Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Mertensotto, Councilmembers Blesener, Cummins, and Smith. Councilmember Koch had notified the Council that she would be absent. AGENDA ADOPTION Councilmember Cummins moved adoption of the revised agenda for the meeting, further revised to delete item 5j, Fire Department fee schedule. Councilmember Smith seconded the motion. Ayes: 4 Nays: 0 APPROVAL OF MINUTES Councilmember Cummins moved approval of the minutes of the May 21, 1991 regular meeting with correction. Councilmember Smith seconded the motion. Ayes: 4 Nays: 0 CONSENT CALENDAR Councilmember Blesener moved approval of the consent calendar for the meeting along with authorization for execution of any necessary documents contained therein. a. Acknowledgment of the minutes of the May •28th Planning Commission meeting. b. Acknowledgment of the code enforcement monthly report for May. c. Approval of the installation of lightning protection at the three Mendakota Park structures, authorizing issuance of a purchase order to Thompson Lighting Protection for $1,090 and change orders, not to exceed $500, to the electrical and painting subcontractors for installation. - and painting of conduit. Councilmember Smith seconded the motion. Ayes: 4 Nays: 0 PUBLIC COMMENTS Mr. Joe Maegher was present to complain about increased air noise over his neighborhood. Mayor Mertensotto informed him of the air corridor resolution adopted on May 21st and the MAC response. Mr. James Losleben stated that there is no spirit of cooperation between the FAA and the city. If there were cooperation, planes would " be kept in the corridor on clear days. Mr. Virgil McQuay stated that the people surrounding O'Hare airport won a major lawsuit, and suggested that someone get a copy of the suit. Page No. 3017 June 4, 1991 d. Councilmember Cummins moved to direct staff to prepare a resolution, with a cover letter from Mayor Mertensotto, to be sent to the Governor, State Executive Council, MAC, all state legislative committees reviewing the Northwest financing package and all relevant legislators, Minnesota's federal congressmen, particularly Congressman Oberstar, and the Commissioner of Transportation, urging that the financing negotiations be used as an opportunity to discuss the worsening noise problem worse; to contact other affected communities to ask that they request that bonding for Northwest be tied to noise relief; and to direct a letter to FAA Tower Chief Griffith to get a commitment to stay within the corridor on non -simultaneous take offs, which does not warrant FAA approval and should be implemented immediately. Councilmember Smith seconded the motion. Ayes: 4 Nays: 0 Administrator Lawell informed Council that staff has submitted press releases to the media regarding the MAC presentation scheduled at City Hall on June 18th. PUBLIC COMMENTS Public Works Director Danielson reviewed his report relative to assertions made by Mr. Virgil McQuay at the last Council meeting with respect to drainage and property damage. Mr. Danielson stated that the McQuay backyard drainage was affected initially when Mn/DOT constructed I -35E. He stated that Mn/DOT has agreed to survey Mr. McQuay's south property line at his_ request. When the surveying is completed, it will answer the question of whether the city pedway was constructed on right-of-way or on the McQuay property. Mayor Mertensotto asked Mr. McQuay what " existed prior to I -35E. He stated that he asked that Mn/DOT post the right-of- way so that they know whether the trail is on his land or the city's. He also stated that he filed a petition with the state three weeks ago to have NSP powerline removed from his property. Mayor Mertensotto informed Mr. Mcquay that the issues are engineering matters which cannot be resolved this evening. Mr. McQuay stated that city crews pulled some of the wood out of the drainage way. He also made allegations about the Police Chief. Mayor Mertensotto responded that the accusations were serious and that he will look into a response but that Council would not further discuss the issue this evening. HEARING: CLUB LIQUOR Mayor Mertensotto opened the meeting for the LICENSE RENEWALS purpose of a public hearing on applications for Club Liquor license renewals from Mendakota Country Club and Somerset Country Club. He asked for questions and comments from the audience. There being no questions or comments, Councilmember Cummins moved that the hearing be closed. Councilmember Smith seconded the motion. Ayes: 4 Nays: 0 Councilmember Cummins moved to approve the renewal of Club Liquor licenses for Mendakota Country Club and Somerset Country Club. Councilmember Smith seconded the motion. PETER'S Mayor Mertensotto opened the meeting for the CHURCH UTILITIES purpose of a feasibility hearing on the proposed extension of sanitary sewer and watermain to serve St. Peter's Church and adjacent areas. Public Works Director Danielson reviewed the feasibility report for Council and the audience. He explained that staff looked at three options for sewer, one of which would bring sanitary sewer north, into the Mendota sewer line. He stated that the City of Mendota has indicated that it will cooperate and recommended this option. He then reviewed the proposed watermain location, and informed the audience that the city has offered Mendota a trade-off to bring water to Mendota in exchange for the sanitary sewer connection. He stated that he will be meeting with the Mendota City,Council in the next week to discuss details of a service contract. Mr. James Losleben, Director of Maintenance and Development for St. Peter's Church., and the Mr. Barney Hansen, the parish's administrator were present for the discussion. Mr. Losleben asked whether sanitary sewer oversizing is going to be charged against the church or if the church will only be paying for its need. Mr. Danielson responded that there is no oversizing - an 8" pipe is proposed and will handle the flows from the Garron and Acacia properties. It was pointed out that $37,000 assessment against unplatted Acacia Park Cemetery property and $150,000 against the Resurrection property is proposed to be supported by TIF but that the assessments will become hook-up charges at such time as the use changes or platting occurs. Mr. Losleben stated that St. Peter's Church representatives came to the City with a utility petition after having its own study completed by Toltz, King, Duvall, Anderson, and that the costs in the City study are about the same as the TKDA study. He further stated that the church needs to coordinate with Mn/DOT's Mendota Interchange improvements because the church property sits on rock and Mn/DOT will be working with rock in the area during its project. He stated that St. Peter's is ready to proceed with the project based on the feasibility study. Mr. Danielson informed Council that the City must enter into a joint powers agreement with Mn/DOT so that utilities are installed as part of the highway construction project. Responding to a question from Mayor Mertensotto, Treasurer Shaughnessy stated that the project will probably be assessed in 1993, depending on the Mn/DOT construction time- table. Mayor Mertensotto asked for questions and comments from the audience. Mr. Vorpahl stated that MAC proposes to install noise monitoring towers in Friendly Hills and the Furlong area to monitor noise, and also to provide flight numbers and aircraft types to be sure that planes are flying in the flight corridor, and a multitude of other data. He further stated that MAC would like to discuss placing a third monitor in the City: the Planning Commission had suggested putting a monitor north of T.H. 110. He asked that City staff work with MAC to find an appropriate location. Mayor Mertensotto asked for questions and comments from the audience. PETER'S CHURCH AND ADJACENT AREAS (IMPROVEMENT NO. 84-2A)." Councilmember Smith seconded the motion. Ayes: 4 Nays: 0 HEARING - HNTB (MAC) Mayor Mertensotto opened the meeting for the NOISE MONITORS purpose of a public hearing on an application from Howard Needles Tammen & Bergendoff for the Metropolitan Airports Commission for conditional use permit to locate two remote noise monitoring towers in Mendota Heights. Mr. Robert Vorpahl, Mr. John Foja and Mr. Eric Johnson, from the MAC noise department were present for the discussion. He pointed out that the complaints would come to the police department and an officer would need to pick up a cat, write reports, and take the animal to a shelter, which would be a totally different cost measure. 'Mr. Johnson stated that, in a sense, he represents the Dodge Nature Center, and that birds in the area are disappearing because of cats. He stated that the cat problem is increasing and must be resolved sooner or later. He informed Council that he has been tracking birds in the area for 21 years and works with the bluebird program for the nature center. He further stated that his neighbor, John Mullins, has a problem with cats also, including cats fighting very early in the morning. Chair John Huber called the meeting to order at 7:05 o'clock p.m. The following members were present: Huber, Damberg, Lundeen, Hunter and Kleinglass. Katz and Spicer arrived late. Staff members present were Parks Project Manager Guy Kullander and Administrative Assistant Kevin Batchelder. APPROVAL OF MINUTES Chair John Huber approved the minutes from the May meeting. MAYFIELD HEIGHTS TRAIL LINK Andrea Larson, of Mayfield Heights Road, stated that she had received the report from staff on the trail request for Mayfield Heights neighborhood and that she was present to advocate for the trail for her neighborhood. Chair John Huber stated that the Parks and Recreation Commission had been discussing this issue since August in a number of meetings and that the trail options reviewed had not been successful. Huber stated that option #1 had not been approved by the Commission because of the opposition of the property owners who would have to provide an easement to the City. Huber stated that the letter from Overlook Condominium Association clearly stated that trail option #2 through their property would not work. Huber stated that the Parks Commission staff had indicated in their memo that other options to the east were not feasible due to severe slopes, significant woods and significant impacts on properties and their privacy. Huber asked for opinions from other Commissioners. Commissioner Kleinglass inquired where the trail went if Douglas Road or James Road could be linked to Mayfield Heights with a trail. Parks Project Manager Kullander responded that two neighborhood parks - Marie and Victoria Highlands - were in the immediate vicinity and that from Douglas Road a person could access trails on Lexington or Victoria that connect to the City trail system. Huber stated that the Council and Commission had discussed communication strategies, expectations and goals, and role clarity. Huber stated that at the 1988 Teambuilding session a "Role of the Parks Commission" document had been drafted and that the current City Council desired to have each Commission review their document for discussion and to report back to the City Council any changes, additions or deletions desired. Huber stated, that at the recent Teambuilding session, role clarity had been discussed as an important component of good communication and teamwork. He stated that Council felt it was important that each Commission review their role for redrafting and approval by City Council. Huber read the "Role of the Parks Commission" as follows: 1. To advocate for facilities, development, planning and expansion of parks. 2. To develop the city's recreation program. 3. . To provide leadership, study and recommendations to the Council. 4. To be responsive to citizen park and recreation needs. 5. To set policy for park maintenance. 6. To monitor park facilities. 7. To recommend disbursement of park funds. 8. To implement park programs determined by Council. 9. To promote the use of park facilities. Commissioner Katz stated that item #1 had been accomplished with the Parks Referendum. Commissioner Damberg stated that item #2 was an important priority for the Commission because the new facilities would be creating new recreational demands. Damberg stated that setting policies will take up a lot of the Commission's time in the next year as there are a host of policy issues to consider for the new facilities ranging from reservation and fee issues to regulations on trails. Huber inquired about current park maintenance service levels. Kullander responded that it has been a tough year for the parks crews to keep up with the cutting of the grass, that they have just recently caught up with the work after having to mow about once every three days because of the rain. Kullander stated that other maintenance items suffer when the grass work is so concentrated. Kullander stated the new mower is definitely helping the parks crews, but that they need more manpower and that there will be more fields next year. Chair Huber stated that Mend -Eagan fulfills most of the City's recreation needs. He inquired what the Commission felt about advocating for more City funded recreation programs. Commissioner Katz stated that this is an area for leadership from the Parks Commission. Katz stated that with more demand for recreation programs there will be a need for coordination, scheduling and monitoring programs that the City will have to be responsible for. The Commission discussed community cooperation with neighboring community's recreation departments, Independent School District and Mend - Eagan. Chair Huber stated that the City should provide for recreational programs that are in Mendota Heights for our residents, for instance softball and other programs that use our facilities. Huber stated that the community cooperation type items would be for items outside Mendota Heights such as ski trips that the City could co-sponsor with West St. Paul. Commissioner Katz stated the City should participate in shared programs if it benefits our residents. Commissioner Damberg stated that when our fields and facilities come on line the City will have to provide recreation programming. Damberg stated that sharing programs with other communities was fine and that the City should begin discussions with other organizations. Kullander stated that staff was aware of approximately twenty softball teams outside of our program that had expressed an interest. Kullander stated that the newsletter would allow the City to inquire about recreation needs. Hunter stated that most cities have conducted surveys that show the same results and that Mendota Heights is not that different from other communities. He suggested that the Commission review programs that are utilized elsewhere and follow through with them. Commissioner Lundeen and Damberg felt the community should be able to participate in a survey. Commissioner Kleinglass moved that the Commission direct staff to prepare a newsletter article for surveying recreation needs in Mendota Heights for review by the Commission for approval by City Council. Batchelder stated that he had included the current park ordinances in tonight's packet to let the Commission see what is on the books as far as enforceable regulations. Batchelder stated that what may be more immediate in need is to consider park policies that govern maintenance, use, administration and monitoring of the growing park system. Batchelder stated that in the- coming months he planned to have the Parks Commission reviewing our operating policies for revision or affirmation, list the new policies needed, draft them for approval and after this is complete address the need for an updated Park Ordinance. He stated when this process is complete we should have a clear set of policies for the parks in one complete document. Batchelder stated that later in tonight's agenda a policy item was being considered, the leasing policy for the Mendakota Concession Area. He stated there is a need for many such new policies, or to consider the appropriateness of old policies. The Commission reviewed the Park Ordinances. Chair Huber stated that he felt the Ordinance banning skateboards in all public and private properties was a little too strict. Huber pointed out that the Park Ordinance contains a clause that prohibits horses from using a park or trail. Kullander stated that the staff receives numerous complaints about horse droppings on the trails. Commissioner Katz felt this should be enforced but not with more signs. Commissioner Katz moved that the City should begin to enforce the prohibition of horses on trails and in the parks. Huber explained that the City Council had expressed an interest in allowing civic groups the use of the concessions area instead of leasing to a private concern. Chair John Huber stated that the operation of the concessions area is going to require coordination and direction by the City and that there are bound to be some problems from time to time. He stated the Parks Commission will be fielding comments, complaints and questions regarding the concessions area. Huber stated the operation of the concessions would be much easier to administer if there is a single entity to deal with. The Commission agreed that one person or one group should run the concessions. Commissioner Kleinglass stated that any- revenue possibilities should be captured by the City and directed into the general fund Recreational Contingency line item. Kleinglass stated that this was a City facility and we are compelled to maximize the use and the revenue potential. AYES: 6 NAYS: 0 NEIGHBORHOOD PARK IMPROVEMENTS Parks Project Manager Kullander reviewed improvements to Wentworth, Valley, Marie and Valley View Heights Parks that were part of the 1989 referendum that had not been completed yet. Kullander stated that these included a backstop hood at Wentworth Park, top dressing at the fields at Marie and Valley parks, and benches, trash receptacles and amenities at Valley View Heights park. Kullander stated these projects are \ estimated at $4,250. VERBAL UPDATES The Commission approved 6-0 that the City seek bids for approval by City Council on these neighborhood park improvement items. Chair Huber stated that Councilmember Jill Smith had contacted him with concerns about the basketball court in Hagstrom King Park. Kullander stated that staff had visited the site and that a bid had been received from a contractor to fix the soil levels and grade around the basketball court and the trail. Also, Kullander stated, the landscaping•would be addressed at the intersection of the trail and Watersedge Road. Commissioner Kleinglass moved to request that staff draft a Request for Proposal, with our terms and conditions, for leasing the Mendakota concessions so the Park Commission can review it and recommend for approval to City Council followed by advertising to civic groups and private organizations. AYES: 6 NAYS: 0 NEIGHBORHOOD PARK IMPROVEMENTS Parks Project Manager Kullander reviewed improvements to Wentworth, Valley, Marie and Valley View Heights Parks that were part of the 1989 referendum that had not been completed yet. Kullander stated that these included a backstop hood at Wentworth Park, top dressing at the fields at Marie and Valley parks, and benches, trash receptacles and amenities at Valley View Heights park. Kullander stated these projects are \ estimated at $4,250. VERBAL UPDATES The Commission approved 6-0 that the City seek bids for approval by City Council on these neighborhood park improvement items. Chair Huber stated that Councilmember Jill Smith had contacted him with concerns about the basketball court in Hagstrom King Park. Kullander stated that staff had visited the site and that a bid had been received from a contractor to fix the soil levels and grade around the basketball court and the trail. The consolidation involves removing the truck trailer from its current location at the Cub Foods parking lot on South Robert St. in order to consolidate the recycling drop off at the Goodwill Store located next to Menards, also on South Robert St. (See attached letter from Goodwill.) The consolidation was not unexpected and was discussed by the four cities and Goodwill during contract negotiations for 1991. The Goodwill Store near Menards has been collecting recyclables for some time and has a drop off area for automobile traffic that will be open for longer hours, has more storage space and more staff support. It is expected to increase the volume of recyclables that we can count towards our abatement goals and solve some operational problems with the trailer. Goodwill has promised to conduct a public information campaign to inform the residents of the four cities about the change in the drop off location. The four cities will also do some advertising to help inform our residents. In addition, Dakota County is currently considering changes to the funding system for Recycling Activities. If the County Board passes on the new system, as expected, beginning in 1992 the funding of the Goodwill drop off center will become a County responsibility. The budget for the fiscal year 1991 was submitted to the County on October 1, 1990 and changes in circumstances have necessitated a request for additional money. We are requesting an additional $13,000 for Solid Waste Abatement in 1991. Our original, approved request from the County was for $48,527 plus $5,850 in 1990 carryover for a total of $54,377. This amount of funding was well under the amount available which was $68,826. (See attached Budget and Maximum Reimbursement Schedule.) The revised request breaks down as follows: Original Request Revised Request Administration 8,800 8,800 Capital Costs 5,500 9,000 Residential Operations 46,100 55,600 Total 60,400 73,400 Capital Costs The change in capital costs is to provide money for an additional 500 bins that will be used as a replacement inventory. 1991 is the last year in which the allocated capital funding will be available for the individual cities. CITY OF MENDOTA HEIGHTS Dakota County, Minnesota RESOLUTION NO. 91- A RESOLUTION REQUESTING A BUDGET REVISION TO THE 1991 SOLID WASTE ABATEMENT JOINT POWERS AGREEMENT WHEREAS, Dakota County has adopted a solid waste master plan which sets goals and targets for accomplishment of solid waste recycling goals in each community in the County; and WHEREAS, Dakota County is also making available to local communities grant funding for implementation of said recycling programs; and WHEREAS, the City of Mendota Heights has participated faithfully in the Community Landfill Abatement Program in 1989 and 1990 and has entered a Joint Powers Agreement for Solid Waste Abatement for 1991 with Dakota County. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Mendota Heights that a budget revision requesting an additional $13,000 within our Finalized Maximum Reimbursement Schedule for 1991 be approved; and BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that the City Council does hereby transmit the attached revised budget to the 1991 funding application, seeking funds in the amount of $67,377. Shaughnessy, Jr., June 12, 1991 AdminisC-rat Treasurer SUBJECT: Request to Purchase Property - Mr. Art Mulvihill Mr. Art Mulvihill has requested the City to consider the purchase of his property located east of Acacia Cemetery. As Council may recall, the property is one of those the City appraised in 1988, and is adjacent to the Rockhold property which we purchased in 1989. At the time bf our appraisal, it was believed that Mr. Mulvihill's parcel was part of a larger vacant parcel. However, the larger parcel is owned by the seven members of the Mulvihill family while the smaller parcel, with a small structure, is owned individually (see attached map). The parcel contains about 15,000 square feet and a small 520 square foot home. Our appraiser felt that there was no value to the structure, while the County taxes the structure at a value of $21,900. - Mr. Mulvihill has had an independent appraisal which shows the structure at a value of $11,800. The home is currently rented for $265 per month plus utilities. It would appear that there is at least some economic value to the home. To purchase the home, we would have to work out some arrangement with the owner/occupant to address the issue of relocation of the renter. Since the transaction is voluntary - Mr. Mulvihill has requested that the City purchase his property - the City is not bound to provide relocation benefits to either the owner or occupant. At the time bf our appraisal, it was believed that Mr. Mulvihill's parcel was part of a larger vacant parcel. However, the larger parcel is owned by the seven members of the Mulvihill family while the smaller parcel, with a small structure, is owned individually (see attached map). The parcel contains about 15,000 square feet and a small 520 square foot home. Our appraiser felt that there was no value to the structure, while the County taxes the structure at a value of $21,900. - Mr. Mulvihill has had an independent appraisal which shows the structure at a value of $11,800. The home is currently rented for $265 per month plus utilities. It would appear that there is at least some economic value to the home. To purchase the home, we would have to work out some arrangement with the owner/occupant to address the issue of relocation of the renter. Since the transaction is voluntary - Mr. Mulvihill has requested that the City purchase his property - the City is not bound to provide relocation benefits to either the owner or occupant. An important aspect of the CIP involves future additional runways which may someday be constructed at Minneapolis/St. Paul International Airport (MSP), and the MAC has been invited to present to the City Council and concerned residents the details of the various expansion concepts under discussion. �3 _K '•1 1 The MSP Long Range CIP is an important document as it charts the course for the future of the airport. The MAC is required to submit the CTP document to the Minnesota Legislature by the end of 1991. In order to meet that goal, the issues of runway and terminal expansion are currently under review, and the MAC intends to designate a preliminary preferred runway/terminal expansion concept as early as August 1991. Cities surrounding MSP requested and were granted an opportunity to be involved in the analysis of various expansion concepts under discussion through a committee known as the MSP Airport Interactive Planning Group. The purpose of the committee is to extensively analyze the various impacts associated with each expansion concept, and present those findings in a report which is tentatively due for completion on July 24th. As part of preparing that report, it is important that our residents be provided .an opportunity to express their input on this subject. Comments and concerns expressed at the scheduled public meeting will be summarized and included in a chapter of the final report.
