2002-08-14 Airport Relations Commission MintuesCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA AIRPORT RELATIONS COMMISSION MINUTES August 14, 2002 The regular meeting of the Mendota Heights Airport Relations Commission was held on Wednesday, August 14, 2002, at 7:00 p.m. in the Large Conference Room at City Hall, 1101 Victoria Curve. The following Commissioners were present: Scott Beaty, John Roszak, Vern Edstrom, Liz Petschel, and Ellsworth Stein. Staff present: City Administrator Cari Lindberg; Administrative Assistant Patrick Hollister and Recorder Bonita Sullivan. Also in attendance: Sandra Krebsbach, Council Member and Airport Zoning Board. Ms. Sullivan took the minutes. Not Present: Commissioner's Joseph Leuman, Gregg Fitzer Approval of Minutes Approval of July 10, 2002 Minutes. Commissioner Petschel had corrections for the minutes. She referenced page two, paragraph six, stating that it did not make sense. She explained that the point regarding Best Buy had been previously made and asked that the entire paragraph be removed. She referenced page nine, Acknowledge Receipt of Documents, paragraph two, regarding the percentage of the operations outside the corridor. She stated that `70% outside the corridor' was incorrect. She clarified that it should be '10% outside the corridor'. Chair Beaty had corrections for the minutes. He referenced page seven, Item D, paragraph 3, regarding the statement that he was in agreement with the Mayor. He clarified that he did not agree with the Mayor's decision not to grant the $300.00. Commissioner Petschel agreed and referenced Chair Beaty's suggestion for a letter of explanation. He agreed stating that the Commission decided to write the letter of explanation and he asked to strike that sentence. City Administrator Lindberg had corrections for the minutes. She referenced page five, paragraph four, it states `Garon Circle issues'. She clarified that it should be `Garon site issues'. A motion was made by Commissioner Roszak, seconded by Commissioner Petschel, to approve the minutes as corrected. Vote 5 Ayes, 0 Nays. Commission Meeting — August 14, 2002 Mendota Heights Airport Relations Commission Unfinished/New Business A. Council Member Sandra Krebsbach: Airport Zoning Board Issues. Council Member Krebsbach provided the Commission with an update on airport zoning issues, the Zoning Board and the decision - making rationale regarding zoning. She explained that the Zoning Board is reviewing the ordinances as it relates to the URS map. She reviewed indemnification with the Commission stating that she made a motion that all areas be treated the same as areas A and B. She stated that it was strongly supported and that the Council goal is uniform treatment of Cities neighboring the airport. She further explained that it applies to the ability to have residential housing. She noted that Mendota Heights removed 55 homes in 70's to create a corridor and explained that the policy is to get the planes to remain in that corridor. She further explained that if they maintain agreement that the same treatment applies to close and departure. She noted the changes in the Lake Nokomis area stating that it is very different now with respect to close and departure. She complimented the Commission for being so effective and encouraged the Commission to walk the Nokomis area to experience close and departure. Chair Beaty noted that the close and departure is being eliminated. Council Member Krebsbach stated that they are considering a reversal adding that it does make a significant difference. Council Member Krebsbach explained that they have the support of the Zoning Board with respect to the same treatments for Safety Zones A & B. She stated that they have the safety zones established and encouraged the Commission to hold out for close in departure. She further stated that Mendota Heights has created the corridor and that it should be maintained. She expressed concerns about the increase in flights over the Garon Site and suggested tracking Augustus North. Council Member Krebsbach reviewed the Garon site with the Commission noting that it is one of the key areas with the same relationship as Mississippi Blvd. She stated that they should be able to built residential on the Garon site and that it could be industrial /commercial strength build condos. She reviewed the location and directions to face the buildings for best views of the area noting that it would compliment the river and provide a beautiful appearance to the gateway area. She stated that the residential could be high -end and encouraged the Commission to take a walk around the Nokomis area to experience the close and departure for noise levels. She suggested that the Commission consider condominiums comparable to the Calhoun area. Chair Beaty asked if the items coming out from the runways are the safety zones. Council Member Krebsbach stated that the safety zone does not go that far. Chair Beaty reviewed the runway takeoff patterns with Council Member Krebsbach and the Commission. Council Member Krebsbach agreed noting that they have hinged the landing and takeoff but that they want them to remain within the corridor. Chair Beaty Commission Meeting — August 14, 2002 Mendota Heights Airport Relations Commission clarified the actual corridor stating that there has been changes made noting that they have hinged the landing and takeoff. Council Member Krebsbach clarified that the present issue is similar treatment. She acknowledged that they did create a corridor for them to fly in and the changes are a different issue that would be addressed separately. Commissioner Edstrom clarified his understanding of the technical facts and asked if the Council is strongly in favor of building on this site. Council Member Krebsbach stated that she thought they were but that it did not include support from all of the Council. She explained that the Council believes this would be a great place to live and she urged the Commission to be vigilant with respect to the corridor issues. Commissioner Petschel stated that the Commission has worked very hard to lobby on issues, discuss issues with the MAC and other organizations. She explained that they have lobbied very strongly on behalf of the City to get the same treatment. She referenced the differences between what the actual corridor should be and what the corridor is today stating that the assignments come from the FAA and that their vigilance in lobbying is pointless if the FAA is moving forward to change the flight patterns. She reviewed the Technical Advisors reports for the last two months noting that they are not following the assigned flight tracks. She stated that they have worked hard to try to get them to work within the corridor and as long as the assigned flight tracks come from FAA it is a federal issue and they have no influence. She acknowledged that technically they are not supposed to be there but they are stating that knowing this, forces the question should they place people in these areas to live. Chair Beaty agreed with Commissioner Petschel and asked if they could consider actually putting people in this area to live stating that this would be the loudest area of the City. Council Member Krebsbach encouraged the Commission to take the position of the City. Commissioner Petschel stated that they have been aware that this has been a simmering issue for awhile and that she did request a joint Commission /Council meeting before coming to a decision. Council Member Krebsbach explained that they would need to have a proposal and that once they have a viable plan they would meet with the Commission. Commissioner Petschel stated that she is not comfortable supporting the Council without knowing the issues first. She further stated that they should be allowed the opportunity to review all the issues before providing support to the Council. She stated that it is no different than the Planning Commission with respect to reviewing the issues prior to making a decision. She explained that they are a consultative group and that they should be utilized in this capacity. Chair Beaty agreed with Commissioner Petschel and expressed his concerns regarding the quality of life for those living in this area. Commission Meeting — August 14, 2002 Mendota Heights Airport Relations Commission Commissioner Petschel noted that the amount of time exposed to aircraft noise is exponential. Council Member Krebsbach acknowledged the overflights and that once the new runway is completed that the overflights would be reduced. Council Member Krebsbach encouraged the Commission not to magnify the MAC position. The Commission clarified that they are not supporting the MAC and that they believe what the MAC is doing is wrong. Council Member Krebsbach explained that the City of Mendota Heights has the same right to develop as other Cities around the airport. She further explained that there are factors MAC has been promised and that she believes it is the City's role and responsibility to hold to these promises. Chair Beaty clarified that the Commission does not have a problem with development but that they need to consider the type of development that would be put in this area. Council Member Krebsbach stated that they would work with a developer that would be able to envision the type of high -end commercial /industrial residential development. Commissioner Petschel clarified that the type of condo they are looking at would be similar to 740 Mississippi River Boulevard in St. Paul. Council Member Krebsbach confirmed and reviewed the locations with the Commission. Council Member Krebsbach thanked the Commission for their intense work and for advocating for the City. She stated that the Commission is very effective as they are bringing people to the Commission. Commissioner Stein asked how many condos were being considered. Council Member Krebsbach stated that they have not made any decisions and suggested walking the Nokomis and Calhoun area. Commissioner Roszak stated that when articulating the City position it is not the MAC and clarified the corridor adding that MAC has nothing to do with FAA. Council Member Krebsbach clarified that the government is people making decisions and she acknowledged the restrictions. She stated that right now Council is supportive of residential development in this area and that the terms of safety zones are not the issue. Chair Beaty suggested a general discussion with Council. Council Member Krebsbach suggested waiting until after the election and meet in January. B. N.O.I.S.E. Conference Report. Administrative Assistant Hollister provided the Commission with an overview of the N.O.I.S.E. Conference. He stated that he and the Mayor attended noting that the Conference was held July 17 -19, 2002 in Providence, Rhode Island. He provided the Commission with a packet for their review. Commission Meeting — August 14, 2002 Mendota Heights Airport Relations Commission Chair Beaty asked if they are members of N.O.I.S.E. Administrative Assistant Hollister stated that Mendota Heights is a member and that they were registered for the conference. He stated that he would check on why they were not included in the list of members. Administrative Assistant Hollister reviewed the following with the Commission. • Conference Sponsors. • Conference Agenda items. • Dave Carbonne, San Francisco Airport Presentation. • San Mateo Round Table process noting the similarities in function with the MAC. • Exhibit Hall exhibits. • TF Green presentations given by several local officials regarding property insulation. • Ben Delionne, FAA Airport Expansion and Streamlining of Environmental Review Process. • Regionalization Issues and Logan Airport. • Breakout Sessions. • Michael Dukakis presentation on High Speed Rail. • Offsite Tour — noise insulated neighborhoods of the area. • Awards Dinner. • Technical Side of the Noise Management Seminar. • Logan Airport neighborhood tour. • Next year Conference will be in Washington, D.C. C. AMM Transportation Committee Airport Noise Statement Administrative Assistant Hollister stated that he and Commissioner Stein serve as representatives and provided an overview of the meeting to the Commission. He explained that the individuals belonging to the Airport subcommittee are not focused on Airport Noise. He further explained that the Minneapolis members are now serious about making the airport noise part of their focus. City Administrator Lindberg asked if there are representatives from Bloomington, Richfield or Minneapolis. Administrative Assistant Hollister stated that membership includes Council Members from Richfield and Burnsville noting that John Hoenstein attended but no longer represents Eagan. He further explained that they are a small group and only deal with issues that affect all Cities. Commissioner Petschel stated that the 60/65 was not fully funded and reviewed with the Commission. She asked what happened to the funding for the 60/65 adding that this was an issue prior to the September 11th tragedy. City Administrator Lindberg stated that she received budget information for the MAC and that she would include it in the next meeting packet. Administrative Assistant Hollister referenced an airport noise report that includes what has been spent so far on airport noise. Commission Meeting — August 14, 2002 Mendota Heights Airport Relations Commission Commissioner Roszak noted that the last paragraph discusses other impacts that need to be identified and suggested adding measures implemented by the MAC, the FAA and other agencies in order to broaden the awareness that there are other agencies involved. Chair Beaty asked that they add the word `valid DNL contour'. D. Airport Noise Plan of Action. The following items were identified by the Commission as focus issues that are to be included in the Airport Noise Plan of Action: • Equal Treatment at the end of runway • Close in VS Distant • Land use • Equity of current runway systems • Monitoring Non - Simultaneous Departure Procedures • Nighttime restrictions. • Third Parallel Runway Contract. • Head -to -Head Operations. The Commission held a general discussion to determine the process they would like to take to identify the Focus items. Administrative Assistant Hollister encouraged the Commission to read the national N.O.I.S.E. reports as it could provide them with ideas as to how other Cities and areas are addressing these issues. Commissioner Edstrom asked if there is data that could be obtained from the FAA that would provide statistics for the Garon Site. Commissioner Petschel suggested contacting Cindy Green, FAA Tower, stating that she could possibly provide information that shows the assigned degree headings for Council review. City Administrator Lindberg suggested reviewing the national reports and bring some ideas to the next meeting for discussion. Chair Beaty asked staff to review the items and put together an overview of the items for discussion at the next meeting. Commissioner Petschel offered to assist City Administrator Lindberg in prioritizing items for discussion. OTHER COMMENTS OR CONCERNS Chair Beaty asked for volunteers to run the meeting next month in his absence. Commissioner Roszak agreed to chair the next meeting.
