Ayes: 5 Nays: 0 ASSISTANT FIRE CHIEF Council acknowledged a report from the City Administrator regarding selection of an Assistant Fire Chief. Administrator Lawell reviewed the selection process for Council and recommended the appointment of John Neska. Ayes: 5 Nays: 0 Councilmember Blesener moved the appointment of John Neska as Assistant Fire Chief, effective on October 1, 1991, conditioned upon an understanding as to the conditions set forth in the Administrator's report. Councilmember Smith seconded the motion. Councilmember Cummins complimented the Fire Department on its annual report to the community. Page No. 3114 September 17, 1991 AIRPORT PLANNING Representatives of the Metropolitan Airports Commission, including Joe Gaspar, MAC Commission member and Nigel Finney, Executive Director, were present to review the Commission's "Preliminary Selection of an Airport Development Concept for the Long Term Comprehensive Plan," report for the Council and audience. Commissioner Gaspar stated that the MAC is holding a series of public meetings, such as this evening's, to update the public on one part of the dual track system, that being the long term expansion of the airport if it stays in its existing location. Mr. Finney explained that the purpose of the discussion is to provide information on the preliminary selection of development Concept 6, construction of a north/south runway and new western terminal facility. He stated that the process began in 1989 with adoption of the Metropolitan Airport Planning Act which required that the Metropolitan Council and MAC provide a recommendation to the legislature in 1996. He further explained that the legislature has retained for themselves the final decision on what direction to take - expansion of the existing facility versus a new airport. The dual track process consists of Metropolitan Council selection of a site for a replacement airport and MAC long-term planning for the existing airport. He stated that it is hoped that a recommendation can be given to the legislature in 1995, in advance of the 1996 deadline, because of the uncertainties which exist for residents of the search area and those surrounding the existing airport. Mr. Finney gave the Council and audience an oral and slide presentation reviewing the report, including existing and projected future airport activity, concepts for airport expansion, evaluation criteria, on and off - airport impacts, and airfield operational criteria. Mr. Finney stated that the committee recommends Concept 6 because it offers operational advantages, increased capacity and independence from the existing runways and further that it offers the best potential for noise mitigation. Page No. 3115 September 17, 1991 Responding to questions from Councilmember Cummins, Mr. Finney stated that the reports from MAC and the Metropolitan Council will be used for comparison by the legislature to make a decision on developing the existing airport or replacing it. In the event the legislature decides to stay with the existing facility, concept 6 would be used as the basis for development. He further stated that it is highly unlikely that a new runway would be built in advance of a legislative decision, as it is not likely that they would invest in a runway which would only be used for a few years. Responding to a question from Mayor Mertensotto, Mr. Finney stated that runway 422 will need to be extended for overseas flights. Councilmember Cummins asked if there is any legislation for the beginning of land acquisition. Mr. Finney responded that acquisition would not occur until after the legislature makes a decision on expansion/replacement. Mr. Gaspar stated that one element of the recommendation was beyond the year 2020. If the north/south runway is built, it means that the airport will remain where it is and that the north parallel runway is an option beyond the year 2020. With respect to a question from Mayor Mertensotto regarding information on how residents can apply for noise attenuation funding, Mr. Finney responded that the MAC is looking at how to implement the Part 150 programs and anticipates having an administrative process in place by early in 1992. Councilmember Smith was excused at 8:30 P.M. RECESS Mayor Mertensotto called a recess at 8:30. The meeting was reconvened at 8:40 P.M. WATER STUDY Council acknowledged a memo from Public Works Director Danielson regarding the City water study prepared by HNTB. The purpose of the study was to analyze the City water supply system and make recommendations. Mr. Brian Lamone and Mr. Tom Rosher, from HNTB, reviewed their report and recommendations for Council and gave a slide Page No. 3116 September 17, 1991 presentation. Mr. Lamone recommended that the City implement a permanent odd/even sprinkling ban until permanent improvements to the water system are constructed, and that a five mile long 24" pipe be constructed from the West St. Paul reservoir to the City's water tank. Mayor Mertensotto stated that the engineering staff has the ability to invoke an odd/even ban now. Mr. Lamone responded that many times, between the time a problem is observed and notice of a ban can be given, the level in the tank can drop an awful lot. He pointed out that the tank only stores 2 million gallons of water and that peak usage in the city is 2 million gallons a day. Councilmember Cummins asked whether it would be cheaper to install a parallel pipe which is not accessed by sprinkler systems. Mr. Lamone responded that the recommendation is to install a 24 inch line in addition to what currently exists. Mayor Mertensotto asked if there would be an option to build an additional reservoir as opposed to installing the line. Mr. Lamone responded that the City needs to build a way to get the water to the south part of the City and would need to construct three miles of 24 inch water line to get to the site of a new reservoir. He stated that it has been his experience that the option of an additional reservoir would cost more than what is proposed. Mayor Mertensotto asked if a possibility would be to construct a 24 inch line from the 30 inch line that fills the reservoir, running a transport line to Delaware and Thompson. Mr. Lamone responded that any 24 inch line that would be constructed from the north end of the city towards the south end would help. Mr. Rosher stated that the computer model of the water system will be an interactive design tool for City staff to use to be able to identify where problems exist and the most cost effective solution. Councilmember Blesener moved to accept the report and authorize staff to prepare a report analyzing the recommendations and presenting Page No. 3117 September 17, 1991 options for Council implementation. Councilmember Cummins seconded the motion. Ayes: 4 Nays: 0 BID AWARD, MENDOTA Council acknowledged a report and tabulation HEIGHTS BUSINESS PARK of bids received for improvements to serve the Mendota Heights Business Park Second Addition (Lennox site). Councilmember Cummins moved adoption of Resolution No. 91-68, "RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR CONSTRUCTION OF SANITARY SEWER, WATER, STORM SEWER AND STREET CONSTRUCTION TO SERVE MENDOTA HEIGHTS BUSINESS PARK 2ND ADDITION (LENNOX, IMPROVEMENT NO. 9, PROJECT NO. 3)," awarding the contract to Ryan Contracting, Inc., for their low bid of $83,676. Councilmember Blesener seconded the motion. Ayes: 4 Nays: 0 LANDFILL ABATEMENT Administrative Assistant Batchelder reviewed his report regarding the 1992 funding application for the Dakota County Community Landfill Abatement Program. Councilmember Koch moved adoption of Resolution No. 91-69, "A RESOLUTION SEEKING FUNDING FROM DAKOTA COUNTY FOR CONTINUATION OF COMMUNITY LANDFILL ABATEMENT PROGRAM." Councilmember Cummins seconded the motion. Ayes: 4 Nays: 0 CDBG PROGRAM Council acknowledged and discussed a memo from the City Administrator regarding the 1992 Community Development Block Grant Program application and the appointment of a Council representative to the District Two Review Committee. Council discussed various potential uses for CDBG funding, including extension of a 24 ine water line to the Beebe area, senior citizen housing, a senior citizen community service program, etc. Administrator Lawell suggested that the City at least apply for money for home rehabilitation. Ayes: 4 Nays: 0 AIRPORT REUSE TASK FORCE Ayes: 4 Nays: 0 Page No. 3118 September 17, 1991 Councilmember Cummins felt that perhaps a program could be created to upgrade properties which owners have allowed to become run down. Staff was directed to review the target issues, compile suggestions from Council, and report back in October. Councilmember Cummins moved to appoint Councilmember Koch as the Council representative on the CDBG District Two Review Committee. Councilmember Blesener seconded the motion. Council acknowledged a report from the City Administrator regarding the newly formed MSP Reuse Task Force. Councilmember Koch moved to appoint Councilmember Cummins as the City representative to the MSP Reuse Task Force, and to designate Councilmembers Smith and Roe Entis�-cra as designated alternates. Councilmember Blesener seconded the motion. PENTEL LITIGATION Mayor Mertensotto informed Council that Attorney Moorman has asked that Council schedule time on October 15th to give depositions with respect to the Pentel litigation. It was the consensus that the depositions be scheduled starting at 1:00 P.M. on October 15th at City Hall. COUNCIL COMMENTS Councilmember Blesener asked that staff prepare a summary of Park and Recreation Commission meeting attendance. Councilmember Blesener informed Council that she will be absent from the October 1st meeting. CITY OF MENDOTA HEIGHTS DRAFTDAKOTA COUNTY, MINNESOTA PLANNING COMMISSION MINUTES SEPTEMBER 24, 1991 The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, September 24, 1991, in the City Hall Council Chambers, 1101 Victoria Curve. The meeting was called to order at 7:35 o'clock p.m. The following Commission members were present: Friel, Koll, Duggan, Dreelan, Krebsbach, Tilsen. Excused members were Chair Dwyer. Also present were Public Works Director James Danielson, Planning Consultant Tim Malloy, and Administrative Assistant Kevin Batchelder. APPROVAL OF MINUTES Commissioner Friel moved approval of the August 27, 1991 minutes. Commissioner Duggan seconded the motion. AYES: 5 NAYS: 0 ABSTAIN: 1 (Tilsen) CASE NO. 91-34: CHEESEBROW VARIANCE r Mr. Nick Cheesebrow, of 594 West Marie Avenue, was present to explain his requested variance. Mr. Cheesebrow stated that his old garage was a carport originally and that he had it modified in 1965 and it now needs new work. Mr. Cheesebrow stated that Marie Avenue is a dangerous road to enter from his property because of the hill on Marie and the traffic as it comes over the hill at the corner of Callahan and Marie. Mr. Cheesebrow stated that most visitors to his home park on Callahan because of the situation on Marie Avenue. Mr. Cheesebrow stated that he desires to have a two car garage and has requirements for more storage needs. He stated that should he receive permission to build his two car garage that he would be removing the detached shed on his property that he currently uses for storage. Mr. Cheesebrow stated that the house is constructed as passive solar and that is the reason it is skewed towards the side lot line. Mr. Cheesebrow stated this is why the corner of the garage, as proposed, is two feet four inches over the side yard setback. He stated the encroachment on the setback was a total of seven square feet. Commissioner Koll stated that the two car garage looked like an improvement to the home and that it appears the traffic problem is real at the hill on Marie. Commissioner Koll inquired if the garage apron was 30 10 feet from the right-of-way on Marie Avenue as required in the new Zoning Ordinance. Public Works Director Jim Danielson responded that the driveway meets the requirements of the Ordinance and is approximately 45 feet from the intersection. Commissioner Friel stated that this seems to be a minor request and inquired if the orientation of the garage could be moved two feet to avoid the variance. Mr. Cheesebrow responded that his original design for a two car garage showed a larger garage of 28 feet. Mr. Cheesebrow stated he revised the size of the garage downwards by moving it nine inches to the west and he cut the length of the garage from 21 feet to 20 feet. Mr. Cheesebrow explained that there was a skylight on the west of the house that illuminates his front entry. Moving the garage further west would cause this light to be eliminated. Mr. Cheesebrow stated that he is already removing the four foot skylight and replacing it with a three foot skylight in order to adjust the garage. Mr. Cheesebrow stated he doesn't want to lose the skylight as it illuminates his interior front entry and provides an amenity to the home. Commissioner Duggan inquired if the shed is coming down and Mr. Cheesebrow responded yes. Commissioner Friel moved to recommend that the City Council approve the requested two foot four inch side yard abutting a street setback variance. Commissioner Koll seconded the motion. AYES: 6 NAYS: 0 CASE NO. 91-37: KEITHAHN VARIANCE Mr. John Spencer, of Sawhorse Builders, appeared before the Planning Commission to explain the requested rear yard setback variance of 2.6 feet for Mr. Larry Keithahn, of 697 Decorah. Mr. Spencer explained that the home was constructed without any crawl space for expansion and that the expansion is needed for a growing family. Vice -Chair Krebsbach inquired if there was a full basement on this house. Mr. Spencer responded no. Commissioner Tilsen stated that it appears the City will be receiving a lot of these types of variances in this neighborhood. Tilsen stated that Delaware Crossings was built without basements and that he believes the lots are minimal in size for the size of houses constructed there. Tilsen stated that caution should be urged on variances in this area. He stated that it appears many houses in this neighborhood had been built without family rooms and no basements. Vice -Chair Krebsbach inquired how many houses in this area have no basements. Public Works Director Jim Danielson responded that it was his impression that most of the houses in this neighborhood do have basements. Commissioner Duggan responded that he knew people in this neighborhood and that the lack of basements was probably the exception, rather than the rule. He stated he has visited houses in this neighborhood and that most of the basements are damp during wet weather. Commissioner Dreelan suggested to Mr. Spencer that sump pumps and drain tile be installed as most of the area has a history of wet basements. Commissioner Koll inquired about what type of gutter runoff plans there would be. Mr. Spencer explained the gutter plan and that it wouldn't drain onto the neighbors property. Mr. Spencer stated that they would be relocating the Juniper bushes to another location in the yard and that the big tree in the back yard will remain. Commissioner Koll moved to recommend that the City Council approve the requested 2.6 foot rear yard setback variance. Commissioner Duggan seconded the motion. AYES: 6 NAYS: 0 CASE NO. 91-29: RESURRECTION SIGN VARIANCE Mr. Jon Louris, Assistant Superintendent of Resurrection Cemetery, appeared before the Planning Commission to discuss a request for temporary signs that require a setback variance and a time limit variance. Mr. Louris explained the recent approvals for the new sign system"that has been constructed at Resurrection Cemetery. Mr. Louris stated Resurrection Cemetery now realizes that the old entrance needs to be closed with some proper traffic direction to the new entrance. He stated Resurrection Cemetery will be removing the old entrance and fencing it shut. Mr. Louris stated it is Resurrection's intention to have a temporary sign internal on the lot warning about the closing of the entrance on October 15th. He stated Resurrection would be sending letters to all funeral directors in the area. Mr. Louris explained when the gate is closed Resurrection Cemetery would then like to place a sign on the gate explaining the new location of the main entrance. Commissioner Duggan inquired about the size of the signs, if they met the requirements. Public Works Director Jim Danielson stated temporary signs are allowed to be 25 square feet and both of these signs are significantly less than 25 square feet, approximately in the neighborhood of six or seven square feet. Commissioner Friel moved to recommend that City Council approve a setback variance to allow a temporary sign to be placed on the property line for a period of one year. Commissioner Koll seconded the motion. AYES: 6 NAYS: 0 CASE NO. 91-35: KNAEBLE SUBDIVISION Mr. Peter Knaeble appeared before the Planning Commission to discuss his proposal to split 1760 Dodd Road into a three lot preliminary plat that would require two variances to the required 100 foot lot width and would require wetlands permits to place the two houses and a culvert. Mr. Knaeble explained their proposal includes two new flag lots with a common drive. Mr. Knaeble submitted for the public record an outline discussing his presentation. (See attached.) Vice -Chair Krebsbach asked Mr. Knaeble to locate the barns and the sheds on the project. Mr. Knaeble stated the shed and the barn are structures that will come out. He stated the existing house faces on Dodd Road and he further clarified that the red barn is on someone elses property to the rear. Mr. Knaeble stated the plan shows setbacks to the adjacent creeks. He stated the 100 foot setback requirement takes up one half of the property. Mr. Knaeble stated that the front two lots would both exceed 30,000 square feet and that the rear lot would be 60,000 square feet and that this matches neighboring properties on the east side of Dodd Road. Mr. Knaeble stated on the west side of Dodd Road is a subdivision with mostly 15,000 square foot lots. Mr. Knaeble stated he met twice with City staff and on the second occasion the setbacks to the creek were adjusted to 80 feet to allow for homeowner/buyer preferences for larger houses. Mr. Knaeble stated that a 60 foot right-of-way to serve the rear of this property with a cul-de-sac would put the existing homes into non-conformance regarding their side yard setbacks. Mr. Knaeble stated a public street would require four variances whereas his proposal for two flag lots requires only two variances. Mr. Knaeble stated his proposal, with private drives to the rear of the property, was more sensitive to the trees and the creeks in the area. Commissioner Koll announced the Planner's Report stated that some organization for this area was needed, instead of considering variances for each lot. Commissioner Koll stated a plan is preferred for the area rather than disorganized development on a case by case basis. Commissioner Koll stated that she was concerned about emergency services to flag lots with long private drives. Administrative Assistant Batchelder stated roadway plans and area plans had been considered in the past for this square block area and that some of these plans were dated back to the early 19601s. Batchelder stated that the City has not adopted any of these plans. Planning Consultant Tim Malloy gave a presentation on an area plan for a roadway system and development of the "super block" done by Midwest Planning in 1961. Malloy stated at that time a roadway configuration was proposed and showed a park dedication in the middle of the block. Mr. Malloy stated Ridgewood Drive was proposed to go through to Delaware and that cul-de-sacs were shown on the north side of the proposed subdivision before us tonight. Mr. Malloy stated, in the area where these cul-de-sacs were shown, the Ridders own platted lots that are in the shape of a right-of-way, however, they are not dedicated as a right-of-way, they are private platted lots. Mr. Malloy stated any roadway master plan in this area is complicated by the large amount of wetlands and the multiple ownership of private property in this area. Commissioner Tilsen inquired under what scenario could this master plan happen in order to give residents an idea of when this could occur. Planner Malloy stated it would involve doing a master plan for the area, re- examining existing conditions, property ownership, topography and looking at the potentials for development in this area. Commissioner Tilsen stated the southeast area master plan was a different beast than this because there was really only one major owner. Planning Consultant Malloy stated when they started the master plan for the southeast area there were at least a dozen owners involved. Commissioner Friel stated there was a difference between the southeast area and this. He stated there was coordination among the owners that a master plan was needed. Planner Malloy stated announcements could be made and public hearings could be held in order to do a master plan process and that it would take approximately six to nine months. Mr. Knaeble stated his subdivision was simply a three lot split with private drives that would not preclude any future master planning or roadway systems in this area. He stated he felt his subdivision would not impact or prevent that type of system from occurring in the future. Vice -Chair Krebsbach inquired if a master plan had ever been formally presented in the past. Public Works Director Jim Danielson stated that these roadway plans were presented back in the 1960's and 1970's. Commissioner Friel stated he had some concerns about Outlot A and inquired what was the logic behind this outlot. Mr. Knaeble responded they had looked at this outlot with two options. The first option was Outlot A could go to lot three to enlarge it or the second option would have Outlot A being made available to the neighbors to the south at 1770 Dodd Road. The rear of their property is only 90 feet wide and if they wish to develop in the future it appears they could use some buildable area. Commissioner Friel inquired about the two ten foot driveways shown on the plan. Mr. Knaeble explained that there are two ten foot property strips, however, there would only be one single 15 foot wide driveway and that would provide legal access for each property. Commissioner Dreelan inquired about interest on buying the lots as proposed. Mr. Knaeble responded that, yes, there has been interest and that is why they approached staff to inquire about an 80 foot wetlands permit setback in order to allow bigger houses that prospective buyers intend to build. Vice -Chair Krebsbach opened the public hearing for comments from the audience. Mr. Jim Fischer, of 1758 Dodd Road, stated he lived just north of the subject property and explained there is a lot of water running through that creek in the springtime. Mr. Fischer inquired what will happen to the rate of the water flow through his backyard with this new development. Mr. Fischer stated he was concerned about retaining water as it flows through the creek and can back up into his property. Mr. Knaeble responded that the flow of the water would be handled by a culvert. Mr. Fischer inquired what would become of the house at 1760 Dodd Road. Mr. Knaeble responded the house will remain as existing, however, the barns and the sheds at the rear of the property would be removed. Commissioner Friel inquired about the extra impervious surface of the new homes and driveways and how that will drain into the watersheds. Mr. Knaeble responded this would not be a significant increase in the amount of water going into the watersheds and he stated he felt the watersheds could handle that additional water. Mr. Jake Deeb, of 1780 Dodd Road, stated he lives to the south of this property. Mr. Deeb stated he has seen the water up to four feet from his house and that in the springtime large amounts of water flow through this creek. In fact, he stated he has canoed it in the spring before. Mr. Deeb stated his house is 15 feet higher than the proposed home levels and the creek rises on occasion pretty high to his house. Mr. Deeb stated he can't perceive that you could dig four feet down anywhere in this area and not have the hole fill up with water. At the request of the Commission, Public Works Director Jim Danielson explained the drainage in this area. Danielson stated the creek on the south has water coming all the way from West St. Paul. Mr. Danielson stated the creek on the north is a small creek and not near as large as the creek on the south. Danielson stated both creeks are identified on the City's wetlands map and any development in this area must seriously consider elevations, drain tiles, soil conditions and culverts to enable the first creek to be crossed and not impede the flow. Danielson stated a City street in this area was not feasible and a private drive was a better way to handle access to this property and preserve the trees and the drainage ways. Mr. Danielson stated the size of the culvert pipe to cross the first creek would have to be coordinated with the City's Engineering Department. Mr. Danielson stated he did not feel this culvert would create any adverse impact on the neighbors. Ms. Juarez, of 1756 Dodd Road, stated the streams are always full in this area and they very seldom run dry. She inquired if there was any guarantee the water won't back up or be retained towards their house which is to the north of the subject property. She stated when the Dodd Road culvert project was done that water backed up at that time and this is a pretty wet area and always has water. Mr. Knaeble responded they won't be damming or impeding the water flow and the culvert they would provide to cross the first creek should provide the same rate of flow as the current stream. Mr. Knaeble stated, as far as the water table is concerned, they y- had soil testings done with borings on the subject property and the results showed the proposal is feasible. Mr. Knaeble stated that the culvert will be sized in coordination with the City Engineering Department and their criteria for storm drainage. Mr. Deeb stated that there currently exists restriction on flow downstream from the subject property and inquired if the drainage plan for this area would increase that restriction. Mr. Knaeble responded the development project should not increase or change in any fashion the flow downstream from the subject property. Commissioner Tilsen inquired if the City had done any drainage plan for this area. Public Works Director Jim Danielson responded that no master plan for storm water runoff had been done for this area. Commissioner Tilsen stated as each parcel develops they appear insignificant by themselves, however, when all added together it makes a difference on the impervious surface runoff in this area. Tilsen stated this is a unique property because it's on the fringes of water on both sides and it's between two drainage ways. Commissioner Tilsen stated he felt utilities and emergency services would be better served from a system that provides interior access. Planning Consultant Tim Malloy stated a previous master plan for this area had shown a cul-de-sac from the north, however, this would have to be done in cooperation with other owners in the area. Planner Malloy stated a comprehensive look at a cul-de-sac such as this would provide a roadway and storm sewer system for the subject property. Commissioner Tilsen inquired if any attempts had been made to cooperate with adjoining property owners. Mr. Knaeble stated that yes the people to the south are in the audience tonight. Mr. Knaeble stated the properties to the north had not been contacted. Ms. Gretchen Arndt, of Burnet Realty, stated she is representing the Walker's in this real estate transaction. She stated that the Petersons, the property owners to the south, have been consulted. She felt a cul-de-sac proposal was too restrictive to the lot sizes in the area and would impact the wetlands and trees greater than a private drive proposal. She stated the private road design and Outlot A had been planned to help the Petersons should they decide to develop in the future. She also stated City water could connect to the Petersons with this scenario. Commissioner Duggan stated he was concerned about having two lots so deep with only 20 feet of access. Commissioner Duggan inquired about servicing gas, electric, phone, and water in the future should any of these utilities need to be dug up when there is only 20 feet of access. Mr. Knaeble responded the utilities would not necessarily be restricted to the 20 foot necks as proposed and there would be easements granted for access to all the utilities. Commissioner Duggan inquired how does any emergency service truck turn around in this area. He stated he had some concerns about a 500 foot long private driveway. Mr. Knaeble responded the same situation is occurring with many of the homes in this block. He stated he felt the privacy amenity outweighed the public safety concerns to most buyers. Commissioner Tilsen inquired if the sewers were feasible with the elevation shown on the proposed plan. Mr. Tilsen stated the house is only two feet higher than Dodd Road and there is a creek to be crossed. Public Works Director Danielson responded the feeder depends on the house elevation and that trunk lines do exist on Dodd Road. Commissioner Tilsen stated he was concerned about the level of the creek, the level of Dodd Road, the level of the houses, and basement elevations. Commissioner Tilsen inquired if they had talked to others in the neighborhood. Mr. Knaeble responded yes they had talked to other property owners but there had been no interest in coordination. 4 Commissioner Tilsen inquired if there were others in the audience that were in favor of a master plan for this area. Mr. Fred Peterson, of 1770 Dodd Road, stated it was about time the City did something regarding decisions on development in this area. He stated if this area is developed, it should be done properly with the City and not with umpteen driveways. Mr. Peterson stated he would like to see a program developed by the City and that now is the time to do it without giving out special permits, variances, etc. Mr. Peterson stated the Fire Department needs to be able to get their new, expensive trucks back into this area. Mr. Jim Fischer stated he is not opposed to this proposal. He stated it is his belief that Mr. Ridder wants to keep this area as it is, in its current existing condition with large estate lots. Commissioner Friel says it's all good and well to have a comprehensive plan. He stated, however, that people who own property in this area must be in the position to carry it out once a comprehensive plan is decided. Mr. Friel stated he did not see the current property owners in this area stating a need for such a master plan. Commissioner Friel also stated that comprehensive plans can force development in an area and its been his experience that large developments can be a mess on the impact to the land compared to a small well done development. Commissioner Friel stated he is still troubled about Outlot A and he believes more information should be available on the drainage issues in this area. Commissioner Friel stated this proposal with large lots and private drives, is preferred. Commissioner Friel moved that the Planning Commission continue the public hearing until the October meeting. Commissioner Friel stated as a condition of continuing the public hearing the applicant should submit a better proposal for Outlot A and should submit some more drainage information. A friendly amendment by Commissioner Tilsen stated this site should be served by City sewer and water. A friendly amendment by Commissioner Duggan stated vegetation preservation and protection plan and tree study required in the Subdivision Ordinance should be provided and that the 23 factors in the Wetlands Permit Ordinance should be addressed by the developer. Commissioner Duggan seconded the motion. AYES: 6 NAYS: 0 Vice -Chair Krebsbach stated if the developer intends to put bigger homes on the preliminary plat, it should be shown as such. Commissioner Friel suggested the developer should attempt to honor the 100 foot wetlands setback and, as far as Outlot A was concerned, what he was looking for was a more definitive proposal that identifies the future use of that outlot. Vice -Chair Krebsbach stated the City staff should provide an overview of this area and suggested a City Planning Commission tour of the site and area. It was decided that at the end of the meeting the Planning Commission would adjourn to a special meeting on some Saturday in October in order to visit the site. CASE NO. 91-36: RING/MULFINGER CONDITIONAL USE PERMIT Mr. and Mrs. King were present to explain their proposal for a conditional use permit to expand their detached garage and to have a rear yard setback variance. Commissioner Dreelan inquired about the tunnel on the plan. Mr. King responded that the tunnel is an idea that they would not necessarily build. He stated that the north side of the house is very icy in the winter and hard to maintain the walk. He stated that was what generated the idea of a tunnel. Commissioner Koll inquired about the drainage that comes out onto the concrete block retaining wall. She stated it was her observation that water moves onto the garage apron area where the proposed extension is designed to be. Mr. King responded the landscaping is proposed to change the drainage from Ashley onto the yard and a gutter system on the garage will help solve the water problem near their driveway apron. Commissioner Friel inquired if the plan could be adjusted to avoid the rear yard setback variance. Mr. King responded that in order to extend the garage in the other direction they would have to cut into the yard with a lot of excavation. Mr. King stated the poor visibility is due to the brush and existing vegetation, not the location of the garage. Commissioner Duggan stated he likes the garage design and the European feel. Commissioner Tilsen inquired if having a storage shed on top of the garage was appropriate. Commissioner Tilsen stated he had a concern that this storage shed not be occupied as living space in the future. Mr. King stated he was willing to have that included as a condition of his permit. He stated the garage is planned to be unheated but they would like the ability to heat the garage in the future. Commissioner Friel inquired about the height of the structure as outlined in the Planner's Report. Planner Malloy stated that according to his calculations a two foot variance is needed for the roof height. Commissioner Duggan moved that City Council approve a conditional use permit for accessory structure and a 17 foot 3 inch rear yard setback variance and a two foot roof height variance with the condition that the drainage plan for the project be approved by City staff. Commissioner Friel seconded the motion. Two of the calls were structures fires. One in the City of Mendota Heights was dispatched on August 4th at 5:12 P.M. Upon arrival the department found that a plastic bowl on the back burner of a stove had melted. The fire and damage confined to the stove and the plastic bowl. The estimated damage was $100. The second fire occurred on August 5th at 10:07 A.M. in Sunfish Lake. The department was dispatched to a structure fire that turned out to be a pump house for the swimming pool. The department was also informed, at the time we were dispatched, that there were several containers of butane next to the home. Upon our arrival the crew made a quick extinguishment and the butane tanks were not a problem. The cause was listed as a short in a robotic pool cleaner. Damage to the structure was estimated at $500 and contents at $5,000. The department also responded to a Mutual Aid call to standby at Inver Grove Heights Station #3 while Inver Grove Heights responded to a structure fire at 2:43 A.M., August 11th. TRAINING The monthly departmental and squad drills were spent training at a house that was loaned to us by the Eagan Fire Department. Firefighter practiced, in a live situation, search and rescue techniques and use of the Self Contained Breathing Apparatus. The house was filled with a non-toxic smoke, with borrowed smoke generators, and firefighters were expected to go in and rescue a couple of teddy bears using the search and rescue techniques. It was a realistic fire drill with the exception that there was not any heat. Visibility and actual working conditions, with full turnout gear, were similar to an actual fire. Swanson SUBJECT: Halloween Bonfire INTRODUCTION Russ Wahl called today to ask permission to conduct the annual Halloween Bonfire. In past years, the City has provided funds to support the cost of hot dogs, etc. Russ has asked that Council authorize $350 for the 1991 bonfire. In addition to the efforts of Russ, his wife Marilyn and members of the Volunteer Fire Department, two local businesses participated in the 1990 bonfire. Employees of the Dakota County State Bank distributed candy bars to everyone in attendance, and Holly Homes ran a popcorn stand and provided free bags of popcorn. Russ felt that the business involvement was a very positive addition to the activity. He is concerned, however, that Council has not discussed or authorized participation by businesses. He has asked that this matter be brought to your attention and that he be informed of the Council's consensus. It is my intent to place this memo on the consent calendar and to recommend that local businesses 'expressing a desire to participate be allowed to do so, subject to Russ Wahl's approval. If Council does not concur in this request, the matter can be removed from the consent calendar for discussion as part of the regular agenda. I was directed to take the actions necessary to include that road on the City's M.S.A. system. DISCUSSION• The first step in the process to designate a new M.S.A. route is to receive prelimary approval, and I submitted a letter of request to Mr. Elmer Morris, our district engineer. On September 23rd I received a call from Mr. Morris informing me that State Aid Offices had now given Mendota Heights preliminary approval to add this segment of street to our M.S.A. system (see attached map). The next step toward adding this segment of street to our M.S.A. system is for Council to adopt a resolution formalizing the request. SUBJECT: Modified CAO Site Plan Review - 1845 Hunter Lane INTRODUCTION: Richard Frye who resides at 1845 Hunter Lane has submitted to staff a permit application and site plan requesting approval to install a six foot privacy fence three feet from their south property line. DISCUSSION• The Frye's property is located within the River Corridor Critical Area and therefore a modified site plan must be approved by City Council prior to staff issuing the requested fence permit. Council should note that Mr. Frye's proposed fence will be kept a minimum of 40 feet from the 40% bluff line. Mr. Frye is scheduled to meet with the City Planner on Monday, September 30, 1991 to discuss the possibility of extending the privacy fence to the west to less than 40 feet from the 40% slope (bluff line). This would require Planning Commission and City Council review and approval sometime in the near future. PRB:mlk CITY OF MENDOTA HEIGHTS MEMO September 27, 1991 To: Mayor, City Council and city Administrator From: Kevin Batchelder, Administrative Assisl�t Subject: Metropolitan Airports Commission Noise Monitor Tower Locations DISCUSSION At the June 4, 1991 meeting, the City Council directed staff to prepare a resolution granting approval to the Metropolitan Airport Commission's Remote Noise Monitoring System based on three sites identified by Council, and to authorize the Mayor to sign the resolution. The three identified sites were the former Mendota Water Company well -site on Mohican court, the city -owned Tousignant property on T.H. 55 and the City tot lot in Curley neighborhood. (See attached minutes.) Recently, MAC has informed the city that two sites are unacceptable because of highway noise. The two sites were the City -owned Tousignant property on T.H. 55 and the City tot lot in Curley neighborhood. John Foggia, of MAC, has been working with staff to find alternative sites. MAC desires to have the towers up and operational by December 31, 1991. Alternative sites have been identified in the Furlong neighborhood and in the Curley neighborhood as shown on the attached maps. Site Number Two, in Furlong neighborhood, is proposed to be at either 1305 or 1306 Kendon Avenue. Both properties are owned by the City. Monitor Site Number Three, in Curley Neighborhood, is proposed to be located on a small lot that houses an AT&T -utility building and driveway. This site is heavily screened by landscaping from neighboring properties. Staff has not heard back from AT&T, but in any case the tower could be located in the R.O.W. ACTION REQUIRED At the June 4, 1991 meeting, Council authorized the Conditional Use Permit for Remote Noise Monitors in three locations. The new proposed sites are being presented to City Council for the purpose of inf'orming Council of the slight changes in locations due to technical requirements. If -Council concurs with the new locations, no new action is necessary. Page No. 3025 June 4, 1991 for the permanent monitoring system. He pointed out that people are normally at a loss as to how to address problems to the FAA, and that the MAC representatives are present to collect data so that they can prove to the FAA that planes are flying out of the corridor. He informed the audience that MAC also needs the residents' phone calls and that they respond to what the residents say - when Mr. Foja gets a resident call, he calls the FAA. Many people have seen planes north of T.H. 110, and what this system will be able to do is radar -track data. MAC will submit that data to the FAA with suggestions on how to address it. The system will track 15 to 20 miles from the airport and will provide indisputable information recorded by the FAA's own equipment. The information will be compiled and presented to MASAC, and residents can come to Mr. Foja's office to look at or acquire the data. See enclosed Ordinance section. INFORMATION• Mrs. Wild is of the opinion that the Ordinance should be specific in it's requirements for board spacing of fences and that four inches would be an appropriate dimension. See enclosed letter. The Uniform Building Code does not address swimming pools. The reference to Section 1711 pertains to guardrails that are required when the elevation difference is over 30 inches. We have been using this six inch criteria for spacing requirements around pools since we felt that the purpose of a guardrail was similar. ACTION REQUIRED: Listen to Mrs. Wild's reasons for an Ordinance modification and decide whether or not it would be appropriate. Advise staff of any changes to be made. RG:mk L_ . 5.1(1) Pools shall not be located within ten feet, measured horizontally, from overhead or underground utility lines of any type. 5.1(2) Pools shall not be located within any private or public utility, walkway, drainage or other easement. 5.1(3) In the case of underground pools, precautions shall be taken during construction to: 5.1(3)a Avoid damage, hazards or inconvenience to adjacent or nearby property. 5.1(3)b Assure that proper care shall be taken in stockpiling excavated material to avoid erosion, dust or other infringements upon adjacent property., 5.1(4) All -access for construction shall be over the owner's land and due care shall be taken to avoid damage to public streets and adjacent private or public property. The owner shall be liable for damages caused to any public or private property. 5.1(5) To the extent feasible, back-flush water or water from pool drainage shall be directed onto the owner's property or into approved public drainage ways and shall not drain onto adjacent private land. Drainage onto public streets or other public drainage ways shall require permission of the appropriate local City officials. 5.1(6) Pool lighting shall be directed toward the pool and not toward adjacent property. 5.1(7) The pool area shall be enclosed with fencing to effectively prevent the entrance of children and be without hand or foot -holds that would enable a child to climb over it. The fence shall be at least five (5) feet in height, but not exceeding six (6) 'feet, to prevent uncontrolled access from the street or adjacent property. Such fence shall have self-closing and self -latching gates with provisions for locking and shall be completely installed prior to the filling of the pool. Adequate screening, including but not limited to, landscaping shall be placed between the pool area and adjacent single-family district lot lines. 5.1(8) Retaining walls shall be designed to resist the lateral pressure of the retained material in accordance with accepted engineering practice. Gill Code Enforcement Officer Regarding: Pool enclosure, 815 Hazel Court Dear Mr. Gill: This letter is written in response to various telephone conversations and letters from your office regarding the pool enclosure at my residence at 815 Hazel Court. Written correspondence regarding this issue which I have received is attached as follows: 1) Mendota Heights letter dated 8-20-91 (attachment #1) 2) Bill and Betsy Wild's letter dated 8-14-91 (attachment #2) 3) Mendota Heights letter dated 9-13-91 (attachment #3) First of all, I would like to confirm that my original construction plans for the pool, deck and fencing were submitted to the City, of Mendota Heights in April of 1987. After several revisions, my plans were approved and were submitted to the City -Council for approval at the May 5, 1987 Council meet- ing. Everything I constructed was approved by the Mendota Heights Council and the Code Enforcement_Office. Many inspections by your office during the summer of 1987 were made of the pool, deck and fence construction. Our family and neighborhood has enjoyed the pool. Many times we have opened it up to neighborhood children with our supervision for enjoyment with no problems. We did not have any complaints about our pool until the summer of 1990. Our new neighbors, the Wilds, told my children they were concerned that the fence around the pool may not be child proof. Additional concern was voiced by the Wilds the week of August 11, 1991. See letter dated August 14, 1991 from the Wilds. As a result of calls to your office by the Wilds, I received your letter dated August 20, 1991. Jim Danielson and yourself also called at my home at that time, inspected the pool area and spoke with my wife regarding the complaints. In response to your August 20, 1991 letter, I replaced approximately thirteen feet of pool fence to correct the height problem of one to six inches by August 24, 1991. Also, I researched the home improvement stores for a good "child -proof" fence. I came upon a product manufactured by Conwed Corpora- tion. It is a "Utility Net" plastic fence advertised as "Deck Safety Screen," (see attachment #4 and #5). It pictorially shows my pool fence situation. This was installed and completed by August 31, 1991. I am also in receipt of your letter dated September 13,, 1991, regarding the same issue. I will install additional staples to address the issue in para- graph #2. I will again research the home improvement market and find a mechanism to comply with paragraph #1. This will all be completed before the opening of the pool for the summer of 1992. As of September 9, 1991, the pool has been closed (covered) and the doors paddlelocked. First time I've had to lock my fence to keep my neighbors out. I thank you for your cooperation and time spent to resolve this issue. You're a professional in your field. I must also go on the record and state that if parents don't }mow where their 18 month old and three year old children are, whether it's my pool, the pond at the back of our properties, the large drain culvert behind our home or the neighborhood kiddie pool (see attachment #6) not enough "child proffing" will solve the problem. I am not sure what the latest complaint pertained to, but in order for your gates -to comply with the ordinance they will have to be fitted with self closing hardware. As the ordinance states "Such fence shall have self-closing and self -latching gates with provisions for locking..." Another issue of concern is the size and number of staples used to secure the plastic netting. Although I haven't seen the product information that you -have that may give installation recommendations, I think that more and larger staples should be used so that it would be more difficult to push the netting away from the wooden fence. The program has worked well to date with the participants providing a positive service to the community through their volunteer efforts. The program is designed to provide some recognition and visibility in exchange for the volunteer services. The Adopt -A -Park program provides community groups, or individuals, with the opportunity to clean up parks, or trails, in exchange for the City providing trash bags and a sign designating an adopted park, or trail section. The permit obligates the participant to two cleanups per year. for a two year period. In reality, most of the participants are visiting the park and picking up litter on a regular basis. The commitment to improve the look of our City parks on a volunteer basis should be commended. Certificates of Recognition to award to the Adopt -A -Park participants have been prepared for tonight's meeting. Signs for the parks have arrived and will be installed this week. Resurrection Cemetery desires to close the main entrance at the northeast corner along Lexington Avenue and redirect traffic to the new main entrance further south on Lexington Avenue (by the apartments). See attached plans and memos. Resurrection is proposing to fence off the old entrance and desires temporary signs to; 1) announce the closing date of October 15th; and when the gate is fenced, 2) to direct traffic to the southern gate with a directional sign. RECOMMENDATION• The Planning Commission recommended unanimously that City Council approve a setback variance to allow the second sign to be placed on the property line when the gate is fenced and a variance to allow a temporary directional sign for a period of one year. The'City recently processed and approved variances allowing Resurrection Cemetery to install new nameplate signs along Lexington Avenue near the apartments and on TH110. These new signs were needed -to establish two new main entrance locations. The Cemetery's existing main entrance.is located at the northeast corner of their site near GNB. DISCUSSION: - Now that these new signs are in place and they are about to close their existing main entrance near GNB, they realize that they need two temporary signs redirecting the traffic (see attached plans) to the new main entrance on the south. Sign B on the attached plans will conform to the City's Ordinance, however, sign -A will violate the setback and time limit provisions in Section 21.5(5). Sign A is proposed to be located on the fence itself which is on the lot line and be in place for a period of one year. The new garage being proposed encroaches upon the side yard setback which abuts a public street, by two feet, four inches (21 411). See attached plans and report. As required under the new Zoning ordinance, Mr. Cheesebrow has obtained signatures from all property owners within 100 feet of his property giving their consent to waiver of the public hearing. Therefore, it is not necessary for the Planning Commission to hold a public hearing on this variance request. The proposal will also realign his driveway from Marie to Callahan, where there is significantly less traffic. Mr. Cheesebrow proposes to replace an existing single -car garage with a two -car garage on his corner lot at 594 West Marie Avenue. He also intends to change the orientation of the garage and relocate the driveway so that access is from Callahan Place instead of Marie Avenue. The driveway access to Marie Avenue would then be removed. Mr. Cheesebrow has stated that he intends to remove the storage shed located to the east of his existing garage and thereafter store the equipment within it in the new garage. The proposed garage would be located within 27 feet 8 inches of the right-of- way line adjacent to Callahan Place. Therefore, a variance of 2 feet 4 inches is required. Due to its orientation, only a small corner of the proposed garage would actually extend into the required corner side yard. 2. The Mendota Heights Zoning Ordinance states that a variance may be granted if there is a practical difficulty or undue hardship that prevents the property from being put to a "reasonable use". If the Commission feels that the property in its current condition (with single -car garage) represents reasonable use of the property, then there is no hardship since the applicant is creating the condition that exceeds the code standards. However, if the Commission agrees that a two -car garage is a basic necessity, then a variance may be reasonable. We say "may be reasonable" because there is an additional factor. The proposed garage is somewhat larger than the minimum dimension for a two -car garage. The proposed dimensions are 20 .feet by 26 feet. The standard dimensions Nicholas Cheesebrow, Case #91-34 �3 for a two -car garage are roughly 20 feet by 22 feet. Mr. Cheesebrow was advised that if he reduces the size of the garage slightly, he could probably fit it on the lot without a variance. However, in order to accommodate the equipment and other items currently located in the storage shed and give the family additional storage space, Mr. Cheesebrow feels the dimensions of the proposed garage are the minimum necessary to serve his needs. Therefore, not only must the Commission believe that a two -car garage is a basic necessity, they must also agree that the extra storage space meets the same test. 4. While there may be some debate regarding whether the change from a single -car to a two -car garage meets the hardship test, it is clear that there is a legitimate argument for reorienting the access to the garage to the east side of the lot off of Callahan Place. The existing garage is oriented such that the only possible access is from Marie Avenue. Marie Avenue is a fairly busy thoroughfare in this area and is steeply sloped at the location of Mr. Cheesebrow's driveway entry. This situation is clearly hazardous both for the Cheesebrow's and their guests and for vehicles passing by on Marie Avenue. The orientation of the proposed garage, as shown on the applicant's site plan, is the only arrangement that allows access off of Callahan and does not require the removal of existing vegetation or other more significant alterations to the structure. 5. There are several other factors that support the applicant's variance request. First, the existing storage shed, which is to be replaced, appears to be significantly closer than 30 feet from the property line along Callahan Place. In fact, it appears that the shed is closer to the property line than the proposed garage would be. Therefore, allowing the garage would result in an increase in the setback on this side of the lot over the existing condition. Also, two -car garages are common in the area surrounding the subject property. 6. The applicant's proposed garage would have minimal impact on the surrounding properties, despite the fact that it would be located in the front yard of a corner lot. The property directly east of the subject property is vacant and is zoned for large lot single-family use. The properties to the north of the Cheesebrow lot would have only a partial view of the proposed garage due to the location of existing vegetation on the property. The lot to the west of the subject property is also vacant and for sale at this time. The proposed garage would not be visible from this lot due to its orientation, the presence of landscaping, and the fact that the property to the west is significantly lower than the subject property. The applicant has provided the signatures of the adjacent property owners signifying that they have reviewed the plans for the garage and do not object to its construction. The proposed Nicholas Cheesebrow, Case #91-34 4 garage would also be substantially screened from Marie Avenue due to existing vegetation on the property and the slope of the road. 7. This proposal clearly has some unique characteristics that deserve special consideration. After the first plan was finished I finally measured the distances the garage would encompass and revised all to try and stay within proper distances. With much revision and compromise the garage ended up at 26ft wide and 20ft. deep. The garage was also moved 9 in to the west and the depth reduced from 21ft. to 20ft. to try and accomodate'the variance problem and still get a 2 car garage plus storage for yard tools, tractor, snowblower, etc. The overriding problem all the time remained the skylite dome that exists in the entry hall and dictates the position of the addition. The garage pitch is 3/12 with special trusses and more specific roofing application.Additionally the 48/30 skylite will be removed to the new garage and will substitute a 36/30 skylite to allow a valley clearance. To move any further west will mandate eliminating all skylite im the entry and a point of interest within the entryway. A move to the west further will spoil the front entry approach. We have a enclosed courtyard and deck that has a entrance now at the west end. The entrance is to be moved to the north side of the fence and next to the garage wall and then using the 3 ft. overhang of the garage roof for passageway past the brick veneer wall to the entrance in the courtyard fence and to the front entry door. LETTER OF INTENT: The need of a variance to build a new 2 car garage to replace the present 35 year old single car garage. The following describes changing the entry on Marie Avenue in the middle of the hill making entry and exit a hazard at all times, more so when snow is banked on the sides in winter, For safety to all concerned it is a good preventative factor. The subject property is owned by Mr. and Mrs. King. The King's propose to expand their existing garage 3 feet further towards the property line along Ashley Lane. They also propose to rebuild the upper part of the garage to provide additional storage space and to attach the garage to the house by constructing a below grade tunnel between them. In addition, they intend to do other grading in their rear yard and construct a deck off the back of the house. 2. The subject property is a through --lot and as such the construction, or alteration- of an accessory structure, requires a Conditional Use Permit (see Section 4.5(5)). The purpose of this section of the ordinance is to ensure that such structures are carefully sited and do not have a negative impact on the adjacent properties. 3. The criteria for granting a CUP includes the requirement that the proposed use for which the permit is to be issued is not detrimental to the health, safety and welfare of the general community and that the use does not create any traffic hazards (Section 5.6(5)). The existing garage is located approximately 15 feet 9 inches from the property line along Ashley Avenue and roughly 24 feet from the edge of the street. Lawrence Ring, Case No. 91-36 Page 2 4. We are concerned that extending the garage 3 feet closer to the property line could create a minor traffic safety hazard. The street in front of the proposed garage is narrow, slightly uphill and curving. In addition, the shallow driveway in front of the garage is bordered on both sides by vegetation and on the west side by a sloped area. These factors combine to make visibility poor for cars coming in and out of the property. This problem would be exaggerated by shortening the driveway. Also, vehicles parked in the driveway would extend nearly to the edge of the pavement for Ashley Lane. One factor that reduces the concern for traffic safety is that Ashley Lane is a very lightly traveled road. 5. The subject property is a through -lot. As such, the 30 -foot front yard setback applies to both the front and rear of the property. Legally both yards are front yards. As a result, the existing garage is a non -conforming structure and any expansion of the structure closer to the property line requires a variance. Since the existing garage was most likely constructed before the zoning ordinance was adopted, it is likely that no variance had been granted previously. Therefore, the applicant would need a variance of 17 feet 3 inches in order to establish legal status for the structure. 6. The Mendota Heights Zoning Ordinance requires that there be a hardship or practical difficulty in order to justify the granting of a variance. In the cheesebrow case (91-34), which is also being reviewed this evening, the commission is asked to decide whether the limitation to one garage stall constitutes the denial of right to reasonable use of the property. In this case, the King's already have a two -stall garage, but are requesting a variance for additional storage space. The dimensions of the existing garage (19 feet by 19 feet) are smaller than the typical 2 -stall garages. Here the commission must decide whether depriving the additional storage space constitutes denial of reasonable use. 7. Another test for hardship is to determine whether there are other reasonable and prudent alternatives. One alternative would be to construct a storage shed on the property separate from the garage. Another, more costly alternative that could be considered would be to extend the garage 3 feet in the direction of the house instead of toward the street. We realize that this would require significant additional excavation and reconstruction of the rear wall of the garage. However, the Kings are Lawrence King, Case No. 91-36 Page 3 already intending to excavate a tunnel 3 feet wide by 50 feet long through their back yard. They have also stated that they will be doing additional grading and leveling in their back yard. Depending on its height, the excavation for the tunnel could be in the area of 1,000 cubic feet of material. The excavation for the 3 -foot garage extension would only add roughly 200 cubic feet to the project. In fact, moving the garage wall closer to the house would reduce the length of the tunnel and further minimize the difference. As for reconstructing the rear wall of the garage, once again this wall was going to be significantly altered by the introduction of the tunnel anyway. Clearly this option would add to the cost of the project for King's. However, in light of the magnitude of the requested variance, the potential traffic conflicts and the fact that the project already includes substantial excavation, we believe it is an option worth considering. 8. The visibility of the garage from the adjacent properties and roadways would continue to be limited by the existing landscaping, assuming it is not removed during construction. Since the applicant has included no details regarding the exterior finishings for the structure, it is difficult to comment on the appearance of the structure other than to say the proportions of the wall facing Ashley Lane are somewhat massive. In fact, it is difficult to determine precisely from the applicants' sketches since the scale has been altered by the reduction process, but it appears as though the structure exceeds the maximum height limits allowed (15 feet) in the Zoning Ordinance. The subject property is owned by Larry and Laura Keithahn who propose to add a family room to the rear of the house. The proposed addition would extend to within 27.4 feet of the rear lot line. The Keithahn's are, therefore, requesting a variance of 2.6 feet from the 30 foot rear yard setback requirement. The addition meets all of the other standards in the zoning ordinance. 2. In this case, the Commission must determine whether the addition of a family room represents a basic necessity to which the owners have a reasonable right. Your deliberation should consider the minor nature and magnitude of the requested variance and the potential impact to the surrounding property owners. A review of the plans indicates that the dimensions of the addition are appropriate to accommodate furniture and circulation. 3. The lots in this subdivision are smaller than the minimum permitted in the zoning ordinance. The average lot in this area is 10,000 square feet. While the lots generally have the required 100 feet of lot width, they are shallower than the typical lot. Since the addition is located in the rear yard, the primary concern is for the potential impact on the adjacent lots to the side and rear of the subject property. The proposed addition would be visible from the surrounding lots. There is no landscaping or other screening along the rear lot lines and the homes are relatively close together as a result of the shallow lot dimensions. However, the proposed addition has been designed to blend in well with the architecture of the existing home. Danis Public Works Di r SUBJECT: Ivy Falls Creek Storm Water Improvements - Phase I Feasibility Report INTRODUCTION• At their September 3, 1991 meeting Council received a request from Mr. Jack Brassard to install bank protection along a tributary of Ivy Creek adjacent to his home. Mr. Brassard agreed to fund all of the bank protection costs. Council directed me to proceed with a feasibility report and to begin the plans and specifications in order to try and construct the improvements sometime late this fall or early winter. DISCUSSION: The attached drawing shows the project areas with the proposed improvements. Site 1 Site one is the improvements to the outlet adjacent to Mr. Bras- sard's where serious erosion has occurred. It would be best to re- route the creek channel in this area thereby moving the creek away from Mr. Brassard's property and decreasing the length of channel work necessary. This routing will also allow us to greatly reduce the height of the bank protection required and reduce the construction costs. In addition to completing bank protection in this area, there is a culvert outlet that needs corrective work and a check dam (gabin drop structure) that needs to be constructed. Mr. Brassard has ap- proved the proposed rerouting (straightening) the channel. Site 2 Site 2 is a culvert under Sylvandale that carries the main chan- nel of Ivy Creek. The outlet for the culvert is in extremely urgent need of repair. The creek bed has dropped 8-10 feet behind the cul- vert and two sections have fallen off. The remaining costs would be held by the City until such time as a future creek project is undertaken improving the remainder of the creek. Staff is attempting to prepare and present those options to Council later this winter for possible construction next year. Current Assessments (Mr. Brassard) $25,000 Future Assessments $57,000 Total $82,000 I have sent letters to the contiguous property owners in an attempt to inform them of the proposed work. They have asked that I meet with them to update them on the entire creek project. I have scehduled a meeting with them on Wednesday evening, October 2nd, here at City Hall. RECOMMENDATION: Provided the City is willing to "bankroll" a portion of these costs for inclusion in a future project, this project is technically and financially feasible. I recommend that Council accept the feasi- bility report and formally order staff to begin preparation of plans and specifications. Danielson, Public Works Director SUBJECT: Grading of Kensington DISCUSSION• Centex Homes has submitted a grading plan for Phase I of their Kensington development that staff has reviewed and approved. This grading plan is for their single family homes and townhome areas. The plan does not include grading for the 40 acre "Owens" area, that area is to be developed later by Dick Putnam. Centex has installed the silt fences and they intend to begin grading once they have a signed developer's agreement which they say will be either today or tomorrow. In conjunction with their grading, they have said that they would be willing to do the mass grading for the City park areas at a cost of $15,000. Staff has prepared a grading plan for the park area (see attached) and we have calculated the cut area to be approximately 27,000 cubic yards. Centex's contractor is Enebek, Inc. and their bid to Centex is $0.90/cubic yard of cut. An estimate of the value of the work that they are proposing to do is as follows: 27,000 cubic yards x $0.90 = $24,300 The City's bid for Mendakota and Sibley Parks were by lump sum so it is not possible to compare this bid with those, however, any bid less than $1/cubic yard is usually considered good. The proposed $15,000 calculates to be approximately $0.55/cubic yard. I feel that Centex's offer is a fair one and that the City should accept their offer. Note: Their bid does not include finish grading, only mass grading. The topsoil would be stockpiled on Centex's property immediately adjacent to the parks and a City contractor would have to be hired to respread the topsoil and fine grade the park next year. W RECOMMENDATION: By State Law, the City must obtain sealed competitive bids for all expenditures over $15,000. Based on our experience with prior grading contractors, and the unique nature of this contract and its iterrelationship to the surrounding property, I recommend that the City Council authorize City staff to work with Centex in order to come to an agreement allowing them to mass grade the Kensington Park areas according to the attached map at a cost less than $15,000. ACTION REQUIRED: If Council desires to implement the recommendation, they should pass a motion authorizing staff to work with Centex and prepare a purchase order for them to grade Kensington Park according to the attached map for a price not to exceed $15,000 dollars.
