C) RECOGNITION OF DONATION – GEORGE SONNEN APPROVAL OF RESOLUTION 2016-11 City Administrator Mark McN�eill explained that in November 2015 George Sonnen, a Mendota Heights resident, donated a photograph to the City. The photograph is of the Friendly Hills neighborhood under construction dated somewhere around 1956 or 1957. Mr. Sonnen explained how he came into possession of the photograph. It was noted by Mayor Krebsbach that anyone who has historical artifacts or photographs should feel free to donate them to the City, as a historical record is highly valued. Councilmember Norton moved to adopt Resolution 2016-11 Acknowledging the Donation of a Historic Photograph of the Friendly Hills Subdivision. Councilmember Petschel seconded the motion. Ayes: 3 Nays: 0 Absent: 2 page 6 D) PRESENTATION BY DAKOTA COUNTY SHERIFF TIM LESLIE Dakota County Sheriff Tim Leslie gave a presentation on the services of the Dakota County Sheriff's Department. He shared information on the department personnel, the Violence Against Women Act (VAWA) Grant, warrants issued, the issuance of gun permits, management of the county jail, court security, ways the department communicates to the public [Twitter, Facebook, Website], establishing a triad to handle crimes against the elderly, hiring of additional personnel / budget, implementing the lethality assessment into operations, explained the goal of reducing outstanding arrest warrants, and the technology used to increase efficiency and effectiveness. Councilmembers asked questions regarding the status of the DNA Collection Project. PUBLIC HEARING None scheduled. NEW AND UNFINISHED BUSiNESS A) STATEWIDE HEALTH IMPROVEMENT PROGRAM (SHIP) GRANT APPLICATION City Planner Nolan Wall presented the Dakota County Statewide Health Improvement Program (SHIP) Grant. This is a grant funded by the Minnesota Department of Health. Their goal is to reduce chronic disease and improve health for all. Active Living Dakota County is the county department that oversees the grant money fram the State. They are seeking proposals this year for projects that meet those criteria to advance those goals for Active Living and Healthy Eating strategies for the 2016 and 2017 project years. Staff has identified a potential project, which would be a bike & pedestrian plan, as an eligible project for funding. The proposed project would update the existing Trail Improvement & Management Plan and study the Dodd Road corridor to identify options for a safe trail facility for this area and identify potential funding sources. This would be an overall plan for a citywide bike and pedestrian network and then narrowing in on the Dodd Road corridor. If the project were successfully funded, staff would propose to work primarily with the Parks and Recreation Commission to develop the plan and facilitate outreach events. Staff recommended that the City request the maximum amount of $35,000. The County does require a 10% matching funds, which could be in the form of cash or in-kind services. In this case, coordinating the plan and doing the stakeholder engagement would not require any additional funds from the budget, and would be considered in-kind services. It was anticipated that the City would contract far professional planning services to complete the planning document. Staff would rely on professionals to do a detailed analysis of the corridar as well as provide cost estimates. Applications are due by January 29, 2016; monies would be awarded in July 2016. If awarded the funds, the project would need to be completed by October 1, 2017. page 7 Councilmembers asked questions regarding this being similar to when the City applied far the grant to plan for the Industrial Park and commented on how timely this grant request is with the Lebanon Hills project and a great lead into the comprehensive planning process. Councilmember Norton moved to approve the submission of the proposed Dakota County SHIP Grant funding request in the maximum amount of $35,000. Councilmember Petschel seconded the motion. Ayes: 3 Nays: 0 Absent: 2 B) SCOPING ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) — MVZ VENTURES, LLC ALTERNATIVE URBAN AREA-WIDE REVIEW (AUAR) Planner Wall noted that Stantec has been hired by the Minnesota Vikings to complete an alternative area wide review for the proposed Vikings Development Project. The project is on approximately 203 acres, would include a corporate headquarters, a training facility, and surrounding mixed-use development. Staff attended two meetings that were hosted by the City of Eagan in December 2015 on the upcoming review process. The Environmental Assessment Worksheet (EAW) was received at the end of December 2015. Since that time, staff reviewed the document and they brought it to the January 4 Council Workshop meeting for review. Comments are due back by February 3, 2016. Planner Wall explained that state statute requires that the City of Eagan conduct a public process to receive comments about the scope of the review. The purpose of the comments on a Scoping EAW for an AUAR is to suggest additional development scenarios and relevant issues to be analyzed in the review. Based on the discussion at the workshop, a summary of the Council's comments included the following: Level of Service "D" analysis, traffic going north on Dodd Road, stadium capacity, outdoor events, transit, noise, traffic, public safety impacts. After discussion, clarification, and questions, the Council made suggestions far additional comments to be included in the document. COMMUNITY ANNOUNCEMENTS Assistant to the City Administrator Tamara Schutta made the following announcements: • The "State of the City" address is scheduled for February 9 at 7:30 a.m. with live broadcasting beginning at 8:00 a.m. on Comcast Cable Channel 18. The Police Department is having a Winter Wonderland Coloring Contest. Pages are due January 22. Winners will be selected by January 29. Recycling of holiday lights continues through February 5, 2016. page 8 COUNCIL COMMENTS Councilmember Norton noted that he had a great time at the City staff event. Councilmember Petschel asked for an update on Highway 13. Engineer Mazzitello replied that Highway 13 would be re-opened on January 21. Councilmember Petschel reminded residents that on March 9 at 7:00 p.m., members of the Metropolitan Airport Commission (MAC) staff and the FAA will explain to the public how and why the airport is operating the way it is. This meeting is open to the public. She also noted that the City Council meeting which was held that evening is her favorite night of the Council calendar, and to be able to recognize City staff, police, and firefighters for their efforts. She eXpressed her appreciation to all employees who help to make the City what it is. Mayor Krebsbach also expressed her appreciation to the staff for their longevity and the recognition by their peers. She also noted that January 23 is the Future Cities Competition, which is open to 6tn 7th and 8th graders throughout the State of Minnesota. It is being held at Dunwoody Institute. There are three teams from Friendly Hills Middle School scheduled to present to the City Council after the competition. ADJOURN Councilmember Petschel moved to adjourn. CALL TO ORDER Mayor Krebsbach called the meeting to order at 6:21 p.m. Councilmembers present included Norton, Petschel, and Krebsbach. Councilors Povolny and Duggan were absent. Also in attendance were City Administrator Mark McNeill, City Attorney Tom Lehman, Public Works Director/City Engineer John Mazzitello, Police Chief Mike Aschenbrener, and John Mertens of the Dakota County Parks Department. TRUNK HIGHWAY 110 UNDERPASS DISCUSSION Mazzitello explained the Dakota County Project Management Team recommendation for the TH 110 crossing. He said that it was possible to design and build an expanded box culvert to be a size identical to the three-sided arch, which the City Council had earlier preferred. The size-20 feet wide by �12 feet tall—would allow the width of a trail to accommodate bicycles and pedestrians on separate paths. There would be an opening in the median, between the eastbound and westbound lanes of Highway 110. The advantage of the box culvert would be that it would cost approximately $1 million less than the three-sided arch, and would mean that traffic on TH 110 would not be disrupted for as long during construction. The Council viewed architectural renderings of the box culvert, and a three-sided arch. Questions were asked about snow removal, and drainage. Also discussed was a desire to soften the impact of the retaining wall, which Mertens explained might be done through terracing. Norton asked whether a staircase could be added to reduce the ramp travel distance. It was agreed that that could be explored, and that the cost of a staircase would be manageable. Mertens said that the current allocation of County funding would allow for the construction of the expanded underpass, with some level of improvements which were acceptable to the City. As a result, no State bonding money would be needed. The consensus of the Council was that the request for the state bonding money would be withdrawn for this year, and that the City would instead regroup, and work to provide for a pedestrian underpass under podd Road north of TH ll 0. If necessary, state bonding money could be sought for the next biennium bonding bill in 2018. ADJOURN Motion Petschel, second Norton, to adjourn the meeting at 6:41 p.m. Motion carried 3-0. Companies, LLC., 775 Willow Lane Lot Split and Wetlands Permit � City Planner Nolan Wall explained that the applicant, on behalf of the property owners, has requested a lot split on the subject parcel at 775 Willow Lane as well as a wetlands permit for construction activity within 100 feet of a wetland/water resource-related area. Planner Wall shared an image of the lots' location in the Bunker Hills N�eighborhood; south of Marie Avenue, west of Dodd Road, north of Highway 110. The subj ect parcel was approximately one acre, contains an existing single-family dwelling, zoned R-1, and guided far low density residential in the Comprehensive Plan. Marie Creek runs through the northwest corner of the lot. The applicant intends to demolish the existing home and then construct two new single-family homes on the newly-created lots. This subdivision would create two lots, both of which are in excess of the 15,000 square foot minimum lot size requirement in the R-1 District. Parcel A would be 23,296 square feet and Parcel B would be 19,702 square feet. Both parcels would have over 100 feet of frontage at the 30-foot setback line and are consistent with the Comprehensive Plan. page 12 As part of the building permit process, the required setbacks for the new dwellings, as well as compliance with the first floor elevation requirement, will be verified at that time. Planner Wall shared an image showing the grading plan that was submitted with the 100-foot buffer line for the wetlands permit. This line does encompass portions of both proposed parcels and, based on the proposed building pads, construction of the new dwellings will require grading � within that buffer area requiring the wetlands permit. Slopes greater than 25% and the 25-foot non- � disturb buffer area requirements are being adhered to. According to the applicant, no vegetation will be removed within the 100-foot buffer area. Based on the preliminary review of the proposed �� development, staff does not feel that there are any negative impacts to the creek. Staff recommended approval of this request. � Commissioners asked questions regarding the location of the existing dwelling and the footprint of the proposed dwellings, proposed setbacks, teardowns, first floor elevation requirements, and � conditions of the request. The applicant shall dedicate drainage and utility easements across the entire 25-foot non- disturb buffer area from the edge of Marie Creek on both proposed parcel, to be denoted on the Certiiicate of Survey submitted to Dakota County. Connection charges for sanitary sewer and water main shall be paid prior to issuance of a building permit. The applicant shall submit grading and utility plans and a dimensioned site plan with associated easements, subject to review and approval by the Engineering Department as part of any building permit application. No disturbance, besides installation of erosion control measures during construction, shall occur within 25 feet of the edge of Marie Creek or on slopes greater than 25%. All grading and construction activity will be in compliance with applicable federal, state, and local regulations and codes, as well as in compliance with the City's Land Disturbance Guidance Document. Future construction on the newly-created parcels will be compliant with all applicable City Code provisions. The applicant shall begin the work authorized by the wetlands permit within ninety (90) days and be completed within twelve (12) months from the date of approval, unless an administrative extension is granted prior to the permit's expiration. PLANNING CASE #2016-03 City of Mendota Heights Proposed City Code Amendments concerning subdivision regulations City Planner Nolan Wall eXplained that the City of Mendota Heights is considering amendments to various sections of Title 11 of the City Code concerning subdivision regulations. Staff had identiiied several issues with the existing regulations; the bulk of which were adopted in 1991 and there were subsequent amendments in 2003 and in 2009. The proposed amendments included in the draft ordinance include administrative and regulatory modifications. Staff reviewed past subdivision requests, platting guidance manuals, and consulted with the Dakota County Surveying Department in order to update certain sections and then to identify those issues that needed to be addressed within the draft ordinance. page 14 Planner Wall briefly summarized each section and fielded questions from the Commission. Commissioners also made suggestions for clarification within the draft ordinance. He shared his concerns related to Planning Case 2016-04 with Commissioner Noonan. PLANNING CASE #2016-04 City of Mendota Heights Proposed City Code Amendments concerning Industrial Zoning District uses City Planner Nolan Wall explained that the City of Mendota Heights is considering amendments to various sections of Title 12, Chapter 1, Article G of the City Code concerning uses in the Industrial Zoning District. The City recently finalized the Industrial District Redevelopment P1an and is proceeding with implementing several of the recommendations included in the plan. The recommendations were developed as a result of surveying property owners and managers, tenants, and brokers; a market analysis completed by a commercial real estate firm; Planning Commission/City Council joint workshop; and then the City Council was presented this information and had several discussions regarding the implementation strategy. Mare specifically, at the January 4 City Council workshop staff received direction to proceed with the process to consider revisions to the uses that are allowed in the Industrial District. Planner Wall then gave a definition of the following terms: Permitted Uses, Conditional Uses, Interim Uses, and Accessory Uses. BACKGROUND One vacancy on the Parks and Recreations Commission has been created by the resignation of Mr. Jack Evans. Staff and the City Council are grateful for his service to Mendota Heights. In anticipation of this vacancy, announcements of the open seat were made, and six individuals responded. Five of those individuals will be interviewed by the City Council prior to the regular City Council meeting on February 2nd; the sixth candidate was interviewed earlier in Janaury. Assuming a consensus is reached, an appointment to the vacant seat should be made at the February 2nd regular meeting. That will need to be done by resolution, and is for the terms of appointment commencing March 1, 2016. An additional item included in the resolution will be the reappointment to new three year terms for incumbents Stephanie Levine, Michael Toth, and Joel Paper. Also to be interviewed on February 2nd are two young people who have indicated an interest in being appointed as youth representatives on the Commission. Those appointments are valid for a single year; if they have not graduated, the youth representatives may ask to be reappointed. The Board of Water and Soil Resources (BWSR), the State regulatory agency that oversees surface water management, requires these municipal plans be updated every 10 years. In addition, the Lower Mississippi River Watershed Management Organization (LMRWMO) recently updated its Watershed Management Plan, to incorporate that portion of Mendota Heights that was part of the Gun Club Lake Watershed Management Organization. Lastly, an updated LSWMP will be required for the upcoming City Comprehensive Plan update schedule to take place in 2017-2018. On October 20, 2015, City Council authorized staff to seek proposals for professional services to update the LSWMP. Staff sent out a Request for Proposals (RFP), inviting four consulting iirms to propose on the plan. All four firms responded with proposals. Staff reissued the RFP on December 17, 2015 to clarify an issue the proposing consultants differed on in their original proposals. All four firms re-submitted their proposals on January 18th, and staff re-evaluated them using the new criteria. The re-submitted proposals needed to demonstrate: 1. The plan must meet the regulatory requirements of the Board of Water and Soil Resources (BWSR) 2. The plan must include the goals, objectives, and requirements of the Lower Mississippi River Watershed Management Organization (LMRWMO) management plan, as adopted in August 2015 3. The plan must include necessary updates to be compliant with the Metropolitan Council's requirements far the City's Comprehensive Plan update to take place in 2017-2018 4. The plan must update our surface water flow water quantity model (including maps and figures) to account for increased rainfall intensity data as identified by the Atlas-14 rainfall intensity data 5. The Plan must include a full water quality model in P8 format that will become the property of the City of Mendota Heights upon completion. The model shall be modifiable so that the City can update the model in the future page 25 Staff has evaluated the proposals and determined that all four proposing firms would meet the basic criteria listed above. Scoring the four proposals yielded extremely close scores, and all but one were under the City's budgeted amount. Using the scoring criteria published with the RFP, two firms scored an exact tie by points. One firm (WSB & Associates) had a lower price, while the other (Consultant 3) provided a better description of their methods for updating the LSWMP with a larger price. The proposed cost for each of the responding consultants is listed below: WSB & Associates = $54,486.00 Consultant 2 = $58,065.40 Consultant 3 = $79,945.00 Consultant 4 = $90,322.00 Given an exact tie in score, staff is recommending the lower price firm, WSB & Associates, for award of the consultant contract. BUDGET IMPACT The revision of the LSWMP is budgeted for and will be paid for out of the Storm Sewer Utility fund. The estimated amount in the budget for this task is $80,000, and sufficient funds exist in the Storm Sewer Utility Fund to cover the expense of this contract. These include, but are not limited to: surveying, geotechnical services, project specific design, traffic analysis, and surface water management. A group of Dakota County engineers and Public Works Directors has been working on developing a blanket Request for Qualifications (RFQ) that all cities in the County could tailor and use for establishing their own, city specific pool. The group would like to send out the RFQ in mid-February for consultants to respond by the end of March. Cities would be able to select and award their respective pools at any time, but the group feels it would be more fair to the consultants to only open the RFP once, rather than several city RFQs being issues periodically throughout the year. The RFQ will include consultant services for the following disciplines: 1. General Municipal Services (project development, feasibility reports, etc.) 2. Infrastructure/Capital Improvement Planning 3. Construction Services 4. Assessment Preparation/Appraisal 5. Miscellaneous/Administrative 6. Architectural/Structural 7. Electrical/Mechanical 8. Land Surveying 9. Utilities/Natural Resources (including surface water & storm sewer) 10. GeotechnicaUSoils Analysis 11. Traffic/Transportation Consulting firms would submit a Statement of Qualifications (SOQ) in response to the RFQ. The City would be able to tailor each of these categories to suit our needs in the RFQ we would publish at the same time the other cities publish theirs. If the City of Mendota Heights participated within this RFQ process, we would select the firms for our pool based on the SOQs that best fit our needs. A standard consultant SOQ is typically considered valid for five years. page 27 Once established, the consultant pool would allow the City to simply award work orders to selected consultants within the pool without going through a Request for Proposal (RFP) process for each work order. Selected consultants would have a rate schedule that would be accepted along with their SOQ and would be held to those billing rates. A work-hour limit could be negotiated within each work order issued so a"not to exceed" price is arrived at prior to work order award. This is a process many other cities throughout the Metro Area use for managing their consultants, and it has proven effective in saving staff time by eliminating the drafting, publishing RFPs, reviewing proposals and awarding contracts. In none of the cities that have developed such pools, has this been intended or utilized as a replacement for city staff. It is merely an efficiency improvement and a tool for staff to utilize that makes the operations of Public Works and Engineering Departments better at delivering their services. BUDGETIMPACT None. RECOMMENDATOIN Staff recommends Council authorize staff to seek professional qualifications by issuing an RFQ in order to establish a pre-approved consultant pool. When the Axelrods picked up there photos they dropped off a card and check to show their appreciation for the citizens academy and to thank volunteer coordinator Pentel. The request requires City approval before being recorded with Dakota County. In addition, a wetlands permit is required for construction activities within 100 feet of a wetland/water resource-related area. Background The subject parcel is approximately one acre and contains an existing single-family residential dwelling. In addition, the northwest portion of the subject parcel is traversed by Marie Creek. If the requests are approved, the existing dwelling would be demolished and two new single-family homes constructed. The proposed newly-created parcels are compliant with the applicable lot area/width standards and the proposed construction activities are not anticipated to negatively impact the creek. The Planning Commission conducted a public hearing at the January 26 meeting; there were no public comments. Discussion The City is using its quasi judicial authority when considering action on subdivision and zoning requests and has limited discretion; a determination regarding whether ar not �he request meets the applicable code standards is required. Companies, LLC., on behalf of the property owner, has applied for a lot split and wetlands permit to demolish the existing dwelling and construct two new single-family dwellings at 755 Willow Lane as proposed in Planning Case 2016-02 and described in Exhibit A; and WHEREAS, the Mendota Heights Planning Commission held a public hearing on this matter at their regular meeting on January 26, 2016. NOW THEREFORE BE IT RESOLVED by the Mendota Heights City Council that the lot split and wetlands permit requests as proposed in Planning Case 2016-02 are hereby approved with the following findings of fact: 1. The proposed subdivision meets the purpose and intent of the City Code and is consistent with the Comprehensive Plan. 2. The proposed development meets the purpose and intent of the Wetlands Systems Chapter of the City Code, will not negatively impact the neighborhood's existing drainage system, and no grading or vegetation removal will occur within the required 25-foot non-disturb buffer area. 3. Adequate erosion control measures will be observed during construction. The request requires City approval before being recorded with Dakota County. In addition, a wetlands permit is required for construction activities within 100 feet of a wetland/water resource-related area. BACKGROUND The subject parcel is approximately one acre (43,712 square feet) and contains an existing single-family residential dwelling constructed in 1967. In addition, the northwest portion of the subj ect parcel is traversed by Marie Creek. If the requests are approved, the existing dwelling would be demolished and two new single-family homes would be constructed within the building pads shown on the proposed Grading Plan (sheet 3 of 4). The proposed location and design of the new dwellings will be reviewed as part of the building permit process and must be compliant with all applicable City Code standards. ANALYSIS Comprehensive Plan The subject parcel is guided LR, Low Density Residential in the 2030 Comprehensive Plan. The applicant's request to subdivide the subject parcel into two parcels, consisting of approximately 0.53 and 0.45 acres each, is consistent with the LR maximum density of 29 units per acre. Lot Split Title ll-3-2 of the City Code (Subdivision Ordinance) allows the subdivision of parcels, provided that the resulting lots are compliant with the requiremenis of ihe applicable zoning district. The existing dwelling on the subject parcel has a front yard setback of 38.1 %et. The adjoining principal struciure to the west, located at 1826 Valley Curve Road, has a front yard setback of approximately 25 feet. Currently, there is no adjoining principal structure at 747 Willow Lane, which was recently demolished as part of an approved lot split/wetlands permit request in Apri12015 (Planning Case 2015-07). The proposed dwelling on the new westerly lot has a proposed minimum front yard setback of approxiinately 70 feet. The applicant has initially shown the R-1 District's 30-foot minimum front yard setback for the proposed building pads on the newly-created parcels; actual compliance will be verified upon submission of building permit applications based on the proposed dwellings' design and construction timelines. Based on the applicable minimum setback standards, there appears to be adequate buildable area far two new single- family dwellings on both proposed parcels. First Floor Elevations Title 12-1E-1-A-5 of the Code requires the following: First Floor Elevation: a. Tear down and construction of new single family dwellings and additions, modifications, and alterations to existing dwellings shall not raise the first floor elevation more than one foot (1) above the existing condition. b. In the case of a split level dwelling, the existing first floor elevation is the lowest elevation of an entrance to the dwelling, excluding entrances to the garage and those that do not face the street. c. By conditional use permit, the first floor elevation may be increased by more than one foot (1) from the existing condition in order to meet one or more of the following conditions: (1) Elevate the lowest level of the dwelling to an elevation of two feet (2) above the 100- year flood elevation, as established by the federal emergency management agency (FEMA). (2) Protect the dwelling from groundwater intrusion. Existing groundwater elevation shall be determined by a professional registered engineer in the state of Minnesota or by a certified hydrologist and provided for review and consideration. (3) Meet state building code, city code or other statutory requirements. The existing dwelling has a first floor elevation of 8429 feet. As shown on the attached plan set, the new dwellings are proposed to be compliant with this provision. If the first floor elevation for either new dwelling is raised higher than one-foot above the existing condition, as part of a subsequent building permit application, the applicant would be required to seek the necessary additional approvals prior to construction. Wetlands Permit page 59 According to Title 12-2-1 of the City Code, the purpose of the Wetlands Systems Chapter is to: • Provide for protection, preservation, maintenance, and use wetlands and water resource-related areas; • Maintain the natural drainage system; • Minimize disturbance which may result from alteration by earthwork, loss of vegetation, loss of wildlife and aquatic organisms as a result of the disturbance of ihe natural environment or from excessive sedimentation; • Provide for protection of potable fresh water supplies; and • Ensure safety from floods. As shown in the attached plan set, the 100-foot wetland/water resource-related area encompasses the existing dwelling and substantial portions of the buildable area on both proposed parcels. Therefore, construction activities for new dwellings on Parcels A and B require a wetlands permit. According to the applicant, no vegetation removal will occur within the buffer area. Proposed erosion control measures will be reviewed in greater detail by the Engineering Department as part of the building permit applications. The drainage maps provided by the applicant show that although the amouni of impervious surface will increase (one structure to two structures), the total area draining to the creek will be reduced due to grading activity associated with the proposed development. Impacts to storm water runoff should be minimized by the reduction in drainage area. Upon preliminary review of the proposed development, there does not appear to be any negative impacts to the creek. Based on preliminary review of the proposed Grading Plan by the Engineering Department, the elevations for the proposed driveways in relation to the existing catch basins in the street may cause drainage issues. A complete drainage review will be completed as part of any subsequent building permit review process, which is included as a condition of approval. Stream bank erosion has taken place along Marie Creek in the past. The 25-foot non-disturb buffer area that is now part of the wetlands permit review process helps to protect stream banks from surface runoff caused by impervious surfaces. With the non-disturb area in place, erosion is more likely to be caused by the velocity of water moving within the creek itself than is likely from surface runoff. However, staff is recommending an expanded drainage and utility easement over the entire 25-foot non-disturb buffer area. ALTERNATIVES Recommend approval of the subdivision and wetlands permit requests, based on the attached findings of fact that, with conditions. / '� 2. BACKGROUND Staff has identified several issues concerning the existing subdivision regulations. It appears the bulk of the regulations were adopted in 1981 and subsequent amendinents were made in 2003 and 2009. The proposed amendments include administrative and regulatory modifications for review and comment. ANALYSIS Staffreviewed past subdivision requests, platting guidelines manual, and consulted with the Dakota County Survey Department in order to update certain sections and identify issues that should be addressed. A summary of the proposed amendments contained in DRAFT Ordinance 490 includes the following: Section 1 Currently, lot line adjustments and lot splits may be exempted from complying with "inappropriate requirements" within the subdivision ordinance as long as they do not create any non-conformities. Histarically, the city has processed both requests by requiring a survey instead of a preliminary/final plat. The existing regulations do not include any specific requirements for such requests, which can cause inconsistent interpretation and subjective administration. In order to provide for a more equitable and transparent review process, both requests include a list of required information as part of the survey. The list was generated by reviewing past surveys and existing zoning regulations that must be complied with as part of either request. page 90 Section 2 According to MN Stat. §462.358, subd. 6, cities may grant variances from the subdivision ordinance requirements if they create an undue hardship on the land. The statute also allows cities to explicitly set standards for granting variances. The existing subdivision ordinance includes the undue hardship threshold and three required findings, which are similar to the requireinents for graniing a zoning variance. In some cases, a proposed development could include variance requests from the subdivision and (i.e. right- of-way or street width) and zoning (i.e. lot width, lot size) ordinances. In order to avoid analyzing the requests under two different standards of review, the proposed amendment simply references the zoning ordinance variance process and requirements. Section 3 The Fee Schedule, as adopted by resolution by the Ciry Council, contains application and escrow fees pertaining io subdivision applicaiions. The proposed amendment references similar language in the zoning ordinance regarding base fees and escrows. Section 4 The proposed amendment includes the following administrative revisions: • Eliminates the number of required copies, which is included on the application form. • References the application form and submittal schedule. • Eliminates the need to supply an abstractor's certificate identifying the property owners within 350 feei of the property in-question, which is already provided by staff as part of the public hearing notice process. • Specifies that notices are to be mailed to property owners within 350 feet of the property in- question, which is consistent with other planning applications. • Includes specific circumstances where plats are to be reviewed by the Parks Commission, Dakota County, or State of Minnesota. Section 5 State statutes do not regulate a time limit between preliminary and final plat approval. However an approved preliminary plat is only provided protection for one year from code or comprehensive plan amendments that may affect the original approval if a final plat has not yet been approved. As a result, the proposed amendment includes a one-year time limit between preliminary and final plat approval. If not approved within the time limit or granted an extension by the City Council, a new application would be required and is subject to any new applicable regulations. Section 6 The proposed amendment includes revisions to the required information on a preliminary plat, including: Slopes over 33% must be shown. Clarification that only the type and size of tree coverage are required, since some of the existing requirements are onerous based on the level of review required for the existing regulations. Sections 7 and 8 Staff worked closely with the Dakota County Survey Departlnent to identify inconsistencies and outdated requirements for final plats. The proposed amendments are now consistent with what the County requires, based on the platting guidelines manual followed by licensed surveyors. page 91 Section 9 The proposed amendment clarifies the current practice of requiring 10-foot drainage and utility easements along the front and rear property boundary lines. It also allows the City Engineer to require any additional easements. Section 10 Proposed disturbance of slopes greater than 25% as part of recent lot split requests has raised issues with the existing standards that should be addressed. It is assumed that the existing standard is meant to protect natural slopes, as there are certainly an amenity warth preserving and protecting. Therefore, rather than continuing to process variance requests based on an outdated standard, the proposed amendment includes: Exemption for previously-disturbed slopes as part of a lot split request. Increase the slope disturbance threshold to 33%, which is consistent with current engineering standards. Section 11 The proposed amendment removes the stormwater management provisions from the subdivision ordinance in order to recognize that they apply to all applicable developments in the city. ALTERNATIVES Following the public hearing and further discussion, the Planning Coinmission may consider the following actions: 1. Table the request, pending additional information and revisions from staff. STAFF RECOMMENDATION Staff recommends the Planning Commission discuss the proposed code amendments. If acceptable to the Commission, action can be taken at this month's meeting. In order to do this, City Code will have to be amended to increase the size of the ARC from its current 7, to 8 members. Background Councilor Liz Petschel currently serves as the Co-Chair of the Metropolitan Airports Commission's Noise Oversight Commission (NOC). She has been working on Mendota Heights airport noise issues for more 17 years, and is in her 7Th year on the NOC. She has recently informed the MAC and NOC that she will be resigning as NOC co-chair effective in March, 2016, and therefore stepping down from her leadership role there. She will remain on the NOC as the "regular" member representing Mendota Heights. Regular members must be an elected official. Councilor Petschel recommends that someone who is experienced in public boards, legislative processes and relations, and in airport issues be appointed to represent the City on the NOC as an alternate. Alternates do not have to be elected officials, but should be on the City's ARC. The regular member would attend periodically, bui it is likely that the alternate would be the active member attending NOC meetings. The City could have two "alternate members on the NOC--the other could continue to be current alternate David Sloan. Mr. Sloan currently chairs the ARC. Councilor Petschel recommends former City Councilor Jill Smith be appointed as the City's new alternate representative. Ms. Smith has extensive knowledge of the warkings of the NOC, MAC, and the State legislative process. page 96 Discussion In order for a position to be added to the current ARC, the existing number of ARC Commissioners would have to be increased from 7, to 8. It is unlikely that having an even number of commissioners would create any issues. The ARC is advisory to the Ciry Council, and the likelihood of a tie vote is rare. If there is a desire to return to seven members, that could be done through attrition in the future. Budget Impact None. Recommendation Staff recommends that the Mendota Heights City Council do the following: 1. Approve an amendment to Section 2-4-2 of the Mendota Heights City Code, increasing the number of representatives on the ARC from 7, to 8. 2. Adopt a Resolution appointing Ms. Jill Smith to membership on the ARC. 3. Appoint Ms. Smith to be an alternate to the NOC, representing the City of Mendota Heights.
