Ayes: 4 Nays: 0 Absent: 1 (Duggan) PULLED CONSENT AGENDA ITEM F) APPROVE CHANGE ORDER FOR VICTORIA ROAD SOUTH IMPROVEMENTS City Administrator Mark McNeill explained that Councilmember Duggan had a comment regarding the estimate for the trail modifications on Victoria Road South. Councilmember Duggan suggested the cost of the fence be shared with the property owner. Assistant City Engineer Ryan Ruzek stated that staff could look at less expensive options for the fence. An ornamental fence was installed along the other retaining wall in the corner, and the proposed fence is similar to that. Possible alternatives included a black vinyl coated chain-link fence, which would be a lesser cost than the ornamental fence. Councilmember Petschel suggested the city install a less expensive fence, and give the homeowner the option to pay an additional amount for the ornamental fence. Councilmember Petschel moved to approve the project with a fence cost not to exceed $30 per lineal foot. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) page 5 K) APPROVAL OF THE PAR 3 MAINTENANCE CONTRACT WITH JK MANAGEMENT Councilmember Petschel requested more information on JK Management and the contract. Recreation Program Coordinator Sloan Wallgren explained that Jason Krause owns JK Management. He is a golf course superintendent for Tiller Corporation who own three golf courses in the metropolitan area; one of them being Troy Burne Golf Course, Hudson, WI. He said that JK Management is able to accommodate the Par 3's schedule. Councilmember Petschel moved to authorize staff to enter into an agreement with JK Management for the 2016 golf season. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) PUBLIC COMMENTS There were no public comments. PRESENTATIONS A) PROPOSED METROPOLITAN COUNCIL RESTRUCTURING Dakota County Commissioner Tom Egan made a presentation regarding a proposed restructuring of the Metropolitan Council. The Metropolitan Council is a Twin Cities area regional government and area planning agency. Among other things, it oversees operations for waste water and transit. Mr. Egan noted that there are four counties seeking a change in the way that the Metropolitan Council is structured. Three commissioners from Dakota County serve on the four -county consortium. A major concern is the way that the 17 members of the Metropolitan Council's policy making board are appointed by the governor. An alternative is to have a majority of the representatives be elected officials. Mayor Krebsbach noted that the issue being proposed is to restructure the Metropolitan Council to a combination of appointed and elected members. Being an appointed commissioner by Governor Ventura and again by Governor Pawlenty, Commissioner Egan believed that he brought a different perspective to this issue. Mr. Egan reviewed the six principles for Metropolitan Council Reform. Principles for Metropolitan Council Reform: I. A majority of the members of the Metropolitan Council shall be elected officials, appointed from cities and counties within the region page 6 II. Metropolitan cities shall directly control the appointment process for city representatives to the Metropolitan Council III. Metropolitan counties shall directly appoint their own representatives to the Metropolitan Council IV. The terms of office for any Metropolitan Council members appointed by the Governor shall be staggered and not coterminous with the Governor V. Membership on the Metropolitan Council shall include representation from every metropolitan county government VI. The Metropolitan Council shall represent the entire region, therefore voting shall be structured based on population and incorporate a system of checks and balances Councilmembers asked how many positions on the Metropolitan Council the governor would appoint if these principles were taken up, how many seats are on the Metropolitan Council at this time, and if it was true that there is no other Metropolitan Council in the United States that is structured as this one is. The Council directed staff to bring a resolution forward to the April 19th City Council meeting supporting the change. PUBLIC HEARING A) RESOLUTION 2016-26, APPROVING MUNICIPAL CONSENT FOR THE MNDOT HIGHWAY 110 REHABILITATION PROJECT LAYOUT City Engineer John Mazzitello explained that the proposal being considered was for the Highway 110 rehabilitation project, which is proposed for construction in 2017. Along with the public hearing was a request for municipal consent, which is required along state highway projects where access into and out of the corridor was to be changed. Accesses that are within the right-of-way — such as changes to a median or extensions to turns lanes — are not part of municipal consent. Engineer Mazzitello noted that he received two comments from business owners along Dakota Drive who could not be in attendance. One of the business owners requested that the public hearing be continued to a future meeting date so he could have time to submit his comments. Ms. Molly Kline, representative of MnDOT, shared information on the project, which will run from Highway 55/Highway 13 to the east junction of I-494. The cost of the project is estimated to be $7.7 million. There will be no cost to the City of Mendota Heights. The construction project is planned to be completed the summer of 2017. The project includes pavement updates, turn -lane extensions, various access modifications, signing updates, various drainage improvements, and ADA updates at some intersections. Dakota County will construct their trail project in conjunction with this project. Construction impacts will include directional closures lasting up to six weeks in each direction, with the detours utilizing I -35E and I-494. The access at Dakota Drive is planning to be closed due to the extension of the turn lane for south I -35E. page 7 Councilmembers asked questions regarding the installation of a crosswalk on all four sides of the Highway 110/Dodd Road intersection. They felt this was unnecessary since a pedestrian underpass is being proposed for that area. Councilmember Norton moved to open the public hearing. Councilmember Petschel seconded the motion Ayes: 4 Nays: 0 Absent: 1 (Duggan) The Lessee of 1044 Dakota Drive commented that he is planning on opening a business at this location and the closing of the access at Dakota Drive would make it hard for his customers to access the business. Discussions occurred on the pros and cons of making the access change, and the impacts that will have at the intersection of Highway 110 and Lexington. City Engineer John Mazzitello shared the comments he received prior to this meeting: The owner of One Ten Cycles is concerned about the access closure because his customers use that as an entrance to get into his facility, as well as an exit. His preference is that the access remains open for his customers. Mr. Mazzitello stated that he had been in telephone contact with Mr. Curley, who is part owner of the building at 1044 Dakota Drive. He said that Mr. Curley would like for the access to remain open because of potential future use at that site. Mr. Curley further requested the Council table any action on this until the Curley family has a chance to submit written comments to the Council. Councilmember Povolny moved to table Resolution 2016-26 Approving Municipal Consent for the Highway 110 Rehabilitation Project Layout to the April 19, 2016 Council meeting and to continue the public hearing at that meeting. Councilmember Petschel seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) NEW AND UNFINISHED BUSINESS A) RESOLUTION 2016-28, CRITICAL AREA PERMIT, CONDITIONAL USE PERMIT, VARIANCES AT 1140 SIBLEY MEMORIAL HIGHWAY — PLANNING CASE 2016-05 Planner Nolan Wall explained that the applicants were requesting a Critical Area Permit, a Conditional Use Permit, and variances to construct an addition to an existing single family dwelling The subject property is located within the Mississippi River Corridor Critical Area and requires site plan approval prior to building permit issuance. page 8 Planner Wall then shared the information, images, applicable city code requirements, and how this application meets those requirements. Councilmember Petschel raised concerns regarding drainage. City Engineer John Mazzitello replied that staff looked at the existing conditions and found that most of the area being built over is already impervious. Staff is anticipating that the run-off from the proposed addition will cause little to no increase in run-off. The applicants were present and indicated that there will be landscaping associated with the project after construction. Councilmember Petschel moved to approve Resolution 2016-28 Approving a Critical Area Permit, a Conditional Use Permit, and Variances at 1140 Sibley Memorial Highway. Councilmember Norton seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) B) RESOLUTION 2016-29, CONDITIONAL USE PERMIT, CRITICAL AREA PERMIT FOR XCEL ENERGY SIBLEY PROPANE PLANT — PLANNING CASE 2016-06 Planner Nolan Wall explained that the applicant was seeking a Conditional Use Permit to bring the existing use into compliance with the applicable zoning district and a Critical Area Permit to make improvements to an existing structure on the subject property within the Mississippi River Corridor Critical Area. The applicant in this case is Xcel Energy, the operators of the site in question. Planner Wall shared images of the site, applicable city code requirements and how this application meets those requirements. As part of a larger rezoning process after completion of the Comprehensive Plan Update, staff recommends that the City consider rezoning a portion of this property so that it is entirely within the B1A Zoning District so there would not be multiple zoning districts contained within one property. Councilmember Petschel moved to adopt Resolution 2016-29 Approving a Conditional Use Permit and a Critical Area Permit for the Sibley Propane Plant. Councilmember Povolny seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) C) MINNESOTA VIKINGS HEADQUARTERS AND MIXED-USE DEVELOPMENT — DRAFT ALTERNATIVE URBAN AREA -WIDE REVIEW (AUAR) Planner Nolan Wall noted that this was a follow-up to an earlier discussion this year regarding the Minnesota Vikings Headquarters and Mixed -Use Development. They are moving forward in the development process and the Alternative Urban Area -wide Review (AUAR). page 9 Planner Wall reviewed the process and timeline. On April 13, the draft AUAR comments are due to the City of Eagan. In May, the final AUAR would be completed for consideration. Planner Wall provided a brief background on what an AUAR is and the process. He shared the development scenarios that were analyzed within the draft AUAR. The master plan included in the information packet was comprised of an office and hotel, multi -family residential, headquarters and training facility, hotel/conference center and office, multi -family residential, retail and office. Planner Wall reviewed the comments provided from the Council to the City of Eagan and their initial responses back regarding noise, traffic, and public safety. Councilmembers requested that the City receive a copy of the signage plan for comment. Councilmembers expressed their appreciation to staff and the City of Eagan for their diligence in providing the comments, responses, and remediation plans. D) APPROVAL TO BEGIN RECRUITMENT PROCESS FOR INFORMATION TECHNOLOGY INTERN Assistant to the City Administrator Tamara Schutta explained that included in the 2016 budget is additional IT support for $15,000. It is proposed to add an IT intern to assist the IT Manager with projects and help desk services. The primary objective would be to assist the IT Manager in maintaining the city's IT infrastructure. Ms. Schutta described other possible tasks and criteria for the position. Councilmember Petschel moved to approve the position description and authorize staff to begin the recruitment process for an Information Technology Intern position. Councilmember Norton seconded the motion. Ayes: 4 Nays: 0 Absent: 1 (Duggan) E) REPORT ON CLOSED SESSION CITY ADMINISTRATOR PERFORMANCE EVALUATION Assistant to the City Administrator Tamara Schutta explained that the City Council held a closed session to conduct a performance evaluation of City Administrator Mark McNeill. Councilmember Norton reported on the results of the closed session by noting that Mark McNeill is doing a great job in all categories and by all accounts. He is meeting or exceeding expectations. It was recommended that Mark McNeill's annual salary be increased to $122,500 retroactive to February 23, 2016, and that the City would pay for meal expenses related to his participation in the Rotary Club. Councilmember Povolny moved to approve the annual salary change for City Administrator Mark McNeill and the Rotary Club expenses as recommended. Councilmember Petschel seconded the motion. The base premium for this year is $234,890. This represents a 15.3% increase over last year’s premium of $203,685. This increase is based on the high claim history we have been experiencing. In previous years the city has purchased an additional policy for city volunteers. This provides limited “no-fault” benefits for volunteers injured while working for the city (the firefighters and police reserves are covered under the city’s worker’s comp and not this volunteer plan). Volunteers receive limited death, disability and impairment benefits. This policy is now automatically included with the workers’ compensation policy renewal. This policy would be covering people volunteering at events such as spring clean up, parks celebration, fishing derby, etc. BUDGET IMPACT There is $186,720 in the 2016 budget for workers compensation costs. The amount budgeted is short of the base premium amount by approximately $38,000. There is an insurance reserve amount ($192,262) designated in fund balance. I recommend that we reduce this amount by $38,000 to cover the amount of premium not budgeted. The 2017 budget will need to have the workers compensation insurance amounts increased to cover the increased premium. RECOMMENDATION Staff recommends that the council pass a motion accepting the regular premium option for the workers compensation renewal with a base premium of $234,890 effective May1, 2016 – May 1, 2017. Temporary on -sale liquor licenses shall be granted only to clubs or charitable, religious or nonprofit organizations. The licenses are subject to final approval by the Director of Alcohol and Gambling Enforcement. Beth Jacob Congregation, located at 1179 Victoria Curve, is planning to hold an event on Sunday, May 22, 2016 at the Congregation during the hours of 10:00 a.m. to 1:00 p.m. They have requested a temporary on -sale liquor license to allow for the sale of alcohol. Security will be present during the event. A completed application has been received, along with the license fee and a certificate of insurance for liquor liability. It should be noted that temporary on -sale liquor licenses have been issued in the past to charitable, nonprofit and religious organizations within the city with no incidents or negative reports. Each individual who provides massage must obtain an individual license. Mariah Bowen, has submitted the required application, license fee and investigation fee for a massage therapist license. She would be working at Green Lotus Yoga and Healing Center. The Mendota Heights Police Department has completed the background investigation and approves of the issuance of the license. Recommendation Staff recommends the approval of a Massage Therapist license for Mariah Bowen to be working at Green Lotus Yoga and Healing Center for the period of April 20, 2016 through June 30, 2016. Mazzitello, PE, PMP, MBA Public Works Director/City Engineer SUBJECT: Ordinance No. 495 Amending City Code Title 10, Chapters 2 & 5 Relating the City Water Utility COMMENT: Introduction The adoption of an Ordinance that establishes the Board of Water Commissioners for the City of Saint Paul's oversight, as well as adoption of the City of Saint Paul's Water Utility Code is required as part of the transfer of the Mendota Heights water distribution system to the City of Saint Paul. Background In October of 2015, the City Council approved a new Omnibus Agreement with the Board of Water Commissioners for the City of Saint Paul that transferred ownership and responsibility for the water distribution system for the City of Mendota Heights to the Board. As required by the Omnibus Agreement, the City has a number of follow-on steps that need to take place to make the transfer complete. Discussion The attached Ordinance No. 495 would adopt language into our City Code that is necessary for The Board of Water Commissioners for the City of Saint Paul (dba Saint Paul Regional Water Service (SPRWS)) to own and operate the water distribution system in the City of Mendota Heights in accordance with the Omnibus Agreement approved in October of 2015. The Ordinance amendments are summarized below: page 18 Section 1: Adds a new paragraph to Title 10-2-1 that adopts the City of Saint Paul City Code Title XI pertaining to water utility. Staff has reviewed Title XI and it is consistent with how the water distribution system has been traditionally designed, constructed, operated, and maintained. Staff sees no impact to water distribution as a result of adopting this code. Section 2: Deletes the existing section pertaining to water meters as this topic is adequately covered in Title XI of the Saint Paul City Code. This section is being reserved for future use by the City of Mendota Heights. Section 3: Amends Chapter 5 to accomplish the following: 1. Adds the same Saint Paul City Code Adoption paragraph as Title 10-2-1-C. Since the Water System is referenced in two separate chapters of Mendota Heights City Code, staff believes it will be easier to understand if this paragraph is adopted in both Chapters 2&5. 2. Adds a section pertaining to service connections establishing ownership of the service lines from the main to the property line; that service lines must be installed in accordance with Title XI of the Saint Paul City Code; and that all service connections must be made in accordance with adopted rules and regulations. 3. Adds a section establishing the setting of Water Rates by the City of Saint Paul, as recommended by the Board of Water Commissioners. Also establishes that the City of Mendota Heights may have a seat on the Board as a Municipal Partner. 4. Authorizes the Board of Water Commissioners to certify past due bills to Dakota County for collection. 5. Renumbers other sections with in the Chapter. The Water Tower sits entirely on City owned property next to the Public Works Garage. The easement is drawn and described in the easiest manner possible to avoid the cost of hiring a Professional Land Surveyor, and it utilizes existing lot lines and landmarks whereever possible to define the easement area. Scott began his career as a firefighter with the Mendota Heights Fire Department in July of 1991. Scott left the department for personal reasons in October of 1996, returned to the department in September of 2001 just days before the 9-11 tragedy, and completed his 20 years of service. Scott is a fifth generation firefighter and his father; Stu also served the department as well as the Eagan Fire Department. Scott was an active member of the department and will truly be missed. During his tenure Scott contributed in many ways from firefighter, Capital Equipment Committee member, Review Board Member, Fire Prevention Committee Chair, Fire Department and Relief Association Secretary, Relief Association Treasurer and he retired as a Captain having served more than 11 years in that capacity. Scott was the "George Lowe Firefighter of the Year" recipient in 1994. He was certified to the Firefighter II level and Haz-mat Operational level. Firefighter Noack is a certified FFII, Haz-Mat Technician and a first responder. Budget Impact The Probationary Firefighter pay is $8.57/hour for fire calls and training. Since Pat Noack is a FFII, Haz-Mat Technician and first responder, his rate of pay should be established at $14.08/hour for fire calls and training, retroactive to February 13, 2016. This memo meets Minnesota State Statutory requirements by having the City Council formally accept the gift and recognizing the donor. On March 29, 2016 Rosemary Plante stopped at the Police Department with 4 mid-size quilts for use as we see fit. All squad cars in the city do have wool blankets in them. The blankets are used for first and / or comfort dependent on the situation. The quilts have already been place in the back of the squads. The will be used and likely over time donated to someone in need at a medical or crisis call of some type. A thank you letter will be sent along with a copy of the signed resolution. BUDGET IMPACT The donation will offset the cost of purchasing new blankets in 2016. BACKGROUND Mold issues in the lower level of City Hall have been evident for quite some time. Legend Technical Services, Inc., a professional mold remediation company, cleaned and sanitized the men's bathroom/locker room in February 2016. Other areas of the lower level of the building have since been tested, and areas are found to be in need of remediation by a similar professional mold remediation company. Water intrusion, which likely contributed to the mold issues, will also need to be fixed as part of the project. Remedies: The Public Works Director and Assistant City Engineer recommend installing a drain tile 24-36 inches below grade along the south side of the building to fix the water infiltration problem. This drain tile would be in addition to the existing drain tile at the foot of the foundation wall, the presence of which was confirmed in an exploratory excavation of the wall last fall. City staff also reviewed a proposed priority list to abate the mold issue with the council during the workshop. BUDGET IMPACT At this time, two quotes have been received to remove the affected gypsum wall board. Shelter Tech's quote of $6,985 is $2,375 lower than the other quote. Staff is also in the process of obtaining quotes for electrical and ceiling work as preparation for the removal of the affected gypsum wall board, as well as quotes for the restoration of the men's locker room. Staff estimates up to $15,000 will be needed to install the drain tile along the exterioiPAT130 City Hall. The preparation work for this will be done as much as possible by city maintenance and Public Works staff. A further recommendation is to hire a project manager to oversee and coordinate these components; the estimated cost for this individual is $10,000. In total, City Council is asked to approve of up to $70,000 for this part of the project. Note these prices do not include costs for other restoration work, such as reinstalling drywall, painting, reinstalling cabinetry and shelving, and reinstalling technology which would have been removed for the initial restoration work. Funding for the lower level mold remediation could come from the Facility Reserve Fund. The current balance in that fund is $90,000. During 2015 many imporvements were made to the parks such as: tennis courts at Ivy Hills Park, tennis backboard at Marie Park, the Off -Leash Dog Area, and canoe rack at Rogers Lake Park, warming house at Marie Park and the hockey boards at Wentworth Park. The commission, council and staff should be very proud of the many wonderful things that took place during 2015. page 51 Ice Rink Usage Report Mr. Wallgren informed the commission that the rinks were only open for 23 days during February. We did see a small decrease in the total number of users this season, but the average daily attendance was up over years past so that is a great sign. The decrease was due to warm/cold weather. Pollinator Work Plan Update Mr. Wallgren reviewed the work plan that staff has created to become a pollinator friendly city. Mr. Wallgren thanked several volunteers that are residents of Mendota Heights for their help with creating the plan. The first step in the plan is to include article in the Heights Highlights and provide information at the Parks Celebration. Recreation Update Mr. Wallgren updated the commission on the planned summer 2016 events. The commission discussed ways that we could take advantage of Market Square Park and possibly get more youth involved. Some ideas that were discussed included an open-mic night for teens, a street dance and talent show. Commission Comments Commissioner Jay Miller thanked everyone for welcoming him and is excited to be on the commission. Commissioner Levine welcomed everyone and is looking forward to a great year. Background In 2015 the Reserve Unit volunteered a total of 2,098.78 hours in support of the Police Department. This impressive donation of time was accomplished by Reserve Sergeant Randy Pentel, Reserve Officers Jim Knox and Jeffrey Parker, and Volunteer Coordinator Becky Pentel. All Mendota Heights Reserve Officers are non -licensed and volunteer members of the Police Department. They perform non -precarious Police functions in support of the full time staff. They primarily assist at city events, with crime prevention efforts and in support of the patrol division as extra eyes and ears on the street. The unit has performed dozens of transports to jail and detox allowing full time Officers to stay back in the city available to respond to emergencies. They participate in ongoing training within the department as well as jointly with other Reserve units from northern Dakota County. Reserve Officers are not trained or authorized to do the majority of the functions of a full time Officer, however they are invaluable because they allow the full time Police Officers more time to focus on protecting the lives and property of the citizens of the communities we patrol. In reviewing the great accomplishments of the unit and its dedicated members we wanted to recognize their efforts formally at a Council meeting and in front of the citizens who benefit from the services they provide. Again this year we would like to honor our members who donated a very large amount of their personal time to the city by presenting them with the Presidents Volunteer Service Award. The President's Volunteer Service Award recognizes individuals and groups that have achieved a certain standard — measured by the number of hours of service over a 12 -month period. This unit which is formally called the Reserve Unit has been operational since May of 2009. Background In 1967 when MHPD was 5 years old, a reserve program was formed under the old civil defense system. In 2009 Captain Jerry Murphy, Sergeant Brian Convery and Reserve Coordinator Becky Pentel worked jointly to revive the Reserve program and added 4 volunteer Reserve Officers to the unit. All but one of the original group, Reserve Sergeant Randy Pentel, have left for personal reasons and to pursue careers in law enforcement. In 2011 four new reserve officers were brought on to help fill the ranks. Of this group Reserve Officers Jim Knox and Jeff Parker continue to actively serve. In 2015 we were down to three reserve officers after the loss of Captain Jerry Murphy. An announcement was posted and we received eight applications. We conducted an extensive selection process and three candidates were recommended to move forward. During the process one of the candidates withdrew after receiving a job offer for a full time police officer position. The new Reserves recruits have under gone an interview process, a criminal background check and fingerprinting. The Reserves will be probationary for the first year. Both of the recruits have completed 40 hours of field training over the past two and a half months with an experienced reserve officer. These new recruits have already accumulated over one hundred hours to prepare them for their duties. page 55 The Reserve Recruits are: • Jon Clayton • Dan Iverson Reserve Officers serve as volunteers working with our two current active Reserve Officers supporting the full time Police Officers. The new Reserves will not be licensed, they will not carry a gun, and they do not have arrest powers. They will supplement the Police Officers and serve as a force expander. Mazzitello, PE, PMP, MBA Public Works Director/City Engineer SUBJECT: Public Hearing on MnDOT Highway 110 Rehabilitation Project and Request for Municipal Consent COMMENT: Introduction The Minnesota State Department of Transportation (MnDOT) is planning on rehabilitating State Trunk Highway 110 in 2017. As part of the design process, MnDOT needs to ask for local government approval of any external access changes to the State facility. Background In order to properly request local government approval, there needs to be a Public Hearing before the local governmental body; in this case, the Mendota Heights City Council. MnDOT will also be requesting local government approval from Sunfish Lake at a separate public hearing. The Public Hearing for Municipal Consent is for access changes from outside the Highway 110 Right -of -Way into the facility. Any changes to access through the Highway 110 median are not covered by the Municipal Consent. At the April 5, 2016 City Council meeting, Council heard a presentation from MnDOT on the project and the request before the Council. Council then opened the Public Hearing and heard testimony. At the request of a local property owner, the Council tabled action, leaving the Public Hearing open, until tonight's meeting. Discussion As part of the proposed rehabilitation project, MnDOT is proposing to close the right-in/right-out access point east of Lexington Avenue that connects Highway 110 to Dakota Drive. The access point would remain for emergency access/egress only with a removable barrier installed. The area is proposed to be converted to a reinforced turf that can support emergency vehicles, but will not appear to the general public to be an access point. Public Works and Public Safety officials have reviewed the plan and endorse it as a public safety measure. In addition to the access change at Dakota Drive, MnDOT also need to establish drainage easements from the Right -of -Way out into adjoining properties. The attached project layout page 57 exhibits show the locations of the drainage easements as well as the change to the Dakota Drive access east of Lexington Avenue. As a result of the discussion at the April 5, 2016 meeting, MnDOT is preparing modified traffic models showing how the access closure to Highway 110 could impact the intersection of Dakota Drive and Lexington Avenue. MnDOT will have this information available at tonight's meeting. The attached Resolutions (2016-26) provide the City Council with three options for acting on the requested Municipal Consent. Council may: Approve Municipal Consent, - Waive Municipal Consent, or Disapprove Municipal Consent. Approving Municipal Consent is self-explanatory. Waiving Municipal Consent is essentially a "non -objection," or a "non -disapproval" of the proposed layout. Disapproving Municipal Consent says the City disapproves of the layout and MnDOT would have three courses of action as outlined in the attached Statutes 161.162 - 161.167. MnDOT may: - Revise project layout to incorporate issues for disapproving Municipal Consent, Appeal the denial to an appeals board as described in the attached Statute, or - Cancel the project altogether. Council does not need to act on Municipal Consent until July 2016; however, MnDOT would appreciate a decision sooner, rather than later. Budget Impact None. Recommendation Staff recommends Council approve Municipal Consent by adopting the attached Resolution 2016-26, RESOLUTION APPROVING MUNICIPAL CONSENT FOR THE MnDOT HIGHWAY 110 REHBILITATION PROJECT LAYOUT. In accordance with Minnesota Statute 161.164, I am submitting for City approval the project's Draft Layout, S.P. 1918-110. The City's approval (municipal consent) is required for this project because it alters access to/from Dakota Drive by removing the right -in, right -out access to Highway 110, and requires acquisition of permanent rights of way in the form of permanent drainage easements. Municipal consent of MnDOT projects is described in Minnesota Statutes 161.162 through 161.167 (attached). Approval or disapproval of the final layout is by resolution of the City Council. The pavement structure will be restored and the ride smoothness increased by resurfacing the roadway from just east of 35E to 494. Safety will be improved in multiple ways: reduce conflict points by limiting access, left turn and crossing movements; lengthen turn lanes; update the pedestrian facilities to meet current ADA standards; updates to guardrail, drainage infrastructure and signing. Project Description This project is located on Highway 110 from Hwy 13/55 to 494. Signing replacement will occur between Highways 13/55 and 494, while the access modifications will occur between Lexington Ave. and Mendota Road, and pavement replacement will occur from just east of 35E to 494. The layout includes areas with geometric changes (access modifications and turn lane extensions) as well as the drainage easements, however it does not show the entire project limits. Planned Project Schedule The letting for this project is scheduled for February 2017, with construction anticipated during the summer of 2017. The construction will require directional closures of Highway 110 which will require traffic to be detoured for a period of time, currently anticipated to last 6 weeks in each direction. Submission of final layout. Before proceeding with the construction, reconstruction, or improvement of any route on the trunk highway system lying within any municipality, the commissioner shall submit to its governing body a final layout and project report covering the purpose, route location, and proposed design of the highway. The final layout must be submitted as part of a report containing any supporting data that the commissioner deems helpful to the governing body in reviewing the final layout submitted. The supporting data must include a good -faith cost estimate of all the costs in which the governing body is expected to participate. The final layout must be submitted before final decisions are reached so that meaningful early input can be obtained from the municipality. Subd. 2. Governing body action. (a) Within 15 days of receiving a final layout from the commissioner, the governing body shall schedule a public hearing on the final layout. The governing body shall, within 60 days of receiving a final layout from the commissioner, conduct a public hearing at which the Department of Transportation shall present the final layout for the project. The governing body shall give at least 30 days' notice of the public hearing. (b) Within 90 days from the date of the public hearing, the governing body shall approve or disapprove the final layout in writing, as follows: (I) If the governing body approves the final layout or does not disapprove the final layout in writing within 90 days, in which case the final layout is deemed to be approved, the commissioner may continue the project development. (2) If the final construction plans contain changes in access, traffic capacity, or acquisition of permanent right-of-way from the final layout approved by the governing body, the commissioner shall resubmit the portion of the final construction plans where changes were made to the governing body. The governing body must approve or disapprove the changes, in writing, within 60 days from the date the commissioner submits them. (3) If the governing body disapproves the final layout, the commissioner may make modifications requested by the municipality, decide not to proceed with the project, or refer the final layout to an appeal board. The appeal board shall consist of one member appointed by the commissioner, one member appointed by the governing body, and a third member agreed upon by both the commissioner and the governing body. If the commissioner and the governing body cannot agree upon the third member, the chief justice of the Supreme Court shall appoint a third member within 14 days of the request of the commissioner to appoint the third member. Subd. 3. Appeal board. Within 30 days after referral of the final layout, the appeal board shall hold a hearing at which the commissioner and the governing body may present the case for or against approval of the final layout referred. Not later than 60 days after the hearing, the appeal board shall recommend approval, recommend approval with modifications, or recommend disapproval of the final layout, making additional recommendations consistent with state and federal requirements as it deems appropriate. Applicability. This section applies to trunk highways that are not interstate highways. Subd. 2. Action on approved final layout. If the appeal board recommends approval of the final layout or does not submit its findings or recommendations within 60 days of the hearing, in which case the the final layout is deemed approved, the commissioner may prepare substantially similar final construction plans and proceed with the project. If the final construction plans change access or traffic capacity or require additional acquisition of right-of-way from the final layout approved by the appeal board, the commissioner shall submit the portion of the final construction plan that shows the changes, to the governing body for its approval or disapproval under section 161.164, subdivision 2, Subd. 3. Action on final layout approved with changes. (a) If the appeal board approves the final layout with modifications, the commissioner may: (1) prepare final construction plans including the modifications, notify the governing body, and proceed with the project; (2) decide not to proceed with the project; or (3) prepare a new final layout and resubmit it to the governing body for approval or disapproval under section 161,164, subdivision 2. (b) If the final construction plans contain changes in access or traffic capacity or require additional acquisition of permanent right-of-way from the final layout reviewed by the appeal board or the governing body, the commissioner shall resubmit the portion of the final construction plans that shows the changes, to the governing body for its approval or disapproval under section 161.164, subdivision 2. Subd. 4. Action on disapproved final layout. If the appeal board disapproves the final layout, the commissioner may: (1) decide not to proceed with the project; or (2) prepare a new final layout and submit it to the governing body for approval or disapproval under section 161.164, subdivision 2. Subd. 5. Final construction plans issued. The conunissioner shall send a complete set of final construction plans to the municipality at least 45 days before the bid opening for informational purposes. Background On January 5, 2016 the city council passed a resolution declaring the City of Mendota Heights a Pollinator- Friendly Community. Since the passing of the resolution, staff has been working with several residents, who are also University of Minnesota Master Gardeners. Through a collaboration of efforts and ideas, the attached Pollinator -Friendly Work Plan has been created. At its April meeting, the Parks & Recreation Commission reviewed and discussed the Pollinator - Friendly Work Plan. A copy is attached. The mission of the work plan is to promote pollinator -friendly activities and practices through public engagement and education. Many of the work plan's activities involve educating staff and residents about current practices and projects with which the city is already involved. Some examples include the Pilot Knob restoration project, Victoria Road project, and the current park management policies. The other major portion of the work plan focuses on future opportunities within the city to increase the amount of pollinator -friendly activities. Examples of those include adding native plantings to city properties, working with MnDOT on the Highway 110 & 149 projects, and hosting community events. Budget Impact Other than some staff time spent coordinating activities and efforts with the Master Gardeners, there will be minimal impact on the current budget. Recommendation The Council should receive and accept the recommended Pollinator -Friendly work plan. Action Required The Council should, by motion, receive and accept the recommended Pollinator Friendly work plan for the City of Mendota Heights. BACKGROUND The Metropolitan Council is a governance and planning agency for the Twin Cities metropolitan area. At the April 5th meeting, the Council heard a presentation by Dakota County Commissioner Tom Egan. Commissioner Egan gave a report on the efforts of the leaders of four Twin Cities metropolitan counties, and their efforts to make reforms to how the Metropolitan Council's policy makers are chosen. The Council heard that the seventeen members of the Metropolitan Council are chosen solely by the Governor, making the Twin Cities unique amongst the approximately 400 metropolitan planning agencies nationwide, in that method of selection. The concern is that this appointment method lessens the accountability to the people which the metropolitan Council represents, especially considering the fact that the Met Council levies property taxes of over $80 million region -wide. The packet for the April 5th City Council contained further information about a proposal to change the selection method for the Met Council representatives to one utilizing elected officials. At the April 5th meeting, the Mendota Heights City Council expressed an interest in supporting a change in the restructuring of the Met Council, and directed that a resolution of support be drafted and considered at the April 19th meeting. Resolution 2016-32 is attached. page 76 If the Council chooses to endorse the restructuring, it would join approximately twenty-five other Metropolitan -area cities who to date have similarly gone on record as supporting the change. The current session of the Minnesota Legislature is debating some of these changes. BUDGET IMPACT There is no direct impact on City finances by this action. ACTION REQUIRED If the Council wants to formally take a position to support a restructuring of the governance of the Metropolitan Council, it should, by motion, adopt the following resolution: RESOLUTION 2016-32 A RESOLUTION SUPPORTING PRINCIPLES FOR REFORM OF THE METROPOLITAN COUNCIL Mark McNeill City Administrator page 77 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 2016-32 A RESOLUTION SUPPORTING PRINCIPLES FOR REFORM OF THE METROPOLITAN COUNCIL WHEREAS, regional planning and local government cooperation is vital to the continued success of the Minneapolis -St. Paul Metropolitan Area; and WHEREAS, the Metropolitan Council is, by statute, the regional planning agency for the Minneapolis -St. Paul Metropolitan Area, with broad authority, including the ability to levy taxes, charge fees and set regional policy; and WHEREAS, cities and counties are the entities most directly affected by policies and financial decisions of the Metropolitan Council, making them the primary constituents of the Metropolitan Council; and WHEREAS, the Metropolitan Council's scope of authority and involvement in regional issues has expanded significantly over the years; and WHEREAS, to be effective a governmental entity, particularly one with taxing authority, must be credible, responsive, and accountable to those it represents; and WHEREAS, the appointment of Metropolitan Council members currently resides solely with the Governor, effectively making the Governor the primary constituent of the Metropolitan Council; and WHEREAS, many cities and counties believe that the Metropolitan Council lacks accountability and responsiveness to them as direct constituents; and WHEREAS, many cities and counties believe that the authority to impose taxes and set regional policy should be the responsibility of local government elected officials; and WHEREAS, reform is necessary to ensure that the Metropolitan Council is an effective, responsive, and accountable partner for regional development and progress. WHEREAS, the Metropolitan Council should be accountable to a regional constituency of those who are impacted by its decisions; and WHEREAS, the Metropolitan Council should not operate as a state agency answerable to only one person, the Governor, as it does in its current form. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mendota Heights, Minnesota, supports reform of the Metropolitan Council by adhering to the following principles: page 78 I. A majority of the members of the Metropolitan Council shall be elected officials, appointed from cities and counties within the region; II. Metropolitan cities shall directly control the appointment process for city representatives to the Metropolitan Council; III. Metropolitan counties shall directly appoint their own representatives to the Metropolitan Council; IV. The terms of office for any Metropolitan Council members appointed by the Governor shall be staggered and not coterminous with the Governor; V. Membership on the Metropolitan Council shall include representation from every metropolitan county government; VI. The Metropolitan Council shall represent the entire region, therefore voting shall be structured based on population and incorporate a system of checks and balances.
