 3. The minimum amount of easement area needed from Dr. Denis is 2,600 square feet. Consistent with our past practice, I told him that I felt $0.25 per square foot ($650) would be a fair price for the easement. Dr. Denis said that $650 was too low. He is currently investigating a counter offer. Note: The City needs to keep in mind that there will be at least five (5) other future easements that will need to be acquired from Dr. Denis' neighbors downstream as part of the Phase II project (whatever we pay him will set a' precedent). If we can not come to terms with Dr. Denis and decide to condemn his easement we should then acquire all the easements at the same time (economy of numbers). ACTION REOUIRED: As of this time I do not have a counter offer back from Dr. Denis however, I am forwarding this memo to keep Council informed of the progress and gain direction on this somewhat difficult negotiation. JED:dfw • • 01 b CITY OF MENDOTA HEIGHTS MEMO TO: Mayor and City Council FROM: Tom Lawell, City Adminis SUBJECT: Discuss 1992 CDBG Allocation October 31, 1991 INTRODUCTION At the September 17, 1991 meeting, the City Council preliminarily discussed the subject of Community Development Block Grant (CDBG) Funding for 1992. The Council offered a number of suggestions for uses of the allocation, and asked staff to further explore these possibilities. DISCUSSION Attached please find a letter from the Dakota County Housing and Redevelopment Authority (HRA) which addresses several of the options Council discussed. It appears we have at least two viable ideas from which to choose. 1. 2. Senior Housing Development We were encouraged to learn from the HRA that they intend to pursue the acquisition of land within Mendota Heights for such development in 1992. In speaking with representatives from the HRA, they were likewise pleased to learn of our interest in senior housing. Other such projects undertaken in the County have utilized CDBG Funds for land acquisition, and despite the timing concerns raised in their letter, the HRA is confident we can utilize CDBG Funds for this purpose in 1992 if we so desire. Housing Rehabilitation Council had suggested we explore a financial allocation to assist in the rehabilitation of deteriorated homes within the community. Assuming the owner/occupant meets the income restrictions of the CDBG Program, this type of housing improvement activity would be eligible •for funding. In very severe cases, the City could also use CDBG Funds to acquire and demolish blighted properties. 3. Water Utility Looping Council had suggested we explore the use of CDBG Funds to finance the cost of water looping in the Beebe area. This expenditure was discussed with HRA staff and it was concluded it would be very difficult to justify the use of CDBG Funds for this project. It is not likely the low to moderate income restrictions could be met in this area, and unless the problem represents a community catastrophe with no other funding source available to address it, the expenditure would not be allowed. Similar to years past, the City's 1992 CDBG allocation is expected to be approximately $50,000. The City must submit its 1992 CDBG application to the HRA by December 15, 1991. Thus it is our intention to have the completed application before the Council at our December 3rd meeting for final approval. ACTION REOUIRED Council should discuss its desired use of CDBG Funds in 1992 to give staff direction in preparing the required funding application. I am writing in response to those questions. Apparently there is some interest by the Mendota Heights City Council in Dakota County's Senior Housing Development Program. When ;the County established the Program, a ten-year Capital Improvement Plan was drawn up, covering the proposed senior housing developments. This plan was largely based on an extensive needs assessment study commissioned by Dakota County HRA. Mendota Heights was included in this plan, with land acquisition proposed for 1992 or 1993, and construction of a 40 -unit building in 1997. CDBG funds can play an important role in the development of senior housing as an acquisition funding source. Therefore it would be appropriate for the City to apply for funding to acquire a site for senior' housing at some point in time. The only potential problem in doing so at this time is that if CDBG funds are expended one of the federal objectives of the program must be met within a reasonable period of time after the expenditure. The acquisition of a site for senior housing would meet the objective of benefitting low and moderate income persons, but only when the housing was actually constructed. If several years pass between site acquisition and project construction, it could result in a finding of non-compliance being issued by the Department of Housing and Urban Development. Another project mentioned by Mr. Danielson involved targeting substandard or problem homes in the City for rehabilitation funding. This type of project would be feasible, provided that the "AN EQUAL OPPORTUNITY EMPLOYER", property was owned and occupied by persons of low or moderate income who were willing to apply for and accept assistance. There would be no restriction preventing the City from referring individuals to the available assistance or encouraging them to apply. We currently have three parties on a waiting list for housing rehabilitation and have had inquiries from several others, primarily residents of the Furlong area who had received assessment abatement assistance. Now that staff is beginning to operate under the new ordinances, it is becoming evident that certain procedural policies need to be changed or reaffirmed. The purpose of this memorandum is to propose a set of new procedural requirements for Council approval and to seek policy direction from City Council on the administration of certain zoning and subdivision issues. DISCUSSION 1. Procedural Requirements When the 1979 Zoning Ordinance was adopted, a set of written procedural requirements for processing planning applications was approved by City Council. Since that time, staff has handled planning applications according to those requirements. Those requirements now need to be amended to coincide with the recently adopted 1991 Zoning Ordinance. Attached is a proposed "Procedural Requirements for Planning Applications" dated October 31, 1991. It has been modified to coincide with our new public hearing notice requirements, otherwise it remains the same. (See attached September 4, 1991 memo.) State statutes regarding public hearing notices have changed since our old procedural requirements policies were adopted. Our new zoning ordinance is consistent with state law and the proposed Procedural Requirements for Planning Applications is consistent with the new Zoning Ordinance. 4 2. Final Platting The City Council should note that the proposed "Procedural Requirements for Planning Applications" also addresses Subdivision requirements. Of particular concern is the Final Platting procedures that state: "May be referred to Planning Commission for review." The Subdivision Ordinance, Section 3.2(1) differs from this policy and states that Final Plats are to receive review at the Planning Commission level. To our knowledge, the City has never processed Final Plats through the Planning Commission, despite the language in the Subdivision Ordinance. Final Plats have always proceeded directly to City Council on their consent agenda. In adopting the new "Procedural Requirements for Planning Applications", City Council should consider reaffirming this past practice and readopting this procedure as policy. This particular matter on Final Plats is being brought to your attention because Commissioner Friel, in a letter to the Planning Commission and staff over his concern about Bridgeview Shores Third Addition, brought the differences in planning procedures and ordinance language to our attention. (See attached letter dated October 17, 1991.) 3. New Side Yard Setbacks in R-1 The new side yard setback requirement for the R-1 Zoning District essentially makes many existing single family homes in Mendota Heights legal non -conforming structures. The new Side Yard requirement states: " 10 feet on each side or 1/2 of the height of the structure contiguous to the side yard, whichever is greater, to a maximum of 15 feet." Any home built at the legal 10 foot side yard setback requirement under the old ordinance, where the height provision under the new ordinance would require a greater setback becomes a legal, non -conforming structure. Current policy dictates that, as legal, non -conforming structures, they would need side yard variances to make them conforming structures prior to any issuance of building permits for additions, enlargements and certain structural improvements. Past practice has been to process legal, non -conforming structures as "housekeeping variances" before a building permit is issued. (Please see attached Non -Conforming Ordinance Clauses.) In many cases, the non -conforming feature is not related to the building permit being requested. For instance, an existing house may not meet the side yard setback requirement, making the structure legal, non -conforming. A 3 season porch addition to the rear of this house may not be related at all to the non -conforming r feature. We are proposing that the City establish a policy to require "housekeeping" variances only in cases where the non -conforming feature is proposed to be extended or intensified in R-1 Zoning Districts, or at the request of the applicant. This would allow single family home owners to process building permits for additions without requiring a variance because of an existing 10 foot side yard setback. It would also eliminate the need for many "housekeeping" variances that are not related to proposals for additions, etc. ACTION REOUIRED If the City Council so desires, they should pass motions: 1. I was surprised to find those requirements of the ordinance for I know that the final plat for the Bridgeview Shores Third Addition was never presented to the Planning Commission. The language to which I refer is contained in Section 3.2 of the subdivision ordinance, and more particularly in 3.2(1). Perhaps there is something that I am overlooking and if there is, I shall appreciate your advice. As you know, I have also raised with you questions about Bridgeview Shores in connection with two sections of the zoning ordinance, namely 4.12, relating to land reclamation, and 4.13, relating to mining. In addition, the definition section 3.2(81) is relevant in connection with the mining provision. It is my view that the correct interpretation of Sections 4.12 and 4.13 requires that developers such as Mary Anderson in the Bridgeview Shores Third Addition are required to get Conditional Use Permits for both filling (land reclamation) under section 4.12 of the zoning ordinance, and for mining under section 4.13 of the ordinance. It is clear that in the case of Bridgeview Shores, more than 400 cubic yards have been mined and more than 400 cubic yards have been used for filling. 210745 BRIGGS AND MORGAN Mr. Jim Danielson October 17, 1991 Page 2 It has been suggested to me that an exception in the definition section of the Ordinance permits the mining in question to be done without a Conditional Use Permit. The exception that apparently is looked to to reach that conclusion is contained in section 3.2(81). That section reads as follows: Mining: The extraction of sand, gravel, rock, soil or other material from the land in the amount of -400 .cubic -yards or more and the removal from the site, except grading and/or excavation in .connection with an approved development or building plan for which permits have been issued by the City Council. It is the exception language in the definition that is relied upon. However, I do not believe that the exception language applies to the Bridgeview Shores Addition because the exception deals only with sites with respect to which there is an "approved development plan" for which a "permit has been issued by the Council" or an "approved building plan" for which a "permit has been issued by the Council". The only provision of the ordinance in which I find any reference to a "development plan" is with respect to PUDs. Obviously the Mary Anderson development is not a PUD. Furthermore, I am unaware of any "building plan" for which a permit has been issued by the City Council with respect to the Mary Anderson project. Again if there is some matter that I am overlooking, I would certainly appreciate your advice and direction. One other matter I believe should not be overlooked in connection frith the Mary Anderson Bridgeview • Shores Third Addition is theApparent. disagreement over the location of the Mary Anderson northerly boundary line. At this point I have had no response from Mary Anderson to the letter which I sent to him, a copy of which was provided to you. While I understand that boundary line disputes are private matters between the abutting owners, those private issues do rise to the dignity of public concern when they involve plats that may include dimensions which reference an erroneous boundary line, for eventually that will create problems for the developer and subsequent owners of the property in relation to meeting lot area requirements and setbacks. CITY OF MENDOTA HEIGHTS MEMO October 31, 1991 TO: Mayor and City Council FROM: Tom Lawell, City Administi SUBJECT: Legislative Policies for 1992 INTRODUCTION As a member City of the Association of Metropolitan Municipalities (AMM) and the League of Minnesota Cities (LMC), these two organizations represent our interests at the State Capitol. The next Legislative Session begins January 6, 1992, and both organizations are currently asking their membership to endorse the policy packages they will advocate during the upcoming Session. BACKGROUND As part of the October 15, 1991, City Council packet, a copy of the AMM Policy packet was distributed. Please bring this document with you to the November 5th Council meeting, if you still have it. If not, please let me know and an additional copy will be made available that night. Attached to this memo, please find a copy of the LMC proposed policies and priorities. As you will see, the LMC Policies in many ways mirror those of the AMM, except in those instances where metropolitan and out state interests significantly diverge. The AMM Policy Adoption Meeting is set for Thursday evening, November 7th in Brooklyn Park, and the LMC Policy Adoption Meeting is set for Thursday morning, November 21st in Bloomington. Councilmembers are invited to attend these meetings if you are so interested. DISCUSSION The AMM Policy package asks each City to identify their top five policy priorities for the year. Staff has reviewed the ninety plus proposed policies and feels the most important issues involve Municipal Revenue and Transportation. Policies of particular concern are as follows: Policy I - A. Levy Limits (see page 1) Despite the push for greater local accountability for property taxes, the State continues to impose arbitrary property tax "levy limits" on units of local government. In years past Legislators have pledged to remove these limits at a specified future date, which always seems to come and go with no action. Currently levy limits are scheduled to sunset for taxes payable in 1993, and the AMM encourages adherence to this date. Policy I - B. Mandated State and Federal Procrrams (see page 1) Many items in our annual City Budget can be traced back to various State requirements which were enacted in previous legislative sessions. This policy points out the tremendous cost that such mandates cause within units of local government, and recommends that any new mandates be accompanied with new funding to carry them out. Policy I - C. Local Government Aid (see page 2) Although entitled "local government aid", this policy also addresses Homestead Credit, Disparity Reduction Aid and the new Local Government Trust Fund (LGTF). The distribution of the new LGTF Two Cent Sales Tax is sure to be a topic of hot debate in the near future. The AMM Policy sets forth a list of criteria it would like to see applied in distributing the tax in the long run, and suggests that the tax be distributed on the basis of household count and/or population in the interim. Policy V - F. Highway Jurisdictional Reassignment, Turnback and Funding (see page 52) There is currently an effort underway to reassign to Cities the jurisdiction over many State and County highways within Minnesota. With the only condition that the road be in "good condition", the City has no authority to refuse the gift from the other unit of government. Within Mendota Heights this turnback procedure could affect a number of roads in the future, including Highway 110, Dodd Road, Victoria, Lexington and a portion of Pilot Knob Road. The AMM Policy supports the turnback program, but only if accompanied by an adequate funding mechanism to maintain the bequeathed roadways. Policy V - G. Transportation Utility (see page 52) As more and more Cities attempt to deal with the replacement and repair of aging streets, the issue of infrastructure funding will become increasingly important. The traditional 429 Special Assessment Procedure is not adequate to effectively address the problem, and in this policy, the AMM proposes an' alternative funding mechanism. The availability of this new approach could be of great assistance to Mendota Heights as we address our road reconstruction issues. Certainly there are dozens of other policies within the package which have implications to Mendota Heights. Should Council wish to include others among our top five, please feel free to suggest them at the meeting. ACTION REQUIRED Discuss the proposed 1992 AMM Legislative Policies and select five which have the greatest priority for Mendota Heights. Danielson, Public Works Direc SUBJECT: "Storm of the Century" Follow Up DISCUSSION The snow "storm of the century" began with the final amounts of snow reaching about 30 inches when it was all over. (We even got another 3 inches today). Combine this with the fact that the snow was extra wet and heavy and the high winds, this snow fall posed major problems for our public works crews who had to remove it all. Public Works began plowing Thursday night at 12:00 A.M., it was still snowing heavily. Those areas that were plowed first had plenty of snow back on the streets by the time we finished going over all the streets late Friday evening. After working 20 1/2 hours straight, everyone but one Public Works employee went home at about 8:30 Friday evening for some food and a nap. They began returning at midnight, 3 1/2 hours later to start again. They then continued to work in shifts with someone always in the City working continuously until Sunday evening when they all went home for a long break. During the storm there were lots of calls at City Hall with most of them being fairly reasonable once 'we explained the situation and approximately when we would get to their street. Some of the problems we encountered were: 1.`, There are three main line routes with a five ton truck with a plow and wing mounted for each route. The road grader can also plow snow and is normally used as a back up (see attached map for routes) . When the snow hit, one of the trucks had our "hot box" mounted on it and could not be used for plowing, we had to use the road grader for plowing from the beginning. 2. Mid-morning Friday, the heavy snow broke a 2 1/2" diameter pin on one of the plows. That truck was down for approximately 1 1/2 hours while we exchanged plows with the one used on the hot box truck. ' 3. We normally use three pickups to plow our 90 plus cul-de- sacs. The hydraulics went out on one pickup and we were left with only two to do the cul-de-sacs. 4. We jumped around some to help some doctors and a pregnant lady get out early. 5. We were two men short on Thursday, one was sick and one had quit (we are currently advertising to replace him). 6. Due to some missed communications, we missed plowing Dodge Lane (the bosses street, how could we?) and Glenhill Road and Culligan Lane. ANALYSIS We feel that the public works crew did an outstanding job, utilizing the resources available to them, working extremely long hours under adverse conditions to make the streets safe for travel in as early a time as possible. There are 21 miles of street per route, which is extremely long. When we hire the new maintenance worker that is budgeted for 1992, we intend to add a fourth route. We will then utilize all the snow removal equipment that the City has available immediately, by using the road grader for that fourth route. This should decrease the time required to remove snow.
