2003-11-12 Airport Relations Commission MinutesCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA AIRPORT RELATIONS COMMISSION MINUTES November 12, 2003 The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, November 12, 2003, at 7:00 p.m., in the Large Conference Room at City Hall, 1101 Victoria Curve, Mendota Heights, Minnesota. The following Commissioners were present: Scott Beaty, Vern Edstrom, Gregg Fitzer, Liz Petschel, Mike Polovny, John Roszak and Ellsworth Stein. Staff present: Jim Danielson, City Administrator; and Bonita Sullivan, Recorder. Ms. Sullivan took the minutes. Approval of Minutes Approval of the October 8, 2003 minutes. Chair Beaty stated that he had a correction. He referenced page five, Item C, line 5, `He suggested that members of the Commission attend as a show of support to the Council' should read `He suggested that members of the Commission attend as a show of support to the Airport Relations Commission and the City Council'. A motion was made by Commissioner Edstrom, seconded by Commissioner Petschel to approve the minutes for October 8, 2003 as amended. Motion carried 7 -0. Unfinished/New Business A. Introduction of new City Administrator — Jim Danielson Chair Beaty introduced the new City Administrator, Jim Danielson to the Commission. He reviewed the purpose of the Commission and their meeting process with City Administrator Danielson. He congratulated him on his new position with the City and welcomed him as a member of the Commission. B. Discussion of Third Parallel Runway Contract Chair Beaty reviewed the Third Parallel Runway Contract with the Commission stating that there were concerns regarding the omission of item #7 on the signed contract he received from Chad Legve. He asked Commissioner Roszak if he had an opportunity to review the contract. He explained that the Commission would like a legal opinion regarding the omission and whether it is an item that should be incorporated back into the document. Commission Meeting November 12, 2003 Mendota Heights Airport Relations Commission Commissioner Roszak stated that he had not had an opportunity to review the signed contract. He stated that he emailed City Administrator Lindberg asking if they had given notice. He stated that in her response she stated that she did not believe that they had adding that he does not believe they met the deadline. Chair Beaty stated that in a conversation he had with City Administrator Lindberg she explained that in a conversation she had with Mr. Leqve it was stated that the omission of Item #7 was on purpose and reviewed with the Commission. He asked if the omission would cause any problems or issues. Commissioner Petschel noted that the original copy of the contract, that included Item #7, was signed by the previous Mayor and asked what happened to that copy of the contract. Chair Beaty explained that it was misplaced, which required a new copy of the contract and a new signature. Commissioner Petschel expressed concerns and asked if the Commission should request a new copy of the contract that would include Item #7. She asked if omission would have any impact on the benefits for Mendota Heights. Commissioner Roszak clarified his understanding of the contract noting that the agreement is between the MAC and Mendota Heights. He noted that it now appears that Mendota Heights has a separate agreement. He clarified that omitting Item #7 does not create an impact if all of the benefits are documented, included and recorded. Commissioner Petschel referenced Item #5 stating that the Commission should monitor the progress closely as the new contract covers the construction of the new runway. She noted that an Environmental Impact Study would have to be done for each end of the runway if the percentage of use exceeds 1.5 %. She stated that anything over 1.5% would require a new EIS and reviewed with the Commission. Commissioner Roszak provided a historical overview of the agreement to the Commission noting that by recording the contract with the County it shows third party benefits and would protect the interests of the City of Mendota Heights. He suggested that the contract also be recorded in Hennepin County and reviewed the benefits of recording the contract with the Commission. Commissioner Edstrom confirmed that it was his understanding that the project would be completed by October 2005. Commissioner Petschel clarified and reviewed the 17 -35 Delay Analysis with the Commission. Commissioner Stein referenced Item #5 and clarified that it is his understanding that it would not be used for arrivals from the south. Commissioner Fitzer clarified the arrival/departure intents for the runway with the Commission. Commissioner Petschel clarified that Mendota Heights would receive the same benefits as City of Minneapolis. Commissioner Fitzer stated that it was his understanding that the ) Commission Meeting November 12, 2003 Mendota Heights Airport Relations Commission wording of the contracts for both Minneapolis and Mendota Heights were the same with respect to the benefits and reviewed with the Commission. Motion by Commissioner Roszak, second by Commissioner Fitzer, that the Airport Relations Commission recommends to the City Council: 1. Approve and sign the contract with the MAC. 2. Record the contract with the appropriate County Recorders to best protect the interests of the City of Mendota Heights. 3. Recommend Hennepin County as the appropriate County and other Counties, as needed, for recording, subject to recommendations from the City Attorney. Motion carried 7-0. C. Pilot Knob Update — City Administrator Danielson City Administrator Danielson stated that they received a large response from the Citizens and various agencies regarding the EAW. He stated that all are opposed and do not believe the EAW is complete. Chair Beaty stated that the Council had suggested he issue a letter from the Commission. He explained that the Mayor was not comfortable with comments issued from the Commission and suggested that he contribute to the process as a citizen of Mendota Heights. He noted that the Airport Relations Committee had already voted, unanimously, not to support the EAW. City Administrator Danielson stated that the City Council would receive a letter from the EAW for their consideration next Tuesday at the Regular Council Meeting. He stated that Council would decide at that time whether they should move forward or not. He reviewed noting that the areas not addressed included noise levels, stormwater runoff and historic impact. Commissioner Edstrom asked if noise levels are included in an environmental assessment. Commissioner Roszak confirmed that noise levels do impact the environment and are included in the assessment process. Chair Beaty asked who would be responsible for the costs if Council would decide on a full blown assessment. City Administrator Danielson stated that the developer paid for the EAW and would also be responsible for the EIS. City Administrator Danielson stated that he would update the Commission on the Council's decision. Acknowledge Receipt of Various Reports/Correspondence: Commissioner Edstrom referenced Item B, a letter from MnDOT and asked for further clarification. Commissioner Petschel explained that this was for the Joint Airport Board meetings that Council Member Krebsbach has been attending and reviewed with the Commission. Chair Beaty further clarified stating that the zoning board has been meeting Commission Meeting November 12, 2003 Mendota Heights Airport Relations Commission on this issue for the last year and a half adding that they have to make some decisions regarding the runway. Commissioner Edstrom referenced the Eagan/Mendota Heights Departure Corridor report stating that there are several disparities in the report and reviewed with the Commission. He asked if there is anything that could be done to address the disparities. He stated that there has been considerable development done based on the centerlines of the runway. Chair Beaty reviewed the differences in the corridor stating that the changes were made due to safety issues. Commissioner Edstrom suggested that the Commission review these issues further. Chair Beaty referenced the Technical Advisor's Report noting that Mendota Heights had 6.2% of the complaints and reviewed with the Commission. Chair Beaty referenced the September 26th Noise Report noting that MIT is heading a team with the FAA for noise and emissions mitigation and reviewed with the Commission. He stated that these are the kinds of issues that the Commission should monitor going forward. Commissioner Roszak agreed and suggested writing the organization to request copies of their report/newsletter. He stated that this would provide an avenue for the Commission to track the issues. Commissioner Petschel stated that she would contact MIT for further information and update the Commission. Chair Beaty referenced the San Jose Airport noting that a recently approved item implementing take -off restrictions for certain aircraft. He stated that it would interesting to know how many Northwest Airlines jets would not qualify. He reviewed the options with the Commission and asked if this would be an issue the Commission would be interested in researching. Commissioner Fitzer reviewed the current designated curfews with the Commission stating that they would have to identify a relief field before implementing the kind of curfew recently approved for San Jose. Commissioner Petschel asked if the fleet mix Northwest Airlines is operating out of Minneapolis is the same as Detroit. Commissioner Fitzer explained that the mix is pretty even between the two airports. He stated that he could research further and provide the Commission with further information that would give them a clearer idea of the mix. He explained Mr. Friel's evolving interest in the airport noise issues with the Commission stating that the file includes a large amount of correspondence between Mr. Friel and Les Case. He stated that Mr. Case discussed concerns such as safety issues and the 15-degree separation in several letters. He suggested that each of the Commissioners take some time to review the file stating that it has some very interesting reading and history. He suggested that they include this item on the agenda each month for discussion until each Commissioner has had an opportunity to review the file. He provided the file to Commissioner Petschel for her review.
